We argue that strong moral objections to widespread implementation of uterine transplantation persist despite recent live births following the procedure. These objections relate not only to the serious medical risk to which live donors are currently subject but also to the strength of pronatalistic and biologistic social forces. We explore medical risk in light of various factors and treat questions relating uterine transplantation to gestational surrogacy.

Recent, well-publicized scandals, involving unethical conduct have rekindled interest in academic misconduct. Prior studies of academic misconduct have focussed exclusively on situational factors (e.g., integrity culture, honor codes), demographic variables or personality constructs. We contend that it is important to also examine how␣these classes of variables interact to influence perceptions of and intentions relating to academic misconduct. In a sample of 217 business students, we examined how integrity culture interacts with Prudence and Adjustment to explain variance in estimated frequency of (...) cheating, suspicions of cheating, considering cheating and reporting cheating. Age, integrity culture, and personality variables were significantly related to different criteria. Overall, personality variables explained the most unique variance in academic misconduct, and Adjustment interacted with integrity culture, such that integrity culture had more influence on intentions to cheat for less well-adjusted individuals. Implications for practice are discussed and future research directions are offered. (shrink)

Decision-Making Capacity First published Tue Jan 15, 2008; substantive revision Fri Aug 14, 2020 In many Western jurisdictions the law presumes that adult persons, and sometimes children that meet certain criteria, are capable of making their own medical decisions; for example, consenting to a particular medical treatment, or consenting to participate in a research trial. But what exactly does it mean to say that a subject has or lacks the requisite capacity to decide? This question has to do with what (...) is commonly called “decisional capacity”, a central concept in health care law and ethics, and increasingly an independent topic of philosophical inquiry. -/- Decisional capacity can be defined as the ability of subjects to make their own medical decisions. Somewhat similar questions of capacity arise in other contexts, such as capacity to stand trial in a court of law and the ability to make decisions that relate to personal care and finances. However, the history behind the more general legal notions of capacity to stand trial and capacity to manage one’s life is different and operates somewhat differently in law (Roth, Meisel, & Litz 1977; Zapf & Roesch 2005). For the purposes of this discussion the notion of decisional capacity will be limited to medical contexts only; most notably, those where decisions to consent or to refuse treatment or participation in clinical research are concerned. There are many commonalities between the goals of transitional justice and domestic redress movements. We look at the movement for reparations for enslavement and Jim Crow in the United States as an example of a domestic reparations movement, and argue for the usefulness of the concept of transitional justice. We are particularly interested in showing that a future democratic transition – the end of mass incarceration – could animate a renewed push for reparations and a formal investigation into America’s legacy (...) of racial injustice. Recent research into cultural transmission suggests that humans are disposed to learn, remember, and transmit certain types of information more easily than others, and that any information that is passed between people will be subjected to cognitive selective pressures that alter the content and structure so as to make it maximally transmittable. This paper presents a review of emerging research on content biases in cultural evolution with relevance to the transmission of popular narratives. This is illustrated with content analysis of (...) urban legends, which found that most exploited at least one known content bias, with emotional information and social information being the most frequent. We argue that the narratives do not succeed because of the transmission of adaptively relevant information but because of their exploitation of content biases in human cognition. (shrink)

There is a puzzle concerning the essences of fundamental entities that arises from considerations about essence, on one hand, and fundamentality, on the other. The Essence-Dependence Link (EDL) says that if x figures in the essence of y, then y is dependent upon x. EDL is prima facie plausible in many cases, especially those involving derivative entities. But consider the property negative charge. A negatively charged object exhibits certain behaviors that a positively charged object does not: it moves away from (...) other negatively charged objects, towards positively charged objects, etc. It is commonly thought that negative charge disposes its bearer to move away from other negatively charged objects, towards positively charged objects, etc. But if negative charge is fundamental, then no other entities—including the property positive charge—can figure in its essence. We thus have a prima facie puzzle: How can we say anything interesting about the essences of fundamental entities without running afoul of EDL? In this paper, I present and discuss the consequences of EDL for the debate between causal essentialists and quidditists about properties, and propose solutions to the puzzle. (shrink)

Properties seem to play an important role in causal relations. But philosophers disagree over whether or not properties play their causal or nomic roles essentially. Causal essentialists say that they do, while quidditists deny it. This article surveys these two views, as well as views that try to find a middle ground.

