Spain is one of the most advanced European countries in terms of the legislative and administrative development of ADs. Article 11 of Law 41/2002, concerning Patient Autonomy, regulates ‘advance directives’ and has prompted various Autonomous Regions to develop legislation in this area. Nevertheless, whilst the variety of legislations in different territories presents advantages, the disparity of criteria also presents problems.Despite significant legislative development, only 23,000 Spanish citizens have filled in an AD. Clearly, AD use is confined to a minority. Several (...) surveys, however, show that the Spanish population views these documents in a positive light. Thus, we must analyse this discrepancy between attitude and practice. A similar situation exists amongst health professionals. Whilst they generally feel that the use of ADs is positive and necessary, they are frequently unwilling to employ them.Bioethical literature and research on ADs has significantly increased in Spain over the last six years. It is likely that this trend will continue in the foreseeable future; but more resources and effort are required if ADs are to become consolidated. (shrink)

This paper evaluates the content of the syllabi of postgraduate courses on public health ethics within accredited schools and programs of public health in the United States in order to gain an awareness of the topics addressed within these courses. Methods: Data was gathered via the analysis of syllabi of courses on PHE. In 2012, information was requested by e-mail from the 48 schools and 86 PH programs accredited by the U.S. Council on Education for Public Health for 2012. The (...) “Epidemiology and PHE Syllabi” project of the University of Miami also was consulted. A table of topics was drawn up in order to carry out content analysis of the documents. Results: Data was obtained from 25 schools and 36 accredited programs ; 36 syllabi were gathered and 75 different topics were found. Of these, 38 topics were addressed in six or more syllabi and can be grouped as follows: foundations of PHE; autonomy and its limits; infectious disease control; justice; research ethics; health education and promotion; environmental and occupational health; screening; genetics; privacy and confidentiality; and community-based practice and vulnerable populations. Conclusions: The analyzed syllabi show high variability in curricular content. The debate with regard to whether a core curriculum on PHE should be established is ongoing. The results of this work might be of interest for schools and programs of PH in other countries or regions of the world in order to develop or ameliorate their own PHE syllabi. (shrink)

Objective: To measure the stability of life-sustaining treatment preferences amongst older people and analyse the factors that influence stability. Design: Longitudinal cohort study. Setting: Primary care centres, Granada (Spain). Eighty-five persons age 65 years or older. Participants filled out a questionnaire with six contexts of illness (LSPQ-e). They had to decide whether or not to receive treatment. Participants completed the questionnaire at baseline and 18 months later. Results: 86 percent of the patients did not change preferences. Sex, age, marital status, (...) hospitalisation, and self-perception of health and pain did not affect preferences. Morbidity and the death of a relative did. Conclusion: Stability of preferences of older persons in relation to end-of-life decisions seems to be more probable than instability. Some factors, such as the death of a relative or the increase in morbidity, can change preferences. These findings have implications for advance directives (ADs) and advance care planning. (shrink)

The accuracy of proxies when they interpret advance directives or apply substituted decision-making criteria has been called into question. It therefore became important to know if the Andalusian Advance Directive Form (AADF) can help to increase the accuracy of proxies' predictions. The aim of this research was to compare the effect of the AADF on the accuracy of proxies' predictions about patients' preferences with that gained from informative and deliberative sessions about end-of-life decision making. A total of 171 pairs of (...) patients and their proxies were randomized to three groups. The control group's answers to the Life Sustaining Preferences Questionnaire (LSPQ) were compared with their proxies' answers to the same questionnaire. In one intervention group, the patients had already completed the AADF and given it to their proxies, who used it to guide their own answers to the LSPQ. In the second intervention (discussion) group, both patients and proxies attended two educative sessions guided by trained nurses and later filled in the LSPQ. Comparisons of accuracy and other variables showed a strong association with the discussion group. The findings show that promoting communication between patients and their proxies improves the accuracy of proxies' predictions much more than isolated use of the AADF form. (shrink)

The aim of this study is to assess the knowledge, attitudes and experiences of Spanish nurses in relation to euthanasia and physician-assisted suicide. In an online questionnaire completed by 390 nurses from Andalusia, 59.1% adequately identified a euthanasia situation and 64.1% a situation involving physician-assisted suicide. Around 69% were aware that both practices were illegal in Spain, while 21.4% had received requests for euthanasia and a further 7.8% for assisted suicide. A total of 22.6% believed that cases of euthanasia had (...) occurred in Spain and 11.4% believed the same for assisted suicide. There was greater support (70%) for legalisation of euthanasia than for assisted suicide (65%), combined with a greater predisposition towards carrying out euthanasia (54%), if it were to be legalised, than participating in assisted suicide (47.3%). Nurses in Andalusia should be offered more education about issues pertaining to the end of life, and extensive research into this area should be undertaken. (shrink)

