As doutrinas sociais das igrejas, especialmente a igreja católica, estabelecem compromissos com os excluídos e promovem o desenvolvimento integral da pessoa humana, (...) buscando justiça social e econômica. Palavras-chave: Evolução Cultural; Religião; Crise da Biodiversidade; Política Ambiental; Papel da Igreja.In this International Year for the Conservation of Biodiversity, I reflect on the increasing responsibilities of religious entities towards solving the present Environmental Crisis. I provide a retrospect on the debate over the origin of religions in the context of the cultural evolution of man. I then mention some ecological dimensions of religious thinking, which are particularly significant for approaching environmental problems. Religious paradigms originate in ways that are similar to those in science. The social doctrines of churches establish compromises for excluded groups and promote the unabridged development of the human individual, which includes social and economic justice. This has implications for the ecological balance of nature and for the future of humanity. I suggest that the Church should act more intensely, integrated with science, in the political intermediation that searches for solutions for our environmental problems. Religious morality could help to restore the economical benefits resulting from the sustainable use of genetic biodiversity to local cultures. I also foresee a larger role of the church in promoting human perceptions regarding the benefits involved in obtaining a more sustainable relationship with nature and in promoting a more rational exploitation of natural resources. The conservation of biodiversity represents a moral matter demanding urgent legislation for the survival of natural ecosystems and, ultimately, of the human species. Although tranquility is a fundamental aspect of human life, the experiential nature of tranquility remains elusive. Traditionally, many philosophical, religious, spiritual, or mystical traditions in East and West have strived to reach tranquil experiences and produced texts serving as manuals to reach them. Yet, no attempt has been made to compare experiences of tranquility and explore what they may have in common. The purpose of this theoretical study is to explore the experiential nature of tranquility. First, we present examples of (...) what we consider some of the most central experiences of tranquility in Eastern and Western traditions. For the sake of simplicity, we sort these examples into four categories based on their experiential focus: the body, emotions, the mind, and mysticism. Second, we offer an exploratory account of tranquility, arguing that the different examples of tranquility seem to share certain experiential features. More specifically, we propose that the shared features pertain both to the content or quality of the tranquil experiences, which involves a sense of presence and inner peace, and to the structure of these experiences, which seems to involve some degree of detachment and absorption. Despite a growing literature on identity theory in the last two decades, much of its current use in archaeology is still driven toward locating and dating static categories such as 'Phoenician,' 'Christian' or 'native.' Previous studies have highlighted the various problems and challenges presented by identity, with the overall effect of deconstructing it to insignificance. As the humanities and social sciences turn to material culture, archaeology provides a unique perspective on the interaction between people and things over the long term. (...) This volume argues that identity is worth studying not despite its slippery nature, but because of it. Identity can be seen as an emergent property of living in a material world, an ongoing process of becoming which archaeologists are particularly well suited to study. Scientists have long counseled against interpreting animal behavior in terms of human emotions, warning that such anthropomorphizing limits our ability to understand animals as they really are. Yet what are we to make of a female gorilla in a German zoo who spent days mourning the death of her baby? Or a wild female elephant who cared for a younger one after she was injured by a rambunctious teenage male? Or a rat who refused to push a lever for food (...) when he saw that doing so caused another rat to be shocked? Aren’t these clear signs that animals have recognizable emotions and moral intelligence? With _Wild Justice_ Marc Bekoff and Jessica Pierce unequivocally answer yes. During the AIDS crisis, natural law arguments have turned up again not only in relation to anti-sodomy arguments, but even as parts of important claims about AIDS prevention made by the medical and scientific community. Such arguments were invoked by the state of Georgia in the 1986 Supreme Court case, Bowers v. Hardwick, in which the Court held that the Constitution does not confer a fundamental right upon homosexuals to engage in sodomy. As we shall see, the Court accepted a (...) version of legal moralism ignoring both the relevance of a right to privacy and two friend-of-the-Court briefs urging them to consider the public health implications of prohibiting homosexual sodomy. I want to argue against legal moralism both in its standard form and in a more sophisticated version that permits natural law arguments a place in legal reasoning. Natural law arguments have aggravated the AIDS crisis by contributing not only to bad law but to bad science. (shrink)

