One thing nearly all epistemologists agree upon is that Gettier cases are decisive counterexamples to the tripartite analysis of knowledge; whatever else is true of knowledge, it is not merely belief that is both justified and true. They now agree that knowledge is not justified true belief because this is consistent with there being too much luck present in the cases, and that knowledge excludes such luck. This is to endorse what has become known as the 'anti-luck platitude'. <br /><br (...) />But what if generations of philosophers have been mistaken about this, blinded at least partially by a deeply entrenched professional bias? There has been another, albeit minority, response to Gettier: to deny that the cases are counterexamples at all. <br /><br />Stephen Hetherington, a principal and vocal proponent of this view, advances what he calls the 'Knowing Luckily Proposal'. If Hetherington is correct, this would call for a major re-evaluation and re-orientation of post-Gettier analytic epistemology, since much of it assumes the anti-luck platitude both in elucidating the concept of knowledge, and in the application of such accounts to central philosophical problems. It is therefore imperative that the Knowing Luckily Proposal be considered and evaluated in detail. <br /><br />In this paper I critically assess the Knowing Luckily Proposal. I argue that while it draws our attention to certain important features of knowledge, ultimately it fails, and the anti-luck platitude emerges unscathed. This book represents the first major attempt by any author to provide an integrated account of the evidence for bias in human reasoning across a wide range of disparate psychological literatures. The topics discussed involve both deductive and inductive reasoning as well as statistical judgement and inference. In addition, the author proposes a general theoretical approach to the explanations of bias and considers the practical implications for real world decision making. The theoretical stance of the book is based on a (...) distinction between preconscious heuristic processes which determine the mental representation of 'relevant' features of the problem content, and subsequent analytic reasoning processes which generate inferences and judgements. Phenomena discussed and interpreted within this framework include feature matching biases in propositional reasoning, confirmation bias, biasing and debiasing effects of knowledge on reasoning, and biases in statistical judgement normally attributed to 'availability' and 'representativeness' heuristics. The work is often ascribed to the Han scholar and court official Dong Zhongshu, but, as this study reveals, the text is in fact a compendium of writings by a variety of authors working within an interpretive tradition that spanned several generations, (...) depicting a utopian vision of a flourishing humanity that they believed to be Confucius's legacy to the world. The Spring and Autumn is a chronicle kept by the dukes of the state of Lu from 722 to 481 B.C.E. _The Luxuriant Gems_ follows the interpretations of the _Gongyang Commentary_, whose transmitters belonged to a tradition that sought to explicate the special language of the _Spring and Autumn_. The Gongyang masters believed that the_ Spring and Autumn_ had been written by Confucius himself, employing subtle and esoteric phrasing to indicate approval or disapproval of important events and personages. The _Luxuriant Gems_ augments Confucian ethical and philosophical teachings with chapters on cosmology, statecraft, and other topics drawn from contemporary non-Confucian traditions, reflecting the brilliance of intellectual life in the Han dynasty during the formative decades of the Chinese imperial state. According to Heidegger's Being and Time, social relations are constitutive of the core features of human agency. On this view, which I call a ‘strong conception’ of sociality, the core features of human agency cannot obtain in an individual subject independently of social relations to others. I explain the strong conception of sociality captured by Heidegger's underdeveloped notion of ‘being-with’ by reconstructing Heidegger's critique of the ‘weak conception’ of sociality characteristic of Kant's theory of agency. According to a weak conception, (...) sociality is a mere aggregation of individual subjects and the core features of human agency are built into each individual mind. The weak conception of sociality remains today widely taken for granted. I show that Christine Korsgaard, one of the most creative contemporary appropriators of Kant, operates with a weak conception of sociality and that this produces a problematic explanatory deficiency in her view: she is unable to explain the peculiar motivational efficacy of shared social norms. Heidegger's view is tailor made to explain this phenomenon. I end by sketching how Heidegger provides a social explanation of a major systematic concern animating Korsgaard, the concern with the importance of individual autonomy and answerability in human life. We owe most scientific knowledge to methods of inquiry that are never formally analyzed. The analysis of behavior does not call for hypothetico-deductive methods. Statistics, taught in lieu of scientific method, is incompatible with major features of much laboratory research. Squeezing significance out of ambiguous data discourages the more promising step of scrapping the experiment and starting again. As a consequence, psychologists have taken flight from the laboratory. They have fled to Real People and the human interest of “real life,” (...) to Mathematical Models and the elegance of symbolic treatments, to the Inner Man and the explanatory preoccupation with inferred internal mechanisms, and to Laymanship and its appeal to “common sense.” An experimental analysis provides