John Rawls was the most influential political philosopher of the 20th century. His magnum opus, A Theory of Justice, revolutionised moral and political philosophy by offering a deductive way out of the intellectually unsatisfying reliance on brute intuitionism while avoiding the pitfall of irrelevance by implausibility that had plagued other contract arguments. Rawls’s elegant, novel and innovative approach provided a parsimonious solution to the problem of distributive justice by using, mutatis mutandis, the familiar device of the social contract. His was (...) an ambitious project that attempted to “provide a deductive basis for the principles that account for [our considered] judgements” (1971: p. 185). Indeed, Rawls stated categorically that his argument was meant to be “strictly deductive,” going as far as to say “we should strive for a kind of moral geometry with all the rigor which this name connotes” (p. 121). Rawls’ grand ambitions, however, did not long survive: under intellectual pressure from several directions he retreated into a somewhat relativistic intuitionism, saying he no longer wanted to discover universal moral principles, but rather principles ‘appropriate’ to modern democracies. I will not attempt engage with or summarize the vast literature of responses to A Theory of Justice that led Rawls down this path. Instead, I will diverge from the later Rawls and defend his original conclusion – i.e. his principles of justice – while modifying parts of his argument. Specifically, I will argue that it is crucial to notice that the veil of ignorance screens out two different types of particular information: information about individuals and information about society. A veil that screens out only the first type of information is a “thin” veil, while one that screens out both the first and second types is a “thick” veil. I will conclude that Rawls’ own methodological commitments – particularly, pure procedural justice – are compatible only with a thin veil of ignorance but, despite this, that broadly Rawlsian principles still emerge from the original position. The alienation of labour is both classical and contemporary. In its classical form, it speaks to the potential dehumanisation of workers in capitalist societies. In its contemporary form, it manifests itself in the disenfranchisement of the individual because of changes in organised global workplaces. Over the years, Africa’s labour transition from traditional spirituality to contemporary organised global workplaces has fuelled new forms of public labour alienation. Civil servants, in some African countries, experience labour alienation reminiscent of work under capitalism. This (...) is in contradiction to the pre-colonial and traditional view of work as a vocation. Zimbabwe is undergoing negative economic, social, and political growth that has resulted in the alienation of civil servants. The government reneges on its public role of providing space for individual growth and well-being in preference for ‘public capitalism’ and cultural alienation. The potential for an effective public service lies in changing the work culture. Contribution: This article interrogates the impacts of the work culture within the public service in Zimbabwe in an attempt to proffer a return to the African traditional spirituality of work that was founded on the principles of ubuntu. It recognises the traditional symbiotic relationship between being and doing among the indigenous African communities as the panacea for the continent’s human capital development. (shrink)

This article argues that the early Christian ?order of widows? provides a fruitful model for Christian ethicists struggling to address the medical and social problems of elderly women today. After outlining the precarious state of the ?almanah? - or widow - in biblical times, it describes the emergence of the order of widows in the early Church. Turning to the contemporary situation, it argues that demographics both in the United States and around the globe suggest that meeting the needs of (...) elderly women will become an enormous challenge in the years to come. The order of widows illustrates a three-fold conception of solidarity that has immediate implications today. That conception of solidarity encourages us: 1) to identify the unique medical needs of elderly women (e.g., osteoporosis); 2) to find ways of overcoming their societal isolation, which can increase their risk of medical and psychological problems; and 3) to develop strategies for enabling them to remain contributing members of the community for as long as possible. This essay is a slightly revised version of a keynote address given by the author at a conference on ?Women?s Health and Human Rights? held in Rome, Italy in February 1998 and sponsored by the Vatican, Georgetown University, and the Università Cattolica del Sacro Cuore. Developing an intellectualist account of skill, Stanley and Williamson define skill as a kind of disposition to action-guiding knowledge. The present paper challenges their definition of skill. While we don’t dispute that skill may consist of a cognitive, a dispositional, and an action-guiding component, we argue that Stanley and Williamson’s account of each component is problematic. In the first section, we argue, against Stanley and Williamson, that the cognitive component of skill is not a case of propositional knowledge-wh, which is (...) typically indexical. In the second section, we seek to show that Stanley and Williamson face difficulties in arguing for a generic claim about skill as a kind of disposition, and they fail to defend intellectualism about skill based on the dispositional account. In the third section we argue that Stanley and Williamson need a more detailed account of the action-guiding aspect of skill to avoid several difficulties, including a threat of a regress. We close with some lessons for the debate over intellectualism and anti-intellectualism about skill. (shrink)

