This paper investigates logical aspects of combining linear orders as semantics for modal and temporal logics, with modalities for possible paths, resulting in a variety of branching time logics over classes of trees. Here we adopt a unified approach to the Priorean, Peircean and Ockhamist semantics for branching time logics, by considering them all as fragments of the latter, obtained as combinations, in various degrees, of languages and semantics for linear time with a modality for possible paths. We then consider (...) a hierarchy of natural classes of trees and bundled trees arising from a given class of linear orders and show that in general they provide different semantics. We also discuss transfer of definability from linear orders to trees and introduce a uniform translation from Priorean to Peircean formulae which transfers definability of properties of linear orders to definability of properties of all paths in trees. Imāmiyya holds that the theory of imāmate must rely on scriptural evidence and designation and that the Imām, the successor to Muḥammad, is in charge of all political and religious issues. The authority of the Imām includes some religious and social duties such as executing the legal punishments, collecting almsgiving, sustaining social order and declaring holy war. The fulfillment of these duties requires actual leadership of the Imām or his deputy. With the beginning of the great occultation in 329/941, there (...) was an uncertainty among the Imāmiyya followers about who would uphold these responsibilities. In this period, Shīʿī ʿulamā began to undertake the duties of the Imām in order to overcome this uncertainty and to avoid the possible schism. In the beginning, this delegation of authority was limited to the religious sphere; but, later, its scope gradually became wider. This process of delegation of power, which covers a long process, needs to be examined in its various periods. In this study, this subject will be considered with special reference to the scholars of the fifth century of hijra (hijrī). An effort is made in this article to reveal how the issues of the Imām’s powers are discussed in the context of the problem of expanding or narrowing the authority of the scholars who played significant roles in systemization of Uṣūlī (rationalist) thought in the period after Shaykh al-Mufīd.Summary: In the issues of Imām/Caliphate which led to political division among Muslims after the Prophet Muḥammad, Imāmī Shīʿa opines that the Imāmate theory relies on scriptural evidence and designation. According to this theory, apart from scriptural evidence and designation, personal qualities such as immaculacy, knowledge, bravery, and vantage are found in Ali, Ḥasan, Ḥusayn and nine people from the lineage of Ḥusayn. The Imām as a successor to the Prophet Muḥammad is a person who has both religious and political power which includes implementation of punishments, collecting alms, ensuring justice, declaring holy war. For the Imāmī Shīʿa, there is a need for imām or his deputy who has absolute power to fulfill these duties.Imāmī Shīʿa, who held that the disappeared twelfth Imām would return back to restore justice in the world, had to confront various problems in finding solutions to some issues related to the existence of Imām himself, as well as theological issues during the period of great occultation. Particularly, the period of great occultation (329/941), in which the link with the Imām was severed completely, the Shīʿī community were uncertain on how to fulfill the responsibilities of the Imām probably due to the lack of religious sources. Shaykh al-Mufīd draws attention to the issue of khums (a one-fifth share of the spoils of war and of other specified forms of income). In this period of uncertainty, the Shiite scholars came into prominence in order to fill the gap and to prevent the social disorder. Referring to a tawqī‘ (rescript) from the Twelfth Imām, they claimed that they would take responsibility for the Twelfth Imām on his behalf. In the beginning, the delegation of the power was limited to the religious sphere. It was gradually extended to other spheres by the contribution of some scholars. It reached the largest dimension with the implementation of “wilāyat al-faqīh” theory.From that period until our times, the era when Sharīf al-Murtaḍā and his disciples lived can be considered as the beginning of this period. In the fifth century when Sharīf al-Murtaḍā and his disciples lived the delegation of power was limited to the religious sphere. In this article, how the scholars who