In his essay ‘Critique of Violence’, Walter Benjamin subjects violence to a critique in order to establish the criterion for violence itself as a principle. His starting point is the distinction between law-positing and law-preserving violence. However, these are for him inseparable and subjected to the law of historical change: the history of the law is nothing but the dialectical rising and falling of legal orders. Benjamin’s analysis of legal violence and his criticism of parliamentary democracies, this article advances, should (...) be related to the critical analysis of the possibilities for alternative politics in contemporary democratic rule of law states, as those advanced by Bernard Noël, Philippe Lacoue-Labarthe, Jean-Luc Nancy and Jacques Rancière. For Benjamin, it is only law-destroying divine violence, whose principle is justice, not power, that is able to break this circle and open up a new era. Divine violence is, however, not only a provocative but also an extremely problematic, even dangerous, concept, as Jacques Derrida, among others, has claimed. This article considers, therefore, whether the concept of divine violence has any real political relevance in the contemporary era. (shrink)

Ṣadr al-Sharīʿa al-Thānī al-Maḥbūbī (d. 747/1346) was the last major Māturīdī theologian of Transoxania. As he left no work of rational theology (kalām) proper, one of the chief sources of his theological thought is his book on legal theory, al-Tawḍīḥ fī ḥall ghawāmiḍ al-Tanqīḥ. Because the work served as a prominent reference for both legal theory and rational theol­ogy, an extensive commentary tradition on it emerged as it was transmitted from Transoxania to South Asia, Anatolia, and the Arab world. A (...) distinctive subfield of this commentary tradition consisted of glosses devoted exclusively to one specific section of al-Tawḍīḥ. Revolving around the nature of good and evil, and intimately linked to the question of human free will, this part of Ṣadr al-Sharīʿa’s text came to be treated as a separate work, commonly referred to as al-Muqaddimāt al-arbaʿ (“The four pro­legomena”). Due to its role as a highly sophisticated refutation of late Ashʿarī doctrine on human volition, al-Muqaddimāt al-arbaʿ eventually developed into a prime source for later Māturīdī scholars in their discussion of human volition and related topics. Mais le concile est présidé par l'empereur, et une ère nouvelle commence pour les chrétiens au sein de l'Empire. Ils sont si bien traités par le prince, ces évêques conciliaires, qu'ils (...) " se demandent s'ils ne sont pas déjà dans le Royaume de Dieu ". Il semble loin le temps de l'épître à Diognète (vers 195) qui parlait des chrétiens en ces termes : " toute terre étrangère leur est une patrie, toute patrie une terre étrangère. " avec Constantin s'inaugure ce qu'on appellera plus tard l'alliance du trône et de l'autel. Ce deuxième tome est celui d'un tournant décisif pour la suite de l'histoire. Mais l'historien qu'est Michel Clévenot se garde bien d'illustrer une thèse, fût-elle éclairante. Il donne au contraire à voir et à entendre la diversité des situations aux quatre coins de l'Empire et au sein des classes sociales si peu homogènes : le lecteur fait connaissance avec le " directeur de conscience " de la bourgeoisie d'Alexandrie, mais il visite aussi les petits agriculteurs d'Italie, d'Afrique du Nord ou des bords du Nil. Les querelles commerciales, les tensions économiques, les controverses théologiques, les affrontements politiques et guerriers, rien de tout cela n'est négligeable pour celui qui entend " l'appel de Jésus à ne pas déserter l'Histoire ". Héritier de l'humanisme de la Renaissance et précurseur du siècle des Lumières, Pierre Bayle est un des penseurs les plus originaux de l'âge classique. Protestant exilé aux Pays-Bas, il est devenu un apôtre de la liberté de conscience, et son activité de philosophe, de journaliste et de savant ainsi que sa vaste correspondance lui ont donné un rôle-clé dans l'évolution de la culture européenne. Conjuguant les approches historique, littéraire et philosophique, les auteurs de ce volume réexaminent la vie et le (...) discours de Bayle, les thèmes de son oeuvre et les modalités de leur diffusion. En mettant l'accent sur les informations fournies par la correspondance et sur le rôle de Bayle dans les débats éthiques et métaphysiques de l'époque, ils étudient: l'activité épistolaire, élément historique déterminant mais aussi métaphore d'un penseur toujours en mouvement; la réflexion philosophique et politique sur la tolérance, la liberté, la justice, la vertu - enjeux actuels, notamment dans le domaine de la laïcité; les tensions irréductibles présentes dans le discours baylien sur la raison et la foi, qui refuse toute simplification. Une riche bibliographie qui répertorie plus de 950 titres parus entre 1900 et 2010 complète ce volume, et donne un aperçu de ces champs de recherche en pleine évolution. L'idéalisme allemand est une philosophie enracinée dans la problématique religieuse. C'est Kant qui en inaugure la réflexion avec l'exposé de " la religion dans les limites de la raison ". Fichte fléchit le discours en repensant sa Doctrine de la Science à partir de l'Évangile de Saint-Jean. Mais c'est avec Hegel et Schelling que l'idéalisme postkantien se donne la tâche de ressourcer la dogmatique chrétienne à partir d'une ontothéologie spéculative. Hegel laisse d'admirables Leçons sur la philosophie de la religion, Schelling (...) construira sa Philosophie Positive à partir des " données " de la mythologie et de la révélation. Ce recueil, issu des travaux d'un colloque au Centre de Recherches sur Hegel et l'Idéalisme allemand de l'Université de Poitiers, rassemble des textes d'auteurs belges, français, allemands, italiens, libanais, luxembourgeois et américains. Ils traitent aussi bien des grands idéalistes que de leurs prédécesseurs essentiels. P. Valenza étudie Jacobi et Reinhold, J. Lambinet parcourt la voie qui va de Paracelse et de Boehme à Schelling. V. Waibel compare Hôlderlin et le jeune Hegel. Une seule contribution est consacrée à Fichte : celle de V. Kokoszka sur la Wissenschafislehre tardive. Deux études portent sur Kant. R. John Locke’s role in the advent of modernity has been debated widely. His work has been (ab)used by those arguing from libertarian, democratic, communitarian, socialist, feminist, or postcolonial points of view, either portraying him as a forefather of their preferred political theory or as an antagonist to their avowed political and philosophical goals. In this paper, we are primarily concerned with highlighting the importance of the executive’s prerogative in Locke’s philosophy, as we argue that this concept, often banished to the (...) side-lines, is indeed central to Locke’s political theory. This partial neglect entails that some of the most popular readings of Locke are potentially based on faulty premises. We focus on how Locke’s prerogative is antithetical to the project of seeing Locke as a forefather of libertarianism. Furthermore, this paper’s arguments could also support challenges to interpretations of Locke as an early and important proponent of democracy. Rather than seeking to find support for modern theories through anachronistic and dubious readings of Locke, we focus on how he conceived of an exceedingly strong executive whose actions are exclusively restricted by the public good. We conclude that there is good reason to consider his philosophy proto-utilitarian, something that further highlights the conflict with libertarianism. As such, we conclude that libertarian or democratic theories postulating Locke as their direct predecessor should be re-examined to account for these findings. (shrink)

