The aim of the Nordic Network for the Archaeology and Archaeobotany of Gardening (NTAA), as it was phrased those first days in Alnarp in the beginning of March 2010, is to: ”bring researchers together from different disciplines to discuss the history, archaeology, archaeobotany and cultivation of gardens and plants”. We had no idea, then, how widely appreciated this initiative would become. The fifth seminar in five years was held on Visingsö June 1-3, 2014 and the sixth seminar will take place (...) in Kristiansand, Norway, June 12-14, 2015. We are very pleased to be able to publish this report, Sources to the History of Gardening: Four Interdisciplinary Seminars 2010–2013, Arranged By the Nordic Network for the Archaeology and Archaeobotany of Gardening (NTAA), based on the first four themes and seminars, in total 26 articles. Most of them origins from one of the seminar contributions 2010, 2011, 2012 and 2013 respectively. However, the editorial group has taken the opportunity, with the aim of the network in mind, to add supplementing contributions on some subjects. The articles are arranged in four themes according to the themes of the seminars. The first theme Archaeological Sources to the History of Gardens and the Cultural Landscape is linked to the first seminar in Alnarp, Sweden, 2010 which had a focus on method, the important connections between archaeology and archaeobotany and the interesting progress within garden archaeology during the last decade. The second theme Cabbage Patches and Kitchen Gardens deals with the second seminar in Norrköping, Sweden, 2011. Its focus was on historical, cultural geographical, archaeological and archaeobotanical research concerning utility gardens or kitchen gardens as well as the concept ‘kålgård’ (cabbage patch or kale yard), its shape and content over time. The third theme Cultural and Garden plants: Under Ground, Above Ground, In Herbariums and Archives connects to the third seminar in Uppsala, Sweden, 2012. It focused on sources, source criticism and interdisciplinary research to gain knowledge on the history of garden cultivation and cultural plants. The articles discuss, among other things, herbariums, written sources, DNA and molecular markers, pollen analysis and georadar. The fourth theme for NTAA’s annual seminar was Cultural Relict Plants and was held on Bornholm, Denmark, 2013. The focus on the seminar was on research and conservation of cultural relict plants, that is cultural plants which have survived in the same place for a long time after the actual cultivation has ceased. We dedicate this report to Kjell Lundquist (1955-2011) who were one of the initiators to this network and we hope it will inspire continuous research and new methodological discussions. (shrink)

This paper explores the relationship between a prominent version of the relational view of memory and recent work on forms of unsuccessful remembering or memory errors. I argue that unsuccessful remembering poses an important challenge for the relational view. Unsuccessful remembering can be divided into two kinds: misremembering and confabulating. I discuss each of these cases in light of a recent relational account, according to which remembering is characterized by an experiential relation to past events, and I argue that experiential (...) relations do not adequately distinguish between remembering and unsuccessful remembering. This is because there are, on the one hand, cases of remembering that do not instantiate the relevant experiential relations, and, on the other hand, cases of confabulation and misremembering that do instantiate the relevant experiential relations. I conclude by suggesting that any successful relationalist attempt to explain remembering needs to come to grips with unsuccessful remembering. (shrink)

The (dis)continuism debate—the debate over whether remembering is a form of imagining—is a prominent one in contemporary philosophy of memory. In recent work, Langland-Hassan (2021) has argued that this debate is best understood as a dispute over whether remembering is a form of constructive imagining. In this paper, I argue that remembering is not a form of constructive imagining because constructive processes in remembering and imagining are constrained, and hence controlled, in different ways at the level of consciousness. More specifically, (...) I argue that remembering and imagining differ in terms of the interventions we can make on the constructive processes as they unfold. If this is correct, then a form of discontinuism is vindicated: remembering and imagining are, on this view, processes of different kinds. (shrink)

