The efforts to prove God's existence in the history of thought have been one of the fundamental problems of philosophy and theology, and even the most important one. The evidences put furword to prove the existence of God constitute the center of philosophy of religion’s problems not only philosophy of religion, but also the disciplines such as theology-kalam and Islamic philosophy are also seriously concerned. Especially in recent times, religious experience has often been regarded as evidence of the existence of God. Studies in the field of religious and mystical experience have put forward many arguments concerning the use of religious experience as evidence. However, this study has been limited to experience of sense and pure consciousness claims rather than examining all of these arguments. In this study firstly, the analogy between experience of sense and religious experience will be deal with, and then claims that conciousness can be emptied by a number of methods which are defended by mystics. In addition, it will be tried to defend the opinion that the mystical experiences which are the common point of the two approaches are valid. The main emphasis of the article will be that these arguments can be used as evidence for the existence of God.Summary: Religious experience - which has not been considered as one of the classical evidences regarding the existence of God before being popular by recent studies – is started to be called one of the arguments. The most important reason for not arguing religious experience among the evidences of God’s existence is that it is a personal experience and therefore contains subjective perspectives. However, many researchers, who refuse to accept the criticism raised against religious experience with restricting to subjectivity, emphasized the importance of religious experience by highlighting the objective aspects of such experiences. Especially, the thinkers who are connected with the philosophy of perennialism and defend this approach, thought that people, who have distinct religion, culture, and beliefs in different parts of the world and in various time periods, had the same experience and considered such experiences were universal by suggesting that this similarity could be called as common essence.Even though the claim which offers that the events of pure consciousness are the same everywhere have been criticized in many respects, the advocates of this approach have argued that the experience has the common essence, but the interpretation is different. This relationship, which was tried to be established between experience and commentary, caused a lot of work for both the thinkers who put forward the claims of pure consciousness and the researchers who opposed it. However, examining the relationship between experience and interpretation requires serious studies in socio-psychological, cultural and religious fields. Therefore, in order not to exceed the limits of the article, the relationship between experience and interpretation is briefly mentioned.While discussing two arguments, the main claims of the arguments were addressed, and the criticisms directed to this argument were not discussed as much as possible. However, some fundamental criticisms have been mentioned shortly for a better understanding of the discussion. Many debates in arenas such as bioethics turn on questions regarding the moral status of human beings at various stages of biological development or decline. It is often argued that a human being possesses a fundamental and inviolable moral status insofar as she is a “person”; yet, it is contested whether all or only human beings count as persons. Perhaps there are non-human person, and perhaps not every human being satisfies the definitional criteria for being a person. A further question, (...) which will be the primary focus of this paper, concerns what essential features of personhood endow persons, human or otherwise, with their moral status and the inherent rights they concomitantly possess. A survey of the history of philosophical theorizing on what it means to be a person yields a broad consensus upon the key capacities being rational thought, self-consciousness, and autonomous volition. It is not sufficient, however, simply to cite these capacities, but to explain why these particular capacities bear moral import. A more recent concern has developed regarding the possible future existence of so-called “post-persons” who, due to their enhanced cognitive and emotive capacities, may be morally superior to mere persons and thereby possess a higher moral status. Christopher Cimorelli's study, (...) the adapted version of a doctoral dissertation completed at the Catholic University of Leuven, Belgium, under the directorship of the noted Newman scholar Terrence Merrigan, appeared in print in 2017. This book is of ongoing relevance, for at least three reasons. (1) No other work since then has replaced or improved upon Cimorelli's close reading and exacting interpretation of Newman's first [End Page 1339] monograph, The Arians of the Fourth Century. (2) There exists no other study on Newman's theology of history in correlation to his development of doctrine of similar depth. (3) Cimorelli has recently become director of the National Institute for Newman Studies (NINS) in Pittsburgh. It is to be expected that the programmatic thrust of this work will inform to some degree the research agenda and the overall theological approach taken at the NINS under his leadership.Cimorelli's book does two things in one: it fills an urgent need in Newman studies, and based on Newman's thought about history, it makes an important—albeit not unproblematic—contribution to the ongoing discussion regarding the development of doctrine by advancing a new theory of the development of tradition. Autorität und Tradition-Authority and Tradition Gadamer's views with regard to authority and tradition grow out of his concepts of preunderstanding and the hermeneutical circle. The effort by the Enlightenment to discredit all authority seemed one-sided to Gadamer because authority is naturally accorded to doctors, judges, professors, and other experts in a field. To acknowledge that they know more about a subject than you do is natural and appropriate. So Gadamer speaks of legitimate authority and illegitimate authority, but authority as a concept seems appropriate. Likewise, tradition inhabits our understanding, and we should seek an ever deeper relationship to our tradition. The German word for tradition is Űberlieferung, that which is handed down. Again, Gadamer takes up arms against the Enlightenment prejudice against tradition as illegitimate without dialogue or a fair trial. 6. Horizontverschmelzung-Fusion of Horizons The "fusion of horizons "is another trademark of Gadamerian philosophy. It is not found elsewhere. Basically, the encounter with the text involves a fusion of horizons, that of the text and that of the interpreter. Also one's own consciousness is a product of a fusion of horizons with the tradition. "Even to acquire one's own horizon requires a fusion of horizons with the tradition." Every conversation, too, involves a fusion of horizons. It is an all-purpose term. 7. Conversation Conversation is a leitmotif of Gadamer's hermeneutical philosophy, an ideal he lived by, an openness he exemplified. Schleiermacher was a gifted conversationalist, as was Gadamer. But a fruitful conversation requires openness to the viewpoint of the other person, and the acknowledgement that he or she could be right. In a true conversation both partners want to come closer to the truth about a matter, and that is more important than winning. Ibogaine is a hallucinogenic alkaloid, derived from Tabernanthe iboga, a plant unique to the rainforests of West Africa. Its traditional use as an epiphanic sacrament in local magico-religious practice inspired its appropriation by Western drug addicts by whom it is now hailed as both a catalyst of psychospiritual insight and an effective alleviator of cravings and withdrawal. While scientific and early clinical studies confirm its role in reducing physical withdrawal and craving, debate continues concerning the significance of its “visionary” (...) properties. An analysis of many addicts’ testimonies of recovery, however, places the visionary experience at center stage. I set out to understand mechanisms of transformation and healing, via a comparative phenomenological exploration of this experience, through the opposing lenses of psychoanalysis and cultural constructivism. I propose that at the heart of the healing encounter is a culturally shaped creative journey to an imaginal unspoilt state in personal or collective history. How this experience is recovered and integrated into life is critically considered. I argue a secular account is vital as the ibogaine scene strives toward social and medical legitimacy. If and how such a framework can sit alongside spontaneously emergent spiritual and religious idioms and experience will also be tentatively explored. (shrink)

