Over the years, companies have adopted hiring algorithms because they promise wider job candidate pools, lower recruitment costs and less human bias. Despite these promises, they also bring perils. Using them can inflict unintentional harms on individual human rights. These include the five human rights to work, equality and nondiscrimination, privacy, free expression and free association. Despite the human rights harms of hiring algorithms, the AI ethics literature has predominantly focused on abstract ethical principles. This is problematic for two reasons. (...) First, AI principles have been criticized for being vague and not actionable. Second, the use of vague ethical principles to discuss algorithmic risks does not provide any accountability. This lack of accountability creates an algorithmic accountability gap. Closing this gap is crucial because, without accountability, the use of hiring algorithms can lead to discrimination and unequal access to employment opportunities. This paper makes two contributions to the AI ethics literature. First, it frames the ethical risks of hiring algorithms using international human rights law as a universal standard for determining algorithmic accountability. Second, it evaluates four types of algorithmic impact assessments in terms of how effectively they address the five human rights of job applicants implicated in hiring algorithms. It determines which of the assessments can help companies audit their hiring algorithms and close the algorithmic accountability gap. (shrink)

In _Beyond Animal Rights_, Josephine Donovan and Carol J. Adams introduced feminist "ethic of care" theory into philosophical discussions of the treatment of animals. In this new volume, seven essays from _Beyond Animal Rights_ are joined by nine new articles-most of which were written in response to that book-and a new introduction that situates feminist animal care theory within feminist theory and the larger debate over animal rights. Contributors critique theorists' reliance on natural rights doctrine and utilitarianism, which, they suggest, (...) have a masculine bias. They argue for ethical attentiveness and sympathy in our relationships with animals and propose a link between the continuing subjugation of women and the human domination of nature. Laffin, Josephine On 31 October 2017 it will be five hundred years since Martin Luther posted his Ninety-Five Theses on the door of the Castle Church in Wittenberg, the date traditionally hailed as the start of the Lutheran Reformation. Another anniversary is a personal one: it is twenty-five years since I began teaching Reformation history. It seems an appropriate time, therefore, to pause and reflect on the significance of this task.

Dasein’s struggle is an investigation of the writings of Martin Heidegger to consider whether his thoughts and beliefs would be useful and / or insightful in addressing contemporary society and its discriminatory practices towards disabled people. Heidegger‟s basic existential being Dasein, is in constant interaction and interconnection with others as it negotiates its best possibilities of Being-in-the-world. This pursuit of an „authentic‟ existence is interpreted as a struggle for individuality, acceptance, engagement and resistance to social conformity and anonymity. Developing the (...) analysis through the theme of „Being‟ the paper‟s discussion is centred on Critical Disability Studies and the evolving Studies in Ableism. The interpretation is underpinned by the contemporary voice of disability, predominantly by autobiographical insights of Nancy Mairs‟ Waist-high in the world; A life among the nondisabled, together with other autobiographical, biographical and narrative texts. L’Union européenne nous invite à repenser les conditions et les attributs de la souveraineté traditionnellement rattachée aux États-nations. Dans cet article, est proposée une tentative de re-conceptualisation à partir des différentes définitions de la souveraineté, et de l’analyse d’un exemple : celui de la politique étrangère et de l’exercice diplomatique de l’Union européenne. En effet, la souveraineté possède toujours deux faces : une face interne qui se charge de définir la loi, le droit, et de les faire appliquer sur un (...) territoire délimité ; une face externe qui exporte et affirme les intérêts, les valeurs et les principes qui prévalent en interne. La politique étrangère et son outil principal qu’est l’action diplomatique, consistent dans l’expression vers l’extérieur de la souveraineté d’un corps politique. Résumé Dans les situations sociomotrices, l’engagement des participants n’est pas seulement réductible aux communications directes. Il est surtout lié à l’émergence de systèmes de signes assurant la dynamique globale du jeu. Nous proposons d’appréhender la communication comme un système d’interaction global constitué de plusieurs canaux. On y retrouve les communications directes mais aussi quatre systèmes de signes : celui des praxèmes, des gestèmes, des gestes et des communications verbales. Ce travail interroge la place de chaque canal communicationnel dans deux sports (...) et deux jeux traditionnels. Nous recrutons trois groupes de 20 étudiants pour participer aux jeux mentionnés. Les communications sont filmées, décryptées, triées et catégorisées. On constate une forte prévalence des praxèmes dans les sports collectifs, tandis que la répartition des communications est plus équilibrée dans les jeux traditionnels. La quantité, la variabilité et l’organisation des signes sont sensibles à la logique interne. Globalement, cette recherche tend à montrer que les jeux sont un formidable laboratoire in vivo pour comprendre l’organisation des systèmes de signes. Spécifiquement, elle apporte des informations sur le pouvoir socialisant de la sémiotricité de chaque jeu et sur le renouvellement des pédagogies qu’elle peut engendrer. (shrink)