Despite much philosophical attention on forgiveness itself, the phenomenon of un-forgiving is relatively neglected. Some views of forgiveness commit us to denying that we can ever permissibly un-forgive. Some go so far as to say the concept of un-forgiving is incomprehensible—it is the nature of forgiveness to be permanent. Yet many apparent cases of un-forgiving strike us as both real and justified. In what follows, I will address the latter view, that genuine un-forgiving is impossible or incomprehensible as a phenomenon, (...) advanced by a character I will call the “Un-Forgiving Denier.” I address two views which purport to describe candidate un-forgiving cases in alternative ways and deny that any candidate un-forgiving cases are truly cases of un-forgiving: the “epistemic invalidation” and “new forgiveness opportunity” views. In creating problems for those views, I hope to defend the possibility of genuine un-forgiving. Even if it’s possible to respond to the “Un-Forgiving Denier,” a defender of genuine un-forgiving still faces the “Un-Forgiving Critic,” who insists that un-forgiving, while possible, is morally indefensible. Against this view, I argue that un-forgiving enables an ideal of forgiveness wherein victims hold wrongdoers accountable for their moral development and allows certain opportunities for relational repair. I conclude that there is good reason to think un-forgiving is both possible and permissible. Embracing genuine un-forgiving puts constraints on how we should theorize about forgiveness itself and gives us an additional tool for understanding and navigating our relationships. (shrink)

The study aims at exposing Meinong's ideas that may be of interest to analytic philosophers. It contains all the basic information concerning Meinong's theory of objects with a special focus upon 'objectives', which are Meinong's propositions. Meinong's theory of meaning and his epistemological views are discussed in detail. An outline of his conception of truth, which is classified as firmly realistic, is followed by a review of the critical works touching upon Meinong's epistemological ideas. Finally, Meinong's theory of objects is (...) presented as inspiring the development of Meinongian logics, with his Aussersein as the prototype of an all-inclusive semantic domain. This paper addresses some apparent philosophical tensions between realism and enactivism by means of Charles Peirce’s pragmatism. Enactivism’s Mind-Life Continuity thesis has been taken to commit it to some form of anti-realist ‘world-construction’ which has been considered controversial. Accordingly, a new realist enactivism is proposed by Zahidi (_Phenomenology and the Cognitive Sciences,_ _13_(3), 461–475, 2014 ), drawing on Ian Hacking’s ‘entity realism’, which places subjects in worlds comprised of the things that they can successfully manipulate. We review this attempt, and (...) argue that whilst Zahidi rightly urges enactivists towards ‘internal realism’, he cannot sustain a non-negotiable aspect of realism that is crucial for scientific progress – the claim that multiple subjects inhabit _the same world_. We explore Peirce’s pragmatism as an alternative solution, foregrounding his distinction between existence and reality, and his inquiry-based account of cognition. These theoretical innovations, we argue, fruitfully generalize Zahidi’s _manipulation-based_ enactivist realism to a richer, _inquiry-based_ enactivist realism. We explore how this realism’s pan-species monism about truth encourages and supports the investigation of non-human animal cognition, and conclude by considering some implications of our discussion for long-standing realism debates within pragmatism. Computational explanations focus on information processing required in specific cognitive capacities, such as perception, reasoning or decision-making. These explanations specify the nature of the information processing task, what information needs to be represented, and why it should be operated on in a particular manner. In this article, the focus is on three questions concerning the nature of computational explanations: What type of explanations they are, in what sense computational explanations are explanatory and to what extent they involve a special, “independent” (...) or “autonomous” level of explanation. In this paper, we defend the view computational explanations are genuine explanations, which track non-causal/formal dependencies. Specifically, we argue that they do not provide mere sketches for explanation, in contrast to what for example Piccinini and Craver :283–311, 2011) suggest. This view of computational explanations implies some degree of “autonomy” for the computational level. However, as we will demonstrate that does not make this view “computationally chauvinistic” in a way that Piccinini or Kaplan :339–373, 2011) have charged it to be. (shrink)

