Émile Durkheim remains one of the most controversial, and deeply misunderstood, classics of social theory. His work differs from the dominant version of sociology that has essentially accepted the modernist self-description of contemporary societies; and it contradicts the individualism that has come to dominate the social sciences. For everybody who is interested in constructing theoretical alternatives to this individualism, Durkheim's sociology can be a useful inspiration - not only because of the solutions it suggests, but already because of the questions (...) it asks. Making use of the theoretical possibilities offered by the Durkheimian tradition, however, requires going beyond the familiar appropriations. The Oxford Handbook of Émile Durkheim takes stock of the different recent debates on Durkheimian sociology, and makes them accessible to a wide audience spanning various disciplines; this includes crucial debates that, due to language barriers, are not easily accessible for an English-reading public. The handbook's chapters elucidate the controversial key concepts of Durkheimian sociology; situate them within the contemporary political and theoretical debates they were originally responding to; offer surveys of empirical research that uses Durkheimian concepts (on topics that were already central for Durkheim's own work as well as on topics that Durkheim hardly touched upon), thus demonstrating the possibilities of a Durkheimian sociology; bring out the divergent, and competing, ways in which Durkheim's ideas have been appropriated and reformulated within more recent theoretical developments in the social sciences. In response to national trends calling for increasing accountability and an emerging dialogue within bioethics, we describe an effort to credential clinical ethicists at a major academic medical center. This effort is placed within the historical context of prior calls for credentialing and certification and efforts currently underway within organized bioethics to engage this issue. The specific details, and conceptual rationale, behind the New York-Presbyterian Hospital’s graduated credentialing plan are shared as is their evolution and ratification within the context of (...) institutional policy. While other programs will design their credentialing schema consistent with their local context and demographics, the description of one such effort is offered to be instructive to others who want to bring additional standardization to the assessment of the readiness and credentials of those who will engage in the practice of clinical ethics case consultation. The COVID-19 pandemic swept through New York City swiftly and with devastating effect. The crisis put enormous pressure on all hospital services, including the clinical ethics consultation team. This report describes the recent experience of the ethics consultants and Columbia University Irving Medical Center during the COVID-19 surge and compares the case load and characteristics to the corresponding period in 2019. By reporting this experience, we hope to supplement the growing body of COVID-19 scientific literature and provide details of the (...) human toll the virus took on our hospitals and communities. We also aim to highlight the role of the clinical ethics consultant as well as areas of policy and law that may need to be addressed in order to be better prepared for a future public health crisis. Change, Choice and Inference develops logical theories that are necessary both for the understanding of adaptable human reasoning and for the design of intelligent systems. In 1890 C. S. Peirce wrote a review of A. C. Fraser’s recent book on Locke, published to coincide with the bicentennial of Locke’s Essay. Peirce remarked that “Locke’s grand work was substantially this: Men must think for themselves, and genuine thought is an act of perception…. We cannot fail to acknowledge a superior element of truth in the practicality of Locke’s thought, which on the whole should place him nearly upon a level with Descartes.” This estimate of Locke was (...) not the common opinion in England during the nineteenth century. This opinion was reflected in Fraser’s book which, Peirce remarked, could not “be said to be a sympathetic account of [Locke]. The biographer seems to see no charm in his hero, and is perpetually speaking of his want of imagination; which only means he was not given to unpractical dreaming.” Locke had his knowledgeable critics and defenders—for instance Dugald Stewart and John Stuart Mill—but the common opinion ranged from extreme hostility and contempt to condescending criticism of isolated minor points. His style was deplored, his philosophy was called unoriginal and a mere unacknowledged plagiarism of Gassendi and Hobbes; he was said to have so thoroughly misunderstood Descartes that he had merely repeated him with new errors; he was said to owe his philosophical reputation entirely to his advocacy of the popular argument for political freedom or merely to the intellectual circumstances of his time; he was held accountable for Condillac’s rejection of reflection and reason; he was knocked down with a few bare sentences loosely drawn from Leibniz; he was said to have made the mind a puny, passive, mechanical thing. He was called a sensualist, a materialist, a sceptic, an atheist, and a utilitarian though at the same time—and not without contradiction—he was generally, especially by his critics, styled a “great lover of truth,” a plain and simple, well-meaning and religious man. To the nineteenth century Locke meant the Essay, and the history of the Essay was in large measure the history of modern thought, of the eighteenth century. Precisely for this reason there was something nearly sinister about him, in spite of his good personal character. “Locke, himself a clear, humble-minded, patient, reverent, nay, religious man,” said Carlyle, “had paved the way for banishing religion from the world.”. The COVID-19 pandemic that struck New York City in the spring of 2020 was a natural experiment for the clinical ethics services of NewYork-Presbyterian (NYP). Two distinct teams at NYP’s flagship academic medical centers—at NYP/ Columbia University Medical Center (Columbia) and NYP/ Weill Cornell Medical Center (Weill Cornell)—were faced with the same pandemic and operated under the same institutional rules. Each campus used time as an heuristic to analyze our collective response. The Columbia team compares consults during the pandemic with (...) the same period during the year prior. The Weill Cornell service describes the phases of the pandemic to depict its temporal evolution and subsequent ethical challenges. Both sites report that the predominant ethical challenges centered around end-of-life decision making, setting goals of care, and medical futility, all complicated by resource allocation questions and the ambiguity of state law under crisis standards of care. The Columbia campus saw a statistically significant increase in ethics consultations provided to Hispanic patients, perhaps reflective of the disproportionate burden of COVID-19 suffered by this demographic. While Weill Cornell and Columbia saw a surge in clinical ethics consultations, the two services assumed a more expansive role than one normally played in institutional life. Serving as intermediaries between frontline clinicians and senior hospital administrators, consultants provided critical intelligence to hospital leadership about the evolution of the pandemic, disseminated information to clinicians, and attended to the moral distress of colleagues who were asked to provide care under truly extraordinary circumstances. The COVID-19 surge in New York City revealed latent capabilities in ethics consultation that may prove useful to the broader clinical ethics community as it responds to the current pandemic and reconceptualizes its potential for future service. ABSTRACT In the present study, we examined how the perceived attainability and relatability of moral exemplars predicted moral elevation and pleasantness among both adult and college student participants. Data collected from two experiments were analyzed with Bayesian multilevel modeling to explore which factors significantly predicted outcome variables at the story level. The analysis results demonstrated that the main effect of perceived relatability and the interaction effect between attainability and relatability shall be included in the best prediction model, and thus, were (...) deemed to predict the outcome variables significantly. The main effect of relatability as well as its interaction with attainability positively predicted elevation and pleasantness. We discussed educational implications of the findings in terms of how relatability may be the first point of emphasis for moral educators to focus on and attainability can then bolster the effectiveness. These relatable and attainable moral exemplars can be sources for moral elevation and pleasantness, which promote motivation to emulate moral behavior presented by the exemplars. (shrink)