This paper offers a qualified defence of physician non-compliance with antiabortion legislation in the wake of the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization. The paper examines two ethically troubling trends of post-Dobbs legislation: narrow and vague maternal health exemption clauses and mandatory reporting of miscarriages in jurisdictions where patients may criminal prosecution for medically induced abortions. It then examines and defends a professional obligation on the part of physicians to comply with the law. This obligation, however, (...) is defeasible. The paper then argues that physicians’ obligations to comply with the law is defeated when the law is illegitimate and following the law would constitute bad medical practice. Finally, it argues that the ethically troubling trends in post-Dobbs antiabortion legislation may meet these criteria. (shrink)

They share certain methodological and epistemological concerns, offer similar challenges to traditional philosophy, and take up a number of the same practical issues. The two disciplines have thus far had little or no direct interaction; this is one attempt to begin some conversation and perhaps stimulate some cross-pollination of ideas. PierceMuch modern criticism follows a long tradition by attending to the presumed effect of literature on our personal and political lives. Feminists, cultural materialists, new historicists, and postcolonialists frequently remind us that texts are "not innocent," and such analysts seek to make explicit the values and judgments that literary texts encourage in their readers. Whether in the vein of unmasking or of celebrating, we (...) critics often attribute great ethical and political significance to the works we study, but we are inclined to be vague about the mechanisms by which these effects occur. Given that I share this presumption that the texts we love to study matter to our lives, I would like to look more closely at how the process occurs, taking Milton's Paradise Regained as a test case.Does our reading of literary texts affect us ethically, and should it?1 An ancient and powerful critical tradition has taken for granted that the answer to both questions is yes. At the very least, good literature read properly is seen as one among the shaping forces of our education. But, beginning in the late eighteenth century, the theoretical movement to separate esthetics from ethics rendered this assumption problematic. Perhaps the beautiful is a value quite separate from the good. Later the literary school of estheticism brashly proclaimed the triumph of beauty over goodness under the banner of art for art's sake, [End Page 208] and Auden more modestly noted in "In Memory of W. B. Yeats" that "poetry makes nothing happen,"2 presumably including in the denial the moral betterment of its readers. The idea that literature is good for us has been almost embarrassing for the past century or so. On the other hand, many feminists and cultural critics have recently argued in effect that literature is often bad for us, that it is implicated in the ethical and political life of the time when it is produced and also in the time when it is received or consumed, so that it may tend to reinforce the ideology of one period or the other. In their assumption that literature is ethically significant they agree with most ordinary people and with the cultural right, especially in concern about its influence.What does this recent set of contentions entail? The term "implicated" that is characteristically used in such analysis claims at a minimum that the literary text in question has been shaped in production, consumption, or both by larger cultural forces, shaped in such a way as to incorporate certain values. Most such analyses go further to assert or suggest that the text under study helps to reinforce those values in the original audience or in later consumers (sometimes by attacking opposed values).3 The characteristic rhetorical stance in such readings is an implied warning to the reader against the insidious effect of the text lest it instill some fallacious, unethical, or politically harmful attitude or idea. Often the reader is rhetorically invited to share a position of intellectual superiority along with the critic, both of them above the corruption that afflicts an unspecified gullible audience. Thus many modern critics identify a romanticizing of war and the military hero in Shakespeare's Henry V, though they differ among themselves in that some locate both poison and cure in the text itself (suggesting, for example, that Shakespeare subverts the official ideology that he portrays), while some offer a "reading against the text," a cure administered by the critic against the wholly poisonous work.Such critics frequently manifest a reasonable caution about their own ethical and political stance. In an age of widespread pluralism and cultural relativism, we have learned to suspect self-confident proclamations of the ethical and political truth by critics as well as by literary authors, and in particular we are suspicious of official codes of conduct, including our own. Pierce SINCE TERMS ARE THE TOOLS of literary study, it is important to keep these tools in good condition, above all by having clear and functional meanings for them. Notoriously, many critical arguments about texts are in fact differences about terminology, and many confused arguments are built on vague or arbitrarily used terms. Few (...) have been the subject of more critical worrying and infighting than "poetry," 1 and few are more disparately defined. Definitions that are fuzzy or tendentious confuse many a discussion of poetry, and in particular they often narrow our response to the rich variety of the texts in front of us by silently imposing a view of what poetry ought to be. I would like to suggest that a Wittgensteinian approach to meaning can cut through a lot of the difficulty that surrounds the term. The refined understanding of the term "poetry" will result in a certain demystification, but it will dissipate only a false mystery based on confusion, not the real mystery of depth and richness that poetry can offer.What does it mean to approach this issue as a Wittgensteinian? The main principle is that the meaning of a term is its use, the way people deploy it in their speaking and writing, the work that it does. 2 A word does not have an essential core of meaning of which the various social uses are approximations; rather those social uses are the meaning. Thus meaning is a social phenomenon, and the way to determine it is to [End Page 151] look outward at how people use a term, not inward for some presumed mental essence that the term designates. What the term "poetry" refers to is a group of publicly visible things in the social world that we call poems, but there is no distillation in the mind that is the essence of poetry, the sense of the term. Of course we have a sense of the term that controls its range of reference. That sense is made up of our bases for calling one thing poetry and not another: the qualities that incline us to see a text as a poem. Wittgenstein would call these defining qualities criteria. The crucial fact is that they are determined by social processes and so are available to public inspection, not hidden away to be discovered only by introspection.Another observation about what it is to assign meaning to a term is important here. If someone asserts that "poetry" means X, he or she can appropriately be asserting that in fact the offered definition describes how people use the term, or else he or she can be suggesting how the term should or will be used in a specific discourse, that is, offering a definition proposal or stipulative definition. In the latter case the proposer needs to show the utility of the change from ordinary speech for his or her purposes. That is of course what literary critics do when they specify meanings for a term like "tragedy" or "irony" that are different from common usage. It is not that Wayne Booth's way of talking about irony uses the real meaning (both his and the ordinary senses are perfectly real since both are socially used), but that his is more useful for literary criticism than the general usage because it is more precise and nuanced. 3Thus it would make sense to begin defining "poetry" by looking at how people use the term and in particular how it is used in literary discourse. In this thesis, I defend John Rawls’s assertion that political liberalism does not use the concept of truth. I respond to objections from Joshua Cohen and David Estlund. I argue that Cohen fails to show that public reason needs a minimalist conception of truth, since individuals with a range of conceptions of moral truth can meet the requirements of public reason. I dispute Estlund’s argument that the liberal principle of legitimacy is merely insular. Estlund assumes that the claim that the (...) liberal principle of legitimacy is reasonable is no different than the claim that the principle is acceptable to reasonable persons. I argue that this assumption is incorrect, and that therefore the liberal principle of legitimacy is justifiable on the grounds that it is reasonable. I argue that political liberals need not worry that doing without the concept of truth will undermine the semantic coherence or objectivity of political liberalism. (shrink)

