Summary The present paper constitutes an elaboration of a previous work by one of us which, among other things, proposed some modifications of Popper's tetradic schema. Here, in the first part, we consider critically and develop further these modifications and elaborate on methods which prove more satisfactory for the mapping of the problem solving processes in Physics. We also find the opportunity to make some comments on Physics and on its relation to Mathematics. In the second part, there is an (...) attempt to test the above ideas on the genesis and development of the Special Relativity Theory. In doing this, we concentrate mainly on Einstein's 1905 paper and try to explicitate its relation with the situation Physics found itself in that period as well as to clarify the epistemological status of Einstein's two postulates. The ArgumentStarting from the thesis that a science constructs the knowledge of the part of the world allotted to it, the present paper aims at bringing together all the various aspects of physics under a unified conceptual framework — that provided by the Marxian concept “mode of production.” After an introduction providing the initial plausibility grounds for the undertaking, the concept is analyzed into its conceptual elements in Part I of the paper. The analysis presents the reconstruction initiated by Louis (...) Althusser and developed by his followers. Part II starts from a characterization of physical problems. This offers a basis for “reading” physics in the terms introduced in Part I. The rest of Part II is devoted to the identification of all the aspects of physics with the conceptual elements in question. The paper aims at three things: to uncover the connections holding among seemingly disparate aspects of physics, usually discussed in almost total independence from each other; to take full account of the social dimensions of physics without vindicating social constructivism; to show that the boundaries separating the disciplines of philosophy, history and sociology of science are more arbitrary than usually considered. In this work, the author deals with the source of Ottoman Family Law, its application examples and its transformation adventure, together with theory, based on court records in different cities. It reflects the examples of the concrete side of the practical applications of Islamic family law, the Hanafi sect in particular, reflected in the registers in the Ottoman Empire. In general, the application is in accord with the views in fiqh sources. However, the views in the fürû sources of the (...) Ḥanafī sect on some controversial issues caused difficulties in practice. In order to eliminate the troubled situations, the state power sought a solution by intervening with kanunnâme, adâletnâme and fermans at the request of Sheikh al-Islam. In addition to these records regarding the implementation of Islamic family law, the book also includes, the observations and notes of travelers, ambassadors and researchers who had been in the Ottoman country. Particular emphasis is placed on the parts that reflect the contradiction. The subject in the book is examined two parts as Classical Period and Ottoman Family Law in post-Tanzimat. In second chapter, it is stated that a radical change was made in the Islamic/Ottoman family law by including the views of four sects with the preparation of Hukûk-ı Aile Kararnamesi. (shrink)

The paper attempts to walk some first steps toward a unified and empirically oriented theory of both the structure and the history of physics. Physics is considered a structured whole made up of three interconstitutive elements (conceptual system, object, experimental procedures). This conceptual system is always already interpreted while it is this interpretation which ties the system to our overall experience thereby making it understood. It is argued that our experience is always ideologically (and thence socially) determined and that this (...) interpretation inevitably harbours the ideological element in the form of scientifically unwarranted ideological "assumptions." The character of such "assumptions" is discussed, some examples are given and some consequences for the history of physics are drawn. (shrink)

Traditionally it has been thought that scientific controversies can always be resolved on the basis of empirical data. Recently, however, social constructionists have claimed that the outcome of scientific debates is strongly influenced by non-evidential factors such as the rhetorical prowess and professional clout of the participants. This volume of previously unpublished essays by well-known philosophers of science presents historical studies and philosophical analyses that undermine the plausibility of an extreme social constructionist perspective while also indicating the need for a (...) richer and more realistic account of scientific rationality. Now that the excitement created by the historicist turn in philosophy of science has cooled down, the particular questions raised by this turn do not command anymore the almost exclusive attention of practitioners in the field. Philosophers of science feel freer to embark on such different projects as, for example, an effort to reexamine—on the basis of the lessons taught and of the experience gained—the issues which dominated the scene before the historicist movement erupted. Tuberculosis (TB) is a potentially fatal infectious disease that, in Aotearoa New Zealand (NZ), inequitably affects Asian, Pacific, Middle Eastern, Latin American, and African (MELAA), and Māori people. Medical research involving genome sequencing of TB samples enables more nuanced understanding of disease strains and their transmission. This could inform highly specific health interventions. However, the collection and management of TB isolate samples for research are currently informed by monocultural biomedical models often lacking key ethical considerations. Drawing on a qualitative kaupapa (...) Māori–consistent study, this paper reports on preliminary discussions with groups of Māori, Pacific, and Afghan people in NZ, whose communities have been harmed by TB and TB stigma. Participants’ discussions highlight key concerns and meanings that ought to inform the development of guidelines and a more robust consultative process for the governance of how TB isolate samples are collected and used both retrospectively and in future research. We argue for ethical processes to be culturally nuanced and community-generated, flexible and meaningful, and situated in relation to the physical and symbolic effects of TB. We discuss the significance of Indigenous data sovereignty, rights, and kāwanatanga (governorship) in shaping a multicultural data sovereignty model. (shrink)

Modern scholars have been concerned with the hostility shown to Alexander by the Hellenistic schools of philosophy. Two literary portraits have been distinguished, the Peripatetic and the Stoic, the former deriving from Theophrastus' book on Callisthenes, or starting with this work the Peripatetics worked out a theory of and applied it to Alexander, in order to belittle his achievements. It was a case of giving sophisticated expression to the kind of crude resentment expressed by Demades.

