Turning an Info-Glut into a Library. Science 266 (7 October): 20-22, p. 20), Internet resources now receive numerous levels of organization, from basic directory listings (...) to elaborate "links" (cross-references to other Internet documents) that flash and glow in the dark. In many ways, the Internet functions as a direct extension of the traditional library. Following linked references across various sites is an electronic version of browsing library stacks, and the serendipitous discoveries made while "surfing the Net" recall the wonders of physically going "book-to-book." Although many of the Internet's best aspects augment library strengths by eliminating physical distance from sources, Net resources pose unique problems for researchers. It is not always clear who is responsible for the content of Web documents, when the document was produced, or how often (if ever) it is updated. Internet resource tools, then, must enable researchers to identify appropriate resources and to evaluate what they find when they get there. Web Research as Taking "Snapshots" Given the Internet's visual nature and fluid content, the process of conducting research on the Web has been likened to taking an informal picture of information on a specific date at a particular time. This metaphor also conveys the "zoom-in" aspect of searching through Web pages by going from general to specific categories. In the first section of this Scope Note, National Reference Center for Bioethics Literature (NRCBL) staff present a snapshot of bioethics resources taken during the spring months of 2000. Entries are divided into the categories of directories, electronic journals, full-text documents, news/current awareness, and teaching resources. In the two subsequent sections, this series of categories is repeated for entries on a specific topic within bioethics-genetics-and again for general search and evaluation tools. Where a Web site may contain pages applicable [End Page 175] to more than one category, multiple entries are made for that site with appropriate information for each category.Much as telecommunication advances have strengthened the relationship of patients and providers as partners, the dynamic nature of the Internet acknowledges that the researcher functions as a librarian whenever accessing the Web. It is our hope that BIOETHICSLINE and the other NRCBL databases not only will enable researchers to search the Web more efficiently, but also will help them to evaluate what they find when they get there. Bioethicsline on the Web: An International Plan in Progress Once only available through libraries, the U.S. National Library of Medicine (NLM), the funding agency for the ongoing development of the BIOETHICS LINE® database from the Kennedy Institute, has provided free Web access to that database of 63,000 citations since September 1998 through Internet Grateful Med. Plans are now underway to eliminate such specialty databases and incorporate all citations into PubMed (for journal articles) or LOCATORplus (for book-like materials and chapters in books). Both of these databases are likewise available at no cost on the Web. In the transition to PubMed and LOCATORplus some features of BIOETHICSLINE that presently are available may be lost. Researchers are encouraged to contact the National Reference Center for Bioethics Literature with search requests or for search strategy assistance with either the current or the future system ([email protected]).The inclusion of bioethics citations in PubMed and LOCATORplus will have several advantages. First, unique keywords from the Bioethics Thesaurus will be considered for inclusion in Medical Subject Headings (MeSH), the indexing vocabulary for PubMed and LOCATORplus, thereby enhancing retrieval of relevant clinical literature by offering more precise terminology covering ethical issues. Second, it will be easier to identify foreign-language materials, which are not currently included in the scope of BIOETHICSLINE. Third, the updating schedule will become more frequent. A cutting-edge survey of formal methods directed specifically at dealing with the deep mathematical problems engendered by the study of developing systems, in particular dealing with developing phase spaces, changing components, structures and functionalities, and the problem of emergence. Several papers deal with the modelling of particular experimental situations in population biology, economics and plant and muscle developments in addition to purely theoretical approaches. Novel approaches include differential inclusions and viability theory, growth tensors, archetypal dynamics, ensembles with variable structures, and (...) complex system models. In the article the mutual influence of folk theatre, Austrian Singspiel and Viennese opera in the genres of comic opera, operetta and drama performances involving music, singing and dancing is studied. The powerful influence of Italian and French opera schools, as well as the Italian Commedia Dell'arte led to the flourishing of music and theatre art in Austria: opera buffa (A. Salieri, Ch. W. Glück, J. Haydn, W. A. Mozart), fairy-tale comedies of F. Raimund and satirical dramas of Nestroy. Their (...) game-like nature finds its expression in musical turns, satirical songs and duets. Viennese dance operetta has absorbed the traditions of Viennese popular comedy and comic opera. Recitative, vocal music and folk dances were the key elements of operettas (J. Strauss junior, F. von Suppe, K. Millöcker, K. Zeller, F. Lehar). The music and the game in Austria are the results of theatralization of life: the life turns into something like art. Austrian culture, which is addressed directly to the human being and short of complex philosophical musings and speculative schemes, has genetically built-in playful, musical and theatrical basis, as well as German. Strongly-pronounced playful and musical source as an important national component of the culture, its code, determine its highly fictitious character (staginess) and integrity (both genre and intermediately), thereby maintain its special status in the European culture. Society has historically not taken a benign view of genetic disease. The laws permitting sterilization of the mentally re tarded~ and those proscribing consanguineous marriages are but two examples. Indeed as far back as the 5th-10th centuries, B.C.E., consanguineous unions were outlawed (Leviticus XVIII, 6). Case law has traditionally tended toward the conservative. It is reactive rather than directive, exerting its influence only after an individual or group has sustained injury and brought suit. In contrast, state legislatures have not been (...) inhibited in enacting statutes. Many of their products can be characterized as hasty, unnecessary, ill-conceived, and based on the heart rather than the head. Moreover the lack of expert consultation sought has also been remarkable. One state legislature, for example, has advocated immunization for sickle cell anemia! Many others have enacted laws for the screening of inborn errors of metabolism, e.g., phenylketon uria, but have poorly defined the lines of responsibility to secure compliance. A spate of specific disease-related bills has emerged in the u.S. Congress, each seeking recognition and appropriations. Sickle cell anemia, hemophilia, Cooley's anemia and Tay-Sachs disease have been among the front-runners for support. Finally, in 1975, Congress has begun to examine an omnibus bill concerning all forms of genetic disease. The bill, termed the National Genetic Diseases Act is, however, still far from being enacted. The article considers the formation and development of philosophy in Belarus in the context of historical conditions and modern opportunities. Discussing the national context of the philosophical process, the author reveals the four aspects of the phenomenon of “national philosophy.” Firstly, there are national institutional and disciplinary structures, which are responsible for an organized scientific, methodological, research and educational activity, which at the level of the nation-state is formalized by certain