Der Band enthält den Briefwechsel Schleiermachers von seinem Amtsantritt als außerordentlicher Professor der Theologie und Philosophie an der Hallenser Universität im Oktober 1804 bis zum Ende des Wintersemesters 1805/06. In seinen Vorlesungen legte Schleiermacher in dieser Zeit den Grund seines theologischen Systems und seiner philosophischen Ethik. Die Entwicklung seiner wissenschaftlichen Auffassungen spiegelt sich in den Briefen des vorliegenden Bandes. Daneben sind die Briefwechsel mit den Altphilologen Heindorf und Spalding in Berlin zur Platon-Übersetzung und mit dem Verleger Georg Andreas Reimer von (...) besonderem wissenschaftlichen Interesse. Weitere Themen sind die immer wieder verschobene Einrichtung des Universitätsgottesdienstes und ein Ruf an Schleiermacher, Prediger an der Kirche Unserer lieben Frauen in Bremen zu werden, den Schleiermacher nutzte, um als Ordinarius Mitglied der Hallenser Fakultät zu werden. Im privaten Briefwechsel ist das Verhältnis zu Eleonore Grunow ein beherrschendes Thema; die Briefe dokumentieren Schleiermachers Hoffnungen und das endgültige Scheitern dieser Beziehung. Einen breiten Raum nimmt die Korrespondenz mit den Freunden in Schwedisch-Vorpommern (Stralsund und Rügen) ein. Von den insgesamt 342 Briefen werden 109 hier in der Erstedition vorgelegt, 37 Briefe werden erstmalig vollständig veröffentlicht. (shrink)

Spiel und Arbeit gelten oft als Gegensätze: Das Spiel als freie Betätigung menschlicher Vermögen, die Arbeit als deren Subordination unter einen äußeren Zweck. Die Festlegung des Spiels auf konsequenzlose Wiederholbarkeit hat ihm den Ruf des Unernsten eingetragen, während das Abzwecken der Arbeit auf die Nützlichkeit ihres Resultats im Bund mit der Sorge ums Dasein steht. Auf einen zweiten Blick scheint dieser Gegensatz jedoch, gerade in den hochentwickeltsten Ausprägungen beider Tätigkeitsformen, zu verschwinden. So kann eine hochgradige Rationalisierung von Spielpraktiken in Arbeit (...) umschlagen, wie etwa im Leistungssport, oder ein komplexer Arbeitsvorgang selbstzweckhafte Momente und Eigendynamiken gewinnen, die ihm Spielcharakter verleihen. Auch andere technologische Entwicklungen geben Anlass dazu, das Verhältnis von Spiel und Arbeit noch einmal grundsätzlich zu bedenken, etwa im Hinblick auf: adaptive Systeme in der Robotik, serious games, Kreativitätstechniken in Unternehmenskulturen, wissenschaftliche Experimentalanordnungen, Online-Rollenspiele oder die Kommodifizierung nicht-zweckrationaler Lebensvollzüge, die traditionell vom Begriff produktiver Arbeit ausgeschlossen waren – einschließlich der Spielräume, die durch neue Umwelt- und Biotechniken erschlossen werden. Anche se siamo comunemente abituati a pensare alla scienza come a un qualcosa di assolutamente atemporale e indipendente da tutto, in realtà essa è profondamente influenzata dalla cultura e dalla società del tempo in cui vive. Infatti né la scienza è isolabile dalla società, né la società è isolabile dalla scienza, tanto meno come si sta configurando oggi. Per approfondire questi aspetti, esistono però due visioni antagoniste che bisogna superare: secondo la visione scolastica, retaggio del positivismo ottocentesco ancora molto diffuso (...) fra scienziati e pubblico di non esperti, la scienza è conoscenza senza soggetto conoscente. All'opposto, la visione cinica della scienza, sull'onda di talune elaborazioni della sociologia della scienza, la riduce a nient'altro che a una costruzione di soggetti che partecipano al gioco scientifico, una cultura come altre e da "mediare", e comunque una conoscenza relativa, se non frutto di una costruzione puramente soggettiva, arbitraria, ideologica. Un'analisi della costituzione sociale della scienza può, invece, mirare a un'indagine scientifica sulla scienza proprio configurando una relatività della conoscenza che supera sia l'assolutismo idealistico sia il relativismo soggettivistico. Responsibility as accountability is normally taken to have stricter control conditions than responsibility as attributability. A common way to argue for this claim is to point to differences in the harmfulness of blame involved in these different kinds of responsibility. This paper argues that this explanation does not work once we shift our focus from other-directed blame to self-blame. To blame oneself in the accountability sense is to feel guilt and feeling guilty is to suffer. To blame oneself in the (...) attributability sense, it will be argued, is to feel shame and feeling shame is also to suffer. The different control conditions cannot be explained by a difference in the harm of blame. Instead, this paper argues that accountability and attributability are governed by different kinds of appropriateness: an agent S is accountability blameworthy for X only if S deserves to feel guilty; an agent S is attributability blameworthy for X only if it is fitting that S feels shame for X. This article investigates the hitherto under-examined relations between affirmative action, paternalism and respect. We provide three main arguments. First, we argue that affirmative action initiatives are typically paternalistic and thus disrespectful towards those intended beneficiaries who oppose the initiatives in question. Second, we argue that not introducing affirmative action can also be disrespectful towards these potential beneficiaries because such inaction involves a failure to adequately recognize their moral worth. Third, we argue that the paternalistic disrespect involved in affirmative action is (...) alleviated when the potential beneficiaries’ preferences against such initiatives are adaptive. We conclude that although there is a relevant sense in which paternalistic affirmative action is disrespectful, it may well be more disrespectful not to pursue such policies. (shrink)

