Entre los diversos aportes teóricos que hicieron de Max Weber una de las figuras principales del pensamiento social del siglo XX, encontramos su sociología del derecho que tiene como tema el proceso de racionalización del derecho occidental. Max Weber estudió ese proceso como una racionalización de tipo formal que es acompañada, aún en su última etapa moderna, de tendencias contrarias que se dirigen hacia la materialización del derecho. A partir de estos trabajos de Weber se ha construido una crítica del (...) Estado social y una oposición a tomar los derechos sociales como derechos fundamentales, consistentes en afirmar que tal proyecto político conspira contra las notas de racionalidad del Estado de derecho por implicar la introducción de exigencias materiales de justicia que degradan la norma superior del ordenamiento jurídico, es decir, la Constitución. The goal of this study was to introduce a model explaining how managers' attitudes, subjective norms, attributions, and the individualism-collectivism cultural dimension affect the way managers' deal with employee bribery in organizations. Twenty-six internal and external attributions related to bribery were identified through a series of structured interviews with 65 subject matter experts. These attributions, together with the other variables in the model, were evaluated by 354 Ecuadorian managers. Hierarchical regression analyses indicated that attitudes and external attributions significantly predicted managers' (...) intentions to discipline employees who accepted a bribe. In addition, external attributions mediated the relationship between individualism-collectivism and intent to discipline corrupt employees. Implications for the management of bribery in Latin American organizations are discussed. (shrink)

We present a mathematical approach to defeasible reasoning based on arguments. This approach integrates the notion of specificity introduced by Poole and the theory of warrant presented by Pollock. The main contribution of this paper is a precise, well-defined system which exhibits correct behavior when applied to the benchmark examples in the literature. It aims for usability rather than novelty. We prove that an order relation can be introduced among equivalence classes of arguments under the equi-specificity relation. We also prove (...) a theorem that ensures the termination of the process of finding the justified facts. Two more lemmas define a reduced search space for checking specificity. In order to implement the theoretical ideas, the language is restricted to Horn clauses for the evidential context. The language used to represent defeasible rules has been restricted in a similar way. The authors intend this work to unify the various existing approaches to argument-based defeasible reasoning. O artigo – desde uma perspectiva da educação como direito humano universal que reconhece a diversidade – realiza um recorrido panorâmico por uma série de dimensões da educação intercultural no ensino superior do Chile, especialmente universitária, discute criticamente a situação atual da interculturalização na universidade – entendida genericamente – e conclui com algumas perguntas que podem orientar pesquisas ou decisões que levem a que o ensino superior considere os direitos indígenas, permita a expressão de sua cultura, promova a interculturalidade, forme (...) os técnicos e profissionais que requerem o desenvolvimento da sociedade e das comunidades e enriqueça a docência e a ciência com outros paradigmas de conhecimento. Desse modo, que reconheça e valide a interculturalidade e os aportes das culturas indígenas a sua identidade, formação e produção de conhecimento. Trata das comunidades e dos estudantes indígenas em geral, mas aprofunda a situação desde o povo mapuche, embasando-se em projetos de pesquisa e desenvolvimento e em experiências em e desde a Região da Araucanía. A proposta se centra na ideia de que o direito à educação, desde a lei e inconstitucionalidade atual, se centra no sistema escolar formal de ensino básico e médio e não considera a educação superior ou a um sistema de educação continuado como direito universal, no qual poderia se especificar uma condição especial aos estudantes indígenas. This paper offers an exposition of Husserl's mature philosophy of mathematics, expounded for the first time in Logische Untersuchungen and maintained without any essential change throughout the rest of his life. It is shown that Husserl's views on mathematics were strongly influenced by Riemann, and had clear affinities with the much later Bourbaki school.