institutions, system of professional education, norms of (...) professional ethos, standards of behavior within the community and in the wider social environment. Secondly, in the light of philosophical culture, national philosophy is interpreted as a set of value and cognitive orientations passed down from generation to generation. Thirdly, national philosophy can be viewed in the aspect of the tradition of studying the philosophical thought of the nation in the context of its historical development. Fourthly, national philosophy appears in the aspect of the philosophical foundations of the national idea and national-cultural identity. The author examines the main stages of the development of the Belarusian philosophical culture, it is shown that the features of this culture were formed under the condition of a complex combination of the worldview and values of Latin civilization, Christianity, modern European science, rationalism of social projects of the Enlightenment, ideological and worldview attitudes of Western Russian culture, formalized Soviet philosophical disciplines. The article reviews the circle of theoretical, ideological, and practical problems that the modern philosophical process in Belarus faces, the author emphasizes the unfading value of philosophical knowledge as a source of heuristic means for finding effective local answers to global problems of cultural and civilizational development. The author argues that there are two conditions that make national philosophy possible: this is, first of all, a connection with the history of thought in the area of national genesis and also the expression of thought in a national language. National Priority Regions (NPRs) are one of Israel’s most robust tools for redistribution: a resource allocation governmental plan that favors some regions over others, mostly according to their socioeconomic status and peripherality. Drawing on archival research, this article is the first to focus on this topic and provide a detailed description and analysis of this measure. It provides historical and theoretical accounts of NPRs, tracing their history, starting in the 1970s, over three periods and showing how they have been (...) used and abused. This allows for some important observations about the stakes of using a "color-blind" place-based distributive mechanism, and about the complex relationship between redistribution, development, and settlement. At the national level, this article shows how NPRs changed over the years from a discriminatory tool that excluded almost all Palestinian-Arab localities into a more inclusionary mechanism, but one that also works to support and incentivize Jewish settlement in the Occupied West Bank. At the theoretical level, this article lends itself to and supports a ‘region-skeptic’ approach that sees the regional scale, much like other seemingly “race-neutral” criteria, mostly as an elusive exercise of power that often deepens inequality. However, drawing on Israel’s experience with NPRs, this article provides some more specific cautionary tales that can, I suggest, work to improve the regional scale rather than eliminate it altogether. Wars are large-scale conflicts between organized groups of belligerents, which involve suffering, devastation, and brutality unlike almost anything else in human experience. Whatever one’s other beliefs about morality, all should agree that the horrors of war are all but unconscionable, and that warfare can be justified only if we have some compel- ling account of what is worth fighting for, which can justify contributing, as individu- als and as groups, to this calamitous endeavour. Although this question should obviously be central (...) to both philosophical and politi- cal discussion about war, it is at the forefront of neither. In recent years, philosophical discussion of warfare has bloomed, but the debate has focused on whom we may kill, on the assumption that our aims are justified.1 Political debate, meanwhile, is more concerned with matters of prudence, international law, and public justification, than with reassessing what is worth fighting for. For wars of intervention to halt or prevent massive humanitarian crises, this gap is not so troubling. When warfare is the only means to prevent the mass killing or enslavement of the innocent, the purposes of military force are clear enough (though undoubtedly many other problems remain). The problem is more pressing, how- ever, for the justification of national defence.3 Although common-sense morality and international law view national defence as the paradigm case of justified warfare, grounding this consensus is surprisingly difficult.4 We typically believe that any state is justified in using lethal force to protect its territory against any form of uninvited military incursion by any other state. And yet we lack a good argument to explain why this should be so. In this chapter, I explain why one familiar and otherwise plausible approach to the justification of killing in war cannot adequately ground common-sense views of permissible national defence.5 Reductionists believe that justified warfare reduces to an aggregation of acts that are justified under ordinary principles of interpersonal morality.6 The standard form of reductionism focuses on the principles governing killing in ordinary life, specifically those that justify intentional killing in self- and other-defence, and unintended but foreseen (for short, collateral) killing as a lesser evil. Justified warfare, on this view, is no more than the coextension of multiple acts justified under these two principles. Reductionism is the default philosophical approach to thinking through the ethics of killing in war. It makes perfect sense to ask what principles govern permissible kill- ing in general, before applying them to the particular context of war. If it cannot deliver a plausible set of conclusions about when national defence is permitted, then we must either revise our beliefs about which conclusions count as plausible, or else face the significant challenge of developing a different theoretical model for justifying war- fare—an exceptionalist model, which views war as an exception to the regular moral landscape, to which principles apply which apply to nothing else but war.7 We must show, in other words, that there is something worth fighting for in wars of national defence, which is not engaged when we use force in any other context. The chapter proceeds as follows. Section 2.2 sets out the argument against reduc- tionism.8 Section 2.3 considers and rebuts one common response to the argument, which has often been thought sufficient grounds to disregard its conclusion. Section 2.4 then asks whether a modified reductionism would survive unscathed by the argu- ment. Finally, section 2.5 sets out some desiderata on a plausible exceptionalist alterna- tive. In National Responsibility and Global Justice, David Miller defends the view that a member of a nation can be collectively responsible for an outcome despite the fact that: (i) she did not control it; (ii) she actively opposed those of her nation’s policies that produced the outcome; and (iii) actively opposing the relevant policy was costly for her. I argue that Miller’s arguments in favor of this strong externalist view about responsibility and control are insufficient. Specifically, I show that (...) National history has once again become a battlefield. In internal political conflicts, which are fought on the terrain of popular culture, museums, schoolbooks, and memorial politics, it has taken on a newly important and contested role. Irrespective of national specifics, the narratives of new nationalism are quite similar everywhere. National history is said to stretch back many centuries, expressesing the historical continuity of a homogeneous people and its timeless character. This people struggles for independence, guided by (...) towering leaders and inspired by the sacrifice of martyrs. Unlike earlier forms of nationalism, the main enemies are no longer neighbouring states, but international and supranational institutions. To use