The figure of form-of-life is a life lived as a ‘how’ or a mode of living, beyond every relation. Form-of-life is a form of impotent, destituent power that seeks to deactivate the biopolitics that continuously divides and separates life itself. Agamben’s work is remarkably silent on the question of reproductive rights. The pregnant woman’s life is regulated continuously by biopolitics, yet Agamben does not discuss this regulation. The woman’s relationship with her foetus is difficult to reconcile with Agamben’s (...) philosophy that seeks to think beyond every relation. In addition, the right to abortion is difficult to reconcile with form-of-life. It is not clear how a woman seeking an abortion is not exercising a sovereign decision to create bare life. I use the UK’s abortion laws as a way to interrogate Agamben’s figure of form-of-life, and to illustrate how, by not accounting for reproductive rights, Agamben’s thought remains incomplete. In this paper reling on Agamben’s genealogical endeavour with regard to the concept of oath, I shall try to discuss how he renders the relation between language and the destituent power that will lead me to address ‘the new experience of the word’, namely, pistis (faith), which is placed at the centre of the messianic announcement. In order to open up this point, I will take into consideration Jacques Derrida’s arguments related to faith and language which appear to (...) be one of the main addressees of Agamben’s critical undertaking, even though he is never mentioned in Agamben’s later book The Sacrament of Language, in which he elaborates the contours of the relation between language and pistis. For Derrida the opening of language is based on an oath, a promise of saying ‘yes’ and thus, speaking is an act of faith. However, it is this functioning of language that has to be suspended according to Agamben, since it is this very dispositif that is connected to sovereign power. It is through this suspension the living being who has language may cease to be homo sacer before language and sovereign power. (shrink)

Bong Joon Ho's Parasite has been globally praised for presenting a new perspective on class conflict and for placing the precarious working class at its center. Prestigious awards such the Palme d'Or at the Cannes Festival or the unprecedented Oscar for the Best Film of the Year only corroborate this global consensus. But I think it's the opposite. Parasite is an overworked and convoluted narrative about the impossibility of overcoming, dismantling, or exiting neoliberal capitalism. Literally, the South Korean film is (...) a cinematic version of Fredric Jameson's infamousthat "it is easier to imagine the end of the world than to imagine the end of capitalism." Therefore, the interesting thing to analyze is how we all have enjoyed globally, in almost ecclesiastical communion, our last cinematic surrender to the ideology of late capitalism. And at that, it must be admitted, Bong Joon Ho's film is a work of genius. Parasite is also a pertinent departure point to revisit some of Žižek’s theories on the issue of neoliberalism’s global fantasies and on Lacan’s four discourses. (shrink)

