M y aim in this paper will be to show that the concept of desert remains an important and useful concept even if one supposes that the justification of praise, blame, punishment, and reward lies solely in their influence on behaviour. The argument will be incomplete, however. I will discuss only deserved legal punishment, the broader notion of deserved harm, and, briefly, deserved blame.

La scène de la prise du pouls, dans le Voyage sentimental à travers la France et l’Italie de Laurence Sterne (1768), est à l’image de cette oeuvre de fiction. Cet épisode, dans lequel Yorick palpe le poignet d’une grisette parisienne (c’est-à-dire d’une ouvrière), évoque les affaires du coeur, au sens propre comme au sens figuré. Les chercheurs ont longtemps spéculé sur le sens à donner aux mots de Sterne, lorsqu’il décrit le Voyage sentimental comme « une oeuvre de rédemption (...) ». Cependant, personne n’a songé à faire un lien entre le discours de Yorick sur la sensibilité et une controverse catholique contemporaine que Sterne était d’ailleurs susceptible de connaître, comme invitent à le croire des preuves circonstancielles. Cette controverse pourrait avoir guidé le rapprochement équivoque de Sterne, pourtant anglican, avec les pratiques catholiques. En 1765, le pape Clément XIII autorisait une certaine dévotion au Sacré-Coeur de Jésus. Il donnait ainsi une valeur aux visions de la soeur Marguerite-Marie Alacoque, qui eurent lieu entre 1673 et 1675. Après le second soulèvement jacobite de la fin des années 1740, le jeune Sterne s’était joint à son oncle Jacques, farouche antipapiste, pour faire condamner les religieuses de Mickelgate Bar à proximité de York, qui occupaient l’un des deux derniers couvents en Angleterre. À travers le Voyage sentimental, où s’élabore une théorie originale et tragicomique du Sacré-Coeur, il est possible que Sterne ait cherché à faire amende honorable, sous une forme excentrique, pour son fanatisme des jours passés. Hippel, author of Die Lebensläufe nach aufsteigender Linie (1778-1781), has been widely recognized as one of the best German authors to write in the manner of Laurence Sterne. This study places Hippel in the context of the theory of the novel and historiography in the eighteenth century. It re-examines the relationship between Hippel and Sterne (as well as Diderot), with emphasis on the contrast in the authors' use of narrators and documents. Surprisingly, when Laurence Sterne’s Yorick sets his head toward Dover, it is with no developed motive of connoisseurship or curiosity: the gentleman dandy ups with his portmanteau at the merest glance of “civil triumph” from a male servant. Perhaps we are in the world of P. G. Wodehouse, with a gentleman’s gentleman who happens, like Jeeves, to be the embodiment of all the prescriptive and opportunistic shrewdness necessary to maintain his master’s innocent privileges—but it is impossible to tell; the (...) servant utters his five words, glances his glance, and disappears from the novel. The prestige that has lent force to his misprision—or is it a sneer?—seems to belong not to a particular personality but to a position, a function , a bond between gentleman and gentleman’s gentleman that, throughout this novel, makes up in affective and class significance what it lacks in utilitarian sense. Yorick’s bond to another valet is the most sustained and one of the fondest in the novel; and, for most of the novel, the bond is articulated through various forms of the conquest and exchange of women.In the discussion ahead, I will be using the “exchange of women” paradigm taken from Claude Lévi-Strauss and, for example, René Girard and Gayle Rubin, to focus on the changing meanings of the bonds between men in a seventeenth-century play and an eighteenth-century novel.1 These discussions are part of a book-length study of what I am calling “male homosocial desire”—the whole spectrum of bonds between men, including friendship, mentorship, rivalry, institutional subordination, homosexual genitality, and economic exchange—within which the various forms of the traffic in women take place. This essay begins from Michel Foucault’s famous claim that life did not exist until the end of the eighteenth-century, and considers how eighteenth-century experiments with the literary genre of the “life” might be related to emerging ideas of life as a distinct form of being. It does this by focusing on one of the period’s most well known lives, and on one of its most prominent philosophers: Laurence Sterne’s The Life and Opinions of Tristram Shandy, and John Locke. Readers (...) have looked to Locke for many things—a labor theory of property and value, an incipient liberalism, an empiricist model of mind—but not, typically, for a philosophy of life. Kim’s causal exclusion argument purports to demonstrate that the non-reductive physicalist must treat mental properties (and macro-level properties in general) as causally inert. A number of authors have attempted to resist Kim’s conclusion by utilizing the conceptual resources of Woodward’s interventionist conception of causation. The viability of these responses has been challenged by Gebharter, who argues that the causal exclusion argument is vindicated by the theory of causal Bayesian networks (CBNs). Since the interventionist conception of causation relies crucially on CBNs (...) for its foundations, Gebharter’s argument appears to cast significant doubt on interventionism’s anti-reductionist credentials. In the present article, we both (1) demonstrate that Gebharter’s CBN-theoretic formulation of the exclusion argument relies on some unmotivated and philosophically significant assumptions (especially regarding the relationship between CBNs and the metaphysics of causal relevance), and (2) use Bayesian networks to develop a general theory of causal inference for multi-level systems that can serve as the foundation for an anti-reductionist interventionist account of causation.1. In this paper I present a novel account of achievement and I argue that, all other things being equal, the presence of this particular type of achievement in a person’s life makes that life more meaningful. In arguing for this conclusion, I explore the connections between m-achievements and a person’s self-conception and especially the idea that m-achievements provide a reason for the revision of one’s self-conception.

This field now spans a greater variety of topics and divergence of opinion than fifty years ago, and Cohen's book addresses the presuppositions implicit to it and the patterns of reasoning on which it relies.

