The present study focuses on the word ‘Kun’ from Quran. In this paper, the discourse of Quran and the conceptual ayah of ‘Kun’ is discussed with reference to exegetical context, the perceptual theory of creation and the reality of the relentless evolution of ‘Kun’ and its possible hermeneutics. The recognition of the ‘intention’ of God has to be unveiled in order to understand the theory of ‘Kun’ and the idea of Creation. The three dimensional design of ‘Kun’ can be (...) seen in the Quran as: the intention of ‘Kun’, when the creation exists in the intention of God; the imagination of God about ‘Kun’, which is the second stage and is related to the imaginable state of the ‘essence’ of ‘Kun’; the final stage refers to the ‘saying’ of ‘Kun’ by God, which unveils the intention of God. The relentless evolution is the reality that every time God says ‘Kun’, it discloses itself with unique creation. The relentless evolution in the perceptual theory of creation of ‘kun’ connects it with the theory of expansion of the cosmos and its evolution. Review of Leigh Eric Schmidt, Village Atheists: How America’s Unbelievers Made Their Way in a Godly Nation,.

Since the adoption of the WTO-TRIPS Agreement in 1994, there has been significant controversy over the impact of pharmaceutical patent protection on the access to medicines in the developing world. In addition to the market exclusivity provided by patents, the pharmaceutical industry has also sought to further extend their monopolies by advocating the need for additional ‘regulatory’ protection for new medicines, known as data exclusivity. Data exclusivity limits the use of clinical trial data that need to be submitted to the (...) regulatory authorities before a new drug can enter the market. For a specified period, generic competitors cannot apply for regulatory approval for equivalent drugs relying on the originator's data. As a consequence, data exclusivity lengthens the monopoly for the original drug, impairing the availability of generic drugs. This article illustrates how the pharmaceutical industry has convinced the US and the EU to impose data exclusivity on their trade partners, many of them developing countries. The key arguments formulated by the pharmaceutical industry in favor of adopting data exclusivity and their underlying ethical assumptions are described in this article, analyzed, and found to be unconvincing. Contrary to industry's arguments, it is unlikely that data exclusivity will promote innovation, especially in developing countries. Moreover, the industry's appeal to a property rights claim over clinical test data and the idea that data exclusivity can prevent the generic competitors from ‘free-riding’ encounters some important problems: Neither legitimize excluding all others. This paper explores the relentless character of writing in elementary education. We begin with the reflections of a Grade Three teacher on incidents in her classroom regarding writing and the leaving of traces, followed with a consideration of the deep cultural investment we have in leaving such traces. A brief examination of the latest work by Lucy Calkins is followed by a discussion of the paradoxical relations between writing, remembering and forgetting and the forging of community as an “order (...) of memories.” The issue of writing as the rendering of experience into cultural capital is followed by concluding remarks on the pleasures of “walking around unwritten.”. This paper, a version of which was presented at the ‘Feminist Futures’ twentieth Anniversary conference of the British and Irish Feminist Theology Summer School in July 2012, is, in one sense, a misnomer. Through the lived experience of one remarkable woman with whom I have the privilege of working as a mental health chaplain and companion, I recount her past of pervasive patriarchal abuse, pain, and psychic ‘storms’ but also her present that contains her songs of survival and her language (...) of liberation. It is one woman’s life, a life that could be replicated in many women’s lives, not only in the past, but in the present and throughout the world. But it is only by being acutely reminded of the unique, personal narratives of women, and men, whose past continues to invade our presents by their unbearable witness to the actual violence of the patriarchal landscapes in which their ‘voices’ have been seemingly silenced and their language pathologized, that we shall be able together to conceive of futures. These are futures where, whilst, acknowledging the continuing severe and enduring psychological damage to the abused and the violated and enabling appropriate treatment to be available, we shall also empower the bearing of the witness, the resolute and hard won language of the remaining, the bursting forth from the deadness of tombs of terror, of resurrected lives in the dance of the garden. This will require a sea-change in the way we imagine and establish mental health services and it will require an applied feminist theological methodology to be at the heart, not only of the theoretical models, but of the witnessing to the theology-making that such hidden, ‘anonymous’ lives intrinsically reveal. To imagine such mental health services is a subject for another paper. For now I want to introduce one such life I have been describing and with whom I have the privilege