The third volume of The History of European Philosophy in the Fifteenth Century deals with the question of "being." In the closing paragraph, Stefan Swiezawski remarks: "Studies on the transformation and distortion of St. Thomas's doctrine on being, especially in regard to its existential element, are fundamentally important for understanding the factual historical development of Thomism as well as for understanding modern Christian thought. They are also of utmost importance for understanding the mainspring and resultant trends which have shaped the (...) direction of philosophical reflection in Europe during the last several centuries". The fourth volume of his opus magnum under review here, touches upon the problematics of God. It is this volume which serves as the best example of all those deviations and distortions which come from a mistreatment of the philosophy of being. Moreover, fifteenth century philosophy, in the disguise of metaphysics, can be seen as "a century of theology which in a more differentiated form and restless way" professed and used "pluralism of the conception of theology as a science". The article considers the nature of legalistic, or formal, conceptions of the rule of law, focusing particularly on the work of Joseph Raz and Albert Venn Dicey. It asks how such apparently narrow conceptions are generated, and how far they can resist including broader social claims. It concludes that the rationale behind legalistic conceptions compels them to address issues of poverty and the literacy of the law's subjects. However, legalistic conceptions of the rule of law can still avoid sliding into (...) the wider non‐legalistic models advanced by writers such as T. R. S. Allan. (shrink)

A good story bears retelling many times, and an appreciative audience will delight in debating its finer points; each participant is – of course – always convinced that only his memory, his understanding, of what the author said is the correct one.

Background: The importance of respecting patients and participants in clinical research is widely recognised. However, what it means to respect persons beyond recognising them as autonomous is unclear, and little is known about what patients find to be respectful. Objective: To understand patients’ conceptions of respect and what it means to be respected by medical providers. Design: Qualitative study from an academic cardiology clinic, using semistructured interviews with 18 survivors of sudden cardiac death. Results: Patients believed that respecting persons incorporates (...) the following major elements: empathy, care, autonomy, provision of information, recognition of individuality, dignity and attention to needs. Conclusions: Making patients feel respected, or valued as a person, is a multi-faceted task that involves more than recognising autonomy. While patients’ views of respect do not determine what respect means, these patients expressed important intuitions that may be of substantial conceptual relevance. (shrink)

Lewis and Charny have come under siege for suggesting remote questioning to decide appropriate medical care. While the criticisms are theoretically valid, the idea is so important practically that Lewis and Charny should be supported and their approach investigated as a way of making medical treatment at least more open and possibly more fair.

Multiculturalism is an imprecise concept with a variety of different meanings, but no matter how multiculturalism is defined, nearly all of its advocates share the common objective of reconstructing Western society in order to protect minority cultural groups from intolerance.1 The multiculturalist coalition has been highly successful in this undertaking because members of the majority culture generally accept the moral diagnosis that their traditional way of life is backward, irrational, and inherently prone to various forms of prejudice. This paper explores gender differences in “make-up” and “suspicion” in a bargaining game in which the privately informed seller of a company sends a value message to the uninformed potential buyer who then proposes a price for the company. “Make-up” is measured by how much the true value is overstated, “suspicion” by how much the price offer differs from the value message. We run different computerized treatments varying in information about the gender and in embeddedness of gender information. The asymmetry (...) of the game and of information allows for a robust assessment of gender effects. We report here the results from just one shot round decision since we expect such effects to be more pronounced for inexperienced participants. We mainly find an effect of gender constellation: when female sellers are aware to confront a female buyer, they overstate more, i.e. there is more “make-up”. However, we cannot confirm gender effects for suspicion. (shrink)

We apply an online optimization process based on machine learning to the production of Bose-Einstein condensates. BEC is typically created with an exponential evaporation ramp that is optimal for ergodic dynamics with two-body s-wave interactions and no other loss rates, but likely sub-optimal for real experiments. Through repeated machine-controlled scientific experimentation and observations our ’learner’ discovers an optimal evaporation ramp for BEC production. In contrast to previous work, our learner uses a Gaussian process to develop a statistical model of the (...) relationship between the parameters it controls and the quality of the BEC produced. We demonstrate that the Gaussian process machine learner is able to discover a ramp that produces high quality BECs in 10 times fewer iterations than a previously used online optimization technique. Furthermore, we show the internal model developed can be used to determine which parameters are essential in BEC creation and which are unimportant, providing insight into the optimization process of the system. Community-based healthcare organisations manage competing, and often conflicting, priorities. These conflicts can arise from the multiple roles these organisations take up, and from the diverse range of stakeholders to whom they must be responsive. Often such conflicts may be titled conflicts of interest; however, what precisely constitutes such conflicts and what should be done about them is not always clear. Clarity about the duties owed by organisations and the roles they assume can help identify and manage some of these conflicts. (...) Taking divisions of general practice in Australia as an example, this paper sets out to distinguish two main types of conflicts of interest, so that they may be more clearly identified and more effectively managed. The development of gene expression profiling and next-generation sequencing technologies have steered oncogenomics to the forefront of precision medicine. This created a need for harmonious cooperation between clinicians and researchers to increase access to precision oncology, despite multiple implementation challenges being encountered. The aim is to apply personalised treatment strategies early in cancer management, targeting tumour subtypes and actionable gene variants within the individual’s broader clinical risk profile and wellbeing. A knowledge-generating database linked to the South African Medical Research Council’s (...) Genomic Centre has been created for the application of personalised medicine, using an integrated service and research approach. Insights gained from patient experiences related to tumour heterogeneity, access to targeted therapies and incidental findings of pathogenic germline variants in tumour DNA, provided practice-changing evidence for the implementation of a cost-minimisation pathology-supported genetic testing strategy. Integrating clinical care with genomic research through data sharing advances personalised medicine and maximises precision oncology benefits. (shrink)

