Entre 1822 et 1824, Micaela Mutis, nièce de Don José Celestino Mutis, mène une intense bataille juridique contre son mari pour obtenir la garde de son enfant illégitime et revendiquer ses droits de citoyenne dans la nouvelle République de Colombie ; paradoxalement, elle est condamnée par le nouvel État en vertu des lois de l’Empire espagnol récemment abandonné. Ce cas, découvert et analysé par l’historienne Aída Martínez Carreño, souligne la nécessité de réinterpréter le rôle des femmes dans l’historiographie colombienne ainsi (...) que la relation entre la vie privée et la vie publique et politique de nombre d’entre elles, qui ont été encouragées à devenir citoyennes grâce à leur engagement pour la cause patriotique. Ces dernières années, des chercheuses tels que Judith González et Martha Lux ont contribué à l’histoire des femmes en Colombie avec des résultats qui discutent et démontrent une fois de plus que le rôle joué par les femmes à cette époque est loin du rôle passif que l’historiographie traditionnelle, majoritairement masculine, leur avait accordé. En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. Este paper examina en detalle el marco constitucional dispuesto en 1991 para la protección del medio ambiente y la configuración del Estado colombiano frente a los nuevos retos que plantea la protección ambiental. Lo anterior, a partir de dos elementos claves para entender el papel de los mecanismos jurídicos en la defensa de la naturaleza y el ambiente: la participación ambiental y el acceso a la justicia ambiental, ello, con el fin de conocer los instrumentos que reconfiguran el Estado para (...) que la ciudadanía y las organizaciones sociales puedan ejercer una defensa jurídica del medio ambiente, que aporte a la construcción de la justicia ambiental. La prevención en materia ambiental, como concepto y principio, es una opción eficaz para aplicar el principio ético de responsabilidad esbozado por Hans Jonas, que propugna por un tratamiento responsable del ambiente de cara a su preservación para las generaciones venideras. En este sentido, la prevención es también un mecanismo de gestión que le da a cada riesgo ambiental el tratamiento particular que se merece, dadas sus características, premura e incluso potencial impacto en lo social, económico y ambiental. En el presente artículo se presenta el panorama y algunos de los más importantes avances que en Colombia se han dado en materia ambiental desde la Constitución Política de 1991. La metodología llevada a cabo es descriptiva y analítica, en tanto se estudian no sólo las normas sino las sentencias más relevantes que se han constituido en un hito en la protección de los derechos ambientales. En tal sentido, lo que se pretende evidenciar es la existencia de un panorama de (...) constitucionalización de los derechos ambientales con signicativos avances tales como el rol preponderante que ha adquirido el principio de precaución o el reconocimiento de la función ecológica de la propiedad. El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. Casi todo lo que nos rodea implica riesgos de algún tipo, aunque no obstante es la cultura del riesgo la que ha coadyuvado al progreso y el desarrollo de la sociedad. El principio de precaución que no es ajeno a esta realidad, responde a la incertidumbre del riesgo, sin limitarse a expresar una actitud subjetiva del miedo. Es, un medio eficaz para la protección, en todo momento y de manera oportuna, de los recursos naturales, para así alcanzar el fin de (...) las normas ambientales. Este libro colectivo constituye a través de una juiciosa recopilación de experiencias de derecho comparado, y de un diálogo en torno a las tensiones que se dan, un llamado de atención para repensar el principio de precaución. El tratamiento de estas cuestiones por parte de los autores, tuvo por norte el equilibrio entre el desarrollo de la sociedad y la salvaguarda de los derechos que podrían afectarse por una situación de riesgo inminente; siempre de cara a la rigurosidad exigida por la ciencia. Esta obra permite al lector contar con valiosas herramientas para realizar una evaluación amplia del alcance actual del principio de precaución, tema que debe tener continuidad en pro de un mejor entendimiento de la gestión del riesgo y de las complejas circunstancias de la invocación y aplicación del principio que debe estar presente en la formulación de las políticas ambientales, dado que las autoridades y los particulares ante la falta de certeza científica absoluta, para impedir la degradación ambiental, deberán darle aplicación cuando exista peligro de daño grave e irreversible como lo establece la legislación colombiana (artículo 1 Ley 99 de 1993). El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera (...) de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. AI systems play an increasingly important role in shaping and regulating the lives of millions of human beings across the world. Calls for greater _transparency_ from such systems have been widespread. However, there is considerable ambiguity concerning what “transparency” actually means, and therefore, what greater transparency might entail. While, according to some debates, transparency requires _seeing through_ the artefact or device, widespread calls for transparency imply _seeing into_ different aspects of AI systems. These two notions are in apparent tension with (...) each other, and they are present in two lively but largely disconnected debates. In this paper, we aim to further analyse what these calls for transparency entail, and in so doing, clarify the sorts of transparency that we should want from AI systems. We do so by offering a taxonomy that classifies different notions of transparency. After a careful exploration of the different varieties of transparency, we show how this taxonomy can help us to navigate various domains of human–technology interactions, and more usefully discuss the relationship between technological transparency and human agency. We conclude by arguing that all of these different notions of transparency should be taken into account when designing more ethically adequate AI systems. (shrink)

Nomy Arpaly rejects the model of rationality used by most ethicists and action theorists. Both observation and psychology indicate that people act rationally without deliberation, and act irrationally with deliberation. By questioning the notion that our own minds are comprehensible to us--and therefore questioning much of the current work of action theorists and ethicists--Arpaly attempts to develop a more realistic conception of moral agency.

