Predictivists use the no miracle argument to argue that “novel” predictions are decisive evidence for theories, while mere accommodation of “old” data cannot confirm to a significant degree. But deductivists claim that since confirmation is a logical theory-data relationship, predicted data cannot confirm more than merely deduced data, and cite historical cases in which known data confirmed theories quite strongly. On the other hand, the advantage of prediction over accommodation is needed by scientific realists to resist Laudan’s criticisms of the (...) no miracle argument. So, if the deductivists are right, the most powerful argument for realism collapses. There seems to be an inescapable contradiction between these prima facie plausible arguments of predictivists and deductivists; but this puzzle can be solved by understanding what exactly counts as novelty, if novel predictions must support the no miracle argument, i.e., if they must be explainable only by the truth of theories. Taking my cues from the use-novelty tradition, I argue that (1) the predicted data must not be used essentially in building the theory or choosing the auxiliary assumptions. This is possible if the theory and its auxiliary assumptions are plausible independently of the predicted data, and I analyze the consequences of this requirement in terms of best explanation of diverse bodies of data. Moreover, the predicted data must be (2) a priori improbable, and (3) heterogeneous to the essentially used data. My proposed notion of novelty, therefore, is not historical, but functional. Hence, deductivists are right that confirmation is independent of time and of historical contingencies such as if the theorist knew a datum, used it, or intended to accommodate it. Predictivists, however, are right that not all consequences confirm equally, and confirmation is not purely a logical theory-data relation, as it crucially involves background epistemic conditions and the notion of best explanation. Conditions (1)–(3) make the difference between prediction and accommodation, and account for the confirming power of theoretical virtues such as non ad-hocness, non-fudging, non-overfitting, independence and consilience. I thus show that functional novelty (a) avoids the deductivist objections to predictivism, (b) is a gradual notion, in accordance with the common intuition that confirmation comes in degrees, and (c) supports the no miracle argument, so vindicating scientific realism. The contrast between the past-future symmetry of mechanical theories and the time-arrow observed in the behaviour of real complex systems doesn’t have nowadays a fully satisfactory explanation. If one confides in the Laplace-dream that everything be exactly and completely describable by the known mechanical differential equations, the whole experimental evidence of the irreversibility of real complex processes can only be interpreted as an illusion due to the limits of human brain and shortness of human history. In this work it is (...) surmised that in the description of real events it would be more reasonable to renounce exactness and completeness of mechanical differential equations, assuming that also further effects exist in nature, governed by different kinds of rules, in spite of being so weak to be directly unobservable in single motions. This surmise can explain not only the time-arrow, but also why, in particular cases, it can happen that approximate and/or statistical models represent an improvement of mechanical theories instead of an approximation: this happened for Boltzmann gas-model and also for the famous work of Max Planck on blackbody-radiation. And it also appears as a more promising “working hypothesis”, stimulating and guiding us to learn more about limits and origin of the basic equations, and also about the nature of chance and the meaning of probability, which is nowadays not clear in spite of the fundamental role it plays in physics. Particularly that kind of probability which gives the connection between quantum–mechanical differential equations and observable events. (shrink)

Deployment Realism resists Laudan’s and Lyons’ objections to the “No Miracle Argument” by arguing that a hypothesis is most probably true when it is deployed essentially in a novel prediction. However, Lyons criticized Psillos’ criterion of essentiality, maintaining that Deployment Realism should be committed to all the actually deployed assumptions. But since many actually deployed assumptions proved false, he concludes that the No Miracle Argument and Deployment Realism fail. I reply that the essentiality condition is required by Occam’s razor. In (...) fact, there is a simpler formulation of essentiality which escapes Lyons’ criticisms and rescues the No Miracle Argument and Deployment Realism from their purported historical counterexamples: a hypothesis is essential when it has no proper parts (in Yablo’s sense) sufficient to derive the same prediction. Although essentiality so conceived cannot be detected prospectively, this is just natural, and it is not a problem but an advantage for Deployment Realism. (shrink)