of travelling, consciously and shamefully aware of my gender in a way which seems OK, which seems re-imagined through the eyes of a woman who has absolutely no reason to love men but who has invited me to tread tenderly towards the sights and seasons of her pain and abuse. Despite the United Nations Declaration of the Rights of Indigenous Peoples, assimilationist policies continue, whether official or effective. Such policies affect more than the right to group choice. The concern is whether indeed genocide or “only” ethnocide (or culturecide)—the elimination of a traditional culture—is at work. Discussions of the distinction between the two terms have been inconsistent enough that at least one commentator has declared that they cannot be used in analytical contexts. While these terms, I contend, have distinct senses, (...) yet in cases of governmental and other institutional assimilationist policy for indigenous peoples, such ethnocide effectively entails genocide. Insofar as any people’s cultural practices and beliefs are essential for life and health, individuals in groups value, if tacitly, their culture as highly as their language or any artifact: Thus, attempts to eradicate a culture through assimilation in fact eradicate individuals’ lives and health and so are effectively murderous. Acknowledgement by worldwide organizations that assimilationist ethnocide is effectively genocide should affect policy concerning indigenous peoples and thus has significance for international law. Experiencing ethics not only refers to being confronted with a situation in which one must choose a course of action; it also makes reference to giving a narrative account of the circumstances and chain of events leading to such crossroads. Between both there is a chasm, a space of indeterminacy into which R. Musil and L. Sterne delve with aesthetic means. Their poetics move in opposite directions, but by following them to their last critical consequences this study reveals a kindred (...) ethical stance. This interpretation sheds light on the ethics revolving around character construction by examining the constraints thwarting any attempt to complete a biographical account or convey a protagonist that led his or her life. Neither Musil nor Sterne posit a narrative agenda that could reach a last chapter or lead to a groundwork determining their ethics. A closer look into their tight-knit prose reveals that both rely on the narrating, on a skill that must be incessantly cultivated through a digressive or essayistic style. Equipped with a vast theoretical repertoire, this approach makes a strong case for a new constellation in comparative literature. (shrink)

Milbank and Pabst’s account of liberalism as rooted in ontological violence picks out the secret commonalities of left-leaning rights-based and right-leaning market-based liberalisms with considerable shrewdness, and their elaboration of associationist and civil economic alternatives contains many strikingly expansive and novel elements. However, their totalising account of liberalism prevents them from engaging the strengths of the liberal era with sufficient generosity, and so impedes their efforts to articulate a way forward that is substantially and not just chronologically post-liberal.

The relationship between mind and matter, mental states and physical states, has occupied the attention of philosophers for thousands of years. Richard Fumerton's primary concern is the knowledge argument for dualism - an argument that proceeds from the idea that we can know truths about our existence and our mental states without knowing any truths about the physical world. This view has come under relentless criticism, but here Fumerton makes a powerful case for its rehabilitation, demonstrating clearly the importance (...) of its interconnections with a wide range of other controversies within philosophy. The relentless informational variability in the field of natural sciences, today's need for the training of highly competent, versatile, apologetic future specialists, as well as the low motivation of psychology students to teach natural disciplines, was established by us in the process of their questioning, require the search for new, non-standard solutions in the organization of natural science training of future psychologists in institutions of higher education. We believe that one of the effective ways to solve this problem is (...) the organization of the educational process with the natural scientific training of future psychologists in higher education institutions based on innovation and heuristic. To organize the educational process from the natural science training of future psychologists on the basis of innovation and eurestiality, there is a need to determine such ultra-innovation pedagogical technologies and teaching methods that will meet the requirements of the time, contribute to the formation of psychology students' motivation to study natural sciences and improve the quality and the effectiveness of natural science training. We have characterized pedagogical technologies, namely: coworking technology, barcamp technology, workshop technology, SMART technology, BYOD technology and such innovative methods as: lecture-visualization, video lecture, debates, round table, electronic brain assault, a laboratory experiment and a