played a role in the systematization of Uṣūlī thought dealt with the issue of the limits of the authority of Imām and how they defined the role of the Imāmī jurists (faqīh) will be examined.Sharīf al-Murtaḍā and his disciples were sometimes cautious on the issue of the delegation of the power of Imām. They, however, pointed out the role of the faqīh in the occultation period in order to overcome the uncertainty. As a matter of fact, Shaykh al-Ṭūsī and al-Qādī Ibn al-Barrāj made significant contributions to the issues of collection and distribution of khums. However, Sallār al-Daylamī’s contribution to the subject is more crucial. He considered khums as the grace of God and believed that it can be allocated by taking into account the share of the Imām. They put forward the views that explained in details the role of the faqīh in the collection and distribution of alms. Even Ibn al-Barrāj opined that in the absence of Imām and his deputy alms are to be allocated to the Faqihs on the ground that they know better how to distribute it. Therefore, in the absence of Imām and his deputy, by suggesting that faqīh must be in charge of collecting and distributing alms, they proposed a remedy in an early period.On the issue of leading the Friday prayer (ṣalāt al-jum‘a), which is one of the social duties of Imām, Sharīf al-Murtaḍā and his disciples considered the presence of the Imām or his deputy as a condition for a valid Friday prayer. In addition to this condition, Al-Ḥalabī, also added that a person who meets the necessary conditions can be also considered in leading Friday prayer. This addition by Ḥalabī was an important contribution to the solution of the problems encountered during the period of great occultation on both Friday prayer and delegation of Imām religious and political authorities to faqīh. On the other hand, Sallār, another disciple of Sharīf al-Murtaḍā, opposed the idea of the faqīh leading the Friday prayer in the absence of the Imām even when the necessary conditions are met. It can be said that this approach of Sallār led to the opinion of some Imāmis which considered Friday prayer unlawful in the absence of Imām. In the occultation period, Sharīf al-Murtaḍā and his disciples showed a cautious attitude about the implementation of the punishments. They argued that only Imām could implement the punishments. However, the major step was taken by Shaykh Ṭūsī on the issue of who implements the punishments in the occultation period. He argued that the Imām’s designated the faqihs to implement the punishments. In addition to this subject, Shiite scholars discussed the issue of whether a Shiite officer under the reigning rule in the occultation period implemented the punishments. On this issue, Sharīf al-Murtaḍā compiled a treaty untitled Mas’ala fi’l-‘amal ma‘a’al-sulṭan. For him, the main criteria are whether such person has necessary responsibilities and qualifications. Sharīf al-Murtaḍā and his disciples also continued their master’s conciliatory attitude. In the final analysis, the contribution of Sharīf al-Murtaḍā and his disciples on the issue of who will undertake the duties and responsibilities of the Imām is crucial in the systematization of the idea of transferal of the power of the Imām to faqīh including political one. In fact, Sharīf al-Murtaḍā’s advice to take part in the existing administrations has been considered a way out for the scholars who want to establish relations with the authorities in the later periods. After 11 September, even more citizens were psychologically shattered when they realized that the terrorist strikes showed that the United States, the most powerful nation on Earth, is still quite vulnerable. On September 1, 2023, Texas made important revisions to it its decades‐old statute granting legal safe harbor immunity to physicians who withhold or withdraw life‐sustaining treatment over the objection of critically ill patients’ surrogate decision‐makers. However, lawmakers left untouched glaring flaws in a key safeguard for patients—the transfer option. The transfer option is ethically important because, when no hospital is willing to accept the patient in transfer, that fact is taken as strong evidence that the surrogates’ treatment (...) requests fall outside accepted medical practice. But there are serious shortcomings in how the transfer option is carried out in Texas and many other states, which undermines the ethical usefulness of the process. We identify these shortcomings and recommend revisions to state statutes and professional guidelines to overcome them. (shrink)

