We propose a revised definition of “argument scheme” that focuses on describing argumentative performances and normative assessments that occur within an argumentative context, the social context in which the scheme arises. Our premise-and-conclusion structure identifies the typical instantiation of an argument in the argumentative context, and our critical framework describes a set of normative assessments available to participants in the context, what we call _practically normative_ assessments. We distinguish this practical normativity from the _rationally or universally normative_ assessment that might (...) be imposed from outside the argumentative context. Thus, the practical norms represented in an argument scheme may still be subject to rational critique, and the scheme avoids the is/ought fallacy. We ground our theoretical discussion and observations in an empirical study of US district court opinions resolving legal questions about copyright fair use and the lawyers’ briefs that led to them, instantiating our definition of argument scheme in the “argument for classification by precedent.” Our definition addresses some criticisms the argument-scheme construct has received. For example, using our data, we show that a minimally well formed instance of this type of argument does not shift any conventional burden from the proponent of the argument to its skeptics. Following the warm reception given to The Idea of Education, a volume of papers in this same Rodopi Series, a second conference around similar themes was held at Oxford University and this book is the result. This edited book provides the reader with a fairly representative, coherent and cohesive statement of the 2003 Oxford conference. Quoting the Chancellor of Paris University with regretting that “in the old days … lectures were more frequent … but now the time taken for lectures (...) is being spent in meeting and discussions” our keynote Frank McMahon made the profound observation that some of the issues around education have been with us for a surprisingly long time. Notwithstanding the longevity of some questions concerning education, this book details and examines contemporary educational practice and theory and as such it is a very important work. (shrink)

Most early studies of consciousness have focused on human subjects. This is understandable, given that humans are capable of reporting accurately the events they experience through language or by way of other kinds of voluntary response. As researchers turn their attention to other animals, “accurate report” methodologies become increasingly difficult to apply. Alternative strategies for amassing evidence for consciousness in non-human species include searching for evolutionary homologies in anatomical substrates and measurement of physiological correlates of conscious states. In addition, creative (...) means must be developed for eliciting behaviors consistent with consciousness. In this paper, we explore whether necessary conditions for consciousness can be established for species as disparate as birds and cephalopods. We conclude that a strong case can be made for avian species and that the case for cephalopods remains open. Nonetheless, a consistent effort should yield new means for interpreting animal behavior. Frankfurt cases are purported counterexamples to the Principle of Alternative Possibilities, which implies that we are not morally responsible for unavoidable actions. A major permutation of the counterexample strategy features buffered alternatives; this permutation is designed to overcome an influential defense of the Principle of Alternative Possibilities. Here we defend the buffering strategy against two recent objections, both of which stress the timing of an agent’s decision. We argue that attributions of moral responsibility aren’t time-sensitive in the way the objectors (...) suppose. We then turn to the crucial question of when an action is relevantly avoidable—when, in the parlance of the literature, an alternative possibility is robust. We call attention to two plausible tests for robustness that merit further consideration, showing that the agents in buffered Frankfurt cases don’t pass these tests, despite being morally responsible for their actions. One (...) of the theses of the book is that, although canonical philosophers like Descartes and Malebranche hold that it is in some sense the latter that is our true self, and although they expend a significant amount of their corpus trying to help us to touch base with it, they also offer well-developed and insightful views about our embodiment and about what we are to do as embodied beings. Another thesis of the book is that, even if early modern philosophers tend to think that we have unimpeded and transparent access to our psychological states after we have done enough reflection to keep our embodiment from restricting the view, a concomitant position in the period is that we otherwise have very little self-knowledge. A related thesis is that important elements of the psychoanalytic tradition of Freud and Lacan can be traced back to philosophers like Descartes and Malebranche and to the investigations that they inspire in their contemporaries and successors. The book is ambitious and is an extremely interesting and important contribution.Descartes holds that as a result of the bad habits of childhood we come to misrepresent external bodies as having qualities like color, smell, taste, and sound. Building on the work of volume one, Moriarty (5, 335–36, 372–73, 243–44) reminds us that Descartes also holds that we come to misrepresent our minds as in part tangible and corporeal (the Second Meditation, Second Replies) and that the Cartesian project of clarifying ideas is not restricted to the ideas of natural science. Indeed, Moriarty could also cite Descartes’s remark that there are circumstances in which we might report that we are thinking of our selves when in fact we are only thinking of our bodies (Principles of Philosophy I:12). Descartes seems to allow that if we are not sufficiently reflective and observant, our thinking is not transparent to us, and if so he is leaving open the view that we can mischaracterize our own psychological states. Descartes does not speak explicitly to this kind of mischaracterization, but in later writings (especially Passions of the Soul and the letters to Princess Elizabeth) he does speak to the importance of clearly defining the passions and distinguishing them, and to the importance of knowing the relationships between brain traces and particular passions so that we can understand our motivations and get a better handle on them (315). Moriarty then brings to the table a number of figures who develop these positions. In Nicole, we find the view that, from the first-person perspective, it can be very difficult to distinguish acting from charity and acting from self-love, and that we have a considerable interest in identifying ourselves as acting from the former (219–24). In La Rochefoucauld, we find the view that friendship is often a matter of wanting to see a certain image of ourselves reflected in and confirmed by others and that true friendship is very rare (243). We might focus on figures like Nicole insofar as they engage the more traditional questions of metaphysics and epistemology, but issues of embodiment and self-knowledge were also front and center in the early modern period, and the contributions of Nicole, Lamy, La Rochefoucauld, and Senault (just to name just a few) are enormous.Another strength of the book is that it highlights the systematic nature of early modern work on self-knowledge. For example, Moriarty not only considers the empirical psychology of thinkers like Nicole and Lamy, but also shows how their results are grounded in fully articulated views of habit, language, and imagination (361–63, 371–74). Which systems/organisms are conscious? New tests for consciousness (‘C-tests’) are urgently needed. There is persisting uncertainty about when consciousness arises in human development, when it is lost due to neurological disorders and brain injury, and how it is distributed in nonhuman species. This need is amplified by recent and rapid developments in artificial intelligence (AI), neural organoids, and xenobot technology. Although a number of C-tests have been proposed in recent years, most are of limited use, and currently we have no (...) C-tests for many of the populations for which they are most critical. Here, we identify challenges facing any attempt to develop C-tests, propose a multidimensional classification of such tests, and identify strategies that might be used to validate them. (shrink)