design-role-playing game, which, in our opinion, will contribute to the implementation of the educational process with the natural science training of future psychologists in higher education institutions based on innovation and heuristic. The claim that we have a moral obligation, where a choice can be made, to bring to birth the 'best' child possible, has been highly controversial for a number of decades. More recently Savulescu has labelled this claim the Principle of Procreative Beneficence. It has been argued that this Principle is problematic in both its reasoning and its implications, most notably in that it places lower moral value on the disabled. Relentless criticism of this proposed moral obligation, however, has (...) been unable, thus far, to discredit this Principle convincingly and as a result its influence shows no sign of abating. I will argue that while criticisms of the implications and detail of the reasoning behind it are well founded, they are unlikely to produce an argument that will ultimately discredit the obligation that the Principle of Procreative Beneficence represents. I believe that what is needed finally and convincingly to reveal the fallacy of this Principle is a critique of its ultimate theoretical foundation, the notion of impersonal harm. In this paper I argue that while the notion of impersonal harm is intuitively very appealing, its plausibility is based entirely on this intuitive appeal and not on sound moral reasoning. I show that there is another plausible explanation for our intuitive response and I believe that this, in conjunction with the other theoretical criticisms that I and others have levelled at this Principle, shows that the Principle of Procreative Beneficence should be rejected. Before the twentieth century, the Universe was usually imagined as a large spatially extended thing unfolding in time. The past was fixed and the future was open; unfolding was conceived as an asymmetric process of coming into being. Relativity introduced a new vision in which space and time are presented together as a single four-dimensional manifold of events. That, together with the fact that the fundamental laws of our classical theories are symmetric in time, made understanding why the past and (...) future present themselves so differently in our experience one of the central challenges of physics. The last two centuries have seen a great deal of progress in understanding various of the so-called arrows of time: the thermodynamic arrow, the cosmological arrow, the arrow of knowledge or information. There remains an outstanding piece of this puzzle that has seen little progress, one that Roger Penrose described in his beautiful paper Singularities and Time-Asymmetry in 1979 as: “The arrow most difficult to comprehend … namely the feeling of relentless forward temporal progression, according to which potentialities seem to be transformed into actualities.”I will propose that the insight needed to resolve the problem involves taking into account that we are part of the universe and that any attempt to model it as a totality involves self-reference. I will argue specifically that self-reference, against the background of a thermodynamic gradient, creates an instability in an embedded agent’s ability to know the future or even treat it as a potential object of knowledge. That instability captures the sense in which the future remains for her perpetually open and the passage of time resolves openness into the fixity of fact. (shrink)

This paper explores Jean‐Luc Nancy's philosophical reflection on surviving his own heart transplant. In ‘The Intruder’, he raises central questions concerning the relations between what he refers to as a ‘proper’ life, that is, a life that is thought to be one's own singular ‘lived experience’, and medical techniques, shaped at this particular historical juncture by cyclosporine or immuno‐suppresssion. He describes the temporal nature of an ever‐increasing sense of strangeness and fragmentation which accompanies his heart transplant. In doing so, Nancy (...) opens up the concealed of transplantation in terms of the problematic ‘gift’ of a ‘foreign’ organ, the unremitting suffering intrusiveness of the treatment regimen, and the living of life as ‘bare life’. He uncovers and exposes the relentless uncanniness that pervades the post‐transplant experience, which for him is an example of our humanistic, never‐ending impulse, to alter ourselves. Nevertheless, Nancy offers no answer to this dilemma, but instead calls us to think about the meaning or ‘sense’ of the prolonging of life and deferring of death, which currently drives our medical interventions. Secular nationalism and Islamism constitute a major political polarization in current day Turkey. The proponents of both political orientations use the trope of the veiled woman, in order to advance their respective ideologies. However, the instrumentalization of women’s bodies in this way not only proves inefficient in adequately addressing many of the problems that women face today, but it is also linked to the relentless state control and regulation over our bodies. The following essay gives an account of the (...) ways in which both secular nationalists and Islamists are not hesitant about policing our bodies at the service of theirideology. Thus is engendered the