The aim of this paper is to offer a Henrian interpretation of the debate between Sartre and Merleau-Ponty concerning the place of the imaginary in the perceptive life. The hypothesis is that in Sartre, Merleau-Ponty and Henry, the role of the imaginary in the original affective experience which the perceptive life has of its own intrinsic vulnerability can be investigated on three levels: the articulation between the absolute dimension and the egological dimension of consciousness in Sartre, the genesis of perception (...) in the body in Merleau-Ponty, and the immanent adherence of the perceptive act to the radical suffering of its own force in Henry. From each of these three levels, the paper shows that without an imaginary in charge of bringing it back constantly to the experience of its own original vulnerability, the perceptive life is bound to lose the aff ective density of its relation to the perceived, and therefore is bound to become disincarnate. L?objectif de cet article est de montrer à partir d?une libre reprise de certaines thèses développées par le second Merleau-Ponty qu?un certain usage de la perception est susceptible d?accroître l?épreuve que le sujet fait d?être profondément requis par le sens d?une situation qu?il est en train de vivre. Notre hypothèse est qu?il est nécessaire pour ce faire que l?acte perceptif s?éprouve intrinsèquement mis en jeu par la situation à laquelle il se rapporte, mis en jeu dans l?épreuve affective qu?il fait (...) de sa possibilité originaire. Ce n?est donc pas seulement ce qui est perçu qui est susceptible de faire événement dans la vie du sujet, mais la façon dont l?acte perceptif est amené à se déployer et à éprouver sa propre possibilité au contact du perçu. Il importe en ce sens de faire une distinction entre les propriétés affectives conférées intentionnellement au perçu et l?épreuve affective que l?acte per­ceptif fait de lui-même en se rapportant à celui-ci. Nous allons ainsi défendre l?idée selon laquelle l?acte perceptif ne peut participer en profondeur à l?épreuve d?une situation qui fait événement dans la vie du sujet que s?il se laisse être profondément mis en jeu par cette situation. Au départ de cette réflexion, il importe ainsi de reconnaître que le sujet peut être ébranlé par le contenu de telle ou telle situation sans que son acte perceptif se laisse pour autant mettre. L’objectif de cet article est de construire à partir d’une reprise de certaines thèses de Michel Henry les premiers jalons d’une phénoménologie radicale du soin. Sur base d’une interrogation sur le rapport entre le souffrir originaire de la vie et son mouvement immanent d’ipséisation, l’auteur montre qu’en refusant toute forme de naturalisation du consentement du pâtir de la vie à lui-même, la phénoménologie radicale de Michel Henry permet de développer une nouvelle approche du soin, notamment du point de vue de (...) son rapport à la dimension originairement intersubjective du désir de s’éprouver de la vie. L’article se termine par une réflexion sur la dimension potentialisante d’un certain usage des rôles dans le rapport de l’acte médical à la singularité radicale de l’individu souffrant. Dans la perspective d’une phénoménologie radicale de la vie, l’acte médical ne peut pas être seulement décrit comme reposant sur l’adhésion des individus à la vie. Il est plus profondément encore amené à accroître par sa façon même de s’effectuer l’adhésion intérieure des individus au pâtir radical de leur vie. (shrink)

This paper contains a novel and coherent reading of Weberian ideal type construction, based on recent philosophical approaches to conceptual engineering. This reading makes transparent the dialectics of Weber's approach, resulting in a more nuanced interpretation of his methodological work. It will become apparent that Weber, when introducing his notion of an ideal type, did not merely summarize his views on methodology in the social sciences, but, rather, presented a two-step argument in favor of these views. The reconstruction will directly (...) bear on issues in the methodology of the social sciences. Weber not only presented a methodology that is, at some level of abstraction, strikingly similar to Carnapian explication (the canonical point of reference in the contemporary debate on conceptual engineering). He also diagnosed, in a systematic fashion, types of problems we face when dealing with ordinary and scientific concepts that play a key role in the description of social reality, and he foreshadowed what is today sometimes described as “debunking” projects. From a philosophy of science perspective, I propose Weber's view (on the reconstruction proposed here) as a serious candidate for an adequate theory of concept replacement in the social sciences. The paper offers an account of the structure of information provided by models that relevantly deviate from reality. It is argued that accounts of scientific modeling according to which a model’s epistemic and pragmatic relevance stems from the alleged fact that models give access to possibilities fail. First, it seems that there are models that do not give access to possibilities, for what they describe is impossible. Can animals, and especially cattle, be the subject ofmoral concern? Should we care about their well-being?Two competing ethical theories have addressed suchissues so far. A utilitarian theory which, inBentham's wake, extends moral consideration to everysentient being, and a theory of the rights orinterests of animals which follows Feinberg'sconceptions. This includes various positions rangingfrom the most radical (about