The use of genetically modified organisms in agriculture makes great promises of better seeds, but also raises many controversies about ownership of seeds and about potential hazards. I suggest that owners of these seeds bear the responsibility to do no harm in using these seeds. After defining the nature of this responsibility, this paper asks, if ownership entails moral responsibility, and ownership can be transferred, then how is moral responsibility transferred? Building on the literature on use plans, I suggest five (...) conditions for a good transfer of moral responsibility for genetically modified seeds. I also look at the Monsanto Technology Use Guide and Technology/Stewardship Agreement, as an examplar of a use plan, to explore the extent to which these conditions are present. I conclude that use plans can play a role in the distribution and transfer of moral responsibility for technologies with high benefits and potential harmful uncertainties. (shrink)

The commutativity of the 1-dimensional XY-h type Hamiltonian and the transfer matrix of a 2-dimensional spin-lattice model constructed from an R-matrix is studied by Sutherland's method. We generalize Krinsky's result to more general Hamiltonians and more general R matrices, and we obtain a generic condition on their parameters for the commutativity, which defines an irreducible algebraic manifold in the parameter space.

The notion of the human embryo is not immutable. Various scientific and technological breakthroughs in reproductive biology have compelled us to revisit the definition of the human embryo during the past 2 decades. Somatic cell nuclear transfer, oocyte haploidisation and, more recently, human stem cell-derived embryo models have challenged this scientific term, which has both ethical and legal repercussions. Here, we offer a legal perspective to identify a universally accepted definition of ‘embryo’ which could help to ease and unify (...) the regulation of such entities in different countries. (shrink)

In this paper we propose a formal theory of metaphors called Constrained Semantic Transference [CST]. We start from the assumptions that metaphors are characterized by the description of one domain, called the target domain, in terms of another domain, called the source domain; and that a metaphor works by transferring a set of structural relationships from the source domain to the target domain coherently.Starting from these assumptions, we formally define the concept of T-MAPs which are partial coherent mappings from the (...) source domain to the target domain. We also define two operators, called Augmentation and Positing Structure that extend a given T-MAP by adding new structure to the target domain. (shrink)

Given a model-complete theory of topological fields, we considered its generic differential expansions and under a certain hypothesis of largeness, we axiomatised the class of existentially closed ones. Here we show that a density result for definable types over definably closed subsets in such differential topological fields. Then we show two transfer results, one on the VC-density and the other one, on the combinatorial property NTP2.

This article offers a detailed response to a recent article in this Journal by Charles Robertson titled “A Thomistic Analysis of Embryo Adoption.” A careful review of important terminology that is used in both Donum vitae and Dignitas personae was undertaken, and a summary is included to help define frequently misleading and even mistaken concepts and terms that can often lead to erroneous conclusions. This article focuses on Donum vitae I.3 and n. 2275 of the Catechism of the Catholic Church, (...) which provide strong magiste­rial support for the liceity of embryo transfer and, ultimately, for the morality of embryo adoption as the only moral solution for “orphaned” embryos. The conclusion offers a faithful interpretation and resolution of the difficult passages in Donum vitae I.5 and Dignitas personae n. 19 regarding the magisterial liceity of both embryo transfer and embryo adoption. Mind transfer is the most important concept of transhumanists. Its tech­nological implementation is to copy and transfer the human mind to a computer, by exact mapping of all neural connections in the human brain and their precise copying in a computer simulation. The idea of mind transfer also brings some dangers, related to the denial of human nature, the placing of hopes for future life in digital spaces and the liberation from the limitations imposed on man by (...) his biological structure. Transhumanists believe that in order to achieve mind transfer, various technologies defined by the acronym NBIC currently available, should be used. The very dynamic development of these technologies in recent years, and in particular the latest AI algorithms seem to be very fast approaching the moment when practical mind transfer will be possible. Horizontal gene transfer (HGT) is a major mechanism responsible for the spread of antibiotic resistance. Conversely, it is often assumed that antibiotics promote HGT. Careful dissection of the literature, however, suggests a lack of conclusive evidence supporting this notion in general. This is largely due to the lack of well‐defined quantitative experiments to address this question in an unambiguous manner. In this review, we discuss the extent to which HGT is responsible for the spread of antibiotic resistance and examine (...) what is known about the effect of antibiotics on the HGT dynamics. We focus on conjugation, which is the dominant mode of HGT responsible for spreading antibiotic resistance on the global scale. Our analysis reveals a need to design experiments to quantify HGT in such a way to facilitate rigorous data interpretation. Such measurements are critical for developing novel strategies to combat resistance spread through HGT. -/- . (shrink)

This paper aims to contribute to epistemology by studying the psychoanalytic notion of transference. Contrary to previous philosophical research on Freud, I claim that traditional models of interpretation or translation are insufficient to explain psychoanalytic understanding. After exploring the conceptual roots of this mistake, which I define as generic, I focus on the notion of transference and claim that it should be viewed as a unique form of understanding that enables the emergence of unconscious meaning or truth. I elaborate this (...) claim with a detailed study of the development of this notion in Freud’s texts. Transference is thus delineated as a form of understanding which is closely related to the matrix of love and defined in relation to the following parameters: intersubjectivity; visuality; and performativity. In this article, I develop the point that whereas talent is the basis for desert, talent itself is not meritocratically deserved. It is produced by three processes, none of which are meritocratic: talent is unequally distributed by the rigged lottery of birth, talent is defined in ways that favor some traits over others, and the market for talent is manipulated to maximally extract advantages by those who have more of it. To see how, we require a sociological perspective on economic (...) rent. I argue that talent is a major means through which people seek rent in modern-day capitalism. Talent today is what inherited land was to feudal societies; an unchallenged source of symbolic and economic rewards. Whereas God sanctified the aristocracy’s wealth, contemporary privilege is legitimated by meritocracy. Drawing on the work of Gary Becker, Pierre Bourdieu, and Jerome Karabel, I show how rent-seeking in modern societies has come to rely principally on rent-definition and creation. Inequality is produced by the ways in which talent is defined, institutionalized, and sustained by the moral deservingness we attribute to the accomplishments of talents. Consequently, today’s inequalities are as striking as ever, yet harder to challenge than ever before. (shrink)

