Risk propagation encompasses a plethora of techniques for analyzing how risk “spreads” in a given system. Albeit commonly used in technical literature, the very notion of risk propagation turns out to be a conceptually imprecise and overloaded one. This might also explain the multitude of modeling solutions that have been proposed in the lit- erature. Having a clear understanding of what exactly risk is, how it be quantified, and in what sense it can be propagated is fundamental for devising high-quality (...) risk assessment and decision-making solutions. In this paper, we exploit a previous well-established work about the nature of risk and related notions with the goal of providing a proper interpre- tation of the different notions of risk propagation, as well as revealing and harmonizing the alternative semantics for the links used in common risk propagation graphs. Finally, we discuss how these results can be leveraged in practice to model risk propagation scenarios. (shrink)

Persons exhibiting mutations in two tumor suppressor genes, BRCA1 and BRCA2, have a greatly increased risk of developing breast and/or ovarian cancer. The incidence of BRCA gene mutation is very high in Ashkenazi Jewish women of European descent, and many issues can arise, particularly for observant Orthodox women, because of their genetic status. Their obligations under the Jewish code of ethics, referred to as Jewish law, with respect to the acceptability of various risk-reducing strategies, may be poorly understood. In this (...) article the moral direction that Jewish law gives to women regarding testing, confidentiality, and other issues is explored. The intent is to broaden nurses' knowledge of how a particular religious tradition could impact on decision making around genetics testing, with the aim of enhancing their understanding of culturally sensitive ethical care. Sleep-related experiences [Watson, D. . Dissociations of the night: Individual differences in sleep-related experiences and their relation to dissociation and schizotypy. Journal of Abnormal Psychology, 110, 526–535] refer to a host of nocturnal altered-consciousness phenomena, including narcoleptic tendencies, nightmares, problem-solving dreams, waking dreams, and lucid dreams. In an attempt to clarify the meaning of this construct, we examined cross-sectional and longitudinal associations of sleep-related experiences , altered-consciousness tendencies , psychological distress, childhood maltreatment , and life stress in young adults. Both (...) types of SREs were found to be distinguishable from altered-consciousness tendencies. Transliminality emerged as a longitudinal predictor of both general SREs and lucid dreams. Psychological distress and an increase in life stress predicted an increase in general SREs over a 3-month interval. We conclude that transliminality is a general altered-consciousness trait that accounts for some of the individual differences in sleep-related experiences, and that general sleep experiences are an outcome of psychological distress and life stress. The purpose of this paper is to emphasize a social phenomenon that exists in Israel: immoral medicine.In recent years, nurses have been exposed to many instances of immoral medicine in hospitals. We want to protest about the demands for money from patients who are waiting for surgical intervention, arouse the medical community’s conscience concerning these immoral activities, and improve professional and moral behaviour.

Following independence in 1948, the Hebrew University of Jerusalem founded a law faculty and modeled it on the European example. Today, the Israeli law faculty is much more similar to the U.S. law school than to institutions of legal education in Europe. This Article traces the history of the changes in Israeli legal education. It argues that the shift began after 1967, faced resistance in the 1980s, and gained momentum in the 1990s. Presently we may be witnessing the beginning of (...) a shift away from U.S. influence and back to Continental Europe or even Asia. The Article discusses three major educational components, which together signaled the shift to U.S. influence: a student-run law review, curricular reform, and open and lively class discussion. The Article then offers several factors to explain the shift: judicial opinions that began to rely on American decisional law, the adoption of the U.S. model of practice by the legal profession, the privatization of law schools, globalization, and Americanization and foreign affairs. Finally, the Article considers the contribution to Americanization made by active U.S. attempts to export American law to other legal systems. (shrink)

Recent marketing theory uses the Jungian concept of the archetype to design strategies for the improvement of product selling. Mark and Pearson propose that archetypes such as the ruler, the hero, the outlaw, and the sage are useful in promoting a product. This article suggests that the concept of archetypes as well as myths such as the Prometheus myth and the myth of the expulsion from Paradise, when combined with the insights offered by Mark and Pearson, may help in understanding (...) the management of trials of dissent as well. The article presents seven motifs that recur in trials of dissent and shows how they form a part of the phenomenon of the political management of dissent: the demonization and otherization of defendants and their supporters; the tendency to employ the charge of conspiracy and thus target a group rather than a single individual; the bending of the laws of procedure; the utilization of previously-untested substantive charges; the appeal made by each side to an external principle or vision--typically, the government resorts to the law of necessity whereas the defense resorts to natural law or a vision of "true justice" ; focus on the judge as manipulator of laws; and the appellate court assuming the role of the ultimate sage, performing its task with balance and detachment. The appellate court may use softer rhetoric in an effort to minimize the damage to the appearance of legality. When it does so, the rule of law is reaffirmed as a concept that benefits all sides; there is thus unity in the commitment to the rule of law, not to patriotism or to identification with the government. In addition, an effort is made to reaffirm the maxim that the government is a government of law, not of men. (shrink)