national history as an integrative tool, new nationalists claim that the media and school history curricula should not contest or question the nation and its great historical deeds, as doubts threaten to weaken and dishonour the nation. This book offers a broad international overview of the rhetoric, contents, and contexts of the rise of these renewed national historical narratives, and of how professional historians have reacted to these phenomena. The transition from empire to nation-state poses challenges in managing religious and ethnic pluralism. Empires, characterized by hierarchical structures and diversity, contrast with nation-states, which aim for uniformity and unity. As empires modernize administratively, they grapple with different approaches to pluralism. While Habsburgs were more in favor of a federal plurality, the Romanovs pushed for centralization and assimilation. Throughout the nineteenth century, the Ottomans vacillated between these two alternative paths. This vacillation is most evident in their approach to millet system (...) which simultaneously followed the contradictory policies of undermining millet boundaries in order to promote a sense of unity across the multi-faith society and policies of promoting and safeguarding the privileges and group-specific rights of non-Muslim communities. Ottoman nationalism eventually shifted towards a homogenizing model, akin to the Romanov approach, leading to the exclusion of religious minorities. This process of homogenization continued in the nationalist policies of modern Turkey and resulted in the secular Turkish Republic being less tolerant towards non-Muslims than the Islamic Ottoman Empire. We examine the extent to which host country income inequality influences multinational enterprises’ (MNE) expansion strategy for foreign production investment, depending on their specific strategic objectives. Applying a transaction cost framework, we predict that national income inequality has an inverted U-shaped relationship with foreign production investment. As inequality increases, MNEs accrue lower transaction costs arising from interactions with various local actors, leading to higher probability of investment. As income inequality increases further, its effect on location attractiveness will become negative, (...) as its attraction effect is increasingly offset by additional monitoring, bargaining, and security costs owing to the more fractious nature of high inequality societies. In addition, we suggest that the impact of income inequality is contingent on investment objectives: The inverted U-shaped relationship is stronger for efficiency-seeking investment but weaker for market-seeking and competence-enhancing investments. We find substantial support for our hypotheses through an analysis of 27 years (1986-2012) of data on Japanese MNEs’ overseas production entries. (shrink)

National Action Plans on business and human rights are a growing phenomenon. Since 2011, 42 such plans have been adopted or are in-development worldwide. By comparison, only 39 general human rights action plans were published between 1993 and 2021. In parallel, NAPs have attracted growing scholarly interest. While some studies highlight their potential to advance national compliance with international norms, others criticise NAPs as cosmetic devices that states use to deflect attention from persisting abuses and needed regulation. In (...) response to wider critiques of international human rights norms, and their failure to exact universal state compliance, experimentalist governance theory highlights the dynamic, dialogic and iterative character of human rights implementation as well as the role of stakeholders. In this article, we apply experimentalist governance theory to evaluate the role and character of business and human rights NAPs. Rather than attempting to evaluate NAPs’ ultimate consequences for rights-holders, which appears premature, we focus on NAPs processes. Specifically, we analyse NAPs processes in twenty-five states against five experimentalist governance criteria relating to stakeholder participation; agreement on a broad problem definition; local contextualisation; monitoring and peer review and periodic revision and learning. According to our findings, NAPs on business and human rights in most states demonstrate resemblance to the traits of experimentalist governance. In particular, our analysis points to the emergence of relatively sophisticated and demanding institutional governance mechanisms within NAPs — including the institutionalisation of complex deliberative processes. Nevertheless, our paper also identifies some significant shortcomings in NAPs, related to the lack of inclusion of vulnerable groups and the lack of explicit indicators and targets. (shrink)

Research in the fields of complex problem solving (CPS) and dynamic decision making using microworlds has been mainly conducted in Western industrialized countries. This study analyzes the CPS process by investigating thinking‐aloud protocols in five countries. Participants were 511 students from Brazil, Germany, India, the Philippines, and the United States who worked on two microworlds. On the basis of cultural‐psychological theories, specific cross‐national differences in CPS strategies were hypothesized. Following theories of situatedness of cognition, hypotheses about the specific frequency (...) of problem‐solving strategies in the two microworlds were developed. Results of the verbal protocols showed (a) modification of the theoretical CPS model, (b) task dependence of CPS strategies, and (c) cross‐national differences in CPS strategies. This article analyzes Orthodox influence on developing national identity in modern Ukraine. The authors state that the factor of national specificity of Christianity is evident if we consider nations, especially in Central and Eastern Europe. In addition, Christianity influences the development of national cultures and has acquired the national characteristics of a particular community. Also, the war in Ukraine, which was started by the Russian Federation on 24 February 2022, has significantly impacted socio-cultural processes in Ukraine, (...) the functioning of national identity, and the religious situation, especially regarding the Orthodox churches. Authors pay attention to the reference to the topic of national identity in the documents and sermons of the Orthodox Church of Ukraine to show how the Orthodox hierarchies treat these issues. In addition, they study the ideologies that the Russian Orthodox Church creates and tries to impose through the faithful of the Ukrainian Orthodox Church churches of the Moscow Patriarchate as a dominant cultural, religious, and political discourse. In response to the concern that ethnically diverse immigrants are not being sufficiently integrated into receiving liberal democratic societies, liberal nationalists have offered two specific naturalization policy proposals. The first would require naturalizing immigrants to assimilate the national culture of the receiving society; the second would encourage newcomers to adopt the prevailing civic national identity. This paper rejects these proposals. In contrast to liberal nationalists, I deny that good citizenship presupposes a common culture or civic national identity (...) and I develop a non-nationalist naturalization model that would encourage immigrants to become integrated into liberal democratic societies by participating in their major socio-economic and political institutions and practices. This paper offers a genealogy of national unity in the United States approached through practices of consumption and punishment. Drawing on the work of Foucault, Mauss, and Bataille, the analysis shows how these practices are mutually determining, how they demonstrate an economy of excess as opposed to one of utility or conservation, and how they depend on and reinforce specific patterns of discursive and emotional coding. The Thanksgiving holiday serves as a privileged site for locating the elements of an (...) apparatus that stretches from the earliest days of colonization