Abstract: Practical deliberation is deliberation concerning what to do governed by norms on intention (e.g. means-end coherence and consistency), which are taken to be a mark of rational deliberation. According to the theory of practical deliberation I develop in this paper we should think of the norms of rational practical deliberation ecologically: that is, the norms that constitute rational practical deliberation depend on the complex interaction between the psychological capacities of the agent in question and the agent's environment. I argue (...) that this view does a better job of justifying particular norms for practical deliberation than intrinsic or constitutivist theories. Finally, I argue against the Myth Theory of deliberation, which takes there to be no such norms on deliberation. (shrink)

In humans, gender is both a concept and performance embodied by females and males, a corporeal technology that is produced dialectically. The process of gendering robots makes especially clear that gender belongs both to the order of the material body and to the social and discursive or semiotic systems within which bodies are embedded. This article explores and interrogates the gendering of humanoid robots manufactured today in Japan for employment in the home and workplace. Gender attribution is a process of (...) reality construction. Roboticists assign gender based on their common-sense assumptions about female and male sex and gender roles. Whereas the relationship between human bodies and genders is a contingent one, I argue that gendered robots render that relationship a necessary one by conflating bodies and genders. Humanoid robots are the vanguard of posthuman sexism, and are being developed within a reactionary rhetorical climate. (shrink)

As a philosophy professor, one of my central goals is to teach students to think critically. However, one difficulty with determining whether critical thinking can be taught, or even measured, is that there is widespread disagreement over what critical thinking actually is. Here, I reflect on several conceptions of critical thinking, subjecting them to critical scrutiny. I also distinguish critical thinking from other forms of mental processes with which it is often conflated. Next, I present my own conception of critical (...) thinking, wherein it fundamentally consists in acquiring, developing, and exercising the ability to grasp inferential connections holding between statements. Finally, given this account of critical thinking, and given recent studies in cognitive science, I suggest the most effective means for teaching students to think critically. (shrink)

According to current definitions of civil disobedience, drawn from the work of John Rawls and Carl Cohen, eco-saboteurs are not civil disobedients because their disobedience is not a form of address and/or does not appeal to the public's sense of justice or human welfare. But this definition also excludes disobedience by a wide range of groups, from labor activists to hunt saboteurs, either because they are obstructionist or because they address moral concerns other than justice or the public weal. However (...) earlier definitions of civil disobedience were not so narrow. I review the development of the current definition and the circumstances of its acceptance. I argue that the circumstances which help to explain the attractiveness of the Rawls/Cohen formulations in the 1970s are no longer applicable and that the question of civil disobedience should be revisited. I suggest a wider definition according to which at least some types of eco-sabotage would be civil disobedience. (shrink)

The Federal Trade Commission has an important role to play in the governmental oversight of mobile health apps, ensuring consumer protections from unfair and deceptive trade practices and curtailing anti-competitive methods. The FTC’s consumer protection structure and authority is outlined before reviewing the recent FTC enforcement activities taken on behalf of consumers and against developers of mhealth apps. The article concludes with identification of some challenges for the FTC and modest recommendations for strengthening the consumer protections it provides.

The new field of experimental philosophy has emerged as the methods of psychological science have been brought to bear on traditional philosophical issues. Oxford Studies in Experimental Philosophy will be the place to go to see outstanding new work in the field. It will feature papers by philosophers, papers by psychologists, and papers co-authored by people in both disciplines. The series heralds the emergence of a truly interdisciplinary field in which people from different disciplines are working together to address a (...) shared set of questions. The inaugural volume is roughly structured into four sections. The first three papers focus on recent developments in moral psychology, a topic that has seen lively debate and a great deal of progress over the last decade. The second section highlights three contributions that bring new methods to moral psychology: formal modeling and special populations. The third section brings together four papers that adopt an experimental philosophy approach to novel topics, including intuitive dualism, generics, joint action, and happiness. The Character Gap by Christian Miller is an excellent discussion of how the empirical research conducted on virtue bears upon the larger question of whether or not people are virtuous, especially when we consider the question through the lens of a philosophically rigorous account of virtue. His conclusion is that overall people are not virtuous—but then, neither are they vicious. In this commentary, I challenge the latter. I explore two alternative ways of conceiving of vice and utilize a range of (...) empirical findings—on topics ranging from bullying, to sexual assault, to factory farming—to argue that perhaps vice is much more prevalent than Miller believes, a worry that deserves our attention and concern. In this paper, I explore the implications of adopting one model of self rather than another in respect to one particular feature of our mental life. The need to explain synchronic unity in normal subjectivity, and also to explain the apparent and puzzling absence of synchronic unity in certain symptoms of severe mental disorder, I show, becomes more pressing with one particular model. But in the process of developing that explanation we learn something about subjectivity and perhaps also something about (...) brain functioning. (shrink)