Extended cognition brings with it a particular phenomenology. It has been argued that when an artifact is integrated into an agent’s cognitive system, it becomes transparent in use to the cognizing subject. In this paper, I challenge some of the assumptions underlying how the transparency of artifacts is described in extended cognition theory. To this end, I offer two arguments. First, I make room for some forms of conscious thought and attention within extended cognitive routines, and I question the close (...) association drawn between attention and effort. Second, I vindicate the importance of paying careful attention to individual differences and the diverse ways in which bodies and technologies can be experienced. I end by offering some hints toward an alternative, and more accurate, account of the phenomenology of extended cognition. (shrink)

According to the Extended knowledge dilemma, first formulated by Clark (Synthese 192:3757–3775, 2015) and subsequently reformulated by Carter et al. (in: Carter, Clark, Kallestrup, Palermos, Pritchard (eds) Extended epistemology, Oxford Univer- sity Press, Oxford, pp 331–351, 2018a), an agent’s interaction with a device can either give rise to knowledge or extended cognition, but not both at the same time. The dilemma rests on two substantive commitments: first, that knowledge by a subject requires that the subject be aware to some extent (...) of some features of that knowledge’s sources and, second, that cognitive processes can only be extended if the subject is mostly unaware of the external object. The overwhelming response to the dilemma by proponents of extended knowledge has been to reconcile the demands of knowl- edge with the requirement that genuine extended cognition must lack any conscious encountering of the external artifact that features in the putative extended cognitive process. My approach, thus far unexplored, will be the opposite: I show how extended cognition can be made compatible with a wide range of agential attitudes, including an active form of epistemic hygiene. Consequently, I open the door for a new way of vindicating the possibility of extended knowledge, and call into question some assumptions that lie at the core of extended cognition theory. (shrink)

In this chapter, I propose a new framework for extended epistemology, based on a second-wave approach to extended cognition. The framework is inclusive, in that it takes into account the complex interplay between the diverse embodiments of extended knowers and the salient properties of technological artifacts, as well as the environment in which they are embedded. Thus it both emphasizes and exploits the complementary roles played by these different elements. The Luck Problem has existed in one form or another since David Hume, at least. It is perhaps as old as Stoic objections to the Epicurean swerve. Although the general issue admits of different formulations with subtly different emphases, the characterization of it that will serve as my target focuses on “cross-worlds” luck, a kind of luck that arises when the decision-making of agents is indeterministic.

Between the mid-1960s and the early 1970s, the quotidian dimension took political centrality in Japan thanks to the leading role of the New Left movement and its ideology. This went hand in hand with an appreciation of the philosophical approaches of Marxist intellectuals such as Jun Tosaka and Gorō Hani, who saw the quotidian as a fundamental space for historical transformation. We know how Tosaka and Hani developed an everyday-centred philosophy of history through their writings, but we know little about (...) how formats other than the written word – such as cinema – contributed to thinking historical reality from the same ideological approach. To address this gap in our understanding, this article analyses the intersection of two highly representative films with Tosaka and Hani’s historical thought: Secrets Within Walls ( Kabe no naka no himegoto, Kōji Wakamatsu, 1965) and Ceremonies ( Gishiki, Nagisa Ōshima, 1971). These films’ cinematic allegorisation of post-war Japan’s everyday relationships was a way to reflect on the political character of that period. (shrink)

Neil Levy (2007) argues that empirical data shows that psychopaths lack the moral knowledge required for moral responsibility. His account is intriguing, and it offers a promising way to think about the significance of psychopaths for work on moral responsibility. In what follows we focus on three lines of concern connected to Levy's account: his interpretation of the data, the scope of exculpation, and the significance of biological explanations for anti-social behavior.

