Questions regarding the moral responsibility of Internet accessand service providers relating to information on the Internetcall for a reassessment of the ways in which we think aboutattributing blame, guilt, and duties of reparation andcompensation. They invite us to borrow something similar to theidea of strict liability from the legal sphere and to introduceit in morality and ethical theory. Taking such a category in thedistribution of responsibilities outside the domain of law andintroducing it into ethics, however, is a difficult thing. Doingso (...) seems to conflict with some broadly shared and deeply feltintuitions regarding the individuality of responsibility and therelationship between responsibility and guilt. These convictionscoincide with some basic ideas in Kantian moral theory and theascriptive theory based on these ideas. Nevertheless, theproblems to which the proposed liabilities / responsibilitiesrelate are so serious that they do not seem to leave room foraloofness. At least, they encourage us to reconsider the idea ofstrict liability carefully and to assess its merits. (shrink)

In this contribution, we identify and clarifysome distinctions we believe are useful inestablishing the reliability of information onthe Internet. We begin by examining some of thesalient features of information that go intothe determination of reliability. In so doing,we argue that we need to distinguish contentand pedigree criteria of reliability and thatwe need to separate issues of reliability ofinformation from the issues of theaccessibility and the usability of information.We then turn to an analysis of some commonfailures to recognize reliability orunreliability.

We present a developmental perspective regarding the difference in perceptions toward privacy between young and old. Here, we introduce the notion of privacy conceptions, that is, the specific ideas that individuals have regarding what privacy actually is. The differences in privacy concerns often found between young and old are postulated as the result of the differences found in their privacy conceptions, which are subsequently linked to their developmental life stages. The data presented have been obtained through a questionnaire distributed among (...) adolescents, young adults, and adults and provide support for this developmental perspective. This study is one of the first to include adolescents when investigating the privacy concerns among young and old. The results show that the privacy conceptions held by adolescents indeed differ from those held by young adults and adults in keeping with the expectations as seen from a developmental perspective. In addition, the areas in which the differences in privacy conceptions are found also reflect the strongest relationship with concerns. As such, these findings present an alternative perspective to the commonly held notion that young people are less concerned about privacy. (shrink)

One of the most significant aspects of Internet, in comparison with other sources of information, such as libraries, books, journals, television, radio etcetera, is that it makes expert knowledge much more accessible to non‐experts than the other traditional sources. This phenomenon has often been applauded for its democratizing effects. Unfortunately, there is also a disadvantage. Expert information that was originally intended for a specific group of people ‐ and not in any way processed or adapted to make it fit for (...) a broader audience ‐ can easily be misunderstood and misinterpreted by non‐experts and, when used as a basis for decisions, lead to unhappy consequences. Can these risks be diminished without limiting the informational freedoms of the information providers and without imposing paternalistic measures regarding the receivers of the information? This article discusses some rather formal characteristics of possible obligations to enhance. Obligations to enhance can exist in the absence of good moral reasons. If obligation and duty however are considered as synonyms, the enhancement involved must be morally desirable in some respect. Since enhancers and enhanced can, but need not coincide, advertency is appropriate regarding the question who exactly is addressed by an obligation or a duty to enhance: the person on whom the enhancing treatment is performed, or the (...) controller or the operator of the enhancement. Especially, the position of the operator is easily overlooked. The exact functionality of the specific enhancement, is all-important, not only for the acceptability of a specific form of enhancement, but also for its chances of success for becoming a duty or morally obligatory. Finally and most importantly, however, since obligations can exist without good moral reasons, there can be obligations to enhance that are not morally right, let alone desirable. (shrink)

Informed consent bears significant relevance as a legal basis for the processing of personal data and health data in the current privacy, data protection and confidentiality legislations. The consent requirements find their basis in an ideal of personal autonomy. Yet, with the recent advent of the global pandemic and the increased use of eHealth applications in its wake, a more differentiated perspective with regards to this normative approach might soon gain momentum. This paper discusses the compatibility of a moral duty (...) to share data for the sake of the improvement of healthcare, research, and public health with autonomy in the field of data protection, privacy and medical confidentiality. It explores several ethical-theoretical justifications for a duty of data sharing, and then reflects on how existing privacy, data protection, and confidentiality legislations could obstruct such a duty. Consent, as currently defined in the General Data Protection Regulation – a key legislative framework providing rules on the processing of personal data and data concerning health – and in the recommendation of the Council of Europe on the protection of health-related data – explored here as soft-law – turns out not to be indispensable from various ethical perspectives, while the requirement of consent in the General Data Protection Regulation and the recommendation nonetheless curtails the full potential of a duty to share medical data. Also other legal grounds as possible alternatives for consent seem to constitute an impediment. (shrink)