By suggesting in The Lily and the Bird that we look to nature's creatures to learn an attunement and responsiveness to our situation as physical creatures subject to finite constraints, Kierkegaard's text comes into dialogue with a form of misalignment portrayed in The Sickness unto Death as a refusal of the given, “the finite,” and “the necessary.” One way of seeking alignment in The Lily (...) and the Bird entails learning to hear and to answer within one's given environment, opening up the possibility of embodied joy. International law holds that states are holistically responsible for their acts. Yet what does the ascription of responsibility to the state imply about the responsibility of its citizens? This article argues that most citizens in a representative democracy bear culpability in association with their state's wrongful acts. Most democratic citizens can be blamed for empowering representatives to act on their behalf, and then failing to adequately oversee and dissent from the specific wrongful decisions their representatives made. Emotion suppression has been found to have negative psychological and social consequences in Western cultural contexts. Yet, in some other cultural contexts, emotion suppression is less likely to have negative consequences; relatedly, emotion suppression is also more common in those East-Asian cultural contexts. In a dyadic conflict study, we aim to conceptually replicate cultural differences found in previous research with respect to the prevalence and consequences of emotion suppression,and extend previous research by testing whether cultural differences are larger for some (...) than for other types of negative emotions. We postulate that cultural differences in suppression are less pronounced for socially engaging emotions than socially disengaging emotions, because the former foster the relationship, whereas the latter emphasize individual goals. Belgian and Japanese couples engaged in a 10-min conflict interaction followed by video-mediated recall, during which participants rated their emotions and emotion suppression every 30 s. As predicted, Japanese participants reported more suppression than their Belgian counterparts, but the cultural difference was more pronounced when participants experienced more socially disengaging emotions than when they experienced more socially engaging emotions. These results suggest that the type of emotion should be considered when describing cultural differences in emotion suppression. Finally, and consistent with previous research, emotion suppression was negatively associated with interaction outcomes in Belgian couples, but not in Japanese couples. (shrink)

What is profoundly under question, especially today, in the aftermath of the pandemic, is on one hand the phenomenon of desire, on the other hand the experience and capability of desiring of the human being. Taking a look at the social situation of the country – recalling first the investigation of the 44th Censis Report 2010, the contents of which in some ways are re-proposed in a naturally volved way in the following one of 2020 –, we are given an (...) image that relaunches our thought owards a need to deepen the ontology of desire and a possible educational pedagogy about it. Our society is depicted as “with no inner desire”: a crisis of desire emerges, in the sense of a crisis about the power of having a vision about the future and capacity of planning with excitement. In this paper, recalling Kant and his transcendental productive imagination as well as the new path of affective neurosciences perspective, going through the Theory of Attachment, I aim at opening a possible way to overcome this impossibility to desire arguing a different hermeneutics in comparison to what the tradition, especially that of J. Lacan, left us about this important and vital faculty of the human being. (shrink)

In this study, we test a number of predictions concerning children's knowledge of the transitive Subject-Verb-Object (SVO) construction between two and three years on one child (Thomas) for whom we have densely collected data. The data show that the earliest SVO utterances reflect earlier use of those same verbs, and that verbs acquired before 2;7 show an earlier move towards adult-like levels of use in the SVO construction and in object argument complexity than later acquired verbs. There is not a (...) close relation with the input in the types of subject and object referents used, nor a close adherence to Preferred Argument Structure (PAS) before 2;7, but both early and late acquired verbs show a simultaneous move towards PAS patterns in selection of referent type at 2;9. The event semantics underpinning early transitive utterances do not straightforwardly fit prototype (high or inalienable) notions of transitivity, but rather may reflect sensitivity to animacy and intentionality in a way that mirrors the input. We conclude that children's knowledge of the transitive construction continues to undergo significant development between 2;0 and 3;0, reflecting the gradual abstraction and integration of the SVO and VO constructions, verb semantics, discourse pragmatics, and the interactions between these factors. These factors are considered in the context of a prototype for the transitive construction. (shrink)