Significant changes in the natural environment over the past 40 years pose key challenges to health and health care in the 21st century. Health care has not yet given serious attention to what the current environmental situation means for human health, or for maintaining an effective health care system. Bioethics is in a good position to help health professionals engage environmental questions. But bioethics, as a field, will first need to explore and integrate ecological thinking —thinking based in the concept (...) of connectedness and committed to viewing humans are part of nature rather than exempt from it. Public health ethicists face two difficult questions. First, what makes something a matter of public health? While protecting citizens from outbreaks of communicable diseases is clearly a matter of public health, is the same true of policies that aim to reduce obesity, gun violence or political corruption? Second, what should the scope of the government’s authority be in promoting public health? May government enact public health policies some citizens reasonably object to or policies that are paternalistic? Recently, some theorists have (...) attempted to address these questions by arguing that something is a matter of public health if and only if it involves a health-related public good, such as clean water or herd immunity. Relatedly, they have argued that appeals to the promotion of public health should only be used to justify the provision of health-related public goods. This public goods conception of public health (PGC) is meant to enjoy advantages over its rivals in three respects: it provides a better definition of public health than rival views, it respects moral disagreement, and it avoids licensing objectionably paternalistic public health policies. We argue, however, that the PGC does just as poorly, or worse, than its rivals in all three respects. (shrink)

