Unter den Befürwortern dieses Verfahrens ist allerdings u. a. strittig, wieweit Sterbefasten als eine „passive“ Form von Suizid gelten kann. Auf dem Hintergrund der WHO-Definition des Suizids verteidigt der Beitrag eine affirmative Antwort und (...) diskutiert, wieweit sich daraus Konsequenzen für die ethische Beurteilung des Sterbefastens ergeben. Is causal analysis an appropriate method to discover causal laws? Some prerequisites for any successful application of mathematical causal models are worked out and discussed. It can be shown that these prerequisites cannot be fulfilled by present models and there are strong reasons to assume that they cannot be satisfied by any model. Therefore causal analysis will probably be of no importance for the discovery of causal laws in sociology.

The focus of this book is on conceptual and philosophical issues of perception including the classic notion of unconscious inferences in perception. The book consists of contributions from a group of internationally renowned researchers who spent a year together as distinguised fellows at the German Centre for Advanced Study.

Kontrovers ist insbesondere die begriffliche Einordnung der Kombination von terminaler Sedierung und Behandlungsabbruch sowie die Frage nach den dafür einschlägigen ethischen Kriterien. Ausgehend von einer Analyse von drei Szenarien mit unterschiedlicher kausaler Rollenverteilung argumentiere ich dafür, den Standardfall der Kombination von terminaler Sedierung und Behandlungsabbruch unter die (...) Kategorie der „passiven Sterbehilfe“ zu subsumieren und für sie dieselben ethischen Kriterien wie für den Behandlungsabbruch allein gelten zu lassen. Eine tentative vergleichende Bewertung ergibt, dass die terminale Sedierung als ultima ratio der Leidensminderung am Lebensende gegenüber der Alternative des assistierten Suizids insgesamt als ethisch vorzugswürdig gelten sollte, ohne jedoch die Alternative des assistierten Suizids als in toto unzulässig erscheinen zu lassen. Though Krause was not the first to talk of animal rights in the history of animal ethics, his theory of animal rights is pathbreaking in embedding a conception of animal rights in an all-encompassing metaphysical system. DBS Think Tank IX was held on August 25–27, 2021 in Orlando FL with US based participants largely in person and overseas participants joining by video conferencing technology. The DBS Think Tank was founded in 2012 and provides an open platform where clinicians, engineers and researchers can freely discuss current and emerging deep brain stimulation technologies as well as the logistical and ethical issues facing the field. The consensus among the DBS Think Tank IX speakers was that DBS expanded in (...) its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. After collectively sharing our experiences, it was estimated that globally more than 230,000 DBS devices have been implanted for neurological and neuropsychiatric disorders. As such, this year’s meeting was focused on advances in the following areas: neuromodulation in Europe, Asia and Australia; cutting-edge technologies, neuroethics, interventional psychiatry, adaptive DBS, neuromodulation for pain, network neuromodulation for epilepsy and neuromodulation for traumatic brain injury. In der Einleitung zu Kerstings und Essers Target-Artikel fällt ein Stichwort, das mir in mehrfacher Hinsicht für den gegenwärtigen Stand des Nachdenkens über Sterben und Tod bezeichnend zu sein scheint: Pluralisierung der Todesbilder. Pluralisierung ist eine Herausforderung für jede einzelne der drei Fragestellungen des Artikels. In Bezug auf den Todesbegriff stellt sich die Frage, ob es einen – und nur einen – verbindlichen Begriff des Todes geben kann oder sollte; in Bezug auf das Verständnis des Todes als anthropologisches Grunddatum stellt (...) sich die Frage, ob es eine – und nur eine – gültige sinnverleihende Interpretation des Phänomen des Todes geben kann oder sollte; hinsichtlich des praktischen Umgangs mit dem Tod – dem eigenen wie dem anderer – stellt sich die Frage, ob sich bei aller kulturellen Diversität ein Katalog von basalen Normen findet, für den sich Allgemeinverbindlichkeit beanspruchen lässt. Wie viel Pluralismus ist notwendig, um der faktischen Vielfalt gerecht zu werden? Wie viel ist möglich, ohne Beliebigkeit und Orientierungslosigkeit heraufzubeschwören? Die Antworten der Autoren zeigen, dass sie in der Zulassung von Pluralismus zumeist das rechte Maß finden. Bei einigen scheinen sie mir allerdings zu weit zu gehen, bei anderen wiederum zu wenig weit. (shrink)

