Carl Schmitt (1888–1985), Professor für Staats- und Völkerrecht, bewegt nach wie vor die Gemüter. Die Reaktion auf seine Schriften, Handlungen und Ausstrahlungen ist vielfältig; die Spanne reicht von entrüsteten, für die er der Teufel in Person bleibt, über viele Zwischenstufen bis zu jenen Lesern, die ihn für einen der subtilsten, noch keineswegs ausgeloteten Geistern dieses Jahrhunderts halten. Sein Leben lang war Carl Schmitt ein passionierter Schreiber von Briefen. Meist handelte es sich um handschriftlich verfasste, die für den Schreibenden (...) die Fortsetzung eines konkreten Gespräches mit anderen Mitteln war. Das macht das authentische und die Spontanität der Schmitt-Briefe aus. Als erste Edition einer umfangreichen Korrespondenz wird in dem Buch die Korrespondenz zwischen Carl Schmitt und Armin Mohler veröffentlicht. Der Briefwechsel umfasst die Zeit von 1947 bis 1980 und enthält 280 Briefe und Karten von Carl Schmitt an Armin Mohler. Von dem Briefpartner und Herausgeber wird in der Regel aus den eigenen Briefen nur auszugsweise zitiert, sofern es für das von Carl Schmitt Geschriebene notwendig ist. Armin Mohler (1920 bis 2003), ist einer der bekanntesten rechtskonservativen Schriftsteller, Kritiker und Historiker in Deutschland. Sein Handbuch zur Konservativen Revolution ist ein Standardwerk. In der Zeit des Briefwechsels war Mohler von 1949 bis 1953 Sekretär Ernst Jüngers, danach Korrespondent großer Zeitungen in Paris und von 1964 an Geschäftsführer der Carl Friedrich von Siemens Stiftung, in der er sehr beachtete Symposien zu aktuellen wissenschaftlichen Themen organisierte. Der Briefwechsel ist für die Deutung Carl Schmitts in der Nachkriegszeit in seinem Sauerländer "Exil" grundlegend, gleichzeitig enthält er pointierte Schlaglichter auf das politische und kulturelle Geschehen der frühen und mittleren Bundesrepublik sowie auf Werk und Leben von Ernst Jünger. The main aim of this study is to test the validity of the Motivation, Engagement, and Thriving in User Experience model in higher education. We propose a process model in which we investigate how the need-satisfaction of digital learning tools within the interface sphere and task sphere accounts for engagement, learning, and well-being. A total of 426 higher education students drawn from two subsamples participated in this cross-sectional study. A structural equation model shows that interface autonomy and competence satisfaction positively (...) predict task autonomy and competence. Task competence, in turn, negatively predicts focused attention and positively predicts perceived usability and well-being. Task autonomy positively predicts perceived usability and reward. Based on our results, we provide some initial support for the METUX model in higher education. However, more validation work is needed to improve the scale that measures need-satisfaction in the interface and task spheres. Moreover, we find no support for the effect of task sphere on learning. Further investigations are needed into how METUX can be used in domain- and situation-specific contexts to account for increases in engagement, learning, and well-being. Finally, future studies need to include all aspects of the METUX model in order to fully test its validity. (shrink)

This volume provides the first English translation of Hans Kelsen's and Carl Schmitt's influential Weimar-era debate on constitutional guardianship and the legitimacy of constitutional review. It includes Kelsen's seminal piece, 'The Nature and Development of Constitutional Adjudication', as well as key extracts from the 'Guardian of the Constitution' which present Schmitt's argument against constitutional review. Also included are Kelsen's review of Schmitt's 'Guardian of the Constitution', as well as some further material by Kelsen and Schmitt on (...) presidential dictatorship under Article 48 of the Weimar Constitution. These texts show Kelsen and Schmitt responding to one another, in the context of a debate focused on a concrete constitutional crisis, thus allowing the reader to assess the plausibility of Kelsen's and Schmitt's legal and constitutional theories. When it comes to evaluating reductive hypotheses in metaphysics, supervenience arguments are the tools of the trade. Jaegwon Kim and Frank Jackson have argued, respectively, that strong and global supervenience are sufficient for reduction, and others have argued that supervenience theses stand in need of the kind of explanation that reductive hypotheses are particularly suited to provide. Simon Blackburn's arguments about what he claims are the specifically problematic features of the supervenience of the moral on the natural have also been (...) influential. But most discussions of these arguments have proceeded under the strong and restrictive assumptions of the S5 modal logic. In this paper we aim to remedy that defect, by illustrating in an accessible way what happens to these arguments under relaxed assumptions and why. The occasion is recent work by Ralph Wedgwood, who seeks to defend non-reductive accounts of moral and mental properties together with strong supervenience, but to evade both the arguments of Kim and Jackson and the explanatory challenge by accepting only the weaker, B, modal logic. In addition to drawing general lessons about what happens to supervenience arguments under relaxed assumptions, our goal is therefore to shed some light on both the virtues and costs of Wedgwood's proposal. Its falsity reveals a distinctive, new kind of explanation, which I call “ennobling”. Its falsity also entails that every previously proposed theory of what grounds grounding facts is false. A translation of Carl Schmitt's classic explanation of the nature and historical/sociological significance of political Catholicism.