The problems of the tolal energy and quasilocalenergy density or an isolated spherically symmetric static system in general relativity (GR) are considered with examples of some exact suintions. The field formulation of GR dereloped earlier hy L. P. Grishchuk. el al. (1984). in ihe framework of which all the dynamical fields, including the gravitation field, are considered in a fixed background spacetime is used intensively. The exact Schwarzschild and Reissner Nordstrom solutions are investigated in detail, and the results are compared (...) with those in the recent work by J. D. Brown and J. W. York. Jr. (1993) as well as discussed with respect to the principle of nonlocalization of the gravitational energy in GR. Those examples are illustrative and simple because the background is selected as Minkowski spacetime and, in fact, the field configurations are studied in the framework of special relativity. It is shown that some problems of the Schwarzschild solution which are difficult to resolve in the standard geometrical framework of GR are resolved in the framework of the field formulation. The latest volume in the splendid critical edition of the Opera philosophica et theologica of William of Ockham in progress at the Franciscan Institute of St. Bonaventure University under the general editorship of Gedeon Gál, O.F.M. The project itself is something of a phenomenon in the area of critical editions of medieval Latin texts in terms of the rapidity at which quality volumes are produced at remarkably reasonable costs. Since 1967 five quarto volumes, totaling some three thousand four hundred pages, (...) have appeared. Three of these contain the first portion of Ockham’s most important theological work, the Ordinatio of his "commentary" on book 1 of the Sentences. The final portion is scheduled to appear early in 1979 as volume 4 of the Opera theologica. Volume 1 of the philosophical opera contains the monumental Summa Logicae, and volume 3 will also appear this year, thus completing with the present volume the edition of the most important of Ockham’s logical works. Editors are also assigned and are already at work on the other major non-political writings, notably the Quodlibet and commentaries on Aristotle’s Physics. Since the Opera politica Guillelmi de Ockham were published in three octavo volumes by the University of Manchester Press, we may expect to have very shortly substantially all the works of the Venerable Inceptor, thanks to the exceptional industry of a team of highly qualified researchers as well as substantial grants by the National Endowment for the Humanities and the De Rance Corporation. Two of the editors of individual works in the present volume are deceased. Father Philotheus Boehner, O.F.M., who came to the Franciscan Institute from Germany before the outbreak of World War II, first conceived of and began work on the critical edition. His text of the Tractatus de praedestinatione was first published in 1945 in Franciscan Institute Publications, Text Series No. 2 and was subsequently translated into English by M. M. Adams and N. Kretzmann in 1969. It differs little in Brown’s revision, which adds variants from the Bruges MS, unavailable to Boehner because of the war. The other posthumous edition is that of E. A. Moody. This too appeared in the aforesaid Text Series as No. 14. The present text is identical with the earlier version, but observations and suggested alternate readings by the general editor are added in footnotes. The thirty-two pages of introduction contains a wealth of information. To mention but two items: One concerns the probable reason why Ockham only incepted in theology but never served as regent master. This apparently had little or nothing to do with Lutterall’s opposition, as Chancellor of the University, to Ockham’s views and his summons later to the papal court at Avignon. It stemmed rather from the Franciscan custom of promoting those bachelors who had completed their magisterial studies to regent master on the basis of seniority. At his time a junior like Ockham could expect a wait of eight to ten years. It was during this period, beginning probably in 1321 that he began his lectures on logic, probably at the Franciscan house of studies in London where he later composed the Summa Logicae and his exposition of Aristotle’s Physics, before the summer of 1324 when he went to Avignon. Another item is the effective refutation of the authenticity views of Prantl and Anneliese Maier of the Expositiones and their relationship to the spurious and derivative Notabilia. As a final comment, we note that this second volume of the Opera philosophica contains all the works of Ockham edited by Marcus de Benevento under the title Expositio aurea et admodum utilis super artem veterem edita per Ven. Inceptorem Guilielmum de Occham, [[sic]] cum quaestionibus Alberti Parvi de Saxonia.—A.B.W. (shrink)

