Successful biomedical data mining and information extraction require a complete picture of biological phenomena such as genes, biological processes, and diseases; as these exist on different levels of granularity. To realize this goal, several freely available heterogeneous databases as well as proprietary structured datasets have to be integrated into a single global customizable scheme. We will present a tool to integrate different biological data sources by mapping them to a proprietary biomedical ontology that has been developed for the purposes of (...) making computers understand medical natural language. The distinction between clinical research and clinical practice directs how we partition medicine and biomedical science. Reasons for a sharp distinction date historically to the work of the National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research, especially to its analysis of the “boundaries” between research and practice in the Belmont Report (1978). Belmont presents a segregation model of the research-practice distinction, according to which research and practice form conceptually exclusive sets of activities and interventions. This (...) model is still the standard in federal regulations today. However, the Commission’s deliberations and conclusions about the boundaries are more complicated, nuanced, and instructive than has generally been appreciated. The National Commission did not conclude that practice needs no oversight comparable to the regulation of research. It debated the matter and inclined to the view that the oversight of practice needed to be upgraded, though the Commission stopped short of proposing new regulations for its oversight, largely for prudential political reasons. What should the EU do about the fact that some Member States are backsliding on their commitments to democracy, supposedly a fundamental value of the EU? The Treaty provisions under Article 7 TEU are widely criticized for being ineffective in preventing such developments. Are they legitimate? I argue that the ultimate sanction of Article 7 TEU falls into a performative contradiction, which undermines its ability to coherently defend fundamental values. Instead, expulsion from the EU is the appropriate, coherent and legitimate (...) final political sanction for democratic and rule of law backsliding by a Member State. The argument has the following steps: In Part 1, I argue that the current Article 7 framework for responding to democratic and rule of law backsliding in the EU is normatively problematic, in that the mechanism currently in the Treaty undermines the values it purports to defend; in other words, it falls into a performative contradiction. It is undemocratic to deprive Member States of their right to vote in the Council while holding them subject to Council decisions. However, Part 2 studies relevant philosophical arguments from an adjacent literature on criminal disenfranchisement, concluding that allowing backsliding Member States to keep their voting rights in the Council _also_ taints the democratic character of Council decision-making. In Part 3, I consider the resulting paradox in light of the literature on militant democracy. Could militant democracy justify Article 7? I argue not; even if we accept the hypothetical justifiability of militant measures, they are not legitimate here since a democratically acceptable alternative exists that would safeguard the democratic character and legitimacy of Council decision-making: expulsion from the Union. I also address a central objection to an expulsion mechanism—that it would require treaty change and is therefore practically impossible. (shrink)

This paper critically engages the legal and political framework for responding to democracy and rule of law backsliding in the EU. I develop a new and original critique of Article 7 TEU based on it being democratically illegitimate and normatively incoherent qua itself in conflict with EU fundamental values. Other more incremental and scaleable responses are desirable, and the paper moves on to assess the legitimacy of economic sanctions such as tying access to EU funds to performance on democratic and (...) rule of law indicators or imposing fines on backsliding states. I hold such sanctions to be a priori legitimate, and argue that in some cases economic sanctions are even normatively required, given that EU material support of backsliding member states can amount to material complicity in their backsliding. However, an economic conditionality mechanism would need to be designed to minimize unjust and counterproductive effects. One way to pursue this could be to complement sanctions against the backsliding government with investment for prodemocratic actors in that state. (shrink)

This article looks at the Indian canonical sources for Mādhyamika Buddhist refusals to personally endorse truth claims, even about customary matters. These sources, on a natural reading, seem to suggest that customary truth is only widespread error and that the Buddhist should do little more than duplicate, or acquiesce in, what the common man recognizes about it. The combination of those Indian canonical themes probably contributed to frequent Indo-Tibetan Madhyamaka positions on truth, i.e., that the customary is no more than (...) surface level truth, mere consensus amongst the mistaken, or, similarly, that there can be no right answers or truth claims to endorse about customary matters, as there are no sources of knowledge that have them as objects. Tsong kha pa and the dGe lugs pa, by contrast, adopted what I consider to be a philosophically more promising stance, one that recognized the need for a robust normativity: things customary are not just reduced to accepted errors; there are right answers about them that should be endorsed and may well defy current consensus of opinion. Not surprisingly, however, they needed a quite different and even strained exegesis of that same Indian textual legacy. (shrink)