metaphorization of an altered reality—structured all but exclusively upon the relentless deceits it proffers. Jubilation and despair come and go, as though wholly inter-changeable; acceptance and rejection, promulgation and rescission are converted into mere variants of the same gestures of ambivalence, if not of travesty. One might thus conclude that the kiss adopts significance worthy of note only as a metonym for and of factitiousness, vacuity and thinly-veiled distortion. Chopin’s script adeptly explores the multifarious comportments and consequences of the kiss: an act fashioned as a “weapon” of dubious value, as a tactical strategy, as a play-act borne of ulterior objectives and, which, as such, deftly prostitutes itself, willingly, nefariously. In the given context, the kiss-act lays bare the heroine’s ostensible “liberation” to be more imagined than real. Her would-be triumph over gendered subjugation exists, if at all, as but an ill-conceived romantic daydream—destined to slake gradually into a woeful destiny of loneliness and imprisonment. The article suggests that Gandhi’s integrated thought and practice is of great significance today. It focuses on three arguments that Gandhi put together and tested in practice, and presents them in the way that R. B. Gregg explicated them. The first is Gandhi’s critique of the problems of Western industrial civilization: increasing global inequality; increasingly destructive cycles of war and violence; and the relentless domination and exploitation of human beings, communities and ecosystems. The second argument is the alternative Gandhi (...) developed: his idea of a ‘countermodernity’ or ‘alternative civilization’ that is grounded in the power of nonviolence, equality, and mutual cooperation. The third and most original argument he put forward and lived every day of his adult life is the nonviolent way (or ways) of life that has the capacity to transform modern social systems of inequality, violence and domination into alternative social relationships and systems in which equality, nonviolence and self-organising democratic cooperation would become paramount. In effect, he assumes the role of unrelenting destroyer—or nihilistic magician—who dances demonically upon the broken and scattered fragments of the Western tradition. Everything touched soon appears torn. Nothing is ever finally darned over, or choreographed for coherence, or foregrounded as magical illusion. Miller, the relentless rift-maker, refuses any apparent repair and rampages onward, dancing, spell-casting, destroying all. This paper focuses on the Argentine philosopher Eugenio Pucciarelli (1907–1995) and his critical reception of phenomenology. It introduces to his contribution to phenomenology in the context of its early reception in Argentina and addresses the following issues: 1) the mission of philosophy, the various ways of accessing its essence, in particular those of Scheler, Dilthey and Husserl, 2) his reception of Husserl as far as the ideals of science and reason are concerned, 3) the crisis of reason 4) his pluralistic (...) conception of reason and time, and finally, to 5) his humanistic stance. I argue that his conception of philosophy, which emphasizes the personal dimension and the social commitment of philosophical practice as well as the relentless search for unshakeable foundations of knowledge as carried out by Husserl, is underpinned by a pluralistic conception of reason, time and culture that confers Pucciarelli’s philosophizing a humanistic bias. Phenomenology as conceived by Pucciarelli becomes thus an active force by embracing multiple perspectives, such that its methodology can be applied to varying contexts and circumstances. Pucciarelli’s commitment to social justice and Latin American culture responds to the attempt to rescue the virtues and freedom of the individual, which ground human dignity. In short, Pucciarelli’s stance reveals a profound pluralistic humanism that does not neglect its militant and critical function, thus evidencing its relevance to the current sociopolitical situation in Latin America. In three respects, ethics can be marked by the category of the ‘priceless’. Its key reference point, ‘human dignity’, was described by Kant as the exact opposite to what can be priced in equivalents. As an enterprise, ethics is ‘priceless’ as a commitment of the human spirit which goes beyond and against the attitude of success calculation. Yet, an understanding of ethics as unconditional recognition and the anticipatory, asymmetric, innovative praxis (Helmut Peukert) that expresses it have a cost. Where does (...) the motivation to forego, for example, ethically problematic therapies, originate? How can respect for what is priceless be sustained in the face of the relentless spread of market categories diagnosed, among others, by Jürgen Habermas and Paul Ricoeur, against which religions may raise a delaying veto? Only a Christology that can adequately conceptualise the experience of the graciousness and superabundance of God’s gift is able to support the increasingly counter-cultural conviction of something beyond our disposition. The Philippine government has been relentless in its counterinsurgency campaigns. From the colonial wars that vilified as insurgents and bandits the honored heroes of today, up to the anti-communist