One moot point in bioethical debates about genetic testing concerns the conditions that have to be fulfilled to make individual genetic testing or individual participation in genetic screening programs truly voluntary. Though there is a relatively broad consensus about the non-viability of views on the extremes of the spectrum of opinions, there is considerable disagreement in the middle. This mirrors the difficulties in defining satisfactory demarcation lines between autonomous choice, pressured choice and coercion in cases in which the decision to (...) participate is triggered, wholly or partly, by factors such as material incentives, urgent health needs, massive social expectations, or moral pressure from relatives. In this contribution, some of the semantic conditions and ethical principles concerning coercion are explored with a view to applying them to genetic testing, especially in the context of insurance and participation in clinical trials. Der Utilitarismus ist die am weitesten ausgearbeitete und – u. a. auch deshalb – seit etwa einem Jahrhundert international meistdiskutierte Variante einer konsequenzialistischen Ethik, d. h. einer Ethik, nach der die moralische Richtigkeit und Falschheit von Handlungen ausschließlich von ihren Folgen abhängt. Handlungsbeurteilungen sind danach zweiteilig. Zunächst sind die Folgen axiologisch oder werttheoretisch, d. h. danach zu beurteilen, wie weit sie als gut oder schlecht, wünschenswert oder vermeidenswert zu bewerten sind; sodann ist die Handlung normativ oder deontisch danach zu beurteilen, (...) wie weit sie auf dem Hintergrund der Folgenbewertung als moralisch geboten, erlaubt oder verboten gelten muss. One of the standard criticisms of classical utilitarian is that it is unable to provide an adequate ethical foundation for the wrongness of killing. It is reasoned that the five arguments against killing available to the classical utilitarian are indeed sufficient to provide such a foundation and that recourse to preference utilitarianism is neither called for nor helpful since it generates a number of problems of its own. On this basis, Singer’s discussion of selective abortion and the selective euthanasia of (...) newborns is criticized from within utilitarianism for not giving sufficient weight to direct and indirect social side-effects, especially if ‘external’ criteria are introduced into the valuation of human life. Seit Benthams Spott über die Menschen- und Bürgerrechte als „Unsinn auf Stelzen“ gilt es als ausgemacht, dass das zentrale Stück des Grundgesetzes, die Grundrechte, und der Utilitarismus nur schwer zusammenkommen können. Auch wenn prima facie strukturelle wie inhaltliche Gründe gegen den Versuch sprechen, beide miteinander vollständig vereinbar machen zu wollen, weist der Beitrag auf mehrere Punkte hin, an denen sich die Grundrechte und der Utilitarismus zur Deckung bringen lassen.

This contribution offers an introduction into the language of rights and the role rights play in ethics and law; with special reference to the rights of children. It emerges that there are a number of very different functions characteristic of 'rights talk'; both in ethics and law; and that many of them offer opportunities for strengthening appeals to moral and legal principles while others involve pitfalls that should be avoided. In conclusion; two of the theoretical questions raised by rights are (...) addressed: whether the concept of rights can be replaced without loss by the concept of obligation; and whether rights should be seen as social constructs derived from obligations; or whether it is more plausible to reverse the order of priority. First I argue that the prohibition of linguistic self-reference as a solution to the antinomy problem contains a pragmatic contradiction and is thus not only too restrictive, but just inconsistent (chap.1). Furthermore, the possibilities of non-restrictive strategies for antinomy avoidance are discussed, whereby the explicit inclusion of the – pragmatically presuposed – consistency requirement proves to be the optimal strategy (chap.2). The central question here is that about the actual reason for antinomic structures. It turns out to be a form (...) of negative self-conditioning (chap.3). This makes it necessary to clarify the status of negative concepts (chap.4). The generalization of these considerations (chap.5) leads to the actual analysis of the antinomic basic structure (chap.6): Decisively for the pragmatics of the concept is that it positively owns a meaning, so that positivity is always constituted by the concept qua concept. Thus a negative concept is characterized by a fundamental ambivalence: From a semantic point of view it has negative character, in its pragmatic status as a concept, however, it has positive character. If the meaning is especially that of a negative self-reference, the ambivalence leads to the antinomic constellation of a negative self-condition – that is the crux of the matter here! The concept thus possesses the property defined by it exactly when it does not possess it and vice versa. A closer analysis shows that the function of reflective structures for the occurrence of antinomies has to be judged much more differentiated than previous opinions suggest. Not only are four forms of reflectivity to be distinguished in this context – ontic, semantic, pragmatic reflectivity, and especially the form of negative self-condition; but it is also apparent that these are intertwined with each other in a way that is difficult to be understood. The astonishing variety of relationships associated with this makes the irritation that has always emanated from the antinomy problem appear more comprehensible. In the developed pragmatic perspective furtheron parallels to the structure of self-consciousness become visible (chap.7). I conclude with considerations about the significance of the antinomic structure for the problem of dialectics, especially for the synthesis formation of mutually exclusive terms (chap.8). ---------- Zunächst wird gezeigt, dass das Verbot sprachlicher Selbstreferenz als Lösung des Antinomienproblems einen pragmatischen Widerspruch enthält und damit nicht nur zu restriktiv, sondern geradezu inkonsistent ist (Kap.1). Ist die Bedeutung insbesondere die eines negativen Selbstbezugs, führt die Ambivalenz zur antinomischen Konstellation einer negativen Selbst-Bedingung – das ist hier der springende Punkt! Der Begriff besitzt so die durch ihn definierte Eigenschaft genau dann, wenn er sie nicht besitzt und umgekehrt. Die nähere Analyse zeigt, dass hierbei die Funktion reflexiver Strukturen für das Auftreten von Antinomien weitaus differenzierter zu beurteilen ist, als bisherige Auffassungen nahelegen. Nicht nur dass in diesem Kontext vier Formen von Reflexivität – ontische, semantische, pragmatische Reflexivität und insbesondere auch die Form negativer Selbstbedingung – unterschieden werden müssen; es zeigt sich auch, dass diese in schwer durchschaubarer Weise ineinander verschränkt sind. Die damit verbundene erstaunliche Beziehungsvielfalt läßt die Irritation, die seit je vom Antinomienproblem ausging, begreiflicher erscheinen. In der entwickelten pragmatischen Perspektive werden ferner Parallelen zur Struktur von Selbstbewußtsein sichtbar (Kap.7). We consider a proportional-prize contest to forecast future events, and show that, in equilibrium, this mechanism possesses perfect forecasting ability for any group size when the contestants share common knowledge about the probabilities by which future events realize. Data gathered in a laboratory experiment confirm the performance invariance to group size. By contrast, when realization probabilities are not common knowledge, there are some differences across group sizes. The mechanism operates marginally better with three or four compared to two players. However, (...) this effect is mainly driven by players’ behavior rather than by differences in the beliefs they form about the realization probabilities. (shrink)