O artigo apresenta uma reflexão sobre a guerra a partir de Carl Schmitt e Hannah Arendt. Para tanto, realiza-se um recorte na obra de cada autor. De Carl Schmitt, discute-se o livro O conceito do político (2009) que contém ainda A teoria do Partisan. De Hannah Arendt, restringe-se a Sobre a violência (2001), A promessa da política (2020), e alguns ensaios contidos em Entre o passado e o futuro (2009). Neste sentido, Carl Schmitt permite discutir o papel da inimizade para (...) a decisão acerca da guerra e como essa situação-limite, ao mesmo tempo, constitui e afeta a dimensão do político. Já Hannah Arendt permite delinear certos traços constitutivos das guerras modernas que escapam à preocupação central Schmittiana, sobretudo o perigo intrínseco da inimizade produzir não a intensificação do político, mas a eliminação da vida humana sobre à Terra. Trata-se, enfim, de pensar o efeito do avanço tecnológico no campo dos assuntos humanos e como essa tópica transforma o estatuto da guerra. (shrink)

One extreme example of intergenerational environmental change is given by nuclear waste. The radiation from a typical nuclear waste assembly will remain fatal for humans for millennia, creating the problem of communicating a warning about hazardous repositories to people so far in the future that we cannot assume any common ground with them in terms of languages and cultural contexts. This poses limitations to solutions proposed in the context of semiotics. The need for communicating danger and for keeping future people (...) away from certain sites may be tackled from a more sensorial and aesthetic perspective. Given the size of nuclear waste repositories, and the problem of keeping people at a distance, the dimension at which the problem must be tackled is environmental. This work argues for an exploration of what environmental aesthetics, despite and perhaps thanks to all the ongoing definitional and conceptual debates in the discipline, has to offer. (shrink)

Un'attenzione particolare, alla fine di ogni capitolo, è dedicata all'eredità moderna e al significato attuale dei problemi dell'etica antica, proponendo in modo esplicito un collegamento fra ricostruzione storica e discussione teorica contemporanea.

This essay addresses the relationships between prescription and description in legal rules. The analysis will focus on the culture-laden connotations of factual categories implied in all legal sentences and/or provisions. This investigation is spurred by the need to assess the impact of cultural difference in people’s understanding of legal imperatives and, symmetrically, how that impact is to be considered in the application of law. Differences in ways of categorizing the world could position the cultural pre-understanding required by law, and the (...) pluralism recognized and protected by constitutional principles and human/fundamental rights discourse, at a crossroads. Hence, even when we find an illegitimacy or an ignorance about what legal rules do not explicitly state but instead implicitly presuppose, this does not exclude that behind that ignorance there may be something worthy of legal protection. A question emerges: is it legitimate and reasonable to consider the ignorantia facti resulting from differing ways of categorizing the factual world as automatically and uncritically subject to the principle ignoratia legis non excusat? The essay continues with an assessment of the possible consequences of ignorantia facti in the administration of justice in multicultural societies and migration contexts. For this purpose, the opportunity for an intercultural use of law—including within national law—will be considered as a means of avoiding the discriminatory application of ignorantia facti. This topic will be addressed by leveraging both semiotic and cultural-anthropological analytical tools, including the well-known greimasien “contrat de véridiction”. (shrink)