and anti-secessionist civil and military efforts of the postcolonial regimes, these campaigns have not only rolled out large state resources but also cost lives of innocent civilians. Patterned after the United States (US) of America’s principle of low-intensity conflict aimed at countering Marxist and anti-imperialist movements (Reed 1986), counterinsurgency campaigns have (...) unleashed a warfare that indiscriminately target its supposed opponents, including unarmed activists. In 2007, the United Nations Special Rapporteur Philip Alston examined the horrible political situation of the Philippines – characterized by political killings, abductions, and tortures – and identified how state elements, under the blanket protection of waging a counterinsurgency campaign, were responsible for the political repressions then (Sales 2009). Today, under the murderous Duterte regime, the counterinsurgency campaign has reached an unprecedented level of ferocity as it is waged through a militarist whole-ofnation approach composed by multi-level government and multi-agency responses. -/- Being greatly influenced by the US, counterinsurgency campaigns in the Philippines follow the paranoiac and hysterical communist witch-hunt of McCarthyism (Hutchins-Viroux 2008). The hysteria’s contemporary and local expression is the phenomenon called red- or terror-tagging.1 Terror-tagging is the systematic process of maliciously naming or identifying an individual or group as a communist and/or terrorist by its association with a supposed communist and/or terrorist group. Being a systematic process, it is initiated and sustained by state elements with the view of maligning or defaming political activists. Terror-tagging is aimed against activists, dissenters, and even the political opposition. The social activist Rhoda Dalang (2014) has noted how terror-tagging has been deployed by the Philippine state in its counterinsurgency efforts, from the Marcos up to the then Aquino regime. And until the previous Duterte regime, yet with increased intensity and fatality, terror-tagging continued to defame and liquidate activists. As terror-tagging has not received enough academic attention, this chapter aims to fill this gap by providing a preliminary analysis of it. The chapter will be doing a critical discourse analysis. It will take off from a revealing study done by Don Kevin Hapal and Raisa Serafica of Rappler, a media outlet in the Philippines. Through a separate discourse analysis of Facebook posts of the National Task Force to End Local Communist Armed Conflict (NTFELCAC),2 the chapter will also identify aspects of terror-tagging. The discussion will further be theorized using the Marxist analysis of the State and informed by interviews of Atty. Maria Sol Taule and Cristina Palabay. They are both human rights workers who have worked with terror-tagged activists and are themselves subjected to terror-tagging. (shrink)

There is the fragmentation in our sense of our known worlds brought about by the relentless explosion of change in our collective knowledge and the related life styles which it necessitates. There is also the fragmentation in our sense of ourselves which will be our present concern. Alasdair Macintyre poses the question, how do actions and conversations add up or cohere in the unity of a human life? (...) Translating MacIntyre’s question we can ask: how might questions, insights, formulations, judgements, and decisions add up, cohere, and shape the form and identity of the self in time? The origins of U.S. corporate taxation are often associated with the 1909 corporate excise tax. Scholars who have investigated the beginnings of this levy have mainly focused on the legislative history of the 1909 corporate tax to argue that it was either an expression of the Progressive Era impulse to regulate large-scale corporations or an attempt to use corporations as remittance devices to collect taxes aimed at wealthy shareholders. This Article broadens the conventional historical accounts of the emergence of American (...) corporate taxation by revisiting the 1909 U.S. corporate tax from a comparative perspective. The aim is to look both below and beyond the American nation-state to determine how and why U.S. state governments and other Western industrialized nations tried to tax corporations at the turn of the twentieth century. This Article investigates a small slice of subnational and transnational comparative examples: corporate tax laws and policies in a few representative nineteenth-century industrializing American states, and in turn-of-the-century England and Germany. Building on the well-known insights of comparative business history, this Article contends that historically-determined political interests, social ideas, and cultural beliefs help explain the American obsession with disciplining large-scale business corporations through the use of nominally punitive tax laws and policies. Comparative-historical analysis shows how differences in the organizational structures of big businesses across place and time have led to variations in political economy that were ultimately expressed in the legal ideas and cultural attitudes toward corporate capitalism. These variations, in turn, shaped the transnational distinctions in corporate tax law and policies. Greater attention to the