Human beings who have mastered a natural language are self-conscious creatures: they can think, and indeed speak, about themselves in the first person. This dissertation is about the significance of this capacity: what it is and what difference it makes to our minds. My thesis is that the capacity for self-consciousness is essential to rationality, the thing that sets the minds of rational creatures apart from those of mere brutes. This, I argue, is what Kant was getting (...) at in a famous passage of his Critique of Pure Reason, when he claimed that a representation which could not be “accompanied with the ‘I think’” would be “nothing to me” as a thinking being. I call this claim the Kantian thesis. My dissertation seeks to explain and defend the Kantian thesis, to show how it entails that the advent of self-consciousness brings with it a new kind of mind, and to sketch the implications of this point for a philosophy of mind that seeks to understand the minds of rational creatures. This involves, on the one hand, an investigation of the kinds of capacities that characterize a rational creature, and, on the other hand, an argument connecting reason with self-consciousness. I show that a rational creature, in the interesting sense, is one capable of conceptual representation, and I argue that (1) to represent conceptually is to represent in a way that decouples information from any particular context or purpose, (2) this special form of representation is possible only in a creature that can reflect explicitly on grounds for judging a proposition true, and (3) to have this capacity to reflect explicitly on grounds is necessarily to have the crux of self- consciousness. If this is right, then the representations of a rational creature must differ from those of a nonrational creature not merely in complexity but in kind. The dissertation sketches the implications of this point for various forms of naturalism and reductionism in the philosophy of mind, for debates about how to explain “first person authority,” and for our understanding of the sort of failure of self-consciousness involved in self-deception. Recent work in neuroimaging suggests that some patients diagnosed as being in the persistent vegetative state are actually conscious. In this paper, we critically examine this new evidence. We argue that though it remains open to alternative interpretations, it strongly suggests the presence of consciousness in some patients. However, we argue that its ethical significance is less than many people seem to think. There are several different kinds of consciousness, and though all kinds of consciousness have some ethical (...) significance, different kinds underwrite different kinds of moral value. Demonstrating that patients have phenomenal consciousness — conscious states with some kind of qualitative feel to them — shows that they are moral patients, whose welfare must be taken into consideration. But only if they are subjects of a sophisticated kind of access consciousness — where access consciousness entails global availability of information to cognitive systems — are they persons, in the technical sense of the word employed by philosophers. In this sense, being a person is having the full moral status of ordinary human beings. We call for further research which might settle whether patients who manifest signs of consciousness possess the sophisticated kind of access consciousness required for personhood. (shrink)

Background: This study is based on the ontological assumption about human interdependence, and also on earlier research, which has shown that patients in psychiatric hospitals and their relatives experience suffering and indignity. Aim: The aim of this study is to explore the experience of patients and relatives regarding respect for dignity following admission to a psychiatric unit. Research design: The methodological approach is a phenomenological hermeneutic method. Participants and research context: This study is based on qualitative interviews conducted with six (...) patients at a psychiatric hospital and five relatives of patients who experienced psychosis. Ethical consideration: Permission was given by the Regional Committee for Medical Research Ethics in Western Norway, the Norwegian Data Protection Agency and all wards within the hospital in which the patients were interviewed. Findings: The analysis revealed one main theme: ‘The significance of small things for experiencing dignity’ and four subthemes described as follows - ‘to be conscious of small things’, ‘being conscious of what one says’, ‘being met’ and ‘to be aware of personal chemistry’. Discussion and conclusion: Staff members seem not to give enough attention to the importance of these small things. Staff members need to explore this phenomenon systematically and expand their own understanding of it. (shrink)

Deixis is the thing referred to by linguistic units outside the text or the discourse. The act of demonstrating or indicating the elements of a state through gestures or linguistic units is called deixis. Deictic is the name given to the linguistic elements such as pronouns, demonstrative nouns and adverbs which refer to the personal, spatial or temporal aspects of a speech act and which are, therefore, all directly related to the context surrounding its act of communication. Since the (...) references of the deixis expressions can only be identified within the context of actual communication, the subject is considered as a part of the pragmatics. This study aims to analyse the demonstrative nouns used in Qur’anic verses within the context of deixis and types of deixis, which are research areas of pragmatics, and to identify the types of deixis used in Qur’an. This study also aims to provide insight about how to present the references of demonstrative nouns especially in Qur’anic translations to be understood correctly by the readers. This is because the translations of Qur’an are presented in written form and the references of the deictic units are not expressed clearly in some of them. In this case, it is assumed that the reader might have difficulty understanding the meanings of the deixis such as “this, to this, these”. This study, firstly by studying deixis and types of deixis from the modern linguistics and pragmatics resources, aims to form a conceptual framework. After the first chapter, upon which the main problem of the study will be built, is completed, the demonstrative nouns are analysed in terms of their structural and referential aspects within balâg̲h̲a and tafsîr sources, classical Arabic language nahw sources being in the first place. After the obtained data is analysed, by associating the demonstrative nouns in Qur’anic verses to types of deixis, anaphora and cataphora, their references are determined. In this direction, firstly the demonstrative nouns in Qur’an will be identified and the type of deixis is tried to be explained by providing one example for each one of the demonstrative nouns in terms of their referential variety. For this purpose, this study highlights the demonstrative nouns which cannot be directly understood but only can be identified by checking the context. That is, the demonstrative nouns which take adjectives or which are adjectives themselves will not be included in the scope. The references of these nouns existing in the verses will be specifically analysed within the classical tafsîr works. This study is significant as it reveals the references of the demonstrative nouns by analysing the types of deixis in order to understand Qur’an more accurately. Though there are various studies regarding the demonstrative nouns, there are no studies found analysing the references of these nouns according to their types of deixis. With this study, it is understood that classical tafsîrs mention the deixis, types of deixis, and the references anaphora and cataphora for demonstrative nouns. As the demonstrative nouns, which are deictic elements, are used to point to all types of living and non-living creatures, they are considered as indefinite things. It is understood that for the other interpreters, the vagueness can only be eliminated by taking pragmatic factors such as the speaker, listener and the context of communication into consideration. 20 types of demonstrative nouns were used for a total of 1047 times in 89 different surahs. These demonstrative nouns are as following: “ذا، هذا، هذان، هاتين، هؤلاء، ذلك، ذانك، ذلكما، ذلكم، تلك، ذلكن، هذه، أولئك، أولئكم، أولاء، كذلك، كذلكم، هاهنا هنالك، ثم”. The fact that demonstrative nouns are used so often in Qur’an prove that these nouns are quite important in understanding the Qur’an. This study addresses the verses with demonstrative nouns in terms of types of deixis, as part of pragmatics, by referring to classical tafsîr and linguistic sources. It has been determined that demonstrative nouns in Qur’an make personal, spatial or temporal references, discourse deixis, anaphora and cataphora, however they do not perform as social deixis. It has been concluded that identifying the references of demonstrative nouns is quite important in understanding and interpreting Qur’an correctly. It is also understood that the methods to determine the references of demonstrative nouns by the sources used in the study have pragmatic characteristics. It is observed that the references of the demonstrative nouns are not presented in certain Qur’an translations. In this context, it has been concluded that stating the references of these nouns in written form for the translation of Qur’an into different languages is vital for these references to be understood correctly. It has also been concluded that it is a requirement in terms of pragmatics to take the references of the deictic elements mentioned especially in the primary sources into consideration. (shrink)