to the present, and that operates across diverse political, religious, and ethnic lines. The National Summit on Legal Preparedness for Obesity Prevention and Control was conceived by the Centers for Disease Control and Prevention as a strategic conference to review the current status of legal preparedness for obesity prevention and control, identify potential gaps, and develop specific action options for improving the contribution law can make to reduce the health threat posed by obesity. Working with the collaborating partners and planning committe, the host committe planned and modeled after the Summit CDC’s 2007 (...) conference on public health emergency legal preparedness that resulted in the National Action Agenda for Public Health Emergency Legal Preparedness. The summit was a working meeting that offered invited participants a structured opportunity to deliberate about the laws and legal issues that impact obesity prevention and control from a public health perspective. Although national identity is valuable in a variety of ways, I argue that its value is not sufficient to justify a group’s right to govern itself, either in the form of an independent, sovereign state or an autonomous, sub-state government. My thesis is somewhat unusual—most philosophers who affirm the value of national identity also endorse the right of a national community to some form of self-government, and most philosophers who deny that a national community has the (...) right to any form of self-government also deny the value of national identity. This article explores nation building as an organizational accomplishment and uses the concept of boundary object to explain how the groups that compose the nation cooperate. Specifically, the article examines the mechanisms devised to secure a flow of money from the Irish-American and Jewish-American diasporas to their respective homelands. To overcome problems associated with conventional philanthropy, Irish and Jewish nationalists issued bonds and sold them to their American compatriots as a hybrid of a gift and an investment. In the Irish (...) case, disagreements about the entitlement to the proceeds resulted in the termination of the bond project. In the Jewish case, the bond served as a boundary object allowing American and Israeli Jews to cooperate despite ongoing tensions. The Israeli bond provided Jewish-Americans with an additional way to invest themselves financially and emotionally in Israel. This bond is an example of a socio-technical mechanism used to create national attachments. (shrink)

The subject of this article is the conceptual core of early Soviet cultural policy in the field of nation-building, as indicated by the well-known Stalinist formulation “socialist in content, national in form.” In addition to being well recognizable, there are several reason to address this phrase: 1) an interest in the Soviet regime’s language of self-description, which not only “conceals” real social practices from us, but also gives us access to them; 2) the opportunity to extend its descriptive power (...) not only to the culture of socialist realism but also to the nature of production in the multinational socialist space; and 3) the formulation is not as vague and empty as it may seem, despite the manipulativeness so characteristic of the language of ideology that allows one to avoid any meaningful definition through multi-stage rhetorical moves.This article describes both the logical-rhetorical effects produced by the phrase and the sociocultural problems it was attempting to respond to. The main material for the present analysis is the work of Bolshevik leaders on the nationalities question and on issues of cultural construction. Its theoretical framework is contemporary research focused on the specific features of the Soviet multinational political project. (shrink)

This article focuses on the themes of the two conferences organized by the League of Nations—“Modern Man” and “The Foundations of Modern Humanism”—which were held in Nice and Budapest in 1935 and 1936, respectively. It was a time of deepening crisis, when the pervasive belief was that European civilization was declining. The more specific questions discussed in these conferences included the relation of modern man to the state, the impact of irrational theories on modern life, and the need for free (...) education for everyone. Renowned writers and academics of the period participated in the debates, among them Thomas Mann, Jules Romains, Salvador de Madariaga, Alfred Zimmern, and Johan Huizinga. I present a critical overview of their debates, beginning with Paul Valéry, the initiator and chairman of these conferences, who coined the intriguing slogan “La Société des Nations suppose la Société des Esprits.”. The aim of this paper is to show the role, the possibilities and the limits of Wyspiański’s national thinking through Shakespeare’s Hamlet. Of particular importance, in this context, is the role the Ghost takes in Wyspiański’s celebrated interpretation of Shakespeare’s Hamlet. By the Ghost we mean the spirit of history, the ghost of a father, the spirit of the fatherland, the voice of the ancestors, and particularly that of the Polish king Casimir the Great, as well as the Holy (...) Ghost and the Evil Spirit because all these aspects of the Ghost belong to Wyspiański’s vision. The play in question bears witness to what the Polish poet calls “the truth of other worlds,” as well as the truth of the theatre, which Wyspiański calls the labyrinth. The poet manages to reduce, to some extent, this difficult truth to the truth of the world he cared most about, that is the present and historical reality of Poland, more specifically the city of Cracow, known as Poland’s spiritual, that is “ghostly,” and only virtual, capital. It is also remarkable that Wyspiański saw the Ghost in Hamlet in the context of other Shakespearean ghosts, apparitions and magicians, such as those that appear in Macbeth, The Tempest, Julius Caesar, A Midsummer Night’s Dream or Richard III. At the same time, Wyspiański realizes that the Ghost, with its irrationalism, offends the spirit of post-medieval times, and as such, is understandably neglected by Hamlet, who for Wyspiański, in anticipation of Harold Bloom, stands for modernity. In this paper, I consider the objection that unilateral secession by a national group (e.g., the Scots) from a legitimate, nonusurping state would wrong minority nationalities within the seceding territory. I show first that most proponents of this objection assume that the ground of the right to national self-determination is the protection of the group’s culture. I show that there are alternative justifications available. I then set out a version of this objection that does not rely on this (...) claim; on this objection, a national minority that seceded and created its own state would commit an expressive wrong against minorities within the territory over which it claimed jurisdiction. I show that this objection is undermotivated: only under a specific set of circumstances would the minorities of the secessionist region be subject to an expressive wrong. Finally, I show that the correct way to think about the claims of minorities in secessionist regions is in terms of a claim to secure access to equal civic status such that they are not at risk of becoming justifiably alienated from their new state. If a secessionist group cannot provide this guarantee to the minority residents of their territory, then their seceding would commit wrongful harm, and the presumption in favour of collective autonomy is defeated. I call this defeater the ‘Alienation Defeater.’With this in hand, we are now in a position to explain why nations are normatively special. Responding to the objections broached by Allen Buchanan and others, I show that even if other kinds of groups, such as religious groups, have the features in virtue of which nations have a claim to self-determination, this does not entail that those groups also have the right to secede. This is because an account of self-determination needs a list of ‘defeaters’—features in virtue of which a group’s claim to self-determination is defeated. I argue that religious groups are the strongest candidate for having a claim to collective autonomy in virtue of sharing many features with nations. I then argue that religious groups will run afoul of the Alienation Defeater; religious identity is too narrow to be the basis of the dominant collective identity of a state. This does not apply to nationality. This, I explain, is because of qualitative differences between religious groups, qua religious groups, and nations. (shrink)