Background: Ontologies and taxonomies are among the most important computational resources for molecular biology and bioinformatics. A series of recent papers has shown that the Gene Ontology (GO), the most prominent taxonomic resource in these fields, is marked by flaws of certain characteristic types, which flow from a failure to address basic ontological principles. As yet, no methods have been proposed which would allow ontology curators to pinpoint flawed terms or definitions in ontologies in a systematic way. Results: We present (...) computational methods that automatically identify terms and definitions which are defined in a circular or unintelligible way. We further demonstrate the potential of these methods by applying them to isolate a subset of 6001 problematic GO terms. By automatically aligning GO with other ontologies and taxonomies we were able to propose alternative synonyms and definitions for some of these problematic terms. This allows us to demonstrate that these other resources do not contain definitions superior to those supplied by GO. Conclusion: Our methods provide reliable indications of the quality of terms and definitions in ontologies and taxonomies. Further, they are well suited to assist ontology curators in drawing their attention to those terms that are ill-defined. We have further shown the limitations of ontology mapping and alignment in assisting ontology curators in rectifying problems, thus pointing to the need for manual curation. (shrink)

Recent work in formal semantics suggests that the language system includes not only a structure building device, as standardly assumed, but also a natural deductive system which can determine when expressions have trivial truth-conditions (e.g., are logically true/false) and mark them as unacceptable. This hypothesis, called the `logicality of language', accounts for many acceptability patterns, including systematic restrictions on the distribution of quantifiers. To deal with apparent counter-examples consisting of acceptable tautologies and contradictions, the logicality of language is often paired (...) with an additional assumption according to which logical forms are radically underspecified: i.e., the language system can see functional terms but is `blind' to open class terms to the extent that different tokens of the same term are treated as if independent. This conception of logical form has profound implications: it suggests an extreme version of the modularity of language, and can only be paired with non-classical---indeed quite exotic---kinds of deductive systems. The aim of this paper is to show that we can pair the logicality of language with a different and ultimately more traditional account of logical form. This framework accounts for the basic acceptability patterns which motivated the logicality of language, can explain why some tautologies and contradictions are acceptable, and makes better predictions in key cases. As a result, we can pursue versions of the logicality of language in frameworks compatible with the view that the language system is not radically modular vis-a-vis its open class terms and employs a deductive system that is basically classical. As AI technologies are rolled out into healthcare, academia, human resources, law, and a multitude of other domains, they become de-facto arbiters of truth. But truth is highly contested, with many different definitions and approaches. This article discusses the struggle for truth in AI systems and the general responses to date. It then investigates the production of truth in InstructGPT, a large language model, highlighting how data harvesting, model architectures, and social feedback mechanisms weave together disparate understandings of veracity. It (...) conceptualizes this performance as an operationalization of truth, where distinct, often-conflicting claims are smoothly synthesized and confidently presented into truth-statements. We argue that these same logics and inconsistencies play out in Instruct’s successor, ChatGPT, reiterating truth as a non-trivial problem. We suggest that enriching sociality and thickening “reality” are two promising vectors for enhancing the truth-evaluating capacities of future language models. We conclude, however, by stepping back to consider AI truth-telling as a social practice: what kind of “truth” do we as listeners desire? (shrink)

Ontology is the philosophical discipline which aims to understand how things in the world are divided into categories and how these categories are related together. This is exactly what information scientists aim for in creating structured, automated representations, called 'ontologies,' for managing information in fields such as science, government, industry, and healthcare. Currently, these systems are designed in a variety of different ways, so they cannot share data with one another. They are often idiosyncratically structured, accessible only to those who (...) created them, and unable to serve as inputs for automated reasoning. This volume shows, in a nontechnical way and using examples from medicine and biology, how the rigorous application of theories and insights from philosophical ontology can improve the ontologies upon which information management depends. In this article I examine a recent development in online communication, the immersive virtual worlds of Massively Multiplayer Online Role-Playing Games (MMORPGs). I argue that these environments provide a distinct form of online experience from the experience available through earlier generation forms of online communication such as newsgroups, chat rooms, email and instant messaging. The experience available to participants in MMORPGs is founded on shared activity, while the experience of earlier generation online communication is largely if not wholly dependent on (...) the communication itself. This difference, I argue, makes interaction in immersive virtual worlds such as MMORPGs relevantly similar to interaction in the physical world, and distinguishes both physical world and immersive virtual world interaction from other forms of online communication. I argue that to the extent that shared activity is a core element in the formation of friendships, friendships can form in immersive virtual worlds as they do in the physical world, and that this possibility was unavailable in earlier forms of online interaction. I do, however, note that earlier forms of online interaction are capable of sustaining friendships formed through either physical or immersive virtual world interaction. I conclude that we cannot any longer make a sharp distinction between the physical and the virtual world, as the characteristics of friendship are able to be developed in each. (shrink)

: In this paper I will examine two conceptions of philosophy that were defended in Latin America during the last century. I believe that both models have to be put away and that we must build a new one, recovering elements of both of them. At the end of my paper I will consider very briefly what can we learn from this in order to construct a genuine philosophical dialogue between the United States and Latin America.

