The Criminalization series arose from an interdisciplinary investigation into criminalization, focussing on the principles that might guide decisions about what kinds of conduct should be criminalized, and the forms that criminalization should take. Developing a normative theory of criminalization, the series tackles the key questions at the heart of the issue: what principles and goals should guide legislators in deciding what to criminalize? How should criminal wrongs be classified and differentiated? How should law enforcement officials apply the law's specifications of (...) offences? The sixth volume in the series offers a philosophical investigation of the relationship between moral wrongdoing and criminalization. Considering the justification of punishment, the nature of harm, the importance of autonomy, inchoate wrongdoing, the role of consent, and the role of the state, the book provides an account of the nature of moral wrongdoing, the sources of wrongdoing, why wrongdoing is the central target of the criminal law, and the ways in which criminalization of non-wrongful conduct might be permissible. The book outlines the contribution of passivity to the constitution of phenomena as diverse as temporal syntheses, perceptual associations, memory fulfillment and cross-cultural communication.

The concept of vulnerability is widely used in bioethics, particularly in research ethics and public health ethics. The traditional approach construes vulnerability as inherent in individuals or the groups to which they belong and views vulnerability as requiring special protections. Florencia Luna and other bioethicists continue to challenge traditional ways of conceptualizing and applying the term. Luna began proposing a layered approach to this concept and recently extended this proposal to offer two new concepts to analyze the concept of vulnerability, (...) namely understanding external conditions that trigger vulnerability and layers of vulnerability with cascading effects. Luna's conception of vulnerability is useful, which we demonstrate by applying her layered view and the new analyses in multiple contexts. We begin by outlining Luna's view and we use vignettes from healthcare involving transgender patients, the care of patients in psychiatric contexts, and research involving prisoners to illustrate how each part of Luna's concept elucidates important moral issues. Consider the Unshareability View, namely, the view that first person thought or self-thought—thought as typically expressed via the first person pronoun—is not shareable from subject to subject. In this article, I show that a significant number of Fregean and non-Fregean commentators of Frege have taken the Unshareability View to be the default Fregean position, rehearse Frege’s chief claims about self-thought and suggest that their combination entails the Unshareability View only on the assumption that there is a one-to-one correspondence between way (...) of thinking and thought-individuating cognitive value, outline an account of self-thought that rejects the assumption and keeps intact all of Frege’s chief claims, and respond to a number of worries to the effect that this proposal yields undesirable results from the point of view of the individuation of self-thought at the level of cognitive value. Sensorimotor theory claims that what you do and what you know how to do constitutes your visual experience. Central to the theory is the claim that such experience depends on a special kind of knowledge or understanding. I assess this commitment to knowledge in the light of three objections to the theory: the empirical implausibility objection, the learning/post-learning objection and the causal-constitutive objection. I argue that although the theory can respond to the first two objections, its commitment to know-how ultimately (...) renders it vulnerable to the third and arguably most serious objection. I then suggest that sensorimotor theory has two options: concede the causal-constitutive objection or challenge it. I shall argue for the latter. I will claim that a radical sensorimotor theory offers the best means of responding to this objection. (shrink)