Modal primitivists hold that some modal truths are primitively true. They thus seem to face a special epistemological problem: how can primitive modal truths be known? The epistemological objection has not been adequately developed in the literature. I undertake to develop the objection, and then to argue that the best formulation of the epistemological objection targets all realists about modality, rather than the primitivist alone. Furthermore, the moves available to reductionists in response to the objection are also available to primitivists. (...) The evidence reveals that young children are targeted by food and beverage advertisers but are unable to comprehend the commercial context and persuasive intent of marketing. Although the First Amendment protects commercial speech, it does not protect deceptive and misleading speech for profit. Marketing directed at children may fall into this category of unprotected speech. Further, children do not have the same First Amendment right to receive speech as adults. For the first time since the Federal Trade Commission's original attempt (...) to regulate marketing to children in the 1970s , the political, scientific, and legal climate coalesce to make the time well-suited to reevaluate the FTC's authority for action. This paper analyzes the constitutional authority for the FTC to regulate television food marketing directed at children as deceptive in light of the most robust public health evidence on the subject. Previous research reveals that when leaders enact environmentally specific transformational leadership, they positively affect corporate environmental responsibility. While this research provides important insights into how leaders create and shape corporate environmental responsibility, confidence in the validity of these findings is limited because the psychometric properties of the measurement of environmentally specific transformational leadership has not yet been assessed. The goal of the current research was to develop and validate a measure of environmentally specific transformational leadership. To this end, four studies (...) were conducted, which together produced a reliable and valid scale from which future research can stem. Theoretical and practical limitations are discussed. (shrink)

Reid offers an under‐appreciated account of the primary/secondary quality distinction. He gives sound reasons for rejecting the views of Locke, Boyle, Galileo and others, and presents a better alternative, according to which the distinction is epistemic rather than metaphysical. Primary qualities, for Reid, are qualities whose intrinsic natures can be known through sensation. Secondary qualities, on the other hand, are unknown causes of sensations. Some may object that Reid's view is internally inconsistent, or unacceptably relativistic. However, a deeper understanding shows (...) that it is consistent, and relative only to normal humans. To acquire this deeper understanding, one must also explore the nature of dispositions, Reid's rejection of the theory of ideas, his distinction between sensation and perception, and his distinction between natural and acquired perceptions. There's a student in my philosophy class who has "real potential." I might express this thought in any of the following ways: "She is potentially a philosopher"; "She is a potential philosopher"; "She has the potential to be a philosopher." The first way uses a cognate of "potential" as an adverb to modify "is." The second ways uses "potential" as an adjective to modify "philosopher." However, the third way uses "potential" as a noun to refer to something that the student (...) has. What kind of thing is this potential? One worry about even asking this question is that this nominalization of the adjective "potential" suggests a metaphysical picture that is an artifact of language. This is even more strongly suggested by the less ambiguous nominalization "potentiality." Once we have the term "potentiality," we have a new kind of entity to countenance, and questions about its nature arise. One might argue, just because we use the word "potentiality," we should not think that it refers to a "thing" that someone can "have." There is something disingenuous about such an argument. It proceeds as if the adverbial and adjectival uses of "potential" are unproblematic, and questions only arise with the nominalization. But it is not obvious what it means to potentially be something, or what it means to be a potential something. To say that someone "is potentially" a philosopher is to talk about a way of being that falls short of actuality. And a "potential philosopher" is not a kind of philosopher at all. So what is it? Each of the three above formulations is a modal claim. If there is anything philosophical puzzling about a potentiality claim, it is not going to go away by translating it into an equivalent modal claim. In this chapter I defend the existence of potentialities against anti-realist arguments, and make a proposal as to their nature. The proposal, in short, is that potentialities are properties, specifically dispositions, though more needs to be said about properties and dispositions. I will do this in Part I. In Part II, I will address two lines of argument against potentialities: that they are reducible, and that they are causally inert. (shrink)