This essay serves as an introduction to this issue of the Journal of Medicine and Philosophy on commodification and health care. The essay attempts to sharpen the articulation of generally expressed worries about the commodification of health care. It does so by defining commodification, analyzing three components of the good of health care, and attempting to assess how commodification might distort the shape of each of those components. Next, it explores how the good of health care might be distorted by (...) the market-based principle of distributive justice, "to each according to ability to pay." Finally, it identifies two basic questions about the relationship of medicine and the market that merit further exploration. How does the market-based language of "incentives" so pervasive in the world of managed care distort the complex patterns of virtue and vice that motivate actors in the health care arena? If we recognize that we cannot eliminate the influence of money from the health care system, how can we insure that the good of health care remains, in Radin's terms, "incompletely commodified"? We demonstrate that the key components of cognitive architectures (declarative and procedural memory) and their key capabilities (learning, memory retrieval, probability judgment, and utility estimation) can be implemented as algebraic operations on vectors and tensors in a high‐dimensional space using a distributional semantics model. High‐dimensional vector spaces underlie the success of modern machine learning techniques based on deep learning. However, while neural networks have an impressive ability to process data to find patterns, they do not typically model high‐level cognition, and (...) it is often unclear how they work. Symbolic cognitive architectures can capture the complexities of high‐level cognition and provide human‐readable, explainable models, but scale poorly to naturalistic, non‐symbolic, or big data. Vector‐symbolic architectures, where symbols are represented as vectors, bridge the gap between the two approaches. We posit that cognitive architectures, if implemented in a vector‐space model, represent a useful, explanatory model of the internal representations of otherwise opaque neural architectures. Our proposed model, Holographic Declarative Memory (HDM), is a vector‐space model based on distributional semantics. HDM accounts for primacy and recency effects in free recall, the fan effect in recognition, probability judgments, and human performance on an iterated decision task. HDM provides a flexible, scalable alternative to symbolic cognitive architectures at a level of description that bridges symbolic, quantum, and neural models of cognition. (shrink)

Reproductive Health Services 1 in the summer of 1989, it was widely prel 109 S. Ct. 3040 (1989). All further citations to Webster will be given parenthetically in the text. To summarize the most significant aspects. of (...) the decision: A. Chief Justice Rehnquist authored an opinion of the Oourt (of the highest precedential value) which was joined by Justices White, Kennedy, Scalia, and O'Connor. The majority found the lower courts to be in error in striking down as unconstitutional the preamble to a Missouri statute which asserted that "the life -0f each human being begins at conception." The opinion of the Court also found that Missouri could constitutionally prohibit the use of public employees and facilities in the performance of abortions not necessary to save the mother's life. B. The Court also upheld the Missouri statute's provision requiring a. doctor to perform viability tests before aborting a fetus the doctor believes is of 20 or more weeks gestational age. In the plurality opinion (of less precedential value than an opinion -0f the Court, since it is not joined by a majority of the justices), Chief Justice Rehnquist, Justice White, and Justice Kennedy argued that since most fetuses are not viable at twenty weeks, the provision would impose substantial restrictions unrelated to the health of the mother upon what are, in fact, simply sec-0nd trimester abortions. Because they believed such restrictions to be in tension with Roe's trimester system, the plurality decided to abandon that system, along with its stipulation that the state's interest in unborn life became compelling only at viability. The plurality contended, however, that Webster presented no occasion for reconsidering Roe's holding, which deemed unconstitutional a statute prohibiting all abortions except those necessary to save the life of the mother. In a concurring opinion, Justice Scalia went further, arguing that the Court should explicitly overrule Roe v. Wade. On the other hand, Justice O'Connor, 