El objetivo de esto, es proponer una descentralización del texto señalado, debido a que se posicionaría como una producción poética tránsfuga que sobrepasa las clasificaciones “generacionales” de los años 90 del siglo XX y del 2000. Resumen: Una de las formas más comunes y menos estudiadas de parcialidad judicial subjetiva es la disminución de la credibilidad otorgada a un testigo debido a un prejuicio identitario implícito del agente judicial. En la epistemología social, este fenómeno ha sido estudiado bajo la rúbrica de la injusticia testimonial. En este ensayo mostramos que para determinar la ocurrencia de un caso de injusticia testimonial en el derecho se deben cumplir tres condiciones que son imposibles de verificar empíricamente y que (...) están basadas en presupuestos psicológicos que han sido puestos en duda en años recientes. Sin la posibilidad de verificar estas condiciones, estamos frente a un tipo de parcialidad judicial indetectable. En su lugar, ofrecemos una nueva forma de entender la injusticia testimonial en el derecho como un fenómeno más general que describe una tendencia comportamental prejuiciosa recurrente por parte de un agente judicial. Entendida de este modo, la injusticia testimonial es completamente verificable. -/- Abstract: One of the most common and least studied forms of subjective judicial partiality is the credibility deficit suffered by a witness due to an implicit identity prejudice in a judicial agent. Social epistemologists have studied this form of partiality under the rubric, “testimonial injustice.” In this essay we argue that to verify the occurrence of a singular instance of testimonial injustice in law three facts must be established, none of which can be established with any degree of confidence. Furthermore, all of them are based on psychological suppositions that have been recently discredited. Without the possibility of establishing these facts, we end up with an undetectable form of subjective judicial partiality. In its place, we offer a new way of understanding testimonial injustice in law as a general phenomenon that describes a recurrent pattern of prejudiced behavior in a judicial agent. Under this characterization, testimonial injustice becomes empirically verifiable. (shrink)

We subject others and are ourselves subjected to risk all the time - risk permeates life. Despite the ubiquity of risk and its imposition, philosophers and legal scholars have devoted little of their attention to the difficult questions stimulated by the pervasiveness of risk. When we impose risk upon others, what is it that we are doing? What is risking's moral significance? What moral standards govern the imposition of risk? And how should the law respond to it? Antinatalism is an emerging philosophy and practice that challenges pronatalism, the prevailing philosophy and practice in reproductive matters. We explore justifications of antinatalism—the arguments from the quality of life, the risk of an intolerable life, the lack of consent, and the asymmetry of good and bad—and argue that none of them supports a concrete, understandable, and convincing moral case for not having children. We identify concentration on possible future individuals who may or may not come to be as the main (...) culprit for the failure and suggest that the focus should be shifted to people who already exist. Pronatalism’s hegemonic status in contemporary societies imposes upon us a lifestyle that we have not chosen yet find almost impossible to abandon. We explicate the nature of this imposition and consider the implications of its exposure to different stakeholders with varying stands on the practice of antinatalism. Imposition as a term has figured in reproductive debates before, but the argument from postnatal, mental, and cultural imposition we launch is new. It is the hitherto overlooked and underdeveloped justification of antinatalism that should be solid and comprehensible enough to be used even by activists in support of their work. (shrink)