an alternative to these divertissements.The “theories” to which objection is raised here are not the basic assumptions essential to any scientific activity or statements that are not yet facts, but rather explanations which appeal to events taking place somewhere else, at some other level of observation, described in different terms, and measured, if at all, in different dimensions. Three types of learning theories satisfy this definition: physiological theories attempting to reduce behavior to events in the nervous system; mentalistic theories appealing to inferred inner events; and theories of the Conceptual Nervous System offered as explanatory models of behavior. It would be foolhardy to deny the achievements of such theories in the history of science. The question of whether they are necessary, however, has other implications.Experimental material in three areas illustrates the function of theory more concretely. Alternatives to behavior ratios, excitatory potentials, and so on demonstrate the utility of rate or probability of response as the basic datum in learning. Functional relations between behavior and environmental variables provide an account of why learning occurs. Activities such as preferring, choosing, discriminating, and matching can be dealt with solely in terms of behavior, without referring to processes in another dimensional system. The experiments are not offered as demonstrating that theories are not necessary but to suggest an alternative. Theory is possible in another sense. Beyond the collection of uniform relationships lies the need for a formal representation of the data reduced to a minimal number of terms. A theoretical construction may yield greater generality than any assemblage of facts; such a construction will not refer to another dimensional system. (shrink)

The use of placebo as a control condition in clinical trials of major depressive disorder and anxiety disorders continues to be an area of ethical concern. Typically, opponents of placebo controls argue that they violate the beneficent-based, “best proven diagnostic and therapeutic method” that the original Helsinki Declaration of 1964 famously asserted participants are owed. A more consequentialist, oppositional argument is that participants receiving placebo might suffer enormously by being deprived of their usual medication(s). Nevertheless, recent findings of potential for (...) suicidality in young people treated with antidepressants, along with meta-analyses suggesting that antidepressants add no significant clinical benefit over placebos, warrant a re-evaluation of the arguments against placebo. Furthermore, the nature of placebo treatment in short-term clinical trials is often not well understood, and lack of understanding can foster opposition to it. This paper will show how scientific justifications for placebo use are morally relevant. The fundamental ethical importance of placebo controls is discussed in relation to several aspects of clinical trials, including detection of adverse events, accurate assessment of clinical benefit, advancing understanding of the heterogeneity of depression and anxiety disorders and respecting informed consent requirements. Prohibiting the use of placebo controls is morally concerning in that such prohibitions allow for the possibility of serious adverse public health consequences. Moral worries that research participants receiving placebo are being unduly jeopardised will be shown to be exaggerated, especially in relation to the net benefits for end-users to be gained from the quality of data resulting from using placebo controls. Outlining "all that a modern monarch needs to know," the text emphasizes rigorous self-cultivation and mental discipline, attributing successful rule to a balance of broad knowledge, diligent application, and penetrating wisdom. The destruction of the Egyptian army in the Book of Exodus is the primary story of salvation for Israel; God is the chief combatant in this story. "Yahweh is a warrior!" So goes the victory hymn in Exodus 15:3 after the annihilation of the enemy by Yahweh, marking the importance held by this show of divine power. This unleashing of divine power and its militaristic imagery has long caught the attention of scholars as starkly nationalistic. Thomas B. Dozeman furthers this (...) study by addressing the theological problem of divine power in the Exodus story and, by extension, the Judeo-Christian attempt to deify nationalism by calling its wars holy. He interprets Exodus as liturgy, the Day of Yahweh, celebrating God's defeat of Pharaoh and the ultimate ascendancy of Israelite authority. This liturgy, though, did not remain static, but changed as the national experience of exile changed the practice of Israelite worship. An isolated event evolved into an extended account of salvation history, in which the life of faith becomes a wilderness march to the promised land. Dozeman traces how revisionary embellishments in the plot structure and characters of the Exodus story reflected the new understanding of divine power. By combining literary and historical interpretation this study offers the first serious inquiry into the idea of divine power, and makes a major contribution to resurgent research on the Pentateuch as a whole. The dominant social scientific approach to studying judicial behavior treats judges as strategic actors pursuing their political preferences under institutional constraint. The intellectual roots of this rational choice approach are in American law’s long but sporadic engagement with pragmatist ideas. This article challenges that approach: a fully pragmatist account of judicial action provides a better description of the intellectual and social work of judging, and better explains how judges reach a decision in difficult cases that most affect the