Two major regulatory changes are affecting the provision of undergraduate legal education in England and Wales. On the one hand, the Qualifying Law Degree is being deregulated, meaning law schools are free to make significant changes to how and what they teach. On the other hand, higher education in England has seen a significant overhaul through the creation of the Office for Students, which treats students as consumers. Now more than ever, law schools need to ask themselves existential questions which (...) will not only test their continued relevance or indeed viability within the ‘market’ for higher education, but also the status of the discipline of law as a whole. The regulatory landscape may indeed present a significant threat, but it is also an opportunity to reflect on what law schools are for, and consequently what changes could result from the academic freedom that comes with deregulation. Whilst different law schools will interpret their mission differently, they should caution against either generalised inertia or succumbing to an outcomes-oriented provision that simply prepares students for the new Solicitors Qualifying Examination. Instead, law schools will find their proper purpose in critical reflection and academic self-grounding, providing undergraduate students with a ‘question everything’ mentality, and showing them that law is something to be experienced and not merely learnt. A substantial balance of evidence favours the view that human souls have libertarian free will, that is the freedom to choose between alternative actions, despite all causal influences acting on them. Free will thus entails soul indeterminism, which entails brain indeterminism. There is no reason to suppose that the same laws govern the behaviour of the brain as govern any other physical system, since the brain is different from any other physical system in being in causal interaction with a soul. (...) In any case, its indeterminism may be ensured by Quantum indeterminism. The main evidence for soul indeterminism is, however, the fact that human counter‐suggestibility would be compatible with determinism only on the assumption of an a priori very unlikely mechanism for the production of beliefs. First-order Gödel logics are a family of finite- or infinite-valued logics where the sets of truth values V are closed subsets of [0,1] containing both 0 and 1. Different such sets V in general determine different Gödel logics GV (sets of those formulas which evaluate to 1 in every interpretation into V). It is shown that GV is axiomatizable iff V is finite, V is uncountable with 0 isolated in V, or every neighborhood of 0 in V is uncountable. Complete (...) axiomatizations for each of these cases are given. The r.e. prenex, negation-free, and existential fragments of all first-order Gödel logics are also characterized. (shrink)

Hilbert’s program was an ambitious and wide-ranging project in the philosophy and foundations of mathematics. In order to “dispose of the foundational questions in mathematics once and for all,” Hilbert proposed a two-pronged approach in 1921: first, classical mathematics should be formalized in axiomatic systems; second, using only restricted, “finitary” means, one should give proofs of the consistency of these axiomatic systems. Although Gödel’s incompleteness theorems show that the program as originally conceived cannot be carried out, it had many partial (...) successes, and generated important advances in logical theory and metatheory, both at the time and since. The article discusses the historical background and development of Hilbert’s program, its philosophical underpinnings and consequences, and its subsequent development and influences since the 1930s. Some of the most important developments of symbolic logic took place in the 1920s. Foremost among them are the distinction between syntax and semantics and the formulation of questions of completeness and decidability of logical systems. David Hilbert and his students played a very important part in these developments. Their contributions can be traced to unpublished lecture notes and other manuscripts by Hilbert and Bernays dating to the period 1917-1923. The aim of this paper is to describe these results, focussing (...) primarily on propositional logic, and to put them in their historical context. It is argued that truth-value semantics, syntactic ("Post-") and semantic completeness, decidability, and other results were first obtained by Hilbert and Bernays in 1918, and that Bernays's role in their discovery and the subsequent development of mathematical logic is much greater than has so far been acknowledged. After a brief, personal reflection on Aron Gurwitsch's life and his many influences on my career, I devote this lecture to some of the central themes of a phenomenology of medicine. Its core is the clinical encounter, which displays a certain structure I term the asymmetry of power and vulnerability —a complex contextual imbalance characterized by multiple points of view, hence points for reflective entrance. These are then interpreted phenomenologically in terms of epoché and reduction, evidence, reflection, and other related (...) themes. After a brief flirtation with logicism around 1917, David Hilbertproposed his own program in the foundations of mathematics in 1920 and developed it, in concert with collaborators such as Paul Bernays andWilhelm Ackermann, throughout the 1920s. The two technical pillars of the project were the development of axiomatic systems for everstronger and more comprehensive areas of mathematics, and finitisticproofs of consistency of these systems. Early advances in these areaswere made by Hilbert (and Bernays) in a series of lecture courses atthe (...) University of Göttingen between 1917 and 1923, and notably in Ackermann's dissertation of 1924. The main innovation was theinvention of the -calculus, on which Hilbert's axiom systemswere based, and the development of the -substitution methodas a basis for consistency proofs. The paper traces the developmentof the ``simultaneous development