El siguiente ensayo busca tematizar los alcances y posibilidades de una fenomenología hermenéutica del testigo en la obra de Paul Ricoeur. Dos objetivos dan cuerpo a este intento: 1) situar el lugar del testigo en el marco de la fenomenología contemporánea, particularmente, de Husserl, Sartre y Lévinas; 2) preguntarse por la condición pasible del testigo, condición que a mí juicio hace de éste un respondiente, inscribiendo la obra ricoeuriana, con todas las cautelas correspondientes, que deben ser muchas, (...) al inicio de lo que puedo llamar el avance de diversos intentos de conducir una fenomenología de la responsividad (Jean-Louis Chrétien, Emmanuel Housset, Claude Romano), siendo cada uno de ellos, en todo caso, tan singular y original que habría que probar si son o no coincidentes. In debates over the legitimacy of markets for live human organs, much hinges on the moral standing of desperate exchanges. Can people in desperate circumstances genuinely choose to sell their organs? Alternatively if they do choose to sell, then surely is it their choice? While sales are banned in most of the Western world due to fears that the poor will be exploited, advocates of these markets find such prohibition unconscionably paternalistic; and from the standpoint of contemporary liberal theory, paternalism (...) is anathema. Is it possible to provide grounds for blocking such desperate exchanges which are not at the same time paternalistic?In ‘Imposing Options on People in Poverty: the Harm of a Live Donor Organ Market', Simon Rippon argues that some options in the market do in fact harm. According to Rippon, if we focus on possible negative consequences of increasing an agent's options, one can develop an argument against human organ markets which is not paternalistic or focused on the idea of exploitation. Whether his account is, as stated, non-paternalistic is an open question, but his analysis of the implications of increased commercial options provides an illuminating and original critique of the human organ markets.Rippon labels his opponents' view the ‘Laissez-choisir Argument’ . A prominent defence of a market in organs from living donors says that if we truly care about people in poverty, we should allow them to sell their organs. The argument is that if poor vendors would have voluntarily decided to sell their organs in a free market, then prohibiting them from selling makes them even worse off, at least from their own perspective, and that it would be unconscionably paternalistic to substitute our judgements for individuals' own judgements about what (...) would be best for them. The author shows that this ‘Laissez-Choisir Argument’ for organ selling rests on a mistake. This is because the claim that it would be better for people in poverty to sell their organs if given the option is consistent with the claim that it would be even better for them to not have the option at all. The upshot is that objections to an organ market need not be at all paternalistic, since we need not accept that the absence of a market makes those in poverty any worse off, even from their own point of view. The author goes on to argue that there are strong theoretical and empirical reasons for believing that people in poverty would in fact be harmed by the introduction of a market for live donor organs and that the harm constitutes sufficient grounds for prohibiting a market. Sin embargo, una tarea común a todas ellas ha sido la de reflexionar acerca de aquellas condiciones que a priori son necesarias para conocer. También estas condiciones, así como el modo de concebirlas, han sufrido variaciones a lo largo de sus escritos. Si en su programa temprano de una antropología del conocimiento aspectos como la reflexión, el cuerpo y el lenguaje tienen (...) un mayor protagonismo, en su posterior pragmática trascendental del lenguaje estos, sin llegar a desaparecer, pasan a reinterpretarse desde la perspectiva de la comunidad de comunicación. Este artículo reconstruye la problemática de los a priori del conocimiento en la filosofía de Apel, y al hacerlo contribuye a una integración, que Apel había planeado llevar a cabo, de esos dos programas. The idea that a world in which everyone was born “perfect” would be a world in which something valuable was missing often comes up in debates about the ethics of technologies of prenatal testing and preimplantation genetic diagnosis . This thought plays an important role in the “disability critique” of prenatal testing. However, the idea that human genetic variation is an important good with significant benefits for society at large is also embraced by a wide range of figures writing in (...) the bioethics literature, including some who are notoriously hostile to the idea that we should not select against disability. By developing a number of thought experiments wherein we are to contemplate increasing genetic diversity from a lower baseline in order to secure this value, I argue that this powerful intuition is more problematic than is generally recognized, especially where the price of diversity is the well-being of particular individuals. Students often suffer from what might be called “ethics anxiety,” a kind of alienation from moral discourse due to a fear that another’s values will be imposed upon them. A consequence of this anxiety is that students detach themselves from participating in moral deliberation. This paper proposes a way of thinking about moral judgments aimed at assuaging the fears of students who are skeptical about any moral claim that is not wholly personal or cultural. Rather than viewing moral judgments as (...) imperatives that aim to impose one’s values on another, moral judgments ought to be understood as truth claims that are practical or action-guiding. El siguiente trabajo profundiza el acontecimiento del duelo en la filosofía de Jacques Derrida. En esta perspectiva, se comienza por el libro Glas de 1974, donde se anunciaría el duelo por la muerte del sentido. Posteriormente, se profundizará en los fantasmas derridianos y la responsabilidad con los desaparecidos. En tercer lugar, emerge la figura del don, que abre al duelo hacia la espera infinita. Finalmente, y desde la lectura derridiana de los psicoanalistas Abraham y Török, se trabajará la figura de (...) la “cripta” como falso inconsciente. Se concluye con una reflexión sobre Chile y los desaparecidos por la dictadura de Pinochet. This article focus on the event of mourning in the philosophy of Jacques Derrida. It begins, accordingly, with the 1974 book Glas, where Derrida announces his mourning for the death of meaning. The article then focus on the Derridean ghosts and the responsibility towards the missing. Thirdly, the figure of gift emerges, one that opens mourning towards the infinite hold. Endly, from the Derridean lecture of phsychoanalysts Abraham and Török, the figure of “crypt” will be presented as a false inconscious. It concludes with a reflection on Chile and the missing people by Pinochet’s dictatorship. (shrink)

