Tout au long de l’histoire de la Chine, les confucéens se sont opposés au contrôle rigoureux du gouvernement légiste et ont mis en garde contre les effets négatifs de l’intervention de l’État dans l’économie. Cela ne s’est toutefois pas traduit par l’approbation d’un régime de droits de propriété privée sans entraves. Du point de vue confucéen, l’État a l’obligation de garantir les conditions du bien-être matériel de base de la population et celle-ci est prioritaire sur la promotion du marché libre, (...) ce qui devrait inspirer un régime justifiable de droits de propriété. Historiquement, les confucéens ont plaidé pour l’abolition des monopoles d’État sur le sel et sur le fer sous la dynastie Han, tandis que le système du « champ de captage » chez Mencius a permis à l’État d’attribuer des terres sur des fondements égalitaires. Ces exemples montrent que l’objectif principal des penseurs confucéens n’est ni un contrôle absolu de l’État sur l’économie, ni une forme de marché libre, mais plutôt un mixte pour le bien-être de la population. De nos jours, une attention particulière est accordée aux valeurs confucéennes dans les régimes de droits de propriété en Asie de l’Est et elle semble inciter les États à redistribuer les ressources de façon égalitaire, par exemple sous la forme d’une portion importante de logements sociaux, à Singapour et à Hong Kong ou, dans le secteur agricole en Chine, de la renaissance moderne du système du « champ de captage » de Mencius sous Deng Xiaoping. Dans ces exemples, l’accès de la population à la terre et au logement sont les garanties de son bien-être matériel basique : c’est ce qui a été privilégié sur un marché immobilier libre (voire libertarien). Une valeur centrale pour la garantie du bien-être matériel de base était le fait Mencius et Confucius, qui considèrent la survie du peuple comme condition préalable nécessaire au bon fonctionnement de tout ordre étatique. Alors que l’idée selon laquelle le confucianisme s’oppose en fait aux droits de propriété privée est largement répandue, cet essai suggère que le confucianisme propose plutôt sa propre théorie de la propriété. Au lieu de contester les droits de propriété en tant que tels, il remet en question les conceptualisations européennes et américaines de ces droits. Fondamentalement, la théorie confucéenne de la propriété considère que les droits de propriété sont « particularistes » et relatifs à d’autres considérations sociales. Par conséquent, ces droits peuvent primer sur les droits individuels, si besoin est. Cette notion confucéenne de la propriété peut non seulement être considérée comme une alternative à la conception libérale occidentale de la propriété, mais elle peut également offrir un point de départ viable pour examiner une multitude de notions de droit façonnées dans un contexte international. S’éloigner d’une notion centrée sur l’Occident et prendre en compte d’autres théories, comme le confucianisme, peut s’avérer crucial non seulement pour l’État chinois dans l’élaboration de ses lois et de ses règlements, mais aussi pour la communauté internationale lors de la rédaction d’accords véritablement internationaux. Cet essai montre comment les droits de propriété de type confucéen ont influencé le fonctionnement des pays d’Asie de l’Est d’héritage confucéen et continuent de le faire. Classification JEL : P14. Cet article porte sur la première phase de formation d’une philosophie économique proprio sensu en Chine, dans les années 1910-1930. Parmi les économistes chinois, ceux ayant reçu une éducation à l’économie occidentale appliquèrent leur savoir tout neuf de l’économie moderne à réinterpréter la pensée chinoise traditionnelle. Ils proposèrent un cadre analytique neuf pour systématiser les idées de la Chine ancienne et concentrèrent leur attention sur les enseignements des sages Laozi, Confucius, Mencius, Mozi, et Guanzi. La comparaison interculturelle plaça des (...) concepts chinois dans un contexte de pensée sociale et économique occidentale. Ensuite, on tira de nombreuses mentions et citations de nature « économique » des sages de l’Antiquité chinoise, pour les insérer dans la littérature universitaire en tant que tels, avec de facto un impact durable sur la recherche ultérieure. Cette entreprise intellectuelle préparait une histoire de la pensée économique chinoise comme discipline universitaire. Une lecture moderne des idées économiques de la Chine ancienne se liait à des questions de développement national. Les économistes de la période républicaine analysaient l’éthique traditionnelle des normes, les relations entre justice et profit, le contrôle des besoins et des désirs humains, les comportements de consommation, dans l’objectif de trouver les obstacles cachés retenant la Chine sur la voie du développement moderne. Ils soulignèrent les réussites de la pensée confucéenne, qui avaient contribué à jeter les bases de succès à venir. Les arguments critiques furent présentés en reconnaissant l’influence de l’éthique confucéenne sur la vie économique du peuple chinois. Le présent article se fonde sur l’étude des écrits d’économistes chinois de la période républicaine : Chen Huanzhang, Yuan Xianneng and Li Zhaoyi sont examinés pour leur exploration de l’héritage philosophique traditionnel, après avoir fait leurs études en Occident. Quant à Li Quanshi et Tang Qingzeng, ils publièrent