Well-known epistemologies of science have implications for how best to understand knowledge transfer (KT). Yet, to date, no serious attempt has been made explicate these particular implications. This paper infers views about KT from two popular epistemologies; what we characterize as incommensurabilitist views (after Devitt 2001; Bird 2002, 2008; Sankey and Hoyningen-Huene 2013) and voluntarist views (after van Fraassen 1984; Dupré 2001; Chakravartty 2015). We argue views of the former sort define the methodological, ontological, and social conditions under which (...) research operates within ‘different worlds’ (to use Kuhn’s expression), and entail that genuine KTs under those conditions should be difficult or even impossible. By contrast, more liberal voluntarist views recognize epistemological processes that allow for transfers across different sciences even under such conditions. After outlining these antithetical positions, we identify two kinds of KTs of two kinds present in well-known episodes in the history of ecology—specifically, successful model transfers from chemical kinetics and thermodynamics into areas of ecological research—which reveal significant limitations of incommensurabilitist views. We conclude by discussing how the selected examples support a pluralistic voluntarism regarding KT. (shrink)

Most complex real systems are found to have multiple layers of connectivity and required to be modelled as multiplex networks. One of the extremely critical problems is to reduce the congestion and enhance the transfer capacity, especially in real communication networks with a big data environment. A novel and effective strategy to improve traffic and control congestion is proposed by adding edges according to their weights which are defined by the topology structural properties. Furthermore, which layer is more effective (...) when our strategy is applied is discussed based on its topology structure. Adding edges between nodes whose product of multiplex network betweenness is the highest is confirmed to be more effective, particularly in the layer with stronger community structure. Simulation experiments on both computer-generated and real-world networks demonstrate that our strategy can enhance the transfer capacity of multiplex networks significantly, which is in good agreement with our analysis. This study deals with Dominicus Gundissalinus’s discussion on metaphysics as philosophical discipline. Gundissalinus’s translation and re-elaboration of al-Fārābī’s Iḥṣā’ al-ʿulūm furnish him, in the De scientiis, a specific and detailed procedure for metaphysical analysis articulated in two different stages, an ascending and a descending one. This very same procedure is presented by Gundissalinus also in his De divisione philosophiae, where the increased number of sources –in particular, Avicenna– does not prevent Gundissalinus to quote the entire passage on the methods of (...) metaphysical science from the Iḥṣā’ al-ʿulūm, with some slight changes in his Latin translation. The analytical procedure herein proposed becomes an effective ‘metaphysical programme’ with regards to Gundissalinus’s onto-cosmological writing, the De processione mundi. The comparative analysis of this treatise with the procedure received by al-Fārābī shows Gundissalinus’s effort to follow and apply this metaphysical programme to his own reflection, in a whole different context from al-Fārābī’s and presenting doctrines quite opposed to the theoretical ground on which al-Fārābī’s epistemology is based, like ibn Gabirol’s universal hylomorphism. Nevertheless, thanks to the application of the ‘metaphysical programme’, one can effectively claim that Gundissalinus’s metaphysics is, at least in the author’s intentions, a well-defined metaphysical system. In appendix to this article the three Latin versions of al-Fārābī’s discussion on metaphysics are reported, e.g., Gundissalinus’s quotations in De scientiis and De divisione philosophiae, and Gerard of Cremona’s translation in his De scientiis. A modification of this construction then assigns a nonstandard model to any theory of arithmetic, enabling us to reproduce conservation results of Moerdijk and Palmgren for nonstandard Heyting arithmetic. Internalizing the construction allows us to strengthen these results with additional transfer rules; we then show that even trivial transfer axioms or minor strengthenings of these (...) rules destroy conservativity over HA. The analysis also shows that nonstandard HA has neither the disjunction property nor the explicit definability property. Finally, careful attention to the complexity of our definitions allows us to show that a certain weak fragment of intuitionistic nonstandard arithmetic is conservative over primitive recursive arithmetic. Let M be an o-minimal expansion of an ordered field. Let φ be a formula in the language of ordered domains. In this note we establish some topological properties which are transferred from $\varphi^M$ to $\varphi^R$ and vice versa. Then, we apply these transfer results to give a new proof of a result of M. Edmundo-based on the work of A. Strzebonski-showing the existence of torsion points in any definably compact group defined in an o-minimal expansion of an ordered (...) field. (shrink)