Aristotle not only fonnulates the problem of intentionality explicitly, he makes a solution to it a requirement for any adequate theory of mind. His own solution, however, is not to be found in his theory of sensation, as Brentano and others have thought. In fact, it is precisely because Aristotle regards this theory as inadequate that he goes on to argue for a distinct new ability he calls “phantasia.” The theory of content he develops on this basis (unlike Brentano’s) is (...) profoundly naturalistic: it is a representational theory, formulated in tenns of the causal powers and physical magnitudes of the body. The global crisis in different areas of human life demands to look at the values. But not in an abstract and empty way, but as that which gives meaning, dignifies and guides human action. In this content, in the educational area it is important to consider the formation of values, as an essential element in any curriculum that generates reflection about the situation and options for the survival of life, starting from the personal area to the social. It is not (...) an exaggeration to talk about the fact that survival on Earth is in danger, either because we are facing a global crisis, for there are “… various ways of social domination and injustice, unfounded relativisms, dichotomies and reductionisms; the predominance of instrumental rationality, of quantitative, of material…” The research of the meaning facing the > can be found in the ethical reflection of values. The study and analysis of these matters from formal educational spaces is current and it can be addressed from the transversal axis. Therefore, teacher training in this area is fundamental, unfortunately in 2018, the philosophical and axiological topics are disappearing from some Mexican study programs, as is intended to be done in the reform of normal education in Mexico, of which undoubtedly demonstrates, a setback. This article picks up on Foucault’s radical reconceptualisation of concept “power”, and presents asignificant challenge to contemporary discourses surrounding instructionist classroom management. We critique his approach to instructionist classroom management on the basis that it conceptualises power as domination in dealing with disruption in the classroom. We argue that power and discourse are interrelated constructs that the teacher uses to perpetuateTaylorism, Fordism andbureaucraticdomination in aninstructionist classroom setting. Drawing on Foucault’s and Bourdieu’s works, this document reviews:1) explores Foucault’s theory of discourse; (...) 2) argues discourse as an instrument of power; 3) captures the philosophical perspectives on instructionist classroom management; and 4) argues a teacher’s power as a tool for social reproduction and domination in instructionist classroom setting. Problem 2 at the 56th International Mathematical Olympiad asks for all triples of positive integers for which ab−c, bc−a, and ca−b are all powers of 2. We show that this problem requires only a primitive form of arithmetic, going back to the Pythagoreans, which is the arithmetic of the even and the odd.

REC or Radical Enactive (or Embodied) Cognition (Hutto and Myin, 2013) involves the claim that certain forms of mentality do not involve informational content and are instead to be equated with temporally and spatially extended physical interactions between an agent and the environment. REC also claims however that other forms of mentality do involve informational content and are scaffolded by socially and linguistically enabled practices. This seems to raise what can be called a cognitive gap question, namely, how do non-contentful (...) behaviours give rise to contentful behaviours? In this paper, I show how REC can tackle a certain understanding of this question. I argue that if REC were to endorse claims made by the later Wittgenstein, then REC could deny that there is any (synchronous) gap in our intelligent behaviour. (shrink)

There is an unresolved conflict concerning the normative nature of desire. Some authors take rational desire to differ from rational belief in being a normatively unconstrained attitude. Others insist that rational desire seems plausibly subject to several consistency norms. This article argues that the correct analysis of this conflict of conative normativity leads us to acknowledge intrinsic and extrinsic reasons to desire. If sound, this point helps us to unveil a fundamental aspect of desire, namely, that we cannot desire at (...) will. Unlike belief, however, desire can unproblematically accommodate a notion of instrumental attitude. (shrink)

We show that the first-order theory of a large class of plane geometries and the first-order theory of their groups of motions, understood both as groups with a unary predicate singling out line-reflections, and as groups acting on sets, are mutually inter-pretable.

The pioneering analysis of synchronicity was given by Jung, yet despite the concept's momentous significance in Jung's work, and despite the widespread dissemination of the term 'synchronicity' even within pop culture, synchronicity is often badly misconstrued and remains "perhaps the least understood of Jung's theories". Synchronicity, Science, and Soul-Making has already been hailed as the most important analysis of synchronicity since Jung himself.

