The Reputation of Justice Oliver Wendell Holmes, Jr., one of the chief architects of twentieth century American law, has gone through a number of phases, changing from being altogether praiseworthy in the last years of his life and the first years after his death in 1935 to that of more sober evaluations. Writing at mid-century Henry Steele Commager offered the judgment that Holmes had had about him “much of the Olympian [and] something of the Mephistophelean.” The most useful account of (...) how the winds of change swept along Holmes' reputation is an article by G. Edward White, “The Rise and Fall of Justice Holmes,” which appeared in the University of Chicago Law Review in 1971. Increased knowledge of the gene–disease associations contributing to common cancer development raises the prospect of population stratification by genotype and other risk factors. Individual risk assessments could be used to target interventions such as screening, treatment and health education. Genotyping neonates, infants or young children as part of a systematic programme would improve coverage and uptake, and facilitate a screening package that maximises potential benefits and minimises harms including overdiagnosis. This paper explores the potential justifications and risks of genotyping children (...) for genetic variants associated with common cancer development within a personalised screening programme. It identifies the ethical and legal principles that might guide population genotyping where the predictive value of the testing is modest and associated risks might arise in the future, and considers the standards required by population screening programme validity measures . These are distinguished from the normative principles underpinning predictive genetic testing of children for adult-onset diseases—namely, to make best-interests judgements and to preserve autonomy. While the case for population-based genotyping of neonates or young children has not yet been made, the justifications for this approach are likely to become increasingly compelling. A modified evaluative and normative framework should be developed, capturing elements from individualistic and population-based approaches. This should emphasise proper communication and genuine parental consent or informed choice, while recognising the challenges associated with making unsolicited approaches to an asymptomatic group. Such a framework would be strengthened by complementary empirical research. (shrink)

