Current health care standards, in many countries, Australia included, are regrettably poor. Surprisingly, practitioners and treating teams alike in mental health and disability sectors, in particular, make far too many basic care-related mistakes, in addition to the already abundant diagnostic mistakes that cause and amplify great harm. In part, too many practitioners also fail to distinguish adverse effects for what they are and all too often treat adverse effects, instead, as comorbidities. Diagnostic failures are dangerous, the result of which generates (...) and perpetuates harms that are extremely costly in terms of patient welfare, in addition to the financial burden placed on everyone. In this essay, I contend that the authority bestowed upon psychiatry is misplaced. Subsequently, this misplaced authority affects the governing and investigatory institutions reliant and informed by psychiatry. The examination process undertaken in this investigation traces the metaphysics of psychiatric disorders relative to the Diagnostic-Statistical-Manual (DSM) in all its iterations and to the epistemological construction process that serves to underpin the fundamentals of psychiatric practice. There exists a crisis of confidence in psychiatric practice and I urge drastic reform be undertaken to arrest the damage. (shrink)

The virtuous character and the ethical agent represent mutually inclusive terms, neither of which independently, in the Aristotelian tradition, is considered an innate quality. Virtues, if not innate, are contingent; but what makes each instantiation recognisably general? Normative ethics in this sense is a dynamic process and similarly process philosophy is based on the principle that existence is dynamic and that it should be the primary focus of any philosophical account of reality. I argue that the transformative process is equally (...) as important as the end result of realising the virtuous dispositional traits. An important criticism of virtue ethics is the focus on character and not rules such as industry practices and codes found in the professions. The criticism however is less worrisome than usually accepted. The reasoning herein developed to overcome this criticism rests on the presupposition that no one exists in isolation and virtues are developed in a social context and not simply given. Using process philosophy as a methodological approach to examine virtue ethical agency and the transformative process involved in its realisation elicits insights that allow the conceptual development of a more robust account of virtue ethics. I extend this nuanced rendition, in ways already commenced by others, into areas of organisational, environmental and intergenerational ethics. (shrink)

Antonio Signorini’s contribution to the constitutive theory of non-linear elasticity is reconstructed and analyzed. Some uninformed opinions suggesting he had a minor role, lacking of significant results, are discussed and refuted. It is shown that Signorini should be rightly credited for being among the first scholars aware of the central problem of non-linear elasticity: the determination of the general form of the elastic potential.

This Research Topic aimed at deepening our understanding of the levels and explanations that are of interest for cognitive sci- entists, neuroscientists, psychologists, behavioral scientists, and philosophers of science. Indeed, contemporary developments in neuroscience and psy- chology suggest that scientists are likely to deal with a multiplicity of levels, where each of the different levels entails laws of behavior appropriate to that level (Berntson et al., 2012). Also, gathering and modeling data at the different levels of analysis is not suffi- (...) cient: the integration of information across levels of analysis is a crucial issue. Given such state of affairs, a number of interesting questions arise. How can the autonomy of explanatory levels be properly understood in behavioral explanation? Is reductionism a satis- factory strategy? How can high-level and low-level models be constrained in order to be actually explanatory of both behav- ioral and neurological or molecular evidence? The recent in vitro derivation of gamete‐like cells from mouse embryonic stem (mES) cells is a major breakthrough and lays down several challenges, both for the further scientific investigation and for the bioethical and biolegal discourse. We refer here to these cells as gamete‐like (sperm‐like or oocyte‐like, respectively), because at present there is still no evidence that these cells behave fully like bona fide sperm or oocytes, lacking the fundamental proof, i.e. combination with a normally derived gamete of the opposite (...) sex to yield a normal individual. However, the results published so far do show that these cells share some defining features of gametes. We discuss these results in the light of the bioethical and legal questions that are likely to arise would the same process become possible with human embryonic stem (hES) cells. (shrink)