Zusammenfassung Ausgehend von den Erfahrungswerten sechs Klinischer Ethiker*innen an Universitätsklinika in Deutschland wurde eine strukturierte Auseinandersetzung mit dem Arbeitsfeld der Fortbildungen im Rahmen der Klinischen Ethikarbeit vorgenommen. Die Zusammenarbeit wurde von der Fragestellung geleitet, was bei der Konzeption einer Ethik-Fortbildung innerhalb einer Einrichtung zu berücksichtigen ist. Der methodische Zugang zur Beantwortung der explorativen Fragestellung bestand in einem mehrstufigen, deskriptiven Verfahren, das alternierend in gemeinsamen Arbeitssitzungen und individueller Arbeit zwischen den Sitzungen umgesetzt wurde. Als Resultat zeigt der Aufsatz eine Übersicht über (...) die Bandbreite möglicher Fortbildungsformate auf, die denjenigen Hilfestellung bieten kann, die in ihrer Einrichtung Fortbildungen zu ethischen Themen konzipieren und durchführen wollen. Darüber hinaus bietet er einen Überblick über die bei der Umsetzung jeweils zu berücksichtigenden _direkt strukturierenden_ sowie _indirekt strukturierenden_ Merkmale. Es wird an Beispielen aufgezeigt, welche Formatvarianten sich in Kombination mit welchen direkt strukturierenden Merkmalen in den ausgewählten Universitätsklinika bewährt haben. Der Beitrag liefert eine Diskussionsgrundlage, um die strukturierte Auseinandersetzung mit konzeptionellen Fragen ethischer Fortbildung in der Klinik zu befördern. (shrink)

Conscious intentional states are mental states that represent things as being a certain way and do so consciously: they involve a phenomenally conscious representation. For any phenomenally conscious state, there is something it is like for its subject to be in it. The way it is like for a subject to be in a certain phenomenal state is the state’s phenomenal character. According to some authors, phenomenal character has two components: qualitative character (i.e., the “what it is like” component) and (...) subjective character (the “for the subject” component). Elsewhere, I have argued for an acquaintance theory of subjective character: a conscious representation is “for the subject” iff the subject is acquainted with it (Giustina forthcoming). The aim of this paper is to take some initial steps toward developing an acquaintance account of qualitative character. More specifically, I develop an acquaintance-representational account of the qualitative character of conscious intentional states, on which qualitative character is constituted by a subject’s being acquainted with the conscious intentional state’s representational properties. By reviewing the main extant accounts of qualitative character and highlighting their shortcomings, I argue that the acquaintance-representational account is antecedently more plausible than its competitors. A co-actor’s intentionality has been suggested to be a key modulating factor for joint action effects like the joint Simon effect (JSE). However, in previous studies intentionality has often been confounded with agency defined as perceiving the initiator of an action as being the causal source of the action. The aim of the present study was to disentangle the role of agency and intentionality as modulating factors of the JSE. In Experiment 1, participants performed a joint go/nogo Simon task next (...) to a co-actor who either intentionally controlled a response button with own finger movements (agency+/intentionality+) or who passively placed the hand on a response button that moved up and down on its own as triggered by computer signals (agency-/intentionality-). In Experiment 2, we included a condition in which participants believed that the co-actor intentionally controlled the response button with a Brain-Computer Interface while placing the response finger clearly besides the response button, so that the causal relationship between agent and action effect was perceptually disrupted (agency-/intentionality+). As a control condition, the response button was computer controlled while the co-actor placed the response finger besides the response button (agency-/intentionality-). We observed a JSE when the co-actor responded intentionally and the causal relationship between co-actor and action effect could be perceived, but not when the co-actor did not respond intentionally and the causal relationship was disrupted (Experiment 1). When the intentionality of the co-actor was maintained but the perception of the causal relationship between co-actor and action effect destroyed, the JSE was absent (Experiment 2). Our findings clearly indicate a vital role of a co-actor’s agency for the JSE and suggest that the ascription of agency is strongly perceptually grounded. (shrink)