The research analyzes the teledentistry service applied in health services during COVID-19, studying the quality of the teledentistry service and the level of satisfaction of patients treated with this care model. A sample of 341 patients was worked on, using the SERVQUAL model. The results showed a statistically significant relationship between quality of service in teledentistry and patient satisfaction (p<0.05), where 34.9% patients perceived low quality of service and dissatisfaction, while 33.7% were pleased with the care. We conclude that, given (...) the dental health difficulties, the population of the Peruvian central jungle is dissatisfied with the teledentistry service. (shrink)

This paper describes the exploratory study which was carried out in Zimbabwe with an elementary Grade 7 class and with the firstand third- year student teachers, at a Teacher Training College, "doing philosophy", using Lipman's PIXIE and HARRY novels, respectively, and the proposed critical inquiry methodology.Secondly the perceptions of the participants, about their experiences during these exploratory sessions, which were derived from the researcher's self-evaluation and the students' informal evaluations, are presented in the paper.

In July 2000, the Seminole Nation of Oklahoma passed a resolution that would effectively expel a significant portion of its tribal members. The resolution amended the Nation's constitution by changing its membership criteria. Previously, potential members needed to show descent from an enrollee of the 1906 Dawes Rolls, the official American Indian tribal rolls established by the Dawes Commission to facilitate the allotment of reservation land. The amended constitution requires possession of one-eighth Seminole Indian blood, a requirement that a significant (...) portion of the tribe's membership cannot fulfill. The members of the Nation who fail to meet this new membership criterion all have one thing in common: they are black.Descendents of former slaves who came to live among the Seminole Indians of Florida in the seventeenth and eighteenth centuries, the black Seminoles have been officially recognized by the U.S. government as members of the Seminole Nation of Oklahoma since 1866. The critical concern of the present volume is contemporary naturalism, both in its scientific version and as represented by newly emerging hopes for another, philosophically more liberal, naturalism.1 The papers collected here are state-of-the-art discussions that question the appeal, rational motivations, and presuppositions of scientific naturalism across a broad range of philosophical topics. As an alternative to scientific naturalism, we offer the outlines of a new non- reductive form of naturalism and a more inclusive conception of nature than any provided (...) by the natural sciences. Our authors collectively believe that holding scientific naturalism up for philosophical scrutiny and challenging its misconceptions is of the first importance both for understanding ourselves and our place in the world; and, also, for the future direction of philosophy itself. Since 1980, the number of twin births in the United States has increased 76 percent, and the number of triplets or higher‐order multiples has increased over 400 percent. These increases are due in part to increased maternal age, which is associated with spontaneous twinning. But the primary reason for these increases is that more and more people are undergoing fertility treatment. Despite an emerging (but not absolute) consensus in the medical literature that multiples, including twins, should be a far less (...) frequent outcome of fertility treatment, American clinicians currently practice fertility medicine in ways likely to result in twins and, occasionally, triplets—often, they tell us, at the request of their patients. At first blush, one might conclude that these practice patterns show that patients and their doctors have weighed the risks associated with twins against the benefits of swiftly completing their families and decided that the risks are worth taking. That is, their requests for twins must represent their free and informed choices. But there are reasons to be skeptical of this interpretation, including that the preferences of many patients seem to be very strongly shaped, if not sometimes completely constrained, by concerns about costs—costs that mainly result from the routine exclusion of in vitro fertilization from health insurance coverage. It is quite possible, we believe, that these cost concerns actually undermine the autonomy of fertility patients, pushing many of them to take risks with their health and the health of their hoped‐for future children. Practical wisdom eliminativism has recently been proposed in both philosophy and psychology, on the grounds of the alleged redundancy of practical wisdom (Miller 2021 ) and its purported developmental/psychological implausibility (Lapsley 2021 ). Here we respond to these challenges by drawing on an improved version of a view of practical wisdom, the “Aretai model”, that we have presented elsewhere (De Caro et al. 2021 ; Vaccarezza et al. 2023 ; De Caro et al. forthcoming ). According to this (...) model, practical wisdom is conceptualized: (i) as virtuousness _tout court_, i.e., as the _ratio essendi_ of the virtues, and (ii) as a form of ethical expertise. By appealing to the first thesis, we counter the charge of psychological implausibility, while we rely on the second thesis to address the accusation of redundancy. In conclusion we argue that the Aretai model implies a significant paradigm shift in virtue ethics. Practical wisdom emerges as both necessary and sufficient for virtuousness, thereby downsizing – without eliminating entirely – the role that individual virtues play in our ethical lives. (shrink)