comparative-historical development of law and political economy may help us understand the stubborn persistence of American corporate taxation, particularly in the face of recent global changes and the relentless economic critiques of the double taxation of corporate income. The launching forth on to wide oceans created the occasion for, and proved the value of, such products of exact thought. On the one side of the frontiers was civilization; on the other, nothing; just barbarism or emptiness. The march of civilization and the idea of the frontiers created a geographic and bodygraphic divide. Certain areas of the planet were designated as the location of the barbarians, and since the eighteenth century, (...) of the primitives. In one stroke, bodies were classified and assigned a given place on the planet. But who had the authority to enact such a classification, and what was the logic of that classification? Furthermore, the classification of the world by region, and the link established between regions and people inhabiting them, was parallel to the march of civilization and companions of it: on the other side of the epistemic frontiers, people do not think or theorize; hence, one of the reasons they were considered barbarians. One, it is said, went insane, another became a heretic, a third died and only the (...) fourth emerged unscathed. A modern variation of this story might go like this. Four or perhaps  philosophers entered the jungle of nationalism and for the most part went insane. There were those who embraced nationalism and consequently abandoned the universality of philosophy for the promotion of xenophobia, racism and even Nazism. Others remained internationalist and hence became futile—philosophical Canutes—commanding the raging beasts of nationality to be still. No one struggled harder with nationalism than Bertrand Russell. In , writing as an internationalist, he announced the demise of the principle of nationality only to see nationalisms explode in every region of the world (see his “National Independence and Internationalism”, Papers ). He opposed it relentlessly and without compromise until near the end of his life when he found himself endorsing wars of national liberation. Nationalism is often depicted as a howling beast. It would be better to think of it as an anaconda that wraps itself around everyone who ventures into its domain. Joan Cocks’ Passion and Paradox is an important book on nationalism and the intelligentsia. She traces the intellectual encounter with nationalism of a number of figures—Karl Marx, Rosa Luxemburg, Isaiah Berlin and the Scottish nationalist Tom Nairn, among others. All are exiles, most are Jews, and all try to hack their way through a jungle of conundrums of nationalist thought. Her accounts of these thinkers sometimes read like complex legal briefs, but are always illuminating. Though an internationalist, she sees the power of nationalist imperatives. Her approach to the contradictory strains of nationalism and hostility to nationalism echoes that of Hegel. She presents critical but sympathetic accounts of each side of the nationalist problematic and shows how their difficulties might be resolved in a higher synthesis. Alas! her resolution suffers from the unworldliness that she finds in other versions of internationalism. Her argument begins with a personal experience. In the early ’s she joined a group of Arabs and Jews against the Gulf War. In the course of their associ- Reviews  ation she learned that the Jews were all internationalists, while the Arabs were outspoken nationalists. This experience presumably demonstrated that a happy collusion of nationalism and internationalism was possible. But, of course, there was another side: those prosecuting the war she opposed were also nationalists. Her central thesis addresses the tragedy of opposition. It states that nationalism is “dilemmatic”, that is, that “all paths of thought obscured equally telling contrary thoughts; all courses of action were strewn with causes for regret and remorse” (p. ). The horns of the dilemma are the valid claims of the internationalist who sees the underlying self-destructive deep structures of nationalism on one side, and the claims of the national particularistic who is engaged in the compelling theatre of national liberation and the protection of local customs and roots on the other. Her book is an account of how her thinkers are framed by this dilemma, locked in by the imperatives of either side. In the period between the Gulf War and the composition of this book in  Cocks was able to observe what she identifies as the destructive logic of nationalism. The ’s were a period of postmodernist celebration of the local, a sensibility that helped to legitimate nationalism. The explosion of nationalism that followed the breakup of the Communist imperium was a time of liberation of the imprisoned nations—a springtime when it was good to be alive. But as the decade wore on the concealed pit bulls came out—in Yugoslavia, in Rwanda and elsewhere. In Cocks’ view nationalism showed an inner logic, of a sort that Russell called attention to in the early ’s—a logic that led from euphoria to self-destruction (see his Prospects). The increase in incarceration of offenders in the United States over the last 40 years has created a system of mass incarceration