Research involving adults who lack capacity to consent relies on proxy (or surrogate) decision making. Proxy decisions about participation are ethically complex, with a disparity between normative accounts and empirical evidence. Concerns about the accuracy of proxies’ decisions arise, in part, from the lack of an ethical framework which takes account of the complex and morally pluralistic world in which proxy decisions are situated. This qualitative study explored the experiences of family members who have acted as a research proxy in (...) order to develop an understanding of the ethical concepts involved, and the interactions between those concepts. Proxies described a complex process of respecting the wishes and preferences of the person they represented, whist integrating preferences with what they viewed as being in the interests of the person. They aimed to make a decision that was ‘best’ for the person and protected them from harm; they also aimed to make the ‘right’ decision, viewed as being authentic to the person’s values and life. Decisions were underpinned by the relationship between the person and their proxy, in which both trust and trustworthiness were key. Proxies’ decisions, based both on respect for the person and the need to protect their interests, arose out of their dual role as both proxy and carer. The findings raise questions about accounts which rely on existing normative assumptions with a focus on accuracy and discrepancy, and which fail to take account of the requirement for proxies to make authentic decisions that arise out of their caring obligations. This article reports on a collective effort to position ethics policies within the context of a specific discipline – Applied Language Studies (ALS). Through a discussion of challenges to ALS-specific pedagogical and research practices, this article highlights (1) the need for consistency across institutional Research Ethics Boards in the application of general principles of ethics review, and (2) the recognition of local considerations that are informed by disciplinary approaches not envisioned in current ethics policies. Ethics policies that are driven by (...) substantive ethical intent will recognize pedagogical practices, research methodologies, and epistemological values and traditions that mark a discipline. Regulation and governance of medical research is frequently criticised by researchers. In this paper, we draw on Everett Hughes’ concepts of professional licence and professional mandate, and on contemporary sociological theory on risk regulation, to explain the emergence of research governance and the kinds of criticism it receives. We offer explanations for researcher criticism of the rules and practices of research governance, suggesting that these are perceived as interference in their mandate. We argue that, in spite of their complaints, researchers (...) benefit from the institutions of governance and regulation, in particular by the ways in which regulation secures the social licence for research. While it is difficult to answer questions such as: “Is medical research over-regulated?” and “Does the regulation of medical research successfully protect patients or promote ethical conduct?”, a close analysis of the social functions of research governance and its relationship to risk, trust, and confidence permits us to pose these questions in a more illuminating way. New models of data governance for health data are a focus of growing interest in an era of challenge to the social licence. In this article, we reflect on what the data trust model, which is founded on principles of participatory governance, can learn from experiences of involving and engagement of members of the public and participants in the governance of large-scale biobanks. We distinguish between upstream and ongoing governance models, showing how they require careful design and operation if they (...) are to deliver on aspirations for deliberation and participation. Drawing on this learning, we identify a set of considerations important to future design for data trusts as they seek to ensure just, proportionate and fair governance. These considerations relate to the timing of involvement of participants, patterns of inclusion and exclusion, and responsiveness to stakeholder involvement and engagement. We emphasise that the evolution of governance models for data should be matched by a commitment to evaluation. (shrink)

Software piracy has become recognized as a major problem for the software industry and for business. One research approach that has provided a theoretical framework for studying software piracy has been to place the illegal copying of software within the domain of ethical decision making assumes that a person must be able to recognize software piracy as a moral issue. A person who fails to recognize a moral issue will fail to employ moral decision making schemata. There is substantial evidence (...) that many individuals do not perceive software piracy to be an ethical problem. This paper applies social exchange theory, in particular equity theory, to predict the influence of situational factors on subjects' intentions to participate in software piracy. Consistent with the predictions of equity theory this study found that input and outcome situational variables significantly effect a person's intentions to commit software piracy. (shrink)

