There has been some concern m recent years that economic interests in the biotechnology area could, particularly through patenting, have a constricting influence on scientific research. Despite this concern, there have been no studies of this phenomenon beyond isolated cases. In this article we examine the evolution of the biomedical field of hybridoma/monoclonal antibody research with detailed examples of the three types of patent claims that have emerged there—basic claims, claims on application techniques, and claims on specific antibodies. We analyze (...) the impact of these claims and their legal histories on the free flow of scientific information and, the activity of scientific researchers. We conclude that such patent claims present severe restrictions for both, not only in the monoclonal area but in general, amounting to a subtle but significant shift in the political economy of science and technology. Collaborative forms of work such as extended networks, expert groups, and consortia increasingly structure biomedical activities. They are particularly prominent in the cancer field, where procedures such as multicenter clinical trials have been instrumental in establishing the specialty of oncology, and subfields such as cancer genetics, where bioclinical activities—for example, testing for breast and ovarian cancer genes and follow-up interventions—are predicated on the articulation of a number of tasks performed by new clinical collectives. In this article, we examine the founding (...) and development of a French bioclinical collective—the Groupe Génétique et Cancer —that coordinates and structures the activities of most French actors in cancer genetics and operates simultaneously in the clinical, research, and regulatory domains. To examine the group’s structure and dynamics, the article combines information gathered through traditional fieldwork methods with information elicited from a coauthorship and semantic-network analysis of the publications of GGC members from 1969 to 2001. At several places in this paper we have made use of a well-known rhetorical device: an argument was made; a character —dubbed “fictional reader” — was then evoked who voiced some objections against that particular argument; and finally, we answered those objections, thus bringing to a close, at least temporarily, our argument. The use of this device raises a question: “How is the presence of the ‘fictional reader” to be understood?” Is it a “mere” rhetorical tool, or does this character (...) designate some particular target? For instance, depending on the context, it could be seen as aimed at different straw men: traditionally minded sociologists, Whiggish historians, well-intentioned philosophers of science. Actually, none of these characters is behind the “fictional reader”. Rather, it refers, potentially, to any of the scientific actors (Milstein, Schwaber, Koprowski, Cohn, and so on) who inhabit our set of narratives. In other words, the “fictional reader” is an icon for the “native” reader/writer who simultaneously produces and questions the products of that particular literary activity known as scientific texts, by explicitly and implicitly raising the issue of the distinction between fact and technique.By following actors in their disputes about the novelty of K & M's contribution, it became apparent that it is not exactly clear which of the different elements of “hybridoma technology” should be regarded as “novel.” Was it the use of the P3 myeloma line? Was it the theoretical framework related to the notion of allelic exclusion? Was it ...? In each and every case, arguments can be made for or against the existence of a certain continuity or discontinuity with previous work. And in each case, the determination of novelty, as translated through the continuity/discontinuity issue, appeared to be hanging on the previous attribution of an epistemological status to the object that had allegedly been discovered: was it a fact or a technique?If one focuses on the relatively narrow network of immunogenetics, it could be argued that within that particular evidential context a series of “facts” had been established which, when transferred to other fields, such as the virological research being pursued in Koprowski's institute, were translated into a technique. However, as we have seen, even from an immunogenetic point of view the production of monoclonal antibodies can be viewed as being simultaneously a fact and a technique to establish that fact. Not only, as he himself noted,139 was Milstein not seeking to develop a technique for the production of monoclonal antibodies when the original experiments were carried out, but the significance later imputed to those experiments was not immediately attributed to them. The paper was seen as one among other papers that used cell fusion techniques to dissect the genetic control of antibody diversity. Distinctions that now appear crucial (e.g.: were the fusion partners two myelomas or a myeloma and a spleen cell?) were easily overlooked. At some point, around 1977, the production of monoclonal antibodies became a goal in itself, no longer linked to the initial immunogenetic network. The transformation of [MILSTEIN 75] into the foundational event of “hybridoma technology” was thus achieved. This transformation did not flow naturally from the original experiments. Rather, it involved specific investments which mobilized the activity of a large number of other scientific and industrial actors.140A tentative generalization can be deduced from our case study. The dichotomy between fact and technique that underlines much of contemporary science studies seem to be fundamentally misconceived, insofar as the determination of what counts as a fact and what counts as a technique is not possible on a priori grounds. Historians and sociologists of science are confronted with a field of heterogeneous