The practice of prenatal screening for disability is sometimes objected to because of the hurt and offence such practices may cause to people currently living with disabilities. This objection is commonly termed “the expressivist objection”. In response to the objection it is standardly claimed that disabilities are analogous to illnesses. And just as it would be implausible to suppose reduction of the incidence of illnesses such as flu sends a negative message to ill people, so it is not plausible to (...) suppose prevention of disability sends a negative message to disabled people. The expressivist objection hinges, however, upon a view of the relationship between disability and self identity which sees disability as part of the identity of the disabled person, in a way in which illnesses such as flu cannot be. This possibility is generally not considered in critiques of the expressivist objection. In this paper, an “identity claim” to the effect that disabilities can be identity constituting is accepted and the force of the expressivist argument is reconsidered in the light of its acceptance. It is concluded that even when such an identity claim is accepted, the expressivist objection is still not morally compelling. (shrink)

In his classic 1936 paper Tarski sought to motivate his definition of logical consequence by appeal to the inference form: P(0), P(1), . . ., P(n), . . . therefore ∀nP(n). This is prima facie puzzling because these inferences are seemingly first-order and Tarski knew that Gödel had shown first-order proof methods to be complete, and because ∀nP(n) is not a logical consequence of P(0), P(1), . . ., P(n), . . . by Taski's proposed definition. An attempt to resolve (...) the puzzle due to Etchemendy is considered and rejected. A second attempt due to Gómez-Torrente is accepted as far as it goes, but it is argued that it raises a further puzzle of its own: it takes the plausibility of Tarski's claim that his definition captures our common concept of logical consequence to depend upon our common concept being a reductive conception. A further interpretation of what Tarski had in mind when he offered the example is proposed, using materials well known to Tarski at the time. It is argued that this interpretation makes the motivating example independent of reductive definitions which take natural numbers to be higher-order set theoretic entities, and it also explains why he did not regard the distinction between defined and primitive terms as pressing, as was the distinction between logical and nonlogical terms. Much time has been spent arguing about the soundness of But in the philosophical literature there is no single such principle; there are many harm principles. And many objections pressed against are objections to only some of these principles. The first half of this paper draws a number of distinctions between harm principles. It then argues that each harm principle is compatible with many other principles that impose limits on the law, including but not limited to other harm principles. The (...) second half of the paper applies the lessons of the first to a number of prominent objections to That principle has been accused of a) being underinclusive; b) misrepresenting the reasons why many act-types ought to be legally proscribed; c) permitting lawmakers to treat people as mere means of achieving their ends; and d) being overinclusive. In the years 2020–2021, journalists, lawyers, scholars, and civil society actors noticed an unusual spike in the refusal of francophone African immigrants in Québec, Canada. While Immigration, refugee and citizenship Canada’s systemic racism problem were already documented, the novelty appeared to be how standardized and sometimes, “nonsensical” the reasons given to many of the applicants were. This eventually prompted a lawsuit against IRCC in which it was revealed that a new piece of software called “Chinook” had been deployed since 2018, (...) approximately at the same time application refusal started spiking. Online and media-fueled speculations culminated in a broad debate about whether Chinook was an artificial intelligence-based technology. Such controversy, for instance, unfolded during parliamentary consultations in which it was finally disclosed that Chinook was not AI per se., but more of a half-baked automated interface. The present article aims to understand how the performative ambiguity of Chinook informs on the progressive becoming of the Canadian Federal state and its immigration control practices in the current Machine Learning hype. Furthermore, it seeks to understand how the interlacing of public–private partnership, in which the private sector is mobilized to produce AI-driven technology, recursively transforms the exercise of governance and governmentality. We argue, through the Chinook controversy and its unfolding, that there is a shift occurring where AI becomes ever more central in statecraft “anarchitecture” and cybernetic adaptability. (shrink)