Summary Although Sir William Forbes of Pitsligo's An Account of the Life and Writings of James Beattie has long served as an invaluable resource for those interested in Beattie's life and thought, there has been little scholarship on the genesis of Forbes's book. This article considers the role played by Dugald Stewart—as well as that of his friend, Archibald Alison—in the making of Forbes's Life of Beattie. It also examines the reasons for Forbes's decision not to print Stewart's letter in (...) its entirety in the Life of Beattie and explores the letter's significance for understanding Stewart's philosophical development. Public health and service delivery programmes, interventions and policies are typically developed and implemented for the primary purpose of effecting change rather than generating knowledge. Nonetheless, evaluations of these programmes may produce valuable learning that helps determine effectiveness and costs as well as informing design and implementation of future programmes. Such studies might be termed ‘opportunistic evaluations’, since they are responsive to emergent opportunities rather than being studies of interventions that are initiated or designed by researchers. However, current ethical guidance (...) and registration procedures make little allowance for scenarios where researchers have played no role in the development or implementation of a programme, but nevertheless plan to conduct a prospective evaluation. We explore the limitations of the guidance and procedures with respect to opportunistic evaluations, providing a number of examples. We propose that one key missing distinction in current guidance is moral responsibility: researchers can only be held accountable for those aspects of a study over which they have control. We argue that requiring researchers to justify an intervention, programme or policy that would occur regardless of their involvement prevents or hinders research in the public interest without providing any further protections to research participants. We recommend that trial consent and ethics procedures allow for a clear separation of responsibilities for the intervention and the evaluation. (shrink)

In a recent issue of Journal of Medical Ethics, we discussed the ethical review of evaluations of interventions that would occur whether or not the evaluation was taking place. We concluded that standard research ethics frameworks including the Ottawa Statement, which requires justification for all aspects of an intervention and its roll-out, were a poor guide in this area. We proposed that a consideration of researcher responsibility, based on the consequences of the research taking place, would be a more appropriate (...) way delineate the scope of research ethics review. Weijer and Taljaard present a counterargument to our proposal, which we address in this reply. They claim that a focus on researcher responsibility will weaken the protection of research participants and link it to ‘unethical research’ and a ‘government experimenting on its own people’. However, the moral responsibility of researchers is defined in terms of the consequences of the research on human welfare and harm, not in opposition to it. Weijer and Taljaard argue that researchers must justify what they are studying whether or not they have any control over it and that governments must justify their programmes, including by demonstrating equipoise, to a research ethics committee if they implement them in a randomised way. We strongly disagree that this is a defensible way to define the scope of research ethics review and argue that this provides no further protections to research participants beyond what we propose, but places a potential barrier to learning from government programmes. ObjectiveTo examine health and social care professionals’ understanding of the legislation governing research involving adults lacking mental capacity in England and Wales.MethodsA cross-sectional online survey was conducted using a series of vignettes. Participants were asked to select the legally authorised decision-maker in each scenario and provide supporting reasons. Responses were compared with existing legal frameworks and analysed according to their level of concordance.ResultsOne hundred and twenty-seven professionals participated. Levels of discordance between responses and the legal frameworks were high across all (...) five scenarios. Nearly half of the participants provided responses that were discordant in all scenarios. Only two participants provided concordant responses across all five scenarios.DiscussionParticipants demonstrated a lack of knowledge about the legal frameworks, the locus of authority and the legal basis for decision-making. The findings raise concern about the accessibility of research for those who lack capacity, the ability to conduct research involving such groups and the impact on the evidence base for their care.ConclusionThis is the first study to examine health and social care professionals’ knowledge and understanding of the dual legal frameworks in the UK. Health and social care professionals’ understanding and attitudes towards research involving adults with incapacity may warrant further in-depth exploration. This book's importance is derived from three sources: careful conceptualization of teacher induction from historical, methodological, and international perspectives; systematic reviews of research literature relevant to various aspects of teacher induction including its social, cultural, and political contexts, program components and forms, and the range of its effects; substantial empirical studies on the important issues of teacher induction with different kinds of methodologies that exemplify future directions and approaches to the research in teacher induction.

The many genetic complementation groups of DNA excision‐repair defective mammalian cells indicate the considerable complexity of the excision repair process. The cloning of several repair genes is taking the field a step closer to mechanistic studies of the actions and interactions of repair proteins. Early biochemical studies of mammalian DNA repair in vitro are now at hand. Repair synthesis in damaged DNA can be monitored by following the incorporation of radiolabelled nucleotides. Synthesis is carried out by mammalian cell extracts and (...) is defective in extracts from cell lines derived from individuals with the excisionrepair disorder xeroderma pigmentosum. Biochemical complementation of the defective extracts can be used to purify repair proteins. Repair of damage caused by agents including ultraviolet irradiation, psoralens, and platinating compounds has been observed. Neutralising antibodies against the human single‐stranded DNA binding protein (HSSB) have demonstrated a requirement for this protein in DNA excision repair as well as in DNA replication. (shrink)