The National Institute for Health and Care Excellence (NICE) is the UK’s primary healthcare priority-setting body, responsible for advising the National Health Service in England on which technologies to fund and which to reject. Until recently, the normative approach underlying this advice was described in a 2008 document entitled ‘Social value judgements: Principles for the development of NICE guidance’ (SVJ). In January 2020, however, NICE replaced SVJ with a new articulation of its guiding principles. Given the significant evolution (...) of NICE’s methods between 2008 and 2020, this study examines whether this new document (‘Principles’) offers a transparent account of NICE’s current normative approach. It finds that it does not, deriving much of its content directly from SVJ and failing to fully acknowledge or explain how and why NICE’s approach has since changed. In particular, Principles is found to offer a largely procedural account of NICE decision-making, despite evidence of the increasing reliance of NICE’s methods on substantive decision-rules and ‘modifiers’ that cannot be justified in purely procedural terms. Thus, while Principles tells NICE’s stakeholders much about how the organisation goes about the process of decision-making, it tells them little about the substantive grounds on which its decisions are now based. It is therefore argued that Principles does not offer a transparent account of NICE’s normative approach (either alone, or alongside other documents) and that, given NICE’s reliance on transparency as a requirement of procedural justice, NICE does not in this respect satisfy its own specification of a just decision-maker. This article aims to discuss the discourses and debates on Khilafah system in Muslim countries and how it transforms into a nation-state system, specifically in Indonesia. These dicourses and debates include the contestation and trends in the connection between Islam as a religion and Indonesia as a nation-state, which reemerged after the ban of Hizbut Tahrir Indonesia (HTI) in 2017 and The Front of Islamic Defenders (Front Pembela Islam/FPI) in 2020 accordingly under President Jokowi’s administration. This article employs descriptive qualitative (...) analysis to investigate the historical sequences of the discourses and debates on the genealogy, contestation, and relation between the Khilafah system and the nation-state system in Indonesia to uncover the fundamental ideology which underlines the conflicting interests in the debate. It operates the historical-sociological approaches to examine the data collected from books, articles, journals, and newspapers which contain the opinions of the prominent Muslim scholars gearing the dynamic discourses and debates on the nation-state system and Khilafah system. This article, therefore, attempts to demonstrate how Khilafah system idea emerged after the death of the prophet Muhammad and how this idea was contested by Muslim scholars and leaders today. This article suggests that in the struggle of ideology, thought, and movement inside the Muslim countries including Indonesia, the Khilafah system and the system of nation-state came into conflict. The National Summit on Legal Preparedness for Obesity Prevention and Control was conceived by the Centers for Disease Control and Prevention as a strategic conference to review the current status of legal preparedness for obesity prevention and control, identify potential gaps, and develop specific action options for improving the contribution law can make to reduce the health threat posed by obesity. Working with the collaborating partners and planning committe, the host committe planned and modeled after the Summit CDC’s 2007 (...) conference on public health emergency legal preparedness that resulted in the National Action Agenda for Public Health Emergency Legal Preparedness. The summit was a working meeting that offered invited participants a structured opportunity to deliberate about the laws and legal issues that impact obesity prevention and control from a public health perspective. The moral issues about nationalism arise from the character of nationalism as a form of partiality. Nationalists care more about their own nation and its members than about other nations and their members; in that way nationalists are partial to their own national group. The question, then, is whether this national partiality is morally justified or, on the contrary, whether everyone ought to care impartially about all members of all nations. As Jeff McMahan emphasizes in [another chapter of (...) the book in which this essay appears], a philosophical examination of this question must consider the specific features of nationalism as one form of partiality among others. Some partiality--for example, toward one's spouse and children--seems morally acceptable and even a duty. According to commonsense moral thinking, one not only may but also should care more about one's family members than about strangers. But other instances of partiality, most notably racial partiality, are in most circumstances widely condemned. Is national partiality more like familial partiality or more like racial partiality? To answer this question, we must know what in general justifies attitudes of partiality. Caring more about certain people is appropriate when one stands in certain special relations to those people. But what are these relations, and to what degree do they hold among members of the same nation? Assuming they are present within families and not within races, to what degree are they present within nations? (shrink)

Objective: To provide an ethical analysis of whether the Ethiopian and Tanzanian national HIV/AIDS treatment guidelines can be considered legitimate and fair rationing tools.Method: Qualitative study and ethical analysis involving guideline documents and interviews with nine key members involved in the development of the guidelines. The analysis followed an editing organising style. The theoretical framework was a guideline-specific framework based on theories of just resource allocation in healthcare and conditions that ensure fair processes in guideline development. According to this (...) framework, legitimate rationing requires reasons for patient selection to be explicit, public and relevant, and decisions must be open to question and revision.Results: The only explicit rationing criteria that both guidelines recommended were clinical antiretroviral treatment indications. Explicit non-clinical rationing criteria were expressed in a separate Ethiopian implementation guideline. Neither of the guideline development processes fully satisfies minimal requirements of procedural fairness. There is a lack of transparency. The reasons for decisions are rarely given and are not publicly available. This reduces the opportunity for public questioning, debate and revisions. The guidelines were based on expert opinion and consensus. Recommendations from the WHO were copied without much discussion, disagreement or adjustment.Conclusions: The two national HIV treatment guidelines discussed are de facto mechanisms for rationing but were developed using methods that do not fully satisfy the requirements of fair processes. This article provides a critical review of new policies in China, the United States, and the European Union that characterize genomic data as a national strategic resource. Specifically, we review policies that regulate human genomic data for economic, national security, or other strategic purposes rather than ethical or individual rights purposes.