The Italian philosopher Giorgio Agamben’s conception and critique of sovereignty has won him wide and well-deserved acclamation. In this article, however, it is argued that Agamben’s conception of sovereignty is somewhat misplaced, and, as a consequence, his positive political project of developing a ‘destituent power’ is highly deficient in terms of construing a popular and viable political alternative. The critique of Agamben is developed through a close reading of Aristotle’s Politics and his notion of kurion. It is argued (...) that Agamben’s flawed conception of sovereignty reemerges symptomatically in his extremely problematic reading of Aristotle’s Politics, and that a viable political alternative to both Agamben’s own project and the conception of politics that he criticizes can be developed through an alternative and closer reading of Aristotle. This paper describes neoliberalism and summarizes new works on democracy in Continental philosophy. Unlike laissez-faire or liberal economic theory—a “leave us alone” strategy in which the state does not interfere with private enterprise—neoliberal governments use the resources of the state to assist the market directly and employ the market to direct or oversee the resources of the state. Alongside neoliberal government, and in its wake, is a society in which the guiding axioms for each human being are self-entrepreneurship and competition. (...) Over the last decade, however, a new body of philosophical work has been dissociating democracy from neoliberal government, critiquing a failed system of political representation, and considering to what extent democracy must take place beyond or outside of the current state. Of equal concern to these philosophers is how to take flight from a way of life that is characterized by self-entrepreneurship and competition. For some, the start of a political future beyond neoliberalism hinges upon a recent distinction between constituent and destituent forms of power. Whereas constituent power attempts to reform one’s government through demonstrations in public space, destituent power abandons the project of reforming one’s government momentarily or even completely in order to experience another form of life entirely. This essay by Giorgio Agamben is based on a lecture given in central France in the summer of 2013. Responding directly to recent occupations and insurrections – from Cairo and Istanbul to London and New York City – Agamben builds upon his existing work in order to develop and clarify his understanding of the political, and in particular, the notion of destituent power. In contrast to attempts to affirm a constituent power independent of a relation to constituted (...) power, which for Agamben both reproduce the governmental structure of the exception and represent the apex of metaphysics, destituent power outlines a force that, in its very elaboration, deactivates the governmental machine. For Agamben, it is in the sensible elaboration of the belonging together of life and form, being and action, beyond all relation, that the impasse of the present will be overcome. The publication of The Use of Bodies, the final volume in Giorgio Agamben’s Homo Sacer series, makes it possible to take stock of Agamben’s project as a whole. Having started with a powerful critique of the biopolitical sovereignty as the essence of modern politics, Agamben concludes his project with an affirmative vision of inoperative politics of form-of-life, in which life is not negated or sacrificed to the privileged form it must attain, but rather remains inseparable from the form that does (...) nothing but express it. The article begins by reconstituting the non-relational logic that Agamben develops in order to render inoperative the existing apparatuses of ontology, ethics and politics. We then address the dimension of lifestyle as a new key domain of Agamben’s work, in which biopolitics may be recast in an affirmative key of form-of-life. While Agamben is better known for sceptical and scornful statements about contemporary liberal democracies, we shall argue that his affirmative biopolitics, characterized by destituent power, resonates with Claude Lefort’s understanding of democracy as structured around the ontological void and epistemic indeterminacy. In the conclusion we question the viability of this biopolitical democracy, focusing on Agamben’s example of the Nocturnal Council in Plato’s Laws. (shrink)

In dialogue with Kristin Ross and Fred Moten, as well as recent theorizations of destituent power, this article aims to trace the practical logic that governs place-based politics in our anarchic epoch, including the construction of collective formations that defend them.

