Toulmin is one of the three or four best-known philosophers of science who, beginning in the late 1950’s, attempted a thoroughgoing criticism of logical positivism (the philosophy of science which predominated at that time). The paper argues that Toulmin depends upon the same sort oftheory-observation dichotomy which resulted in many of the difficulties which bedeviled logical positivism. Thus Toulmin’s criticism is neither as radical nor as trouble-free as many suppose.

In his new book, Fred Schauer adopts a prototypical approach to the law in order to reestablish the importance of “The Force of Law”, and I strongly support his claim that there are interesting things to be said about the relationship between law and force. One aspect concerns the special kind of force to which the law is related. In the tradition of political philosophy, this kind of force has often been characterized with the state's monopoly on legitimate force. Whereas (...) the essay will support the idea that the law has a monopoly of force, it will challenge the idea that it is its legitimacy that makes it characteristic. It is a monopoly not so much on legitimate, but on ultimate force. The robustness of the force the law is—prototypically—related to, however, should not obscure the fact that the relation between law and force is quite delicate and precarious. This paper assesses the role of the Refutation of Idealism within the Critique of Pure Reason, as well as its relation to the treatment of idealism in the First Edition and to transcendental idealism more generally. It is argued that the Refutation is consistent with the Fourth Paralogism and that it can be considered as an extension of the Transcendental Deduction. While the Deduction, considered on its own, constitutes a 'regressive argument', the Refutation allows us to turn the Transcendental Analytic (...) into a 'progressive argument' that proceeds by the synthetic method. This paper develops co-ordinated multiple-domain supervenience relations to model determination and dependence relations between complex entities and their constituents by appealing to R-related pairs and by making use of associated isomorphisms. Supervenience relations are devised for order-sensitive and repetition-sensitive mereologies, for mereological systems that make room for many-many composition relations, as well as for hierarchical mereologies that incorporate compositional and hylomorphic structure. Finally, mappings are provided for theories that consider wholes to be prior to their parts.

This paper distinguishes bruteness from fundamentality by developing a theory of stochastic grounding that makes room for non-fundamental bruteness. Stochastic grounding relations, which only underwrite incomplete explanations, arise when the fundamental level underdetermines derivative levels. The framework is applied to fission cases, showing how one can break symmetries and mitigate bruteness whilst avoiding arbitrariness and hypersensitivity.

This paper establishes that the occasional identity relation and the contingent identity relation are both non-transitive and as such are not properly classified as identity relations. This is achieved by appealing to cases where multiple fissions and fusions occur simultaneously. These cases show that the contingent and occasional identity relations do not even satisfy the time-indexed and world-indexed versions of the transitivity requirement and hence are non-transitive relations.

One hundred and fifty years ago, a hopeful young researcher reported a recent discovery he had made. Working in the bowels of a medieval castle in the German city of Tübingen, he had isolated a then entirely new type of molecule. This was the birth of a field that would fundamentally change the course of biology, medicine, and beyond. His discovery: DNA. His name: Friedrich Miescher. In this article, the authors try to find answers to the question why—despite the fact (...) that virtually everyone nowadays knows DNA—hardly anyone remembers the man who discovered it. In the history of science, the discovery of DNA was a seminal moment. Why then did it not enter into public memory? Ground‐breaking discoveries can occur in a historical context that is not ready to appreciate them. But that's not all that decides who is remembered and who is forgotten. Scientific pioneers sometimes fail to publicize their findings in a way that ensures that they receive the attention they merit. As discussed here, their personalities and habits may cause discoveries to be “overwritten” by more recent researchers, resulting in distorted cultural memories no longer reflecting the initial event. The developement of intensive care and transplantation medicine gave rise to ethical problems of the proper treatment of dying patients: How long should they be upheld and from which point on could their organs be removed? Brain oriented concepts of death promised to ease these problems, but on closer look turn out to be untenable. Hence, an alternative attitude towards death and the morally proper treatment of the dying is urgently needed. In former times, before intensive care was developed, death (...) always had comprised various different changes, usually losses, which do not necessarily or conceptually belong to death, but which none the less were responsible for the moral weight we still attach to death. Modern medicine cut the joints between these losses, and hence dissolved the traditional, morally weighty concept of death. This leaves medical ethics with the task to inquire, one by one, into the ethical consequences of these different losses. Die Entwicklung der Intensiv- und Transplantationsmedizin hat eine Reihe neuartiger medizinethischer Probleme entstehen lassen: die Fragen, bis wann man einen Menschen mit allen Mitteln am Leben erhalten und ab wann man ihm lebensnotwendige Organe entnehmen darf. Die Identifikation des menschlichen Todes mit dem Hirntod bot eine attraktive Auflösung dieser Schwierigkeiten, ist aber in den letzten Jahren zunehmend in die Kritik geraten, weil die begrifflich/weltanschaulichen Argumente, die für diese Gleichsetzung angeführt werden, einer Überprüfung nicht standhalten. Es gilt anzuerkennen, daß die medizinische Entwicklung nicht etwa eine Neudefinition des Todes erforderlich, sondern jede derartige Definition müßig gemacht hat, weil die Auffächerung der Sterbeprozesse in der Intensivmedizin die herkömmliche Annahme, daß mit dem Tod ein plötzlicher Umschwung im moralischen Status eines Menschen verbunden ist, ihrer Legitimation beraubt. An ihre Stelle tritt die Anerkennung einer ganzen Reihe verschiedener moralisch folgenreicher Veränderungen , die ein Mensch im Laufe seines Sterbens durchmacht. Es ist die Aufgabe der medizinischen Ethik, die Auswirkungen dieser Veränderungen auf die Patienten-Arzt-Beziehung zu erforschen. (shrink)