However in France, the influence of this German philosopher is such that contemporary French thought cannot be properly understood without reference to Heidegger and his extraordinary influence. Tom Rockmore examines the reception of Heidegger's thought in France. He argues that in the period after the Second World War, due to the peculiar nature of the humanist French Philosophical tradition, Heidegger became the master thinker of French philosophy. The idea to utilise cognitive neuroscientific research for educational purposes is known as Mind-Brain Education or Educational Neuroscience. Despite some calls for an uncritical endorsement of such an agenda, a growing number of educational scholars argue that it must remain impossible to translate neurological descriptions into mental or educationally relevant descriptions. This paper takes these well-established arguments further by not only focusing upon these different levels of description but going beyond this issue to assess the theoretical foundations of cognitive science (...) as a functional theory of the mind. With relevance to education it is argued that because of its functional character a cognitive-psychological approach to education suffers from an inherent blind spot regarding the actor’s feelings and motivations. The paper concludes with the claim that, because of this experiential poverty, any cognitive neuroscientific approach must face severe limitations when utilised for educational purposes. (shrink)

Tom Reucher uses excerpts from the writings of various psychology specialists who operate as experts with respect to transsexuality. A close reading shows that these texts produce discrediting, insulting, sexist, homophobic and transphobic discourses. These writings show the fear of the so-called « experts », whose attachment to obsolete theories leaves them ignorant of the questions around transsexuality. Transsexuals and transgenders who speak up against the professionals and experts speaking in their place is something new in France. It goes along (...) with the reappropriation of their identity by self-naming and the creation of organizations to defend their rights. Medical and surgical practices can lead to the violation of the human rights of transsexuals and transgenders. The protocols of care for transnssexual and transgender patients are maladapted and out of synch with the evolution of knowledge and of society. Background: Ethical leadership is important for developing ethical healthcare practice. However, there is little research-based knowledge on how to stimulate and educate for ethical leadership. Objectives: The aim was to develop and investigate the feasibility of a 6-week web-based, ethical leadership educational programme and learn from participants’ experience. Training programme and research design: A training programme was developed consisting of (1) a practice part, where the participating middle managers developed and ran an ethics project in their own departments aiming at (...) enhancing the ethical mindfulness of the organizational culture, and (2) a web-based reflection part, including online reflections and coaching while executing the ethics project. Focus group interviews were used to explore the participants’ experiences with and the feasibility of the training. Participants and research context: Nine middle managers were recruited from a part-time master’s programme in leadership in Oslo, Norway. The research context was the participating leaders’ work situation during the 6 weeks of training. Ethical considerations: Participation was voluntary, data anonymized and the confidentiality of the participating leaders/students and their institutions maintained. No patient or medical information was involved. Findings: Eight of the nine recruited leaders completed the programme. They evaluated the training programme as efficient and supportive, with the written, situational feedback/coaching as the most important element, enhancing reflection and motivation, counteracting a feeling of loneliness and promoting the execution of change. Discussion: The findings seem consistent with the basic assumptions behind the educational design, based partly on e-health research, feedback studies and organizational ethics methodology, partly on theories on workplace learning, reflection, recognition and motivation. Conclusion: The training programme seems feasible. It should be adjusted according to participants’ proposals and tested further in a large-scale study. (shrink)

The research importance of biobanked biological materials and their derived data is growing, especially as these are increasingly linked with individual and population‐level medical and health information. The number, diversity, and size of biobanks are growing in tandem. So, too, is the number of individuals whose donations are being used in biobank‐supported research, with or without their knowledge. Pretty soon, we all will be “participants” in a variety of research projects we know nothing about. Until recently, our leftover tissue or (...) deidentified medical information could be used for research without our consent or even our knowledge. Even if we've been asked–as the current regulations require when research uses are anticipated‐we were most likely asked to give a blanket consent to any future use, with no prospect of learning about or controlling how our material is later used. This is an ethically problematic state of affairs, but there are options for improving it. (shrink)

This thesis proposes a new philosophical reading of the work of the French psychoanalyst Jacques Lacan. In particular, it is argued that it is Lacan's concept of the 'Real', one ofhis three registers of the Real, Symbolic and the Imaginary, that provides the crucial conceptual horizon for La can' s work, early and late, against those who would locate the emergence of the centrality of the Real only late in Lacan's teaching. The thesis sets out to establish the conceptual genesis (...) and multiple instantiations of the concept of the Real in both Lacan's articles and seminars, arguing that, far from being a hypostatized 'outside' to the Symbolic and Imaginary, the Real is to be understood as immanent to both. Further, Lacan's theory of language is highlighted as revealing the particularity of the Real, especially through the concept of the material signifier. In developing a novel typology of the 'signifier-in-relation' and the 'signifier-in-isolation', the thesis underscores the singularity of Lacan's theory of language and its transcendence of its roots in Saussure's linguistics. Finally, the Real is shown to have a central pertinence to the novel theory of the body proposed in Lacan' s final seminars, a theory of the body that is itself shown to be intimately connected to Lacan' s theory of language, and to his revision of Freud's theories of primary narcissism. This paper has outlined the theoretical framework for constructing a survey instrument designed to elicit attitudes that contribute to perceived legitimacy of corporate environmental sustainability policies or initiatives. It posits six attitudinal components of legitimacy that can be influenced independently, and that combine to yield an overall attitude regarding the legitimacy of sustainability as a factor in managerial decision-making. It discusses how a survey instrument could be developed to measure these attitudinal components, and suggests practical and pedagogical applications.