Late last year the English Court of Appeal confirmed a lower court's ruling that doctors could impose an operation to separate recently born conjoined twins, overriding the refusal of consent of their parents. The doctors believed the operation would probably save one of the babies at the cost of killing the other, while not operating would highly probably be followed by the death of both twins within months of their birth. The parents, said to be devout Roman Catholics, believed that (...) it was absolutely wrong to kill one of their babies, even to save the life of the other.Undoubtedly many people, the writer included, would agree with the English courts that the “least worst” option was to separate the twins and save one at the cost of killing the other. But surely many fewer people would have imposed their own resolution of this acute moral dilemma upon parents who conscientiously chose the other limb of the dilemma, refusing to kill one baby even in order to save the other. Were the English judges right, then, to take away the parents' normal right and duty to make health care decisions on behalf of their children and instead impose their own answer to what they admitted to be a terrible dilemma? Describing the two alternatives in terms of choosing between the lesser of two evils on the one hand, and the obligation not to kill on the other, Lord Justice Ward declared, according to The Times law report,1 that: “Parents who were placed on the horns of such a terrible dilemma simply had to choose the lesser of their inevitable loss [sic]”. Past research has sought to elucidate how speakers and addressees establish common ground in conversation, yet few studies have focused on how visual cues such as co-speech gestures contribute to this process. Likewise, the effect of cognitive constraints on multimodal grounding remains to be established. This study addresses the relationship between the verbal and gestural modalities during grounding in referential communication. We report data from a collaborative task where repeated references were elicited, and a time constraint was imposed to increase (...) cognitive load. Our results reveal no differential effects of repetition or cognitive load on the semantic-based gesture rate, suggesting that representational gestures and speech are closely coordinated during grounding. However, gestures and speech differed in their execution, especially under time pressure. We argue that speech and gesture are two complementary streams that might be planned in conjunction but that unfold independently in later stages of language production, with speakers emphasizing the form of their gestures, but not of their words, to better meet the goals of the collaborative task. El segundo momento busca las coordenadas del sentido en la puntuación del poema, y su estratificación, en la (...) rima, para penetrar en lo desconocido de la palabra por medio de una música desconocida. Recientemente ha muerto Jacques Derrida. Nos deja su obra y nos deja con un nombre que es más que su obra. Su nombre que, como todo nombre, es el nombre de alguien. Este texto trata de mostrar que el propio nombre de Derrida, ahora un alguien más allá de la vida, es también otra imposibilidad de la ontología y otra desconstrucción de la pretensión del juego metafísico de la presencia y su representación. Tratamos de mostrar aquí cómo este alguien ausente (...) cuestiona, en su imposibilidad, todas las posibilidades de su representación, incluyendo los epitafios del signo. (shrink)

The computational hypothesis was formulated with due concern for limits and is consistent with imposed intelligibility doctrines. Theories are products of scientific work that impose human classifications and formalisms on nature. The claim that “cognitive agents are dynamical systems” is untenable. Dynamical formalisms imposed on a natural system, given an approximate fit, serve as an explanatory framework and render a represented system predictable and intelligible.