Die Würde des Menschen ist unantastbar. – Trotz ihrer prominenten Rolle im Grundgesetz und in vielen anderen Dokumenten nach dem Zweiten Weltkrieg hat sich die moderne Philosophie lange Zeit nur wenig um die Menschenwürde gekümmert. Erst als um die Jahrtausendwende herum die Würde von Embryonen zur Diskussion stand, zeigte es sich, wie spannend und schwierig es ist, ein angemessenes philosophisches Verständnis der Menschenwürde zu finden. Dieses Buch basiert auf drei Grundgedanken: dass die Menschenwürde aus ihren Verletzungen heraus verstanden werden muss, (...) dass wir sie in ihrem historischen Kontext betrachten sollten und dass es vor allen Dingen wichtig ist, ihre vielfältige Verwendung in unterschiedlichen Feldern der Angewandten Ethik zu untersuchen. Entsprechend vereint das Buch theoretische philosophische Überlegungen mit konkreten Untersuchungen zu öffentlich vieldiskutierten Themen wie Hirntod, assistiertem Suizid, Todesstrafe und Ehrenmord. Reflexionen zur Würde des Kindes, des Alters und des Sterbens bilden den Abschluss des Buches. Dabei erweist es sich, dass der Menschenwürde eine unverzichtbare Rolle in der Ethik zukommt, weil sie die Bedeutung eines für jedermann geltenden Schutzes vor Erniedrigungen ausdrückt, und damit für uns alle einen – vielleicht sogar den – Kern unseres moralischen Status formuliert. Die Qualität der psychoanalytischen Praxis ist eine immer aktuelle Frage für den einzelnen Psychoanalytiker und die analytischen Institutionen. Ausgehend von den Grundelementen der psychoanalytischen Situation werden Basiskompetenzen des Analytikers postuliert und beschrieben, die die Herstellung und Bewahrung der analytischen Situation garantieren. Im Zentrum der Überlegung steht dann die analytische Deutungsfunktion, um die immer wieder gerungen werden muss, weil sie auch der Dynamik von Übertragung und Widerstand unterworfen ist. Es wird festgestellt, dass diese Überlegungen in Übereinstimmung mit modernen Auffassungen der psychoanalytischen (...) Haltung und Kompetenz stehen. (shrink)