This article works out the main characteristics of `practice theory', a type of social theory which has been sketched by such authors as Bourdieu, Giddens, Taylor, late Foucault and others. Practice theory is presented as a conceptual alternative to other forms of social and cultural theory, above all to culturalist mentalism, textualism and intersubjectivism. The article shows how practice theory and the three other cultural-theoretical vocabularies differ in their localization of the social and in their conceptualization of the body, mind, (...) things, knowledge, discourse, structure/process and the agent. Affirmative action is standardly pursued in relation to admissions to prestigious universities, in hiring for prestigious jobs, and when it comes to being elected to parliament. Central to these forms of affirmative action is that they have to do with competitive goods. A good is competitive when, if we improve A’s chances of getting the good, we reduce B’s chances of obtaining the good. I call this Competitive Affirmative Action. I distinguish this from Non-competitive Affirmative Action. The latter has to (...) do with non-competitive goods, e.g., being granted early parole or freedom from arbitrary arrest. I argue that some of the most prominent objections against affirmative action—in particular, the reverse discrimination objection and the merit objection—speak less against Non-competitive Affirmative Action. And that some of the most prominent arguments in favor of affirmative action, insofar as they justify Competitive Affirmative Action, also justify Non-competitive Affirmative Action. (shrink)

This English translation of the author's original work has been thoroughly revised, expanded and updated. The book covers logical systems known as type-free or self-referential . These traditionally arise from any discussion on logical and semantical paradoxes. This particular volume, however, is not concerned with paradoxes but with the investigation of type-free sytems to show that: (i) there are rich theories of self-application, involving both operations and truth which can serve as foundations for property theory and formal semantics; (ii) these (...) theories provide a new outlook on classical topics, such as inductive definitions and predicative mathematics; (iii) they are particularly promising with regard to applications. Research arising from paradoxes has moved progressively closer to the mainstream of mathematical logic and has become much more prominent in the last twenty years. A number of significant developments, techniques and results have been discovered. Le present volume analyse, non plus en amont la definition kantienne de la science, du savoir, de la scientificite en general, mais cette fois en aval la place des divers savoirs dont Kant a pu traiter. Par une serie d'etudes consacrees a diverses sciences en contexte kantien, le present volume etudie comment Kant assigne a chaque science une unite ideale, une region ontique (un domaine d'objets), une methode, voire une epistemologie, ainsi qu'un mode historique de constitution et de progression propres, (...) avec le constant souci (issu du criticisme) de distinguer les sciences, de ne jamais confondre leurs limites. Ce volume revele ainsi un Kant, non pas seulement theoricien de la science, mais theoricien, voire praticien des sciences en leur pluralite. The aim of this paper is to defend the structural concept of representation, as defined by homomorphisms, against its main objections, namely: logical objections, the objection from misrepresentation, theobjection from failing necessity, and the copy theory objection. The logical objections can be met by reserving the relation.