The article analyses reflection as a methodology of Husserl's phenomenology. Husserl used reflection as a method in his research, but did not always specifically consider it when describing his own methodology. He paid much more attention to essential intuition, epoché (reduction) and intentional analysis. The author develops the thesis that reflection is inextricably linked with these methods and requires special study. The article discusses the specifics of reflexive analysis used in Husserl's phenomenology to study consciousness and solve problems of cognition (...) of the external world. The author takes into account its goals and objectives, which determine the terminological apparatus for fixing its results and are based on a certain understanding of the experience of consciousness. Stakeholder maneuvers such as Internet media attacks or consumer boycotts can have devastating effects on companies. By contrary, vital relationships between companies and their stakeholders can be highly beneficial. A review of the existing stakeholder-management literature suggests to engage stakeholders in business activities in a positive manner. However, the types of successful engagement activities differ across industries. The purposes of this article are to develop an explanatory framework based on the literature findings, to introduce stakeholder-engagement literature to a segment of (...) the water sourcing industry, and to unfold industry’s stakeholder-engagement measures. Based on a content analysis of 11 cases, we investigate if and how companies in the natural mineral water bottling industry in Austria inform, communicate, and therefore engage with stakeholders. It became evident that fewer than three of eleven companies published information on sustainability or corporate social responsibility reports, open house days, workshops, or international community activities. Most companies maintained a website for their bottled natural mineral water or communicated quality consciousness. We conclude that most companies in the Austrian mineral water industry could increase their stakeholder-engagement activities to positively respond to challenging business environments. (shrink)

The article discusses the process of “conceptual borrowing”, according to which, when a new discipline emerges, it develops its technical vocabulary also by appropriating terms from other neighbouring disciplines. The phenomenon is likened to Carl Schmitt’s observation that modern political concepts have theological roots. The authors argue that, through extensive conceptual borrowing, AI has ended up describing computers anthropomorphically, as computational brains with psychological properties, while brain and cognitive sciences have ended up describing brains and minds computationally and informationally, as (...) biological computers. The crosswiring between the technical languages of these disciplines is not merely metaphorical but can lead to confusion, and damaging assumptions and consequences. The article ends on an optimistic note about the self-adjusting nature of technical meanings in language and the ability to leave misleading conceptual baggage behind when confronted with advancement in understanding and factual knowledge. This theoretical study focuses on terraforming in the context of the industrially created image of the world by the mainstream media and on philosophical objections to the terraforming activities of humanity. The first part discusses the specific nature of the spectacularism of media images, while the second part explains the paradigmatic change in media images. The third part then turns to the ethically grounded binarism of current philosophical reflections on human expansion into space. The purpose of this study is to (...) consider objections to the mainstream media focus from the viewpoint of contemporary philosophy. The theoretical reflection is based on induction and deduction in order to point out the ambivalence of what humanity can do in the framework of progress in the sense of what it is capable of and in the sense of what is right. In this paper, we wish to explore the role that textual representations play in the creation of new mathematical objects. We do so by analyzing texts by Joseph-Louis Lagrange (1736–1813) and Évariste Galois (1811–1832), which are seen as central to the historical development of the mathematical concept of groups. In our analysis, we consider how the material features of representations relate to the changes in conceptualization that we see in the texts.Against this backdrop, we discuss the idea that new mathematical (...) concepts, in general, are increasingly abstract in the sense of being detached from material configurations. Our analysis supports the opposite view. We suggest that changes in the material aspects of textual representations (i.e., the actual graphic inscriptions) play an active and crucial role in conceptual change.We employ an analytical framework adapted from Bruno Latour’s 1999 account of intertwined material and representational practices in the empirical sciences. This approach facilitates a foregrounding of the interconnection between the conceptual development of mathematics, and the construction, (re-)configuration, and manipulation of the materiality of representations. Our analysis suggests that, in mathematical practice, distinctions between the material and structural features of representations are not permanent and absolute. This problematizes the appropriateness of the distinction between concrete inscriptions and abstract relations in understanding the development of mathematical concepts. (shrink)

This study examined patterns of auxiliary provision and omission for the auxiliaries BE and HAVE in a longitudinal data set from 11 children between the ages of two and three years. Four possible explanations for auxiliary omission—a lack of lexical knowledge, performance limitations in production, the Optional Infinitive hypothesis, and patterns of auxiliary use in the input—were examined. The data suggest that although none of these accounts provides a full explanation for the pattern of auxiliary use and nonuse observed in (...) children's early speech, integrating input-based and lexical learning-based accounts of early language acquisition within a constructivist approach appears to provide a possible framework in which to understand the patterns of auxiliary use found in the children's speech. The implications of these findings for models of children's early language acquisition are discussed. (shrink)