RESUMO: O presente artigo tem por objetivo investigar a recepção do Tratado Teológico-Político de Espinosa, bem como sua crítica da religião pelo Marquês de Sade, numa obra bastante peculiar e que desafia todas as tentativas de classificação: La Philosophie dans le Boudoir. Em seu "Quinto Diálogo", Sade insere um texto intitulado "Franceses, mais um esforço se quereis ser Republicanos". Através do emprego desse artifício metalinguístico - um livro dentro de um livro - a política é agora introduzida na alcova e (...) o leitor se dá conta de que a instrução de Eugénie não é meramente sexual, mas também uma educação filosófica e política. Por meio de sua crítica ao Cristianismo, na primeira seção do texto, Sade argumenta que a tirania e a superstição religiosa são âmbitos intimamente relacionados, e a teologia é um dos principais alicerces do poder político. ABSTRACT: This article aims to investigate the interpretation by the Marquis de Sade of Spinoza's Theological-Political Treatise. Sade's interpretation appears in a very peculiar work which defies all rigid attempts of classification: La Philosophie dans le Boudoir. In the "Fifth Dialogue", Sade inserts a pamphlet entitled "Yet another effort, Frenchmen, if you would become Republicans". Through the employment of a metalinguistic device - a book inside a book - politics is now introduced into the boudoir, and the reader becomes aware that Eugénie's education is not merely sexual, but also philosophical and political. Through his critique of Christianity in the first section of the pamphlet, Sade argues that tyranny and religious superstition are closely related and that theology is one of the main foundations of political power. The many constraints of outer space experience challenge the human ability to coexist. Paradoxically, astronauts assert that on the international space station there are no conflicts or, at least, that they are able to manage their differences, behavioral as well as cognitive, in full respect of human rights and the imperatives of cooperative living. The question is: Why? Why in those difficult, a-terrestrial, and therefore almost unnatural conditions do human beings seem to be able to peacefully and collaboratively live together? (...) What is there beyond terrestrial boundary conditions that allows for such a result? And what can we learn from the astronauts’ experience about the effectiveness of human rights on Earth? My proposal is that the a-terrestrial dimension deeply alters the mind/body indexical framework and, in this way, disentangles the human inclination to semiosis from the cognitive and behavioral habits of categorization and territorialization inherent in the experience on Earth. If analyzed through the spectrum of an interdisciplinary approach involving anthropology, semiology, law, and human geography, I think that outer space enterprises can offer many insights into the cognitive and ethical/political hindrances to the effectiveness of human rights and their intercultural uses. Meanwhile the compulsive greed for a possessive territorialization of outer space and celestial bodies is growing by leaps and bounds. It haunts and imbues both astropolitics and space law. The astronauts’ semio-anthropological experience of human rights and cooperative coexistence seems to have been left in orbit. The future requires awareness and action by anthropologists, semioticians, cognitive scientists, geographers and lawyers, working all together in an interdisciplinary effort to move beyond approaching the experiential with a territorial mindset. The hope is that the “dark dream” of human exploitation/colonization of outer space will not turn from a political and legal speculation into a future reality. (shrink)

This essay, between serious and facetious, addresses an apparently secondary implication of the planetary tragedy produced by Covid-19. It coincides with the ‘problem of the veil,’ a bone of contention in Islam/West relationships. More specifically, it will address the question of why the pandemic has changed the proxemics of public spaces and the grammar of ‘living together.’ For some time—and it is not possible to foresee how much—in many countries people cannot go out, or enter any public places, without wearing (...) a sanitary mask. In short, almost all of us, by obligation or by urgent advice from the public authorities of the various countries, will not live the public sphere with our faces uncovered. The alteration of the social context affecting many Western countries will inevitably involve also the ‘local’ perception of the Islamic veil and—as a matter of equality—the consistency of the prohibition of wearing it. What will thus become of the ban on wearing it in public places established by some countries such as France and asseverated by the ECHR? If everyone can and will have to go around with their faces covered, why should only Islamic women be discriminated against? Will not the change in boundary conditions produced by Covid-19 also induce Western people to re-categorize the meaning of the veil? And will this re-categorization not directly affect the ‘fact’ of wearing the veil, that is, its empirical perception? And still, will this psycho-semantic change not show how empirical perceptions are cultural constructs rather than ‘objective facts,’ as such allegedly independent from the observer’s point of view? Consequentially, will the plurality of perceptions and cultural meanings related to the gesture of covering one’s own face not gain renewed relevance in determining the legitimacy of wearing the veil? The socio-semantic earthquake produced by Covid-19 compels us to rethink this and other issues orbiting around the translation of ‘facts’ into legal language; furthermore, it highlights the instrumentality of many ideological/partisan and ethnocentric assumptions passed off as objectivity regarding those alleged ‘facts.’ The essay will attempt to provide an answer to the above questions by proposing a semiotic-legal approach to intercultural conflicts and, indirectly, the pluralism in law. Recently the CJEU decision in the case of ‘Ewa Glawischnig-Piesczek v. Facebook Ireland Limited’ has raised the issue of the transcultural/trans-territorial signification of hate speech and hate crimes. Taking a cue from this decision and the related semiotic/legal implications, the paper proposes an analysis of the semio/pragmatic conditions for the production of performativity inherent in hate speech across different cultural universes of discourse. Given that web-based digital communication is global—at least, potentially—regardless of any spatial/political compartmentalization, it crosses different semio-cultural circuits. (...) This trans-spatiality implies transcultural crossings that can multiply and even transfigure the semantic implications of the original signifier and the related prognoses of ‘semantic effectiveness.’ Cultural boundaries therefore may function as a kind of ‘horizon of events’ for hate speech and, more inclusively, all linguistic acts and their legal signification/classification. The question then arises regarding whether and to what extent the performativity of hate speech is able to withstand the variation of cultural boundary conditions. Insofar as cultures are universes of experience, the issue to be investigated broadens, and ends up invoking the question of whether or not the production of performativity implicitly presupposes and tacitly epitomizes the semio-pragmatic implications/consequences (or, in Peircean terms, ‘bearings’) coextensive with cultural universes of experience. Were this the case, it would seem to call into question the very possibility of ‘making things only with words,’ or more explicitly, the alleged meaning of ‘linguistic acts.’. (shrink)