Two apparently mutually exclusive ideas about the relation between contrastive and non-contrastive explanations can be found in the literature. According to contrastivists, all explanation is contrastive explanation and the supposed existence of non-contrastive explanations can be revealed to be an illusion. According to non-contrastivists, on the other hand, contrastive explanation can be fully analysed in terms of non-contrastive explanation, and is thus not of fundamental importance. In the current article, I discuss the main arguments in favour of and against each (...) of the two positions. This discussion leads to the idea that contrastive explanations are to be understood as parts of a bigger, more complete non-contrastive explanation; but that all actual explanations explain only a limited set of contrasts. I conclude that, once the relation between contrastive and non-contrastive explanations is understood correctly, there remains no substantial issue to divide contrastivism and non-contrastivism. El Naturalismo Trascendental del Ultimo Wittgenstein The present article considers an internal tension in Wittgenstein's late philosophy. In what I call his 'naturalism', Wittgenstein circumscribes philosophical reflection to natural objects, to «making natural history». In his 'transcendentalism' he focuses on the «possibility of phenomena» and distinguishes philosophical method from the method of the natural sciences. I show that his 'transcendentalism' is present in his discussion of rules and prívate language, arguing for an interpretation in terms of a kantian type of (...) transcendental synthesis. But far from contradicting his 'naturalism', both tendencies are inseparable and essential to the main purpose of his Philosophical Investigations. (shrink)

In this paper I aim to show that the philosophy of Mihai Şora can both be seen as a phenomenological treatment of being and as a general theory of being in its most rigorous sense. At least, this philosophy could be designated as a phenomenological ontology which opens up itself towards an originally metaphysical perspective based on a specific type of knowledge of the sort of “global disclosure”. I will argue too that within Şora's philosophy one can have a twofold (...) approach: one starts from what we could call the phenomenology of the “common givenness” (“ordinary/ quotidian givenness”) and then proceeds (in a phenomenological manner) to a general theory of being, which is represented in Şora's philosophy by the constitution of the model of the “sphere with the null ray”; the second commences with the treatment of the ontological model as such (the model, which is already formed, represents in the end the symbolic structure of reality), that is, from this “general theory of being” (or of the constitution of being) and then advances step by step towards various (phenomenological) applications of this ontological model to the multifaceted spheres of the domain of being (the sphere of language, of temporality, of ethics, of the social, of politics, etc.). In this paper I aim to show that the issue of the constitution of time in Husserl’s thought can not be fully exhausted by a descriptive analysis of the immanent level of consciousness and it rather asks for a deeper search at a pre-immanent (and pre-subjective) level. The way Husserl developes his interpretation regarding the constitution of time leads the descriptive (phenomenological) method to an impasse. Because of this, the Husserlian analysis proceeds to some techniques which bear on what some (...) commentators called a constructive phenomenology. The central point that I argue for in this study is that the premise from which Husserl starts his examination of the constitution of time is ab initio problematic or debatable: that is, consciousness forms the origin of time and one could reach this source by following the path oppened by descriptive analysis. I will hold that time rather originates in the encounter between consciousness and objects or between consciousness and other consciousness (i.e. founded/originated in a relation). (shrink)

The long‐standing issue of Wittgenstein's controversial remarks on Gödel's Theorem has recently heated up in a number of different and interesting directions [, , ]. In their , Juliet Floyd and Hilary Putnam purport to argue that Wittgenstein's‘notorious’ “Contains a philosophical claim of great interest,” namely, “if one assumed. that →P is provable in Russell's system one should… give up the “translation” of P by the English sentence ‘P is not provable’,” because if ωP is provable in PM, PM is (...) ω ‐inconsistent, and if PM is ω‐inconsistent, we cannot translate ‘P’as ’P is not provable in PM’because the predicate‘NaturalNo.’in ‘P’“cannot be…interpreted” as “x is a natural number.” Though Floyd and Putnam do not clearly distinguish the two tasks, they also argue for “The Floyd‐Putnam Thesis,” namely, that in the 1930's Wittgenstein had a particular understanding of Gödel's First Incompleteness Theorem. In this paper, I endeavour to show, first, that the most natural and most defensible interpretation of Wittgenstein's and the rest of is incompatible with the Floyd‐Putnam attribution and, second, that evidence from Wittgenstein's Nachla strongly indicates that the Floyd‐ Putnam attribution and the Floyd‐Putnam Thesis are false. By way of this examination, we shall see that despite a failure to properly understand Gödel's proof—perhaps because, as Kreisel says, Wittgenstein did not read Gödel's 1931 paper prior to 1942‐Wittgenstein's 1937–38, 1941 and 1944 remarks indicate that Gödel's result makes no sense from Wittgenstein's own perspective. This analysis of Mexico’s nanotechnology policies utilizes indicators developed by the Organization for Economic Co-operation and Development, which in 2008 conducted a pilot survey comparing the nanotechnology policies of 24 countries. In this paper, we apply the same questionnaire to the Mexican case, adding business information derived from the National Institute of Statistics and Geography survey on nanotechnologies, also an OECD instrument.