This chapter discusses the theory of international law. In analytic jurisprudence, at least since the latter half of the twentieth century, the primary debate in general jurisprudence has been between legal positivism and its most ardent critic, Ronald Dworkin. The positivist tradition is represented here by its two most important theorists, Hans Kelsen and H.L.A. Hart. During their careers, Kelsen and Hart clashed over the best understanding of legal positivism. For his part, Dworkin devoted the bulk of his critical attention (...) to Hart's work. The chapter also focuses on the way in which each theorist builds his view of international law against the background of a more general jurisprudence. Hart argues that the differences between international law and municipal law might eventually be overcome. International law might be in a stage of transition that will bring it nearer in structure to a municipal system. (shrink)

Background Migrant live-in care workers are a main pillar of long-term care in many countries, including Germany. Several studies examining their working and living conditions reveal serious problems. However, a key element of live-in arrangements, namely the relationship between the individuals involved, has not yet been systematically investigated from an ethical perspective. Aim Building on previous socioempirical work that explored and set out the meaning of “care networks”, we start from the premise that live-ins are embedded in a network of (...) relationships which are essential for their employment and living situation. Methods The theoretical analysis draws on a network approach that takes care–ethical considerations into account. Using Joan Tronto’s four care–ethical phases, existing dependencies are described and reflected upon using the corresponding four care–ethical dimensions. The central questions are how dependencies in the live-in arrangement can be characterised based on the existing body of empirical studies and with a focus on the elements of power, dependency and trust in the ethical reflection on care. Results Based on this analysis, it becomes apparent that the ambivalence resulting from the simultaneity of different forms of asymmetry and mutual dependence is omnipresent in live-in arrangements and gives rise to seemingly contradictory forms of relationships and emotions. Responsibilities are vague and are constantly renegotiated on the basis of implicit assumptions and problematic role expectations and are also assigned without negotiation. Conclusions In the future, it will not only be necessary to better understand and clarify responsibilities at the micro level of the individual care arrangement from the various positions and roles and with a view to the changing processes of caring for another, but also to address the pressing ethical questions and problems in live-in arrangements at the meso and macro levels—enriched by care–ethical perspectives. Gillian Brock’s Justice for People on the Move is an important contribution to the migration literature. While I agree with many of Brock’s arguments, I focus here on a few key points of difference between us. I press three interrelated concerns about Brock’s view: first, the practical implications of her assessment of the state-system’s current illegitimacy remain too unclear. Second, Brock’s human rights-based theory neglects the importance of citizens’ democratic agency, in a way that may have paternalistic implications. Third, Brock’s (...) view is tolerant of inequalities of wealth and power that may enable relations of exploitation, as we see by examining her advocacy of guestworker schemes. The article draws attention to those places where Brock’s view faces hard questions, and explains why I might have answered some of these questions differently. (shrink)

The question of work–family practices commonly arises in both theory and daily practice as a matter of responsibility in today’s organisations. More information is needed about them for socially responsible human resource management. In this article our interest is in how work–family practices, serve as an important element of SR-HRM, constructed as helpful for employees’ work–family integration, are realised in organisational life. We investigate the discursive ways in which members of two different organisations working at different organisational levels construct the (...) issue in the Finnish context. Three discourses were interpreted: a discourse of compliance with external pressure, a discourse of negotiation and a discourse of individual flexibility. Discursive constructions of work–family practices make visible the complex interconnectedness of individuals and organisations with the environment in which they operate. Many organisational efforts to create positive work–family practices can, in fact, lead to failure to make these practices either available or usable, and they may result in the unjust treatment of organisation members. Creating sustainable work–family practices is a complex challenge for which SR-HRM must work out a solution. (shrink)

