I argue that a gendered division of labor is often the result of choices by women that count as fully voluntary because they are an expression of preferences and commitments that reflect women's understanding of their own good. Since liberalism has a commitment to respecting fully voluntary choices, it has a commitment to respecting these gendered choices. I suggest that justified political action may require that we fail to respect some people's considered choices.

Stress in health care is affected by moral factors. When people are prevented from doing ‘good’ they may feel that they have not done what they ought to or that they have erred, thus giving rise to a troubled conscience. Empirical studies show that health care personnel sometimes refer to conscience when talking about being in ethically difficult everyday care situations. This study aimed to construct and validate the Stress of Conscience Questionnaire (SCQ), a nine-item instrument for assessing stressful situations (...) and the degree to which they trouble the conscience. The items were based on situations previously documented as causing negative stress for health care workers. Content and face validity were established by expert panels and pilot studies that selected relevant items and modified or excluded ambiguous ones. A convenience sample of 444 health care personnel indicated that the SCQ had acceptable validity and internal consistency (Cronbach’s alpha exceeded 0.83 for the overall scale). Explorative factor analysis identified and labelled two factors: ‘internal demands’ and ‘external demands and restrictions’. The findings suggest that the SCQ is a concise and practical instrument for use in various health care contexts. (shrink)

This study explored patients' experiences of participation and non-participation in their health care. A questionnaire-based survey method was used. Content analysis showed that conditions for patient participation occurred when information was provided not by using standard procedures but based on individual needs and accompanied by explanations, when the patient was regarded as an individual, when the patient's knowledge was recognized by staff, and when the patient made decisions based on knowledge and needs, or performed self-care. Thus, to provide conditions for (...) true patient participation, professionals need to recognize each patient's unique knowledge and respect the individual's description of his or her situation rather than just inviting the person to participate in decision making. The carer of the person with dementia is enjoined to maintain respect, and to reinforce this a bill of rights has been established . Of course, talk of rights does not guarantee respectful behaviour. In this paper it is argued that the discovery that the sufferer continues to be a person, with a unique lifeworld, can assist the carer to conform willingly to the demand that they act respectfully.The current research project makes central the idiographic description of the individual case.

