This paper reports the first case in which a linguist served as an expert witness in Hong Kong, a former British colony that has operated as a special administrative region of the People’s Republic of China (PRC) since 1997. The dispute was on the meaning of the political slogan “Liberate Hong Kong, Revolution of Our Times”, which was widely adopted during the 2019–2020 protests. The keywords “liberate” and “revolution” are smoking gun evidence for the prosecution in a large cluster of (...) cases that involve sedition law and national security offences. Section I of the paper provides background information about a case the author was involved in, which was concerned with whether the slogan was seditious. Section II describes the analysis conducted, which concludes that the slogan as a whole refers to a need to rectify a problem and to return to the original, a more desirable state of affairs for Hong Kong, without specifying what problem there is and what the desirable state of affairs looks like. Section III highlights some critical issues in the analysis, discussing challenges faced and ethical questions for the expert witness. This paper takes a bottom-up approach to empirically investigate how people construct the meaning of obscenity, and offers an experientialist, cognitive linguistic account to explain why the term appears to defy definition and makes a problematic legal concept. To study the contextual dependence of the term, we examined the extent to which various item characteristics (such as genre, context, and the race or celebrity status of the people portrayed) and individual variables (such as gender, religion, sexual orientation and previous personal (...) and cultural experiences) influence our perception of seemingly obscene materials. We report correlations that have not been previously shown. The data support the thesis that the meaning of obscenity emerges in a cognitive-affective response that arises during a dynamic process of interpretation, and thus allows for extralegal factors to influence judgment. The results challenge the assumption that obscenity is a symbolic representation of objectively existing reality and argue that community standard of obscenity is a legal fiction. (shrink)

Background Residual dried blood spots (rDBS) from newborn screening programmes represent a valuable resource for medical research, from basic sciences, through clinical to public health. In Hong Kong, there is no legislation for biobanking. Parents’ view on the retention and use of residual newborn blood samples could be cultural-specific and is important to consider for biobanking of rDBS. Objective To study the views and concerns on long-term storage and secondary use of rDBS from newborn screening programmes among Hong Kong Chinese (...) parents. Methods A mixed-method approach was used to study the views and concerns on long-term storage and secondary use of rDBS from newborn screening programmes among Hong Kong Chinese parents of children 0–3 years or expecting parents through focus groups (8 groups; 33 participants) and a survey (n = 1012, 85% mothers) designed with insights obtained from the focus groups. We used framework analysis to summarise the themes as supportive factors, concerns and critical arguments for retention and secondary use of rDBS from focus group discussion. We used multiple logistic regression to assess factors associated with support for retention and secondary use of rDBS in the survey. Results Both in focus groups and survey, majority of parents were not aware of the potential secondary use of rDBS. Overall secondary use of rDBS in medical research was well accepted by a large proportion of Hong Kong parents, even if all potential future research could not be specified in a broad consent. However parents were concerned about potential risks of biobanking rDBS including leaking of data and mis-use of genetic information. Parents wanted to be asked for permission before rDBS are stored and mainly did not accept an “opt-out” approach. The survey showed that parents born in mainland China, compared to Hong Kong born parents, had lower awareness of newborn screening but higher support in biobanking rDBS. Higher education was associated with support in rDBS biobanking only among fathers. Conclusion Long-term storage and secondary use of rDBS from newborn screening for biomedical research and a broad consent for biobanking of rDBS are generally acceptable to Hong Kong parents given their autonomy is respected and their privacy is protected, highlighting the importance of an accountable governance and a transparent access policy for rDBS biobanks. On one hand, Chinese consumers are well known for conspicuous consumption and the adoption of luxury products and named brands. On the other hand, they also have a bad reputation for buying counterfeit products. Their simultaneous preferences for two contrasting types of product present a paradox that has not been addressed in the literature. This study attempts to present an explanation of this paradox by examining the effects of traditional Chinese cultural values and consumer values on consumers’ deontological judgment of (...) pirated CDs and the amount of social benefits they perceive they gain from them. We interviewed 300 Hong Kong Chinese consumers, and found that face consciousness increased materialism and risk aversion, thereby producing a favorable deontological judgment of pirated CDs. Face consciousness also has a direct effect on the amount of social benefits perceived in pirated CDs. Both favorable deontological judgment and perceived social benefits contributed to a strong intention to buy pirated CDs. The results are discussed in a cultural perspective. (shrink)

BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. The fundamental tenet of contemporary sociobiology, namely the assumption of a single process of evolution involving the selection of genes, is critically examined. An alternative multiple-level, multiple-process model of evolution is presented which posits that the primary process that operates via selection upon the genes cannot account for certain kinds of biological phenomena, especially complex, learned, social behaviours. The primary process has evolved subsidiary evolutionary levels and processes that act to bridge the gap between genes and these complex behaviours. The (...) subsidiary levels are development, individual animal learning, and socioculture itself. It is argued that individual learning is pivotal to the derivation and biological analysis of culture. The differences between cultural and noncultural societies are stressed. It is concluded that such a multiple-level model of evolution can form the basis for reconciling opposing sides in the sociobiology debate. (shrink)

What credentials does evolutionary epistemology have as science? A judgement based on past performance, both in terms of advancing an empirical programme and further ng theory construction, is not much. This paper briefly outlines some of the research areas, both theoretical and empirical, that can be developed and that might secure for evolutionary epistemology a future in evolutionary biology.

There are many passages in ancient literature which depict an imaginary existence different from the hardships of real life-an existence blessed with Nature's bounty, untroubled by strife or want. Naturally this happy state is always placed somewhere or sometime outside normal human experience, whether ‘off the map’ in some remote quarter of the world, or in Elysium after death, or in the dim future or the distant past. Such an imaginary time of bliss in the past or the future has (...) become known as the ‘golden age’. This is the name which modern scholars generally give to the ancient belief. The phrase is often echoed by modern poets. The same language has been transferred from the unknown to the known, and it has become a commonplace to describe an outstanding period of history or literature as a ‘golden age’. (shrink)

The extent of the dependence of early Greek cosmogony on mythical conceptions has long been a prolific source of controversy. Views on the subject have varied from Professor Cornford's claim that ‘there is a real continuity between the earliest rational speculation and the religious representation that lay behind it’ to Professor Burnet's extreme statement, ‘it is quite wrong to look for the origins of Ionian science in mythological ideas of any kind.’ The solution of the problem that I wish to (...) suggest is one which should satisfy those who insist on ‘the scientific character of the early Greek cosmology,’ while retaining a direct connection with pre-scientific beliefs—namely, that some, at least, of the earliest philosophers founded their doctrines of the beginning of the universe on a deliberate rationalization of earlier and contemporary mythical ideas. The appearance of notions like the ‘world-egg’ in a number of passages, too well known for quotation, shows that primitive cosmogony assumed an analogy between the generation of the world and the generation of animate creatures. I believe it can be proved that, so far from the ‘renunciation of sexual imagery’ which even Professor Cornford has recently attributed to Anaximander, he and other philosophers retained the habit of regarding cosmogony and anthropogony as parallel phenomena, only substituting for the mythical ‘world-egg’ a more scientific view of the embryo and its development. They looked at the world through the same spectacles as their predecessors, but after wiping from them the rose tint of mythological fancy. (shrink)