This essay contends that the debate between subjectivism and objectivism in ethics is better understood as a dispute among three alternatives: subjectivism, objectivism, and intrinsicism. Ayn Rand has identified intrinsicism – the belief that certain things are good “in, by, and of” themselves – as the doctrine that is actually operative in many defenses of moral objectivity. What intrinsicism fails to appreciate, however, is the significant role of the subject, the person to whom and for whom anything can be valuable. (...) Objective value, in Rand's view, is relational. Its existence depends on contributions of both external reality and human consciousness. Values are not reducible to psychological states, as in subjectivism, but nor are they independent of them, as in intrinsicism. Objectivity in ethics is attained neither through revelation of the intrinsic property of goodness nor through the subject's creation of goodness, but through a rational procedure of evaluation that is governed by the method of objectivity. This essay is in three parts, explaining Rand's view of exactly what intrinsicism is; elaborating on her view of the nature of moral objectivity; and highlighting certain features that make plain the differences between an intrinsicist and an objectivist account of value. The article discusses human dignity in the aspect of modern challenges of technological civilization, which has entered a new stage of its development. Human dignity as a category of ethics remains underestimated, since in the first row of ethical values humanitarians, as a rule, put the categories of freedom and justice. Today, “dignity” acquires a special and higher status, the concept of human dignity is being rethought, going beyond the ethical category itself as a virtue. In the global world, human (...) dignity is a response to such contemporary challenges as the formation of a communicative world community with a focus on digital civilization, the anthropological problem of the future of humanity, the ecological situation on a global scale, the reorientation of the ethical and legal relations of a globalizing world. Human dignity is a problem of national-ethnic and national-state relations in the transition to transnational regulatory interactions. In the interpretation of the nation, the authors do not share the well-known two approaches to understanding the nation, on the one hand ethnocultural, and on the other - national-civil. Both approaches lead, whenever possible or necessary, to the transnational posing of the question, when human dignity becomes a priority regardless of nationality. In this connection, the utopian idea of the possibility of a global ethos is touched upon. The authors focus on the anthropoxy-axiological approach to the understanding of human dignity, where the cosmological principle of human existence is determined by his creative power. The urgency of the problem of human dignity is due to the fact that, as it were, in the modern life world a person did not put the economy above morality, the basis of human dignity in its being is a value moral consciousness, in the depth of which basic human values of transnational nature “work”, contradicting values consumer society driven by practical interests. Human dignity in this regard should be interpreted as an absolute value and at the same time one should take into account the multidimensionality of the problem of dignity in the context of modern globalization processes. Based on the ontological understanding of globalization as megatrends in the self-movement of the natural historical process, the authors substantiate the anthropological value of human dignity, which has universal, transcultural significance. The use of an anthropoxy-axiological approach and interdisciplinary methods reveals the universal value of virtue, based on the anthropo-social moral nature and the creative value of man. The creative transformational activity itself will not be worthy in quality without moral responsibility. The modern concept of human dignity is addressed to the ethics of responsibility, which means responsibility, which highlights the moral and axiological attitude to life, the adoption of responsible decisions in modern conditions of sociocultural interactions. In the context of globalization, the philosophy of human dignity becomes the dominant of all conscious-volitional activities, the core of the moral rethinking of the transnational and national ratio in the light of tolerance, the ability to non-violence. At the same time, the authors indicate in the formulation of the main issue of the philosophy of human dignity the possibility of going beyond the ethical category of human dignity, since the unchanging core of the universal human values of goodness-beauty-truth does not lose its meaning in the global, changing world. Although there are many other debts to Plato in Gadamer, I point to these two and testify to Gadamer's gifts as a conversationalist and debater. I single out three concepts of Aristotle that Gadamer used: phronesis, mimesis, and tragedy. Phronesis is the practical wisdom that goes beyond calculative reason. It is based not on formulas that can be learned but on experience of life . Mimesis in Aristotle is not just copying, but on a recognition that ultimately conveyed truth about life. Finally, tragedy for Aristotle is not just a structure with six parts but an experience of pity and terror that transformed the perspective of the viewer. This was important in the hermeneutics of Gadamer that looked at the viewer's experience of recognition and application, a participatory experience of the meaning of the action of the tragedy. Gadamer is indebted to Hegel for the historical character of consciousness, the Hegelian dialectic, and the recognition that that art is a sensuous representation of the real. He did not agree with Hegel that art was a thing of the past, and also explained what Hegel meant by this: we no longer saw art as a disclosure of the divine. I mention an experience I had of Heidegger's visit to Heidelberg, where he spoke after Gadamer's lecture rejecting his effort to connect his dialect of clearing and concealing with Hegelian dialectic, because Hegel's philosophy always ended in absolute knowledge. For the second major part of the lecture, I turn to an analysis of Gadamer's essay on art, The Relevance of the Beautiful , comparable in a way to Heidegger's famous lectures on The Origin of the Work of Art . In the latter work, Heidegger declares his independence of his masterwork and presents art in terms of the tension between earth and world. In Gadamer's essay on art, he goes beyond the Heideggerian emphasis on the ontology of the artwork by seeking to establish the anthropological roots of art in Greek culture. He discusses the roots of all culture in play, the significance of the symbol, and the meaning of religious festivals. But he begins with an analysis of the problem of formulating a theory of art that does justice both to classical art and contemporary nonrepresentational art. In all three elements, play, symbol, and festival, Gadamer finds a foundation for art in the deep roots of our culture as found in the ritual, dance, and tragic plays of ancient Greece. (shrink)

Based on the hypothesis that the selfhood is the last outpost of sociality within a person, consciousness and the self are considered as complex spiritual and material phenomena, they include at least three main components: neurobiological activity, intimate personal environment and social context. The author analyzes an internal materialistic perspective, which infers the reduction of self and consciousness to ordinary neural processes of the brain. With this perspective, the main thing for neural activity is to maintain homeostasis, first, within (...) the brain itself, and then within the organism as a whole. Based on the latest achievements of neuroscience and the constructions of neurophilosophy, the impossibility of a significant accentuation of the production of the self against the background of the default activity of brain activity is demonstrated. The concept of protoconsciousness is introduced. In its context, it is shown that even the simplest ones can use complex algorithms for processing information, correcting behavioral errors to ensure effective existence in the life world intended for them. As a result – there is an integrative behavior, when one or another of its elements is not just a single reaction to a stimulus but formed as a result of the execution of a certain algorithm (of yet not clear structure and origin), data and commands for which come from several sources. Attention is drawn to the fact that even for a quite simple behavior there is need for some built-in spatio-temporal matrix which will be typologically similar to Kant’s forms of perception. From the standpoint of a materialistic perspective, it is proposed to consider rationality and the self, which is associated with it, as a kind of superstructure over the outconscious interaction with reality that our biological predecessors developed. However, both rationality and the self inevitably presuppose a return to sociality, without which neither the first nor the second can be conceived. (shrink)