leurs ouvrages sur l’histoire de la pensée économique chinoise en chinois. Une étude exhaustive de ces sources permet de reconstituer la démarche intellectuelle qui interpréta les idées économiques de l’ancienne Chine. As practiced in most Western universities, the study of political theory generally involves a rehearsal of the canon of Western political thought from Plato to Marx. Only rarely are practitioners of political thought willing (and professionally encouraged) to transgress the canon and thereby the cultural boundaries of North America and Europe in the direction of genuine comparative investigation. Bourdieu’s thought is disturbing. Provocative. Scandalous even, at least for those who do not easily tolerate the unmitigated truth about the social. Nonetheless his ideas, among the most important and innovative of our time, are here to stay. This thought has taken form in the course of a career and through works on diverse subjects that have constructed a far-reaching analytical model of social life, which the author calls more readily an anthropology rather than a sociology. In their totality, they (...) constitute today an original and powerful proposal to explain human practices. In the face of criticisms commonly leveled at Bourdieu’s thought (notably the charge that it reduces everything to a single schematic model), it is important to identify the spirit of his enterprise. Early on, it is true, his thought drew on a few fundamental concepts—the trilogy habitus, field (champ), practice (pratique)—to which it constantly returned, and followed a clearly defined trajectory. At the same time, however, he continually reformulated, adapted, and refined his analytical model, depending on the operations to which he subjected new objects of inquiry. The regenerative and transformative force of his thought was supported by two convictions. First, that there being nothing more vain than theory for theory’s sake, it is preferable that theoretical production originate in the study of concrete and occasionally very specific cases. Second, that in order to escape stereotypical classifications, boundaries separating disciplines are best transgressed, thereby favoring new constructions of the object of inquiry. (shrink)

What is a game? What are we doing when we play a game? What is the value of playing games? Several different philosophical subdisciplines have attempted to answer these questions using very distinctive frameworks. Some have approached games as something like a text, deploying theoretical frameworks from the study of narrative, fiction, and rhetoric to interrogate games for their representational content. Others have approached games as artworks and asked questions about the authorship of games, about the ontology of the work (...) and its performance. Yet others, from the philosophy of sport, have focused on normative issues of fairness, rule application, and competition. The primary purpose of this article is to provide an overview of several different philosophical approaches to games and, hopefully, demonstrate the relevance and value of the different approaches to each other. Early academic attempts to cope with games tried to treat games as a subtype of narrative and to interpret games exactly as one might interpret a static, linear narrative. A faction of game studies, self-described as “ludologists,” argued that games were a substantially novel form and could not be treated with traditional tools for narrative analysis. In traditional narrative, an audience is told and interprets the story, where in a game, the player enacts and creates the story. Since that early debate, theorists have attempted to offer more nuanced accounts of how games might achieve similar ends to more traditional texts. For example, games might be seen as a novel type of fiction, which uses interactive techniques to achieve immersion in a fictional world. Alternately, games might be seen as a new way to represent causal systems, and so a new way to criticize social and political entities. Work from contemporary analytic philosophy of art has, on the other hand, asked questions whether games could be artworks and, if so, what kind. Much of this debate has concerned the precise nature of the artwork, and the relationship between the artist and the audience. Some have claimed that the audience is a cocreator of the artwork, and so games are a uniquely unfinished and cooperative art form. Others have claimed that, instead, the audience does not help create the artwork; rather, interacting with the artwork is how an audience member appreciates the artist's finished production. Other streams of work have focused less on the game as a text or work, and more on game play as a kind of activity. One common view is that game play occurs in a “magic circle.” Inside the magic circle, players take on new roles, follow different rules, and actions have different meanings. Actions inside the magic circle do not have their usual consequences for the rest of life. Enemies of the magic circle view have claimed that the view ignores the deep integration of game life from ordinary life and point to gambling, gold farming, and the status effects of sports. Philosophers of sport, on the other hand, have approached games with an entirely different framework. This has lead into investigations about the