In this paper I focus on the neglected theme of maternal compassion in the writings of Girard, letting them enter into conversation, first, with Emil Fackenheim's reflections on the plight and actions of Jewish mothers during the Holocaust and, second, with themes sounded in the philosophy of Emmanuel Lévinas. I argue that maternal compassion is actually central to Girard's understanding of the unveiling of the victimage mechanism, because it sees goodness in the very life of every potential victim, regardless ofwhat that person has done or is capable ofdoing, simply because he or she exists, has a face. The "innocence" of every victim is reducible to the innocence of the infant, because an infant within a sacrificial system can substitute for every other possible victim. The first chapter in the so-called "Inner Life" – the sequence of eight chapters on the virtues of St. Francis – Chapter Five is notable for its insistent focus on sensory experience, due both to Francis's physical mortifications and (...) to his consciousness of the world's beauty, the "comfort" provided to him by the "creatures" he touched, tasted, heard, and saw. The chapter opens with a declaration of Francis's choice to "carry in his own body the armor of the cross" by holding "in check his sensual appetites," practicing self-denial lest he give in "to the earthbound inclinations of the senses," and they impede his spiritual progress. It ends, after an account of four miracles involving tactile, gustatory, auditory, and visual experience, respectively, with a laud of God, the "entire fabric of [whose] universe / came to the service / of the sanctified senses of the holy man." The pivot upon which the narrative turns from deprivation to gratification is, as editors of the Legenda have noted, "a carefully crafted paragraph" on Francis's freely flowing tears, a paragraph "which needs to be understood in light of Bonaventure's theology of the spiritual senses."That theology has been interpreted, however, in vastly different ways by two major twentieth-century theologians, Karl Rahner and Hans Urs von Balthasar, as the comparative work of Stephen Fields has shown, and as Balthasar himself, writing partly in response to Rahner, emphatically points out. Curiously, neither Rahner nor Balthasar pay particular attention to Chapter Five of the Legenda maior. In this essay I read that chapter closely, partly in light of the questions raised by the disagreement between Rahner and Balthasar . I argue that the operation of the spiritual senses in Francis's soul already at the purgative stage is understood by Bonaventure to have affected Francis's corporeal sensory experience, not as a general habitus but in isolated, expressive acts or perceptions involving particular senses at particular times and places. These corporeal perceptions of God's presence and glory in his creatures are, furthermore, an impressive means and safeguard for Francis's eternal beatitude: "Blessed are those who mourn, for they shall be comforted" .For this reason Chapter Five singles out four episodes in Francis's life that correspond to the four dotes or endowments of the glorified body. These four episodes explicitly highlight four of the five physical senses, but omit, significantly, any direct reference to the fifth sense, that of olfaction. Represented indirectly in Chapter Five, I propose, through a decisive act of charitable discretion, the spiritual sense of smell becomes explicit in Bonaventure's Legenda maior in Chapter Fifteen, when Francis's body is laid to rest in the odor of sanctity. Day’s observations of the spontaneous behavior of people who helped one another at that time of crisis guided her later in dealing with the great crash of 1929 and the subsequent economic depression, during which, in 1933, she cofounded with Peter Maurin (1877–1949) the Catholic Worker Movement and its many Houses of Hospitality.Day’s experience of an anti-sacrificial civilization of love emerging spontaneously out of a chaotic situation of social crisis seems to challenge René Girard’s theory of the scapegoat-mechanism as the normative way of restoring order and peace to a community whose very existence is threatened by anarchy. The earthquake and its social effect as observable phenomena force the consideration that Girard’s early formulations of his theory, which explicitly distanced it from naturalistic explanations of myth, need to be revised in a way that accords more closely with his own later, apocalyptic thought.In an article published recently in Contagion, Matthew Pattillo has shown that Girard’s writings parallel, and to some extent directly affected, those of Jacques Ellul,1 the noted Christian anarchist who cites Girard explicitly on occasion and whose many books, according to Mark and Louise Zwick, “influenced the later Catholic Worker Movement.”2 In this article, I follow Pattillo’s lead, going back in time in order to examine ways in which the mimetic theory of Girard illumines the early thought and practice of Day, highlighting the originality of Day’s Christian anarchism as a remedy for a culture founded on violence. Whereas Girard posits a prereligious phase of anarchic, contagious violence, to which the rituals and prohibitions of religious societies responded (thus distantly preparing the way for a secularized modernity in which “law and order” stand opposed to an ever-threatening “anarchy”), Day finds a freely chosen Christian anarchy the best cure for anarchic destruction and totalitarianism alike, thus forging what Pattillo calls a “‘third way’ beyond law, beyond morality, beyond chaos.”3 In the end, the prolonged crisis within which the Catholic Workers shape their anarchistic “new society” against an eschatological horizon confirms Girard’s apocalypticism, even as it serves to place it in conversation with the apocalyptic philosophy of history of the Russian philosopher Nicholas Berdyaev (1874–1949), whose thought influenced Maurin and Day.4The Earthquake and the TombFor Girard, the tomb is the real and metaphoric evolutionary origin of human civilization. “Culture,” he writes,always develops as a tomb. The tomb is nothing but the first human monument to be raised over the surrogate victim, the first, most elemental and fundamental matrix of meaning. It illustrates how the subject has a clear, practical purpose vital to our daily lives and thinking; includes stories of many of the world's greatest economists; and covers the history of economics from the early barter system through the Industrial Revolution to the emergence of globalization.

The standard view of ignorance is that it consists in the mere lack of knowledge or true belief. Duncan Pritchard has recently argued, against the standard view, that ignorance is the lack of knowledge/true belief that is due to an improper inquiry. I shall call, Pritchard’s alternative account the Normative Account. The purpose of this article is to strengthen the Normative Account by providing an independent vargument supporting it.