In this paper I defend an 'ontology of binding relations' entailed in a critical examination of the concept of ‘being’ based on a new perspective of the human organism conceived as a Space-Time-Event-Motion entity or containment-field of being. As such the paper serves to defend the viability of ontology by way of revising how we ought to engage in ontological thinking. Central to this analysis is to demonstrate what explanations can be deduced by examining what otherwise have remained disparate ontological (...) categories such to enable a new view of two major metaphysical problems: the ‘problem of identity and persistence’ and associated ‘problem of composition’. As a result of this examination a candidate coupling formulation emerges to serve as a principle of individuation. The central issue here concerns whether Being as explored by Martin Heidegger in Being and Time is constituted spatiotemporally. As such this project has two interlinked objectives. One objective is to supply conceptually plausible answers to Heidegger’s unanswered questions regarding the temporality of Being, which he raised at the very end of Being and Time. In response I argue that each individual human being is constituted as a Space-Time-Event-Motion (STEM) containment-field embodied entity. Heidegger situates Dasein (human existence) in a temporal (...) stream moving towards the nothingness of death but all the while separating being and time as two distinct phenomena rather than coexistent. I demonstrate why this was a crucial error in Heidegger’s thinking. The second objective deals with the sense of authentic being developed by Heidegger. The spatiotemporal nature of one’s life for Heidegger is understood from the standpoint of Being-in-the-world, as an engaged participant, coexistent with the world, so that contextually it is through this engagement in recognition of this facticity or thrownness that one comes to recognise one’s own authentic self. Somewhat problematic is the coexistent phenomenological recognition that one does not live in isolation and as such one may question what of the contingent, constraining and influencing factors that shape one’s sense of self particularly against the backdrop of self-other relations. This project is situated methodologically within Process Philosophy, and it is from this perspective that draws attention to the role of human agency in which individuals are spatiotemporally construed in terms of Space-Time-Event-Motion (STEM) entities. When examining the human being as a conscious being, we are still to arrive at an understanding of, firstly, the conditions required whereby physical processes give rise to consciousness and secondly, how consciousness is something fundamental to life as an intrinsic part of nature. Humans are complex organisms with myriad interacting systems whereby the convergence of the activities toward the support and development of the whole organism requires a high level of organisation. Though what accounts for the dynamic unity of (...) the human being? From an empirical perspective the question remains unanswered. The aim of this paper is to conceptually establish a fundamental biophysical organising principle to account for the unity and organisation of the human being. To this end I draw from David Bohm’s interpretation of quantum theory to provide an adapted and adjunct conceptual scheme in the form of a Triple-Aspect-Theory (TAT) of Being as a grounding ontology. David Bohm presented a holistic view of two interwoven orders of existence defined as the Explicate material world and the Implicate (quantum) enfolded world from which the former materialises. Consistent with David Bohm’s idea that matter at a fundamental level consists of a kind of protointelligence, the TAT facilitates a perspective based on aspect conditions of the human organism intended to furnish an explanation of the constitutive mechanism (TAT) inherent in the evolving human being. The TAT operates as an organising principle by which evolution inherently proceeds and maintains itself in an interactive relation between the Implicate and Explicate orders. The accumulated effect of natural selection is to produce adaptations, but without an organising principle: ‘Consciousness’, ‘Body-of-Experience’ and ‘Intellect-Reflective’ (the terms for the engaged coexistent aspects of being) it is argued could not occur. The content of this paper is primarily the product of an attempt to understand consciousness by working through the Gestell - conventionalised epistemology, at least some of several foundational concepts. This paper indirectly addresses the ancient question: “How is objective reference – or intentionality, possible? How is it possible for one thing to direct its thoughts upon another thing?” As such, I have adopted a holistic methodology; one in which I develop a framework based on a form of process philosophy (...) and descriptive emergentism. Many of the problems associated within the philosophy of mind arise because of a failure to understand the interrelations among the concepts we employ when we talk about consciousness and perception. These concepts are generally associated with certain structural features of reality. Hence, the paper advances through a series of attempts at defining the concept of time, moving through to some of the central figures, their thoughts and arguments and problems associated within the philosophy of time. Given the intertwined nature of the associated concepts, I have expanded on these to a level of conceptual integration. (shrink)