Before talking about national science as a specific phenomenon we find out the essence of science as a phenomenon in general. We note that science is one of the most complex phenomena of social life. Complex understanding of it complicates the fact that science is structurally extremely complex, polyfunctional, historically variable, with many of its faces included in this or that sphere of social life. It therefore appears as an extremely diverse social phenomenon. This raises some difficulties in developing (...) a general definition of it. As G. Volkov correctly pointed out, "there is nothing simpler than giving a definition to any phenomenon, when the whole thing is only in the formulation, and there is nothing more complicated than when it comes to the concentration in the concentrated form of the very essence of the object under study". In this article, I shall evaluate critically the democratic citizenship education project in South Africa to ascertain whether the patriotic sentiments expressed in the Manifesto on Values, Education and Democracy (2001) are in conflict with the achievement of reconciliation and nation building (specifically peace and friendship) after decades of apartheid rule. My first argument is that, although it seems as if the teaching of patriotism through the Department of Education's democratic citizenship agenda in South African schools is a laudable initiative (...) that can contribute toward establishing a definitive break with our apartheid past, the expression of blind patriotic sentiments (such as pledging allegiance to one's country and its citizens only) as articulated in the Manifesto can potentially marginalise others (immigrant communities) as the country endeavours to build its fledgling democracy. My second argument is that the intended democratic form of patriotism of the Department of Education can possibly be undermined by cultivating a culture of ‘safe expression’, which could slow down the country's quest for reconciliation and nation building. BackgroundEthical and regulatory guidance on the collection and use of human biospecimens for research forms an essential component of national health systems in Sub-Saharan Africa, where rapid advances in genetic- and genomic-based technologies are fueling clinical trials involving HBS and the establishment of large-scale biobanks.MethodsAn extensive multi-level search for publicly available ethics regulatory guidance was conducted for each SSA country. A second review documented active trials listed in the WHO International Clinical Trials Registry Platform as of January 2015 in (...) which HBS collection was specified in the protocol. Findings were combined to determine the extent to which countries that are study sites for HBS-related research are supported by regulatory guidance language on the collection, use, ownership and storage of biospecimens.ResultsOf the 49 SSA countries, 29 had some form of national ethics guidance, yet only 17 provided language relating to HBS-related research, with specific guidance on consent, ownership, reuse, storage, and export/import/transfer. Ten countries accounted for 84 % of the active clinical trials involving the collection of HBS in SSA. All except one of these countries were found to have some national guidance in the form of regulations, codes of ethics, and/or standard operating procedures; however, only seven of the ten offered any language specific to HBS.ConclusionsDespite the fact that the bulk of registered clinical trials in SSA involving HBS, as well as existing and proposed sites for biorepositories under the H3Africa Initiative, are currently situated in countries with the most complete ethics and regulatory guidance, variability in the regulations themselves may create challenges for planned and future pan-African collaborations and may require legislative action at the national level to revise. Countries in SSA that still lack regulatory guidance on HBS will require extensive health system strengthening in ethics governance before they can be full participants in the modern research enterprise. The development of genomics has dramatically expanded the scope of genetic research, and collections of genetic biosamples have proliferated in countries with active genomics research programs. In this essay, we consider a particular kind of collection, national biobanks. National biobanks are often presented by advocates as an economic ‘‘resource’’ that will be used by both basic researchers and academic biologists, as well as by pharmaceutical diagnostic and clinical genomics companies. Although national biobanks have been the subject of (...) intense interest in recent social science literature, most prior work on this topic focuses either on bioethical issues related to biobanks, such as the question of informed consent, or on the possibilities for scientific citizenship that they make possible. We emphasize, by contrast, the economic aspect of biobanks, focusing specifically on the way in which national biobanks create biovalue. Our emphasis on the economic aspect of biobanks allows us to recognize the importance of what we call clinical labor—that is, the regularized, embodied work that members of the national population are expected to perform in their role as biobank participants—in the creation of biovalue through biobanks. Moreover, it allows us to understand how the technical way in which national biobanks link clinical labor to databases alters both medical and popular understandings of risk for common diseases and conditions. Throughout Europe, science and technology policy within the environmental field is currently in a process of transformation, which has been characterised by many observers as ecological modernisation. Emphasis is being given to preventive principles and so-called cleaner technologies in the quest for a more sustainable development. Each European country has, however, adapted the new doctrines and practices in distinctive ways. The main aim of the paper is to show how contemporary policies have been shaped by history, more specifically, by institutional (...) and cognitive traditions, and by national policy styles. By comparing 'ecological modernisation ' in Sweden and Denmark, we attempt to indicate how such national cultural differences affect the ways in which science and technology policies in the environmental field are formulated and implemented. Issues that arise in using game theory to model national security problems are discussed, including positing nation-states as players, assuming that their decision makers act rationally and possess complete information, and modeling certain conflicts as two-person games. A generic two-person game called the Conflict Game, which captures strategic features of such variable-sum games as Chicken and Prisoners'' Dilemma, is then analyzed. Unlike these classical games, however, the Conflict Game is a two-stage game in which each player can threaten to (...) retaliate — and carry out this threat in the second stage — if its opponent chose noncooperation in the first stage.Conditions for the existence of different pure-strategy Nash equilibria, or stable outcomes, are found, and these results are extended to situations in which the players can select mixed strategies (i.e., make probabilistic threats or choices). Although the Conflict Game sheds light on the rational foundations underlying arms races, nuclear deterrence, and other strategic situations, more detailed assumptions are required to tie this generic game to specific conflicts. In modern discourse about the history of science, it seems to be widely accepted that at the end of the nineteenth century, Germany was one of the leading countries in the production of science. In the past, historians of science tried to trace back a specific ‘German style’ of science that—in combination with other factors—determined this German dominance around 1900, especially in the life sciences. Considering the theoretical concept of ‘national styles’, it has to be kept in mind that (...) around 1900, contemporaries already proclaimed ‘national styles’ of science as representations of national identity. Thus, the question arises as to how far existing historiographical conceptions of national styles may include earlier claims and prejudices. Careful reconstructions of contemporary discourses on national styles and inquiries into the ‘stylisation’ of a dominant, successful ‘German style’ are necessary. One of the contemporary critics of a ‘German style’ of science was the physiologist Jacques Loeb (1859–1924), who emigrated to the USA in 1891. Loeb corresponded regularly with the physicist and philosopher Ernst Mach (1838–1916). Ernst Mach can be considered Loeb's intellectual father with whom he corresponded about strategic, philosophical, and epistemological questions. Using the Loeb–Mach correspondence, the aim of the paper is to reconstruct Loeb's conception of a ‘German style’ of science and its differences to an ‘American style’. Changes in his views are discussed as well as the roots of his views and some of their consequences. Finally, Loeb's ideas on national styles and his working profiles before and after his emigration are compared to historiographical analyses of ‘American’ or ‘German’ styles of science around 1900. Many countries, including Australia, have established a national scheme that supports the recognition of a single ethical review for multi-centre research conducted in publicly funded health services. However, local site-specific governance review processes remain decentralised and highly variable. This short report describes the ethics and governance processes required for a negligible risk national survey of physiotherapy-led airway clearance services in Australia. We detail inconsistencies in research governance document preparation and submission (platforms, processes, forms and signatories) and report the (...) time cost and likely impact of these inconsistencies on health services research outcomes. Processes and strategies that facilitated success in this project are identified and summarised as helpful hints to other researchers looking to embark on negligible risk research in public health facilities. BackgroundAs hospitals have grown more complex, the ethical concerns they confront have grown correspondingly complicated. Many hospitals have consequently developed health care ethics programs (HCEPs) that include far more than ethics consultation services alone. Yet systematic research on these programs is lacking.MethodsBased on a national, cross-sectional survey of a stratified sample of 600 US hospitals, we report on the prevalence, scope, activities, staffing, workload, financial compensation, and greatest challenges facing HCEPs.ResultsAmong 372 hospitals whose informants responded to an online survey, (...) 