In this paper the authors argue that research ethics committees should not be paternalistic by rejecting research that poses risk to people competent to decide for themselves. However it is important they help to ensure valid consent is sought from potential recruits and protect vulnerable people who cannot look after their own best interests. The authors first describe the tragic deaths of Jesse Gelsinger and Ellen Roche. They then discuss the following claims to support their case: competent individuals are epistemologically (...) and ethically in the best position to say which risks are reasonable for them, so RECs should be no more restrictive than the “normal” constraints on people taking risks with themselves; RECs do not judge individual competence ; individual liberty is mostly limited by what serves the public interest, and RECs do not determine public interest; RECs may have a paternalistic role in preventing exploitation of competent people vulnerable to the use of incentives, and in protecting the interests of incompetent people; however, the moral and political authority of RECs has not been established in this respect. [It] rests upon the notion that existence is, so to speak, a property that you can attribute to things, and that the things that exist have the property of existence and the things that do not exist do not. That is rubbish . I have dared to puncture several metaphysical balloons and nothing came out of them but hot air.

One of the many ways that ‘deflationary’ and ‘inflationary’ theories of truth are said to differ is in their attitude towards truth qua property. This difference used to be very easy to delineate, with deflationists denying, and inflationists asserting, that truth is a property, but more recently the debate has become a lot more complicated, owing primarily to the fact that many contemporary deflationists often do allow for truth to be considered a property. Anxious to avoid inflation, however, these deflationists (...) are at pains to point out that the truth property, on their view, is not a property of any significant interest. Correspondingly, inflationists have seen this as an opportunity to refine what kind of property they think truth is, which—according to them—moves their views beyond deflationism. The upshot of this is that there are number of different accounts in the literature of what distinguishes an inflationary truth property from a deflationary one, or—as it is sometimes put—what distinguishes a ‘substantive’ property from an ‘insubstantive’ one. This has made it hard to pin down exactly what is at issue at the metaphysical level between deflationists and inflationists, which makes it increasingly hard to see how debates between them are properly phrased. Given that these positions represent the two central attitudes towards truth in contemporary debates, this makes for a serious obstacle for the project of discerning the correct theory of truth. The aim of this paper is to discern the best way to distinguish between substantive and insubstantive properties, and thus to restore some focus to these debates. I argue that the three central distinctions in the literature fail, and offer what I take to be a more promising distinction in terms of a graded distinction between abundant and sparse properties. In explaining this background, he targets the widely held assumption that the history of modern philosophy can best be understood in terms of a fundamentally unified conception of the subject and subjectivity that unfolds inevitably from Descartes and culminates in twentieth-century phenomenology and existentialism. Those who share this assumption fail to recognize the significance of what Husserl (in the Crisis of European Sciences) called the "paradox of subjectivity," which derives from the necessity of understanding the knowing subject both as a subject for the world and as an object in the world.The origins of contemporary interpretations of the metaphysics of the subject are found primarily in Heidegger's thought. Even Kant and Husserl figure as representatives of a tradition in which "the knowing subject takes the role of substance; everything is reduced to first properties, whether as immanent in consciousness, object for the subject, or, as in transcendental philosophy, construct and product of subjective activity" (Carr, 31).In chapters 2-4, Carr argues that the Heideggerian interpretation is inadequate with respect to Kant and Husserl. In supporting this position, Carr emphasizes the close affinities between Kant's and Husserl's conceptions of objectivity for consciousness and between their portrayals of subject and self. ABSTRACT Many people argue that disagreements and inconsistencies between Research Ethics Committees are morally problematic and there has been much effort to ‘harmonise’ their judgements. Some inconsistencies are bad because they are due to irrationality, or carelessness, or the operation of conflicting interests, and so should be reduced or removed. Other inconsistencies, we argue, are not bad and should be left or even encouraged. In this paper we examine three arguments to reject the view that we should strive for complete (...) consistency between committees. The first argument is that differences in judgement are not necessarily incompatible with ideas of justice for patients who are potential participants of research reviewed by different committees. We call this ‘the justice argument.’ The second argument is that such committees do not have access to a single moral truth, to which their judgement is supposed to correspond. We call this the ‘moral pluralism argument.’ The third argument is that the process of ethics committee review is also morally relevant and not solely the outcome. We call this the ‘due process argument.’ While we fall short of establishing exactly how much variation and on what substantive issues would be ethically permissible, we show that it is largely inevitable and that a certain amount of variation could be seen as a desirable part of the institution of medical research. Alethic pluralism, on one version of the view , is the idea that truth is to be identified with different properties in different domains of discourse. 1 Whilst we operate with a univocal concept of truth, and a uniform truth predicate, the thought is that the truth property changes from one domain to the next. So the truth property for talk about the nature and state of the material world may be different from the truth property for moral discourse .Tappolet (...) challenged alethic pluralism by asking how it can account for the truth of mixed compounds, such as a mixed conjunction like ‘this cat is wet and funny’, where each of the conjuncts are from different domains of discourse, and thus assessable in terms of different truth properties. She argues that the alethic pluralist is left in a dilemma: either admit of a ‘generic’ truth property, which can be possessed by propositions from all domains, thus rendering the plural ways of being true obsolete, or deny the truth of mixed conjunctions.In Edwards 2008, I argued that there is route out of Tappolet's dilemma. Briefly, I suggested that we acknowledge that the truth of a mixed conjunction is dependent on the truth of its conjuncts, and we should explain the truth of the conjunction by saying that it is true just in case each of its conjuncts is true. This, I argued, gives us an account of the truth of the conjunction without needing to appeal to a troublesome ‘generic’ truth property.Aaron Cotnoir criticizes my solution to Tappolet's problem. In this article we examine ethical aspects of the involvement of children in clinical research, specifically those who are incapable of giving informed consent to participate. The topic is, of course, not a new one in medical ethics but there are some tensions in current guidelines that, in our view, need to be made explicit and which need to be responded to by the relevant official bodies. In particular, we focus on tensions between the World Medical Association Declaration of Helsinki, (...) and the guidance offered by the British Medical Association, the Royal College of Paediatrics and Child Health , and the Council for International Organizations of Medical Sciences. We conclude with a call for these organisations to make their guidance explicit in relation to the World Medical Association Declaration. (shrink)