The term “dualism” is used in quite divergent connotations across religious studies, sociology, theology, anthropology, and other academic fields. This paper characterizes the differing usages of the term, and uses them to explore the sometimes-converging and sometimes-orthogonal relationship between academic fields, with a focus on religious studies and the sociology of religion. I argue that although the two fields have mutually benefited from insights originating on either side of their divide—and thus converged in important ways—substantive differences remain. Their differing understandings (...) of “dualism” represents important theoretical and analytic divergence, and the justified critique of certain forms of dualism has been used to reject all versions of the concept, including some—here termed “embodied dualism” or “experiential dualism”—that remain analytically crucial to the study of social life generally and religion particularly. Can exposure to media portrayals of human violence impact an individual’s ethical decision making at work? Ethical business failures can result in enormous financial losses to individuals, businesses, and society. We study how exposure to human violence—especially through media—can cause individuals to make less ethical decisions. We present three experiments, each showing a causal link between exposure to human violence and unethical business behavior, and show this relationship is mediated by an increase in individual hostility levels as a result of (...) exposure to violence. Using observational data, we then provide evidence suggesting that this relationship extends beyond the context of our experiments, showing that companies headquartered in locations marked by greater human violence are more likely to fraudulently misstate their financial statements and exhibit more aggressive financial reporting. Combined, our results suggest that exposure to human violence has significant and real effects on an individual’s ethical decision making. (shrink)

Safe stair negotiation is an everyday task that children with developmental coordination disorder are commonly thought to struggle with. Yet, there is currently a paucity of research supporting these claims. We investigated the visuomotor control strategies underpinning stair negotiation in children with and without DCD by measuring kinematics, gaze behavior and state anxiety as they ascended and descended a staircase. A questionnaire was administered to determine parents' confidence in their child's ability to safely navigate stairs and their child's fall history. (...) Kinematics were measured using three-dimensional motion capture, whilst gaze was measured using mobile eye-tracking equipment. The parents of DCD children reported significantly lower confidence in their child's ability to maintain balance on the stairs and significantly more stair-related falls in the previous year compared to the parents of typically developing children. During both stair ascent and stair descent, the children with DCD took longer to ascend/descend the staircase and displayed greater handrail use, reflecting a more cautious stair negotiation strategy. No differences were observed between groups in their margin of stability, but the DCD children exhibited significantly greater variability in their foot-clearances over the step edge, which may increase the risk of a fall. For stair descent only, the DCD children reported significantly higher levels of state anxiety than the TD children and looked significantly further along the staircase during the initial entry phase, suggesting an anxiety-related response that may bias gaze toward the planning of future stepping actions over the accurate execution of an ongoing step. Taken together, our findings provide the first quantifiable evidence that safe stair negotiation is a significant challenge for children with DCD, and that this challenge is reflected by marked differences in their visuomotor control strategies and state anxiety levels. Whilst it is currently unclear whether these differences are contributing to the frequency of stair-related falls in children with DCD, our findings pave the way for future research to answer these important questions. Background: Research involving adults lacking mental capacity relies on the involvement of a proxy or surrogate, although this raises a number of ethical concerns. Empirical studies have examined attitudes towards proxy decision-making, proxies’ authority as decision-makers, decision accuracy, and other relevant factors. However, a comprehensive evidence-based account of proxy decision-making is lacking. This systematic review provides a synthesis of the empirical data reporting the ethical issues surrounding decisions made by research proxies, and the development of a conceptual framework of proxy (...) decision-making for research. Methods: A systematic review was conducted according to PRISMA guidelines. Databases including MEDLINE, EMBASE, and CINAHL were searched using a combination of search terms, and empirical data from eligible studies were retrieved. The review followed the framework synthesis approach to refine and develop a conceptual framework. Results: Thirty-four studies were included in the review. Two dimensions of proxy decision-making emerged. The ethical framing criteria of decision-making used by proxies: use of a substituted judgement, use of a best interests approach, combination of substituted judgement and best interests, and ‘something else’, and the active elements of proxy decision-making: ‘knowing the person’, patient-proxy relationship, accuracy of the decision, and balancing risks, benefits and burdens, and attitudes towards proxy decision-making. Interactions between the framing criteria and the elements of decision-making are complex and contextually-situated. Conclusions: The findings from this systematic review challenge the accepted reductionist account of proxy decision-making. Decision-making by research proxies is highly contextualized and multifactorial in nature. The choice of proxy and the relational features of decision-making play a fundamental role: both in providing the proxy’s authority as decision-maker, and guiding the decision-making process. The conceptual framework describes the relationship between the framing criteria used by the proxy, and the active elements of decision-making. Further work to develop, and empirically test the proposed framework is needed. (shrink)

Richard Rufus of Cornwall was educated as a philosopher at Paris where he was a master of arts. 1 In 1238, after lecturing on Aristotle’s librinaturales, Rufus became a Franciscan and moved to Oxford to study theology, becoming the Franciscan master of theology in about 1256 and probably dying not long after 1259. 2.

