The celebrity effect is the well-documented phenomenon in which people ascribe an enhanced worth to artefacts owned by famous individuals. This effect has been attributed to a belief in psychological contagion, the transmission of a person’s essence to an object via contact. We examined people’s judgments of the persisting worth of celebrity-owned artefacts following transformations of their parts/material and found that the celebrity effect was evident only for post-transformation artefacts that were composed of parts/material that had direct physical contact with (...) the celebrity. Insofar as the celebrity effect arises from psychological contagion, the findings suggest that the essence imparted to a celebrity-owned artefact is conceived as akin to a residue deposited in/on the object rather than a germ capable of spreading in an indirect manner to new parts/material added to the object. The results illuminate the nature of psychological contagion and offer insight into how best to preserve the value of historically important artefacts. (shrink)

Generics (e.g., “Ravens are black”) express generalizations about categories or their members. Previous research found that generics about animals are interpreted as broadly true of members of a kind, yet also accepted based on minimal evidence. This asymmetry is important for suggesting a mechanism by which unfounded generalizations may flourish; yet, little is known whether this finding extends to generics about groups of people (heretofore, “social generics”). Accordingly, in four preregistered studies (n = 665), we tested for an inferential asymmetry (...) for generics regarding novel groups of animals versus people. Participants were randomly assigned to either an Implied Prevalence task (given a generic, asked to estimate the prevalence of a property) or a Truth-Conditions task (given prevalence information, asked whether a generic was true or false). A generic asymmetry was found in both domains, at equivalent levels. The asymmetry also extended to properties varying in valence (dangerous and neutral). Finally, there were differences as a function of property valence in the Implied Prevalence task and a small but consistent interaction between domain and prevalence in the Truth-Conditions task. We discuss the implications of these results for the semantics of generics, theoretical accounts of the asymmetry, and the relation between generics and stereotyping. (shrink)

Analytic particularism claims that judgments of moral wrongness are about particular acts rather than general principles. Metaphysical particularism claims that what makes true moral judgments true is not general principles but nonmoral properties of particular acts. Epistemological particularism claims that studying particular acts apart from general principles can justify beliefs in moral judgments. Methodological particularism claims that we will do better morally in everyday life if we look carefully at each particular decision as it arises and give up the search (...) for a complete moral theory. Illness creates a range of negative emotions in patients including anxiety, fear, powerlessness, and vulnerability. There is much debate on the ‘therapeutic’ or ‘helping’ nurse–patient relationship. However, despite the current agenda regarding patient-centred care, the literature concerning the development of good interpersonal responses and the view that a satisfactory nursing ethics should focus on persons and character traits rather than actions, nursing ethics is dominated by the traditional obligation, act-centred theories such as consequentialism and deontology. I critically examine these theories (...) and the role of duty-based notions in both general ethics and nursing practice. Because of well-established flaws, I conclude that obligation-based moral theories are incomplete and inadequate for nursing practice. I examine the work of Hursthouse on virtue ethics’ action guidance and the v-rules. I argue that the moral virtues and a strong (action-guiding) version of virtue ethics provide a plausible and viable alternative for nursing practice. I develop an account of a virtue-based helping relationship and a virtue-based approach to nursing. The latter is characterized by three features: (1) exercising the moral virtues such as compassion; (2) using judgement; and (3) using moral wisdom, understood to include at least moral perception, moral sensitivity, and moral imagination. Merits and problems of the virtue-based approach are examined. I relate the work of MacIntyre to nursing and I conceive nursing as a practice: nurses who exercise the virtues and seek the internal goods help to sustain the practice of nursing and thus prevent the marginalization of the virtues. The strong practice-based version of virtue ethics proposed is context-dependent, particularist, and relational. Several areas for future philosophical inquiry and empirical nursing research are suggested to develop this account yet further. (shrink)

We explain three phenomena in legal discourse in terms of MacFarlane’s assessment-sensitive semantics: incompatible applications of law, assessments of statements about what is legally the case, and retrospective overruling. The claim is that assessment sensitivity fits in with the view, shared by many legal theorists at least with respect to hard cases, that the final adjudicator’s interpretation of legal sources is constitutive of the applied norm. We argue that there are strong analogies between certain kinds of statements in legal discourse (...) as understood in light of that view and discourse about matters of taste and future contingents. Thus, if assessment-sensitive semantics provides a compelling account of discourse about matters of taste and future contingents, then it likewise provides a compelling account of those statements in legal discourse. In his last book, David Armstrong sets out his metaphysical system in a set of concise and lively chapters each dealing with one aspect of the world. He begins with the assumption that all that exists is the physical world of space-time. On this foundation he constructs a coherent metaphysical scheme that gives plausible answers to many of the great problems of metaphysics. He gives accounts of properties, relations, and particulars; laws of nature; modality; abstract objects such as numbers; (...) and time and mind. (shrink)

If there is a moral reason for A to do X, and if A cannot do X without doing Y, and if doing Y will enable A to do X, then there is a moral reason for A to do Y. This principle is plausible but mysterious, so it needs to be explained. It can be explained by necessary enabler consequentialism, but not by other consequentialisms or any deontological moral theory. Or so I argue. Frances Howard-Snyder objects that this argument (...) fails to establish consequentialism as understood by, because it fails to establish agent-neutrality. I respond by distinguishing consequentialism, which need not be agent-neutral, from utilitarianism, which claims agent-neutrality. Howard-Snyder also presents a schema for a non-consequentialist theory that is supposed to explain moral substitutability. I respond that her explanation cannot be completed without introducing incoherence into deontological moral theories. (shrink)

Avtor tu pokaže, da običajno razumevanje vodi v naslednje protislovje: je pravno pravilno storiti to, kar pravno ni pravilno.