From 2012 to 2015 I was the first Eugene H. Fram Chair in Applied Critical Thinking at Rochester Institute of Technology, in Rochester, NY. To the best of my knowledge it is the only such endowed position devoted solely to this at a major North American university. It was made possible by a generous 3 million dollar gift from an anonymous alumnus who wished to honor a retired faculty member who had taught for 51 years. The honoree was revered for (...) his devotion to Bloom’s taxonomy and his academic rigor, which infused case studies and the Socratic method. A primary motivation for the chair was a belief that an alarming number of college graduates lack the necessary critical thinking skills in order to advance successfully in their careers. My responsibilities included collaborative leadership, advocacy and oversight for critical thinking across the entire campus. It provided a unique opportunity to reflect on the current state of critical thinking instruction–very broadly construed, as well as to examine its specific role at RIT, an institution with its own unique history, mission, and character. In lieu of an abstract, here is a brief excerpt of the content:166 HUME'S INTEREST IN NEWTON AND SCIENCE Many writers have been forced to examine — in their treatments of Hume's knowledge of and acquaintance with scientific theories of his day — the related questions of Hume's knowledge of and acquaintance with Isaac Newton and of the nature and extent of Newtonian influences upon Hume's thinking. Most have concluded that — in some sense — Hume was acquainted with and (...) influenced by Newton's thought in particular and scientific thought in general. The genesis of this paper is the recent point of view put forward by Peter Jones which challenges the many permutations of this almost ritualistic standard line by removing Hume entirely from the Newtonian and the scientific scenes of thought. Jones argues that Hume knew less about Newton and science, and needed to know less about Newton and 2 science, than he believes is required by the above interpretation. Indeed, Jones argues that Hume's fundamental assumptions, which, according to Jones, derive ultimately from a form of Ciceronian humanism, drive a "wedge" between Newton's thought and that of 3 Hume. Even Hume's introductory remarks in the Treatise about his universal "science of man" are, for Jones, a declaration of independence from the materialistic trend (as Jones sees it) of Newtonian 4 science and not, as so many commentators have maintained — however tenuously or strongly evidence for linkage of Hume's project with Newtonian or scientific thought. Jones baldly argues that Hume totally lacked interest in science in general and in Newton and Newtonian science in particular. Following J. H. Burton's observation that Hume's work is surprisingly free from the "opinions" of contemporary scientists, 167 Jones states there is no evidence that Hume ever studied science at the University of Edinburgh or that he "pursued" scientific studies of any formal sort. Regarding Newtonian scientific thought, he emphasizes the paucity of specifically Newtonian scientific textbooks in the early eighteenth century 7 which might have been available for Hume to study and argues that nowhere in Hume's writings is there evidence of precise and detailed knowledge of Newton's science beyond what is available in Q Chamber's Cyclopaedia. Jones acknowledges that, in the Introduction to the Treatise, Hume utilizes a "general version" of Newton's "Regulae Philosophandi" from the beginning of Book III of Newton's Principia. Nevertheless, in Jones' view, Hume's fundamentally humanistic orientation separates him completely from g any Newtonian influence. Finally, according to Jones, Hume does not betray the least bit of knowledge of Newton's mathematics and its role in Newton's experimental methodology. On this evidence Jones grounds his central claim of Hume's "total lack of interest in contemporary science." What references there are to Newton and to science in Hume's works Jones finds "traceable to essentially literary predecessors such as Fontenelle or Montesquieu, or to standard works of theologians ] 2 or free-thinkers." The absence of clearly direct references to what Jones feels are scientific works results both from Hume's "total lack of interest in science" and from his commitment to a form of Ciceronian humanism which is "inimical" to what Jones finds to be the obvious materialistic tendencies of 13 science in the early modern period. Jones' account of the Ciceronian and French contexts of Hume's thought is excellent. But his claim that Hume had no interest whatsoever in science 168 is simply too strong and finally forces us to view science in Hume's day as equivalent to science in our own time, a manifestly anachronistic point of view. Throughout this paper, my argument will be conditioned by my view that Hume's interest in science cannot be separated from his epistemology or his religious scepticism. Hume's interest in science was precisely that of a man of letters of the eighteenth century vitally engaged in determining the proper use of scientific methodology in establishing the limits of the secular science of man once it has 14 been freed from the fetters of theology. It distinguishes between ‘positive’ political power appropriately wielded by the state, and ‘negative’ power that individuals may use to protect their own activities and interests from excessive or illegitimate state action and argue for institutions and practices designed to equalize power by ‘leveling up’ the powerless to match (...) the strong. The article proposes to defend the basic income as a pillar of a socio-cultural revolution. This is done exclusively from a literature review and articulation of different works. The introduction section presents the characteristics of a basic income. Section 2 brings how it would mitigate current capitalism problems, which are: increasing inequality, lack of equality of opportunity, means tested social security and its bureaucracy, narrow definition of paid work and future of labor. On Section 3, the author does a literature (...) review to address two common objections against basic income: the cost, and potential labor decrease. Section 4 presents the author argument on three pillars of the socio-cultural revolution: austerity, active citizenship, and solidarity. The article ends with a general conclusion. (shrink)

Conventionality and aptness are two dimensions of metaphorical sentences thought to play an important role in determining how quick and easy it is to process a metaphor. Conventionality reflects the familiarity of a metaphor whereas aptness reflects the degree to which a metaphor vehicle captures important features of a metaphor topic. In recent years it has become clear that operationalizing these two constructs is not as simple as asking naïve raters for subjective judgments. It has been found that ratings of (...) aptness and conventionality are highly correlated, which has led some researchers to pursue alternative methods for measuring the constructs. Here, in four experiments, we explore the underlying reasons for the high correlation in ratings of aptness and conventionality, and question the construct validity of various methods for measuring the two dimensions. We find that manipulating the processing fluency of a metaphorical sentence by means of familiarization to similar senses of the metaphor (“in vivo conventionalization”) influences ratings of the sentence's aptness. This misattribution may help explain why subjective ratings of aptness and conventionality are highly correlated. In addition, we find other reasons to question the construct validity of conventionality and aptness measures: for instance, we find that conventionality is context dependent and thus not attributable to a metaphor vehicle alone, and we find that ratings of aptness take more into account than they should. Scientific knowledge relies heavily on models, shaped by simplifying assumptions, with common categories being abstraction and idealization. This article aims to expose conceptual challenges inherent in conventional interpretations of these concepts, particularly in their practical application to scientific modeling. The primary hurdle emerges in applying these categories to real­world instances of scientific modeling, which we illustrate with examples of non­causal explanations. Key issues revolve around (i) the ambiguous distinction between abstraction and idealization and (ii) the application of the simplifying assumption (...) of abstraction. Our hypothesis posits that non­causal explanations face unintelligibility due to an unclear understanding of the role of simplifying assumptions in them. To test this, we analyze selected examples, ranging from (toy­)examples to real­world instances, scrutinizing the alignment with the standard notions of abstraction and idealization. Throughout, we investigate the influence of simplifying assumptions on these explanations, assessing their adherence or deviation from conventional concepts. (shrink)

