This essay draws upon Gramsci’s understandings of law and of the philosophy of praxis to develop a critical analysis of international law in the constitution and potential revolutionary transformation of the contemporary global political economy. The analysis illustrates the analytical utility of Gramscian conceptions of historical bloc and hegemony in capturing the significance of international law as an effective historical force. It also extends these conceptions, theoretically, by arguing that the global political economy is undergoing a process of juridification in (...) which a commodified legal form provides the template for economic and political regulation. The commodity form theory of law is presented as the key to understanding the significance of international law under the culture of global capitalism. (shrink)

Reaction time to detect a phoneme target in a sentence was found to be faster when the word in which the target occurred formed part of the semantic focus of the sentence. Focus was determined by asking a question before the sentence; that part of the sentence which comprised the answer to the sentence was assumed to be focussed. This procedure made it possible to vary position of focus within the sentence while holding all acoustic aspects of the sentence itself (...) constant. It is argued that sentence understanding is facilitated by rapid identification of focussed information. Since focussed words are usually accented, it is further argued that the active search for accented words demonstrated in previous research should be interpreted as a search for semantic focus. Regulatory authorities have advised smokers who would not or could not quit smoking to switch to lower tar cigarettes. Smoking such cigarettes was seen as a means of reducing the harm caused by smoking, but not as offering a ‘safe’ smoking option. Correspondingly manufacturers have been required to place tar and nicotine information on packet labels and/or advertisements. This paper explores the possibility that the conventional format for conveying tar and nicotine information could be responsible for the belief, held by (...) a significant proportion of smokers, that some brands of lower tar cigarettes are absolutely ‘safe’. To deal with this situation it is suggested that changes should be made to health warnings, and tar and nicotine communications. Proposed changes to the latter are evaluated in terms of their ethical and public health implications. The authors conclude that brand specific warnings and a classification of cigarettes as either ‘Very Dangerous’ or ‘Dangerous’, is best suited to reconciling consumer needs for information with the public health objectives of reducing the harm caused by smoking. This imagined conversation between Sir Isaac Newton and the priestess Diotima examines the possible merits of reductionism in scientific inquiry, finding it of value both as a methodology for the simplification of scientific explanations and for the decisive elimination of metaphysically extravagant scientific hypotheses. However, the power and narrative appeal of reductionism renders its overuse a perennial danger. Science thus needs reductionism, but also needs reminding that its task is to explain natural phenomena, not to explain them away.

Few aspects of social behavior tell us more about a culture than those practices that involve the roles it assigns to models and copies. Under interpretation, such conduct reveals its attitudes toward authority and antiquity, its sense of identity and regard for security, and the relative importance that it attached to imitation and invention. To varying degrees, all societies display these concerns, but in none were they so firmly grounded in a considered theory of the relation between prototype and derivative (...) as they were in Byzantium. An example from the domain of law will illustrate, though not explain, this cultural difference. As against the Roman tradition in which the use of copies as evidence in court was prohibited, at least from the tenth century on Byzantine tribunals accepted the legitimacy of certified copies of documents. The very word used for an official copy—ison, meaning equal— suggests the conceptual distinction between it and the terms copie, Kopie, kopiya, and so on, in modern languages, all derived from the Latin word for abundance. In its proposals for a Performance Related Pay scheme for teachers the Labour Government has presented appraisal as having a dual role. It is to be used to determine the pay of teachers making reference to quantitative targets; and to facilitate teachers' professional development. This article examines the tensions between these two functions of appraisal.

STS scholarship has produced important insights about relationships between the roles of peer review and the social construction of knowledge. Yet, barriers related to access have been a continual challenge for such work. This article overcomes some past access challenges and explores peer review normativities operating in the new discipline of Engineering Education. In doing so, it contributes new insights about disciplinary development, interdisciplinarity, and peer review as a site of knowledge construction. In particular, it draws attention to an aspect (...) of peer review not previously discussed – how peer review normativities are shaped by disciplinary origins. A content analysis of peer review documentation revealed that a hyperfocus on methods, which can be traced back to disciplinary origins, continues to be a guiding normativity. However, interviews with editors revealed that they do not acknowledge that normativity. Implications of those findings and their misalignment are discussed, as are contrasts with the history of other disciplines. (shrink)