For his contribution to the general series of Harper Essays in Philosophy, Hilary Putnam selects only one of several philosophical problems in the interrelated fields of logic and/or mathematics that have interested him, viz. the nominalism-realism issue: Are the "abstract entities" spoken of in these sciences, such as classes, number, functions from various kinds of things to real numbers, things that "really exist" or not? He is concerned to present a detailed argument for his own "qualified realism" rather than a (...) survey of current opinions. He argues persuasively that while a nominalist would like to eliminate all talk of logical classes such as S, M and P in favor of such circumlocutions as "The following schema turns out to be true no matter what words or phrases of the appropriate kind one may substitute for the letters S, M and P," etc., such descriptions avoid references to classes only by replacing them with equally nonphysical entities such as "all possible words, strings of letters, formalized languages," etc., and that the notion of truth or validity itself cannot be applied to physical objects or material inscriptions, but to what sentences mean or say, and the things they say are not physical. He rejects Quine's distinction that first order statements or arguments such as "All crows are black; all back things absorb light, therefore," etc., are logical truths, whereas "For all classes S, M and P, if all S is M and all M is P, then all S is P," are mathematical. This runs counter, he says, to the whole logical tradition. The natural intention of the logician in setting down first-order schemata is to assert implicitly their validity and that itself is a second-order assertion. All logic, therefore, including quantification theory, involves references to classes. This also highlights the difficulty of distinguishing between logic and mathematics in terms of first and second order logic, for if only the former is stipulated to be the proper domain of logic, then we must accept the awkward consequence that validity and implication turn out to be notions that belong to mathematics rather than logic. Since the nominalistic position presents the same problems for mathematics as for logic, Putnam sees no point in trying to draw any sharp distinction between the two, which explains his initial broad interpretation of logic as including all of pure mathematics and also the title of the book. To avoid some of the classical objections to a realistic interpretation of sets, he points up the distinction between a predicative and impredicative conception of set. Whereas the latter speaks of all sets of individuals as a well-defined totality, the former defines "set" only for a particular language N or a hierarchic series of languages, N, N', N", etc. in which it is still nonsensical to speak of "all sets" without qualification, though one can speak of "all" up to any given level in the series. While some form of set theory is necessary for all the sciences, both formal and physical, one can get along with predicative set theory. Putnam's basic argument for realism then comes down to this. Quantification over mathematical entities such as things, real numbers and functions is indispensable for logic, mathematics and the physical sciences and this commits one to accept the existence of such entities. In the final stages of the argument he examines and rejects the alternative options to realism, namely that realistic locutions about such entities represent logically deviant forms of speech, or that mathematical truths are "true by pure convention" or that such "entities" are useful fictions. In the closing paragraphs he indicates two other philosophical problems in logic that merit extensive discussion, namely the problem of equivalent constructions which is relevant to the question of whether mathematics needs "foundations" and the problem of whether we may not have to revise logical principles as we have geometrical ones on the grounds that in some sense logic may have empirical foundations.--A. Among the quantificational notions neglected by classical logic are "many," "few," and "nearly all." Despite the apparent vagueness associated with these terms in ordinary discourse, in specific contexts we can and do draw strict inferences from statements in which they occur. In this pioneering work, Altham has attempted to uncover something of the formal logic that justifies such inferences. He begins by showing the mutual interdefinability of the three terms. If negation and any one of them are taken as primitive, (...) the other two are definable in terms of these. Selecting as his basic semantic notion the idea of a manifold or many-membered-set, he shows it is only necessary to fix upon a number n, greater than one, to represent the least number of elements to constitute a specific manifold and then one can construct a natural deductive system which uses the standard predicate logic. He develops at great length a weak system that yields principles of inference which are valid in every non-empty domain and in which the classical predicate logic appears as a limiting case. One point that emerges is that the three plurality operators may all be exhibited as involving a double quantification not characteristic of "some," "none," or "all." Next, two stronger systems are developed more briefly which are valid only in many-membered domains. The strongest can represent the largest set of informal arguments and seems to be the most natural of the three. Nevertheless, since these three systems admittedly do not give an exhaustive account of the use of these quantifiers in informal discourse, Altham explains three further systems which correspond more closely to the natural language use of these terms. Finally an appendix indicates what modifications would be required for an intuitionistic logic like Heyting's or the minimal logic of Kolmogorov-Johansson. The text is clearly written and requires no greater logical sophistication to understand than would be needed to follow Lemmon's Beginning Logic or Mates' Elementary Logic.--A. B. W. (shrink)