In the summer of 2016, the University of Dallas and the Instituto Tecnológico Autónomo de México organized a conference to discuss the topic of the middle class and its continued decline—recognizing that, despite some historical, political and cultural differences, healthy democracies throughout the hemisphere depend upon a strong and prosperous middle class. This volume brings together contributions by nine scholars from both institutions. The chapters reflect diverse disciplinary perspectives that are historical, political, economic, anthropological, and philosophical. Despite this diversity, the (...) volume possesses a conceptual unity that stems from its foundation in Aristotle’s approach to the middle class. On this basis, the topic is given a rigorous study that is both theoretical and data-driven. The chapters include treatments of Aristotle, Montesquieu, Adam Smith and Sir James Steuart, Catholic social teaching, the problem of inequality in the US, the definition and measurement of the middle class in Mexico, as well as its values and political attitudes, the rise of middle-class politics in early-twentieth-century Latin America, and a comparative analysis of healthcare for the middle class in North America. Lack of guidance and regulation for authorizing medical cannabis for conditions involving the health and neurodevelopment of children is ethically problematic as it promulgates access inequities, risk-benefit inconsistencies, and inadequate consent mechanisms. In two virtual sessions using participatory action research and consensus-building methods, we obtained perspectives of stakeholders on ethics and medical cannabis for children and youth. The sessions focused on the scientific and regulatory landscape of medical cannabis, surrogate decision-making and assent, and the social and political culture of medical (...) cannabis. We found that evidence-gathering and data dissemination, pressures on clinical relationships, and the lack of integration of culturally diverse perspectives and Indigenous knowledges were key areas of concern. Participants emphasized the importance of utilizing adaptive study designs, highlighted the importance of trust-building between clinicians, patients and caregivers, and discussed barriers including historical and ongoing stigmatization of medical cannabis. We conclude that continued public consultation and strength-based research that integrate diverse perspectives are critical steps forward. (shrink)

The Declaration of Helsinki and the Council of the International Organization of Medical Sciences provide guidance on standards of care and prevention in clinical trials. In the current and increasingly challenging research environment, the ethical status of a trial design depends not only on protection of participants, but also on social value, feasibility, and scientific validity. Using the example of a study assessing efficacy of a vaccine to prevent human papilloma virus in HIV-1 infected adolescent girls in low resource countries (...) without access to the vaccine, we compare several trial designs which rank lower on some criteria and higher on others, giving rise to difficult trade-offs. This case demonstrates the need for developing more nuanced guidance documents to help researchers balance these often conflicting criteria. (shrink)