animal liberation) tomore moderate ones (concerned with the well-being ofanimals). Notwithstanding their diversity, theseconceptions share some common flaws. First, as anextension of primarily anthropocentric (...) theories (aboututility or rights) they still participate in the flawsof the original setting. Second, extending them tonon-human beings raises the problem of the borderwhich is to be drawn between what can be included inthe purview of moral consideration and what is leftoutside. Third, such theories are not able to distinguishbetween an ethics of wildlife and an ethics ofdomestic life, which too often leads to preposterousstatements. We would like to argue (i) that we should distinguishbetween environmental ethics (concerned withpopulations, species, biotic communities) and animalethics (where animals are taken into consideration individually);(ii) that individualist animal ethics are not relevantfor animal rearing; (iii) that animal rearing is a hierarchicalrelationship which rules are to be found in the fiction of a domesticcontract.Hence, we would like to construct a new conception ofthe ethics of the relation between men and the cattlethey breed based on the idea of a domestic contract.Our main assumption is Mary Midgleys's anthropologicalassumption, according to which human communities,since the Neolithic age, have always included variousanimals, so that relations of sociability have alwaysexisted between human beings and animals within thedomestic community (a mixed community). In order tospecify the hierarchical and non-egalitarian, butinclusive reciprocal obligations and relations insidesuch a community, we will elaborate on the notion ofa ``domestic contract'', an implicitly assumedidea traced back to Lucretius and whichwe will follow up to the physiocrats and Adam Smith.We will show that such an idea relies upon theassumption of communication between cattle farmer andanimals, of shared experience and exchanges betweenthe two parties. We will then show how modern factory,or battery animal farming, can be seen as unilaterallybreaking this domestic contract, forsaking ourduties towards domestic animals. (shrink)

This paper analyses J.S. Mill's theory on the relationships between individual autonomy and State powers. It will be argued that there is a significant discrepancy between Mill's general liberal statements aimed to secure individual largest possible autonomy and the specific examples which provide the government with quite wide latitude for interference in the public and private spheres. The paper outlines the boundaries of government interference in the Millian theory. Subsequently it describes Mill's elastic paternalism designed to prevent people from inflicting (...) harm upon others as well as upon themselves, from soft paternalism on issues like compulsory education to hard paternalism on very private matters such as marriage, having children, and divorce by consent. Framing effects occur when different descriptions of the same decision problem give rise to divergent decisions. They can be seen as a violation of the decisiontheoretic version of the principle of extensionality (PE). The PE in logic means that two logically equivalent sentences can be substituted salva veritate. We explore what this notion of extensionality becomes in decision contexts. Violations of extensionality may have rational grounds. Based on some ideas proposed by the psychologist Craig McKenzie and colleagues, we contend that (...) framing effects are justified when the selection of one particular frame conveys choice relevant information. We first discuss this idea from a philosophical point of view, and proceed next to formalize it first in the context of the Bolker–Jeffrey decision theory. Finally, we extend the previous analysis to non-expected utility theories using the Biseparable Preference model introduced by Ghirardato and Marinacci (2001) and therefore show that the analysis is independent of the assumptions of Bayesian decision theory. To find adequate answers to a changing reality heavily influenced by advances in technology, medical professionals have developed and adopted an array of terms that have brought new concepts into the profession. “Dignity,” “vegetative state,” “futility,” “double effect,” and “brain death” have become indispensable words in the medical setting. In the following discussion, the attention is on terminology. If we believe in phenomenology, the assumption is that we should closely reflect on the words we use in all spheres of life, (...) especially in those that concern life and death. This article calls for a sincere discussion about these terms and concepts. The thesis put forward is that the language in the medical setting serves primarily the physicians, at times at the expense of the patients’ best interests. This language and the concepts it describes have generated an unhealthy atmosphere for patients, which might lead to undesirable actions at the end of patients’ lives. (shrink)