Electrifying when first delivered in 1973, legendary in the years since, Dieter Henrich's lectures on German Idealism were the first contact a major German philosopher had made with an American audience since the onset of World War II. They remain one of the most eloquent explanations and interpretations of classical German philosophy and of the way it relates to the concerns of contemporary philosophy. Thanks to the editorial work of David Pacini, the lectures appear here with annotations linking them (...) to editions of the masterworks of German philosophy as they are now available. Henrich describes the movement that led from Kant to Hegel, beginning with an interpretation of the structure and tensions of Kant's system. He locates the Kantian movement and revival of Spinoza, as sketched by F. H. Jacobi, in the intellectual conditions of the time and in the philosophical motivations of modern thought. Providing extensive analysis of the various versions of Fichte's Science of Knowledge, Henrich brings into view a constellation of problems that illuminate the accomplishments of the founders of Romanticism, Novalis and Friedrich Schlegel, and of the poet Hölderlin's original philosophy. Wer kennt GOTTLOB FREGE (1848-1925)? Nur wenige verbinden mit seinem Namen einen der groaten Logiker aller Zeiten, ohne dessen "Logik von Funktion und Argument" die heutige Computertechnik kaum denkbar ist. Frege fuhlte sich zeitlebens zu seiner Heimat im Norden Deutschlands hingezogen. In Wismar verbrachte er seine Kindheit und in Bad Kleinen, in unmittelbarer Nahe, seinen Lebensabend. Das im Jahre 2000 gegrundete Gottlob-Frege-Zentrum der Hochschule Wismar organisierte ihm zu Ehren im Mai 2013 in seiner Geburtsstadt eine internationale Konferenz, an der Forscher (...) aus der mathematischen Grundlagenforschung und der Analytischen Philosophie teilnahmen. Im Konferenzband erfahren Sie von bekannten Wissenschaftlern u.a., begin{itemize} item was Frege zur Entwicklung der Mathematik, Logik und Philosophie leistete, item welche wissenschaftlichen Auffassungen Frege vertrat und welche er scharf kritisierte, item mit welchen bekannten Wissenschaftlern Frege korrespondierte und wer sein Werk fortsetzte oder in Frage stellte, item was wir heute noch aus Freges Arbeiten lernen konnen. Den an den gewaltigen Umwälzungen unserer Zeit Interessierten bewegen heute in erster Linie die Probleme des sozialen Wandels - oder besser des dringend not wendigen Umbaus unserer Welt. Erst dahinter tritt seit einiger Zeit die Forderung nach dem Umbau des Menschen auf 1. Sie ist von der öffentlichkeit noch relativ wenig beachtet und offenbar als unangenehm fast tabuiert. Von den die Frage initiierenden Biologen ist diese Forderung aber durchaus ernst gemeint. Ihre Ten denz ist radikal. Außerhalb dieser Tendenz laufen aber (...) bereits unentwegt Prozesse, die zuerst Eingriff in die Physis und Psyche des Menschen, dann eben doch schon Veränderung bedeuten oder bedeuten können. Der Massenausstoß von Chemikalien bis ins Trinkwasser und in die Zahnpasta hinein und die permanente massenhafte Massenbeeinflussung teilgeplanter Art, zum Beispiel durch Werbung, deren Wirkung (besonders insgesamt!) völlig unbekannt ist, ist damit gemeint. Hier setzt unser Interesse ein. Die Idee einer Veränderung des Menschen ist einmal überhaupt bewegend. Zum anderen gilt ihr deshalb unser Fachinteresse, weil eine an der Kulturanthropologie und der sogenannten Philosophischen Anthropologie orientierte Soziologie durch die Behauptung und Verbreitung des Konzeptes von der »Offenheit« und »Plasti zität«, der unbegrenzten Beeinflußbarkeit und Lernfähigkeit des Menschen, zu sammen mit einer untheoretischen Evolutionstheorie erst den Hintergrund für die Idee der Möglichkeit eines »Umbaus« des Menschen geliefert hat. Ist der Mensch total offen, nicht festgelegt, dann kann er auch beliebig angepaßt werden. (shrink)