As you might guess, the words goodness, truth, and beauty are not of heavy poetic value today. Terms of concept may be stressed again someday, and maybe soon, but at the moment have gone out of poetry in favor of more concreteness, more imagery, more connotative suggestion, less effect of the naming and labeling virtues, which Ezra Pound and other twentieth-century leaders have told us not to use. But actually these terms of abstract concept were lessened in major usage in (...) poetry long before the twentieth century. They had flourished in a setting of kings and courts. The love poetry, the political poetry, the philosophic poetry not only dealt directly with truth and goodness but used them constantly for evaluative commentary of other subjects. People, as well as moral issues, were good; lovers, as well as propositions, were true . . . Love and honor, good and true, these were terms of value in which poetry worked so strongly that a large proportion of its reference was limited to these alone, and so thoroughly that there was not a poet in the sixteenth and seventeenth centuries who did not share in this emphasis. Normativity concerns what we ought to think or do and the evaluations we make. For example, we say that we ought to think consistently, we ought to keep our promises, or that Mozart is a better composer than Salieri. Yet what philosophical moral can we draw from the apparent absence of normativity in the scientific image of the world? For scientific naturalists, the moral is that the normative must be reduced to the nonnormative, while for nonnaturalists, the moral is that (...) there must be a transcendent realm of norms. _Naturalism and Normativity_ engages with both sides of this debate. Essays explore philosophical options for understanding normativity in the space between scientific naturalism and Platonic supernaturalism. They articulate a liberal conception of philosophy that is neither reducible to the sciences nor completely independent of them—yet one that maintains the right to call itself naturalism. Contributors think in new ways about the relations among the scientific worldview, our experience of norms and values, and our movements in the space of reason. Detailed discussions include the relationship between philosophy and science, physicalism and ontological pluralism, the realm of the ordinary, objectivity and subjectivity, truth and justification, and the liberal naturalisms of Donald Davidson, John Dewey, John McDowell, and Ludwig Wittgenstein. The authors aim in this article to show why it is extremely difficult to expect representatives of missionary religions to engage in productive interreligious dialogue. The article demonstrates how the imperative to convert, which is rooted in a sense of epistemic authority that one holds the best version of truth, precludes interreligious dialogue among religionists. The authors note, on the one hand, that the primary condition for any dialogue is that each of those involved come to the dialogue intellectually humble. (...) On the other hand, the authors note that for missionary religionists to embrace intellectual humility requires a fundamental rethink of their claims of epistemological certainty and final epistemic authority. This implies abandoning the missionary mandate and witnessing built on a sense of intellectual certainty and pride. The authors therefore argue that intellectual humility is a necessary condition for productive interreligious dialogue. Because representatives of missionary religions claim certainty about the knowledge they espouse, what is paraded as interreligious dialogue is largely a myth. It will remain a mere concept that yields little to no tangible result unless these representatives embrace intellectual humility, which is more achievable within a secularist framework.Contribution: This research contributes to the seemingly easy but difficult discourse and practice about interreligious dialogue. It brings to the limelight a more appropriate conception of dialogue in the context of interreligious dialogue, and explains how side-lining that conception empties the predominant practice of interreligous dialogue. When Nadya Suleman gave birth to eight babies in January 2009, the story ignited a media frenzy—first because the babies were only the second set of octuplets born in the United States, and later because of the irregularities of their conception by in vitro fertilization and the personal details of their mother's life. Hidden beneath the sensational aspects of the story, though, are a number of fundamental ethical, medical, and legal issues concerning assisted reproductive technologies. Three essays examine these questions.

Animals, Mind, and Matter challenges the current ascription of object status to animals in the law, commerce, and science, where they are conceived as property and commodities. Instead, Donovan establishes that animals are living subjects, have minds and opinions, and care about what happens to them.