This study compares the balance of newspaper and television news coverage about migration in two countries that were differently affected by the so-called “refugee crisis” in 2015 in terms of the geopolitical involvement and numbers of migrants being admitted. Based on a broad consensus among political elites, Germany left its borders open and received about one million migrants mainly from Syria during 2015. In contrast, the conservative British government was heavily attacked by oppositional parties for closing Britain’s borders and, thus, (...) restricting immigration. These different initial situations led to remarkable differences between the news coverage in both countries. In line with news value theory, German media outlets reported much more on migration than did their British counterparts. In line with indexing theory, German news coverage consonantly reflected the consensual view of German political elites, while British news media reported along their general editorial lines. Cancer is a singular cellular state, the emergence of which destabilises the homeostasis reached through the evolution to multicellularity. We present the idea that the onset of the cellular disobedience to the metazoan functional and structural architecture, known as the cancer phenotype, is triggered by changes in the cell's external environment that occur with ageing: what ensues is a breach of the social contract of multicellular life characteristic of metazoans. By integrating old ideas with new evidence, we propose that with (...) ageing the environmental information that maintains a multicellular organisation is eroded, rewiring internal processes of the cell, and resulting in an internal shift towards an ancestral condition resulting in the pseudo‐multicellular cancer phenotype. Once that phenotype emerges, a new local social contract is built, different from the homeostatic one, leading to tumour formation and the foundation of a novel local ecosystem. (shrink)

Principles of procreative beneficence (PPBs) hold that parents have good reasons to select the child with the best life prospects. Sparrow (2010) claims that PPBs imply that we should select only female children, unlesswe attach normative significance to “normal” human capacities. We argue that this claim fails on both empirical and logical grounds. Empirically, Sparrow’s argument for greater female wellbeing rests on a selective reading of the evidence and the incorrect assumption that an advantage for females would persist even when (...) a serious gender imbalance is obtained. Logically, PPBs cite only pro tanto reasons and allow that the good of an individual child could be outweighed by other morally relevant considerations, such as those which take collectively suboptimal outcomes into account. There is thus no need to attach value to the “normal.”. (shrink)

Human decisions are increasingly supported by decision support systems (DSS). Humans are required to remain “on the loop,” by monitoring and approving/rejecting machine recommendations. However, use of DSS can lead to overreliance on machines, reducing human oversight. This paper proposes “reflection machines” (RM) to increase meaningful human control. An RM provides a medical expert not with suggestions for a decision, but with questions that stimulate reflection about decisions. It can refer to data points or suggest counterarguments that are less compatible (...) with the planned decision. RMs think against the proposed decision in order to increase human resistance against automation complacency. Building on preliminary research, this paper will (1) make a case for deriving a set of design requirements for RMs from EU regulations, (2) suggest a way how RMs could support decision-making, (3) describe the possibility of how a prototype of an RM could apply to the medical domain of chronic low back pain, and (4) highlight the importance of exploring an RM’s functionality and the experiences of users working with it. This paper focuses on the connotations and grounds of the paraphrase cum canere vellem in Serv. Ecl. 6. 3. The analysis of the sense of verb volo within this context, as well as the confrontation between that passage and Serv. Ecl. 6. 5, show that Servius interprets the clause cum canerem reges et proelia as a reference to Virgil's early endeavor to compose an epic poem, from which he shortly desisted. This interpretation is conditioned by the idea that the chronological sequence Eclogues - Georgics - Aeneid has a hierarchical correlate, an idea which is founded on biographical information and the theory of tripertita varietas. De esta manera funciona el relato de Fineo como guía de navegación para los Argonautas. Con el ineludible modelo de los relatos de viajes de Odisea, esta narración interna guarda una relación especular con la obra que la contiene y conlleva una cuasi-identificación entre narrador interno y narrador principal. Este artículo tiene como objetivo el análisis de los niveles narrativos en (...) este relato, para mostrar el modo en que esa técnica anticipatoria funciona en el poema en un nivel metaliterario. One type of prolepsis, frequently used in the Argonautica, is the programmatic speech in which a character anticipates the subsequent story. In this manner works the story of Phineus as navigation guidance for the Argonauts. With the inevitable model of travel stories of Odyssey, this internal narrative keeps a mirror-relationship with the work that contains it and carries a quasi-identification between internal narrator and main narrator. This article aims to analyze the narrative levels in this story, to show how this anticipatory technique works in the poem on a metaliterary level. (shrink)