A person, usually a child, enters civilization after having been raised by wolves or kept in some kind of cruel captivity. The outsider perspective on domestication ensuing in an edge of a culture's self-recognition of its clumsier attributes, what has been taken for granted becomes apparent, is brought to the foreground with the stranger and made questionable. Amusement follows naïve questions or observations such as Kaspar Hauser in the Herzog film, The Enigma of Kaspar Hauser, when Kaspar notes that while in his room he is engulfed by it, but when he looks at the tower he can turn away and it disappears. Ergo, the room is larger than the tower. How entertaining. The aberrant one destabilizes the comforting cultural normative. Places become seen as mere impressions out of space, a patterning, a rut that not everyone lives in like us. This is one figure of the feral. The naiveté that begs all the questions. As a figure for a certain philosophical disposition, the rapidity of one’s saccade scans the environment, intuits it’s space, not from an initial thaumazein or a Critchlean sense of disappointment, but from a child-like naiveté bent on survival. To serve the naïve is merely one form of critique, and it is not nearly used enough in lieu of the critique that provides answers. How dull. It is not necessary to be an outsider to entrench a critique with naiveté. After having forced to suffer in the most parched and rocky terror, itself for so long rooted upwards of fifty feet into the ground upon which it grows, even a grapevine can spontaneously produce a white grape on a red vine. The curious feral can arise from within, and like pinot grigio, it adds variety without admonishing its roots. There is also the feral dog. Not raised by wolves, but humans. Founded in place the figure of this feral denies this place. The trajectory of this feral roves from the cultivated to uncultivated, or in speaking of plants from controlled to volunteer, finding the necessary nutrients and survival patterns on its own. Finding other places, reaching out into space testing its fertility. And when introduced into a foreign environment, it withers or flourishes. We would like to attempt a thesis at this juncture and to accept neither feral figure in its entirety, but to argue for the intimate conjunction between a cultivated place and its resonance with the space it procures for its nest and kin. There is no para-academic. We all have day jobs. 'Para-academic' seeped through the cracks as an adjective in the call to frame publishing dedicated to the critical rigor expected by academic publishing, but to deny the limitations of guarded legitimation through capital means. Open-access holds hands with this parasitic descriptor. Para-academic publishing's refusal to adhere to the valuation of locked access of a site, the site “of a desperate initiation to the empty form of value,” 1 seeks to recognize not merely an inclusive interpretation of significance, but the significance of thinking practice. The practice inside the paywalls of academic 'education' is held in a deathgrip by its infatuation with value and information, both empty without the apprehension of human experience, the barbaric yawp. “I can't breathe in here.” It is not that a para-academic practice leads one to the childish wonder of Kaspar Hauser who wonders about the spatiality of his room. It is the academic legitimation that distorts that one can hold the understanding of both in a constellation of place and space. Led to believe there is only a place for things, we are led to disillusionment. It is also not that a para-academic practice relinquishes itself to the invasive growth outside of careful cultivation, an abandonment of pleasantries for the toothy growl of a predator. It is the academy's fear that thought does not require capital to signify value. Some of the most nutritious meals can be foraged. Defining a para-academic practice is not outlining a place of accreditation of the practice, it is the recognition that any place is subject to modulation by the space it inhabits as well as creates. The para-academic practice keeps an eye of the creation of spaces, follows those paths that eat themselves in the name of academia. This is not unlike Red Peter's report to the academy, only successful if we report in idle idiosyncratic banalities that we have once again become victorious in our acculturation and nullification within the confines of accredited mush and our trajectory of wild rigor is defeated in our desire for recognition as recognizable in this place. Weeds are integral to the functioning of a large ecosystem. The manicured garden is entirely reliant on its keeper. The pansy can also go wild once neglected, the daisy definitely does.... a universe comes into being when a space is severed or taken apart. The skin of a living organism cuts off an outside from an inside. So does the circumference of a circle in a plane. By tracing the way we represent such a severance, we can begin to reconstruct, with an accuracy and coverage that appear almost uncanny, the basic forms underlying linguistic, mathematical, physical, and biological science, and can begin to see how the familiar laws of our own experience follow from the original act of severance. The academy is a muddy spot, it is fertile, but its gates are high and its dogs are barking. The coordinates of concept and experience. Already claimed by a stabilizing suspension, the terms enter specificity of ‘this is this’. Another correlation: activity and the individual. The individual, a placeholder in the crosshairs of juridical identification. Activity, what expands and surrounds this location, but utterly indebted to the node of “one who”. What's happening in this oscillation of nature and nurture is practice. Practice, as Stengers tells us “is not the activity of an individual or the product of that activity. It is the ingredient without which neither that activity nor this product would exist as such.” 3 Moving outward from our own honing, we're curious about the ingredient creating the place for holding conceptual and experiential engagements in each hand. And we'd like to argue that this place is not a limiting specification, but a practice undulating daily, by the minute. And we call this practice the para-academic practice. Without a para-academic practice, the scholar spends half the time merely working on behalf of a hierarchy, to maintain it, and the other measly amounts of time are in the name of thinking, but only in name. Not to mention the amount of debt it takes to attend the halls of higher education. Not to mention the snoring tenures. Not to mention the barely scraping by adjuncts. Not to mention the materials that shake the very force of producible theory. Not to mention when swimming in texts becomes slogging through data. Academia is a barbaric food chain and it is our claim that there is, as always, an imperative for thought to move, with Heidegger, beyond the logics of calculation and planning, to a time of its own. The path, into the panic of the dark wood of this space can be followed by any; any who let the silence and the rigor enter the play. The validity of Louise Rosenblatt's transactional theory of the literary work, expounded in Literature as Exploration and The Reader, The Text, The Poem, and its relevance for contemporary educators, particularly in the field of English education, has recently been reasserted by Jeanne Connell in her timely and cogent article in this journal. 1 The present article, however, seeks to refocus debate by problematizing and subsequently developing some aspects of key theories such as Rosenblatt's while examining the individual and social nature of reading in schools. Rosenblatt's view that aesthetic experiences can have both social origin and effect certainly deserves further theorizing if aesthetic experience in school communities and classrooms is to flourish.The influence of John Dewey's Art as Experience upon Rosenblatt is evident as this seminal text conceives of our primary task as the restoration of "continuity between the refined and intensified forms of experience that are works of art and everyday events." 2 Such continuity with experience is vital because, for Dewey, "experience is the fulfillment of an organism in its struggles and achievements in a world of things, it is art in germ." 3 Applying such a notion to education in schools, Rosenblatt saw the aim of literature lessons as the growth of experience rather than the acquisition of knowledge. The basic concepts 'person' (Person), I/self (Ich) and 'subject' (Subjekt) structuring the Russian discourse of personhood (Personalität) developed during the philosophical discussions of the 1820s-1840s. The development occurred in the course of an intense reception of German Idealism and Romanticism. Characteristic of this process is that the modern meaning of personhood going back to the theological and natural-law interpretations of the person in Western Europe does not exist in the Russian cultural consciousness. Therefore the Russian concepts of personhood demonstrate the (...) influence of the semantic innovations of Romanticism. Correspondingly, the semantic core of the Russian discourses on personhood is not the idea of an 'autonomous person' but that of an 'unique individuality'. Here, personhood is not the indefeasible attribute of every man, but the mark of inimitable individuality. Accordingly, the basic distinction underlying the discourse on personhood in Russia is not the differentiation between 'person' and ' thing' as in the European tradition, but the distinction between 'individual' and (anonymous) 'community'. Also, in the meaning of the concept of I/self the dominant differentiation is not that between I/self (Ich) and not-I/not-self (Nicht-Ich), but that between I and We. This discourse on personhood centring on the idea of individuality took form in Russia starting in the middle of the nineteenth century, in particular in aesthetics, psychology, and educational theory, as well as in the philosophy of history. The comparative intercultural analysis of the history of concepts pertaining to personhood in the German-Russian cultural transfer brings to light the dialectic of European modernity in which a degree of tension is visible between the idea of personal autonomy and individuality. The Cognitive Reflection Test is purported to test our inclination to overcome impulsive, intuitive thought with effortful, rational reflection. Research suggests that philosophers tend to perform better on this test than non-philosophers, and that men tend to perform better than women. Taken together, these findings could be interpreted as partially explaining the gender gap that exists in Philosophy: there are fewer women in Philosophy because women are less likely to possess the ideal ‘philosophical personality’. If this explanation for the gender (...) gap in Philosophy is accepted, it might be seen to exonerate Philosophy departments of the need to put in place much-needed strategies for promoting gender diversity. This paper discusses a number of reasons for thinking that this would be the wrong conclusion to draw from the research. Firstly, the CRT may not track what it is claimed it tracks. Secondly, the trait tracked by the CRT may not be something that we should value in philosophers. Thirdly, even if we accept that the CRT tracks a trait that has value, this trait might be of limited importance to good philosophising. Lastly, the causal story linking the gender gap in CRT score and the gender gap in Philosophy is likely to be far more complex than this explanation implies. (shrink)