Written in the 1960s, TRUTH AND METHOD is Gadamer's magnum opus. Looking behind the self-consciousness of science, he discusses the tense relationship between truth and methodology. In examining the different experiences of truth, he aims to "present the hermeneutic phenomenon in its fullest extent.

This essay argues that Pufendorf conceived the principles of natural law against the rationalism and innatism of the 17th century, and that Condillac similarly formulated a conception of the human origin of language, both of them thus securing open and human foundations for the two primal institutions of law and language, and also making all citizens free agents in the ordering of communal living.

Almaatouq et al. argue that an “integrative experiment design” approach can help generating cumulative empirical and theoretical knowledge. Here, we discuss the novelty of their approach and scrutinize its promises and pitfalls. We argue that setting up a “design space” may turn out to be theoretically uninformative, inefficient, and even impossible. Designing truly diagnostic experiments provides a better alternative.

From mid-March through May 2020, New York City was the world’s epicenter of the COVID-19 pandemic, and its hospitals faced an unparalleled surge of patients who were critically ill with the virus. In addition to putting an enormous strain on medical resources, the pandemic presented many ethical issues to emotionally and physically stressed clinicians and hospital administrators. Analyses of the challenges faced by the ethics consultation services of the two campuses of New York Presbyterian Hospital, and how they assisted their (...) clinician and administrative colleagues, is the subject of the following four articles. Substituted judgement is often used in the absence of advanced directives to guide decision-making when patients lack decisional capacity. We present a remarkable case of family members exercising substituted misjudgement for a 42-year-old man hospitalized with multiorgan failure on life support. Feeling that their loved one would rather die than face severe disability, they elected to withdraw life support. Although this was done, the patient remained alive and recovered enough to clearly indicate his preference for life, even with severe disability. (...) This case suggests that in instances of unusual quality-of-life judgements where the patient's wishes cannot be known with reasonable certainty, families and physicians should be very wary using substituted judgement to refuse life support. Unless there are strong considerations based on the patient's prior statements, actions and values to decline life support, it would seem ethically appropriate to continue treatment, even with substantial disability the likely outcome. Since the beginning of the 20th century, philosophers of science have asked, "what kind of thing is a scientific theory?" The logical positivists answered: a scientific theory is a mathematical theory, plus an empirical interpretation of that theory. Moreover, they assumed that a mathematical theory is specified by a set of axioms in a formal language. Later 20th century philosophers questioned this account, arguing instead that a scientific theory need not include a mathematical component; or that the mathematical component need (...) not be specified by a set of axioms in a formal language. We survey various accounts of scientific theories entertained in the 20th century -- removing some misconceptions, and clearing a path for future research. (shrink)