The Anthropocene has become an umbrella term for the disastrous transgression of ecological safety boundaries by human societies. The impact of this new reality is yet to be fully registered by political theorists. In an attempt to recalibrate the categories of political thought, this article brings Hannah Arendt’s framework of The Human Condition into the gravitational pull of the Anthropocene and current knowledge about the Earth System. It elaborates the historical emergence of our capacity to “act in the mode of (...) laboring” during fossil-fueled capitalist modernity, a form of agency relating to our collectively organized laboring processes reminiscent of the capacity of modern sciences to “act into nature” discussed by Arendt. I argue that once read from an energy/ecology-centric perspective, The Human Condition can help us make sense of the Anthropocene predicament, and rethink the modes of collectively organizing the activities of labor, work, and action. The Vatican recently published directives regarding “beginning of life” issues that explain the Catholic Church's position regarding new technologies in this area. We think that it is important to develop a response that presents the traditional Orthodox Jewish position on these same issues in order to present an alternative, parallel system. There are many points of commonality between the Vatican document and traditional Jewish thought as well as several important issues where there is a divergence of opinion. The latter include (...) the status of the zygote as produced during in vitro fertilization, the acceptable of procreation in a method other than through the conjugal act, and the permissibility of deriving benefit from the products of an illicit act. Arendt’s concept of experience can contribute in important ways to the contemporary debates in political and feminist theory. However, while the notion is ubiquitous in Arendt’s thinking we lack an understanding of experience as a concept, as opposed to the impact of Arendt’s personal experiences on her thought. Drawing from her notes for “Political Experiences in the Twentieth Century,” the article seeks to enrich our understanding of the Janus-faced character of political experience. It emphasizes the importance of vicariousness, and argues (...) that experience should be understood as a process of suffering, enduring, and re-experiencing events beyond our conscious control. The article further posits that experience appear only when events, through metaphors, are allowed to leave their mark on our way of using language. It is argued that this concept poses an important challenge to the different ways experience is approached in contemporary political and feminist theory. (shrink)

For Hannah Arendt, some of the most distinctive features of the modern age derived from the adoption of a process-imaginary in science, history, and administration. This article examines Arendt’s work, identifying what it calls the ‘process-frame’ in her criticism of imperialism, economy, and the biologization of politics. It discusses an interpretation in which ‘natality’ presents a completely alternative mode of temporality, a resistance to the process-frame. This interpretation, it is argued, needs to be specified by taking into account that political (...) action both interrupts and starts processes of its own. To confine and overcome the negative effects of process-framing, it is important to emphasize action as a world-building activity – something capable of establishing a relatively stable area of the common world by initiating processes of its own. Second, it is also important to cultivate ways of thinking and perceiving particular acts as meaningfully independent of all-embracing processes. (shrink)

The article addresses the role of the essay in Hannah Arendt’s theorizing. By paying attention to Arendt’s style, we are better able to draw the full conclusions from the well-known fact that she was not a system-builder but took her bearings from concrete experiences. First, the concept of experience—too often taken at face value—is explicated. It is argued that Arendt’s understanding of the concept cannot be reduced to her personal experiences, but must be read against the background of the common (...) world. A crucial dimension in the incorporation of experiences into the Arendtian political theory is the essayistic style of her writings. The essay, as an experimental and tentative platform, provides an indispensable angle to Arendt’s work—even though often overshadowed by “classical” or “narrative” readings. This will be demonstrated in relation to the puzzlement surrounding the controversial concept of “the social.”. (shrink)

We argue that moral decision making is reasons-based, focusing on the idea that people encounter decisions as questions to be answered and that they process reasons to the extent that they can see them as putative answers to those questions. After introducing our topic, we sketch the erotetic reasons-based framework for decision making. We then describe three experiments that extend this framework to moral decision making in different question frames, cast doubt on theories of moral decision making that discount reasons (...) and appeal, and replicate our initial finds in moral contexts that do not involve direct physical harm. We conclude by reinterpreting Stanley Milgram’s studies in destructive obedience in our new framework. (shrink)

In his anthropology (that reflects on the basic structure of human beings) a similar way of relating to the world is discussed: the “primitive mentality” that is characterized by the “need to participate” (besoin de participation). Both phenomenology (...) and mentalité primitive imply a critique of modern scholarship. This fundamental criticism of the prevailing (historical) approach in the humanities including religious studies explains the growing distance between van der Leeuw and the majority of scholars of religion in the decades after his death in 1950. Ainsi à travers le masochisme de la Vénus à la fourrure, la peinture du Lorrain, l'espace public démocratique du contrat social, et l'étrange athéisme de Sade, on peut voir la force de révélation que détiennent les concepts (...) deleuziens d'espace lisse et de lignes de fuite. Mais en même temps qu'on verra jouer concrètement ces concepts, leur parenté très grande avec ceux de Lacan apparaîtra clairement. Le travail d'analyse, la clinique, quand il est concret et précis, dissout les gros concepts et, au-delà des oppositions d'opinion massives, ouvre et trace des lignes de sens et des perspectives de lecture radicalement nouvelles, où les vieux antagonismes deviennent désuets.