Ever since the work of Louis Mackey, Kierkegaard: A Kind of Poet, English-language Kierkegaard scholarship has struggled to do justice to the literary-poetic as well as theological-philosophical aspects of the Danish authorship. The first part of this paper traces the development of this debate, noting how Kierkegaard, often in the journals and papers, comments on specific intellectual and doctrinal claims of the Christian faith. The debate between these two ways of reading and understanding is frequently viewed as an impasse. In (...) a second part, the paper endorses and makes a case for a way of reading Kierkegaard neither as “a non-doctrinal literary provocateur” nor as a “non-literary dogmatist.” For all of the difficulty that they pose to interpreters, Kierkegaard's literary stratagems are designed to challenge a reader to wrestle with doctrinal claims amid the struggles of personal existence. Granted, facing such urgent problems as war, poverty, and environmental degradation, few if any of us would urge them to put their activism on hold until they clarify their theoretical foundations. Yet given how these Buddhists have diverged on such issues as abortion, homosexuality, intoxicants, possible legitimate uses of violence, and sexual contact between Buddhist teachers and students, further theoretical labor would sharpen their praxis and develop Buddhist social ethics.In this respect, David Loy's The Great Awakening deserves a close read. Though not pursuing the degree of systematic theorizing implied by the subtitle, A Buddhist Social Theory, Loy takes a significant step in that direction. After expounding on Buddhist dukkha (suffering) and linking it to "social dukkha" (ch. 1), Loy offers discerning treatment of poverty (ch. 2), globalization (ch. 3), corporations (ch. 4), the "war on terror" (ch. 5), crime and punishment (ch. 6), violence (ch. 7), technology (ch. 8), and worldviews that exacerbate or help resolve our environmental crisis (ch.9). [End Page 170]Drawing on two of his previous books, Nonduality and Lack and Transcendence, Loy deploys the constructs of nonduality and lack to grapple with these issues. Working over the "three marks of existence" (suffering, impermanence, and no-self), Loy sketches adroitly how the vague recognition that we lack any substantial self or soul leads us to engage in fearful "reality projects," attempts to "ground" ourselves "by modifying the world" (p. 164) or by objectifying ourselves as something real in the world (p. 22). This response to "lack" is exacerbated by dualistic ways of knowing: "The sense of duality between ourselves and the world feeds our insecurity and therefore our preoccupation with power, which we seek in order to secure ourselves. The unfortunate fact that we never feel secure enough is experienced as a lack of sufficient power" (p. 29). Overall, Loy's presentation of the cause of suffering (dukkha) in terms of lack, fear, reality projects, and dualism augments well the traditional Buddhist focus on clinging and ignorance of impermanence.Loy develops his analysis by expounding on the three types of suffering outlined in the Pali canon and their connection to social dukkha. He amplifies the construct of the "three poisons" (greed, ill will, and delusion) by highlighting their "institutionalization" and the ways in which capitalism promotes and spreads these mental states (pp. 80–86). And, proceeding along this trajectory, he expands the scope of the traditional antidotes to the three poisons: "Collectively as well as individually, institutionally as well as personally, greed must be transformed into generosity, ill will into loving-kindness, ignorance into wisdom" (p. 29). In this volume, Geoffrey Madell develops a revised account of the self, making a compelling case for why the "simple" or "anti-criterial" view of personal identity warrants a robust defense. Madell critiques recent discussions of the self for focusing on features which are common to all selves, and which therefore fail to capture the uniqueness of each self. In establishing his own view of personal identity, Madell proposes that there is always a gap between ‘A is f and g’ and (...) ‘ I am f and g’ ; , that a complete description of the world offered without recourse to indexicals will fail to account for the contingent truth that I am one of the persons described; and , that an account of conscious perspectives on the world must take into account what it means for an apparently arbitrary one of these perspectives to be mine . Engaging with contemporary positions on the first person, embodiment, psychological continuity, and other ongoing arguments, Madell contends that there can be no such thing as a criterion of personal identity through time, that no bodily or psychological continuity approach to the issue can succeed, and that personal identity through time must be absolute, not a matter of degree. This study has two goals: first, to show that Avicenna’s account of being and thing significantly influenced Aquinas’s doctrine of the primary notions; second, to establish the value of adopting a mereological construal of these primary notions in the metaphysics of Avicenna and Aquinas. I begin with an explication of the mereological construal of the primary notions that casts these notions in terms of wholes and parts. Being and thing refer to the same entitative whole and have the (...) same extension, but they are distinct in intension according to the different entitative parts they signify. Existence and essence constitute the two most fundamental entitative parts of every entitative whole. Being is taken to mean that which has existence, and thing signifies that which has essence. I then show how this mereological construal of the primary notions clarifies a number of texts in Avicenna and Aquinas. Metaphysics and ethics are two distinct fields in academic philosophy. The object of metaphysics is what is, while the object of ethics is what ought to be. Necessitarianism is a modal doctrine that appears to obliterate this neat distinction. For it is commonly assumed that ought (at least under normal circumstances) implies can. But if necessitarianism is true then I can only do what I actually do. Hence what I ought to do becomes limited to what I in fact do. (...) This is one widespread way of construing the danger that necessitarianism poses for ethics. There is, however, another way in which this collapse of what is with what ought to be can be construed. One could think of what is as already being what ought to be, of the two being one. On this picture, everything that is, is already valuable. In this thesis I explore the theory that being is intrinsically valuable. I do so by investigating the philosophy of perfection present in the works of the early modern rationalist Spinoza. For in his philosophy of perfection, I argue, we find being and value to be perfectly aligned. Hence, my reading challenges a widespread interpretation, according to which (ontological) perfection is divested of normativity in Spinozism. The position that all being is intrinsically valuable since it is perfect may be thought to be incompatible with human perfectionism. For what room can there be for human progress toward an ideal of perfection if all that exists, is necessarily perfect? The goal of the thesis is to respond to this question by providing a systematic interpretation of the metaphysics of human perfectibility in Spinoza’s philosophy. In order to achieve this goal, I undertake two tasks. First, I examine Spinoza’s multi-faceted philosophy of perfection. I distinguish between ontological and teleological perfection. Moreover, I argue that since Spinoza maintains that everything is perfect to the extent that it is, perfection shoulders the role of a transcendental within his system. In order to highlight the normative significance of transcendental perfection, I compare Spinoza’s thought with the transcendental theory of the good in Thomas Aquinas. In addition, I distinguish between ontological and speculative perfection. Speculative perfection is conscious awareness of ontological perfection. Second, I show how infinity plays an essential role in Spinoza’s ethics by indicating how we, by availing ourselves of this notion, are able to acquire a perspective on reality from which its ontological perfection may be discovered. On this basis, I am able to demonstrate the (relatively understudied) ethical and soteriological importance of Spinoza’s conception of infinity. I argue that it is because (a) Spinoza’s ideal of human perfection is speculative, and because (b) one will be able to establish the (ontological) perfection of things by deducing it from the divine essence only when one considers this essence absolutely infinite, that (c) the absolute infinity of the divine essence plays a significant role in Spinoza’s account of human perfection as consisting in conscious awareness of the value of all being. As a Cold Warrior, he designed logical systems that modeled "rational" human and machine behaviors, and yet he was largely oblivious to the emotional damage his irrational personal behavior inflicted upon his family, lovers, and business partners. He died young, but left behind a fascinating record of his life, including correspondence with such philosophically inclined physicists as Niels Bohr, Norbert Wiener, and John Wheeler. These remarkable letters illuminate the long and often bitter struggle to explain the paradox of measurement at the heart of quantum physics. I will examine potential affinities between Eckhart and Buddhist thought with the modest hope of identifying areas in Eckhart's mysticism that may present themselves as particularly ripe for Buddhist-Christian conversations.On April (...) 