Prvi del prispevka obravnava besedilno ustavo – in argument namena, s katerim razlagalci včasih radi istovetijo svoje odločitve v konkretnem sporu z voljo ustavopisca. Takšno rabo tega argumenta avtor izpodbije. Razprava je napisana v odgovor kritikam, ki so zadnja tri desetletja letele na ekspresivno ali izrazno pojmovanje pravil. Avtor najprej dokazuje, da ob izraznem pojmovanju lahko obravnavamo fakultativna dejanska stanja, ne da bi se v opisu normativnega sistema pri tem porodilo kakršnokoli protislovje. Nato pokaže, da je mogoče opisati (i) propozicijsko vsebino metapravil, ne da bi semantizirali kazalnik ilokucijske (normativne) moči predmetnega pravila, in (ii) dovolilno zaporo normativnega sistema, tudi če zanikamo pojmovno avtonomijo dovolitvenih dejanj. Na tej podlagi v sklepu (...) ponudi rešitev za izrazno ponazoritev pogojnih pravil. Medtem ko je prvi del razprave namenjen razjasnjevanju, predlogi iz zadnjega dela stremijo k napredku v izrazni teoriji, razširjeni med pravniki. (shrink)

Multiple Personality Disorder (MPD), now also known as Dissociative Iden- tity Disorder, raises many questions about the nature of persons, the goals of treatment, the suggestibility of patients, and the reliability of defendant reports of their own mental states. These issues become crucial when courts need to decide whether or not to punish a person with MPD who has committed a crime. This paper will explore that issue and propose a test of when people with MPD should be held criminally (...) responsible. (shrink)

This paper explores whether brain images may be admitted as evidence in criminal trials under Federal Rule of Evidence 403, which weighs probative value against the danger of being prejudicial, confusing, or misleading to fact finders. The paper summarizes and evaluates recent empirical research relevant to these issues. We argue that currently the probative value of neuroimages for criminal responsibility is minimal, and there is some evidence of their potential to be prejudicial or misleading. ABSTRACT In “What is terrorism?” Igor Primoratz defines ‘terrorism’ as “the deliberate use of violence, or threat of its use, against innocent people, with the aim of intimidating them, or other people, into a course of action they otherwise would not take.” I argue that this definition needs to be modified (1) by requiring that the harm or threat be to persons other than those intimidated, (2) by including aims which do not concern action, and (3) by distinguishing terrorists who (...) know they are terrorists from those who do not. All contentious moral issues--from gay marriage to abortion and affirmative action--raise difficult questions about the justification of moral beliefs. How can we be justified in holding on to our own moral beliefs while recognizing that other intelligent people feel quite differently and that many moral beliefs are distorted by self-interest and by corrupt cultures? Even when almost everyone agrees--e.g. that experimental surgery without consent is immoral--can we know that such beliefs are true? If so, how? These profound questions lead to (...) fundamental issues about the nature of morality, language, metaphysics, justification, and knowledge. They also have tremendous practical importance in handling controversial moral questions in health care ethics, politics, law, and education. Sinnott-Armstrong here provides an extensive overview of these difficult subjects, looking at a wide variety of questions, including: Are any moral beliefs true? Are any justified? What is justified belief? The second half of the book explores various moral theories that have grappled with these issues, such as naturalism, normativism, intuitionism, and coherentism, all of which are attempts to answer moral skepticism. Sinnott-Armstrong argues that all these approaches fail to rule out moral nihilism--the view that nothing is really morally wrong or right, bad or good. Then he develops his own novel theory,--"moderate Pyrrhonian moral skepticism"--which concludes that some moral beliefs can be justified out of a modest contrast class but no moral beliefs can be justified out of an extreme contrast class. While explaining this original position and criticizing alternatives, Sinnott-Armstrong provides a wide-ranging survey of the epistemology of moral beliefs. (shrink)