This article approaches Judaism through Rabbi Bradley S. Artson’s book, God of Becoming and Relationships: The Dynamic Nature of Process Theology. It explores his understanding of how Jewish theology should and does cohere with central features of both process theology and Robert S. Hartman’s formal axiology. These include the axiological/process concept of God, the intrinsic value and valuation of God and unique human beings, and Jewish extrinsic and systemic values, value combinations, and value rankings.

Clinical research under the usual regulatory constraints may be difficult or even impossible in a public health emergency. Regulators must seek to strike a good balance in granting as wide therapeutic access to new drugs as possible at the same time as gathering sound evidence of safety and effectiveness. To inform current policy, I reexamine the philosophical rationale for restricting new medicines to clinical trials, at any stage and for any population of patients (which resides in the precautionary principle), to (...) show that its objective to protect public health, now or in the future, could soon be defeated in a pandemic. Providing wider therapeutic access and coordinating observations and natural experiments, including service delivery by cluster (wedged cluster trials), may provide such a balance. However, there are important questions of fairness to resolve before any such research can proceed. (shrink)

This paper examines one particular justification for the screening and termination of embryos/fetuses which possess genetic features known to cause disability. The particular case is that put forward in several places by John Harris. He argues that the obligation to prevent needless suffering justifies the prevention of the births of disabled neonates. The paper begins by rehearsing Harris's case. Then, drawing upon claims advanced in a recent paper in the Journal of Medical Ethics, it is subjected to critical scrutiny, focusing (...) on Harris's “suffering claim” .1 It is argued that the suffering claim must be false if understood as an empirical claim. And, even if understood as a conceptual truth, it mistakenly assimilates the concepts of harm and suffering. Finally, again focusing on Harris's recent work in this area, his characterisation of disability as a “harmed condition” is shown not to apply in the case of at least some moderate forms of intellectual disability. Edwards_raises timeless questions about desire, choice, good, and evil, contrasting the opposing Calvinist and Arminian views of free will and addressing issues related to God's foreknowledge, determinism, and moral agency.