This article argues for the possibility of the State to be tolerant when acting as arbitrator in tolerance conflicts. Two objections are considered, depending on how political conflicts, and in particular tolerance conflicts, are described. The article presents a theory of political descriptions and shows how this theory can respond in a politically satisfactory manner to the two objections initially raised. Finally, it discusses the relationship between the justification of political actions in an ideal normative context and its justification in more local, non-ideal contexts where the political action takes place. Decoding Abortion Rhetoric: Communicating Social Change. By Celeste Michelle Condit.

According to a widespread view, a complete explanatory reduction of all aspects of the human mind to the electro-chemical functioning of the brain is at hand and will certainly produce vast and positive cultural, political and social consequences. However, notwithstanding the astonishing advances generated by the neurosciences in recent years for our understanding of the mechanisms and functions of the brain, the application of these findings to the specific but crucial issue of human agency can be considered a “pre-paradigmatic science” (...) (in Thomas Kuhn’s sense). This implies that the situation is, at the same time, intellectually stimulating and methodologically confused. More specifically—because of the lack of a solid, unitary and coherent methodological framework as to how to connect neurophysiology and agency—it frequently happens that tentative approaches, bold but very preliminary claims and even clearly flawed interpretations of experimental data are taken for granted. In this article some examples of such conceptual confusions and intellectual hubris will be presented, which derive from the most recent literature at the intersection between neurosciences, on the one hand, and philosophy, politics and social sciences, on the other hand. It will also be argued that, in some of these cases, hasty and over-ambitious conclusions may produce negative social and political consequences. The general upshot will be that very much has still to be clarified as to what and how neurosciences can tell us about human agency and that, in the meantime, intellectual and methodological caution is to be recommended. Matthew Beovich never gave a speech in the aula, the Council 'hall' inside St Peter's Basilica, nor did he prepare a written submission. At first glance, his seemingly minimal participation reinforces the damning judgment of Patrick O'Farrell that members of the Australian hierarchy were 'frequently uncomprehending and even resistant to the spirit of change'. With this from the doyen of Catholic historians (...) in Australia in the late twentieth century, it is not surprising that Ian Breward concluded in his survey of Australian religious history: 'Most Australian bishops were bemused observers of a process which shattered their convictions about the uniformity of the Roman Catholic Church. Australian contributions to Council debates were few. The pragmatism and traditionalism of the Australian Church stood nakedly exposed'. (shrink)

Many scientists and doctors hope that affordable genome sequencing will lead to more personalized medical care and improve public health in ways that will benefit children, families, and society more broadly. One hope in particular is that all newborns could be sequenced at birth, thereby setting the stage for a lifetime of medical care and self‐directed preventive actions tailored to each child's genome. Indeed, commentators often suggest that universal genome sequencing is inevitable. Such optimism can come with the presumption that (...) discussing the potential limits, cost, and downsides of widespread application of genomic technologies is pointless, excessively pessimistic, or overly cautious. We disagree. Given the pragmatic challenges associated with determining what sequencing data mean for the health of individuals, the economic costs associated with interpreting and acting on such data, and the psychosocial costs of predicting one's own or one's child's future life plans based on uncertain testing results, we think this hope and optimism deserve to be tempered.In the analysis that follows, we distinguish between two reasons for using sequencing: to diagnose individual infants who have been identified as sick and to screen populations of infants who appear to be healthy. We also distinguish among three contexts in which sequencing for either diagnosis or screening could be deployed: in clinical medicine, in public health programs, and as a direct‐to‐consumer service. Each of these contexts comes with different professional norms, policy considerations, and public expectations. Finally, we distinguish between two main types of genome sequencing: targeted sequencing, where only specific genes are sequenced or analyzed, and whole‐exome or whole‐genome sequencing, where all the DNA or all the coding segments of all genes are sequenced and analyzed.In a symptomatic newborn, targeted or genome‐wide sequencing can help guide other tests for diagnosis or for specific treatment that is urgently needed. Clinicians use the infant's symptoms (or phenotype) to interrogate the sequencing data. These same complexities and uncertainties, however, limit the usefulness of genome‐wide sequencing as a population screening tool. While we recognize considerable benefit in using targeted sequencing to screen for or detect specific conditions that meet the criteria for inclusion in newborn screening panels, use of genome‐wide sequencing as a sole screening tool for newborns is at best premature. We conclude that sequencing technology can be beneficially used in newborns when that use is nuanced and attentive to context. (shrink)