Mastroianni (bio), Ruth Faden (bio), and Daniel Federman (bio)In recent years, claims have been made by segments of the research community and by women's health advocacy groups that clinical research practices and policies have not benefitted women's health to the same extent as men's health. Central to these claims has been an assertion that women have been inadequately (...) represented as subjects of clinical studies and that as a result neither health conditions unique to women—e.g., menopause—nor women's manifestations of health problems affecting both sexes—e.g., heart disease—have been investigated sufficiently.The scientific community, including federal agencies that sponsor and regulate clinical studies, is increasingly responsive to these claims and is taking steps to raise the level of women's participation in clinical studies. Controversy and concern have surrounded these actions, however. Two of the claims that have been made are: (1) that women are more difficult to study than men because of their cyclical hormonal changes; and (2) that conducting gender-specific subgroup analyses would increase the size of study populations, raise the cost of studies, and thereby reduce the number of studies that could be performed with the limited resources available. In addition, controversy over the inclusion of women of childbearing potential and pregnant women has been particularly salient. Concerns have been expressed about avoiding potential harm to existing or potential fetuses and about the possible legal and financial ramifications of such harm. A further concern involves the perceived difficulties in enrolling women in studies and retaining them for the duration of the studies.Against this backdrop, the Office of Research on Women's Health at the National Institutes of Health (NIH) asked the Institute of Medicine (IOM) in October 1992 to establish the Committee on the Ethical and Legal Issues Relating to the Inclusion of Women in Clinical Studies. The Committee's charge was to: (1) consider the ethical and legal implications of including women, particularly pregnant women and women of childbearing potential, in clinical studies; (2) examine known instances of litigation regarding injuries to research subjects [End Page 55] and describe existing legal liabilities and protections; and (3) provide practical advice on these issues for consideration by NIH, institutional review boards (IRBs), and clinical investigators.The 16 Committee members came from diverse backgrounds: bioethics, law, epidemiology and biostatistics, public health policy, obstetrics and gynecology, clinical research, pharmaceutical development, social and behavioral sciences, and clinical evaluative sciences.1 Chaired by two of the authors of this article, Ruth Faden and Daniel Federman, and coordinated by the third, IOM Study Director Anna Mastroianni, the Committee met five times over a fourteen-month period, convened a one-and-one-half day invitational workshop, and commissioned several background papers. The Committee's deliberations were complicated by the announcement of new federal policies late in its term. Specifically, the Food and Drug Administration (FDA) issued guidelines (FDA 1993) to replace its 1977 guidelines, which prohibited the inclusion of women of childbearing potential in early phases of most clinical drug trials. In addition, Congress passed the NIH Revitalization Act of 1993 (P.L. 103-43), which contains provisions mandating the inclusion of women and racial and ethnic minorities in NIH-sponsored clinical research. In February 1994, the IOM Committee publicly issued its final report and recommendations, Women and Health Research: Ethical and Legal Issues of Including Women in Clinical Studies, publishing the workshop presentations and commissioned papers in a separate volume.Deliberations of the CommitteeA number of issues arose at the outset as the Committee considered its charge. This article is the first to bring into scientific discussion and to provide a historico-philosophical analysis of a manuscript “Neoplatonic Philosophy from the archive of Pamfil Danylovych Yurkevych. The reviewed manuscript belongs to P. D. Yurkevych’s handwritten nachlass stored in the funds of the Institute of Manuscript of V. I. Vernadsky National Library of Ukraine in the city of Kyiv. Additional archival materials are involved to answer several research questions. The author of this article provides arguments in favor of proving (...) that the manuscript is to be attributed to P. D. Yurkevych’s own handwriting, to be dated circa 1856, and that the purposing of its content is to be qualified as didactic. As it is established in the article, textual content of the manuscript in question is an original concise description and analysis of neoplatonic philosophy, which belongs to the set of materials created by P. D. Yurkevych in preparation for teaching the course on Ancient Philosophy in Kyiv Theological Academy during Kyivan period of his work. Turning to the inner critique of the manuscript, author of this article emphasizes an analysis that P. D. Yurkevych conducts concerning Plotinus’s ideas of the process of emanation of the world from the One and the role that philosophy has in true cognition. While comparing the manuscript “Neoplatonic Philosophy” with one of P. D. Yurkevych’s substantial philosophical works “Idea”, additional light is shed upon the prosess of genesis and development of Christian-Platonic worldview of the thinker. Furthermore, it is established that the manuscript in question played a major role in P. D. Yurkevych’s own schooling, particulary concerning his view on the philosophy of Plotinus, and his general reception of the Platonic tradition. (shrink)