Arthur Schopenhauer (1788-1860) is now recognised as a figure of canonical importance to the history of philosophy. Schopenhauer founded his system on a highly original interpretation of Kant's philosophy, developing an entirely novel and controversial worldview guided centrally by his striking conception of the human will and of art and beauty. His influence extends to figures as diverse as Fredrich Nietzsche, Ludwig Wittgenstein and Iris Murdoch within philosophy, and Richard Wagner, Thomas Hardy, Sigmund Freud, Thomas Mann, Samuel Beckett and (...) Jorge Luis Borges outside it. The Schopenhauerian Mind is an outstanding, wide-ranging collection that explores the rich nature of Schopenhauer's ideas, texts, influences, and legacy. Comprising 38 original chapters by an international team of contributors, the volume is organised into five clear parts: Knowledge and Reality Aesthetics and the Arts Ethics, Politics, and Salvation Before Schopenhauer After Schopenhauer. The Schopenhauerian Mind covers all the key areas and concepts of Schopenhauer's philosophy, including fields omitted in previous studies. It is essential reading for students of nineteenth-century philosophy, Continental philosophy and philosophy of art and aesthetics, and also of interest to those in related disciplines such as literature and religion. Erfurt Quarto 290 includes two commentaries on Aristotle40, 1 chiefly on the basis of a thirteenth-century ascription to Richard Rufus, deciphered by Fr. Leonard Boyle; the aim of this essay is to show that the author of the commentary on folios 4640, the Scriptum, but that seems misleading since Noone also claims that what we have is a record preserved by its auditors, a reportatio. And in medieval scholarly practice, a reportatio is distinguished from a scriptum, which is a (...) written version corrected by the author and meant for publication. In order not to prejudice the question whether this commentary is reportatio or a scriptum, we will call it the DissertatioinMetaphysicamAristotelis, taking the term from the workPlacetnobisnuncparumperdissereredequadampropositionequamdicitAristotelesin56 probably dates from around 1235, but the basis for that claim will be stated at the end of this paper. Contemporary conversations about religion and culture are framed by two reductive definitions of secularity. In one, multiple faiths and nonfaiths coexist free from a dominant belief in God. In the other, we deny the sacred altogether and exclude religion from rational thought and behavior. But is there a third way for those who wish to rediscover the sacred in a skeptical society? What kind of faith, if any, can be proclaimed after the ravages of the Holocaust and the many religion-based (...) terrors since? Richard Kearney explores these questions with a host of philosophers known for their inclusive, forward-thinking work on the intersection of secularism, politics, and religion. An interreligious dialogue that refuses to paper over religious difference, these conversations locate the sacred within secular society and affirm a positive role for religion in human reflection and action. One of the first to teach the new Aristotle, Richard Rufus of Cornwall here presents exciting accounts of divisibility, growth, and Aristotelian mixture which transform our understanding of the introduction of Aristotelian natural philosophy to the West and provide insight into the early history and prehistory of chemistry.