This paper has a twofold aim. On the one hand, we will discuss the much debated question of the source of normativity (which traditionally has nature and practical reason as the two main contenders to this role) and propose a new answer to it. Second, in answering this question, we will present a new account of practical wisdom, which conceives of the ethical virtues as ultimately unified in the chief virtue of phronesis, understood as ethical expertise. To do so, we (...) will first criticize the main current view of phronesis and its bearer (the phronimos), then offer another view of the nature of phronesis and of its relation to the other ethical virtues. Our proposal should not be intended as an interpretation of Aristotle’s own view; rather, it should be seen as a broadly Aristotelian theoretical proposal, which we believe can satisfyingly address most of the problems that afflict the more traditional accounts of practical wisdom. In section 2 of this paper, after criticizing first-nature naturalistic views of moral virtue, we take practical reason to be the cornerstone of second-nature naturalistic views; in section 3, we will outline criticisms to which, in our view, the traditional views of phronesis are ill-suited to respond, and, in section 4, we will outline our view of phronesis as ethical expertise – a view which in our view is immune to the above-mentioned criticisms – by spelling out the three main tenets of phronesis as ethical expertise: a conceptual thesis, an epistemic thesis, and the educational implications of the two. Finally, we will support our proposal with some empirical evidence taken from cognitive science. (shrink)

In a project The Hastings Center is now running on the future of prenatal testing, we are encountering clear examples, both in established law and in the practices of individual providers, of failures to respect women's reproductive autonomy: when testing is not offered to certain demographics of women, for instance, or when the choices of women to terminate or continue pregnancies are prohibited or otherwise not supported. But this project also raises puzzles for reproductive autonomy. We have learned that some (...) clinicians and patients do not discuss the fact that prenatal testing can lead to a decision about whether to terminate a pregnancy—they just don't talk about it. And while the decision whether to agree to prenatal screening and diagnostic testing is to be made with women's free and informed consent, many screening tests have been routinized in such a way that some women do not even recall agreeing to testing, while others feel that agreeing to testing is what their clinicians expect of them or that the testing is necessary to protect themselves and their families from the significant financial hardship of raising a child with a disability. In the face of these pressures, can one really say that women are freely choosing to undergo testing or are freely choosing to continue or terminate a pregnancy following receipt of test results? The reality of these pressures is requiring us to consider expanding the scope of our investigation beyond the clinical encounter to the broader context—to think harder about what reproductive autonomy means and how best to enhance it. Background There is now rising consensus that community engagement is ethically and scientifically essential for all types of health research. Yet debate continues about the moral aims, methods and appropriate timing in the research cycle for community engagement to occur, and whether the answer should vary between different types of health research. Co-design and collaborative partnership approaches that involve engagement during priority-setting, for example, are common in many forms of applied health research but are not regular practice in biomedical research. (...) In this study, we empirically examine the normative question: should communities be engaged when setting priorities for biomedical research projects, and, if so, how and for what purpose? Methods We conducted in-depth interviews with 31 members of the biomedical research community from the UK, Australia, and African countries who had engaged communities in their work. Interview data were thematically analysed. Results Our study shows that biomedical researchers and community engagement experts strongly support engagement in biomedical research priority-setting, except under certain circumstances where it may be harmful to communities. However, they gave two distinct responses on what ethical purpose it should serve—either empowerment or instrumental goals—and their perspectives on how it should achieve those goals also varied. Three engagement approaches were suggested: community-initiated, synergistic, and consultative. Pre-engagement essentials and barriers to meaningful engagement in biomedical research priority-setting are also reported. Conclusions This study offers initial evidence that meaningful engagement in priority-setting should potentially be defined slightly differently for biomedical research relative to certain types of applied health research and that engagement practice in biomedical research should not be dominated by instrumental goals and approaches, as is presently the case. This article discusses Hilary Putnam's views on the mind-body problem, by locating them in the general context of a satisfying pluralistic naturalism that he tried to articulate throughout his entire philosophical career. The first attempt in this direction was computational functionalism, his version of psychological functionalism centered on the analogy between mind/body and software/hardware, which (differently from David Lewis and others) he came to think of as an empirical hypothesis. That was a very successful proposal; however, later Putnam abandoned it (...) and embraced what he called 'liberal functionalism'. The reason for this change of mind was twofold: on the one hand, Putnam reached the conclusion that computational functionalism was incompatible with his views on semantic externalism; on the other hand, he began to think that mental states, besides being compositionally plastic (i.e., two entities can be in the same psychological state without being in the same physical state), are also computationally plastic (i.e., two entities can be in the same psychological state without being in the same functional state).In conclusion, I will argue that 'liberal functionalism' opened an interesting perspective for a successful non-reductive version of naturalism.