Gerald Doppelt claims that Deployment Realism cannot withstand the antirealist objections based on the “pessimistic meta-induction” and Laudan’s historical counterexamples. Moreover it is incomplete, as it purports to explain the predictive success of theories, but overlooks the necessity to explain also their explanatory success. Accordingly, he proposes a new version of realism, presented as the best explanation of both predictive and explanatory success, and committed only to the truth of best current theories, not of the discarded ones. Elsewhere I criticized (...) his new brand of realism. Here instead I argue that Doppelt has not shown that Deployment Realism cannot solve the problems raised by the history of science, explaining explanatory success does not add much to explaining novel predictive success, and Doppelt is right that truth is not a sufficient explanans, but for different reasons, and this does not refute Deployment Realism, but helps to detail it better. In a more explicit formulation, the realist IBE concludes not only to the truth of theories, but also to the reliability of scientists and scientific method, the order and simplicity of nature, and the approximate truth of background theories. Graphs are among the most frequently used structures in Computer Science. Some of the properties that must be checked in many applications are connectivity, acyclicity and the Eulerian and Hamiltonian properties. In this work, we analyze how we can express these four properties with modal logics. This involves two issues: whether each of the modal languages under consideration has enough expressive power to describe these properties and how complex it is to use these logics to actually test whether a given (...) graph has some desired property. First, we show that these properties are not definable in a basic modal logic or in any bisimulation-invariant extension of it, like the modal μ-calculus. We then show that it is possible to express some of the above properties in a basic hybrid logic. Unfortunately, the Hamiltonian and Eulerian properties still cannot be efficiently checked. In a second attempt, we propose an extension of CTL* with nominals and show that the Hamiltonian property can be more efficiently checked in this logic than in the previous one. In a third attempt, we extend the basic hybrid logic with the ↓ operator and show that we can check the Hamiltonian property with optimal complexity in this logic. Finally, we tackle the Eulerian property in two different ways. First, we develop a generic method to express edge-related properties in hybrid logics and use it to express the Eulerian property. Second, we express a necessary and sufficient condition for the Eulerian property to hold using a graded modal logic. (shrink)

Many formulations of scientific realism (SR) include some commitment to metaphysical realism (MR). On the other hand, authors like Schlick, Carnap and Putnam held forms of scientific realism coupled with metaphysical antirealism (and this has analogies in Kant). So we might ask: do scientific realists really need MR? or is MR already implied by SR, so that SR is actually incompatible with metaphysical antirealism? And if MR must really be added to SR, why is that so? And which additional arguments (...) scientific realists need to support it? After reviewing and classifying a number of different kinds of realisms, metaphysical and not, I answer that SR and MR are logically independent of each other, so that there is no logical inconsistency in holding SR while rejecting MR. However, I argue that the “no miracle” argument (NMA) not only is the “ultimate” argument for SR, but by the same token it also supports MR. Therefore one cannot effectively defend SR without also subscribing to MR, but this can be done at no additional argumentative cost. I show this by discussing not only the standard version of the NMA, but also three more versions which are not usually considered as such in the literature. (shrink)

