The political and financial investments in the implementation of forensic DNA databases and the ethical issues related to their use and expansion justify inquiries into their performance and general utility. The main function of a forensic DNA database is to produce matches between individuals and crime scene stains, which requires a constant input of individual profiles and crime scene stains. This is conditioned, among other factors, by the legislation, namely the criteria for inclusion of profiles and the periods of time (...) and conditions for their retention and/or deletion. This article aims to provide an overview of the different legislative models for DNA databasing in Europe and ponder if wider inclusion criteria – and, consequently, database size – translates into more matches between profiles of crime scene stains and included individuals. The legislation governing forensic DNA databases in 22 countries in the European Union was analysed in order to propose a typology of two major groups of legislative criteria for inclusion/retention of profiles that can be classified as having either expansive effects or restrictive effects. We argue that expansive criteria for inclusion and retention of profiles do not necessarily translate into significant gains in output performance. (shrink)

Observations of animals engaging in apparently moral behavior have led academics and the public alike to ask whether morality is shared between humans and other animals. Some philosophers explicitly argue that morality is unique to humans, because moral agency requires capacities that are only demonstrated in our species. Other philosophers argue that some animals can participate in morality because they possess these capacities in a rudimentary form. Scientists have also joined the discussion, and their views are just as varied as (...) the philosophers’. Some research programs examine whether animals countenance specific human norms, such as fairness. Other research programs investigate the cognitive and affective capacities thought to be necessary for morality. There are two sets of concerns that can be raised by these debates. They sometimes suffer from there being no agreed upon theory of morality and no clear account of whether there is a demarcation between moral and social behavior; that is, they lack a proper philosophical foundation. They also sometimes suffer from there being disagreement about the psychological capacities evident in animals. Of these two sets of concerns—the nature of the moral and the scope of psychological capacities—we aim to take on only the second. In this chapter we defend the claim that animals have three sets of capacities that, on some views, are taken as necessary and foundational for moral judgment and action. These are capacities of care, capacities of autonomy, and normative capacities. Care, we argue, is widely found among social animals. Autonomy and normativity are more recent topics of empirical investigation, so while there is less evidence of these capacities at this point in our developing scientific knowledge, the current data is strongly suggestive. It is tempting to assume that being a moral creature requires the capacity to attribute mental states to others, because a creature cannot be moral unless she is capable of comprehending how her actions can have an impact on the well-being of those around her. If this assumption were true, then mere behaviour readers could never qualify as moral, for they are incapable of conceptualising mental states and attributing them to others. In this paper, I argue against such an assumption (...) by discussing the specific case of empathy. I present a characterisation of empathy that would not require an ability to attribute mental states to others, but would nevertheless allow the creature who possessed it to qualify as a moral being. Provided certain conditions are met, a behaviour reader could be motivated to act by this form of empathy, and this means that behaviour readers could be moral. The case for animal morality, I shall argue, is therefore independent of the case for animal mindreading. (shrink)

Twin-earth thought experiments, standardly construed, support the externalist doctrine that the content of propositional attitudes involving natural-kind terms supervenes upon properties external to those who entertain them. But this doctrine in conjunction with a common view of self-knowledge might have the intolerable consequence that substantial propositions concerning the environment could be knowable a priori. Since both doctrines, externalism and privileged self-knowledge, appear independently plausible, there is then a paradox facing the attempt to hold them concurrently. I shall argue, however, that (...) externalist claims about the dependence of content on environmental factors presuppose certain theses about the semantics of natural-kind terms that, if sound, would make those claims eligible for empirical justification instead. In fact, that is the only interpretation of their epistemic status that could square with the standard conclusion from twin-earth cases. Furthermore, it can be shown to solve the paradox of externalism and self-knowledge in a more doxastically conservative way--accommodating precisely each of the well-accepted intuitions about knowledge, closure and the individuation of content given up by available competitors. A common utilitarian argument in favor of abortion for fetal defects rests on some controversial assumptions about what counts as a life worth living. Yet critics of abortion for fetal defects are also in need of an argument free from controversial assumptions about the future child's quality of life. Christopher Kaczor (in: Kaczor (ed), The ethics of abortion: women's rights, human life, and the question of justice, Routledge, New York, 2011) has devised an analogy that apparently satisfies this condition. On (...) close scrutiny, however, Kaczor's analogy is too weak to debunk the common-morality intuition that at least some abortions for fetal defects are morally permissible. The upshot of this discussion is that, on the moral permissibility of abortions for fetal defects, a case-by-case approach is to be preferred. (shrink)