We continue our study of finitary abstract elementary classes, defined in [7]. In this paper, we prove a categoricity transfer theorem for a case of simple finitary AECs. We introduce the concepts of weak κ-categoricity and f-primary models to the framework of א₀-stable simple finitary AECs with the extension property, whereby we gain the following theorem: Let (������, ≼ ������ ) be a simple finitary AEC, weakly categorical in some uncountable κ. Then (������, ≼ ������ ) is weakly categorical (...) in each λ ≥ min { \group{ \{\kappa,\beth_{ \group{ (2^{ \aleph_{ 0 _} ^});^{ + ^} \group} _}\}; \group} . If the class (������, ≼ ������ ) is also LS(������)-tame, weak κ-categoricity is equivalent with κ-categoricity in the usual sense. In this paper, logics are conceived as two-sorted first-order structures, and we argue that this broad definition encompasses a wide class of logics with theoretical interest as well as interest from the point of view of applications. The language, concepts and methods of model theory can thus be used to describe the relationship between logics through morphisms of structures called transfers. This leads to a formal framework for studying several properties of abstract logics and their attributes such as consequence operator, (...) syntactical structure, and internal transformations. In particular, we treat Belief Revision Systems (BRS) as our main example, defining the Wide Belief Revision Systems (WBRS''s). This generalization allows us to define BRS''s in an abstract setting for classical and non-standard logics. We also show how the concept of translation between logics can be obtained as a particular case of transfers. (shrink)

In this thesis, we study transfer principles in the context of certain Henselian valued fields, namely Henselian valued fields of equicharacteristic $0$, algebraically closed valued fields, algebraically maximal Kaplansky valued fields, and unramified mixed characteristic Henselian valued fields with perfect residue field. First, we compute the burden of such a valued field in terms of the burden of its value group and its residue field. The burden is a cardinal related to the model theoretic complexity and a notion of (...) dimension associated to $\text {NTP}_2$ theories. We show, for instance, that the Hahn field $\mathbb {F}_p^{\text {alg}})$ is inp-minimal, and that the ring of Witt vectors $W$ over $\mathbb {F}_p^{\text {alg}}$ is not strong. This result extends previous work by Chernikov and Simon and realizes an important step toward the classification of Henselian valued fields of finite burden. Second, we show a transfer principle for the property that all types realized in a given elementary extension are definable. It can be written as follows: a valued field as above is stably embedded in an elementary extension if and only if its value group is stably embedded in the corresponding extension of value groups, its residue field is stably embedded in the corresponding extension of residue fields, and the extension of valued fields satisfies a certain algebraic condition. We show, for instance, that all types over the power series field $\mathbb {R})$ are definable. Similarly, all types over the quotient field of $W$ are definable. This extends previous work of Cubides and Delon and of Cubides and Ye.These distinct results use a common approach, which has been developed recently. It consists of establishing first a reduction to an intermediate structure called the leading term structure, or $\operatorname {\mathrm {RV}}$ -sort, and then of reducing to the value group and residue field. The draft Code of Conduct for Research is an important initiative towards assisting the scientific community in complying with the provisions of the Protection of Personal Information Act 4 of 2013 (POPIA). However, its approach towards cross-border data sharing should be reconsidered to clarify the ambiguities inherent in the legal requirements for the cross-border sharing of health data in the POPIA. These ambiguities include the concept of ‘transfer of information’, the application of adequacy as a legal mechanism for (...) class='Hi'>transfer, the nature of consent for cross-border sharing and the scope of the recipient third party. We suggest that the draft Code of Conduct for Research can be improved by: Explaining or defining the concept of ‘transfer of information’ and when it applies to cross-border sharing in research Clarifying the application of adequacy as a legal mechanism for transfer vis-à-vis the other alternatives Expanding on the interpretation and application of consent as a legal mechanism for cross-border transfers Expanding the category of persons who may be recipients of personal information in a third country. Both the Beth definability theorem and Craig's lemma (interpolation theorem from now on) deal with the issue of the entanglement of one language L1 with another language L2, that is to say, information transfer—or the lack of such transfer—between the two languages. The notion of splitting we study below looks into this issue. We briefly relate our own results in this area as well as the results of other researchers like Kourousias and Makinson, and Peppas, Chopra and (...) In this paper I put forward a suggestion for identifying causality in micro-systems with the specific quantum field theoretic interactions that occur in such systems. I first argue — along the lines of general transference theories — that such a physicalistic account is essential to an understanding of causation; I then proceed to sketch the concept of interaction as it occurs in quantum field theory and I do so from both a formal and an informal point of view. Finally, I (...) present reasons for thinking that only a quantum field theoretic account can do the job — in particular I rely on a theorem by D. Currie and to the effect that interaction cannot be described in (a Hamiltonian formulation of) Classical Mechanics. Throughout the paper I attempt to suggest that the widespread scepticism about the ability of quantum theory to support a theory of causality is mistaken and rests on several misunderstandings. This is a “bottom-up” paper in the sense that it draws lessons in defining disciplinary categories under study from a series of empirical studies of interdisciplinarity. In particular, we are in the process of studying the interchange of research-based knowledge between Cognitive Science and Educational Research. This has posed a set of design decisions that we believe warrant consideration as others study cross-disciplinary research processes.