A continuación, señala qué aspectos de esa lectura habrían influido de manera más marcada en las obras de Maistre y Saint-Simon, con las que abarca las dos tendencias post-revolucionarias de entender la historia, catecóntica y quiliástica. We propose developing AIs whose only final goal is being shut down. We argue that this approach to AI safety has three benefits: (i) it could potentially be implemented in reinforcement learning, (ii) it avoids some dangerous instrumental convergence dynamics, and (iii) it creates trip wires for monitoring dangerous capabilities. We also argue that the proposal can overcome a key challenge raised by Soares et al. (2015), that shutdown-seeking AIs will manipulate humans into shutting them down. We conclude by comparing (...) our approach with Soares et al.'s corrigibility framework. (shrink)

This paper argues that research on normative issues in the life sciences will benefit from a tighter integration of philosophy of science. We examine research on ethical, legal and social issues in the life sciences (“ELSI”) and discuss three illustrative examples of normative issues that arise in different areas of the life sciences. These examples show that important normative questions are highly dependent on epistemic issues which so far have not been addressed sufficiently in ELSI, RRI and related areas of (...) research. Accordingly, we argue for the integration of research on the epistemic aspects of the relevant areas of science into ELSI research to provide a better basis for addressing normative questions. Within collective epistemology, there is a class of theories that understand the epistemic status of collective attitude ascriptions, such as ‘the college union knows that the industrial action is going to plan’, or ‘the jury justifiedly believes that the suspect is guilty’, as saying that a sufficient subset of group member attitudes have the relevant epistemic status. In this paper, I will demonstrate that these summativist approaches to collective epistemology are incompatible with epistemic permissivism, the doctrine that a single body (...) of evidence may rationalize multiple doxastic attitudes. In particular, I will make use of epistemic permissivism to provide a general recipe for generating so-called divergence cases, which demonstrate situations in which rationality requires group-level and member-level attitudes to diverge. I will call this class of cases permissive divergence cases. While other divergence cases have been discussed in the literature, permissive divergence cases prove themselves to be less susceptible to many of the worries raised against their competitors, while being directly built on an often-defended epistemological thesis. Substructural approaches to paradoxes have attracted much attention from the philosophical community in the last decade. In this paper we focus on two substructural logics, named ST and TS, along with two structural cousins, LP and K3. It is well known that LP and K3 are duals in the sense that an inference is valid in one logic just in case the contrapositive is valid in the other logic. As a consequence of this duality, theories based on either logic are (...) tightly connected since many of the arguments for and objections against one theory reappear in the other theory in dual form. The target of the paper is making explicit in exactly what way, if any, ST and TS are dual to one another. The connection will allow us to gain a more fine-grained understanding of these logics and of the theories based on them. In particular, we will obtain new insights on two questions concerning ST which are being intensively discussed in the current literature: whether ST preserves classical logic and whether it is LP in sheep’s clothing. Explaining in what way ST and TS are duals requires comparing these logics at a metainferential level. We provide to this end a uniform proof theory to decide on valid metainferences for each of the four logics. This proof procedure allows us to show in a very simple way how different properties of inferences (unsatisfiability, supersatisfiability and antivalidity) that behave in very different ways for each logic can be captured in terms of the validity of a metainference. What makes a friendship a good friendship? One way of answering that question, taken by Aristotle and many philosophers since, is to describe an ideal friendship, and then say that a friendship is a good friendship insofar as it resembles the ideal. An ideal of friendship, so presented, is intended to capture the qualities that all good friendships share, regardless of who the friends are and regardless of their circumstances. This approach to good friendship, I argue, fails to capture the (...) variety of good kinds of friendship and the role of friendship in real human lives. I propose an alternative approach, on which a good friendship is one that improves the lives of the friends by bringing to those lives some of the many disparate values especially associated with friendship. On this view, there are many forms of good friendship, often mutually incompatible; no single kind of friendship is a model for all others; and the point of friendship is to improve the lives of humans as they are, with all their distinguishing weaknesses, limitations, and needs. This book traces allusions to smell in philosophy, psychoanalysis, and political economy by probing the key question: is smell the anti-philosophical?