Analyzing Oppression asks: why is oppression often sustained over many generations? The book explains how oppression coercively co-opts the oppressed to join their own oppression and argues that all persons have a moral responsibility to resist it. It finally explores the possibility of freedom in a world actively opposing oppression.

It can be shown by means of a paradox that, given the Principle of Sufficient Reason, there is no conjunction of all contingent truths. The question is, or ought to be, how to interpret that result: _Quid sibi velit?_ A celebrated argument against PSR due to Peter van Inwagen and Jonathan Bennett in effect interprets the result to mean that PSR entails that there are no contingent truths. But reflection on parallels in philosophy of mathematics shows it can equally be (...) interpreted either as a proof that there are "too many" contingent truths to combine in a single conjunction or as a proof that the concept _contingent truth_ is indefinitely extensible and there is no such thing as "all contingent truths." Either interpretation would reconcile PSR with contingent truth, but the natural rationales of those interpretations are at odds. This essay argues that the second interpretation is a more satisfactory explanation of why, if PSR is true, there should be no conjunction of all contingent truths. This sheds new light on the nature of the explanatory demand embedded in PSR and uncovers a number of surprising implications for the commitments of rationalism. (shrink)

Anne Margaret Baxley offers a systematic interpretation of Kant's theory of virtue, whose most distinctive features have not been properly understood. She explores the rich moral psychology in Kant's later and less widely read works on ethics, and argues that the key to understanding his account of virtue is the concept of autocracy, a form of moral self-government in which reason rules over sensibility. Although certain aspects of Kant's theory bear comparison to more familiar Aristotelian claims about virtue, Baxley contends (...) that its most important aspects combine to produce something different - a distinctively modern, egalitarian conception of virtue which is an important and overlooked alternative to the more traditional Greek views which have dominated contemporary virtue ethics. This edition of the early diaries of Rudolf Carnap (1891–1970), which are housed in the Carnap estate at the University of Pittsburgh, was published in two volumes by Felix Meiner Verlag Hamburg in 2021 and 2022. These are also the first two volumes of the Meiner Edition Schriften aus dem Nachlass von Rudolf Carnap. The title of these two volumes is succinctly Rudolf Carnap. Tagebücher (Rudolf Carnap. Diaries), supplemented by the respective indication of the volume. Volume 1 (approx. 600 pages) (...) comprises the diaries from 1908 to 1919, Volume 2 (approx. 900 pages) those from 1920 to 1935. With these volumes, the diaries of one of the central thinkers of the Vienna Circle and Logical Empiricism become accessible to a wider circle of researchers and interested parties. While the diaries were previously only partially accessible, they have now for the first time been released in their entirety in the form of a proper text-critical edition. The editor is Christian Damböck with the collaboration of Brigitte Arden, Roman Jordan, Brigitte Parakenings and Lois M. Rendl. Text transcriptions of the originals, which Carnap had written in shorthand, served as the basis for the edition. The transcription was done by Brigitte Parakenings and Brigitte Arden, further editing by Lois M. Rendl and Roman Jordan. (shrink)

The aim of this study was to gain a deeper understanding of privacy in occupational health services. Data were collected through in-depth theme interviews with occupational health professionals (n=15), employees (n=15) and employers (n=14). Our findings indicate that privacy, in this context, is a complex and multilayered concept, and that companies as well as individual employees have their own core secrets. Co-operation between the three groups proved challenging: occupational health professionals have to consider carefully in which situations and how much (...) they are entitled to release private information on individual employees for the benefit of the whole company. Privacy is thus not an absolute right of an individual, but involves the idea of sharing responsibility. The findings open up useful new perspectives on ethical questions of privacy and on the development of occupational health practices. (shrink)