Language defines human existence. Yet defining language is a fraught project. I use the term "language" to refer to a specific mode of information transfer. First, it is a communicative mode. By communication I mean the information transfer serves a function, that is, an activity that occurs because it has increased the evolutionary fitness of ancestors. Secondly, while all communication is governed by norms, human communication, as opposed to biological communication, is governed by norms that have evolved within (...) the learned traditions of individual cultures. The meaning of an assertion in a culture’s language is the set of commitments to which that culture holds its speakers when they utter that assertion. Syntax has appeared in recent evolution to facilitate and enrich the communicative function, but it is a secondary aspect of language. The defining characteristic of human communication, of "language," -- is its capacity to constitute meaning. (shrink)

Written for non-experts, this volume introduces the mechanisms that underlie reticulate evolution. Chapters are either accompanied with glossaries that explain new terminology or timelines that position pioneering scholars and their major discoveries in their historical contexts. The contributing authors outline the history and original context of discovery of symbiosis, symbiogenesis, lateral gene transfer, hybridization or divergence with gene flow, and infectious heredity. By applying key insights from the areas of molecular (phylo)genetics, microbiology, virology, ecology, systematics, immunology, epidemiology and computational (...) science, they demonstrate how reticulate evolution impacts successful survival, fitness and speciation. Reticulate evolution brings forth a challenge to the standard Neo-Darwinian framework, which defines life as the outcome of bifurcation and ramification patterns brought forth by the vertical mechanism of natural selection. Reticulate evolution puts forward a pattern in the tree of life that is characterized by horizontal mergings and lineage crossings induced by symbiosis, symbiogenesis, lateral gene transfer, hybridization or divergence with gene flow, and infective heredity, making the “tree of life” look more like a “web of life.” On an epistemological level, the various means by which hereditary material can be transferred horizontally challenges our classic notions of units and levels of evolution, fitness, modes of transmission, linearity, communities, and biological individuality. The case studies presented examine topics including the origin of the eukaryotic cell and its organelles through symbiogenesis; the origin of algae through primary and secondary symbiosis and dinoflagellates through tertiary symbiosis; the superorganism and holobiont as units of evolution; how endosymbiosis induces speciation in multicellular life forms; transferrable and non-transferrable plasmids and how they symbiotically interact with their host; the means by which pro- and eukaryotic organisms transfer genes laterally (bacterial transformation, transduction and conjugation as well as transposons and other mobile genetic elements); hybridization and divergence with gene flow in sexually-reproducing individuals; current (human) microbiome and viriome studies that impact our knowledge concerning the evolution of organismal health and acquired immunity; and how symbiosis and symbiogenesis can be modelled in computational evolution. In quantum logic, introduced by Birkhoff and von Neumann, De Morgan's Laws play an important role in the projection-valued truth value assignment of observational propositions in quantum mechanics. Takeuti's quantum set theory extends this assignment to all the set-theoretical statements on the universe of quantum sets. However, Takeuti's quantum set theory has a problem in that De Morgan's Laws do not hold between universal and existential bounded quantifiers. Here, we solve this problem by introducing a new truth value assignment for (...) bounded quantifiers that satisfies De Morgan's Laws. To justify the new assignment, we prove the Transfer Principle, showing that this