In response to Bourdieu and Wacquant, I argue that American hegemony in setting the terms of debate on ethnicity and racism is nothing new, led in the first half of the century by US heterotopic intellectuals, immigrants, outsiders and descendants of slaves. Ironically, in the light of claims made by the authors, in the post-war era the debate is increasingly dominated by ex-imperial British and French postcolonial thinkers. The authors' disquiet is more explicable, however, if viewed against the background of (...) French republican discourses that deny the legitimacy of `difference' in the public sphere. But in the final analysis, terms such as multiculturalism or ethnicity are not legislated from above but respond to grassroots social movements, and in France minority groups are presently claiming a voice and presence in the public sphere. The rise of Islamic fundamentalism in Europe seems to be tangibly signalled by an increase in women and young girls wearing the Muslim veil, the hijab. In France, this has led to the legal banning of all headscarves and other religious symbols in state schools in the name of French secularism. The article considers the ambiguities and ambivalences associated with the politics of embodiment surrounding veiling and honour killings comparatively, in Britain and France, and the implications for ongoing debates on (...) multiculturalism. The article argues that the publicity surrounding symbolic practices of sexual intimacy in the context of modernity may come to be loaded with secondary symbolic connotations, often highly politicized, for both Muslims and Europeans, leading to irresolvable conundrums. The processes of higher order symbolization outlined here raise critical questions of authority: who has the authority to interpret the scriptures, in this case the Koran and ideas about individual liberty? Who has the right to determine the limits of modesty, or whom a young person should marry? As in the earlier confrontations in South Asia between Sufi saints and learned Muslim clerics, the current contestation involves a range of actors claiming authoritative sacred knowledge. (shrink)

It is an ancient view, to be found even in Aristotle’s analysis of friendship, that the other is an alter ego, another myself. More recently, this conception has provoked spirited debate within and without the phenomenological tradition. It can be found in a wide variety of texts, from Husserl’s Cartesian Meditations to Thomas Nagel’s “What is it like to be a bat?” The basic position can be summarized as follows. Intentional experiences are subjective, first-person experiences, not objective, third-person experiences.

Privacy is a sociocultural perception, depending on the dominant values of a society, sociocultural heritage, and contemporary technological developments. This article focuses on privacy perception among adolescents based on a European school survey (PRACTIS), and presents comparative results of an exploratory study conducted among over 1,428 adolescents in six countries. The results reveal that adolescents attribute high value to privacy and are prepared to actively oppose if an online corporation is challenging their personal interests. However, they tend to trade off (...) privacy for other perceived benefits. Adolescents’ privacy perception and data protection are affected by cultural diversity, age, gender, and most of all their various social network sites activities and their attitudes toward importance of sharing and controlling personal information. This study discusses the mediating role of statistics anxiety and motivation in the relationship comprising academic dishonesty, personality traits, and previous academic achievements in three different learning environments. Self-determination theory provides a broad psychological framework for these phenomena. Data were collected from 649 bachelor-degree students in the Social Sciences in five Israeli academic institutions. Structural equation modelling was employed to investigate the research variables’ relationships. Findings indicate that statistics anxiety mediates the relationship between personality traits and academic dishonesty in the (...) POE and the ERT learning environments. Findings also indicate the relationship between students’ achievements and academic dishonesty, but only in the ERT learning environment. In contrast, motivation mediates the relationship between students’ achievements and statistics anxiety only in the POE learning environment. This study unveils that learning environments determine the mediating role of statistical anxiety. In digital learning environments, mediation has been found between students’ personality traits and academic dishonesty. No similar parallel mediation could be established in the physical learning environment, F2F. Thus, we conclude that online courses should be designed according to student-centred approaches. Israeli courts were recently faced with the question whether an employer is allowed to voice objections to unionization during an organizing drive. Since the legislation fails to provide an answer to this question, it was up to the courts to come up with a solution. The National Labor Court in Histadrut v. Pelephone held that employers have no say and must refrain from any communications whatsoever with the workers regarding the decision whether or not to join the union. The Supreme (...) Court later affirmed this decision. This Article explores this legal question and examines whether this decision was justified, and whether it should be adopted in other countries as well. It first discusses the justifications for the conflicting freedoms in this scenario — the workers’ freedom of association and the employer’s freedom of speech — to appreciate their relative strength in the circumstances. It then examines whether it is possible to achieve a certain balance. To this end, the Article critically reviews the legal mechanisms adopted by other legal jurisdictions in this regard, shedding light on their effectiveness and the difficulties of organizing in practice in each jurisdiction. The main argument advanced in this Article is that the solution has to be purposive — to advance the goals of labor law, specifically freedom of association — and that the purposive analysis must be contextual. A rule prohibiting the employer from voicing opinions is surely an infringement of freedom of speech, and strong reasons are needed to justify it. Whether strong enough reasons exist depends on several contextual factors. Essentially, the question is whether it is possible, given the current context, to secure real freedom of association without such a rule. By context we mean two main things: first, the real-life current experience concerning the struggles of organizing; and second, the existence of alternative legal mechanisms that might address this problem. This article focuses on the construction of two types of non-logical paradoxes in news discourse: 1) inconsistencies of positions and acts; 2) conflicts between reality and expectations or common sense. I will argue that these paradoxes are constructed by various discursive devices and will demonstrate the key role played by conventional and conversational implicatures in this regard. The discussion will focus on 23 items covering disputes between ultra-Orthodox and secular Jews, broadcast on mainstream Israeli television news in 2009. I will (...) show that the journalists consistently attribute paradoxicality to Haredim, and that this corresponds with the common public bitterness towards them because they enjoy financial support from the government, while sharing little of the economic and security burden. Moreover, I will argue that the paradoxical representations of Haredim rely on the secular ‘we’ group view and serve to base its common sense and norms. (shrink)