G.E. Moore's philosophical legacy is ambiguous. On the one hand, Moore has a special place in the hearts of many contemporary analytic philosophers. He is, after all, one of the fathers of the movement, his broadly commonsensical methodology informing how many contemporary analytic philosophers practise their craft. On the other hand, many contemporary philosophers keep Moore's own substantive positions at arm's distance. According to many epistemologists, one can find no finer example of how to beg the question than Moore's case (...) against the sceptic. And, according to many moral philosophers, one can find no more vivid case of philosophical extravagance than Moore's non-naturalism. Given this ambiguity, one wonders: How should we assess Moore's legacy in epistemology and ethics – the two areas of philosophy in which Moore did most of his work?That is the task of this welcome collection of 16 essays. The list of contributors to the book is impressive: Crispin Wright, Ernest Sosa, Ram Neta, William Lycan, C.A.J. Cody, Paul Snowdon, Michael Huemer and Roy Sorenson consider Moore's work in epistemology. Stephen Darwall, Terry Horgan, Mark Timmons, Richard Fumerton, Charles Pigden, Robert Shaver, Joshua Gert, Jonathan Dancy and the editors of the book explore Moore's views in ethics. As one might expect, given this list of contributors, the quality of the essays is very high. Moreover, there is a decidedly constructive tone to many of them. Este trabajo muestra cómo una modificación en el sentido del término caracter adquirido llevó a rechazar la hipótesis de la herencia de esos caracteres. Se considerará el ejemplo del experimento llevado a cabo por Weismann que fue tomado como un caso paradigmático en los libros de textos y en la bibliografía especializada para refutar esa hipótesis. Ese diseño experimental fue aceptado por la comunidad como una refutación, a pesar de que los caracteres a los que hacía referencia no cumplían con (...) ninguna de las condiciones necesarias para poder ser considerado un carácter adquirido. Así, quedó establecida la premisa de que sólo las células germinales podían heredarse fundándose lo que se conoció como la barrera de Weismann. Este caso pretende poner en consideración cómo la enseñanza y reproducción de los términos científicos y de sus indicadores puede llevar a limitar el desarrollo de las teorías. In this article I will analyze whether the so-called Extended Evolutionary Synthesis represents a synthesis and an extension with respect to its predecessor, Modern Synthesis. It will be argued that the MS proposes an externalist approach to evolution while the EES considers it necessary to overcome the internalism/externalism dichotomy by proposing more integrative approaches. It will be concluded that the EES cannot be considered an extension of MS and that the appeal to that extension is related to sociological aspects and (...) the epistemic value of theoretical unification that was always present in biological evolutionary thinking. ABSTRACT The article argues that, while the configuration of the lesbian body and of subjectivity in Sarah Waters’s first three novels—Tipping the Velvet, Affinity, and Fingersmith —is carried out in the discursive and performative terms of postmodernist feminism, her latest novels evince a move towards a queer phenomenological position characterised by a growing interest in the material and socioeconomic conditions of the body and subjectivity. Initiated in The Night Watch and The Little Stranger, and culminating in The Paying Guests, this (...) phenomenological turn is observable in that these novels are centrally concerned with material issues of class and situated in periods of collective post-war trauma and political unrest that open up the possibility for cultural change and social transformation, thus suggesting a move towards a transmodernist position. The article offers a queer reading of The Paying Guests, based on Sarah Ahmed’s notions of “encounter” and “orientation” as a way to substantiate this assertion. (shrink)