Two significant, apparently unrelated, trends have emerged in American society and medicine. First, American medicine is reexamining its approach to dying. The Institute of Medicine, the American Medical Association and private funding organizations have recognized that too many dying people suffer from pain and other distress that clinicians can prevent or relieve. Second, this past decade has marked a sharp increase in the number of physicians prosecuted for criminal negligence based on arguably negligent patient care. The case often cited as (...) a watershed is People u. Einaugfer, which involved a New York nursing home patient whose physician was convicted in 1993 of two criminal misdemeanors after he ordered an elderly dialysis patient to be tube fed through a peritoneal dialysis Catheter.How is the growing awareness of dying patients’ pain and the increasing willingness of prosecutors to charge physicians with crimes connected? Pain at the end of life is frequently treated with narcotics, prescription drugs that are closely regulated by state and federal law. That complex web of laws—and a growing fear of legal sanctions—has deterred physicians from prescribing controlled substances. As those legal sanctions move from disciplinary actions to criminal charges, physicians’ fears may expand. (shrink)

Introduction The mainstream view in philosophy of language is that sentence meaning determines truth-conditions. A corollary is that the truth or falsity of an utterance depends only on what words mean and how the world is arranged. Although several prominent philosophers (Searle, Travis, Recanati, Moravcsik) have challenged this view, it has proven hard to dislodge. The alternative view holds that meaning underdetermines truth-conditions. What is expressed by the utterance of a sentence in a context goes beyond what is encoded in (...) the sentence itself. Truth-conditional content depends on an indefinite number of unstated background assumptions, not all of which can be made explicit. A change in background assumptions can change truth-conditions, even bracketing disambiguation and reference assignment. That is, even after disambiguating any ambiguous words in a sentence and assigning semantic values to any indexical expressions in the sentence, truth-conditions may vary with variations in the background. Who gets to decide what it means to live a healthy lifestyle, and how important a healthy lifestyle is to a good life? As more governments make preventing obesity and diet-related illness a priority, it's become more important to consider the ethics and acceptability of their efforts. When it comes to laws and policies that promote healthy eating--such as special taxes on sugary drinks and the banning of food deemed unhealthy--critics argue that these policies are paternalistic, and that they limit (...) individual autonomy over food choices. In Healthy Eating Policy and Political Philosophy: A Public Reason Approach, Anne Barnhill and Matteo Bonotti show that both paternalistic justifications for healthy eating efforts and anti-paternalistic arguments against them can be grounded in perfectionist views that overly prioritize some values over others. The authors therefore propose a more inclusive, public reason approach to healthy eating policy that will be appealing to those who take pluralism and cultural diversity seriously, by providing a framework through which different kinds of values, including but not limited to autonomy and health, can be factored into the public justification for healthy eating efforts. Additionally, the book adopts a 'farm to fork' approach to the ethics of healthy eating efforts: it engages with theories and debates in political philosophy, considers the implications of different theoretical positions for healthy eating efforts, and then develops a concrete tool for assessing policies that will be of interest to both scholars and policymakers. As well as offering a novel normative analysis of healthy eating policy, the authors offer a new theoretical framework that will be applicable to a wide range of public policy scenarios. (shrink)

Anders sieht dies freilich hinsichtlich seiner Wirkungsperspektive aus, insbesondere in der Frühen Neuzeit. Dort ist die Präsenz seiner Schriften - von der Forschung bislang kaum beachtet - immens. Die vorliegenden Beiträge, hervorgegangen aus einem Symposium der "Europaischen Melanchthon-Akademie" in Bretten, dokumentieren und analysieren die Spuren und die Wirkung von Ciceros Schriften in dieser Epoche. Der Band leistet damit auf diesem (...) noch weitgehend unerforschten Feld Grundlagenforschung: Exemplarisch legen die Beiträge die historiographischen, literarischen bzw. literaturkritischen und rhetorischen Perspektiven der Cicero-Rezeption in der Frühen Neuzeit offen und nehmen besonders die Wirk- und Aneignungsformen der philosophischen Schriften bzw. ihrer theologischen Implikationen in den Blick.