In an article published in 2009 titled "How Do Mādhyamikas Think?" I tried to go some distance with Yasuo Deguchi, Jay Garfield, and Graham Priest (henceforth "DGP") in reading certain Buddhist texts as dialetheist.1 The dialetheism that I saw as plausible for the Prajñāpāramitā-sūtras and Nāgārjuna was not the full-blown robust variety of DGP (i.e., acceptance of the truth of some statement of the form p & ¬p) but a non-adjunctive variety, acceptance of p and acceptance of ¬p. Beauchamp (bio)AbstractThis article is a reply to Robert Baker’s attempt to rebut moral fundamentalism, while grounding international bioethics in a form of contractarianism. Baker is mistaken in several of his interpretations of the alleged moral fundamentalism and findings of the Advisory Committee on Human Radiation Experiments. He also misunderstands moral fundamentalism generally and wrongly categorizes it as morally (...) bankrupt. His negotiated contract model is, in the final analysis, itself a form of the moral fundamentalism he declares bankrupt.Robert baker’s imaginative and incisive articles on international bioethics (Baker 1998a & b) are rich in history and philosophy, but they are as profoundly misguided as they are misdirected. In this comment, I will concentrate both on a pivotal interpretation and criticism that he offers of the Report of the Advisory Committee on Human Radiation Experiments (ACHRE 1996) and on his philosophical thesis that a moral fundamentalism of principles and rights is bankrupt. Baker seriously misinterprets the ACHRE report, distorts and fails to refute moral fundamentalism, and ultimately embraces a form of the very fundamentalism that he declares bankrupt. He presents this conflict as primarily a factual issue regarding whether different cultures and eras accept different moral principles—“the difference claim,” in his vernacular (Baker 1998a, pp. 208–9). This interpretation eventuates in a critique of the work of both ACHRE and Ruth Macklin:[W]hen Macklin and the Radiation Committee consider the challenge of multiculturalism, they construe this challenge, not as dispute about anthropological fact, but as a dispute about philosophical theory. More specifically, they treat any assertion of the difference claim as a form of “ethical relativism.”... They thus respond to the multiculturalist’s factual observations—even to factual observations by anthropologists—as if they were philosophical analyses.(Baker 1998a, p. 209)Baker thinks that a factual question has been fallaciously transformed into a philosophical one. In this article we aim to reconstruct some aspects of Davidson's idea of triangulation, and against this reconstruction, ask whether the idea is viciously circular. We begin by looking at the claim that without a triangularn setting, there is no saying what the cause of a being's responses is. In the first section we discuss the notion of relevant similarity, and what difference the presence of a second non‐linguistic being could make for the individuation of a common focus of attention. (...) In the second section we look at the role of a second person in language‐acquisition. It is important that being corrected to ‘go on as others do’ does not yet presuppose thought, and similarity standards can be applied to a learner's reactions even before she is aware of these standards. We also show why Davidson is not committed to any consensus view of correctness. In the last section we discern three charges of circularity that can be levelled against the idea of triangulation. We argue that Davidson can respond to the first two charges, and point to a way of answering the third. But the response we propound raises a new question, namely, why does the second being have to be a speaker or thinker even before the learner is aware of the three points of the triangle? (shrink)

Towards the end of the eighth century CE there occurred a debate over the future direction of Buddhism in Tibet. It pitted an Indian side, with their Tibetan sympathizers, against a Chinese side, with their Tibetan and perhaps even some Indian sympathizers too. The philosophy of Kamalaśīla, the leader of the Indian side, of meditation and yogic perception concords by and large with mainstream Indo‐Tibetan Buddhist theoretical accounts. The exchange between Kamalaśīla and Heshang, the Chinese leader, was heatedly polemical. Details (...) of the debate and its historical context are found in the classic work of the Sinologist Paul Demiéville, Le Concile de Lhasa. The debate is in part about the efficacy of various types of meditation, but, more broadly, it is about the respective worth of analysis and meditation as approaches to knowledge and enlightenment. The debate, as the chapter shows, is fundamentally about epistemological issues, problems of knowledge. (shrink)

Alleged refutations of utilitarianism are not uncommon, so it is unlikely that the title of the present essay will raise eye-brows. ‘Another paper about utility's failure to account for our duty to be just’, is apt to be the prevailing reaction to the title's stated objective. This is understandable. For utilitarianism has been taken to task on just this score more than a score of times. And rightly so, I believe, though I shall not argue that point here. Here I (...) intend to offer a refutation of utilitarianism which turns, not on the duty of justice, but on the value of friendship, a refutation which, so far as I am aware, has never previously been advanced in the not inconsiderable body of literature critical of that theory.