Big data and Machine learning Techniques are reshaping the way in which food safety risk assessment is conducted. The ongoing ‘datafication’ of food safety risk assessment activities and the progressive deployment of probabilistic models in their practices requires a discussion on the advantages and disadvantages of these advances. In particular, the low level of trust in EU food safety risk assessment framework highlighted in 2019 by an EU-funded survey could be exacerbated by novel methods of analysis. The variety of processed (...) data raises unique questions regarding the interplay of multiple regulatory systems alongside food safety legislation. Provisions aiming to preserve the confidentiality of data and protect personal information are juxtaposed to norms prescribing the public disclosure of scientific information. This research is intended to provide guidance for data governance and data ownership issues that unfold from the ongoing transformation of the technical and legal domains of food safety risk assessment. Following the reconstruction of technological advances in data collection and analysis and the description of recent amendments to food safety legislation, emerging concerns are discussed in light of the individual, collective and social implications of the deployment of cutting-edge Big Data collection and analysis techniques. Then, a set of principle-based recommendations is proposed by adapting high-level principles enshrined in institutional documents about Artificial Intelligence to the realm of food safety risk assessment. The proposed set of recommendations adopts Safety, Accountability, Fairness, Explainability, Transparency as core principles (SAFETY), whereas Privacy and data protection are used as a meta-principle. KDD (Knowledge Discovery in Databases) confronts us withphenomena that can intuitively be grasped as highly problematic, but arenevertheless difficult to understand and articulate. Many of theseproblems have to do with what I call the ``deindividualization of theperson'': a tendency of judging and treating persons on the basis ofgroup characteristics instead of on their own individual characteristicsand merits. This tendency will be one of the consequences of theproduction and use of group profiles with the help of KDD. Currentprivacy law and regulations, (...) as well as current ethical theoryconcerning privacy, start from too narrow a definition of ``personaldata'' to capture these problems. In this paper, I introduce the notionof ``categorical privacy'' as a starting point for a possible remedy forthe failures of the current conceptions of privacy. I discuss some waysin which the problems relating to group profiles definitely cannot besolved and I suggest a possible way out of these problems. Finally, Isuggest that it may take us a step forward if we would begin to questionthe predominance of privacy norms in the social debate on informationtechnologies and if we would be prepared to introduce normativeprinciples other than privacy rules for the assessment of newinformation technologies. If we do not succeed in articulating theproblems relating to KDD clearly, one day we may find ourselves in asituation where KDD appears to have undermined the methodic andnormative individualism which pervades the mainstream of morality andmoral theory. ABSTRACT In recent debates about conceptual engineering, it appears that the internalist has an explanatory advantage when it comes to accounting for meaning change and conceptual change. In this paper, I argue against this impression. I show how two different varieties of externalism, originalism and anti-individualism, can coherently explain various cases of meaning change, irrespective of whether they involve proper names or kind terms; and also irrespective of whether they occur in everyday, legal, or scientific contexts. I point out which (...) mechanisms and interpretational strategies the originalist and anti-individualist can invoke, relative to their respective background assumptions about the nature of concepts. Furthermore, I offer an argument in favour of the claim that externalism as such has no implications concerning whether concepts can undergo change. I establish this by showing that originalism allows for conceptual change while anti-individualism insists on conceptual stability. (shrink)

Peter Singer’s defense of the duty to aid the world’s poor by the pond analogy is self-defeating. It cannot be both true that you ought to save the drowning child from a pond at the expense of ruining your shoes and that you ought to aid the world’s poor if you thereby do not sacrifice anything of comparable moral importance. Taking the latter principle seriously would lead you to let the child in front of you drown whenever you could thereby (...) save more children in the developing world. Though Singer can defend the duty to aid the world’s poor starting from consequentialist principles requiring you to make things go best in the impartial sense, he cannot have it invoking the commonsense judgment about what you ought to do in the pond case. There is no sound path from commonsense morality to Singer’s principles of beneficence. (shrink)