This paper provides an account of Kant's categories of freedom, explaining how they fit together and what role they are supposed to play. My interpretation places particular emphasis on the structural features that the table of the categories of freedom shares with the table of judgements and the table of categories laid out by Kant in the Critique of Pure Reason. In this way we can identify two interpretative constraints, namely (i) that the categories falling under each heading must form (...) a synthetic unity whereby the third one derives from the combination of the other two. and (ii) that the first two categories falling under each heading must be morally undetermined and sensibly conditioned, while the third category is sensibly unconditioned and determined only by the moral law. Recently, metaphysical coherentism has been propounded as an alternative to metaphysical foundationalism and infinitism. The view replaces the picture of reality as a hierarchy of levels with that of a network of objects or facts standing in symmetric or, more generally, cyclic relations of metaphysical dependence. This paper defends the orthodox picture of a well-founded hierarchy against the claimed superiority of coherentism. First, it will be argued that alleged theoretical advantages of coherentism do not hold up to scrutiny. Secondly, examples (...) that are claimed to support coherentism are either misdescribed as involving metaphysical interdependence, or foundationalist treatments fare at least as good and often better than coherentist interpretations. Thirdly, a similar diagnosis applies to a recently proposed coherentist interpretation of quantum entanglement. The more general diagnosis is that claims of metaphysical dependence are convincing only if there is a detailed account of how one item metaphysically explains another. While foundationalists can resort to various specific explanatory relations, coherentism seems to be incapable of providing detailed explanations. (shrink)

School as counter-public" is the hermeneutic key with which Ralf Koerrenz interprets the school model of the Jena Plan. Similar to the Dalton-Plan or the Winnetka-Plan, the Jena Plan is one of the most important concepts of alternative schools developed in the first half of the 20th century as part of the international movement for alternative education, the?World Education Fellowship?. 0Peter Petersen's "Jena Plan" concept must be understood from his educational philosophical foundations. The didactic levels of action at school (...) (teaching, learning) as well as the reflection of theory in pedagogical practice are made understandable by "school as a counter-public". Not least with a view to the today's Jena Plan schools, the question is asked for a context-independent core of what makes a school a Jena Plan school. The following paper is devoted to the discussion of three important and closely interlocked topics in the philosophy of Donald Davidson, the questions: What are reasons? — What are actions? — And: What is the relation between a reason and an action, when the reason explains the action by giving the agent's reason for doing what he did? The last question is actually a quotation; it is the first sentence of Davidson's famous article Actions, Reasons, and Carnes. Although subse-quently modified (...) in various important respects, it still provides the meta-physical groundwork for Davidson's later views on action theory and the philosophy of mind. It is this metaphysical basis that I want to concentrate on. Offhand, Davidson's answers to all the three questions are common in philosophical action theory: Actions are events, reasons are causes of those events, and giving the agent's reason explains an action because it explains the action causally. In what follows, I shall first recapitulate Davidson's reasoning toward the third claim, which I take to be true and to be what Davidson thinks. In discussing a possible objection against this claim I shall then try to show that the second thesis, the thesis that reasons are causes, is neither true nor is it Davidson's opinion. And finally, I want to argue with regard to the first thesis that although Davidson actually holds that actions are events, he should better abandon this position. (shrink)

In this paper, the results of an empirical analysis of a set of 416 descriptive case studies published by corporate members of the UN Global Compact are presented. Although these cases cannot be viewed as representative of the Compact itself or of corporate social responsibility (CSR) and development in general, they can illustrate which kinds of projects are deemed appropriate as best practice examples among Compact members, and therefore indicate the direction, in which predominantly voluntary and business‐led CSR might at (...) best be evolving. To help contextualize the analysis, the paper starts with a brief overview of recent academic work on the strengths and limitations of CSR in the light of international development, followed by the empirical analysis of Compact case studies. The results raise doubts regarding the general suitability of contemporary CSR initiatives to tackle some of the most pressing developmental challenges. Instead, only certain topics are commonly addressed, while a number of issues such as anti‐corruption measures or labour rights are underrepresented in the case study sample. Regarding the target regions of the best practice examples, the majority is reported on activities based in OECD countries and a small number of emerging markets such as South Africa, India or China, while neglecting other regions such as sub‐Saharan Africa (excluding South Africa). From a European Union policy perspective, these results indicate that there is a role to play for the state in order to create a better fit between CSR agendas and the actual developmental needs in the South. Modal dispositionalism is the view that possibilities are a matter of the dispositions of individual objects: it is possible that p if and only if something has a disposition for p to be the case. We raise a problem for modal dispositionalism: nothing within the theory rules out that there could be necessary, perfect masks, which make the manifestation of a disposition impossible. Unless such necessary perfect masks are ruled out, modal dispositionalism runs the risk of failing to provide a (...) sufficient condition for possibility, and indeed of engendering contradictions. But to rule them out, modal dispositionalism would have to revise a crucial tenet of the view, its localism. (shrink)