A quick tour through an average U.S. hospital gives pause to anyone with even a rudimentary concern for environmental issues. To a careful observer, the typical U.S. hospital presents an array of challenges to the health of ecosystems. For example, hospitals consume vast quantities of natural resources. The most obvious of these are fossil fuels, which form the basic building blocks of the industrialized medical care industry. Aside from the worry that our healthcare systems are technologically and functionally dependent upon (...) nonrenewable, relatively scarce, and politically volatile resources, our heavy reliance on fossil fuels has important ill effects, including unfavorable health outcomes for humans. For example, the combustion of fossil fuels is the driving force behind global warming, which will likely result in increasing heat-related mortality and morbidity and may contribute to the spread and resurgence of infectious diseases around the world. Also, the combustion of coal and oil releases pollutants such as sulfur oxides, nitrogen oxides, and ground-level ozone that contribute to various respiratory ailments. In addition to being energy intensive, the modern hospital uses a great deal of water, wood, paper, metals, minerals, plastics, chemicals, food, and land. (shrink)

The use of social media as a recruitment tool for research with humans is increasing, and likely to continue to grow. Despite this, to date there has been no specific regulatory guidance and there has been little in the bioethics literature to guide investigators and institutional review boards faced with navigating the ethical issues such use raises. We begin to fill this gap by first defending a nonexceptionalist methodology for assessing social media recruitment; second, examining respect for privacy and investigator (...) transparency as key norms governing social media recruitment; and, finally, analyzing three relatively novel aspects of social media recruitment: the ethical significance of compliance with website “terms of use”; the ethics of recruiting from the online networks of research participants; and the ethical implications of online communication from and between participants. Two checklists aimed at guiding investigators and IRBs through the ethical issues are included as appendices. (shrink)

Four audit cases and questionnaires were distributed to experienced pre-manager level auditors in Ireland and the U. S. The findings revealed that while perceived unethical pressure to engage in dysfunctional behaviours and unethical tone at the top were significant in forming an ethical evaluation, only perceived unethical pressure had an (...) impact on intention to engage in the behaviours. Country was also found to have a significant impact, with U. S. respondents reporting higher ethical evaluations and lower intentions to engage in unethical acts than Irish respondents. An attempt is made to give a coherent account of the logical essence of the Copenhagen interpretation of quantum theory. The central point is that quantum theory is fundamentally pragmatic, but nonetheless complete. The principal difficulty in understanding quantum theory lies in the fact that its completeness is incompatible with external existence of the space—time continuum of classical physics.

A philosophical and practical model for approaching the ethical challenges librarians are facing is provided in this work. The moral value of information is first examined, prompting a rethinking of librarians' understanding of professional neutrality and calling for them to broaden their role as community information specialists. Organizational ethics are next covered; the authors recommend specific management styles and values appropriate to libraries. This is followed by a critical analysis of the culture and tradition of librarianship, showing how the field (...) has reached its current identity and how its history can provide insights for new professional values. In this article I respond to the obligation to institute the policy of decoupled crop subsidies as is provided in Pilchman’s article “Money for Nothing: Are decoupled Crop Subsidies Just?” With growing problems of poor nutrition in the United States there have been two different but related phenomenon that have appeared. First, the obesity epidemic that has ravaged the nation and left an increasing number of people very unhealthy; and second, the phenomenon of food deserts where individuals are unable to (...) access fresh fruits and vegetables. A possible solution to this problem, as has been proposed by some, is to institute a decoupled crop subsidy that would increase the production of fruits and vegetables in the United States. In this paper I explore the possible unintended consequences of this policy and how it may violate liberal international conceptions of justice. I conclude that there must be further empirical research before anyone can call decoupled crop subsidies an obligation to justice. (shrink)