97% of hospitals have HCEPs. Their scope includes clinical ethics functions in virtually all hospitals, but includes other functions in far fewer hospitals: ethical leadership (35.7%), regulatory compliance (29.0%), business ethics (26.2%), and research ethics (12.6%). HCEPs are responsible for providing ongoing ethics education to various target audiences including all staff (77.0%), nurses (59.9%), staff physicians (49.0%), hospital leadership (44.2%), medical residents (20.3%) and the community/general public (18.4%). HCEPs staff are most commonly involved in policy work through review of existing policies but are less often involved in development of new policies. HCEPs have an ethics representative in executive leadership in 80.5% of hospitals, have representation on other hospital committees in 40.7%, are actively engaged in community outreach in 22.6%, and lead large-scale ethics quality improvement initiatives in 17.7%. In general, major teaching hospitals and urban hospitals have the most highly integrated ethics programs with the broadest scope and greatest number of activities. Larger hospitals, academically affiliated hospitals, and urban hospitals have significantly more individuals performing HCEP work and significantly more individuals receiving financial compensation specifically for that work. Overall, the most common greatest challenge facing HCEPs is resource shortages, whereas underutilization is the most common greatest challenge for hospitals with fewer than 100 beds. Respondents’ strategies for managing challenges include staff training and additional funds.ConclusionsWhile this study must be cautiously interpreted due to its limitations, the findings may be useful for understanding the characteristics of HCEPs in US hospitals and the factors associated with these characteristics. In this article, I make the case for—and begin the task of—examining the role of nation branding in the philanthropic sector. Using a series of cases drawn from Canadian organized philanthropy, I explore the ideological work that philanthropic nation branding does, as well as the social and political implications of this phenomenon. I bring critical theories of nation and national identity together with Marxian-inspired theories of capitalism—particularly those that foreground the racial and colonial dimensions of capital accumulation—to illuminate the (...) nationally embedded contradictions at the core of organized philanthropy in Canada. Specifically, I focus on how racialized and colonial discourses of the nation are mobilized in philanthropic nation branding in ways that elevate and legitimize organized philanthropy as a contradiction-free mechanism for addressing racial and colonial inequities in Canada. In doing so, philanthropic nation branding obscures the explicitly racial and colonial processes of accumulation that produce the philanthropic wealth powering much of the sector, thereby reinforcing an ahistorical Canadian nation brand. Through this analysis, I illustrate the importance of centering race and national identity in critical work on the political economy of philanthropy, organizational branding, and the ethics of philanthropy as a social policy mechanism in Canada, as well as other national contexts. Accounts of the nation and national identity have tended to focus upon the transmission by cultural elites of authoritative culture, invented traditions and folk customs. Following Billig, I suggest that the national is increasingly located in the everyday and in the realm of popular culture; far more so than in ‘high’ and ‘official’ forms of culture. To exemplify this, I discuss national automobilities, specifically exploring the role of iconic models, mundane motorscapes and the everyday, habitual performances of (...) driving. With a particular focus upon British and Indian car cultures, I further suggest that the ‘national’ is not a singular or monolithic entity but is constituted out of a vast matrix of interrelated elements, three of which are the models, geographies and performances identified above. As the national proliferates and expands, becoming globalized, it generates multiple forms of national identity, although consistencies and points of focus remain. Accordingly, as in other cultural fields, I argue that while global manifestations of automobility proliferate, this has not necessarily diminished the salience of the national in the relationship between driving cars and identity. The national thus remains a powerful constituent of identity precisely because of its often unreflexive grounding in everyday spaces and practices. (shrink)

This study gave a historical account of the contributions of Christianity to the overall development of Nigeria. From the inception of Christianity in Nigeria, it has been inculcating in its adherents’ uncompromised moral values, respect for human life and dignity through adequate education and social tasks. Unfortunately, social critics have constantly but erroneously, underestimated the contributions made by Christian missionary work in Nigeria. Therefore, this research was an attempt to specifically show that Christianity is genuine; it has made great strides (...) in the areas of education, agriculture, healthcare and rural development. Its contribution to national development will be portrayed in this work. Christianity was committed to upholding social justice, equality and people’s welfare, all of which helped a country achieve national development. The purpose of enumerating the contributions of Christianity was to correct the bad impressions which the social critics might have generated. This was also to buttress that nation building was part of the agenda in missionary work in Nigeria. To achieve this aim, a historical approach was used. The findings made clear the fact that Christianity is one popular institution that has greatly influenced many Nigerians positively. Hence, most Nigerians were in love with Christian mission.Contribution: This work corrected the negative impressions which social critics might have generated about Christianity. It buttressed that nation building remained the prime agenda in missionary work in the entire universe. Christianity’s continuous contribution to Nigeria cannot be overemphasised; it is a peaceful religion. (shrink)

Gabaccia's endeavor is motivated by the question "What difference does it make if we call someone a foreigner, an immigrant, an emigrant, a migrant, a refugee, an alien, an exile or an illegal or clandestine?" (Gabaccia 5). (...) This question is very important to the immigration debate because, as Gabaccia goes on to show, "[t]o ponder this question is to explore the vastly differing ways that human population movements figure in nation-building and in the historical imagination of nations" (Gabaccia 5-6). In this paper, I am going to delve deeper into Gabaccia's claim and argue that the issue of immigration is important for philosophers to consider because it is an issue that lies at the heart of the intersection between political philosophy and philosophy of race—an intersection that shows, more than anywhere else and in particular in the debate surrounding the use of the word illegal, how and why words do matter.The Braid of WhitenessDavid Roediger, in his book Working Toward Whiteness, argues that it is problematic to read "ethnicity" back into earlier accounts of race, specifically in the United States during the period from 1860-1924. Roediger argues that the term "ethnicity," at least as we use it today, does not really appear during this period. He goes on to show how the use of racialized language during that period was in fact very messy and would not fit neatly into the strict biological/phenotypic definitions that we give today. While I am not sure Roediger does enough in his account to warrant dismissing the race/ethnicity distinction at the turn of the century, I think he is right in emphasizing whiteness as central to racism. He is also correct to note the key role that restrictions on immigration played in the construction and solidification of the U.S. nation-state as a white nation.To be clear, the term whiteness, in its more technical sense, does not simplistically refer to skin color, but denotes the dominant race and/or ethnicity as it passes for the nonracialized and non-ethnic norm upon which the "other" is differentiated. MVi is actively engaged with the Bounorng, Kouy, Stieng, Kreung, Prov, Laak, and Kavet communities in the provinces of Mondulkiri, Stung Treng, and Kratie. Over the years, MVi has implemented three strategic