848 344 M. This article considers the sort of diversity in perspective appropriate for a presidential commission on bioethics, and by implication, high-level governmental commissions on ethics more generally. It takes as its point of comparison the respective reports on human cloning produced by the National Bioethics Advisory Commission, appointed by President Bill Clinton, and George W. Bush's President's Council on Bioethics, under the leadership of its original chair, Leon Kass. I argue that the Clinton Commission Report exemplifies forensic diversity (the type of (...) diversity between contesting parties in a legal case), while the Kass Council Report exemplifies academic diversity (the diversity found in a medieval disputatio). Drawing upon Thomas Aquinas, I argue that the type of diversity most appropriate for such advisory bodies is deliberative diversity, which facilitates the President's process of taking counsel. After considering their respective charges, I suggest that neither the Clinton Commission nor the Kass Council possessed an adequate degree of deliberative diversity for their respective tasks. All illness represents a state of diminished autonomy and therefore the doctor-patient relationship necessarily and justifiably involves a degree of medical paternalism argues the author, an American medical student. In a broad-ranging paper he discusses the concepts of autonomy and paternalism in the context of the doctor-patient relationship. Given the necessary diminution of autonomy which illness inflicts, a limited form of medical paternalism, aimed at restoring or maximising the patient's autonomy is entirely acceptable, and indeed fundamental to the relationship he (...) argues. The report produced by the National Bioethics Advisory Commission at the request of President Bill Clinton, titled Cloning Human Beings, provides a good example of the two-pronged approach to religion in bioethics. The report merits careful scrutiny precisely because of the deftness with which it appears to negotiate the thorny questions surrounding the role of religion in public policy. Analysis of the structure, arguments, and rhetoric of the report reveals the theoretical and practical inadequacy of the currently reigning two-pronged approach (...) to the role of religious perspectives in the field of bioethics. Much has been published about the ethical issues encountered by clinicians in genetics/genomics, but those experienced by clinical laboratory scientists are less well described. Clinical laboratory scientists now frequently face navigating ethical problems in their work, but how they should be best supported to do this is underexplored. This lack of attention is also reflected in the ethics tools available to clinical laboratory scientists such as guidance and deliberative ethics forums, developed primarily to manage issues arising within the clinic.We explore (...) what ethical issues are being experienced by clinical scientists, how they think such issues could be best analysed and managed, and whether their practice might be enhanced by more situated approaches to ethics deliberation and practice such as ethical preparedness. From thematic analysis of cases presented by clinical scientists at a specially convened meeting of the UK Genethics Forum, we derived three main ethical themes: (1) the redistribution of labour and responsibilities resulting from the practice of genomic medicine; (2) the interpretation and certainty of results and (3) the proposal that better standardisation and consistency of ethical approaches (for example, more guidelines and policy) could resolve some of the challenges arising.We argue that although standardisation is important for promoting shared understandings of good (including ethical) practice, supplementary approaches to enhance and sustain ethical preparedness will be important to help clinical scientists and others in the recently expanded genetic/genomic medicine environment foster quality ethical thinking. In "Democracy and Tradition," Jeffrey Stout contends that American constitutional democracy constitutes a well-functioning moral and political tradition that is not hostile to religion, although it does not depend on any specifically religious claims. I argue that Stout's contention is supported by a consideration of the great common law subject of contracts, as taught to first-year law students across the United States. First, I demonstrate how contract law can fruitfully be understood as a Maclntyrean tradition. Second, I illustrate the moral (...) richness of this tradition, and the mutually interpreting nature of rules and facts, by close attention to one particularly colorful case, Syester v. Banta. I conclude by suggesting that both religious and secular ethicists might find common law cases in general and contract law cases in particular to be a source of moral reflection that is substantively rich without being religiously divisive. The teratogenic effect of ethanol on human and animal embryos is now well documented. Recent studies have clearly demonstrated that ethanol and related spindle‐acting agents may additionally interfere with normal meiotic chromosome segregation during oocyte maturation, leading to the production of aneuploid embryos. The mode of action, and potential hazard posed by these agents is considered.