No obstante, aunque el marco conceptual es denso, uno recorre sus páginas con un creciente interés, como si este repertorio sistemático de ideas fuese una necesidad ineludible (...) frente al pensamiento débil y las triquiñuelas esotéricas. En el cuerpo de creencias que uno puede rebatir con las argumentaciones de Bunge figuran la parapsicología, el sociologismo, la psicología evolutiva, las ideologías fundamentalistas e incluso algunos postulados políticos y económicos. En el mágico país de las pseudociencias, donde no rige la retórica de la obviedad (sentido común, si lo prefieren) sino el ronroneo de lo posible, la voz del filósofo argentino suena con una especial intensidad. A lo largo del libro, las revelaciones son constantes. Vivimos en una época en la que casi todo vale, como quien dice. A Neuroscientist Offers Evidence of Where the Brain Ends and Consciousness Begins.

The Bible recounts that in Eden, Adam gives names to all the animals. But those names are not only representations of the animals’ nature, rather they shape and constitute it. The naming by Adam contains in itself the divide between the human and non-human. Then, there is the Fall: Adam falls and forgets Being. Though he may still remember the names he gave to the animals in Eden, he is no longer sure about their meaning. Adam will have to try (...) to remember his own intentions. Through this effort he can also become aware of how he thinks, who he is, and what was the natural order he knew before the Fall. Medieval bestiaries tell us this story. Bestiaries are works of word play populated by animal figures. They depend on back-and-forth anthropomorphization, or circular metaphor. Animal figures are portrayed as both a mirror of human nature and a window on it. Bestiaries served as means for the moral education of human beings and, at the same time, a way to criticize the current state of humanity, including political and ethical habits. Within the moral irony of medieval bestiaries we can find the origin of the invented nature that modernity will try, subsequently, to insert into natural rights discourse through the teleological oxymoron of their naturalized and naturalizing counter-factuality. I will propose a historical-semiotic journey through the ironic representations of the human-beasts from the ancient world to contemporaneity. The proposal resulting from this cultural excursion is that the words included in the many national and international Rights declarations operate much like the names Adam gave to the animals and still more as they were re-read in medieval bestiaries, both textual and musical. So, can the words of Rights still serve as musical scores, open to an infinite play of re-signification? If we were able to overcome the modern culture/nature and human being/animal dualisms, we could cast, today as in the past, a zoological gaze on human rights by means of contemporary bestiaries and, in this way, perhaps find the gist of rights’ names and our ever regained and ever lost again humanity. The scale is the most famous emblem of the law, including intellectual property (IP). Because IP rights impose social costs on the public by limiting access to protected work, the law can be justified only to the extent that, on balance, it encourages enough creation and dissemination of new works to offset those costs. The scale is thus a potent rhetorical trope of fairness and objectivity, but also an instrument the law thinks with – one that is constantly invoked to (...) justify or to question the extent of available IP protection. The balancing act that underlies the legitimacy of IP is, however, literally impossible to perform. Because we are unable to measure the benefits that IP has for inventors or the costs it has for the public, the scale has nothing to weigh. It conveys a clear sense that IP law can be balanced, but in fact propagates only a visible simulacrum of balance – one that is as empty as it is powerful. (shrink)

Epistemologists have debated at length whether scientific discovery is a rational and logical process. If it is, according to the Artificial Intelligence hypothesis, it should be possible to write computer programs able to discover laws or theories; and if such programs were written, this would definitely prove the existence of a logic of discovery. Attempts in this direction, however, have been unsuccessful: the programs written by Simon's group, indeed, infer famous laws of physics and chemistry; but having found no new (...) law, they cannot properly be considered discovery machines. The programs written in the Turing tradition, instead, produced new and useful empirical generalization, but no theoretical discovery, thus failing to prove the logical character of the most significant kind of discoveries. A new cognitivist and connectionist approach by Holland, Holyoak, Nisbett and Thagard, looks more promising. Reflection on their proposals helps to understand the complex character of discovery processes, the abandonment of belief in the logic of discovery by logical positivists, and the necessity of a realist interpretation of scientific research.