This article argues that the passage to world society proliferates a structural transformation of constitutionalism. It is argued that its postdemocratic character is mainly rooted in a process where substantial policy objectives are constitutionalized on a higher-ranking level. While the first part of the article elaborates this diagnosis by combining systems-theoretical and post-marxist insights, the second part turns to a critique of contemporary theories about transnational constitutionalism. It reveals the shortcomings of cosmopolitan, societal and popular-sovereignty approaches in overcoming these postdemocratic (...) structures. Finally, it is argued that – in the light of such a new constitutionalism – the notion of constituent power must be replaced by the figure of a destituent power which attempts to free the constitution as a form from the selective policy objectives. One of the most important devices in the management and control of our global societies is the scenario-planning. In this regard, this paper analyses the impact that the massive use of these devices implies to our society. Specifically, it is used as an analytical approach the concepts of difference, différance and destituent power. These theoretical proposals, which have been regarded as important dimensions of resistance and liberation, paradoxically are relevant to understanding the operation of the scenario-planning. En este sentido, el presente artículo analiza el impacto que la utilización masiva de estos dispositivos entraña para nuestra sociedad. Específicamente, se utilizará como enfoque analítico el concepto de diferencia de Deleuze, la différance de Derrida y lo destituyente en Agamben. Dichas propuestas teóricas, que permanentemente han sido consideradas como dimensiones de resistencia, subversión y liberación, se muestran paradójicamente pertinentes para comprender el funcionamiento de las técnicas de construcción de escenarios ficcionales. This article aims to elucidate the relationship between Agamben’s notion of messianism and his project of philosophical archaeology. Whereas the former relates to political and ethical aspects of Agamben’s philosophy, the latter belongs to the domain of methodology of philosophical research itself. The main thesis of the paper argues that these two components rely on each other and constitute one and the same project. The author demonstrates that Agamben’s notion of messianic action and scholarly activity of philosophical archaeology overlap, which (...) leads to a problematization of political dimension of Agamben’s messianism. The orientation towards the past in Agamben’s understanding of the messianic is its crucial presupposition that imposes limits on its applicability to the realm of politics. This thesis is substantiated by an investigation of the problem of relation between theory and practice in Agamben’s thought and by a close reading of the ‘Mystery of Anomia’ section in The Time that Remains. Beginning with the problem of the possibility of a transition from the tragic narrative elaborated in the Homo Sacer project to the messianic state of lawlessness, the author demonstrates that in Agamben’s thought this transition is made possible only by means of an archaeological inquiry. Beginning from the texts of Colectivo Situaciones on the insurrectional movements of December 2001 in Argentina, this article raises the question of institutional critique on the basis of a reflection on destituent practices. Far from being reducible to the aim of a reinstitution – that is, the aim of accomplishing the classical functions of political power – these practices refer instead to a « positive no », to the self-transforming actualization of the potentials of social action before and (...) beyond the figures of institutional representation. Thus, what appears amidst destitution is not a « labor of negation », but rather the contours of an instituting activity that engenders new forms of coexistence and coaction, even if this activity is partially haunted by the staging of past conflicts. To better understand this instituent activity, we must consider a second meaning of the word « destitution », which is desubjectivation as the destruction of the faculty of subjectivation, as Agamben describes it in Remnants of Auschwitz. It is only on the basis of the double meaning of destitution that the complex co-involvement of institution and destitution can be brought to light and that the privilege long accorded to « constitution » can be questioned, on the level of the theory of subjectity as well as that of politics. ABSTRACT The work of Giorgio Agamben is punctuated by constant references to Michel Foucault’s work, so that the latter appears as an important theoretical framework for the former. However, an effort to bring the two authors together proves to be quite problematic as it is perceived that the Italian philosopher operates certain methodological and conceptual categories fundamental to Foucauldian thought in a radically different way from the French philosopher. Such incompatibility is presented with greater clarity when we propose to explore (...) the theme of the destituent in Agamben’s work, from which ontology, politics and ethics intersect, revealing the differences between the two philosophers. Thus, in order to expose the limits of this approximation, it will first be explored the methodological distinctions between the two authors in their approach of the problem of ‘power’, as well as the way in which the concept is formulated in the work of each of them. Next, the general lines of the agambenian ‘modal ontology’ and the ‘ethics of inoperability’ will be presented in order to conclusively explain the divergence between the ethical solutions proposed by Foucault and Agamben in their later works. Are there illusions of duration? Certainly, many experiences of an event’s duration differ from its measure in clock duration, the measure of that event in seconds, minutes, hours, and so forth. However, I argue that an illusory duration requires more than difference from a real duration; it requires difference from a duration that is relevant to experience. It is plausible to hold that there are many kinds of real duration and reason to question the relevance of all of them. In (...) particular, the interpretation of experienced duration as illusory is typical because it is compared to clock time; the experience of duration goes wrong by being different from a clock measurement of duration. However, I argue that clock duration is not obviously relevant to evaluating the experience of duration.In response, one might hold that it is plausible to evaluate experience by clock duration because clocks more closely match reality than experiences do; on the scale of experience, clock time is no different to real duration. It is not that experienced duration is an illusion because it is merely different from clock duration; it is an illusion because it is different from real duration and we know this because of its difference from clock duration. It is like illusions of size: some object seems to be a size it is not and we know this by comparing it to an object we can otherwise accurately measure by meters.However, unlike size illusions, it is not clear what the ‘real duration’ is against which we should evaluate apparent duration. What is meant by ‘real duration’ involves either an appeal to the duration of substantial absolute time or some kind of duration in things, for example, duration which is the measure of change in some kind of process. is an irrelevant duration; few positions hold that we experience absolute time. As for, if real duration is a measure of change, then, for experienced duration to match clock duration, they must both agree on the relevant change. If there is a difference in what is treated as the real duration, then neither experience nor clocks can be treated as evaluable in terms of the other.Finally, we may have an illusory duration because there are cases of variation between experiences of the same duration. Yet, even here, we may be misled; we may not be directly comparing experiences. We compare the experienced durations through first measuring each in terms of clock duration. If there is a variability in the relationship between clock standard and some relevant standard for experience, then one expects anything accurately meeting one standard to differ from anything accurately meeting the other. The error is holding there is a stable relationship between the standards. This error is not a matter of our experience of duration, and so is not an illusion of duration. (shrink)