This article argues that in the ordinary course of events, most parents routinely practice “reproductive teleology” in that they attempt to manipulate the physical and psychological characteristics of children, and they do so as part of the process of good parenting. Furthermore, such attempts are socially approved of and encouraged. With these two considerations in mind, it is argued that common objections to technological interventions, especially with respect to designer babies— based on the grounds that such processes would promote despotic (...) parenting, deny children an open future, and interfere with the designed child's sense of self—should be seen in the context of reproductive teleology. The implications of this argument encourage an orientation toward the salience of social pressures that promote reproductive teleology. (shrink)

Leif Wenar’s kind-desire theory states that an individual holds a claim-right against an agent only because she has reason to desire, as a member of a particular social or natural kind, that the agent fulfil his duty. He argues that the kind-desire theory is superior to the interest theory of claim-rights, which states that an individual holds a claim-right against an agent only because his duty is in some manner beneficial to her. I compare the merits of the kind-desire theory (...) and a justificatory interest theory, and argue that the kind-desire theory does not satisfy two conditions for a satisfactory analysis of claim-rights as well as this justificatory interest theory. Michel Janssen and Harvey Brown have driven a prominent recent debate concerning the direction of an alleged arrow of explanation between Minkowski spacetime and Lorentz invariance of dynamical laws in special relativity. In this article, I critically assess this controversy with the aim of clarifying the explanatory foundations of the theory. First, I show that two assumptions shared by the parties—that the dispute is independent of issues concerning spacetime ontology, and that there is an urgent need for a constructive interpretation (...) of special relativity—are problematic and negatively affect the debate. Second, I argue that the whole discussion relies on a misleading conception of the link between Minkowski spacetime structure and Lorentz invari-ance, a misconception that in turn sheds more shadows than light on our understand-ing of the explanatory nature and power of Einstein’s theory. I state that the arrow connecting Lorentz invariance and Minkowski spacetime is not explanatory and uni-directional, but analytic and bidirectional, and that this analytic arrow grounds the chronogeometric explanations of physical phenomena that special relativity offers. The article provides a moral analysis of the commercial trade of financial claims against private debtors. Secondary debt markets process a type of object that differs from regular commodities. The specificity of debt lies in its peculiar relationality that is in tension with its legal constitution as a commercial object, or with its treatment as a mere thing. The constitution of a credit claim presupposes a corresponding financial liability. Thus, debt relations are constituted by polar correlates of deontic modalities. Debt (...) buyers do not obtain mere monadic objects, but intersubjective rights of action against debtors. In turn, they arguably do not become mere owners of abstract claims, but successors to a position in a preceding social relation that is imbued with moral limitations and responsibilities. Markets for debt should thus be subjected to the deontic logic of credit relations, not to the norms of ownership in things. (shrink)

John Cook Wilson is increasingly recognised as an important predecessor of ordinary language philosophy. He emphasizes the authority of ordinary language in philosophical theorizing. At the same time, however, he circumscribes the limits of that authority and identifies cases in which it threatens to mislead us. My aim is to consider in detail one case where, according to Cook Wilson, ordinary language has misled philosophical theorizing. Judgement was one of the core notions of the logic, epistemology, and philosophy of mind (...) of Cook Wilson’s time. Cook Wilson rejects this notion, in the form developed by his contemporaries, in part because it is based on a problematic analogy between ordinary language and the thoughts expressed in that language. Cook Wilson’s discussion of judgement also highlights the extent to which Cook Wilson was critical of, but also responsive to, his contemporaries. In addition, variants of the language-thought analogy Cook Wilson opposes continue to feature in 21st century epistemology and philosophy of mind. Cook Wilson’s criticism of the analogy thus raises questions about recent work as well as the theories of his contemporaries. (shrink)

The reanalysis of genomic sequencing results has the potential to provide results that are of considerable medical and personal importance to recipients. Employing interviews with forty-seven predominantly medically underserved families and ethnographic observations we argue that there is pressing need to standardize the approach taken to reanalysis. Our findings highlight that study participants were unclear as to the likelihood of reanalysis happening, the process of initiating reanalysis, and whether they would receive revised results. Their reflections mirror the lack a specific (...) focus upon reanalysis within consent and results sessions as observed in clinical settings. Mechanisms need to be put into place that standardize the approach to reanalysis in research and in clinical contexts. This would enable clinicians and genetic counsellors to communicate clearly with research participants with respect to potential for reanalysis of results and the process of reanalysis. We argue that that the role of reanalysis is too important to be referred to in an ad-hoc manner. Furthermore, the ad-hoc nature of the current process may increase health inequities given the likelihood that only those families who have the means to press for reanalysis are likely to receive it. Recent political theory has seen a revived interest in theorizing the political party, and, in particular, exploring what the political party can do to address its decline and revitalize itself. This renewed interest, however, draws largely on the political praxis of party politics of established liberal democracies in the United States and Europe. In this article, I bring Chinese thinker Wang Hui’s (Maoist) party theory into the conversation. By engaging Wang’s party theory, I demonstrate how we can understand party decline (...) in nonliberal democratic countries with revolutionary legacies. I then analyze Wang’s solution to the decline of the revolutionary party, which focuses on the intricate relationship between individualistic charismatic politics and party politics. Finally, through reading Wang in and beyond the Chinese context, I show the problems with Wang’s theory and discuss how it can learn from the party-movement relationship in other contexts. (shrink)

