We explore the ethics of using motivational interviewing, an evidence-based, client-centred and directional counselling method, in conversations with next of kin about deceased solid organ donation. After briefly introducing MI and providing some context around organ transplantation and next of kin consent, we describe how MI might be implemented in this setting, with the hypothesis that MI has the potential to bring about a modest yet significant increase in next of kin consent rates. We subsequently consider the objection that using (...) MI in this context would be manipulative. Although we cannot guarantee that MI would never be used in a problematically manipulative fashion, we conclude that its use would, nevertheless, be permissible as a potential means to increase next of kin consent to deceased solid organ donation. We propose that MI be trialled in consent situations with next of kin in nations where there is widespread public support for organ donation. (shrink)

This article is about the information relevant to decision-making capacity in refusal of life-prolonging medical treatment cases. We examine the degree to which the phenomenology of the options available to the agent—what the relevant states of affairs will feel like for them—forms part of the capacity-relevant information in the law of England and Wales, and how this informational basis varies across adolescent and adult medical treatment cases. We identify an important doctrinal phenomenon. In the leading authorities, the courts appear to (...) count the first-personal phenomenology of the available options among the information that adolescents seeking to refuse life-prolonging treatment must understand and appreciate in order to possess capacity; adults are not held to this (higher) standard. We evaluate this differential treatment in light of philosophical work on transformative choice—decisions involving options whose sensory character, and effect on our values and preferences, are grasped only through experience itself. Adolescents are routinely treated differently to adults, even when they possess similar capacities. In this article, we explore the justification for one case of differential treatment of adolescents. We attempt to make philosophical sense of the concurrent consents doctrine in law: adolescents found to have decision-making capacity have the power to consent to—and thereby, all else being equal, permit—their own medical treatment, but they lack the power always to refuse treatment and so render it impermissible. Other parties, that is, individuals (...) who exercise parental responsibility or a court, retain the authority to consent on an adolescent’s behalf. We explore four defences of the doctrine. We reject two attempts to defend the asymmetry in the power to consent to and refuse medical treatment by reference to transitional paternalism. We then consider and reject a stage of life justification. Finally, we articulate a justification based on the distinctiveness of adolescent well-being. (shrink)

Some form of assisted dying (voluntary euthanasia and/or assisted suicide) is lawful in the Netherlands, Belgium, Oregon, and Switzerland. In order to be lawful in these jurisdictions, a valid request must precede the provision of assistance to die. Non-adherence to the criteria for valid requests for assisted dying may be a trigger for civil and/or criminal liability, as well as disciplinary sanctions where the assistor is a medical professional. In this article, we review the criteria and evidence in respect of (...) requests for assisted dying in the Netherlands, Belgium, Oregon, and Switzerland, with the aim of establishing whether individuals who receive assisted dying do so on the basis of valid requests. We conclude that the evidence suggests that individuals who receive assisted dying in the four jurisdictions examined do so on the basis of valid requests and third parties who assist death do not act unlawfully. However, further research on the elements that may undermine the validity of requests for assisted dying is warranted. One feature that classical apocalyptic writings commonly share is their eschatological dimension, their "sense of an ending"1—the end of the world, of time, of humanity. But whereas traditional apocalyptic texts were for the most part utopian, their tales of destruction followed by narratives of redemption, modern secular apocalyptic literature is largely dystopian, ending in pure devastation. This article examines the Depo-Provera Affair—where Israeli doctors administered the contraceptive Depo-Provera to newly immigrated Ethiopian Jewish women—to argue that the Israeli settler colonial project depends on these forms of gendered anti-Black violence, through the management of Black African bodies. In 2013, then Israeli Deputy Health Minister Yaakov Litzman admitted that they had administered Depo-Provera to Ethiopian immigrant women without their consent, after reproductive and civil rights activists in Israel called for an investigation after a drop in the (...) birthrate among Ethiopian women: close to 50 per cent within the previous decade. The demarcation of Blackness as a political tool necessary to advance Israeli modernity and the situating of Black bodies as antithetical to the state of Israel are not contradictory but rather illuminate Israel’s deployment of anti-Blackness through the racial and reproductive violence necessary to become part of the superior, European West. Sundquist terms the "black-Jewish question" (2). In doing so, the book serves as both culmination and corrective to an already-expansive (...) scholarly literature on blacks and Jews generated since the late 1960s. Much of this scholarship has operated within a U.S.-centered paradigm to chart interethnic relations, laboring as it does to unpack, complicate, theorize, and otherwise come to understand the changing texture of black-Jewish relations and, in Sundquist's wods, its "intermixture of empathy, anxiety, and Hostility' (3)." The authors suggest that social movements research should recognize more the potential of the protesting body as an agent of social and political change. This contention is based on studying the relations among the body, gender, and knowledge in social protest by comparing two Israeli-Jewish leftist protest movements, a woman-only movement and a mixed-gender one, which protested against the Israeli Occupation in the early 1990s. The comparison reveals reversed patterns of body/knowledge relations, each connoting a different meaning and outcome of (...) the social protest. In the mixed movement, the body served as an instrument in carrying out the political knowledge and thus was left unmarked. In Women in Black, on the other hand, the body was the message, as it produced and articulated political ideology, simultaneously challenging the national security legacy and the gender order in Israel. In August 2001, the Israeli Ministry of Health issued its Limitation of Smoking in Public Places Order, categorically forbidding smoking in hospitals. This forced the mental health system to cope with the issue of smoking inside psychiatric hospitals. The main problem was smoking by compulsorily hospitalized psychiatric patients in closed wards. An attempt by a psychiatric hospital to implement the tobacco smoking restraint instruction by banning the sale of cigarettes inside the hospital led to the development of a black (...) market and cases of patient exploitation in return for cigarettes. This article surveys the literature dealing with smoking among psychiatric patients, the role of smoking in patients and the moral dilemmas of taking steps to prevent smoking in psychiatric hospitals. It addresses the need for public discussion on professional caregivers’ dilemmas between their commitment to uphold the law and their duty to act as advocates for their patients’ rights and welfare. This article examines how Žižek’s analysis of “subjective” violence can be used to explore the ways in which media coverage of a terrorist attack is contoured and shaped by less noticeable forms of “objective” (symbolic and systemic) violence. Drawing upon newspaper coverage of the 2017 London Bridge attack, it is noted how examples of “subjective” violence were grounded in the externalization of a clearly identifiable “other”, which symbolically framed the terrorists and the attack as tied to and representative of the (...) UK Muslim community. Examples of “systematic” violence were most notable in the ideological edifice that underpinned this framing but also in the ways in which newspaper reports served to draw upon British values in the aftermath of the attack. This directed attention away from the contradictions within the UK, towards narratives that sought to “fix” these contradictions through eradicating the problem of “the other” and/or by violently protecting the British values “they” seek to undermine. As a consequence, newspaper coverage worked to uphold the illusion that “peace” could be achieved by eradicating terrorism through further forms of objective violence, including, internment without trial; the “ripping up” of human rights; and, closer surveillance of Muslim communities. Indeed, it was this unacknowledged violence that worked to maintain British values in the press’ coverage. (shrink)