ObjectiveTo examine how physical and psychological childbirth experiences affect maternal perceptions and experiences of early infant behavioural style.BackgroundUnnecessary interventions may disturb the normal progression of physiological childbirth and instinctive neonatal behaviours that facilitate mother–infant bonding and breastfeeding. While little is known about how a medicalised birth may influence developing infant temperament, high impact interventions which affect neonatal crying and cortisol levels could have longer term consequences for infant behaviour and functioning.MethodsA retrospective Internet survey was designed to fully explore maternal experiences (...) of childbirth and her postnatal perceptions of infant behaviour. Data collected from 999 mother–infant dyads were analysed using Pearson’s correlations and multiple analyses of covariance, employing the Bonferroni method of correction to establish initially significant variables. Multiple linear regressions were conducted to determine major perinatal contributors to perceived early infant temperament.ResultsMultiple regression analyses on each of the eight Mother and Baby Scales outcome variables indicated that early infant behavioural style was largely predicted by subjective maternal states during and post-childbirth, postnatal depression scores, maternal personality traits and infant age. For example, infant age was the most significant predictor of Alert-Responsive infant behaviour, followed by maternal Postnatal Positive experience. In contrast, depression scores were the most significant predictor of Unsettled-Irregular infant behaviour, followed by Anxious-Afraid Birth Emotions and infant age. Mothers also perceived their infants as more Alert-Responsive and Easier overall after a Supported birth experience.ConclusionMaternal and infant outcomes were influenced by multiple physical and psychological perinatal variables. The mother’s subjective experience appeared to be of equal significance to more objective factors. Social support enhanced the mother’s childbirth experience, benefitting her perceptions of her baby’s early temperament. These findings provide further support for current World Health Organisation intrapartum guidelines on the importance of making childbirth a ‘positive experience’ for women. (shrink)

Lawrence Kohlberg's Approach to Moral Education presents what the late Lawrence Kohlberg regarded as the definitive statement of his educational theory. Addressing the sociology and social psychology of schooling, the authors propose that school culture become the center of moral education and research. They discuss how schools can develop as just and cohesive communities by involving students in democracy, and they focus on the moral decisions teachers and students face as they democratically resolve problems. In this article, we address the relevance of J.S. Mill’s political philosophy for a framework of public health ethics. In contrast to some readings of Mill, we reject the view that in the formulation of public policies liberties of all kinds enjoy an equal presumption in their favor. We argue that Mill also rejects this view and discuss the distinction that Mill makes between three kinds of liberty interests: interests that are immune from state interference; interests that enjoy a presumption (...) in favor of liberty; and interests that enjoy no such presumption. We argue that what is of focal importance for Mill in protecting liberty is captured by the essential role that the value of self-determination plays in human well-being. Finally, we make the case for the plausibility of a more complex and nuanced Millian framework for public health ethics that would modify how the balancing of some liberty and public health interests should proceed by taking the thumb off the liberty end of the scale. Mill’s arguments and the legacy of liberalism support certain forms of state interference with marketplace liberties for the sake of public health objectives without any presumption in favor of liberty. Can computer systems ever be considered moral agents? This paper considers two factors that are explored in the recent philosophical literature. First, there are the important domains in which computers are allowed to act, made possible by their greater functional capacities. Second, there is the claim that these functional capacities appear to embody relevant human abilities, such as autonomy and responsibility. I argue that neither the first (Domain-Function) factor nor the second (Simulacrum) factor gets at the central issue in the (...) case for computer moral agency: whether they can have the kinds of intentional states that cause their decisions and actions. I give an account that builds on traditional action theory and allows us to conceive of computers as genuine moral agents in virtue of their own causally efficacious intentional states. These states can cause harm or benefit to moral patients, but do not depend on computer consciousness or intelligence. (shrink)