_On Tyranny_ is Leo Strauss’s classic reading of Xenophon’s dialogue _Hiero_, or _Tyrannicus_, in which the tyrant Hiero and the poet Simonides discuss the advantages and disadvantages of exercising tyranny. Included are a translation of the dialogue from its original Greek, a critique of Strauss’s commentary by the French philosopher Alexandre Kojève, and the complete correspondence between the two. This revised and expanded edition introduces important corrections throughout and expands Strauss’s restatement of his position in light of Kojève’s commentary to (...) bring it into conformity with the text as it was originally published in France. Recent interest in the idea that there can be scientific understanding without explanation lends new relevance to Duhem's notion of natural classification. According to Duhem, a classification that is natural teaches us something about nature without being explanatory. However, Duhem's conception of naturalness leaves much to be desired. In this paper, I argue that we can measure the naturalness of classification by using an amended version of the notion of unification as defined by Schurz and Lambert. If this thesis is (...) correct, it both leads to a better conceptual understanding of scientific understanding, and also gives the nascent literature on this topic some much-needed precision. Society Semantics, introduced by W. Carnielli and M. Lima-Marques, is a method for obtaining new logics from the combination of agents of a given logic. The goal of this paper is to present several generalizations of this method, as well as to show some applications to many-valued logics. After a reformulation of Society Semantics in a wider setting, we develop in detail two examples of application of the new formalism, characterizing a hierarchy of paraconsistent logics called Pn and a hierarchy (...) of paracomplete logics In. We also propose three further generalizations, obtaining Society Semantics for several many-valued logics, including a hierarchy of logics called In Pk which are both paraconsistent and paracomplete. My aim in this paper is to analyze the way in which Edmund Husserl deals with the problem of the constitution of image in his writings. The difference between a common thing and a work of art lies in the fact that the ‘thing’ is submitted as an object to perception, while the work of art is the product of the human capacity called imagination or fantasy (Phantasie). Therefore, the difference between perception (which is an objectifying act) and imagination (which (...) refers to a mental representation) is the fundamental difference Husserl operates with in his analysis of the phenomenological problem of the image building. I also want to show that Husserl’s analysis of the constitution of the image is fundamental in the understanding of the work of art (aesthetic phenomena including) and of its difference from a common thing. From the point of view of the History of Philosophy, the Husserlian analysis presupposes the overcoming of the classical opposition between subject and object, and the aesthetic experience is one of the (privileged) ways through which this overcoming can be achieved. The present contribution has the purpose of evidencing both the originality of Şora’s understanding of time (and its importance for the question of authenticity, empathy and intersubjectivity), and the possibility of a dialogue with Husserl’s understanding of the consciousness of internal time. One of the most important aspects of my paper is the endeavour to bring to light the underlying structure of temporality at work in Mihai Şora’s philosophy. The two forms of temporality present in Şora’s thought – the temporality (...) “of the Moment” and that “of the instances of countable time” – open up the possibility of a phenomenological understanding of time. Some specific terms which Şora uses to describe the two forms of temporality – like the “vertical plunge”, “openness”, “disclosure”, “the gift of Encounter”, “the horizontal walk”, etc. – seem, at least at first, to belong to a poetic language, full of metaphors, a language which doesn’t seem to have much in common with the rigors of a philosophical language, but they nevertheless reveal some fundamental characteristics of the two forms of temporality. The possibility of understanding and interpreting these forms of temporality as structures belonging to the consciousness of time, in a broad sense (which correspond to the fabric of the real word, according to Şora’s ontological model), is another interesting question which will be debated in the present study.