The disciplinary enterprises engaged in the study of consciousness now extend beyond their original paradigms providing additional knowledge toward an overall understanding of the fundamental meaning and scope of consciousness. A new transdisciplinary domain has resulted from the syncretism of several approaches bringing about a new paradigm. The background for this overarching enterprise draws from a variety of traditions. In this paper however elaboration is restricted to the quantum-mechanical account in David Bohm’s theoretical work in relation to his ideas about (...) “active information”, “protointelligence”, and “non-locality”. This leads to an adapted version of Bohm’s thesis concerning the implicate order and explicate order of the Universe - the Impression Order and the Expression Order, respectively. On this view, the Universe is formed on an actual-material level, the apparent properties of things, and a potential-material level, a constant process of becoming that exerts an attractive force on the present. The central thesis emerges from a radical reformulation of certain core concepts that transforms many ontological assumptions about the material basis of consciousness. That is, the above platform inclusively connects to a hypothesis that the concepts of ‘space’, ‘time’, ‘event’, and ‘motion’ can be unified to capture the notion of simultaneous activity at reducing levels to the Impression order. This notion coheres with a physical-theoretical model of Signature-Energy-Frequency which has been well demonstrated in the atomic, chemical, and information fields. This study embraces a holistic and creative worldview based on a triadic model wherein consciousness itself is postulated as the most basic, primordial stratum. Importantly, both orders are constantly conjoined since the Impression Order exists as potential energy of the quantum vacuum. The physical realm is formed by the proposed Triangulate-Three conditions as a principle of animation and ‘being’: Consciousness, Body-of-Experience and Intellect-Reflective in the Expression Order, one aspect of which emerge as lifelike properties. This Triangulate-Three principle inheres in every particle and organism to which it guides its development, adaptation, and survival. The conscious being thus possesses all three conditions in Expression Order through STEM-interactions via SEF transmissions, as a self-organising organism. (shrink)

The Australian Football League (AFL) is the premier sporting competition in Australia in terms of capital outlay, breadth of industry associations, public consumption, and arguably cultural significance. The AFL competition is now a domain of specialisations and interests, which provides vast opportunity for both sporting and non-sporting institutions seeking to utilise the game to capitalise on a society of consumption, entertainment and risk. AFL officials expect high standards of their players both on and off the field. These standards are expressed (...) in various forms of Codes and Policies. Off field player misconduct is an ongoing concern not escaping media attention, which is a resounding indication more needs to be done by the AFL to improve responsible player character development. Whether the current education programmes are sufficient to meet the AFL’s own expectations is the central issue addressed in this chapter. As it stands AFL governance is deficient on several counts. In this chapter I will focus on three governance deficiencies: firstly, the AFL Illicit Drug Policy (IDP) contains unnecessary inconsistencies relative to its primary purpose; secondly, the present measures undertaken to ensure players have appropriate education to achieve the expected character development are far from efficacious and so arguably can be vastly improved; and thirdly, the promotion of live-odds gambling during televised games is culturally problematic and inconsistent with its own demands. The ethical grounds central to this investigation are ‘fairness’ and ‘cultural influence’. In order to resolve some of its governance concerns I will explain why the AFL should be characterised as a practice-community and as such should adopt a comprehensive virtue and value-based compliance ethical education programme consistent with its own vision and conduct expectation of its players and officials. I will argue that the AFL as a practice community is much more than simply a game, given its cultural influence, commercial associations and community programmes. (shrink)

The moving spotlight account (MS) is a view that combines an eternalist ontology and an A-theoretic metaphysics. The intuition underlying MS is that the present time is somehow privileged and experientially vivid, as if it were illuminated by a moving spotlight. According to MS-theorists, a key reason to prefer MS to B-theoretic eternalism is that our experience of time supports it. We argue that this is false. To this end, we formulate a new family of positions in the philosophy of (...) time, which differ from MS in that, intuitively, they admit a plurality of moving spotlights. We argue that these ‘deviant’ variants of MS cannot be dismissed as conceptually incoherent, and that they are as well-supported by our experience as is MS. One of these variants, however, is consistent with the B-theory. Thus, if our experience of time supports MS, then it supports the B-theory as well. (shrink)

Open futurism is the indeterministic position according to which the future is ‘open’, i.e., there is now no fact of the matter as to what future contingent events will actually obtain. Many open futurists hold a branching conception of time, in which a variety of possible futures exist. This paper introduces two challenges to branching-time open futurism, which are similar in spirit to a challenge posed by Fine to tense realism. The paper argues that, to address the new challenges, open (...) futurists must adopt an objective, non-perspectival notion of actuality and subscribe to an A-theoretic, dynamic conception of reality. Moreover, given a natural understanding of “actual future”, it is perfectly sensible for open futurists to hold that a unique, objectively actual future exists, contrary to a common assumption in the current debate. The paper also contends that recognising the existence of a unique actual future helps open futurists to avoid potential misconceptions. (shrink)