or mass punishment. While consequentialist theories of punishment may generate considerable doubts about the value of this system, it seems that retributive theories of punishment lack the resources to criticize mass punishment. Because of their focus on individual desert, it seems that they can say nothing about punishment in the aggregate. Nevertheless, there are good reasons for a certain (...) kind of retributivism to question the justice of mass punishment. When retributive punishment is considered as one of the functions of a state whose task is to create and maintain a system of equal freedom for all, then punishment must be justified not only at the individual level but also at the level of the system of punishment as a whole. If the criminal justice system inflicts excessive amounts of punishment in the aggregate, it becomes unjust, not because individual offenders are treated unjustly, but because a policy of relentless prosecution and punishment is not appropriate for a free society. Too much work on Smith still assumes that there is not much to say [End Page 323] about his political thought because he regarded all but the most minimal government as an obstacle to the proper functioning of markets. Smith is supposed to be a "classical liberal" bent on preserving as much natural liberty as possible in the face of government's relentless overextension of its powers of regulation. In Adam Smith's Politics: An Essay in Historiographic Revision (Cambridge: Cambridge University Press, 1978), Donald Winch rejected that approach to Smith in favor of a portrait of the author of The Theory of Moral Sentiments and The Wealth of Nations as an eighteenth-century thinker with an eighteenth-century thinker's concerns. Sagar's project is quite different. This is a book on Smith's political thought that does not once deploy the term 'Whig.' Sagar's Smith does not wholly float free of his historical situation—the questions he addresses are those posed by the end of feudalism and the advent of modernity—but situating him in the particular circumstances of Britain in the age of revolutions is not Sagar's concern. As Sagar sees it, the fundamental issues addressed by Smith's political thought concern the distinctive form taken by commercial society in the modern era. Smith, according to Sagar, held that all advanced societies are commercial societies. Commercial society as such needed no vindication. The question, rather, was what kind of commercial society a modern state wanted to be. That was a political question insofar as it was a question about the kind of freedom that mattered and about the kind of institutions needed to make that freedom a reality.Defined in maximally general terms, freedom for Smith was the absence of domination, where domination is understood as a lack of security in respect of one's physical safety and possessions. The condition of the poor and powerless had always been one of subjection to the will of the rich and powerful. What changed that, according to Smith, was implementation of the rule of law. This is in itself not a new reading of Smith, but what distinguishes Sagar's version of it is the care with which he examines both the place of the rule of law in Smith's historical account of the emergence of liberty in modern Europe and the precise nature of the connection between the rule of law and freedom. First, on Sagar's view, there needed to be a comprehensive picture of domination and slavery, which had been the normal condition of almost everyone for almost all of human history. Then there needed to be an explanation of how it was that, at one particular historical moment, domination was slowly but surely challenged by the emergence of law and law courts considered as independent of political power. In England, this was the story of the common law and of judges who held office for life, rather than at the pleasure of traditional possessors of power. It was the story of security in property, of the backing of property by law, and it was a largely urban story, of burghers who managed to enlist monarchs on their side in the battle against the barons. It was, in other words, in large part a medieval story, and one consequence is that there was more to say about the rise of liberty in the modern age than that it was caused inadvertently by... Looking at Dickinson and Hölderlin, this essay begins by exploring the idea of the poetic dimension of existence and its relation to the image, or more precisely, to the capability to disclose into images. For Dickinson the relentless “poverty” of a non-poetic existence indicates that what is missing from such existence are not just images but the capacity for their “disclosing” - the poetic gift or aptitude. With the help of Heidegger’s essays on poetry and poverty, I invert this (...) relation between image and poverty to show that, even though the inceptive character of the poetic word and the element of poetic dwelling it allows to emerge appear poor in comparison to images or concepts, it is the poetic word that for the very first time lets humans dwell. Although it can neither boast the richness of “pictures” nor the strength and precision of conceptual comprehension, the poetic is what opens up the world for humans and simultaneously opens their being to its characteristic manner of inhabiting this world.