The standard behavioral index for human consciousness is the ability to report events with accuracy. While this method is routinely used for scientific and medical applications in humans, it is not easy to generalize to other species. Brain evidence may lend itself more easily to comparative testing. Human consciousness involves widespread, relatively fast low-amplitude interactions in the thalamocortical core of the brain, driven by current tasks and conditions. These features have also been found in other mammals, which suggests that consciousness (...) is a major biological adaptation in mammals. We suggest more than a dozen additional properties of human consciousness that may be used to test comparative predictions. Such homologies are necessarily more remote in non-mammals, which do not share the thalamocortical complex. However, as we learn more we may be able to make “deeper” predictions that apply to some birds, reptiles, large-brained invertebrates, and perhaps other species. (shrink)

The metacognitive stance of Smith et al. risks ignoring sensory consciousness. Although Smith et al. rightly caution against the tendency to preserve the uniqueness of the human mind at all costs, their reasoned stance is undermined by a selective association of consciousness with high-level cognitive operations. Neurobiological evidence may offer a more general, and hence more inclusive, basis for the systematic study of animal consciousness.

Institutional guidelines for transgender children and adolescent minors fail to adequately address a critical juncture of care of this population: how to proceed if a minor and their parents have disagreements concerning their gender-affirming medical care. Through arguments based on ethical, paediatric, adolescent and transgender health research, we illustrate ethical dilemmas that may arise in treating transgender and gender diverse youth. We discuss three potential avenues for providing gender-affirming care over parental disagreement: legal carve-outs to parental consent, the mature minor (...) doctrine and state intervention for neglect. Our discussion approaches this parent–child disagreement in a manner that prioritises the developing autonomy of transgender youth in the decision-making process surrounding medically assisted gender affirmation. We base our arguments in the literature surrounding the risks and benefits of gender-affirming therapy in transgender children and the existing legal basis for recognising minors’ decision-making authority in certain medical situations. Before a general cognitive model for recurrent complex visual hallucinations (RCVH) is accepted, there must be more research into the neuropsychological and cognitive characteristics of the various disorders in which they occur. Currently available data are insufficient to distinguish whether the similar phenomenology of RCVH across different disorders is in fact produced by a single or by multiple cognitive mechanisms.

Biological ontologies are used to organize, curate, and interpret the vast quantities of data arising from biological experiments. While this works well when using a single ontology, integrating multiple ontologies can be problematic, as they are developed independently, which can lead to incompatibilities. The Open Biological and Biomedical Ontologies Foundry was created to address this by facilitating the development, harmonization, application, and sharing of ontologies, guided by a set of overarching principles. One challenge in reaching these goals was that the (...) OBO principles were not originally encoded in a precise fashion, and interpretation was subjective. Here we show how we have addressed this by formally encoding the OBO principles as operational rules and implementing a suite of automated validation checks and a dashboard for objectively evaluating each ontology’s compliance with each principle. This entailed a substantial effort to curate metadata across all ontologies and to coordinate with individual stakeholders. We have applied these checks across the full OBO suite of ontologies, revealing areas where individual ontologies require changes to conform to our principles. Our work demonstrates how a sizable federated community can be organized and evaluated on objective criteria that help improve overall quality and interoperability, which is vital for the sustenance of the OBO project and towards the overall goals of making data FAIR.