The locus classicus for Plutarch's own views on his methods is in the Alexander He has begun by asking for the indulgence of his readers if they do not find all the exploits of Alexander and Caesar recounted by the biographer or if they discover him not reporting some famous incident in detail (); and he goes on to compare his own search for evidence which will indicate the kind of soul, with the activity of the painter, who, in order (...) to create a likeness, concentrates on the eyes and pays little attention to the other parts. Commentators and critics have been right to take this as a key text for the purpose of understanding Plutarch's attitude towards his biographical work; nevertheless there are other passages in the Lives where we can at least glimpse his attitude to his subject, and we can only see the Alexander-remarks in correct perspective if we take these other passages into account. I propose therefore, starting with the Alexander, to see how far these critical remarks apply to Plutarch's theory and practice elsewhere in the Lives. (shrink)

According to the Ars Amatoria the notorious rape took place on the occasion of a primitive dramatic entertainment staged in a theatre, in which the seats and furnishings were also primitive. There is no time for a description of the arts of the performers—a tibicen and a ludius—before the Romans, impatient for action, receive their signal from Romulus. Nor is there any mention of a god in whose honour the entertainment had been provided.

The study of defeasible reasoning unites epistemologists with those working in AI, in part, because both are interested in epistemic rationality. While it is traditionally thought to govern the formation and (with)holding of beliefs, epistemic rationality may also apply to the interrogative attitudes associated with our core epistemic practice of inquiry, such as wondering, investigating, and curiosity. Since generally intelligent systems should be capable of rational inquiry, AI researchers have a natural interest in the norms that govern interrogative attitudes. Following (...) its recent coinage, we use the term ``zetetic'' to refer to the properties and norms associated with the capacity to inquire. In this paper, we argue that zetetic norms can be modeled via defeasible inferences to and from questions---a.k.a erotetic inferences---in a manner similar to the way norms of epistemic rationality are represented by defeasible inference rules. We offer a sequent calculus that accommodates the unique features of ``erotetic defeat" and that exhibits the computational properties needed to inform the design of zetetic agents. The calculus presented here is an improved version of the one presented in Millson (2019), extended to cover a new class of defeasible erotetic inferences. (shrink)

Trope theory is a leading metaphysical theory in analytic ontology. One of its classic statements is found in the work of Donald C. Williams who argued that tropes qua abstract particulars are the very alphabet of being. The concept of an abstract particular has been repeatedly attacked in the literature. Opponents and proponents of trope theory alike have levelled their criticisms at the abstractness of tropes and the associated act of abstraction. In this paper I defend the concept of a (...) trope qua abstract particular by rejecting arguments that purport to show that tropes should not be understood as abstract and by arguing that the abstractness of tropes plays an indispensable role in one of our more promising trope-theoretic analyses of universals and of concrete objects. In this article, we will attempt to understand Sellars’ puzzling notion of ‘adequate picturing’ and its relation to the Sellarsian ‘conceptual order’ through Spinoza’s intuitive knowledge. First, it will be suggested that there are important structural similarities between Sellarsian ‘adequate picturing’ and Spinoza’s intuitive knowledge which can illuminate some ‘dark’ and not so well understood features of Sellarsian picturing. However, there remain some deep differences between Sellars’ and Spinoza’s philosophy, especially with regard to their notion of ‘adequacy’ and the sense (...) in which an idea can be said to ‘correspond’ with its object. As a consequence of those differences it turns out that, from a Sellarsian viewpoint, Spinoza’s notion of intuitive knowledge is a version of the myth of the Given. However, Sellars’ own proposed way out of the Myth has problematic consequences by Sellars’ own lights: His sharp distinction between the ‘space of reasons’ level and the level of picturing makes the Sellarsian vision of the ‘stereoscopic fusion’ of those levels virtually unintelligible. Finally, it will be argued that a non-standard interpretation of Spinoza’s intuitive knowledge -proposed in Baltas -, combined with a Sellars-inspired bifurcated understanding of Dreyfusian expert knowledge, can provide the means 1) for constructing a notion of intuitive knowledge that evades the myth of the Given, and, 2) for making full sense of the claim that the ‘space of reasons’ dimension of understanding the world can in principle be fused with the ‘picturing’ dimension and provide us with a single complex coherent experience of reality and our place in it. The concept of instantiation is realized differently across a variety of metaphysical theories. A certain realization of the concept in a given theory depends on what roles are specified and associated with the concept and its corresponding term as well as what entities are suited to fill those roles. In this paper, the classic realization of the concept of instantiation in a one-category ontology of abstract particulars or tropes is articulated in a novel way and defended against unaddressed objections.