Traditionally, the manufacturer/operator of a machine is held (morally and legally) responsible for the consequences of its operation. Autonomous, learning machines, based on neural networks, genetic algorithms and agent architectures, create a new situation, where the manufacturer/operator of the machine is in principle not capable of predicting the future machine behaviour any more, and thus cannot be held morally responsible or liable for it. The society must decide between not using this kind of machine any more (which is not a (...) realistic option), or facing a responsibility gap, which cannot be bridged by traditional concepts of responsibility ascription. I offer a new understanding of Descartes’ metaphysics, arguing that his primary question is ‘what is real and true?’ – not as we have been accustomed to believe, ‘how can I be certain?’ – an inquiry that requires both reason’s authority and freedom’s autonomy. I argue that without freedom and its internal relation to reason, Descartes’ undertaking would not get off the ground; yet that relation has gone unnoticed by successive studies of his philosophy. I demonstrate that it is only (...) when we grasp the centrality of freedom to his Meditations that we can understand what motivates key parts of his metaphysics. I present Descartes’ distinctive metaphysics of freedom and resolve what has been seen as an intractable inconsistency between his account of freedom in the Meditations, and the account of freedom he presents in the Principles I 37 and the notorious letter to Mesland (1645). I defend his compelling conception of the true unity of the self, a thinking active being, and its place in the world. (shrink)

Confronted with mounting pressure to ensure accountability vis-à-vis customers, citizens and beneficiaries, organizational leaders need to decide how to choose and implement so-called accountability standards. Yet while looking for an appropriate standard, they often base their decisions on cost-benefit calculations, thus neglecting other important spheres of influence pertaining to more broadly defined stakeholder interests. We argue in this paper that, as a part of the strategic decision for a certain standard, management needs to identify and act according to the needs (...) of all stakeholders. We contend that the creation of a dialogical understanding among affected stakeholders cannot be a mere outcome of applying certain accountability standards, but rather must be a necessary precondition for their use. This requires a stakeholder dialogue prior to making a choice. We outline such a discursive decision framework for accountability standards based on the Habermasian concept of communicative action and, in the final section, apply our conceptual framework to one of the most prominent accountability tools (AA 1000). This book aims to lay bare the logical foundations of tractable reasoning. It draws on Marvin Minsky's seminal work on frames, which has been highly influential in computer science and, to a lesser extent, in cognitive science. Only very few people have explored ideas about frames in logic, which is why the investigation in this book breaks new ground. The apparent intractability of dynamic, inferential reasoning is an unsolved problem in both cognitive science and logic-oriented artificial intelligence. By means of (...) a logical investigation of frames and frame concepts, Andreas devises a novel logic of tractable reasoning, called frame logic. Moreover, he devises a novel belief revision scheme, which is tractable for frame logic. These tractability results shed new light on our logical and cognitive means to carry out dynamic, inferential reasoning. Modularity remains central for tractability, and so the author sets forth a logical variant of the massive modularity hypothesis in cognitive science. (shrink)

This paper extends scholarship on multi-stakeholder initiatives (MSIs) in the context of corporate social responsibility in three ways. First, I outline a framework to analyze the strength of couplings between actors participating in MSIs. Characterizing an MSI as consisting of numerous local networks that are embedded in a wider global network, I argue that tighter couplings (within local networks) and looser couplings (between local networks) coexist. Second, I suggest that this coexistence of couplings enables MSIs to generate policy outcomes which (...) address the conditions of a transnational regulatory context. I argue that MSIs’ way of organizing enables them to cope with three challenges: the stability, flexibility, and legitimacy of governance. Reflecting on these challenges, the article identifies a number of problems related to MSIs’ role in transnational governance. Third, I discuss the UN Global Compact as an illustrative case and examine problems and opportunities related to its stability, flexibility, and legitimacy. (shrink)

It is common in the autonomy literature to claim that some more demanding theories of autonomy disrespect certain individuals by giving the result that those individuals lack autonomy. This claim is often made in the context of the debate between substantive and content-neutral theories of autonomy. Proponents of content-neutral theories often argue that, in deeming certain people non-autonomous—especially certain oppressed people who seem to have internalized their oppression in certain ways—the substantive theories disrespect those people. They take this as reason (...) to accept content-neutral views over substantive views. Despite its ubiquity, this concern about disrespect is hard to pin down precisely. In this paper, I articulate two questions that need to be answered before we can understand the disrespect objection. First: Who, exactly, is supposedly being disrespected by substantive views? Second: Why is it that excluding people with these features is disrespectful? I consider a number of possible answers to each of these questions, and I argue that none of them gives us a plausible explanation of why we should think substantive theories of autonomy are disrespectful to anyone. No matter how we fill in the details, I will argue, there is simply no reason to prefer content-neutral theories of autonomy over substantive ones on the grounds of respect. (shrink)