Carl Schmitt kept diaries throughout his life, several of which he specifically selected for academic publication. These are the recordings made in the early years after World War II, when Schmitt lost all his positions. After his release from the prison he returned to his home in small town of Plettenberg, where he remained until his death. Schmitt ordered these diaries to be published only after his death, because, even several decades after the war, they remained ideologically (...) dangerous. In this issue we continue to publish fragments of translation of the “Glossarium”. In the fragments prepared for present publication, Schmitt argues on several important topics. First, he writes about utopia — paradise located in a remote, but achievable future. The ability to think future located at long distance decreases in modern times. Therefore, in the 19th century they have to move from utopia to positive science. Those who write on future must say that heaven can come tomorrow. Schmitt goes further to compare the utopian ideas of Thomas More with the utopias of the 19th century. More was not a cleric; he was just a clerk, an intellectual, a writer, not a priest. Schmitt questioned the rightfulness of the canonization of More and compared him with another Catholic thinker of that time, Fr. Vitoria. Another important topic — the problem of legality and legitimacy. Schmitt once again handles it in connection with the events in Czechoslovakia in 1948. In Stability and Justification in Hume’s Treatise, Louis Loeb ascribes to Hume a naturalistic account of justified belief, one on which Hume is fundamentally concerned with the question whether stable belief can be achieved. Loeb’s interpretation is systematic, richly explanatory, and powerfully argued. He makes a compelling case that stability plays a central role in Hume’s epistemology. Loeb’s case is so compelling indeed that anyone who wants to defend an alternative interpretation will now have to assimilate or deflect the massive (...) textual evidence in favor of the stability interpretation. I will argue here that, for some passages Loeb cites in favor of the stability interpretation, a veritistic interpretation explains the text at least as well as the stability interpretation does. Why do we so often care about the outcomes of games when nothing is at stake? There is a paradox here, much like the paradox of fiction, which concerns why we care about the fates and threats of merely fictional beings. I argue that the paradox threatens to overturn a great deal of what philosophers have thought about caring, severing its connection to value and undermining its moral weight. I defend a solution to the paradox that draws on Kendall Walton's (...) solution to the paradox of fiction, developing his idea that it be extended to games. The solution takes games to involve make‐believe: in particular, players and spectators make‐believe that the outcome of the game matters. I also explore how the phenomenon extends beyond games. And I explore some moral implications: in particular, my view preserves the idea that we have reason not to impede others in their pursuit of what they care about. (shrink)

According to orthodoxy, the most fundamental kind of causation involves one event causing another event. I argue against this event‐causal view. Instead, the most fundamental kind of causation is thing causation, which involves a thing causing a thing to do something. Event causation is reducible to thing causation, but thing causation is not reducible to event causation, because event causation cannot accommodate cases of fine‐grained causation. In Knowledge and Belief, Frederick Schmitt explores the nature and value of knowledge and justified belief through an examination of the dispute between epistemological internalism and externalism. Knowledge and justified belief are naturally viewed as belief of a sort likely to be true--an externalist view. It is also intuitive, however, to view them as an internal matter; justification must be accessible to the subject or constituted by the subject's epistemic perspective. The author argues against the view that internalism is (...) the historically dominant epistemology by examining closely the epistemological principles that underlie the treatment of skepticism in Plato, the Academic and Pyrrhonian skeptics, Descartes and Hume. Schmitt develops a sustained, detailed argument against many forms of internalism in favor of a reliabilist/externalist epistemology. His version of reliabilism, though strictly externalist, accommodates and explains the most durable intuitions alleged to support internalism. Knowledge and Belief assumes no knowledge of epistemology or its history.