Sexual violence against women is an issue of urgency that arises in all cultures locally, nationally, globally and transnationally. This problem has broad dimensions in both the public and private domains, both cases that are reported or not reported to law enforcement. Factually, the trend of this problem has been identified as increasing every year in Maluku, Indonesia. Therefore, the church requires serious attention to prevention and systematic treatment to overcome it. This sensitivity and awareness are a manifestation of the (...) church’s sense of calling and responsibility for the restoration of human dignity. The pastoral sermon service model is the church’s strategic approach to handling this problem. This research aimed to develop a model of pastoral sermons for victims of sexual violence against women in Maluku. This research focused on identifying and exploring the tragic experiences and impacts of sexual violence against women. Furthermore, a cross-cultural pastoral model was created for victims of violence.Contribution: This article provided a new perspective from the post-modern homiletics to approach social issues. This new homiletical approach to dealing with the problem of women’s sexual violence is one of the main focuses of ‘Women’s Theological Studies’ in HTS. (shrink)

This paper points out the vagueness and methodological naivete of current anti-normative studies of science. The Tversky-Kahneman paradigm catalogues common 'mistakes' in statistical reasoning, but fails to describe and explain people's embarrassment when these 'mistakes' are pointed out to them. A comprehensive naturalistic account of science should not limit itself to the quick-and-dirty aspects of scientific practice. The semantic view of theories is faulted for failing to account for the processes of prediction and explanation. I also argue against Baltas' (...) examples of ideological assumptions which are purported to be impossible to criticize during certain historical periods. (shrink)

Effective public policy to mitigate climate change footprints should build on data-driven analysis of firm-level strategies. This article’s conceptual approach augments the resource-based view of the firm and identifies investments in four firm-level resource domains to develop capabilities in climate change impact mitigation. The authors denote the resulting framework as the GISTe model, which frames their analysis and public policy recommendations. This research uses the 2008 Carbon Disclosure Project database, with high-quality information on firm-level climate change strategies for 552 companies (...) from North America and Europe. In contrast to the widely accepted myth that European firms are performing better than North American ones, the authors find a different result. Many firms, whether European or North American, do not just “talk” about climate change impact mitigation, but actually do “walk the talk.” European firms appear to be better than their North American counterparts in “walk I,” denoting attention to governance, information management, and systems. But when it comes down to “walk II,” meaning actual Technology-related investments, North American firms’ performance is equal or superior to that of the European companies. The authors formulate public policy recommendations to accelerate firm-level, sector-level, and cluster-level implementation of climate change strategies. (shrink)

A promise to do some action seems to create a binding obligation to do that action. And yet, paradoxically, an obligation seems not to be a fact that we can create or bring into existence; we can create an obligation only by creating or bringing into existence something else. The only way to avoid the paradox is to show that the act of promising creates something other than an obligation, which nonetheless binds us to perform the action in question. After (...) considering and rejecting various options such as the promisee's expectation and the promisor's resolve, Prichard locates the bindingness of a promise in a prior general promise, which allows the noises we make when promising to generate an obligation to perform the promised action. The master narrative of Apartheid South Africa created a specific identity for white boys and men and, together with this identity, a very particular role and place within the South African context. This identity was exemplified in the men who were conscripted into the military from 1967 until 1994, and who participated in operations on the border regions of Namibia and Angola as well as within local townships in the war of liberation against apartheid and minority rule. Many veterans have (...) been left grappling not only with the traumas associated with combat but also with the loss of their identities as war heroes in a country under changed political control. As a result, many of their personal stories and experiences of combat have been silenced by society at large and also, to varying degrees, within their own families, the Church, and among the younger generation who have grown up under a different dispensation. The conflict between vacillating narratives of villains who fought on the wrong side of history and victims of a closed socialisation system has supported the identity struggle faced by many veterans today. Against this backstory, this article explores the effects of storytelling as a trauma release using a narrative approach.Contribution: This article offers a contribution to the use of storytelling in pastoral conversations as a trauma release for untold stories. This insight links to the focus and scope of the journal as a pastoral narrative approach has been used under the umbrella of Practical Theology. (shrink)

Se aborda el problema de qué es una ley científica. Se analiza la concepción tradicional hempeliana sobre la posibilidad de caracterizar una forma lógica para los enunciados de ley científica, que las distinguiría de las regularidades accidentales, concluyendo que ello no es posible. Se analiza entonces el problema de cómo es posible la predicción a partir de enunciados de ley, si no hay diferencia lógica con afirmaciones de regularidad, buscando criterios que permitan el establercimiento de afirmaciones proyectables. Correlativamente se trata (...) el problema de la normatividad de un criterio de identificación de candidatos a enunciados de ley, candidatos que ya no denominamos "lawlike statements" puesto que se ha abandonado la pretensión de que lo que determina los buenos candidatos a leyes sea su forma. A lo largo del texto se analizan de modo argumentado las posiciones filosóficas más tradicionales. Las conclusiones apuntan a la posibilidad de criterios de identificación a leyes sólo parcialmente normativos. (shrink)