15, 1329, Pope John XXII issued the bull "In agro dominico" that condemned tenets of Meister Eckhart's teaching. Pope John XXII, who had also dealt harshly with the spiritual Franciscans, was truly concerned about Eckhart's seductive impact on the uneducated in the pews.1 Eckhart's claim that every human's true identity, attainable through detachment, is divine must have created dreams in some of an unmediated experience of and union with the divine, and nightmares in others of the bypassing of the Church's structures, sacraments, and hierarchies.Eckhart, a University of Paris teacher and a preacher, bases his mysticism in part on Proclus and Dionysius the Areopagite. Similarly to Proclus, Eckhart proposes that the soul's circular journey runs from the nothingness of the God beyond God, the God beyond the Trinity, into the somethingness of the world, and back to the nothingness of the God beyond the God. There is a firm ontological link between the One, the Trinity, and creation, which means that creation in its core is Trinitarian and One. In his interpretations of Job 22:14 and Ps. 61:12, Eckhart demonstrates that God is never static as One or Three or creation, but God is at once dialectically One and flowing out into the persons of the Trinity and flowing over into creation.2 This continuity between the Creator and creature, time and eternity, sanctifies creation and transience in all its grittiness and overcomes a duality between Creator and creature similar to the interpretation of samsara and nirvana (conditioned reality is Boundless Openness in Mahayana thought). Furthermore, Eckhart maintains that the One, as transparent and transcendent nothingness, encompasses and penetrates all. The wondrous truth, for Eckhart, is that we are truly all in all, just like the center of the circle is everywhere and its circumference nowhere.3 [End Page 111]To his audience, Eckhart repeatedly underscores that the soul is ontologically rooted in the nothingness of the divine unity and is thus in its deepest essence divine. In fact—and here we find profound resonances with tenets of Buddhist thought such as the concept of no-self (anatta or anatma)—the self's only true existence is the divine nothingness. Contrary to such thinkers as Thomas Aquinas, Eckhart focuses on the principal existence of things in the godhead and maintains that the human being does not possess a true substantial existence or "I" apart from God.4 Hence, the "I" or self can never constitute the foundation of reality. Because of the human being's absolute ontological dependence on God, Eckhart can assert that "where God is, there is the soul, and where the soul is, there is God."5 In his writings, Eckhart therefore differentiates between the true existence that creatures have in their original cause, the esse virtuale, and the particular and ephemeral existence that creatures possess in themselves, the esse formale.6 Thus, instead of autonomy and possessive individualism, "theonomy" implies the realization of the human being's full potential.While the autonomous, individual self is a form of negative nothingness or no-self, it paradoxically constitutes the greatest attachment for the human being. According to property-emergentism, consciousness is an emergent property of certain aggregate neurological constructions, whereas substance-emergentism maintains that the emergence of consciousness depends on the emergence of mental substance or soul. In this article, we presented some arguments supporting substance-emergentism by analysing various properties of consciousness, including the first-person perspective, referral state, qualia, being active, causative, non-atomic, interpretative, inferential and inventive. We also explored the impossibility of representing big images on the small monitor and the incapacity of physical entities being (...) class='Hi'>conscious because of their intrinsic multiplicity, absence and deficiency. These arguments, which apply the philosophy of Mulla Sadra, could be considered by philosophers of mind and religion, as well as theologians who follow some religious beliefs such as the afterlife on existence and survival of the soul. Also, we attempted to respond to property-emergentists' objections to substance-emergentism.CONTRIBUTION: This research contributes to prove and accept the emergence of the immaterial soul after the stages of natural evolution of the body. It uses the basics of emergentism, including natural evolution, to link science and religion in believing the existence of the immaterial soul. Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

THE ordinary attitude of traditional philosophy regarding the argument to God’s existence directs the attention much more to the process of reason by which the human mind arrives at the necessity of affirming the proposition ‘God exists’, than to the real, personal acceptance of God. It is a curious fact, but in the period of modern philosophy this approach is very striking. This attitude was taken up of set purpose and is due, we believe, to a rationalistic tendency in Descartes. (...) That philosophical temper enjoyed an ever-widening influence over minds and systems, whether this new influence was immediate and direct, or indirect and only traceable along a variety of byways. In the end it gained such an ascendancy over modern mental life that any one taking an active part in that life has had to cope with it. Often the influence was not even consciously felt. If it was, however, the thinker had to decide for himself how far he should submit to it, or how much he should resist it. Often enough it took a tremendous mental effort to free oneself from its powerful spell. It is significant that the philosopher St. Augustine is often portrayed as connected with the Cartesian Cogito, ergo sum on account of his famous argument against the sceptically-minded Academicians, Si fallor, sum. If this implies that St. Augustine is of the same mentality as Descartes, it is a complete misrepresentation. His outlook is entirely opposed to this mentality: Verus philosophus, amator Dei. He is not the true philosopher who constructs an argument as to the existence of God, but who verily accepts God in love. (shrink)

ABSTRACT The article examines the limitations of the restitution of property rights approach, with its repercussions for on civil law, and its way of narrating the subject-owner and the thing-good appropriated, in order to address the experiences of harm suffered by displaced and dispossessed peasants in Colombia. Such narration reaffirms the separation between persons and things; reduces the significant potentiality of the relations between peasants and land; and limits the interpretive field of harm and reparation since the experiences of those harmed are not heard. The article highlights the conceptual issues related to Kant’s analysis of the soul, a concept of utmost importance for the metaphysics and psychology of German academic philosophy (Schulphilosophie) of the Enlightenment was significantly dependent on the developed and systematically presented philosophical and scientific ideas and concepts of Christian Wolff. Kantian philosophy, its themes, and conceptual language were formed in the crucible of Wolfean discourse, and from the early 1770s in the struggle against it, which led to the emergence of a (...) new, critical philosophy – transcendental idealism, in which the problem of the soul, consciousness, and self-awareness became fundamental. It is this issue that was thoroughly covered in the «Critique of Pure Reason» and other works that were published later, after the first Critique. The article draws attention to Kant’s Lectures, which, on the one hand, demonstrate his critical attitude towards the so-called Wolfians, their metaphysics, and psychology, and, on the other hand, the lecture materials illustrate Kant's new conceptual position, and, what is important, develop, supplement and clarify it. The sources of Kant’s lectures are highlighted, taking into account the fact that we have at our disposal lecture notes, the authors of which are either unknown or, if known, their authorship is still somewhat doubtful, since they are notes that different people have rewritten. The article analyses lecture notes on psychology, the authors of which are more or less well-known, and experts recognize these notes as quite valid. The conceptual content of these lectures allows us to look at Kant’s understanding of the problem of the soul in a somewhat broader context compared to the «Critique of Pure Reason», where this problem is analyzed in connection with the paralogisms of reason and the transcendental deduction of categories. In his lectures on psychology, Kant draws attention to the problem of the interaction of the soul with the human body, the «location of the soul», linking it not so much to the organs of the human body (for example, the head) as to the location of a person as a bodily being in the world makes all acts of consciousness, self-awareness, and sense perception possible. Kant emphasizes the basic importance of such a spatial location of a person for the soul, as something that belongs to a person with a certain integrity, and not a separate organ, to act properly, to perform its cognitive functions. The article analyses the problem of existence, which is important for critical philosophy, its various modalities, and predication, with a special emphasis on the problem of the existence of metaphysical objects - the soul, God, and the world as a whole. Bullying often results in negative coping in victims, including an increased consumption of alcohol. Recently, however, an increase in alcohol use has also been reported among perpetrators of bullying. The factors triggering this pattern are still unclear. We investigated the role of empathy in the interaction between bullying and alcohol use in an adolescent sample (IMAGEN) at age 13.97 (±0.53) years (baseline (BL), N = 2165, 50.9% female) and age 16.51 (±0.61) years (follow-up 1 (FU1), N = 1185, 54.9% female). (...) General empathic distress served as a significant moderator of alcohol use in perpetrators (F9, 493 = 17.978, p < 0.01), which was specific for males and FU1. Sidgwick’s dualism of the practical reason is the idea that since egoism and utilitarianism aim both to have rational supremacy in our practical decisions, whenever they conflict there is no stronger reason to follow the dictates of either view. The dualism leaves us with a practical problem: in conflict cases, we cannot be guided by practical reason to decide what all things considered we ought to do. There is an epistemic problem as well: the conflict of egoism and utilitarianism shows (...) that they cannot be both self-evident principles. Only the existence of a just God could, for Sidgwick, prevent the conflict and thus solve the dualism. The paper first explores in detail and rejects some reconstructions of the dualism: a purely logical account, and accounts whereby egoism and utilitarianism are principles of pro tanto reasons or of sufficient reasons. Then it proposes a better account, in which egoism and utilitarianism are logically compatible and yet conflicting principles of all things considered reason. The account is shown to fit with Sidgwick’s view of the dualism and of its practical and epistemic pitfalls. Finally, some views are discussed as to the wider positive significance of the dualism, regarded as a challenge to the rational authority of morality, or as indicating the structural opposition of agentrelative and agent-neutral reasons, or again as the imperfect yet amendable attempt at a comprehensive pluralist theory of practical reasons. This book is an examination of personal identity, exploring both who we think we are, and how we construct the sense of ourselves through art. It proposes that the notion of personal identity is a psycho-social construction that has evolved over many centuries. While this idea has been widely discussed in recent years, Andrew Spira approaches it from a completely new point of view. Rather than relying on the thinking subject's attempts to identify itself consciously and verbally, it focuses on (...) the traces that the self-sense has unconsciously left in the fabric of its environment in the form of non-verbal cultural conventions. Covering a millennium of western European cultural history, it amounts to an 'anthropology of personal identity in the West'. Following a broadly chronological path, Spira traces the self-sense from its emergence from the collectivity of the medieval Church to its consummation in the individualistic concept of artistic genius in the nineteenth century. In doing so, it aims to bridge a gap that exists between cultural history and philosophy. Regarding cultural history (especially art history), it elicits significances from its material that have been thoroughly overlooked. Regarding philosophy, it highlights the crucial role that material culture plays in the formation of philosophical ideas. And yet it is almost invariably the case that most, if not all, of these biographical items are gradually lost sight of as the main business of interpreting and criticizing advances. Introduction Descartes held that reflection on "the commonest matters", for example our recognition of a piece of wax, reveals our more fundamental awareness of ourselves. And further, if the [notion or] perception of the wax has seemed to me clearer and more distinct, not only after the sight or the touch, but also after many other causes have (...) rendered it quite manifest to me, with how much more [evidence] and distinctness must it be said that I now know myself, since all the reasons which contribute to the knowledge of wax, or any other body whatever, are yet better proofs of the nature of my mind!2 Even if I only seem to see a piece of wax, when I have no eyes to see and there is no wax before me, I still know something. I know myself. When I judge that the wax is soft I am aware of myself as so judging. When I judge that the wax is hard, I am aware that I_ judge it so. I cannot have knowledge of external bodies without having certain knowledge of myself, because even my mere beliefs reveal my self-knowledge. Descartes exploited the insight that he is more intimately conscious of his own mind than anything else to establish that he is "a mind or a soul... a thing which thinks".3 Philosophers who did not share Descartes' rationalism still held the view that we are intimately conscious of ourselves, and that our awareness of other things enhances our self-awareness, and is epistemically dependent on it. Butler claimed that our awareness of ourselves was beyond doubt, since to doubt that awareness presupposes that we already have it. Whenever we "turn our thoughts upon ourselves" we have 48 "certain conviction, which necessarily and every moment, rises within us" of our personal identity. In A Treatise of Human Nature Hume argues against both the intelligibility of the notion of immaterial substance, and the claim that we have simple awareness of our selves independently of our awareness of other objects. when Hume turns his attention squarely to the topic of personal identity in the Treatise, he has already dismissed the rationalist notion of immaterial substance or soul. He attacks the view which tempted rationalists and empiricists alike, that our awareness of ourselves is distinct from our feeling and thinking, but is often enhanced by such experience. Hume's argument has been and continues to be influential. Recent Wittgenstein interpretation suggests that the Tractatus discussion of the unencounterability of the self in experience is directly borrowed from Hume.5 Chisholm's views concerning self-awareness are motivated in part by problems he locates in Hume's negative argument. Chisholm argues that the report that he finds no impression of self commits Hume to the existence of a subject of experience.6 Most recently, Nozick suggests that Hume did not consider the possibility that our awareness of ourselves might be isolated by employing •7 special techniques, such as yoga or meditation. In this paper I will focus on the passage in the Treatise where Hume reports his failure to find an impression of the self and presents this as an argument against the theory of self-awareness which many philosophers found irresistible. Although Hume's argument has been influential and is often discussed in contemporary literature, the Treatise passage in which it occurs appears confused. The confusion is cleared up only when it is seen that Hume really presents two 49 different arguments against the view that we are intimately conscious of ourselves. Finally I suggest how Hume's actual arguments pave the way for his positive views. 2. The Difficulty Hume's discussion of personal identity in the Treatise begins with his consideration of the view of "some philosophers, who imagine we are every moment intimately conscious of what we call our SELF."8 After characterizing the view, Hume rejects it, having found that we have no idea of self "after the manner it is here explain'd". Thevery image of the world as the semantic substituent to modeled object plays a significant role in a choosing of reference points in communicative space, in particular in political culture. A human being (...) deals with cultural signs, exchanging, absorbing, interpreting and generating them in infinitely growing quantity. Paradigmatic shift aside communicatively-significant relations specifies necessity of a reconstruction reference, that is of actually human personal sense. The person is alienated in new sign dehumanizated environments of culture. Thus, between direct participants of the communications there is a seductive opportunity to take root to socalled intermediaries. The media spaces, inspiring false valuable reference points in artificial way, play the most promoting role in it. Hence, it is necessary to reconsider in cultural-philosophical sense the existing representations in understanding of cultural grasp of the reality both by societies as a whole, and the separate nations. First-Order Representational theories of consciousness — FORs — primarily seek to explain a property’s being phenomenal in terms of the property being represented in experience. Despite differences in both explanans and explananda, HORs and FORs share a reliance on there being such a property as being represented. In this paper I (...) develop an argument — the Unicorn Argument — against both HORs and FORs. The core of the Unicorn is that since there are mental rep- resentations of things that do not exist, there cannot be any such prop- erty as being represented, and thus no such property with which to identify either being conscious or being phenomenal. This article aims to show that Wittgenstein’s remarks on religious belief and religious statements can be understood in modest philosophical terms, consistent with the thought that they are neither intended as serving to justify or undermine religious beliefs, nor as the expression of any theorizing about the nature of religious belief or the meaning of religious language. Instead, their philosophical significance is held to consist in their functioning to remind us of what we already know about the latter: such (...) things as in what circumstances