In seinem 1960 erschienenen Hauptwerk "Wahrheit und Methode" nimmt Gadamer die bis in die Antike zuruckreichende hermeneutische Tradition auf, um vor allem im Anschluss an Hegel und Heidegger eine philosophische Hermeneutik zu begrunden. Das Buch brachte seinem Autor internationalen Ruhm, und die philosophische Hermeneutik ist eine der massgeblichen Konzeptionen der neueren Philosophie geworden. Nach wie vor bildet "Wahrheit und Methode" den Ausgangspunkt fur eine philosophische Klarung des Verstehens und seiner von Gadamer behandelten Auspragungen in Kunst, Geschichte und Sprache. Der vorliegende (...) Band rekonstruiert und diskutiert in Form eines kooperativen Kommentars, der Gliederung des Werkes folgend, Gadamers Gedankengang, zeigt aber auch die Perspektiven einer Philosophie auf, die sich gegenuber ihrem eigenen hermeneutischen Charakter nicht verschliesst.". Dass Edmund Husserl am Problem der Intersubjektivität gescheitert ist, gilt als ausgemacht - und ebenso, welche Konsequenzen daraus zu ziehen sind. Entgegen dem allenthalben pauschal erklärten `Abschied vom Subjekt' spricht aber vieles dafür, dass es in der gegenwärtigen Sozialtheorie eher um eine Reformulierung transzendentaler Subjektivität geht. Diese Interpretationsthese wirft ein neues Licht auf den sozialtheoretischen Diskurs, der im deutschen Sprachraum in den vergangenen dreissig Jahren vom Gegensatz von Jürgen Habermas' und Niklas Luhmanns Theorien bestimmt war: `Diskurs' und `System' erscheinen als (...) gegensätzliche Versuche, `Subjektivität' und `Interität' in ein theoretisch befriedigendes Verhältnis zu setzen. Wenn aber - so die kritische These dieses Buches - weder die Reformulierung von Subjektivität als `Interität' noch die Reformulierung von Subjektivität ohne `Interität' das Problem der Intersubjektivität überzeugend löst, ist dies ein Grund, neuerlich in eine direkte Auseinandersetzung mit Husserls Theorie transzendentaler Subjektivität einzutreten. Dabei stellt sich heraus, dass Husserls vielkritisierter und -skandalisierter Versuch, den Sinn `Anderer' im `Eigenen' zu fundieren, in der transzendentalphänomenologischen Subjekttheorie durch ein umgekehrtes Begründungsverhältnis konterkariert wird. Bei aller Problematik dieser Theorieanlage - welche nur in Gegenwendung zu den Gewohnheiten der Husserl-Interpretation, vor allem aber auch zu Husserls Selbstinterpretation in den Blick kommt - zeigt sich, dass der phänomenologische Begriff des transzendentalen Subjekts seinen Reformulierungen als Diskurs und als System in mancher Hinsicht überlegen ist. This chapter investigates the idea of collective epistemic commonality suggested by Charles Taylor's example, and contrasts it with a distributive notion of epistemic commonality. It describes a number of accounts of collective epistemic commonality, and then argues that, contrary to what Taylor suggests, conversation is not constitutive of collective epistemic commonality as such, but rather presupposes basic forms of collective epistemic commonality. Taylor's remarks indicate that understanding the consensus is insufficient as whatever proposition people rationally and openly accept in conversation. (...) It is suggested that joint attitudes are irreducible, relational, and pre-reflective, and that such attitudes are joint, in the respect that the participants are aware of themselves as a ‘we’. Highly inferential beliefs need some form of communication, and are probably really some form of joint commitment. (shrink)

This research explores the experiences of UK NHS healthcare professionals working with asylum applicants housed in contingency accommodation during the COVID-19 pandemic. Using a critical understanding of the concept of moral resilience as a theoretical framework, we explore how the difficult circumstances in which they worked were navigated, and the extent to which moral suffering led to moral transformation. Ten staff from a general practice participated in semistructured interviews. Encountering the harms endured by people seeking asylum prior to arrival in (...) the UK and through the UK’s ‘Hostile Environment’ caused healthcare staff moral suffering. They responded to this in several ways, including: (1) feeling grateful for their own fortunes; (2) defining the limitations of their professional obligations; (3) focusing on the rewards of work and (4) going above and beyond usual care. Although moral resilience is reflected in much of the data, some participants described how the work caused ideological transformations and motivated challenges to systems of oppression. We show how current moral resilience theory fails to capture these transformative political and social responses, warning of how, instead, it might encourage healthcare staff to maintain the status quo. We caution against the widespread endorsement of current formulations of moral resilience in contemporary social and political climates, where the hostile and austere systems causing suffering are the result of ideological political decisions. Future work should instead focus on enabling working conditions to support, and developing theory to capture, collective resistance. (shrink)