The COVID-19 pandemic caused university education to transition from face-to-face contacts to virtual learning environments. Young adults were forced to live an entirely new life online, without valuable and enjoyable social interaction. We examined subjective perspectives towards life online during the pandemic. We identified four viewpoints about life mediated by computers. Two viewpoints express “struggling”: Viewpoint 1 (Angry, Depressed and Overwhelmed), and Viewpoint 3 (Restricted to and Overwhelmed by Virtuality). A third feeling-state conveys experiences of “surviving”: Viewpoint 4 (Isolated and (...) Powerless in Convenience). Surprisingly, Viewpoint 2 is about “thriving” (Comfortable and Convenient Routine with Computers). The research shows that virtualization, confinement, and anxiety are taking a toll on the mental health of some members of the younger generation, while at the same time other members feel they are thriving in a situation of limited resources, virtuality, and reduced face-to-face human interaction. Priority setting is inevitable to control expenditure on expensive medicines, but citizen support is often hampered by the workings of the ‘identified victim effect’, that is, the greater willingness to spend resources helping identified victims than helping statistical victims. In this paper we explore a possible cognitive debiasing strategy that is being employed in discussions on healthcare priority setting, which we call ‘empathy counterbalancing’ (EC). EC is the strategy of directing attention to, and eliciting empathy for, those who might be (...) harmed as a result of one-sided empathy for the very ill who needs expensive treatment. We argue that governments have good reasons to attempt EC because the identified victim effect distorts priority setting in ways that undermine procedural fairness. We briefly outline three areas of application for EC and suggest some possible mechanisms that might explain how EC might work, if at all. We then discuss four potential ethical concerns with EC. First, EC might have the counterproductive effect of reducing overall citizen support for public funding of expensive medical treatments, thereby undermining solidarity. Second, EC may give rise to a ‘competition in suffering’, which may have unintended side effects for patients who feature in attempts at EC. Third, there may be doubts about whether EC is effective. Fourth, it may be objected that EC comes down to emotional manipulation, which governments should avoid. We conclude that insofar these concerns are valid they may be adequately addressed, and that EC seems a promising strategy that merits further investigation. (shrink)

In this book, Phillip Wiebe examines religious, spiritual, and mystical experiences, assessing how these experiences appear to implicate a spiritual order. Despite the current prevalence of naturalism and atheism, he argues that experiences purporting to have a religious or spiritual significance deserve close empirical investigation. Wiebe surveys the broad scope of religious experience and considers different types of evidence that might give rise to a belief in phenomena such as spirits, paranormal events, God, and an afterlife. He demonstrates that there (...) are different explanations and interpretations of religious experiences, both because they are typically personal accounts, and they suggest a reality that is often unobservable. Wiebe also addresses how to evaluate evidence for theories that postulate unobservables in general, and a Theory of Spirits in particular. Calling for more rigorous investigation of these phenomena, Wiebe frames the study of religious experience among other accepted social sciences that seek to understand religion. (shrink)

This study was an attempt to investigate the nature of metaphor by doing a cross-cultural comparison of metaphor in 2 typologically different languages-English and Persian. For this purpose, animal metaphors were taken for comparison. The "GREAT CHAIN OF BEING" metaphor (Lakoff & Turner, 1989), along with the principle of metaphorical highlighting (Kovecses, 2002), were used as a framework in comparing different aspects of animal metaphors as interpreted by native speakers of the 2 languages. The results showed that although animal metaphors (...) in English and Persian are similar to a certain extent, many aspects of them are culture-specific. The similarities and differences among 44 animal metaphors in these 2 languages are shown and some possible explanations are put forward. (shrink)