ABSTRACT This essay suggests that we should understand the varieties of “popular science” as part of a larger phenomenon: the changing set of processes, practices, and actors that generate and transform public knowledge across time, space, and cultures. With such a reconceptualization we can both de‐essentialize and historicize the idea of “popularization,” free it from normative notions, and move beyond existing imbalances in scholarship. The history of public knowledge might thus find a central place in many fundamental narratives of the (...) modern world. More specifically, the essay proposes that we pay more attention to forms of knowledge outside the realm of “science,” embrace the richness, traffic, and transfer of public knowledge on a transnational scale as well as in comparative perspective, and rethink conventional forms of periodization. I discuss Descartes’ metaphysics of selfhood, and relevant parts of contemporary philosophy regarding the first person. My two main concerns are the controversy that surrounds Descartes’ conception of conscientia, mistranslated as ‘consciousness’, and his conception of selfhood and its essential connection to conscientia. ‘I’-thoughts give rise to the most challenging philosophical questions. An answer to the questions concerning the peculiarities of the first person, self-identification and self-ascription, is to be found in Descartes’ notion of conscientia. His conception of selfhood insightfully (...) informs his conception of personhood. I offer a unified account of selfhood, conscientia, the first person, and personhood anchored in the self’s authority of reason and autonomy of freedom. (shrink)

According to the Strawsonian tradition, a person is responsible for an action just in case it is appropriate to hold them responsible for that action. One important way of holding people responsible for wrongdoing is by experiencing and expressing blaming emotions. This raises the questions of what blaming emotions are and in what sense they can be appropriate. In this chapter I will provide an overview of different answers to both these questions. A common thread in the chapter will be (...) a challenge for the Strawsonian tradition. Given that this tradition understands moral responsibility in terms of the appropriateness of blaming emotions, it must provide a realistic picture of these emotions and the practices in which they take part. On the other hand, it also aims to develop a normatively plausible account of the conditions of responsibility. I will try to show that it is often difficult to strike a satisfactory balance between these two aspirations. (shrink)

Construed as a theory of justice, relational egalitarianism says that justice requires that people relate as equals. Construed as a theory of what makes democracy valuable, it says that democracy is a necessary, or constituent, part of the value of relating as equals. Typically, relational egalitarians want their theory to provide both an account of what justice requires and an account of what makes democracy valuable. We argue that relational egalitarians with this dual ambition face the justice-democracy dilemma: Understanding social (...) relations in such a way that renders relational egalitarianism plausible as an answer to what makes democracy valuable comes at the price of understanding social relations in a way that makes it less plausible as a theory of justice, and vice versa. We also argue that there is no easy way out of the dilemma and that relational egalitarians, who want relational equality to provide both accounts mentioned, may simply have to set their ambitions lower on behalf of relational equality. Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which has (...) recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. Relational egalitarianism is a theory of justice according to which justice requires that people relate as equals. According to some relational egalitarians, X and Y relate as equals if, and only if, they (1) regard each other as equals; and (2) treat each other as equals. In this paper, we argue that relational egalitarians must give up (1).

Two prominent relational egalitarians, Elizabeth Anderson and Niko Kolodny, object to giving people in a democratic community differential voting weights on the grounds that doing so would lead to unequal relations between them. Their claim is that deviating from a “one-person, one-vote” scheme is incompatible with realizing relational egalitarian justice. In this article, I argue that they are wrong. I do so by showing that people can relate as moral, epistemic, social, and empirical equals in a scheme with differential voting (...) weights. I end the article by showing that from the perspective of relational egalitarianism, it is sometimes true that differential voting weights are more just than equal voting weights. (shrink)