one utters religious statements, what the consequences of accepting or rejecting religious beliefs are, and so on. His position is that all attempts to say something more than this are either a mark of philosophical arrogance or a manifestation of one’s own personal commitment to adopting a stance of religious belief or non-belief. As such, they do not furnish us with genuine philosophical insights. I argue that such an interpretation possess two principal merits. Firstly, it demonstrates that there is no tension between Wittgenstein’s remarks on the nature of philosophy and his remarks on religious belief and religious statements. Secondly, it shows that it is possible to philosophize about religion in a manner that does not assume that this has to consist either in presenting an apology for or critique of religion or in formulating philosophical theories regarding the nature of religious belief and the meaning of religious language. Over the past decade, there has been an extensive debate about whether researchers have an obligation to disclose genetic research findings, including primary and secondary findings. There appears to be an emerging (but disputed) view that researchers have some obligation to disclose some genetic findings to some research participants. The contours of this obligation, however, remain unclear. -/- As this paper will explore, much of this confusion is definitional or conceptual in nature. The extent of a researcher’s obligation to return (...) secondary and other research findings is often limited by reference to terms and concepts like “incidental,” “analytic validity,” “clinical validity,” “clinical relevance,” “clinical utility,” “clinical significance,” “actionability,” and “desirability.” These terms are used in different ways by different writers to describe obligations in different sorts of cases. -/- Underneath this definitional confusion is a general notion, supported by much of the literature, that findings only need to be disclosed when they surpass certain presumably objective or measureable thresholds, such as medical importance or scientific reproducibility. The problem is that there is significant variability in the way that these terms and concepts are used in the literature and, as such, in defining the scope of an obligation to return findings that surpasses the relevant thresholds. -/- The goal of this paper is to analyze the definitional muddle underlying the debate about returning genetic research findings, with the hope of answering a few questions. First, what is the range of definitions being used in this debate? Based on an extensive literature review, Part 1 will lay out a range of articulated definitions for each relevant term, with the goal of categorizing them into a handful of distinct types. Part 2 explains the definitional redundancy and confusion in the current literature, and, drawing from the terminological patterns identified in Part 1, outlines more cohesive building blocks to inform the development of future disclosure frameworks.Our minimum goal in articulating these conceptual building blocks is to promote clearer articulations of, and distinctions between, future disclosure frameworks. More ambitiously, we suggest which definitions and conceptualizations we consider most appropriate to use in future disclosure frameworks. Here, we seek to balance benefits to participants through the disclosure of important information with the minimization of undue burdens on individual researchers and the research enterprise more generally. -/- Our analysis builds upon the central philosophical distinction between concepts and conceptions. The basic idea is that the “concept” of X refers to the general (and relatively uncontroversial) structure/shape of X, while various “conceptions” of X are more particular, filled out, and controversial elaborations of the concept. In other words, “concepts” of X will be formal representations of X, while “conceptions” of X will be substantive interpretations of the key elements and relationships operating within that formal framework. (Implicit in this distinction is an important point about the nature of disagreement – namely, that in order for two or more parties to “disagree” about X as opposed to simply talk past one another, there must be at least enough shared agreement about X to know that the parties are referring to the same thing. A concept of X provides this point of common agreement, while competing conceptions of X mark the areas where disagreement arises.) In this paper, we will employ this distinction in a fundamental way to clarify exactly where the primary disagreements arise in the debate over disclosing genetic research findings. -/- We propose that, underlying all the seeming confusion and disagreement, there are three central and widely agreed upon concepts at work in this debate—validity, value, and volition. The first two concepts concern the nature of the information itself. An obligation to disclose only exists when findings are valid and have value but there are competing conceptions of how to determine or define validity and valuableness. The third concept—volition—pertains not to the information but rather to the person to whom it will be disclosed. Does that person want or not want the information, and what is the best way of determining this? Here, too, competing conceptions arise. Our key point, though, is that almost all of the ethical disagreement arises because of competing conceptions of these three concepts. Understanding and appreciating this key point can help to refocus the substantive debate by providing some common ground to start from in determining how best to interpret these shared concepts. This refocusing can, ideally, produce more productive debate and facilitate some progress in resolving it. (shrink)

Philosophers and scientists refer to the special character of phenomenal consciousness, something supposedly obvious to all conscious persons. However, we had no empirical evidence about the folk view of consciousness until the first studies were carried out in the experimental philosophy of consciousness. According to the leading interpretation of these results, laypersons—people without academic knowledge about consciousness—do not notice the phenomenal aspect of consciousness. The aim of the article is to answer the question of whether we can trust these (...) results. I show that there are serious doubts about the validity of the experimental philosophy of consciousness research. As a result, the leading interpretation should be rejected, and the question about the folk nature of the concept of consciousness must be regarded as open. (shrink)

This chapter suggests a new interpretation of Spinoza’s concept of mind claiming that the goal of the equation of the human mind with the idea of the body is not to solve the mind-body problem, but rather to show how we can, within the framework of Spinoza’s rationalism, conceive of finite minds as irreducibly distinguishable individuals. To support this view, the chapter discusses the passage from E2p11 to E2p13 against the background of three preliminaries, i.e. the notion of a union (...) between mind and body as it appears in Thomas Aquinas’ refutation of Averroism, Spinoza’s views on knowledge of actually existing things in E2p8c, and the phenomenological character of E2a2-4. It argues that while this view on the human mind does not undermine radical rationalism, it does require its amendment by some irreducibly empirical concessions. (shrink)

The purpose of the article is to study ethical problematics in the philosophical works of Alasdair MacIntyre and Hannah Arendt. On the one hand we have the analysis of virtues ethics and of its place in modern society, and on the other hand, we have the analysis of action and judgment as scopes of person’s self-representation, which are valuable by themselves. MacIntyre developed his hypothesis about an individual biography pointing out that modern emotivism ethics does not leave a room for (...) conscious ethical worldview, reduces the scope of ethical choice to the very statement of individual preference. By that, a sequence of ethical decisions and preferences in a person’s life acquires irrational and wayward nature, due to which conscious transition from one narrative to another becomes impossible. In its turn, the possibility of individual biography as a holistic story that everyone can tell about themselves provides such an informative nature of ethical views, which have features of a narrative that can be rationally told and rationally perceived by others. Hannah Arendt analyzed the issue of modern ethical crisis from the other side – she studied the ethical dimension of judging ability and the role of action in social interaction. An action becomes the strictly human scope of human activity, in which personality can “open up”. Judging ability appears in this context as a foundation, thanks to which a person becomes able to act: ethical worldview exists in terms of evaluation of something that exists in relation to something due. An action in this context is an active embodiment of a certain worldview position that “unfolds” itself precisely in the area of ethics while being involved in interpersonal interaction. Arendt claimed that an action, due to its nature, is unpredictable and that every human being, who dares to take it, risks getting, in the end, a result that is far from their intentions. Exactly because of it, an action exists in the actor’s biography and the fabrics of interpersonal connections simultaneously – it is the latter, which gives the space for interpretation of an actor’s actions significance. Thus, the individual biography becomes the thing that makes sense only through the prism of interpersonal interaction and mutual interpretations of individual stories. (shrink)