The right-to-die debate has gone on for centuries, playing out most recently as a spectacle of protest surrounding figures such as Terry Schiavo. In _Deconstructing Dignity_, Scott Cutler Shershow offers a powerful new way of thinking about it philosophically. Focusing on the concepts of human dignity and the sanctity of life, he employs Derridean deconstruction to uncover self-contradictory and damaging assumptions that underlie both sides of the debate. Shershow examines texts from Cicero’s _De Officiis_ to Kant’s _Groundwork of the (...) Metaphysics of Morals_ to court decisions and religious declarations. Through them he reveals how arguments both supporting and denying the right to die undermine their own unconditional concepts of human dignity and the sanctity of life with a hidden conditional logic, one often tied to practical economic concerns and the scarcity or unequal distribution of medical resources. He goes on to examine the exceptional case of self-sacrifice, closing with a vision of a society—one whose conditions we are far from meeting—in which the debate can finally be resolved. A sophisticated analysis of a heated topic, _Deconstructing Dignity _is also a masterful example of deconstructionist methods at work. (shrink)

This dialogue discusses a proposal for the legalization of torture under specific circumstances and contrasts it with arguments for a total ban on torture. We consider three types of objection: first, that the difficulty of having adequate knowledge renders the stock “ticking bomb” scenario such a low-probability hypothetical as to present no realistic threat to a policy banning all torture; second, that empirically the information gleaned from torture is so unlikely to be reliable that it could not justify the moral (...) risk; and third, that sanctioning torture, even if only under the most extreme circumstances, would generate a ‘culture of torture,’ hence undermining fragile advances in international human rights rooted in unwavering commitment to human dignity. Compelling as these arguments appear, not all the conversants are wholly convinced by them; to this extent the dialogue ends aporetically. (shrink)

Derrida always stipulates that deconstruction is not a ‘‘method’’. But deconstruction nevertheless involves a certain strategy and protocol: terms that both designate a process and serve as an example of that process. Derrida's deployment of these terms clarifies how his analyses of logocentrism anticipate the political texts of his later career. In his early texts, Derrida famously shows how the dyad of speech and writing is a ‘‘violent hierarchy’’ in which speech is everywhere privileged. Clahsen proposes two distinct processing routes, for regularly and irregularly inflected forms, respectively, and thus is apparently making a psychological claim. We argue that his position, which embodies a strictly linguistic perspective, does not constitute a psychological processing model.

This philosophical dialogue explores some of the barriers to an adequate definition of general health, encompassing physical, social, and mental/emotional well-being. Many of the putative obstacles to such a definition—concerns about subjectivity, cultural difference, marginal cases, etc.—prove to be chimerical once the characters take seriously the Peircean insight that truth-claims methodologically grounded in people’s lives, experiences, and conversations need not be apodictic to be useful. Drawing on Canguilhem and others, the characters critically discuss a proposed definition of health: a dynamic (...) equilibrium by which a human being thrives in relation to its situation. Even if war, terrorism, and other acts of political violence are inherently wrong, in so radically imperfect a world as our own there remains a need, as Virginia Held suggests, to evaluate such acts so as to distinguish between degrees of their unjustifiability. This essay proposes a notion of deliberative democracy as one criterion for such a comparative evaluation. Expanding on an analysis of the psychologically terrorizing impact of violence borrowed from Hannah Arendt, I suggest that it is principally this (...) that makes for the special wrongness of terrorism, though that by itself does not show that it is never necessary.An effort to distinguish clearly the superiority of states over non-state actors (or vice versa) in this regard proves futile, so I conclude that there is no automatic legitimacy to be gained by either sort. It follows that we should weigh an act of political violence on its own demerits irrespective of whether it is done by a state or by a group in opposition to states, and further that we should resist the propagandistic labeling of non-state violence as “evil” or “terroristic,” where such terms beg the question of its relative merits, in context, vis-à-vis state violence. Coral bleaching has impacted reefs worldwide and the predictions of near‐annual bleaching from over two decades ago have now been realized. While technology currently provides the means to predict large‐scale bleaching, predicting reef‐scale and within‐reef patterns in real‐time for all reef users is limited. In 2020, heat stress across the Great Barrier Reef underpinned the region's third bleaching event in 5 years. Here we review the heterogeneous emergence of bleaching across Heron Island reef habitats and discuss the oceanographic drivers that (...) underpinned variable bleaching emergence. We do so as a case study to highlight how reef end‐user groups who engage with coral reefs in different ways require targeted guidance for how, and when, to alter their use of coral reefs in response to bleaching events. Our case study of coral bleaching emergence demonstrates how within‐reef scale nowcasting of coral bleaching could aid the development of accessible and equitable bleaching response strategies on coral reefs.