A strong tradition in philosophy denies the possibility of moral dilemmas. Recently, several philosophers reversed this tradition. In this dissertation, I clarify some fundamental issues in this debate, argue for the possibility of moral dilemmas, and determine some implications of this possibility. ;In chapter I, I define moral dilemmas roughly as situations where an agent morally ought to adopt each of two alternatives but cannot adopt both. Moral dilemmas are resolvable if and only if one of the moral oughts overrides (...) the other. ;In chapter II, I criticize several opponents of moral dilemmas, including utilitarians, Kant, Aquinas, and Ross. My main criticism is that no opponent of moral dilemmas can adequately justify moral residue . ;Chapters III and IV concern the two main arguments against the possibility of moral dilemmas. First, the argument for 'ought' implies 'can' runs as follows. If the agent cannot adopt both, then it is not the case that the agent ought to adopt both. But the agent ought to adopt both, since the agent ought to adopt each . Thus, the defining judgements of a moral dilemma seem to imply a contradiction. In response, I argue that the relation between 'ought' and 'can' is not a logical implication but a conversational implicature. ;Chapter IV concerns the argument from 'ought' implies 'permitted': If the agent ought to adopt one alternative, then the agent is permitted to adopt that alternative, which means that it is not the case that the agent ought not to adopt that alternative. But the agent ought not to adopt that alternative, since the agent ought to adopt the other alternative and cannot adopt both. I respond that 'ought' does not logically imply but conversationally implicates 'permitted'. ;In chapter V, I argue that, despite recent claims, both moral realism and anti-realism are compatible with the possibility of moral dilemmas. Thus, there are several reasons to accept and no reasons to deny the possibility of moral dilemmas. (shrink)

This essay (1) gives an overview of thought experiments, especially in mathematics; (2) outlines three major positions on the current dose-response controversy for ionizing radiation; and (3) sketches an original mathematical thought experiment that might help resolve the low-dose radiation conflict. This thought experiment relies on the assumptions that radiation "hits'' are Poisson distributed and that background conditions (...) cause many more radiation-induced cancers than human activities. This English translation of On Anger provides a newly read and supplemented Greek text of one of the most important "Herculaneum papyri," the only collection of literary texts to survive the eruption of Vesuvius in 79 CE. On Anger is our sole evidence for the Epicurean view of what constitutes natural and praiseworthy anger, as distinguished from unnatural pleasure in vengeance and cruelty for their own sake, a view that can be shown to have influenced Latin authors like Cicero, Horace (...) and Virgil. Epicurus is one of the first social contract theorists, holding that justice is an agreement neither to harm nor be harmed. He also says that living justly is necessary and sufficient for living pleasantly, which is the Epicurean goal. Some say that there are two accounts of justice in Epicurus -- one as a personal virtue, the other as a virtue of institutions. I argue that the personal virtue derives from compliance with just social institutions, and so we need to (...) attribute only one account of justice to Epicurus. I show how this interpretation makes sense of claims about justice by Epicurus and his followers, including Hermarchus, Lucretius, and Diogenes of Oinoanda. (shrink)

Modality, morality and belief are among the most controversial topics in philosophy today, and few philosophers have shaped these debates as deeply as Ruth Barcan Marcus. Inspired by her work, a distinguished group of philosophers explore these issues, refine and sharpen arguments and develop new positions on such topics as possible worlds, moral dilemmas, essentialism, and the explanation of actions by beliefs. A prominent view of psychopathic moral reasoning suggests that psychopathic individuals cannot properly distinguish between moral wrongs and other types of wrongs. The present study evaluated this view by examining the extent to which 109 incarcerated offenders with varying degrees of psychopathy could distinguish between moral and conventional transgressions relative to each other and to nonincarcerated healthy controls. Using a modified version of the classic Moral/Conventional Transgressions task that uses a forced-choice format to minimize strategic responding, the present study found (...) that total psychopathy score did not predict performance on the task. Task performance was explained by some individual subfacets of psychopathy and by other variables unrelated to psychopathy, such as IQ. The authors conclude that, contrary to earlier claims, insufficient data exist to infer that psychopathic individuals cannot know what is morally wrong. (shrink)

The Idea of a Moral Economy is the first modern edition and English translation of three questions disputed at the University of Paris in 1330 by the theologian Gerard of Siena. The questions represent the most influential late medieval formulation of the natural law argument against usury and the illicit acquisition of property. Together they offer a particularly clear example of scholastic ideas about the nature and purpose of economic activity and the medieval concept of a moral economy. Throughout the history of philosophy, skepticism has posed one of the central challenges of epistemology. Opponents of skepticism--including externalists, contextualists, foundationalists, and coherentists--have focussed largely on one particular variety of skepticism, often called Cartesian or Academic skepticism, which makes the radical claim that nobody can know anything. However, this version of skepticism is something of a straw man, since virtually no philosopher endorses this radical skeptical claim. The only skeptical view that has been truly held--by Sextus, Montaigne, Hume, Wittgenstein, and, (...) most recently, Robert Fogelin--has been Pyrrohnian skepticism. Pyrrhonian skeptics do not assert Cartesian skepticism, but neither do they deny it. The Pyrrhonian skeptics' doubts run so deep that they suspend belief even about Cartesian skepticism and its denial. Nonetheless, some Pyrrhonians argue that they can still hold "common beliefs of everyday life" and can even claim to know some truths in an everyday way. This edited volume presents previously unpublished articles on this subject by a strikingly impressive group of philosophers, who engage with both historical and contemporary versions of Pyrrhonian skepticism.