of logic and mathematics'' throughthe -notation and provides an analysis of Ackermann'sconsistency proofs for primitive recursive arithmetic and for thefirst comprehensive mathematical system, the latter using thesubstitution method. It is striking that these proofs use transfiniteinduction not dissimilar to that used in Gentzen's later consistencyproof as well as non-primitive recursive definitions, and that thesemethods were accepted as finitistic at the time. Social cognition differs from general cognition in its focus on understanding, perceiving, and interpreting social information. However, we argue that the significance of domain‐general processes for controlling cognition has been historically undervalued in social cognition and social neuroscience research. We suggest much of social cognition can be characterized as specialized feature representations supported by domain‐general cognitive control systems. To test this proposal, we develop a comprehensive working model, based on an interactive activation and competition architecture and applied to the control (...) of action. As such, we label the model “ICON” (interactive activation and competition model for the control of action). We used the ICON model to simulate human performance across various laboratory tasks. Our simulations emphasize that many laboratory‐based social tasks do not require socially specific control systems, such as those that are argued to rely on neural networks associated with theory‐of‐mind. Moreover, our model clarifies that perceived disruptions in social cognition, even in what appears to be disruption to the control of social cognition, can stem from deficits in social representation instead. We advocate for a “default stance” in social cognition, where control is usually general, but representation is specific. This study underscores the importance of integrating social cognition within the broader realm of domain‐general control processing, offering a unified perspective on task processing. (shrink)

When the modern artist is seen as moving about in a nebulous area between two opposing worlds, that of life or immediate experience and that of art or established truth, I think it is appropriate to discuss this activity in terms of metaphor. Indeed the present concern for metaphor in the academic and artistic communities is but one of many reflections of our sense that life is a process of the gradual attainment of knowledge through experience, whether sensuous or intellectual. (...) Like our artists, we strive to create a picture of our world, yet that picture is never complete; for we continually pass on to new experiences and new images of reality. Not only do we grow and change but our world seems to change with us. Although the truths revealed through our art are founded in our experience, they seem more permanent and public than the acts of discovery leading to them. A principle once established and integrated with a body of other established truths enters into recorded history perhaps to be revered, disputed, or reinterpreted, but nevertheless to remain. The individual experience or discovery, however, passes; with the individual, only the sense of the continuing search yields personal identity. In a changing world, metaphor renders the truth of experience as the truth of knowledge, for it is the means of passing from individual immediacy to an established public world; the new must be linked to the old, and the experience of any individual must be connected with that of his society. Excluding the possibility of the creation of entirely new worlds and the resultant transformation of all personal identities, acts of genius or dramatic breakthroughs in fields of study can affect our present world order only if they are joined to it by means of a powerful metaphor. Indeed establishing the metaphoric bridge itself may be considered the act of genius, and the entry into new areas of knowledge is its consequence. There have been few tests of whether exposure to naturalistic or experimental disease-threat inductions alter disgust sensitivity, although it has been hypothesized that this should occur as part of disgust’s disease avoidance function. In the current study, we asked Macquarie university students to complete measures of disgust sensitivity, perceived vulnerability to disease, hand hygiene behavior and impulsivity, during Australia’s Covid-19 pandemic self-quarantine period, in March/April 2020. These data were then compared to earlier Macquarie university, and other local, and overseas student (...) cohorts, to determine if disgust sensitivity and the other measures, were different in the lockdown sample. The most consistent finding in the lockdown sample was of higher core disgust sensitivity, with some evidence of greater germ aversion on the PVD, and an increase in hand and food-related hygiene, but with little change in impulsivity. The consistency with which greater core disgust sensitivity was observed, suggests exposure to a highly naturalistic disease threat is a plausible cause. Greater disgust sensitivity may have several functional benefits and may arise implicitly from the threat posed by the Covid-19 pandemic. (shrink)