If there is any social organization that has provided a powerful illustration of the permeable boundaries between social politics—defined by Stephen M. Buechler as “forms of collective action that challenge power relations without an explicit focus on the state”—and social movements , and the role of collective identity in transforming either, as defined for women by Betty Friedan—it would be the Israeli kibbutz movement. The research presented here on grassroots Israeli women activists, a significant proportion of whom had grown up (...) or had lived in a kibbutz, suggests that the social politics of everyday life on a kibbutz facilitated women's participation in larger social movements for peace, but also placed constraints on their activism. Many of these women had left or were in the process of leaving the kibbutz between 1989 and 1999, when this research was conducted. Those who had already left, and anchor women who organized urban demonstrations, saw the kibbutz as a conservative anti-woman force. Nonetheless, evidence gathered from qualitative interviewing with them suggests that the kibbutzim supported women who were politically active on national issues. Several women-led social protest movements illustrate how the kibbutz geared its members to think about the interplay of the moral and social orders in the small spaces of everyday life. (shrink)

This thesis develops and defends a Peircean conception of the task of metaphysics and critically compares it with recent anti-metaphysical forms of pragmatism. Peirce characterises metaphysics in terms of its place within his hierarchical classification of the sciences. According to the classification, metaphysics depends on logic for principles and provides principles to the natural and social sciences. This arrangement of the sciences is defended by appeal to Peirce's account of philosophy as 'cenoscopy'. The dependence of the natural and social sciences (...) on cenoscopy is then argued for on the basis of Peirce's rejection of psychologism and in terms of the necessity of abductive inference. Peirce's position is then compared with recent forms of pragmatism. While it is less naturalistic, Peirce's position is defended on pragmatist grounds. An account of Peirce on truth is then developed. Peirce's account of truth in terms of an ideal limit of inquiry is defended as consistent with recent, more deflationary, approaches. The truth of 'abstract propositions' is a matter of local indefeasibility. These abstract propositions are related to the 'absolute truth', understood as a single non-abstract proposition. The truth of this proposition is then understood in terms of an identity theory. Two conceptions of Peircean metaphysics are presented. Both are 'abductive'. Their task is to explain the possibility of success in inquiry. However, only one proposal accepts the notion of an absolute truth. The 'absolutist' proposal is defended as an interpretation of Peirce and as a contemporary option for pragmatist philosophers. The thesis concludes by comparing recent anti-metaphysical arguments due to Huw Price with the Peircean position. Room for the absolutist proposal is defended by means of an account of recent exchanges between Price and Robert Brandom on dispositional modality. (shrink)