Jansen and Wall suggest a new way of defending hard paternalism in clinical research. They argue that non-therapeutic research exposing people to more than minimal risk should be banned on egalitarian grounds: in preventing poor decision-makers from making bad decisions, we will promote equality of welfare. We argue that their proposal is flawed for four reasons.First, the idea of poor decision-makers is much more problematic than Jansen and Wall allow. Second, pace Jansen and Wall, it may be practicable for regulators (...) to uncover the values that a potential research participant holds when agreeing to enter a research project, so their claim that we must ban such research projects for all if we are to ban them for poor decision-makers looks to be unmotivated. Third, there seem to be cases where the liberty to enter the sort of research project Jansen and Wall discuss is morally weighty, and arguably should outweigh concerns of egalitarian distribution. Fourth, banning certain types of research, which seem on the face of it to offer an unfavourable risk-benefit ratio, would have unwelcome consequences for all clinical research, which Jansen and Wall do not recognize. This article asks: Is the human self, the stream of human consciousness, a single unique enduring actual entity or whole (like Alfred North Whitehead’s God) or a society of transient actual occasions (like Charles Hartshorne’s God)? It argues forcefully for the former and against the latter and concludes that both God and human selves are enduring but constantly developing actual entities who are constantly being enriched by new events, experiences, and activities in time.

Alethic pluralism is the view that truth requires different treatment in different domains of discourse. The basic idea is that different properties play important roles in the analysis of truth in different domains of discourse, such as discourse about the material world, moral discourse, and mathematical discourse, to take three examples. Alethic disjunctivism is a kind of alethic pluralism, and is the view that truth is to be identified with the disjunctive property that is formed using each of the domain-specific (...) properties as disjuncts (i.e., in the view's simplest form, truth is the property of either having domain-specific property 1, or domain-specific property 2, and so on). This paper evaluates the prospects for alethic disjunctivism. In particular, it outlines the proper formulation of the view, and assesses some concerns that the disjunctive property lacks the pedigree necessary to be considered a truth property. I begin by briefly outlining the motivations for alethic pluralism, before noting four general constraints on formulations of the view. I then consider a ‘simple’ formulation of alethic disjunctivism, and recommend an amendment. I then demonstrate that the candidate truth property specified by this new formulation is able to meet the central constraints required for it to be considered a viable formulation of alethic pluralism. The final part of this demonstration involves making some distinctions between different kinds of disjunctive properties, and arguing that disjunctive properties are not necessarily highly abundant properties: some are more sparse than others. ABSTRACT In this paper, I support the claim that placing certain restrictions on public access to possible new treatments is morally problematic under some exceptional circumstances. Very ill patients may find that all available standard treatments are unacceptable, either because they are ineffective or have serious adverse effects, and these patients may understandably be desperate to try something new even if this means stepping into the unknown. Faced with certain death, it is rational to want to try something new and (...) to chance a dire outcome. Restricting possible new treatments to research trials may put these treatments scientifically, geographically or economically out of reach of these patients. For those who can get access, research restrictions could weaken, though not necessarily eliminate, the value of consent participants of such trials are able to give. Some participants may therefore be exploited for scientific purposes in the name of public interest. There are nonetheless compelling reasons for keeping some restrictive regulation in this area. What is truth? What precisely is it that truths have that falsehoods lack? Pluralists about truth (or “alethic pluralists”) tend to answer these questions by saying that there is more than one way for a proposition, sentence, belief—or any chosen truth-bearer—to be true. In this paper, I argue that two of the most influential formations of alethic pluralism, those of Wright (1992, 2003a) and Lynch (2009), are subject to serious problems. I outline a new formulation, which I call “simple determination (...) pluralism,” that I claim offers better prospects for alethic pluralism, with the potential to have applications for pluralist theories beyond truth. While researchers have examined the types of ethical issues that arise in long-term care, few studies have explored long-term care nurses’ experiences of moral distress and fewer still have examined responses to initial moral distress. Using an interpretive description approach, 15 nurses working in long-term care settings within one city in Canada were interviewed about their responses to experiences of initial moral distress, resources or supports they identified as helpful or potentially helpful in dealing with these situations, and factors that (...) hindered nurses in their responses. Using a thematic analysis process, three major themes were identified from the nurses’ experiences: (i) the context of the situation matters; (ii) the value of coming together as a team; and (iii) looking for outside direction. The work of responding to initial moral distress was more fruitful if opportunities existed to discuss conflicts with other team members and if managers supported nurses in moving their concerns forward through meetings or conversations with the team, physician, or family. Access to objective others and opportunities for education about ethics were also identified as important for dealing with value conflicts. (shrink)