interventions where particular pieces of work are constituted as discrete entities and simultaneously attributed a technical or a factual identity. “Novelty” and “innovation” are precisely the result of such polymorphic attributional processes. This paper builds on previous work that investigated anticancer drugs as ‘informed materials’, i.e., substances that undergo an informational enrichment that situates them in a dense relational web of qualifications and measurements generated by clinical experiments and clinical trials. The paper analyzes the recent transformation of anticancer drugs from ‘informed’ to ‘informing material’. Briefly put: in the post-genomic era, anti-cancer drugs have become instruments for the production of new biological, pathological, and therapeutic insights into the underlying etiology and evolution of (...) cancer. Genomic platforms characterize individual patients’ tumors based on their mutational landscapes. As part of this new approach, drugs targeting specific mutations transcend informational enrichment to become tools for informing their targets, while also problematizing the very notion of a ‘target’. In other words, they have become tools for the exploration of cancer pathways and mechanisms. While several studies in the philosophy and history of biomedicine have called attention to the heuristic relevance and experimental use of drugs, few have investigated concrete instances of this role of drugs in clinical research. Contemporary popular culture is riddled with references to Mexican drug cartels, narcos, and drug trafficking. In the United States, documentary filmmakers, journalists, academics, and politicians have taken note of the increasing threats to our security coming from a subculture that appears to feed on murder and brutality while being fed by a romanticism about power and capital. Carlos Alberto Sánchez uses Mexican narco-culture as a point of departure for thinking about the nature and limits of violence, culture, and personhood. (...) A Sense of Brutality argues that violent cultural modalities, of which narco-culture is but one, call into question our understanding of “violence” as a concept. The reality of narco-violence suggests that “violence” itself is insufficient to capture it, that we need to redeploy and reconceptualize “brutality” as a concept that better captures this reality. Brutality is more than violence, other to cruelty, and distinct from horror and terror—all concepts that are normally used interchangeably with brutality, but which, as the analysis suggests, ought not to be. This major publication is a history of the semantic tradition in philosophy from the early nineteenth century through its incarnation in the work of the Vienna Circle, the group of logical positivists that emerged in the years 1925-1935 in Vienna who were characterised by a strong commitment to empiricism, a high regard for science, and a conviction that modern logic is the primary tool of analytic philosophy. In the first part of the book, Alberto Coffa traces the roots of (...) logical positivism in a semantic tradition that arose in opposition to Kant's theory that a priori knowledge is based on pure intuition and the constitutive powers of the mind. In Part II, Coffa chronicles the development of this tradition by members and associates of the Vienna Circle. Much of Coffa's analysis draws on the unpublished notes and correspondence of many philosophers. The book, however, is not merely a history of the semantic tradition from Kant 'to the Vienna Station'. Coffa also critically reassesses the role of semantic notions in understanding the ground of a priori knowledge and its relation to empirical knowledge and questions the turn the tradition has taken since Vienna. El presente artículo intenta elucidar la observación de Wittgenstein que sostiene que la forma de un problema filosófico se puede presentar con la expresión “Yo no sé salir del atolladero” (IF § 123). En el artículo se elige, a manera de ejemplo, el escándalo kantiano, que demanda que demostremos con el uso de (...) la razón que la proposición “hay objetos físicos” es verdadera. Sin renunciar al ejemplo, se explora en qué sentido la expresión de Wittgenstein caracteriza en buena medida la naturaleza misma de la dificultad filosófica. En el ejercicio se atienden recomendaciones formales del Tractatus, terapias desplegadas en Sobre la Certeza y el recurso de distinguir entre sentido primario y sentido secundario de una expresión insinuado en las Investigaciones Filosóficas. Abortion is largely accepted even for reasons that do not have anything to do with the fetus' health. By showing that (1) both fetuses and newborns do not have the same moral status as actual persons, (2) the fact that both are potential persons is morally irrelevant and (3) adoption is not always in the best interest of actual people, the authors argue that what we call ‘after-birth abortion’ (killing a newborn) should be permissible in all the cases where abortion (...) is, including cases where the newborn is not disabled. Human-centered explainable AI (HCXAI) advocates for the integration of social aspects into AI explanations. Central to the HCXAI discourse is the Social Transparency (ST) framework, which aims to make the socio-organizational context of AI systems accessible to their users. In this work, we suggest extending the ST framework to address the risks of social misattributions in Large Language Models (LLMs), particularly in sensitive areas like mental health. In fact LLMs, which are remarkably capable of simulating roles and personas, may lead (...) to mismatches between designers' intentions and users' perceptions of social attributes, risking to promote emotional manipulation and dangerous behaviors, cases of epistemic injustice, and unwarranted trust. To address these issues, we propose enhancing the ST framework with a fifth 'W-question' to clarify the specific social attributions assigned to LLMs by its designers and users. This addition aims to bridge the gap between LLM capabilities and user perceptions, promoting the ethically responsible development and use of LLM-based technology. (shrink)