The aim of our study is to single out a possible path towards the recognition culture in a world strained by deep social cleavages and by a strong conflict among values. In this context, we consider that a recognition culture is possible only by activating the comprehensive being that each of us, humans, is. The study attempts to answer the desideratum of the recognition culture by developing a model of the political founded on the correlation of certain aspects of the (...) human and of the political. The identification of the hypostases of the political and the human and the correlations between them help us understand one of the specific anthropo-political mechanisms that may allow us to reach the recognition culture that is based on accepting the other and assuming one’s own fallibility. An influential objection to the view that intentions are non-derivatively relevant to the moral permissibility of actions states that if intentions were relevant to permissibility in such a way, one would have to take them into account in decision making, which would be odd (in some morally relevant sense of ‘oddness’). The paper outlines and assesses three candidates for the oddness: that considering intentions in decision making is an unordinary practice, that it is impossible or conceptually confused, and that it (...) assigns intentions the weight as moral considerations that they intuitively do not have. The paper rejects the first two and shows that the third is probably what motivates most critics of the relevance of intentions who raise this objection. If this is correct, the objection is a non-starter as it assumes what it has to prove. Towards the end, it is argued that the objection does not serve as a plausible error theory either. (shrink)

The aim of this paper is to single out the path towards a model of fallibility assumed by the establishment and implementation of the culture of recognition and comprehensive truth. Starting from the hypostases of the human, this anthropological model defines the fallible human being, the author of the comprehensive truth oriented towards the culture of recognition. The main idea of this demarche is, in fact, that between recognition and comprehension there is a deep, organic connection and the comprehensive truth (...) lies at the basis of the culture of recognition. This study endeavours to demonstrate the dynamic “tolerance-recognition” in view of a comprehensive paradigm. Tolerance is presumed to be a „modus vivendi” – that is, the recognition of multiple ways of finding the good and happiness by human communities. In this context, the author proposes, as a heuristic device, a model of humanity based upon correlations between nature, condition, and essence as hypostases of humanity. In lieu of an abstract, here is a brief excerpt of the content:Notes and Discussions ARISTOTLE'S ALLEGED "REVOLT" AGAINST PLATO Hermippus' most conspicuous contribution to Aristotle's biography probably was his determined effort to depict Aristotle as the founder of an original school of philosophy which was wholly independent of Plato and Platonic teachings. Among the several and, in all likelihood, fanciful stories about Aristotle he invented or propagated, the most startling was the account, subsequently widely accepted (and widely exploited by (...) the detractors of Aristotle), that after having been a disciple of Plato for a while, he seceded from the Academy and from Plato's philosophic teachings while Plato was still alive. 1 Accordingly, he owed little to Plato and to the Academy. This story, invented and propagated by an inveterate Peripatetic (Hermippus), was intended to demonstrate the original philosophic genius of Aristotle which developed in complete independence of Plato and necessitated a break with the master's teachings. In devising his argument, Hermippus might have made use of a report, found in some of Aristotle's ancient biographers, that a few brash young men (members of the Academy?) revolted against Plato and, in a spirit of independence, defiance and antagonism, attempted to start a school of their own which would rival the intellectual standing of the Academy. 2 Hermippus, it appears, subsequently identified these young "rebels" with Aristotle, a substitution convenient to Hermippus" aim to depict Aristotle as a wholly independent and totally original philosopher who owed nothing whatever to Plato and his teachings. In all likelihood, Diogenes Laertius' statement that Aristotle "seceded from the Academy while Plato was still alive," a is just an echo either of a statement made by Hermippus himself or is a conclusion drawn from the several unpleasant stories about Aristotle invented and reported by some of Aristotle's detractors. This article examines Gadamer's claim that language is fundamentally metaphorical from the perspective of Ricoeur's complementary analysis of metaphor. I argue that Gadamer's claim can only be understood in relation to a broader understanding of metaphor in which metaphor is not regarded as secondary to literal meaning. From this context one is better able to understand the connection Gadamer makes between language and ontology, which is found in his statement "Being that can be understood is language.".