Plato's "Ion," despite its frail frame and traditionally modest status in the corpus, has given rise to large exegetical claims. Thus some historians of aesthetics, reading it alongside page 205 of the Symposium, have sought to identify in it the seeds of the post-Kantian notion of 'art' as non-technical making, and to trace to it the Romantic conception of the poet as a creative genius. Others have argued that, in the "Ion," Plato has Socrates assume the existence of a technē (...) of poetry. In this article, these claims are challenged on exegetical and philosophical grounds. To this effect, Plato's use of poiētēs and poiēsis in the Symposium is analysed, the defining criteria of technē in the "Ion" and other dialogues are identified and discussed, and the 'Romantic' interpretation of the dialogue is traced to Shelley's tendentious translation of it. These critical developments lead to what is presented as a more faithful reading of the dialogue. In the "Ion," it is claimed, Plato seeks to subvert the traditional status of poetry by having Socrates argue that poetry is both non-rational and non-cognitive in nature. In the third part of the article, suggestions are offered as to the contribution made by the "Ion" to the evolution of Plato's reflections on poetic composition, and particularly as to the reasons which later induced Plato to substitute the concept of mimesis for that of inspiration in his account of poetry. This article makes two key contributions to the debate concerning digital privacy. First, we use theories of justice to help understand the way consumers conceive of, and react to, privacy concerns. Specifically, it is argued that an important component of consumers' privacy concerns relates to (...) fairness judgments, which in turn comprise of the two primary components of distributive and procedural justice. Second, we make a number of prescriptions, aimed at both firms and regulators, based on the notion that consumers respond to perceived privacy violations in much the same way they would respond to an unfair exchange. This article discusses the representation of law in Toni Morrison’s Beloved in the context of legal philosophy. Beloved’s contribution to the legal humanities has been described in terms of the contrast Morrison dramatizes between two visions of law: the violence of human chattel slavery embodied by the titular ghost, Beloved, and the communal act of solidarity that exorcizes her from her mother’s house. Yet this characterization neglects the associations Morrison draws in Beloved and in her metacommentary between the ghost and (...) other juridical forms, including personality and property. This article proposes an interpretation of Beloved that reads the ghost as a metaphor for the modern, metaphysicalized sense of the legal person for whom self-possession has become a prerequisite for action. Through a reading of Beloved that considers the final version of the novel against an unpublished earlier ending revealed by Morrison’s papers, I argue that Beloved challenges the reducibility of modern personhood to reflexive ownership. This paper shows that low-level generalisations in argument structure constructions are crucial to understanding the concept of alternation: low-level generalisations inform and constrain more schematic generalisations and thus constructional meaning. On the basis of an analysis of the causative alternation in English, and more specifically of the theme, I show that each construction has its own schematic meaning. This analysis is conducted on a dataset composed of 11,554 instances of the intransitive non-causative construction and the transitive causative construction. The identification (...) of lower-level generalisations feeds into the idea that language acquisition is organic and abstractions are formed only gradually from exposure to input. So far, most of the literature on argument structure constructions has focused on the verb itself, and thus fails to capture these generalisations. I make up for this deficit through an in-depth analysis of the causative alternation. (shrink)

This paper addresses the issue of the influence of global governance institutions, particularly international sustainability standards, on a firm’s intra-organizational practices. More precisely, we provide an exploratory empirical view of the impact of the Global Reporting Initiative on a multinational corporation’s corporate social responsibility management practices. We investigate standard compliance by comparing the stated intention of the use of the GRI with its actual use and the consequent effects within the firm. Based on an in-depth case study, our findings illustrate (...) the processes and consequences of the translation of the GRI within the organization. We show that substantive standard adoption can lead to unintended consequences on CSR management practices; specifically it can influence the management structure and CSR committee function; the choice of CSR activities, the relationships between subsidiaries, the temporal dimension of CSR management and the interpretation of CSR performance. We also highlight the need to look at the relationship dynamics between standards. Finally, we illustrate and discuss the role of reporting and its influence on management in order to better understand the internal issues arising from compliance with standards. (shrink)

While cognitive scientists increase their tentative incursions in the social domains traditionally reserved for social scientists, most sociologists and anthropologists keep decrying those attempts as reductionist or, at least, irrelevant. In this paper, we argue that collaboration between social and cognitive sciences is necessary to understand the impact of the social environment on the shaping of our mind. More specifically, we dwell on the cognitive strategies and early-developing deontic expectations, termed naïve sociology, which enable well-adapted individuals to constitute, maintain and (...) understand basic social relationships. In order to specify the way in which the demanding character of typical social relationships can be recognized in situ, we introduce the concept of “deontic affordances”. Finally, we shed light on the continuum that might relate a primitive naïve sociology, dedicated to the processing of invariant properties of the social life and a mature naïve sociology, necessary for dealing with the variable properties of cultural forms of life. Despite their common core in statistics, insurance and epidemiology propel two different forms of solidarity. In insurance, the collective is a source of protection, thanks to the pooling of risks; in epidemics by contrast, the group remains the source of danger for the individual. The aim of this paper is to highlight the conceptions of community and solidarity at play in epidemics in contradistinction to insurance, with a focus on the shift introduced by big data and algorithms. Paradoxically, while the (...) new technologies and epidemiology share a common view on the relation between the individual and the collective, tracing apps were not widely adopted in the Covid-19 crisis. This reluctance to use current technologies for the sake of epidemic containments highlights, beyond legitimate interrogations, a confusion between two imaginaries of the social: insurance solidarity where the interdependence is a source of rights, and epidemic solidarity that imposes duties.