Broadly speaking, ancient concepts of causality in terms of explanatory priority have been contrasted with modern discussions of causality concerned with agents or events sufficient to produce effects. As Richard Taylor claimed in the 1967 Encyclopedia of Philosophy, of the four causes considered by Aristotle, all but the notion of efficient cause is now archaic. What we will consider here is a notion even less familiar than Aristotelian material, formal, and final causes—what we will call 'demonstrational causality'. Demonstrational causality (...) refers to the dependence of the conclusion on the premises of a demonstration. Here, if ever, we have a case of explanational priority, since among other things what is required of the premises is that they be better known or more manifest than the conclusion. But, oddly enough, Aristotle and his medieval commentators describe demonstrational causality in the same terms as efficient causality. Aristotle speaks of the conclusion as an "effect" of the premises; his commentators speak of the "sufficiency" of first principles or axioms in producing the conclusion. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:“Garrulus sum et loquax et expedire nescio. Diu te tenui in istis, sed de cetero procedam.” These are the words of Richard Rufus of Cornwall, a thirteenth-century Scholastic and lecturer at the Universities of Paris and Oxford. Rufus is apologizing to his readers: “I am garrulous and loquacious, and I don’t know how to be efficient. I have detained you with these things a long while, but let (...) me now proceed to another topic.” This apology introduces the third part of the Speculum animae, a preliminary modern edition of which we publish here. In this short treatise, Rufus presents a unique Aristotelian theory of perception, describes what is and is not intelligible, and finally proves to his own satisfaction the immortality of the rational soul. To us this would hardly seem the place to apologize for being long-winded; indeed, we might wonder how Rufus could accomplish such an ambitious task in such a short treatise. We would certainly not accuse him of excessive verbosity. But Rufus was a man of exceptional humility, who once referred to himself as the least of the lesser thinkers of his time.1Despite Rufus’s humility, he was no minor figure in the development of Scholastic philosophy. A teacher at the Universities of Paris and Oxford ,2 he is the author of the earliest known, surviving lectures on several of Aristotle’s major texts, including the Metaphysics, the Physics, De generatione et corruptione, and De anima3 . In fact, Rufus was one of the very first lecturers to teach the libri naturales at Paris after a ban on such instruction was effectively lifted in 1231 A.D. His works were influential not only among his contemporaries, but also among later authors, particularly John Duns Scotus. Roger Bacon, though a harsh critic of Rufus, acknowledged Rufus’s influence and fame decades after his death, albeit among what Bacon termed the “vulgar multitude.”4The Speculum animae is one of Rufus’s later works. He begins the treatise by posing the following question: “In what way is the soul all things?” This refers, of course, to a familiar doctrine Aristotle establishes in the De anima—that the soul is, in some way, all things —and Rufus is here seeking to clarify it. But this is, in fact, only the first of five questions addressed in the Speculum. The five questions Rufus posits and answers in this treatise are, in order:1. In what manner is the soul all things?2. In what manner do a sensible and the sense, or an intelligible and the possible intellect, become one?3. What is predicated and of what is it predicated?4. What is intelligible?5. What is the cause of the immortality of the soul?In this short work, therefore, Rufus addresses apparently diverse topics including perception, understanding, logic, and the nature of the soul. But, in fact, the Speculum is principally a summary of Rufus’s theory of human perception and understanding. Like other medieval theories of perception and understanding, Rufus’s theory centers around the notion of species, a kind of form that is received in the soul when a person senses something or grasps something intellectually.5 In this, and in other aspects of the theory, Rufus was heavily dependent on Aristotle and St. Augustine. Rufus was working in a philosophical tradition based on Aristotle’s categories that had been accepted for centuries in the West. But in his lifetime, the Aristotelian corpus was enlarged to include Aristotle’s psychology and more generally his natural philosophy and metaphysics, together with the commentaries of Averroës . As is well known, this philosophical tradition was respected and continued not just by Rufus but by many authors after his time.So what makes Rufus’s theory.. (shrink)

Virtue Epistemology has come a long way since Ernest Sosa first mooted its possibility in ‘The Raft and the Pyramid’, a paper about the pitfalls of coherentism and foundationalism. What makes Virtue Epistemology distinctive, as opposed to other forms of reliabilist externalism, is that the epistemic agent becomes the locus for justification rather than the belief. In the midst of a small but growing literature in this focus on the agent, two clear trends are emerging that reflect a difference in (...) interest by the authors rather than any real underlying antagonism between camps. Where faculty reliabilists like Sosa and Greco are concerned about sceptical challenges, virtue responsibilists like Zazebski or Roberts and Wood prefer to write about intellectual flourishing. The law of the collegium of ivory and citrus-wood merchants is best known for its suspected prohibition against outsiders or non-practitioners. The present study argues that the regulation in question actually prohibits curatores from enrolling outsiders—the text curiously labels such an offense ‘fraud’. Rather than banning outsiders altogether, the law provides that only quinquennales shall have the authority to admit non-practitioners. It is still a rather unusual law, and since it conveys the impression that this collegium is wildly popular (...) even among non-practitioners, and headed by quinquennales who excel in the virtue of orderliness, its audience and function are both scrutinized here. The relocation of a stone from its natural habitat changes the found object from an ordinary rock to a viewing stone that invites close examination and perhaps contemplation.In this essay, I will examine the act of "re-grounding" rocks that have been removed from nature and resettled in the soil of culture.