Human and automated tutors attempt to choose pedagogical activities that will maximize student learning, informed by their estimates of the student's current knowledge. There has been substantial research on tracking and modeling student learning, but significantly less attention on how to plan teaching actions and how the assumed student model impacts the resulting plans. We frame the problem of optimally selecting teaching actions using a decision-theoretic approach and show how to formulate teaching as a partially observable Markov decision process planning (...) problem. This framework makes it possible to explore how different assumptions about student learning and behavior should affect the selection of teaching actions. We consider how to apply this framework to concept learning problems, and we present approximate methods for finding optimal teaching actions, given the large state and action spaces that arise in teaching. Through simulations and behavioral experiments, we explore the consequences of choosing teacher actions under different assumed student models. In two concept-learning tasks, we show that this technique can accelerate learning relative to baseline performance. (shrink)

In this paper, I revisit Kimberlé Crenshaw's argument in “Demarginalizing the Intersection of Race and Sex” (1989) to recover a companion metaphor that has been largely forgotten in the “mainstreaming” of intersectionality in (white-dominated) feminist theory. In addition to the now-famous intersection metaphor, Crenshaw offers the basement metaphor to show how—by privileging monistic, mutually exclusive, and analogically constituted categories of “race” and “sex” tethered, respectively, to masculinity and whiteness—antidiscrimination law functions to reproduce social hierarchy, rather than to remedy it, denying (...) Black women plaintiffs legal redress. I argue that in leaving the basement behind, deployments of “intersectionality” that deracinate the concept from its origins in Black feminist thought also occlude Crenshaw's account of the socio-legal reproduction of hierarchical power. Observational studies have suggested that some nonhuman primates’ cooperative behavior may rely on their capacity to share goals and understand the role of their partners. Experimental studies have tried to find evidence for this under controlled conditions, investigating aspects like the degree of organization in different primate species and the individuals’ capacity to recognize and choose good partners, switch roles with them, and care about their outcomes. Often, the results have been mixed. Partly, this is because of the methodological difficulties (...) inherent to empirical research. In this paper, I offer a critical, methodological review of the experimental studies done in the last years on nonhuman primates’ cooperation, I discuss their findings, and suggest possible solutions to some of the procedural problems. Hopefully, this will contribute to improve the design of future studies and therefore our knowledge about the evolutionary history of cooperation. (shrink)

This article proposes an innovative methodology for enhancing the technical validation, legal alignment and interdisciplinarity of attempts to encode legislation. In the context of an experiment that examines how different legally trained participants convert select provisions of the Australian Copyright Act 1968 (Cth) into machine-executable code, we find that a combination of manual and automated methods for coding validation, which focus on formal adherence to programming languages and conventions, can significantly increase the similarity of encoded rules between coders. Participants nonetheless (...) encountered various interpretive difficulties, including syntactic ambiguity, and intra- and intertextuality, which necessitated legal evaluation, as distinct from and in addition to coding validation. Many of these difficulties can be resolved through what we call a process of ‘legal alignment’ that aims to enhance the congruence between encoded provisions and the true meaning of a statute as determined by the courts. However, some difficulties cannot be overcome in advance, such as factual indeterminacy. Given the inherently interdisciplinary nature of encoding legislation, we argue that it is desirable for ‘rules as code’ (‘RaC’) initiatives to have, at a minimum, legal subject matter, statutory interpretation and technical programming expertise. Overall, we contend that technical validation, legal alignment and interdisciplinary teamwork are integral to the success of attempts to encode legislation. While legal alignment processes will vary depending on jurisdictionally-specific principles and practices of statutory interpretation, the technical and interdisciplinary components of our methodology are transferable across regulatory contexts, bodies of law and Commonwealth and other jurisdictions.