Social representations of addiction and the resulting stigmatization have been widely described and studied in the literature, but their effects are no less problematic. These representations, which also occur in care settings, generate a climate of distrust which damages the therapeutic relationship, and its ethical quality. This article, combining clinical experience and an ethical stance, offers an original, innovating approach to the existence of distrust in care relationships in the area of addiction. Pragmatic approaches deriving from the human sciences and (...) analytical philosophy provide an invitation to escape from the demanding climate of mistrust, and to take the gamble on trust so as to improve the quality of interactions between protagonists in care. In complementary fashion, a sociology of action can combat the disquiet generated by distrust through a new commitment to innovating forms of action. This “poetic” mode of action is legitimized by the reflection that backs it up, and by its presentation to peers qualified to approve it. Finally, continental moral philosophy underlines the importance of a carefully weighed commitment on the part of caregivers and addicted patients towards promises aiming to support a sincere care relationship, without damaging the therapeutic dynamic or the ethical quality by providing too many safety nets. This reflection is intended to achieve better identification of the clinical and ethical issues raised by mistrust, and inclusion of these aspects in the training of personnel and in care provision planning. In this article I analyze some of the troubling issues in Canadian media ethics, based on in-depth interviews with more than 50 experts on Canadian media. I begin by reflecting on the cultural considerations involved in the Canadian media's proximity to the United States. Subsequently, I discuss the problems of excessive ownership of the media by a few organizations, arguing that the right to exercise free expression does not include the right to own as many media organizations as money can (...) buy. In this context are considered the work of two Royal Commissions: the 1970 Davey Commission and the 1980 Kent Commission. Finally, I am concerned with excessive intrusion of individual privacy. When news becomes entertainment and private stories become public spectacle, individual lives can be mercilessly exposed to the glaring spotlight of unwanted publicity. In delineating the boundaries of intrusion, there is a need to distinguish between public figures and ordinary citizens, and between those who choose to live in the spotlight and ordinary citizens who stumble into the public eye. In this paper, the relation between identity-based reduction and one specific sort of reductive explanation is considered. The notion of identity-based reduction is spelled out and its role in the reduction debate is sketched. An argument offered by Jaegwon Kim, which is supposed to show that identity-based reduction and reductive explanation are incompatible, is critically examined. From the discussion of this argument, some important consequences about the notion of reduction are pointed out.

We should not understand in this title "What does not return to the same" the announcement of a return to Levinas, but rather of what the word or concept of "return" could mean in Levinas's work. There is perhaps no better way of misunderstanding Levinas than imposing on his philosophical gesture the interpretative grid of a "horizon of return". This article will attempt to dismantle the strategies of reading which stipulate that Levinas's philosophy is one of "return". In this way (...) we shall reveal the complexity of Levinasian thought, and that, beyond the numerous slogans, there are the ones of a "return" or of its simple contrary, the ones of a "philosophy of exile". The Dutch experience has influenced the debate on euthanasia and death with dignity around the globe, especially with regard to whether physician-assisted suicide and euthanasia should be legitimized or legalized. Review of the literature reveals complex and often contradictory views about the Dutch experience. Some claim that the Netherlands offers a model for the world to follow; others believe that the Netherlands represents danger, rather than promise, and that the Dutch experience is the definitive answer regarding why we should not (...) make active euthanasia and physician-assisted suicide part of our lives.Having investigated the Dutch experience for a number of years, in the summer of 1999 I went to the Netherlands to visit the major centers of medical ethics as well as some research hospitals, and to speak with leading figures in euthanasia policy and practice. This essay commences by providing some background information on the practice of euthanasia and on the legal framework, and then reports the main answers to my first question: Why the Netherlands? Flawed clinical practice guidelines may compromise patient care. Commercial conflicts of interest on panels that write treatment guidelines are particularly problematic, because panelists may have conflicting agendas that influence guideline recommendations. Historically, there has been no legal remedy for conflicts of interest on guidelines panels. However, in May 2008, the Attorney General of Connecticut concluded a ground-breaking antitrust investigation into the development of Lyme disease treatment guidelines by one of the largest medical societies in the United States, the Infectious Diseases (...) Society of America (IDSA). Although the investigation found significant flaws in the IDSA guidelines development process, the subsequent review of the guidelines mandated by the settlement was compromised by a lack of impartiality at various stages of the IDSA review process. This article will examine the interplay between the recent calls for guidelines reform, the ethical canons of medicine, and due process considerations under antitrust laws as they apply to the formulation of the IDSA Lyme disease treatment guidelines. The article will also discuss pitfalls in the implementation of the IDSA antitrust settlement that should be avoided in the future. (shrink)