In his essay “Painting Memories” , Michael Fried identifies memory as the privileged thematic that structures Charles Baudelaire’s Salon of 1846. But he then limits his investigation of this topic by focusing on the representation of “past” art, to the exclusion of the recollection of “past” experience. Fried thus isolates the theme of memory from the dialectic of life and art that characterizes its performance for Baudelaire. Such selective analysis not only reverses Baudelaire’s priorities but deflects his pointed comments on (...) modernity and naiveté, which in turn inform the example of Edouard Manet, Fried’s exemplary modernist painter. One wonders whether too much of Baudelaire and Manet is lost to this view. Perhaps the predilections of contemporary criticism have sanctioned Fried’s approach. For today we hesitate to ground art in experience, preferring to conceive of representations as signs fully engendered by and engendering other signs. Baudelaire was of a different mind; he lived through the dawning of our own age, but also in the fading light of another. He was heir to a tradition that regarded the forms of art as powerfully motivated by the experience of internalized ideas and sensations; for him, a master artist’s “signs” would appear more symbolic than allegorical, more immediate than mediated or distanced. As we deny artistic signs motivation in extralinguistic “experience,” we aggravate that perennial problem of origins which Fried himself invokes. It might be reformulated in this manner: all painting depends on a lineage of antecedent painting; yet, to succeed, a new work must transcend its filial bondage, as it compounds the effect of the “original” in its own originality. Vexation follows from this issue of the artistic source. Since memories of past art make possible the very creation of art, the creative event cannot assume priority over memory. And the matter of primordial memory, like the matter of an absolutely original art, is aporia. Fried does not pursue this matter ; but the question necessarily implies that both representations and memories, in constituting the “past,” must always be distanced. Distanced not from the present, which they enter and likewise constitute, but from those “original” experiential moments they purport to present. Systematics based solely on structuralist principles is non-science because it is derived from first principles that are inconsistent in dealing with both synchronic and diachronic aspects of evolution, and its evolutionary models involve hidden causes, and unnameable and unobservable entities. Structuralist phylogenetics emulates axiomatic mathematics through emphasis on deduction, and “hypotheses” and “mapped trait changes” that are actually lemmas and theorems. Sister-group-only evolutionary trees have no caulistic element of scientific realism. This results in a degenerate systematics based on patterns of (...) fact or evidence being treated as so fundamental that all other data may be mapped to the cladogram, resulting in an apparently well-supported classification that is devoid of evolutionary theory. Structuralism in systematics is based on a non-ultrametric analysis of sister-group informative data that cannot detect or model a named taxon giving rise to a named taxon, resulting in classifications that do not reflect macroevolutionary changes unless they are sister lineages. Conservation efforts are negatively affected through epistemological extinction of scientific names. Evolutionary systematics is a viable alternative, involving both deduction and induction, hypothesis and theory, developing trees with both synchronic and diachronic dimensions often inferring nameable ancestral taxa, and resulting in classifications that advance evolutionary theory and explanations for particular groups. Um einen angemessenen Kontext zur Verfügung zu stellen, folgt nach einer kurzen Diskussion der schwierigen Beziehungen zwischen Philosophie und Medizin eine Reflexion über verschiedene Implikationen des neuen biologischen Wissens und der daraus resultierenden Technologien für die medizinische Praxis. Von besonderem Interesse sind dabei frühere Diskussionen dieser Implikationen von Genetikern, insbesondere im Hinblick auf eine Erneuerung der Evolutionstheorie und ihrer klinischen Applikationen sowie einen daraus hervorgehenden Disput (...) über in-vitro-Fertilisation, der den Ausgangspunkt für die gegenwärtigen Kontroversen über genetische Entdeckungen bildet. Danach werden einige zentrale Punkte angesprochen: Die Kontrolle über die Reproduktion des Menschen und neuerliche philosophische Debatten über die Signifikanz genetischer Entdeckungen für die philosophischen Fragen der Identität und des Rechts auf Privatheit. Danach wird die These aufgestellt, daß ein neues Modell, das der Molekularbiologie, sich im Bereich der Medizin ausgebreitet hat, das im Themenkreis von Ethik, Recht und Philosophie für das 21. Jahrhundert völlig neue Fragen aufwirft.Several scenarios involving new discoveries in genetics set the stage for an analysis. To provide a proper context, a brief discussion of the vexed relations between philosophy and medicine is followed by a reflection on several implications of new biological knowledge and its resulting technologies for medical practice. Of particular interest are earlier discussions by geneticists of these implications, especially for renewed assessments of evolution theory and clinical applications, and one resulting dispute, about in vitro fertilization, which sets the stage for current controversies occasioned by genetic discoveries. Attention is then given to several central issues: control over human reproduction and renewed philosophical disputes over the significance of genetic discoveries for philosophical questions of personal identity and privacy. It is then suggested that a new model, molecular biology, has come into place for medicine, presenting wholly novel questions for the twenty-first century in ethics, law and philosophy. (shrink)

The ArgumentFocusing on the celebrations of Newton and his work, this article investigates the use of the concept of genius and its connection with debates on the methodology of science and the morality of great discoverers. During the period studied, two areas of tension developed. Firstly, eighteenth-century ideas about the relationship between genius and method were challenged by the notion of scientific genius as transcending specifiable rules of method. Secondly, assumptions about the nexus between intellectual and moral virtue were threatened (...) by the emerging conception of genius as marked by an extraordinary personality – on the one hand capable of breaking with established methods to achieve great discoveries, on the other, likely to transgress moral and social conventions. The assesments of Newton by nineteenth-century scientists such as Brewster, Whewell, and De Morgan were informed by these tensions. (shrink)