development of (...) law and its relationship to society. The article argues that the foundational intellectual problem for appellate judges is how to define the legal questions presented in a case. Definitions of legal questions arise from the interplay of habitual and creative action in the local social context of an appeals court. Professional and local interpretive habits and legal forms ordinarily do a great deal to define the key questions, which are not strictly determined when a case comes before a court. Unscripted small group interactions at oral arguments also figure in question definition; oral arguments are most important in the rare but legally important cases where habitual practices alone are insufficient to delimit the legal question judges must answer. Supported by extensive interviews with federal appeals judges and clerks, the article illustrates judges’ creative, interactional efforts to define an answerable question in a major asylum case decided in the Seventh Circuit Court of Appeals. Building from this case, the article describes the factors that shape judicial question definition, and describes the conditions when creative judicial action is likely to be most prominent. The Conference on Artificial General Intelligence is the only major conference series devoted wholly and specifically to the creation of AI systems possessing general intelligence at the human level and ultimately beyond. Its second installation, AGI-09, in Arlington, Virginia, March 6-9, 2009, attracted 67 paper submissions, which is a substantial increase from the previous year. Of these submissions, 33 (i.e., 49%) were accepted as full papers for presentation at the conference. Additional 13 papers were included as position papers. This study further examined the negative association between boys77, differences in height and log-transformed weight were judged using analysis of covariance (ANCOVA) with measurement age as a covariate, and parental education level (four levels), number of sisters (0, 1, 2 or 3+) and number of brothers (0, 1, 2+) as predictors. The relative importance of birth order and sibling sex was examined among the near majority of boys with one sibling (47%, 278/596). The sibling composition variable was defined using mutually (...) exclusive categories representing individuals with one sibling: either one older or younger brother or sister. All boys contributed information before leaving middle school at a mean age of 14·9±0·4 years SD. The results were compared with similar analyses of data for 154 of these same boys for whom measurements were available from primary school entry at a mean age of 6·4±0·3 years SD onward. Results were also compared with data for a cohort of 153 boys who entered primary school later in 1986. Results confirm that boys from the Da-an area born in the mid-1970s who did not have sisters were significantly taller (2·23·9 kg, p[less-than-or-equal]0·016) than those with one or two sisters. However, the 26 boys with three or more sisters, most of whom were last-born, were somewhat taller than those with one or two sisters. The same curvilinear relationships in height and weight appeared both among boys as they prepared to leave middle school and among the subset also measured just after entering primary school. When numbers of sisters were statistically controlled, the presence of two or more brothers was also significantly negatively associated with mean stature, but not weight, among middle school boys. Analyses among boys with one sibling revealed that birth order was associated with mean stature, but only if the sibling was female; an older sister was associated with a greater deficit in mean stature than a younger sister. Evidence of rising educational expectations, continued declines in family size with fewer gender-related differences in numbers of siblings, and a clear secular increase in body size in this community among children entering primary school from 1982 to 1986 suggest a possible explanatory model. Doing and Being confronts the problem of how to understand two central concepts of Aristotle's philosophy: energeia and dunamis. While these terms seem ambiguous between actuality/potentiality and activity/capacity, Aristotle did not intend them to be so. Through a careful and detailed reading of Metaphysics Theta, Beere argues that we can solve the problem by rejecting both "actuality" and "activity" as translations of energeia, and by working out an analogical conception of energeia. This approach enables Beere to discern a hitherto unnoticed (...) connection between Plato's Sophist and Aristotle's Metaphysics Theta, and to give satisfying interpretations of the major claims that Aristotle makes in Metaphysics Theta, the claim that energeia is prior in being to capacity and the claim that any eternal principle must be perfectly good. Bronchiolitis obliterans is the most common pathologic finding on biopsy, characterized by fibrous granulation tissue, which obliterates the lumen of the bronchiole. Clinically, in the absence of tissue for pathology, BO syndrome refers to a progressive irreversible drop in the forced (...) expiratory volume in 1 second. Recently, a broader definition of chronic rejection, termed "chronic lung allograft dysfunction", has been used to encompass a more inclusive definition of posttransplant dysfunction. Recently, the lung transplant community has come to realize that chronic rejection may be the final common result after repetitive epithelial insults. Acute rejection, infection, and alloreactivity to mismatched HLA antigens are a few of these insults that damage the surface of the bronchioles. Recent evidence of autoimmunity to the normally hidden structural proteins collagen V and K-α1 tubulin have been correlated with a BO phenotype as well, perhaps correlating the epithelial