In the years of his maturity Fichte seems to go beyond the self-sufficiency of natural rights theories towards a philosophy of practice more consonant with the developments of his Doctrine of the Science. In this paper we show that it is possible to eliminate the converse operator from the propositional dynamic logic CPDL (Converse PDL), without compromising the soundness and completeness of inference for it. Specifically we present an encoding of CPDL formulae into PDL that eliminates the converse programs from a CPDL formula, but adds enough information so as not to destroy its original meaning with respect to satisfiability, validity, and logical implication. Notably, the resulting PDL formula is polynomially related to the (...) original one. This fact allows one to build inference procedures for CPDL, by encoding CPDL formulae into PDL, and then running an inference procedure for PDL. (shrink)

This paper explores taste fragmentalism, a novel approach to matters of taste and faultless disagreement. The view is inspired by Kit Fine’s fragmentalism about time, according to which the temporal dimension can be constituted—in an absolute manner—by states that are pairwise incompatible, provided that they do not obtain together. In the present paper, we will apply this metaphysical framework to taste states. In our proposal, two incompatible taste states (such as the state of rhubarb’s being tasty and the state of (...) rhubarb’s being distasteful) can both constitute reality in an absolute manner, although no agent can have joint access to both states. We will then develop a formalised version of our view by means of an exact truthmaker semantics for taste assertions. Within this framework—we argue—our linguistic and inferential practices concerning cases of faultless disagreement are elegantly vindicated, thus suggesting that taste fragmentalism is worth of further consideration. Retracing the primary common aspects between anthropological and psychoanalytic thought, in this article, we will further discuss the main common points between the notions of the unconscious according to Carl Gustav Jung and Claude Lévi-Strauss, taking into account the thought of Erich Neumann. On the basis of very simple elementary logic considerations centered around the basic notion of the separation of opposites, our observations might be useful for speculations on the possible origins of rational thought and hence on the origins (...) of consciousness. Artefacts do not always do what they are supposed to, due to a variety of reasons, including manufacturing problems, poor maintenance, and normal wear-and-tear. Since software is an artefact, it should be subject to malfunctioning in the same sense in which other artefacts can malfunction. Yet, whether software is on a par with other artefacts when it comes to malfunctioning crucially depends on the abstraction used in the analysis. We distinguish between “negative” and “positive” notions of malfunction. A negative malfunction, (...) or dysfunction, occurs when an artefact token either does not or cannot do what it is supposed to. A positive malfunction, or misfunction, occurs when an artefact token may do what is supposed to but, at least occasionally, it also yields some unintended and undesirable effects. We argue that software, understood as type, may misfunction in some limited sense, but cannot dysfunction. Accordingly, one should distinguish software from other technical artefacts, in view of their design that makes dysfunction impossible for the former, while possible for the latter. (shrink)

A widespread opinion holds that norms and codes of conduct as such can only be established via words, that is, in some lexical form. This perspective can be criticized: some norms produced by human acts are not word-based at all. For example, many norms are actually conveyed through graphics (e. g. road signs and land-use maps), sounds (e. g. the referee’s whistle), a silent gesture (the traffic warden’s signal to halt). In this article, we will focus on the norms that (...) are created by means of drawings and can be termed “drawn norms” or “graphical norms.” Specifically, we will inquire into the phenomenon of graphical norms with particular regard to traffic signs and land-use plans, and we will discuss the philosophical and legal problems to which these phenomena give rise. This book provides a general survey of the main concepts, questions and results that have been developed in the recent interactions between quantum information, quantum computation and logic. Divided into 10 chapters, the books starts with an introduction of the main concepts of the quantum-theoretic formalism used in quantum information. It then gives a synthetic presentation of the main “mathematical characters” of the quantum computational game: qubits, quregisters, mixtures of quregisters, quantum logical gates. Next, the book investigates the puzzling entanglement-phenomena (...) and logically analyses the Einstein–Podolsky–Rosen paradox and introduces the reader to quantum computational logics, and new forms of quantum logic. The middle chapters investigate the possibility of a quantum computational semantics for a language that can express sentences like “Alice knows that everybody knows that she is pretty”, explore the mathematical concept of quantum Turing machine, and illustrate some characteristic examples that arise in the framework of musical languages. The book concludes with an analysis of recent discussions, and contains a Mathematical Appendix which is a survey of the definitions of all main mathematical concepts used in the book. (shrink)