We write as Australian youth work educators. We consider some of the ethical challenges involved in teaching youth work ‘in a warm climate’, situated in the diaspora of English youth work but where youth work also has a uniquely Australian character, placing us in an ethically liminal space in our teaching between an understanding of youth work that is robustly defended as being both ‘good’ and ‘true’, and what we do, which is different from this, and has its own character (...) and strengths. We situate this in the policy history of youth work in Australia, particularly in the ‘neoliberal turn’ that this has taken in the last four decades which has created ethical challenges for us, just as it has for those elsewhere. Two guiding questions shape this paper. The first is, given our differences, what challenges do we face in maintaining connections with ‘good’ youth work and its value base as traditionally defined and defended in England, and relatedly, given that policy and funding regimes in the UK seem to be aligning more with an Australian model, is there anything that the youth work community in the UK can learn from the Australian experience? The COVID‐19 pandemic has reinforced the critical role of ethics and community engagement in designing and conducting clinical research during infectious disease outbreaks where no vaccine or treatment already exists. In reviewing current practices across Africa, we distinguish between three distinct roles for community engagement in clinical research that are often conflated: 1) the importance of community engagement for identifying and honouring cultural sensitivities; 2) the importance of recognising the socio‐political context in which the research is proposed; and 3) the (...) importance of understanding what is in the interest of communities recruited to research according to their own views and values. By making these distinctions, we show that current practice of clinical research could draw on anthropology in ways which are sometimes unnecessary to solicit local cultural values, overlook the importance of socio‐political contexts and wider societal structures within which it works, potentially serving to reinforce unjust political or social regimes, and threaten to cast doubt on the trustworthiness of the research. We argue that more discerning anthropological engagement as well as wider collaboration with other social scientists and those working in the humanities is urgently needed to improve the ethics of current biomedical and pharmaceutical research practice in Africa. The ethics of care still appeals to many in spite of penetrating criticisms of it which have been presented over the past 15 years or so. This paper tries to offer an explanation for this, and then to critically engage with three versions of an ethics of care. The explanation consists firstly in the close affinities between nursing and care. The three versions identified below are by Gilligan (1982 ), a second by Tronto (1993 ), and a third by Gastmans (...) (2006 ), see also Little (1998 ). Each version is described and then subjected to criticism. It is concluded that where the ethics of care is presented in a distinctive way, it is at its least plausible; where it is stated in more plausible forms, it is not sufficiently distinct from nor superior to at least one other common approach to nursing ethics, namely the much-maligned 'four principles' approach. What is added by this paper to what is already known: as the article tries to explain, in spite of its being subjected to sustained criticism the ethics of care retains its appeal to many scholars. The paper tries to explain why, partly by distinguishing three different versions of an ethics of care. It is also shown that all three versions are beset with problems the least serious of which is distinctiveness from other approaches to moral problems in health care. (shrink)