: This article draws upon the Roman Catholic distinction between "ordinary" and "extraordinary" means of medical treatment to analyze the case of "Jodie" and "Mary," the Maltese conjoined twins whose surgical separation was ordered by the English courts over the objection of their Roman Catholic parents and Cormac Murphy-O'Connor, the Roman Catholic Cardinal Archbishop of Westminster. It attempts to shed light on the use of that distinction by surrogate decision makers with respect to incompetent patients. In addition, it critically analyzes (...) various components of the distinction by comparing the reasoning used by Catholic moralists in this case with the reasoning used in other cases that raise similar issues, including women facing crisis pregnancies who prefer abortion to adoption and the Indiana "Baby Doe" case. This essay invites Christian ethicists to engage in a mutually beneficial conversation with the secular law, particularly the common law. It argues that the common law's feature of narrative accountability provides a natural bridge to Christian ethics. It also points out contact points between the two fields regarding normative concepts of persons, actions, norms, and the common good. Finally, it illustrates the possibilities of a conversation between law and Christian ethics by delving into the leading case on the doctrine of (...) unconscionability, which permits courts to refuse to enforce contracts that shock the conscience. Recent advanced statistical analysis of complex spikes has revealed that their instantaneous firing rate within a time bin of a few milliseconds carries information if many trials are averaged, as happens in motor learning. The firing rate encodes sensory error signals in the inverse-dynamics motor-command coordinates, and these are exactly the same coordinates as for simple spikes. This strongly supports the most critical assumption of the feedback-error-learning model and argues against several hypotheses about the functions of the complex spikes. Russian-Australian relations in the sphere of nuclear power are studied in this article. The history, evolution, current state and prospects of these relations are analyzed. Two agreements between the USSR/Russia and Australia on cooperation in the use of nuclear energy for peaceful purposes of 1990and 2007 are studied and compared. The difference between two agreements is analyzed. Positive influence of these agreements on the intergovernmental relations is emphasized. According to the new agreement the expansion of cooperation in the sphere of (...) peaceful use of nuclear energy comparing with the previous agreement is also underlined. The cooperation in the sphere of supply and trade of Australian uranium using international fuel cycle center at Angarsk for enrichment is analyzed and defined as good and profitable for both countries. The positive influence of the cooperation on all spheres is emphasized. Factors influencing on the development of the relations are outlined. The change of political situation led to the confrontation between partners and the suspension of Australian uranium sales to Russia. The suspension of cooperation instead of written and ratified agreement led to significant degradation of Russian-Australian relations in economic and humanitarian spheres. (shrink)

In recent years, the non-relativistic quantum dynamics derived from three assumptions; probability current conservation, average energy conservation, and an epistemic momentum uncertainty. Here we show that, these assumptions can be derived from a natural extension of classical statistical mechanics.

If the exclusive promotion of values inimical to our basic humanity extends to the health care policy arena, we face a defensive, restricted, impersonal and ultimately impoverished health care system. Americans know it already as ‘managed-care’. This is why it is crucial for health policy analysts to make explicit the role of values in policy-making, especially that involving the input of ‘value-neutral’ economics. The nature of any clinical effectiveness policy will be determined by the understanding of cost-effectiveness employed in its (...) design and implementation. Given that cost-effectiveness is nowadays usually defined according to health economists’ criteria, the battle over the meaning of clinical effectiveness is a significant development in health economics’ move to assume control of the NHS.