We introduce a hitherto overlooked phenomenon in the cognitive and psycholinguistic study of metaphors that we termed imposed metaphoricity. We propose that a metaphorical reading can be imposed on a given expression regardless of its semantic content. We suggest that there is a class of constructions that impose metaphorical interpretation. We present findings from three experiments and from corpus-based analyses that support our proposal. Experiments 1–2 compared interpretations of expressions that can have both a literal and a metaphorical meaning when (...) embedded in a standard metaphorical form and in a form that imposes metaphoricity. In Experiment 3 we examine reaction time to such forms in an attempt to identify interference of form with early metaphorical processing. Two corpus-based analyses characterize the use of these two metaphorical constructions in natural language. We discuss the independence of metaphoricity from semantics, as demonstrated by forms that impose metaphorical interpretations. (shrink)

The media coverage of an Arizona prison takeover showed the journalistic struggle over the balancing of the fundamental tenets of the craft: How to report truthfully and accurately while minimizing harm. This case study included interviews with reporters who faced pressures from officials to self-censor so guards and hostages would not be injured or killed. Ethicists and commentators contributed to the discussion.

ABSTRACT We have previously argued that there are forms of greenhouse gas offsetting for which, when one emits and offsets, one imposes no risk. Orri Stefansson objects that our argument fails to distinguish properly between the people who stand to be harmed by one’s emissions and the people who stand to be benefited by one’s offsetting. The bioethical, professional, and policy discourse over brain death criteria has been portrayed by some scholars as illustrative of the minimal influence of religious perspectives in bioethics. Three questions then lie at the core of my inquiry: What interests of secular pluralistic societies and the medical profession are advanced in examining religious understandings of criteria for determining death? Can bioethical and professional engagement with religious interpretations of death present substantive insights for policy discussions on neurological criteria for death? And finally, (...) how extensive should the scope of policy accommodations be for deeply held religiously based dissent from neurological criteria for death? I begin with a short synopsis of a recent case litigated in Ontario, Canada, Ouanounou v. Humber River Hospital, to illuminate this contested moral terrain. (shrink)

Esta conferencia formó parte del encuentro “Archivos Sonoros y cultura popular” realizado el 17 de septiembre de 2019 en el marco del Coloquio sobre Memorias Populares organizado por Doctorado en Historia y la Maestría en Historia y Memoria de la FaHCE junto a la presencia del historiador italiano Alessandro Portelli. En dicha conferencia, las autoras presentaron el archivo oral “Memorias encontradas” de la Comisión por la Memoria (CPM). Por un lado, relataron la historia de la producción y recolección de entrevistas (...) surgidas a partir de los distintos trabajos de la CPM y, por el otro, reflexionaron sobre algunas particularidades de la serie “El archivo y el testigo”: el contexto de producción, el diálogo entre el relato oficial/policial y la voz de las y los testigos, los distintos modos de narrar, de contar. Sometime ago, I found myself using the diagnosis of a student’s depression as a critical tool of interpretation, searching for signs of mental illness in her essay that explored order and disorder in T. S. Eliot’s The Waste Land. I realised that my reading had become a creative act, combining poem, poet, student essay and author to create, in a sense, one readable text. The present paper is a reflection upon the processes of order and disorder located in a diagnosis (...) of “madness” and the readings of writer and text this diagnosis initiated.