We explore the distinctive characteristics of Mexico's society, politics and history that impacted the establishment of genetics in Mexico, as a new disciplinary field that began in the early 20th century and was consolidated and institutionalized in the second half. We identify about three stages in the institutionalization of genetics in Mexico. The first stage can be characterized by Edmundo Taboada, who was the leader of a research program initiated during the Cárdenas government (1934-1940), which was primarily directed towards improving (...) the condition of small Mexican farmers. Taboada is the first Mexican post-graduate investigator in phytotechnology and phytopathology, trained at Cornell University and the University of Minnesota, in 1932 and 1933, respectively. He was the first investigator to teach plant genetics at the National School of Agriculture and wrote the first textbook of general genetics, Genetics Notes, in 1938. Taboada's most important single genetics contribution was the production of "stabilized" corn varieties. The extensive exile of Spanish intellectuals to Mexico, after the end of Spain's Civil War (1936-1939), had a major influence in Mexican science and characterizes the second stage. The three main personalities contributing to Mexican genetics are Federico Bonet de Marco and Bibiano Fernández Osorio Tafall, at the National School of Biological Sciences, and José Luis de la Loma y Oteyza, at the Chapingo Agriculture School. The main contribution of the Spanish exiles to the introduction of genetics in Mexico concerned teaching. They introduced in several universities genetics as a distinctive discipline within the biology curriculum and wrote genetics text books and manuals. The third stage is identified with Alfonso León de Garay, who founded the Genetics and Radiobiology Program in 1960 within the National Commission of Nuclear Energy, which had been founded in 1956. The Genetics and Radiobiology Program rapidly became a disciplinary program, for it embraced research, teaching, and training of academics and technicians. The Mexican Genetics Society, created by de Garay in 1966, and the development of strains and cultures for genetics research were important activities. One of de Garay's key requirements was the compulsory training of the Program's scientists for at least one or two years in the best universities of the United States and Europe. De Garay's role in the development of Mexican genetics was fundamental. His broad vision encompassed the practice of genetics in all its manifestations. (shrink)

It has been argued that some animals are moral subjects, that is, beings who are capable of behaving on the basis of moral motivations. In this paper, we do not challenge this claim. Instead, we presuppose its plausibility in order to explore what ethical consequences follow from it. Using the capabilities approach, we argue that beings who are moral subjects are entitled to enjoy positive opportunities for the flourishing of their moral capabilities, and that the thwarting of these capabilities entails (...) a harm that cannot be fully explained in terms of hedonistic welfare. We explore the implications of this idea for the assessment of current practices involving animals. (shrink)

Could animals behave morally if they can’t mindread? Does morality require mindreading capacities? Moral psychologists believe mindreading is contingently involved in moral judgements. Moral philosophers argue that moral behaviour necessarily requires the possession of mindreading capacities. In this paper, I argue that, while the former may be right, the latter are mistaken. Using the example of empathy, I show that animals with no mindreading capacities could behave on the basis of emotions that possess an identifiable moral content. Therefore, at least (...) one type of moral motivation does not require mindreading. This means that, a priori, non-mindreading animals can be moral. (shrink)

Ethics and integrity should be intertwined within the concept of Responsible Research. Integrity Officers should also be Ethics Officers, enforcing compliance with rules and norms, but also raising awareness on the meaning of ethics in researchers’ daily work. Paul Ricoeur’s definition of Ethics – “the aim of living a good life with and for others in just institutions” (Ricoeur in Oneself as Another. University of Chicago Press, 1994 ) –, points out the relational dimension of Ethics that matters to all (...) the stakeholders in scientific research. The dialogical interaction between Ethics and Integrity can help to prevent researchers from assuming self-regulation as the only possible path to be followed. In this paper, the challenges and the opportunities posed by this approach will be outlined and discussed, mainly, the challenges of building trust bottom up, while setting up restrictions to comply with rules and norms top down. Concerning the opportunities, the focus will be on making better science and building a solid network among the various stakeholders of the research system. (shrink)

Resumen Los textos televisivos interpretan y analizan la realidad circundante e influyen en la visión que la audiencia tiene del mundo. Es más, los programas cómicos basados en la burla y el sarcasmo hacia grupos étnicos minoritarios refuerzan estereotipos negativos y promueven la discriminación cultural. En este artículo se estudia el humor étnico en La paisana Jacinta. Esta serie peruana ha sido acusada de racista por diversas personas y grupos, entre ellos, la excongresista indígena Hilaria Supa, LUNDU y CHIRAPAQ. Primero, (...) se analizan las estrategias pragmático-lingüísticas empleadas en la construcción del humor étnico en una selección de diálogos y monólogos de Jacinta, el personaje principal de la serie. Para ello, se utiliza la Teoría General del Humor Verbal. Asimismo, dado que todo texto es multimodal, se tiene también en cuenta cómo imágenes, gestos, y elementos musicales y prosódicos en la serie contribuyen en la producción de la comicidad. Finalmente, a partir de estos resultados, se examina el contenido cómico del programa desde una perspectiva crítica para determinar si este es discriminatorio. (shrink)