I explore the limits of corporate responsibility standards – for example Social Accountability 8000 (SA 8000), the Global Reporting Initiative, the Fair Labor Association workplace code – by looking at these initiatives through Derrida's aporias of justice as set out in ‘Force of Law: The “Mystical Foundation of Authority”’. Based on a discussion of SA 8000, I uncover the unavoidable aporias that are associated with the use of this standard. I contribute to the literature on corporate responsibility standards in general (...) and SA 8000 in particular by showing (a) that attempts to standardise corporate responsibility can only be successful insofar as we recognise that compliance with SA 8000's rules requires a ‘fresh judgement’ every time they are applied, (b) that SA 8000 should not be pushed down the supply chain as such coercion does not require a truly responsible decision by suppliers and eventually leads to moral mediocrity and (c) that the necessarily time‐consuming reflections about the singular contexts within which SA 8000 is applied challenge the urgent need for implementing this standard. I discuss the implications of my analysis of SA 8000 for corporate responsibility standards in general. (shrink)

According to relational egalitarianism, justice requires equal relations. In this paper, I ask the question: can equal relations be unjust according to relational egalitarianism? I argue that while on some conceptions of relational egalitarianism, equal relations cannot be unjust, there are conceptions in which equal relations can be unjust. Surprisingly, whether equal relations can be unjust cuts across the distinction between responsibility-sensitive and non-responsibility-sensitive conceptions of relational egalitarianism. I then show what follows if one accepts a conception in which equal (...) relations can be unjust, including why it provides a reason to grant some people less political power than others. (shrink)

A simple explanation of theoreticity says that a term is theoretical if and only if it refers to nonobservational entities. Paradigmatic examples of such entities are electrons, neutrinos, gravitational forces, genes etc. There is yet another explanation of theoreticity: a theoretical term is one whose meaning becomes determined through the axioms of a scientific theory. The meaning of the term ‘force’, for example, is seen to be determined by Newton’s laws of motion and further laws about special forces, such as (...) the law of gravitation. Theoreticity is a property that is commonly applied to both expressions in the language of science, and referents and concepts of such expressions. Objects, relations and functions as well as concepts thereof may thus qualify as theoretical in a derived sense. (shrink)

According to Arti Dhand, it can be argued that all Indian ethics have been primarily virtue ethics. Many have indeed jumped on the virtue bandwagon, providing prima facie interpretations of Hindu, Jain, and Buddhist canons in virtue terms. Others have expressed firm skepticism, claiming that virtues are not proven to be grounded in the nature of things and that, ultimately, the appeal to virtue might just well be a mere façon de parler. In this paper, we aim to advance the (...) discussion of Indian virtue ethics. Our intent is not to provide a catch-all interpretation of the different Indian schools. Our goal is, more modestly, to offer a theory of virtues in Indian philosophies, as a framework for theorists and interpreters who see these diverse traditions as amenable to systematic virtue analysis. Our theory grounds virtues in the reality of genuine moral dispositions and in a system of beliefs where morality is understood as transformative in nature. (shrink)

Reconsidering Arendt’s On Revolution (1963) and its evocation of Hermann Melville’s novella Billy Budd (1891), I show first that the novella bears the traces of an essay by Samuel Taylor Coleridge, “The Appeal to (...) Law” (1809). Then, drawing on Walter Benjamin’s writings on trauma in Illuminations (1968, edited by Arendt), I discuss the political importance Arendt attaches to the proper way of telling a story, at a time when “the communicability of experience is decreasing” (Benjamin, Illuminations, 86). Through the analysis of Benjamin’s “The Storyteller” and Arendt’s “heartless” report on the Eichmann trial (1963), I equally show that, according to Arendt, testimonies must be narrated, or rather performed, in a dispassionate, dry, and compact manner so that they can be historically and politically relevant. This paper argues that God's immanent causation and Spinoza's account of activity as adequate causation (of finite modes) do not always go together in Spinoza's thought. We show that there is good reason to doubt that this is the case in Spinoza's early Short Treatise on God, Man and His Well‐being. In the Short Treatise, Spinoza defends an account of God's immanent causation without fully endorsing the account of activity as adequate causation that he will later introduce in the Ethics (...) (E3def2). We turn to an examination of how God's immanent causation relates to the activity of finite things in the Ethics. We consider two ways to think about the link between God, seen as immanent cause, and the activity of finite things: namely, in terms of entailment and in terms of production. We argue that the productive model is most promising for understanding the way in which the activity of finite things and God's immanent causality are connected in Spinoza's (mature) philosophy.