damage with a mechanism for developing BO lesions. Many immunomodulatory medications and treatments have been studied for effectiveness for the treatment of chronic lung allograft dysfunction. New drugs, which more precisely target the immune system, are being developed and tested. This paper distinguishes four major types of futility (physiological, imminent demise, lethal condition, and qualitative) that have been advocated in the literature either in a patient dependent or a patient independent fashion. It proposes five criteria (precision, prospective, social acceptability, significant number, and non-agreement) that any definition of futility must satisfy if it is to serve as the basis for unilaterally limiting futile care. The evidence for force feedback with adequate gain or for an appropriate central representation is not sufficient to conclude that force is the major controlled variable in (...) normal limb movements.Morton's hypothesis, thatlengthis controlled by a follow-up servo, has a number of difficulties related to the delays, gains, variability, and specificity in feedback pathways comprising potential servo loops. However, experimental evidence is consistent with these pathways providing servo assistance for some movements produced by coactivation of α- and static γ-motoneurons. Dynamic γ-motoneurons may provide an additional input for adaptive control of different types of movements.The idea that feedback is used to compensate for changes in musclestiffnesshas received experimental support under static postural conditions. However, reflexes tend to increase rather than decrease the range of variation in muscle stiffness during some cyclic movements. Theoretical problems associated with the regulation of stiffness are also discussed. The possibilities of separate control systems forvelocityorviscosityare considered, but the evidence is either negative or lacking. I conclude that different physical variables can be controlled depending on the type of limb movement required. The concept of stiffness regulation is also useful under some conditions, but should probably be extended to the regulation of the visco-elastic properties (i.e., the mechanical impedance) of a muscle or joint. To describe the content of practice guidelines on euthanasia and assisted suicide (EAS) and to compare differences between settings and guidelines developed before or after enactment of the euthanasia law in 2002 by means of a content analysis. Most guidelines stated that the attending physician is responsible for the decision to grant or refuse an EAS request. Due care criteria were described in the majority of guidelines, but aspects relevant for assessing these criteria were not always described. Half of the (...) guidelines described the role of the nurse in the performance of euthanasia. Compared with hospital guidelines, nursing home guidelines were more often stricter than the law in excluding patients with dementia (30% vs 4%) and incompetent patients (25% vs 4%). As from 2002, the guidelines were less strict in categorically excluding patients groups (32% vs 64%) and in particular incompetent patients (10% vs 29%). Healthcare institutions should accurately state the boundaries of the law, also when they prefer to set stricter boundaries for their own institution. Only then can guidelines provide adequate support for physicians and nurses in the difficult EAS decision-making process. (shrink)

A review of theavailable literature would suggest that it is hard to find a piece of work thatconsiders the problem of corruption from all its theoretical aspects from anIslamic perspective or is exclusively dedicated to examining it from (...) to theperspective of the Qur’ān, Sunnah, or indeed both together. To fill this gap, thispaper is a thematic examination of the problem of corruption according to themain sources of Islam; i.e. the Qur’ān and Sunnah, through which an attemptis made to investigate the main theoretical facets in relation to understandingand tackling corruption. Objectives: To assess the knowledge and behaviour of researchers regarding criteria for authorship, and the practices of ghost and gift authorship. Design: Semidirective interviews of senior clinical researchers. Setting: University hospital. Participants: Thirty-nine main investigators of clinical research programmes. Main measurements: Awareness and use of International Committee of Medical Journal Editors (ICMJE) criteria for authorship, and perceptions about ghost and gift authorship. Results: A total of 48 protocols submitted by 42 principal investigators between 1994 and 1996 were identified. Thirty-nine investigators (...) were contacted; 37 (one of whom delegated a co-author) were interviewed between May 2002 and March 2003. Two co-authors of two principal investigators were also interviewed. In all, 42 studies were represented. The interviews lasted for 40–90 minutes and were conducted with openness and respect for confidentiality. The choice of names of co-authors did not follow the ICMJE recommendations. Half of the respondents stated they were aware of criteria for authorship and knew of ICMJE, but most of them did not cite any of the ICMJE criteria among those they applied in deciding authorship. Most of them disagreed with the obligation to meet the three criteria justifying co-authorship because they found these too rigid and inapplicable. Gift authorship was a common practice; 59% of the respondents had been a recipient of gift authorship. Twenty-five (64%) were aware of ghost authorship and the majority considered it questionable and blameworthy. Conclusions: The ICMJE criteria were ignored by clinicians at a university hospital. Ghost and gift authorship were frequent among them. There is a need for French guidelines for authorship to be prepared and implemented. (shrink)