Our EcoDialogue Center is an educational space for human sustainability within the University of Veracruz. We propose that creating sustainable knowledge requires re-thinking how we conceive ourselves as human beings. This requires paying attention to what we call “the quality of being,” which means caring about and attending to the physical–emotional–mental–spiritual as the foundation of education. This way we can create a space where we can dialogue contemplatively where all dimensions of our lives interact; the physical, the emotional, the communitarian, (...) the social politic, the planetarium, and the spiritual being act with social–environmental responsibility. ABSTRACT In Mexico informed consent is a legal requirement that ensures that patients who are invited to participate in clinical trials are provided with all the information needed to decide whether to participate, or not, in a research protocol. To improve our understanding of the problems physicians in developing countries encounter, when obtaining informed consent (IC), we examined their opinion on the importance of IC in clinical research, the quantity and quality of the information provided to the participant, and the (...) conditions in which the IC is obtained. Investigators considered that IC was useful to the patients, providing information that helped the patient to make a decision about his/her participation. Nevertheless, they felt that for some aspects of the research, like drug development in general, the use of placebos, and the randomization process, many of the patients were not capable of fully understanding the information provided, referring to the complexity of the information and illiteracy as the main reasons. Many investigators were not acquainted with some of the guidelines established in the Mexican General Law of Health,1 36% of them admitting to not having completed their IC letters. Most investigators gave only minutes to the patient to make a decision and 20% of ICs were obtained while the patient was hospitalized. Except for one investigator, all of them considered that specific training in medical ethics would be useful for the daily clinical work. (shrink)

El interés no es comprobar la existencia de Dios, sino simplemente saber si el lenguaje religioso como tal tiene o no sentido. Para esto, primero veremos la concepción de la creencia en general. A continuación, trataremos las creencias religiosas bajo dos puntos de vistas totalmente opuestos: por un lado, se expondrá la posición de autores (...) que dicen que las creencias religiosas sí tienen una evidencia razonable que las sustenta y, por otro, nos encontraremos con autores que afirman que dichas creencias no pueden ser justificadas racionalmente porque lo espiritual refiere el ámbito de lo indecible, en el cual no es factible afirmar que los enunciados religiosos son apropiados a ser verdaderos o falsos. BackgroundThe idea that individuals are responsible for their health has been the focus of debate in the theoretical literature and in its concrete application to healthcare policy in many countries. Controversies persist regarding the form, substance and fairness of allocating health responsibility to the individual, particularly in universal, need-based healthcare systems.ObjectiveTo examine how personal health responsibility has been framed and rationalised in Norwegian key policy documents on priority setting.MethodsDocuments issued or published by the Ministry of Health and Care Services between (...) 1987 and 2018 were thematically analysed. We developed a predefined conceptual framework that guided the analysis. The framework included: the subject and object of responsibility, the level of conceptual abstraction, temporality, normative justificatory arguments and objections to the application of personal health responsibility.ResultsAs an additional criterion, personal health responsibility has been interpreted as relevant if: the patient’s harmful behaviour is repeated after receiving treatment, and if the success of the treatment is conditional on the patient’s behavioural change. When discussed as a retrospective criterion, considerations of reciprocal fairness have been dominant. When discussed as a prospective criterion, the expected benefit of treatment justified its relevance.ConclusionPersonal health responsibility appears to challenge core values of equality, inclusion and solidarity in the Norwegian context and has been repeatedly rejected as a necessary criterion for priority setting. However, the responsibility criterion seems to have some relevance in particular priority setting decisions. (shrink)

This paper examines what it takes for a state of knowledge-how to be extended (i.e. partly constituted by entities external to the organism) within an anti-intellectualist approach to knowledge- how. I begin by examining an account of extended knowledge- how developed by Carter, J. Adam, and Boleslaw Czarnecki. 2016 [“Extended Knowledge-How.” Erkenntnis 81 (2): 259–273], and argue that it fails to properly distinguish between cognitive outsourcing and extended knowing-how. I then introduce a solution to this problem which rests on the (...) distribution of tasks between agent and non-biological entity. On closer inspection, I show that this solution is ultimately unsatisfactory, though its failure is instructive as it illuminates the important role played by an agent’s skilled interaction with an external entity. Drawing on key anti-intellectualist ideas, as well as on insight from cognitive psychology, I propose an account according to which what ultimately matters for extending knowledge-how is whether a hybrid ability is self-regulated. In closing, I illuminate the practical value of extended knowledge-how vis-à-vis cognitive outsourcing. (shrink)

In this paper I argue that Wittgenstein's aim in the aspect-perception passages is to critically evaluate a specific hypothesis. The target hypothesis in these passages is the Gestalt psychologist Köhler's "isomorphism principle." According to this principle, there are neural correlates of conscious perceptual experience, and these neural correlates determine the content of our perceptual experiences. Wittgenstein's argument against the isomorphism principle comprises two steps. First, he diffuses the substantiveness of the principle by undermining an important assumption that underpins this principle, (...) namely, that there is a unitary concept of seeing. Next, Wittgenstein argues that some forms of aspect-perception involve recognitional capacities, the exercise of which is normatively constrained. The normative nature of aspect-perceiving plays a pivotal role in Wittgenstein's rejection of the isomorphism principle. Aside from the clear exegetical benefits gained from identifying the target hypothesis in the aspect-perception passages as the isomorphism principle, construing the remarks in the way suggested here is also philosophically interesting in its own right: it shows Wittgenstein engaging directly in the mind–body problem, construed as the problem of intentionality.