The increasingly pluralistic character of modern societies has led to questions, not only about the proper use of ethnic-group terms, but also about the correct semantic analysis of them. Here I argue that ethnic-group terms are analogous to other linguistic expressions whose extension is fixed in the way suggested by a causal theory of reference. My view accommodates precisely those scenarios of communication involving ethnic-group terms that will be seen puzzling to Fregeans. At the same time, it undermines the plausibility (...) of skepticism about those terms. (shrink)

Modern management reporting on its company''s performance is influenced by individuals ethical considerations. Stakeholders philosophies have continued to change over the last 75 years affecting reporting systems for companies reporting information internally and externally. These fundamental changes in philosophy have affected how information is conveyed. We are not claiming that only one philosophical viewpoint dominates companies reporting practices, but there does appear to be a changing trend of philosophies building on one another. We use resource dependence theory in relationship to (...) a decision-making model to explain changing stakeholders positions over time. This paper argues that six dominant philosophical theories have influenced the way individuals and organizations report financial and other information. Further, these philosophies then are depicted in a model that helps us to understand what influences companies to present themselves to the outside world. There is scarce knowledge about the influence of the professional group, education, and age on public perspectives on the risks and benefits of forensic DNA databases. Based on data collected through an online questionnaire applied to 628 individuals in Portugal, this research fills that gap. More than three quarters of the respondents believed that the Portuguese forensic DNA database can help fight crime more efficiently and develop a swifter and more accurate justice, whereas only approximately half thought that it could (...) deter and prevent crime. Lack of security and control over access to data and the future unforeseen misuses of genetic information were the most relevant risks selected by the participants. Health care and life sciences professionals were more likely to agree with all the benefits, as opposed to those working in the field of law enforcement. More educated and older participants disagreed with benefits more often. Concerns with the risks increased with age. (shrink)

The public’s understanding of forensic DNA databases remains undertheorized and few empirical studies have been produced. This article aims to address this omission by exploring the answers to an open-ended question taken from an online questionnaire regarding the reasons for individuals’ voluntarily accepting or refusing to allow their DNA profile to be included in the Portuguese forensic DNA database. The analysis is undertaken from the perspective of biological citizenship and the simultaneous empowering and disempowering effects of surveillance. The results indicate (...) a pragmatic ethical framework that is linked to the cultural and emotional elements of altruism, resistance, stigma, and social representations of what is beneficial or harmful to the individual and to society. These subjectivities are anchored in commonplace images and metaphors for genetics, DNA, and forensic science that circulate in the messages transmitted by the media which pervade everyday life; hierarchies of trust in science and the justice system; and moral categories associated with the individual self-judgment in relation to crime, surveillance, and social order. It is generally assumed that humans are the only animals who can possess a concept of death. However, the ubiquity of death in nature and the evolutionary advantages that would come with an understanding of death provide two prima facie reasons for doubting this assumption. In this paper, my intention is not to defend that animals of this or that nonhuman species possess a concept of death, but rather to examine how we could go about empirically determining whether animals can (...) have a concept of death. In order to answer this question, I begin by sketching an account of concept possession that favours intensional classification rather than mere extensional discrimination. Further, I argue that the concept of death should be construed as neither binary nor universal. I then present a proposal for a set of minimal conditions that must be met to have a concept of death. I argue that having a minimal understanding of death entails first expecting a dead individual to be alive, and then grasping its non-functionality and irreversibility. Lastly, I lay out the sort of observational and experimental evidence that we should look for to determine whether animals have the capacity for a minimal comprehension of death. (shrink)

The Convention on the Rights of Persons with Disabilities, approved on December 13, 2006 by the UN General Assembly, represented a historic advance in the field of disability by recognizing that the right to education implied the right to an quality inclusive education, thus consolidating a normative evolution from previous international instruments. Since May 3, 2008, the Convention has been part of the Spanish legal system, which implies that the State is obliged to modify national laws that do not correspond (...) to the principles established in the Convention. However, different reports have revealed the weakness of its implementation in Spain, with the consequent breach of the rights of people with disabilities. These difficulties in establishing a truly inclusive education show how ableist conceptions and practices continue to be perpetuated in the educational field. (shrink)