We seem to directly perceive external things. But can we? According to the time‐lag argument, we cannot. What we directly perceive happens now. There is a time‐lag between our perceptions and the external things we seem to directly perceive; these external things happen in the past; thus, what we directly perceive must be something else, for example, sense‐data, and we can only at best indirectly perceive other things. This paper examines the time‐lag argument given contemporary metaphysics. I argue that this (...) argument is not as compelling as it may initially seem. First, it denies that what we directly perceive can ever be what it seems to be; second, it conflicts with the current physical conception of time, relativity theory. This latter point leads to a more general one: the argument's force depends on a particular metaphysical conception on time, presentism, which is controversial in contemporary metaphysics of time. Given the alternative conception, eternalism, the argument is much less compelling. The overall argument of this paper, then, is that, if one wishes to hold that we directly perceive external things, we should subscribe to the latter view of time, i.e., eternalism. (shrink)

Historically Wales has been regarded as a country with relatively low levels of school exclusion, particularly in comparison with England. This has been used as an indicator of Wales’ commitment to the UN Convention on the Rights of the Child, which foregrounds a rights-based agenda that would argue school exclusion is a consequence of broader socio-economic structures than individual actions. However, simple analyses may mask a different picture of school exclusions in Wales. In this article, we study more detailed information (...) on formal school exclusions by looking at ‘instances’ of school exclusion, which considers the frequency and length of formal school exclusions in Wales, and alongside recorded school absence. The article also demonstrates that the pupils ‘at risk’ of formal school exclusion varies by when they experience school exclusion during their educational lifecourse. The article concludes by highlighting that patterns of school exclusion are complex, and that interpretation of these patterns depends on what kind of measure of school exclusion is used. By publishing these results, the article hopes to persuade policymakers and practitioners to re-examine their processes of exclusion to ensure they are commensurate with the law and to prevent unnecessary school exclusions. My One Fallacy theory says there is only one fallacy: equivocation, or playing on an ambiguity. In this paper I explain how this theory arose from rnetaphilosophical concerns. And I contrast this theory with purely logical, dialectical, and psychological notions of fallacy.

The doctrine of the specious present, that we perceive or, at least, seem to perceive a period of time is often taken to be an obvious claim about perception. Yet, it also seems just as commonly rejected as being incoherent. In this paper, following a distinction between three conceptions of the specious present, it is argued that the incoherence is due to hidden metaphysical assumptions about perception and time. It is argued that for those who do not hold such assumptions, (...) so long as we are clear about what the doctrine is really saying, we can make perfect sense of the specious present doctrine. This book explores the important yet neglected relationship between the philosophy of time and the temporal structure of perceptual experience. It examines how time structures perceptual experience and, through that structuring, the ways in which time makes perceptual experience trustworthy or erroneous. -/- Sean Power argues that our understanding of time can determine our understanding of perceptual experience in relation to perceptual structure and perceptual error. Articles by Lyn Horn and Alison Thompson highlight several points crucial to understanding how our theory figures in wider debates about social justice as well as the particular relevance of our theory for assessing the overall practice of public health (Horn, 2013; Thompson, 2013). We begin with these two articles, first to respond to and concur with many of their central points, and second to set the stage for dealing more efficiently with some points raised in the other articles.

Starting from the special theory of relativity it is argued that the structure of an experience is extended over time, making experience dynamic rather than static. The paper describes and explains what is meant by phenomenal parts and outlines opposing positions on the experience of time. Time according to he special theory of relativity is defined and the possibility of static experience shown to be implausible, leading to the conclusion that experience is dynamic. Approaches to programming ethical behavior for computer systems face challenges that are both technical and philosophical in nature. In response, an incrementalist account of machine ethics is developed: a successive adaptation of programmed constraints to new, morally relevant abilities in computers. This approach allows progress under conditions of limited knowledge in both ethics and computer systems engineering and suggests reasons that we can circumvent broader philosophical questions about computer intelligence and autonomy.