normative nature of games—what guides the applications of rules and how those rules might be applied, interpreted, or even changed. It is well known in contemporary Madhyamaka studies that the seventh century Indian philosopher Candrakīrti rejects the foundationalist Abhidharma epistemology. The question that is still open to debate is: Does Candrakīrti offer any alternative Madhyamaka epistemology? One possible way of addressing this question is to find out what Candrakīrti says about the nature of buddha’s epistemic processes. We know that Candrakīrti has made some puzzling remarks on that score. On the one hand, he claims buddha is the pramāṇabhūta-puruṣa (person of (...) epistemic and moral authority), sarvākārajñatājñānaṃ (omniscient, wise), pratyakṣalakṣaṇam (exclusively perceptual in characteristic) [Candrakīrti (MABh VI.214)], and claims that there are clearly four pramāṇas—epistemic warrants—direct perception (pratyakṣa), inference (anumāna), testimony (āgama) and analogy (upamāna) [Candrakīrti (Pp I.3), cf. MacDonald 2015, pp. 287–288]. On the other hand, somewhat paradoxically, Candrakīrti claims that buddhahood is an embodiment of a complete cessation of “mind and mental processes” [Candrakīrti (MABh XI.1, 155a; MAB XI.17d)] Now how are we to make sense of these two seemingly contradictory statements? Do these statements reflect any deeper conflicts within Candrakīrti’s system or is there a coherent way to interpret these statements? The Tibetan Prāsaṅgika interpreters of Candrakīrti’s Madhyamaka largely agree that there is no internal contradiction in Candrakīrti’s system, and agree there is a way to make coherent sense of these statements. Nevertheless, the Tibetans exegetes bring to the table two radically conflicting proposals to approach Candrakīrti’s Mādhyamaka; both claiming to successfully address the apparent tension arising from Candrakīrti’s statements. One proposal is made by Tsongkhapa Losang Dakpa (Tsong kha pa bLo bzang grags pa, 1357–1419), who maintains the tension can be plausibly resolved by demonstrating that Candrakīrti’s unique non-foundationalist epistemological program renders him an epistemological coherentist. In contrast Taktsang Lotsawa Sherap Rinchen (sTag tshang Lo tsā ba Shes rab rin chen, 1405–1477) argues that according to Candrakīrti buddha is a global agnostic, on the ground of the nonexistence of mind and mental processes for those who have attained fully awakening. Taktsang instead proposes the no-mind thesis as a more plausible way to resolve the tension in Candrakīrti’s philosophy, categorically refusing to attribute to buddha any cognitive processes and epistemic warrants. This paper is an analysis of Taktsang’s no-mind thesis—the claim that buddhas utterly lack any knowledge of the world because they do not have epistemic processes and warrants to perceive the world—in what follows a rational reconstruction of his arguments is developed in order to evaluate his thesis. We shall then assess the implications of accepting Taktsang’s no-mind thesis. (shrink)

In this paper, we first briefly survey the main responses to the challenge that experimental philosophy poses to the method of cases, given the common assumption that the latter is crucially based on intuitive judgments about cases. Second, we discuss two of the most popular responses in more detail: the expertise defense and the mischaracterization objection. Our take on the expertise defense is that the available empirical data do not support the claim that professional philosophers enjoy relevant expertise in their (...) intuitive judgments about cases. In contrast, the mischaracterization objection seems considerably more promising than its largely negative reception has suggested. We argue that the burden of proof is thus on philosophers who still hold that the method of cases crucially relies on intuitive judgments about cases. Finally, we discuss whether conceptual engineering provides an alternative to the method of cases in light of the challenge from experimental philosophy. We argue that this is not clearly the case, because conceptual engineering also requires descriptive information about the concepts it aims to improve. However, its primarily normative perspective on our concepts makes it largely orthogonal to the challenge from experimental philosophy, and it can also benefit from the empirical methods of the latter. Bernard Williams argues that philosophy is in some deep way akin to history. This article is a novel exploration and defense of the Williams thesis —though in a way anathema to Williams himself. The key idea is to apply a central moral from what is sometimes called the analytic philosophy of history of the 1960s to the philosophy of philosophy of today, namely, the separation of explanation and laws. I suggest that an account of causal explanation offered by David Lewis (...) may be modified to bring out the way in which this moral applies to philosophy, and so to defend the Williams thesis. I discuss in detail the consequences of the thesis for the issue of philosophical progress and note also several further implications: for the larger context of contemporary metaphilosophy, for the relation of philosophy to other subjects, and for explaining, or explaining away, the belief that success in philosophy requires a field-specific ability or brilliance.