Do we have positive duties to help others in need or are our moral duties only negative, focused on not harming them? Are any of the former positive duties, duties of justice that respond to enforceable rights? Is their scope global? Should we aim for global equality besides the eradication of severe global poverty? Is a humanist approach to egalitarian distribution based on rights that all human beings as such have defensible, or must egalitarian distribution be seen in an associativist (...) way, as tracking existing frameworks such as statehood and economic interdependence? Are the eradication of global poverty and the achievement of global equality practically feasible or are they hopelessly utopian wishes? -/- This book argues that there are basic positive duties of justice to help eradicate severe global poverty; that global egalitarian principles are also reasonable even if they cannot be fully realized in the short term; and that there are dynamic duties to enhance the feasibility of the transition from global poverty to global equality in the face of nonideal circumstances such as the absence of robust international institutions and the lack of a strong ethos of cosmopolitan solidarity. The very notion of feasibility is crucial for normative reasoning, but has received little explicit philosophical discussion. This book offers a systematic exploration of that concept as well as of its application to global justice. It also arbitrates the current debate between humanist and associativist accounts of the scope of distributive justice. Drawing on moral contractualism (the view that we ought to follow the principles that no one could reasonably reject), this book provides a novel defense of humanism, challenges several versions of associativism (which remains the most popular view among political philosophers), and seeks to integrate the insights underlying both views. I here defend microphysical manyism. According to microphysical manyism, each composite or higher-level object is a mere plurality of microphysical particles. After clarifying the commitments of the view, I offer two physicalist-friendly arguments in its favour. The first argument appeals to the Canberra Plan. Here I argue that microphysical particles acting in unison play the theoretical roles associated with composite objects - that they do everything that we think of composite objects as doing - and thus that composite objects are (...) to be identified with pluralities of microphysical particles. Along the way I rebut the objections that pluralities of particles don’t display the right emergent, ‘lingering’, or modal properties to be good candidates for identification with higher-level objects. In the second argument I claim that microphysical manyism is uniquely able to capture a compelling and widespread physicalist intuition concerning the intimate nature of the relationship between higher-level, composite objects and the microphysical world. Although the therapeutic misconception (TM) has been well described over a period of approximately 20 years, there has been disagreement about its implications for informed consent to research. In this paper we review some of the history and debate over the ethical implications of TM but also bring a new perspective to those debates. Drawing upon our experience of working in the context of translational research for rare childhood diseases such as Duchenne muscular dystrophy, we consider the ethical and legal (...) implications of the TM for parental consent to research. In this situation, it is potentially the parent who is vulnerable to TM. In our analysis we not only consider the context of informed consent for research but also the wider environment in which the value of research is promoted, more broadly through the media but also more specifically through the communication strategies of patient organizations. All dissemination about developments in research for health runs the risk of portraying an overly optimistic view of the promise of biotechnological solutions and has the potential to encourage a ‘collective’ TM. In this paper we consider the challenge that TM presents to parents as well as explore the ethical and legal responsibilities of researchers to ensure an appropriately informed consent: compatible with a hopeful disposition of parents who consent for the their children whilst avoiding a blind and misleading optimism. Human communities teem with a variety of social norms. In order to change unjust and harmful social norms, it is crucial to identify the psychological processes that give rise to them. Most researchers take it for granted that social norms are uniquely human. By contrast, we approach this matter from a comparative perspective, leveraging recent research on animal social behaviour. While there is currently only suggestive evidence for norms in nonhuman communities, we argue that human social norms are likely produced (...) by a wide range of mechanisms, many of which we share with nonhuman animals. Approaching this variability from a comparative perspective can help norm researchers expand and reframe the range of hypotheses they test when attempting to understand the causes of socially normative behaviours in humans. First, we diagnose some of the theoretical obstacles to developing a comparative science of social norms, and offer a few basic constructs and distinctions to help norm researchers overcome these obstacles. Then we develop a six-dimensional model of the psychological and social factors that contribute to variability in both human and potential nonhuman norms. -/- This article is part of the theme issue ‘Social norm change: drivers and consequences’.