assignment of a truth value to every bounded ZFC theorem has a lower bound determined by the commutator, a projection-valued degree of commutativity, of constants in the formula. We study the most general class of truth value assignments and obtain necessary and sufficient conditions for them to satisfy the Transfer Principle, to satisfy De Morgan's Laws, and to satisfy both. For the class of assignments with polynomially definable logical operations, we determine exactly 36 assignments that satisfy the Transfer Principle and exactly 6 assignments that satisfy both the Transfer Principle and De Morgan's Laws. Hegel, in his work _Philosophy of Right_, defines ownership through three elements: acquisition by occupation, use, and transfer. To own something involves mere acquisition and encompasses its appropriate use and potential transfer to others. Subsequently, the final aspect mentioned was the concept of infinite judgement. The acts of owning and transferring to others are diametrically opposed, and Hegel’s unique logic forcibly connects these opposing concepts. This form of infinite judgement was advocated by the young Hegel during the era (...) of _Phenomenology of Spirit_. There, he stated, “Spirit is a bone”. However, when he later wrote _Science of Logic_ or _Encyclopedia_, the formulation of infinite judgement changed to “Spirit is not something that is bone”. This shift was influenced by Kant. In _Logic_, the discourse advances into syllogism, inferential theory, leading to “Spirit is a bone for such-and-such reasons”. In essence, Hegel binarily connected spirit and bone in his youth and introduced a mediating term in this connection later in his life, establishing inferential links. However, the notion of forcibly connecting opposing concepts remains. Therefore, the statement “Ownership is transfer” represents an infinite judgement while simultaneously signifying syllogism that “I truly own this object if I can transfer it to others”. This contributes to the reasoning that “I and objects can be connected through the intermediary of others”, progressing to the inference that “I and others can be connected through objects”, thereby laying the foundation for society. The design of Web browsers has resulted in a transfer of power to Web users and developers who often lack an ethical framework in which to act. For example, the technology makes it simple to copy and use other people’s Web page formatting without their permission. The author argues that we need to educate more people about ethical Web practices, and the author asks for “rules of the road” which amateurs and professionals can understand and follow. This article discusses (...) four areas of concern about Web development: the browser wars, information storage and retrieval, access for the handicapped, and cookies. Well-known epistemologies of science have implications for how best to understand knowledge transfer (KT). Yet, to date, no serious attempt has been made to explicate these particular implications. This paper infers views about KT from two popular epistemologies; what we characterize as incommensurabilitist views (after Devitt, 2001; Bird, 2002, 2008; Sankey and Hoyningen-Huene 2013) and voluntarist views (after Van Fraassen, 1984; Dupré, 2001; Chakravartty, 2015). We argue views of the former sort define the methodological, ontological, and social conditions under (...) which research operates within ‘different worlds’ (to use Kuhn's expression), and entail that genuine KTs under those conditions should be difficult or even impossible. By contrast, more liberal voluntarist views recognize epistemological processes that allow for transfers across different sciences even under such conditions. After outlining these antithetical positions, we identify two kinds of KTs present in well-known episodes in the history of ecology—specifically, successful model transfers from chemical kinetics and thermodynamics into areas of ecological research—which reveal significant limitations of incommensurabilitist views. We conclude by discussing how the selected examples support a pluralistic voluntarism regarding KT. (shrink)