plans since 2006, focusing on supporting indigenous and rural communities in these three provinces. The strategic plan for the period 2023–2027 is designed to enhance the livelihoods and economic conditions of indigenous and vulnerable communities. This plan prioritizes four key areas: climate change, natural resource management, modern agriculture production (...) and market, and social accountability. Supporting the establishment and functionality of sub-national networks is not only a core value of MVi but also a strategic approach. MVi actively facilitates the formation of sub-national networks, including the indigenous youth network, indigenous women's network on NRM, and youth/child network on CEFM. These networks are crucial in promoting self-reliance and addressing specific issues. The performances of indigenous youths and women are evaluated based on their understanding of roles and responsibilities, dissemination of youth's roles in natural resource management, participation in trainings and seminars, organization of regular meetings, coordination with community leaders for various meetings and events, mobilization of youth members to address NRM issues, implementation of plans to protect natural resources, integration of NRM plans into commune investment plans, advocacy for NRM issues with networks and decision-makers, and collaboration with other communities for NRM discussions and actions. The application of the latest technologies in biology and medicine has brought them to a qualitatively new level of possibilities. Worldwide, biobanking is actively developing through the creation of biobanks of various types and purposes, whose resources are used to solve therapeutic or scientific problems. Legal science remains an open question concerning the boundary that runs between the right to data protection and the scope of disclosure of data needed for medical purposes. In this article, the author considers peculiarities of (...) data processing in the context of biobanking activity on the example of Austria and its national legislation. In addition, the article reveals features of the approaches of the European Court of Human Rights (ECtHR) and the Council of Europe to the issue of biobanking in general, its characteristics in the context of data, and legal regulation of this phenomenon in the national law of states. The author devoted an important part of the study to the role of Austria’s experience in the context of data processing for scientific purposes and the development of biobanking for a number of other European states. The aim of the article is to analyze the Austrian legislation on data processing for scientific research and biobanking, the attitude of the Council of Europe to this phenomenon, and the practice of the ECtHR, as well as to consider the impact of the current world situation on these activities. The leading method of research used in the article is the formal-legal method. The article analyzes the Austrian law in the context of data processing in medical research, the relationship of the specifics of personal data protection, and the need to disclose them for scientific purposes. The author pays special attention to the influence of Austrian law on the legislation of other countries, which is reflected in the conclusions to the article. In addition, based on an analysis of the application of the Austrian experience to the legislation of Poland and Ukraine, the author points out the necessary changes that should be made in the laws of these countries. This article argues that historically specific, transnational structures and conjunctures influence the car’s national belongingness. Neither historians nor sociologists have devoted sufficient attention to how the automobile mediates cultural processes in general and national identification in particular, the article maintains. Using a British motoring journalist’s observations on the 1928 Berlin Auto Show, the discussion explores how the Mercedes worked as a symbol of German automotive tradition, a marker of international relations between Britain and Germany, and a spur to (...) anxieties about the effects of mass production techniques and US automobility for both countries. The article then turns to small cars, demonstrating that the British observer’s embrace of German and Continental small-car design belied longer-term anxieties about the level and nature of British automobility, while simultaneously mirroring German dissatisfactions and hopes regarding the potential for mass auto ownership in the form of the Volkswagen. If cars in some sense ‘belong’ to nations, the study concludes, then it is important to stress how the continuities and discontinuities that condition such belongingness often work across national borders in historically unique combinations. According to the Russian tradition literature is something more than only literature. In the special situation, the writers take over functions of scientific disciplines such as philosophy, ethics, the press or the political parties. These trends intensify during critical periods when Russia has to solve a problem of its national identity. The aim of the present text is an attempt to present how contemporary Russian “patriotical” literature is insistently fighting to keep monopoly on spiritual leadership in democratizing Russia. Petrifying (...) specific tradition, the writers are diagnosing all signs of evil, tracing either actual or potential wrongdoers. Their wish is to realize the vision of an autarchic Russia as a special being. Literature not only supports ideology—especially conservative, right—wing ideology, but also becomes the ideology itself. (shrink)

The founding will of the Republic of Turkey, after challenges that they had to go though in a new country, have entered into a new state and feverish efforts to build a new society. The victories which were won in the battlefield must be crowned with a strong state and community structure that will not have to face the same problems again. The first and most important thing to be done for this is to provide the construction of the (...) class='Hi'>national identity which is the fundamental basis of the indivisible integrity of the state with the country and nation by implementing some changes that have been discussed within the intellectual point of view since the Tanzimat reform era. Just as history, language, mythology, culture, science and education became the means of this purpose, the religious institution was tried to be organized to serve this basic purpose. It is certain that religious arrangements will meet greater challenges than other revolutions. The aim of the study is to provide a better understanding of the basic intention behind the arrangements that the founding staff of the republic are trying to implement in the religious field in terms of language. The main purpose of the revolutions in the Turkishization of the language of religion is the concerns about the construction of a solid national identity. It is an article of almost religious faith in the United Kingdom that the National Health Service is far superior to a competitive market in health care services. In this brief and informal paper I show that the opposite is true. In contrast to market provision, the existence of the National Health Service entails the following. First, consumer sovereignty is virtually destroyed, since what services the consumer receives and how much he pays (through taxation) are determined by the (...) government of the day in consultation with vested and ideological interests. Second, a person may be denied a life-saving service despite having contributed more than his fair share to National Health Service over the course of his working life. Third, people often spend less on health care than they would like to spend, because any additional contributions (via increased taxes) are not linked to any benefit specifically for the person who makes them. Fourth, provision of services free at the point of need which is not linked to what a person pays encourages a wasteful misuse of resources. Fifth, absence of competition between health care providers leads to high cost and poor quality of service and a tendency to produce a standardised service rather than a tailored one; and government attempts to address this problem usually make it worse. Sixth, people’s freedom to engage in particular activities or lifestyles is likely to be curtailed because the costs of those activities are artificially socialised. I also point out that issues of inequality or poverty are much better addressed by means other than a nationalised health service. (shrink)

After coming into force of the Treaty of Lisbon it is acknowledged that better control and respect of the principle of subsidiarity is one of the most important and innovative goals of the Treaty. To achieve this goal, the Treaty introduces a mechanism which, apart from checking compliance of draft legislative acts with that principle, may eventually lead to a draft act to be deleted from the legislative agenda of the European Union on grounds of violation of subsidiarity. Within this (...) mechanism, crucial role is attributed to the national parliaments of the Member States. In this article, the reasons for overall inclusion of national parliaments in the European Union (hereinafter EU, the Union) activities are analysed. The role of national parliaments in the EU according to the specific provisions of the EU treaties is also discussed and the largest part of the work is devoted to the ex ante subsidiarity principle control mechanism (the Early Warning System), which gives the right for the national parliaments to influence the EU legislative process.