In this article is presented a reading of Heidegger in relation to the conception of desire, and its relation to various terms he uses frequently. I argue that the genesis of desire lies in the gap between the fullness of possibility and the poverty of actualization; that inauthentic desire aims at presence, possession, actualization (always insufficient); and that authentic desire aims at the conservation of the possibility-character of being. I also pay attention to the temporality of desire; to the analogy (...) between Kant's emphasis on respect for the law one has freely postulated and Heidegger's emphasis on Dasein's subjection to the possibilities it projects; to possibility as original abundance; and, in principle, to the turning in which desire is evoked in the event of granting, rather than simply produced in the act of projection. Special attention is paid on the German word 'Verlangen', which is related etymologically to the English 'long for', which stands for wanting something very much. But the word is also connected to the word 'long' which is important to get a grip on the notion of desire in Heidegger. (shrink)

The scholarly literature suggests high or increased tax burdens tend to reduce economic growth, lowering incomes. Some argue, however, that low taxes and high economic growth can have adverse income distribution consequences or can lead to utility-reducing under-consumption of needed public goods. Evidence is presented questioning those assertions. People seek happiness by moving, and tend to migrate to low tax areas. Moreover, there is little evidence that governmental expansion leads to truly greater equality. Appropriately measured, income equality is actually far (...) greater than typically claimed. Moreover, income data suggest that the international equalization of incomes and global reduction of poverty largely reflect private sector activity, namely market forces working where the rule of law and strong protection of property rights prevails. Agency is a power, but what is it a power to do? The tradition presents us with three main answers: (1) that agency is a power to affect one’s own will, consequent upon which act further events ensue, beginning with the movement of a part of one's body; (2) that agency is a power to affect one’s own body, consequent upon which act further events ensue, beginning with the movement of an object that one touches; and (3) that agency is (...) a power to affect that material upon which one brings one's action to bear---e.g. the apple one is peeling (with a knife in one's hand). These three answers correspond to three increasingly expansive conceptions of the province of human agency. I refer to them, respectively, as volitionalism, corporealism and materialism. Only the first two are seriously considered in contemporary action theory. Favoring the third, and hoping to sharpen the conflict between the third and the first, I criticize the second. Corporealism has been a popular position—arguably, the default position in the philosophy of action—since Donald Davidson’s classic paper “Agency” (1971). Although it seems to occupy a sensible middle ground between volitionalism and materialism, corporealism is, I argue, indefensible: it shares the vulnerabilities of both its two rivals, without possessing the strengths of either. Nevertheless, reflection on corporealism lights the road to materialism, which, in the end, is the only possible alternative to volitionalism. (shrink)

The article proposes to further develop the ideas of the Extended Evolutionary Synthesis by including into evolutionary research an analysis of phenomena that occur above the organismal level. We demonstrate that the current Extended Synthesis is focused more on individual traits (genetically or non-genetically inherited) and less on community system traits (synergetic/organizational traits) that characterize transgenerational biological, ecological, social, and cultural systems. In this regard, we will consider various communities that are made up of interacting populations, and for which the (...) individual members can belong to the same or to different species. Examples of communities include biofilms, ant colonies, symbiotic associations resulting in holobiont formation, and human societies. The proposed model of evolution at the level of communities revises classic theorizing on the major transitions in evolution by analyzing the interplay between community/social traits and individual traits, and how this brings forth ideas of top-down regulations of bottom-up evolutionary processes (collaboration of downward and upward causation). The work demonstrates that such interplay also includes reticulate interactions and reticulate causation. In this regard, we exemplify how community systems provide various non-genetic ‘scaffoldings’, ‘constraints’, and ‘affordances’ for individual and sociocultural evolutionary development. Such research complements prevailing models that focus on the vertical transmission of heritable information, from parent to offspring, with research that instead focusses on horizontal, oblique and even reverse information transmission, going from offspring to parent. We call this reversed information transfer the ‘offspring effect’ to contrast it from the ‘parental effect’. We argue that the proposed approach to inheritance is effective for modelling cumulative and distributed developmental process and for explaining the biological origins and evolution of language.