Data sharing – broadly defined as the exchange of health-related data among multiple controllers and processors – has gained increased relevance in the health sciences over recent years as the need and demand for collaboration has increased. This includes data obtained through healthcare provisions, clinical trials, observational studies, public health surveillance programs, and other data collection methods. The practice of data sharing presents several notable challenges, however. Compliance with a complex and dynamic regulatory framework is essential, with the General Data (...) Protection Regulation being a prominent example in a European context. Recent regulatory developments related to clinical trial transparency, trade secrecy, data access, AI training data, and health data spaces further contribute to the difficulties. Simultaneously, government initiatives often encourage scientists to embrace principles of “open data” and “open innovation.” The variety of regulations in this domain has the potential to impede widespread data sharing and hinder innovation. This edited volume, therefore, compiles comparative case studies authored by leading scholars from diverse disciplines and jurisdictions. The book aims to outline the legal complexities of data sharing. By examining real-world scenarios from diverse disciplines and a global perspective, it explores the normative, policy, and ethical dilemmas that surround data sharing in the health sciences today. Directive 96/9/EC of the European Parliament and of the Council on the legal protection of databases of 11 March 1996, which was intended to protect the interests of the makers of databases, determined that databases could be protected by double rights: copyright and sui generis right. The article first of all analyses what persons are entitled to be acknowledged as holders of copyright and sui generis right in respect of a newly created database. As the issue of the owner of (...) copyright is not regulated by the 1996 Directive, this is determined by the application of national provisions. Pursuant to the Law on Copyright and Related Rights of the Republic of Lithuania, the owner of copyright may mean, depending on the situation, a natural person – the author of a database or a group of authors, the holder of the right to a collective work, or an employer. The analysis presented in the articleindicates that predominantly it is the author (authors) of a database who is held to be the owner of the copyright. Courts tend to interpret the rule concerning the transfer of copyright to the employer in a restrictive way; besides, in accordance with the specifics of the Lithuanian legal regulation, economic rights are transferred to the employer only for the period of 5 years. The category of collective work is of a subsidiary character and may be applied only in exclusive cases. Therefore, when a database is created upon the commission of another person, including the employer, the customer is expected to form a written agreement where the transfer of economic rights to the customer is clearly defined. Background:Moral courage is defined as courage to act according to one’s own ethical values and principles even at the risk of negative consequences for the individual. In a complex nursing practice, ethical considerations are integral. Moral courage is needed throughout nurses’ career.Aim:To analyse graduating nursing students’ moral courage and the factors associated with it in six European countries.Research design:A cross-sectional design, using a structured questionnaire, as part of a larger international ProCompNurse study. In the questionnaire, moral courage was assessed with (...) a single question (visual analogue scale 0–100), the questionnaire also covered several background variables.Participants and research context:The sample comprised graduating nursing students (n = 1796) from all participating countries. To get a comprehensive view about graduating nursing students’ moral courage, the views of nurse managers (n = 538) and patients (n = 1327) from the same units in which the graduating nursing students practised were also explored, with parallel questionnaires.Ethical considerations:Ethical approvals and research permissions were obtained according to national standards in every country and all participants gave their informed consent.Results:The mean of graduating nursing students’ self-assessed moral courage was 77.8 (standard deviation 17.0; on a 0–100 scale), with statistically significant differences between countries. Higher moral courage was associated with many factors, especially the level of professional competence. The managers assessed the graduating nursing students’ moral courage lower (66.5; standard deviation 18.4) and the patients slightly higher (80.6; standard deviation 19.4) than the graduating nursing students themselves.Discussion and conclusions:In all countries, the graduating nursing students’ moral courage was assessed as rather high, with differences between countries and populations. These differences and associations between moral courage and ethics education require further research. (shrink)

We have also considered Arabic metaphysical translations, especially the translation of Book Lambda. The translation you will read is a commentary of the ninth chapter of Book Lambda by Themistius. The Greek original (...) commentary of Lambda was lost, and after the Arabic translation, it was transferred to Latin and Hebrew. However, later parts of the Arabic text were also lost. In this chapter, Themistius comments on the part in which Aristotle discusses the difficulties on the nature of divine intellect and tries to prove that the object of reason, the act of thinking and the object of thinking are the same things. That symbols have emotive and volitional properties as well, that they have elaborate and complicated relations to the self which uses them, that they are themselves physical counters, i.e., noises, visual objects, etc.,—all of these facts I recognize but choose to neglect. When symbols are considered merely as instruments for the transfer of meanings, only one important assumption is involved, viz., symbols which are precisely (...) defined are to be preferred to symbols which either are undefined or are defined inadequately. The program of the evolution of the base of knowledge in machines' mechanisms on the example of technical systems of arbitrary purpose and structure with the aim of formalization and structurization of knowledge for creation of new techniques of automatized projecting in suggested. The program is declared as the process of transference of the base of knowledge from its initial state into final one, at the permissible restrictions in quality and resources in real time. The program's concept is based on (...) the introduction of N-measured structural space. Discrete coordinates of the multi-measured vector of this space are: flathierarchical sets of languages, objects, problems, estimations, resources, restrictions, types of working areas, etc. The vectors' co-ordinates define the set of the program projects. The possibility of choice of the optimal program strategies' realization is discussed. The concept can be applied to objects of arbitrary purpose. (shrink)