ACCORDING TO HUSSERL, THE REVOLUTION brought about by the new mathematical science of the seventeenth century was primarily an ontological one: a shift in the conception of the real. That Husserl opposes the new Galilean-Cartesian ontology is clear. This much is evident from the potent rhetoric of the Crisis declaiming Galileo as an "entdeckender und verdeckender Genius", forgetful of the lifeworld, failing to grasp what the mathematical-empirical method he brought to such a degree of perfection actually achieves. Indeed, even without (...) the ringing Crisis passages, one could already expect that Husserl, the phenomenologist, would oppose the Platonizing scientific realism of a Galileo or a Descartes. However, Husserl's critique of Galileo poses many puzzling questions, questions which are not directly addressed in the Crisis, and which can be answered only in terms of the broader position outlined by Husserl elsewhere. To whit: what is the more precise content of Husserl's objections against Galileo, and how are these justified? Further, if scientific realism is to be rejected on phenomenological grounds, does this imply that a phenomenological approach is necessarily instrumentalist? Finally, what solution does Husserl's thought offer to the realism/instrumentalism debate? (shrink)

Iterability, the repetition which alters the idealization it reproduces, is the engine of deconstructive movement. The fact that all experience is transformative-dissimulative in its essence does not, however, mean that the momentum of change is the same for all situations. Derrida adapts Husserl's distinction between a bound and a free ideality to draw up a contrast between mechanical mathematical calculation, whose in-principle infinite enumerability is supposedly meaningless, empty of content, and therefore not in itself subject to alteration through contextual change, (...) and idealities such as spoken or written language which are directly animated by a meaning-to-say and are thus immediately affected by context. Derrida associates the dangers of cultural stagnation, paralysis and irresponsibility with the emptiness of programmatic, mechanical, formulaic thinking. This paper endeavors to show that enumerative calculation is not context-independent in itself but is instead immediately infused with alteration, thereby making incoherent Derrida's claim to distinguish between a free and bound ideality. Along with the presumed formal basis of numeric infinitization, Derrida's non-dialectical distinction between forms of mechanical or programmatic thinking (the Same) and truly inventive experience (the absolute Other) loses its justification. In the place of a distinction between bound and free idealities is proposed a distinction between two poles of novelty; the first form of novel experience would be characterized by affectivites of unintelligibility , confusion and vacuity, and the second by affectivities of anticipatory continuity and intimacy. Heidegger's attacks against humanism have come under renewed scrutiny, especially in France, as the latest wave of polemics over his political engagement has metamorphosed into a debate over the nature of humanism itself. Yet these recent discussions give rise to a number of perplexities. Firstly, for all their differences, it is remarkable how Heidegger's critics and defenders alike distort his position. On the one side, his French defenders hold that humanism is the attribution of a fixed essence to man, according (...) to which definition "even Nazism is a humanism." Thinking after Derrida and Deconstruction.

This article focuses on the pendulum-like change in the way people read and use text, which was triggered by the introduction of new reading and writing technologies in human history. The paper argues that textual features, which characterized the ancient pre-print writing culture, disappeared with the establishment of the modern-day print culture and has been “revived” in the digital post-modern era. This claim is based on the analysis of four cases which demonstrate this textual-pendulum swing: (1) The swing from concrete (...) iconic-graphic representation of letters and words in the ancient alphabet to abstract phonetic representation of text in modern eras, and from written abstract computer commands “back” to the concrete iconic representation in graphic user interfaces of the digital era; (2) The swing from scroll reading in the pre-print era to page or book reading in the print era and “back” to scroll reading in the digital era; (3) The swing from a low level of authorship in the pre-print era to a strong authorship perception in the print era, and “back” to a low degree of authorship in the digital era; (4) The swing from synchronic representation of text in both visual and audio formats during the pre-print era to a visual representation only in print, and “back” to a synchronic representation in many environments of the digital era. We suggest that the print culture, which is usually considered the natural and preferred textual environment, should be regarded as the exception. (shrink)

The dream argument and its role in Cartesian doubt continue to engage commentators. As recent scholarship shows, a consensus has yet to be attained. In what follows I attempt to resolve the current debate by offering an account of the dream doubt which captures Descartes’s rhetorical strategy in Meditation I. A faithful reading of the text, I propose to show, reveals that the dream doubt is not entertained seriously nor is it proposed merely for the sake of methodological skepticism. It (...) is rather an integral part of a dogmatic intrusion of Cartesian science at a pivotal point in the critique of prescientific experience.