This volume illustrates both theoretically and empirically the differences between religious diversity and religious pluralism. It highlights how the factual situation of cultural and religious diversity may lead to individual, social and political choices of organized and recognized pluralism. In the process, both individual and collective identities are redefined, incessantly moving along the continuum that ranges from exclusion to inclusion. The book starts by first detailing general issues related to religious pluralism. It makes the case for keeping the empirical, the (...) normative, the regulatory and the interactive dimensions of religious pluralism analytically distinct while recognizing that, in practice, they often overlap. It also underlines the importance of seeking connections between religious pluralism and other pluralisms. Next, the book explores how religious diversity can operate to contribute to legal pluralism and examines the different types of church-state relations: eradication, monopoly, oligopoly and pluralism. The second half of the book features case studies that provide a more specific look at the general issues, from ways to map and assess the religious diversity of a whole country to a comparison between Belgian-French views of religious and philosophical diversity, from religious pluralism in Italy to the shifting approach to ethnic and religious diversity in America, and from a sociological and historical perspective of religious plurality in Japan to an exploration of Brazilian religions, old and new. The transition from religious diversity to religious pluralism is one of the most important challenges that will reshape the role of religion in contemporary society. In this Introduction we lay out the context of a ‘Continental philosophy of biology’ and suggest why Georges Canguilhem’s place in such a philosophy is important. There is not one single program for Continental philosophy of biology, but Canguilhem’s vision, which he referred to at one stage as ‘biological philosophy’, is a significant one, located in between the classic holism-reductionism tensions, significantly overlapping with philosophy of medicine, philosophy of technology and other themes moving away from the more common existential and (...) phenomenological motifs of post-war European thought. This book is a systematic analysis of John R. Searle’s philosophy of mind. Searle’s view of mind, as a set of subjective _and_ biologically embodied processes, can account for our being part of nature _qua_ mindful beings. This model finds support in neuroscience and offers reliable solutions to the problems of consciousness, mental causation, and the self.

So-called Locke's thesis is the view that no two things of the same kind may coincide, that is, may be completely in the same place at the same time. A number of counter-examples to this view have been proposed. In this paper, some new and arguably more convincing counter-examples to Locke's thesis are presented. In these counter-examples, a particular entity (a string, a rope, a net, or similar) is interwoven to obtain what appears to be a distinct, thicker entity of (...) the same kind. It is argued that anyone who subscribes to certain standard metaphysical arguments, which are generally taken for granted in the debate about Locke's thesis, is virtually compelled to accept the counter-examples. This paper presents a systematic discussion, mainly for non-economists, on economic approaches to the concept of sustainable development. As a first step, the concept of sustainability is extensively discussed. As a second step, the argument that it is not possible to consider sustainability only from an economic or ecological point of view is defended; issues such as economic-ecological integration, inter-generational and intra-generational equity are considered of fundamental importance. Two different economic approaches to environmental issues, i.e. neo-classical environmental economics and ecological (...) economics, are compared. Some key differences such as weak versus strong sustainability, commensurability versus incommensurability and ethical neutrality versus different values acceptance are pointed out. (shrink)

The following article proposes an empirical study to explore communication strategies in the Cosa Nostra. Psychological studies on the characteristics of the language within the criminal organization are undoubtedly recent, but crucial to thoroughly understand the characteristics of implicit and explicit communication it adopts in the various contexts it works, as well as the power and value they assume. The data we have obtained from some videos concerning interviews and police interrogations to men of honor have been analyzed through a (...) method that refers to the grounds of qualitative research in clinical psychology, the Grounded Theory by Glaser and Strauss. The analysis we have carried out and its relevant data show us a world of the Mafia where the care for linguistic choices, for both form and contents, is characterized as a crucial activity, even when words are replaced by silence or gestures. Henri Bergson (1859–1940), the most prominent member of nineteenth-century French spiritualism, is the first philosopher who explicitly defined philosophy as a practice which consists in posing problems anew and in creating concepts. In this article, I will try to reconstruct the progressive importance acquired by the terms ‘problem’ and ‘concept’ in nineteenth-century French philosophy and how they combined in Bergson’s theories about creativity, invention and novelty. I will argue that Bergson’s conception of philosophy as a creative intellectual practice was the (...) result of a negotiation, inside a pre-existent spiritualist framework, between, on the one hand, neo-Kantianism and, on the other hand, evolutionism which strongly influenced empirical psychology and the emerging social sciences. Bergson’s solution, influenced by the evolution of mathematics and literary theory, was just one of the possible options, and the main alternative to a new form of transcendental philosophy. (shrink)