The ethics of deceased organ procurement (OP) is supposedly based on individual consent to donate, either explicit (opt-in) or presumed (opt-out). However, in many cases, individuals fail to express any preference regarding donation after death. When this happens, the decision to remove or not to remove their organs depends on the policy’s default option or on family preferences. Several studies show that in most countries the family plays a significant and often decisive role in the process of decision-making for OP. (...) Depending on the country, the family may be allowed to take different kinds of actions in different situations, and this may be granted either by law or by clinical practice only. This adds much complexity to the usual classification of consent policies in two categories: opt-in and opt-out. Here we propose a novel and comprehensive taxonomy of the models of consent for OP according to three variables: (1) the deceased’s wishes, if any, (2) family wishes, if any, and (3) default policies. By analysing these models of consent, we show that they rely on at least three different concepts of autonomy: individual autonomy, relational autonomy, and family autonomy. In light of this analysis, we discuss the ethical debates surrounding two policy approaches: presumed consent and family veto. (shrink)

In Leibniz’s New Essays stands out, within many important topics, his doctrine of innate ideas, which supposes the division between sense knowledge and innate knowledge and implies the distinction between truths of reason and truths of fact. That doctrine is particularly relevant for Leibniz’s philosophy, but implicitly entails the epistemological difference between belief, on one hand, and certainty, on the other. In this paper I outline, according to my interpretation, how Leibniz explains that humans can have certainty about innate ideas. (...) This topic is important because if Leibniz demonstrates the possibility of having certainty of those ideas, then, it is feasible to believe in its existence. However, if his explanation is unsatisfactory his metaphysical doctrine would be seriously weakened and, at the same time, both skepticism and Locke’s empiricist doctrine would be reinforced. The classification of preserved hypothalamic activity in brain death and brainstem death as functional or non-functional has become a subject of debate. While proponents of the neurological criterion claim that these activities lack functional significance (Shemie et al. 2014), Nair-Collins and Joffe (2023) argue for their functional physiological role. However, the interpretation of the term "function" within the medico-legal framework, where death is characterized by the irreversible cessation of all brain functions, remains unclear. -/- My intention here is not to (...) engage in a debate over the validity of different viewpoints regarding the functional significance of preserved activities in the hypothalamus or the heart. Rather, I aim to highlight the critical importance of exploring and defining the concept of function in medicine, which currently lacks clarity. My point is that, whatever our position in the brain death debate, reaching a consensus on this conceptual matter would minimize misunderstandings and establish a robust foundation for further insightful analysis. Gestützt auf die bisher unveröffentlichten Teile des Briefwechsels von Leibniz mit Denis Papin aus der Zeit von 1692 bis 1700 wird in diesem Aufsatz versucht, einige Aspekte der Leibnizschen Dynamik darzulegen. Insbesondere wird der apriorische Beweis der Erhaltung der actio f ormalis im Zusammenhang mit der Diskussion zwischen Leibniz und Papin über die Messung der Kraft bei der horizontalen Bewegung behandelt. Es war Leibniz* Absicht, durch den apriorischen Beweis die Dynamik zu begründen und die Cartesianischen Gesetze der Bewegung zu ersetzen. (...) Papin seinerseits beschränkte sich auf die physikalische Ebene der Gesetze der Mechanik. Im Laufe der Debatte entwickelte Leibniz als Antwort auf Papins Kritik wichtige Argumente über die metaphysische Begründung der Dynamik. Die Begriffe actio f ormalis, inertia naturalis, entelecheia und Geschwindigkeit als quantitas intensiva werden in diesem Zusammenhang von Leibniz gegen Papins Einwände verteidigt. (shrink)

The Australian Federal Government has announced a two-year trial scheme to compensate living organ donors. The compensation will be the equivalent of six weeks paid leave at the rate of the national minimum wage. In this article I analyse the ethics of compensating living organ donors taking the Australian scheme as a reference point. Considering the long waiting lists for organ transplantations and the related costs on the healthcare system of treating patients waiting for an organ, the 1.3 million AUD (...) the Australian Government has committed might represent a very worthwhile investment. I argue that a scheme like the Australian one is sufficiently well designed to avoid all the ethical problems traditionally associated with attaching a monetary value to the human body or to parts of it, namely commodification, inducement, exploitation, and equality issues. Therefore, I suggest that the Australian scheme, if cost-effective, should represent a model for other countries to follow. Nonetheless, although I endorse this scheme, I will also argue that this kind of scheme raises issues of justice in regard to the distribution of organs. Thus, I propose that other policies would be needed to supplement the scheme in order to guarantee not only a higher number of organs available, but also a fair distribution. (shrink)