In some ways that have been largely ignored, ethnic-group names might be similar to names of other kinds. If they are, for instance, analogous to proper names, then a correct semantic account of the latter could throw some light on how the meaning of ethnic-group names should be construed. Of course, proper names, together with definite descriptions, belong to the class of singular terms, and an influential view on the semantics of such terms was developed, at the turn of the (...) nineteenth century, from discussion of a puzzle about some differences in the cognitive value of certain statements of identity. Clearly, that a = a (e.g., that Mark Twain was Mark Twain) is trivial, and its truth could be known a priori, just by thinking. On the other hand, that a = b (e.g., that Mark Twain was Samuel Clemens) is of course informative and knowable only by empirical investigation. To solve this puzzle, Frege famously proposed that those variations in the cognitive value of statements of identity “can arise only if the difference between the signs corresponds to a difference in the mode of presentation of that which is designated.” On his view, although in the above statements of identity, the singular terms, ‘a,’ and, ‘b,’ may designate the same thing, they do so with different senses, or under different modes of presentation of that object. When the puzzling statements involving ‘a’ and ‘b’ are true, they may then be said to have exactly the same reference. But since those singular terms pick out the object of reference differently (i.e., under different senses or modes of presentation), therefore the cognitive value of these statements also varies significantly. On this account, then, the reference of a non-vacuous proper name is secured by the name’s sense, or mode of presentation, which constitutes its semantic content. And given that Fregeans (here under the influence of Russell) cash out that sense as consisting in whatever concept (or cluster of concepts) could be uniquely associated with that name, they might hold, for example, that the property of being the author of Huckleberry Finn, and that of being an American who lived his early life in Hannibal, Missouri, and later became a famous writer, amount to the senses of ‘Mark Twain,’ and ‘Samuel Clemens,’ respectively.. The aim of this paper is to show how modern genetics reached Spain through the Junta para la Ampliación de Estudios e Investigaciones Científicas (JAE) during the decade of 1920s, the role played by key persons, and the level of development this discipline achieved from its different points of inception and under the conditions of financial scarcity and political turmoil that prevailed during the Spanish Civil War (1936-1939). In addition, the effect of the war on the continuity of the lines (...) of research already began is outlined, identifying the main area in which genetics first reappeared: agronomy. (shrink)

The interest of assigning homework is frequently discussed due to its alleged low impact on student achievement. One of the current lines of research is to emphasize the quality of student homework engagement rather than the amount of time spent on homework. The aim of this study was to determine (a) the extent to which students’ prior achievement affects their homework engagement (i.e., time spent, time management, and amount of teacher-assigned homework done), and (b) how students’ intrinsic motivation towards homework (...) may mediate or moderate the relationship between prior achievement and the homework engagement variables. A large sample of students from the first four years of Secondary Education (N = 1899) completed questionnaires. The results showed that intrinsic motivation partially mediates, but does not moderate, the effect of prior achievement on the three variables related to homework engagement (time spent, time management, and amount of teacher-assigned homework done). These results highlight the importance of considering both students’ current level of achievement and their motivation towards homework engagement when assigning homework. (shrink)

What challenges does the political participation of children pose to the Philosophy of Childhood? What challenges does the Philosophy of Childhood pose to children's political participation? This text is inspired by the idea that “research is not about enumerating situations, but making researchers lose their sleep”. It is divided into two distinct parts. In the first, we introduce the theoretical framework that orients our research group and our work with children in the philosophical research community. We posit a link between (...) listening to children's voices, the conditions of listening, and the location of their political participation in public space. The second part is comprised of a creative illustrated narrative in the form of a dialogue. From the coast of what could be called the territory of political participation, two characters - Sentinel and Walker - discuss the waves of children that crash onto the territory. To what extent does creating space and time for listening to children open polyphonic movements and enable the construction of new forms of polis: poly(s)phonies? In what ways does the Philosophy of Childhood challenge itself in the creation of poly(s)phonies where the participation of children sets the tone?