Political exclusion on grounds of incapacity is the primary remaining source of exclusion from the franchise. It is appealed to by states and theorists alike to justify excluding young people and many people with cognitive disability from the franchise. Defenders of this exclusion claim that no wrong is done by this exclusion and that states gain some significant benefits from this restricting of the franchise. I have argued elsewhere that political exclusion as currently practiced in modern liberal democratic states in (...) fact causes significant harms, as it excludes some people who have the relevant capacity for political participation. Here, I argue that the exclusion of incapable actors prevents no significant harms to democratic outcomes, and that it confers no significant democratic benefits on the states practising this exclusion. As such, I argue that we ought to heavily modify and perhaps even abandon the capacity standard for political inclusion. (shrink)

As AI technologies are increasingly deployed in work, welfare, healthcare, and other domains, there is a growing realization not only of their power but of their problems. AI has the capacity to reinforce historical injustice, to amplify labor precarity, and to cement forms of racial and gendered inequality. An alternate set of values, paradigms, and priorities are urgently needed. How might we design and evaluate AI from an indigenous perspective? This article draws upon the five Tests developed by Māori scholar (...) Sir Hirini Moko Mead. This framework, informed by Māori knowledge and concepts, provides a method for assessing contentious issues and developing a Māori position. This paper takes up these tests, considers how each test might be applied to data-driven systems, and provides a number of concrete examples. This intervention challenges the priorities that currently underpin contemporary AI technologies but also offers a rubric for designing and evaluating AI according to an indigenous knowledge system. The meaning that expressions take on particular occasions often depends on the context in ways which seem to transcend its direct effect on context-sensitive parameters. ‘Truth-conditional pragmatics’ is the project of trying to model such semantic flexibility within a compositional truth-conditional framework. Most proposals proceed by radically ‘freeing up’ the compositional operations of language. I argue, however, that the resulting theories are too unconstrained, and predict flexibility in cases where it is not observed. These accounts fall into this position because (...) they rarely, if ever, take advantage of the rich information made available by lexical items. I hold, instead, that lexical items encode both extension and non-extension determining information. Under certain conditions, the non-extension determining information of an expression e can enter into the compositional processes that determine the meaning of more complex expressions which contain e. This paper presents and motivates a set of type-driven compositional operations that can access non-extension determining information and introduce bits of it into the meaning of complex expressions. The resulting multidimensional semantics has the tools to deal with key cases of semantic flexibility in appropriately constrained ways, making it a promising framework to pursue the project of truth-conditional pragmatics. This article discusses the current epistemological status of the political blogosphere, in light both of the concerns raised by Alvin Goldman in his 2008 paper ?The Social Epistemology of Blogging? and the recent drastic changes in the structure of the blogosphere. I argue that the political blogosphere replicates epistemically beneficial functions of the mainstream media for the functioning of democracy, and defend this claim from objections to the blogosphere that have been levelled by Goldman and Richard Posner. This article begins with the assumption that criminal disenfranchisement is at least sometimes theoretically defensible, as a component of punishment. From this assumption, I argue that it is only legitimate in a constrained set of cases. These constraints include: implementing disenfranchisement only for serious crimes; tying disenfranchisement to both the electoral cycle and to the length of imprisonment imposed for an offence; and assessing a background condition of sufficient justice present within the state that wishes to disenfranchise. Once these constraints (...) are considered, I argue that there are very few instances in which disenfranchisement is defensible. To prove this, I examine both current disenfranchisement practices and the commonly present factors that undermine the constraints outlined above. (shrink)

How are biases encoded in our representations of social categories? Philosophical and empirical discussions of implicit bias overwhelmingly focus on salient or statistical associations between target features and representations of social categories. These are the sorts of associations probed by the Implicit Association Test and various priming tasks. In this paper, we argue that these discussions systematically overlook an alternative way in which biases are encoded, that is, in the dependency networks that are part of our representations of social categories. (...) Dependency networks encode information about how features in a conceptual representation depend on each other. This information determines the degree of centrality of a feature for a conceptual representation. Importantly, centrally encoded biases systematically disassociate from those encoded in salient-statistical associations. Furthermore, the degree of centrality of a feature determines its cross-contextual stability: in general, the more central a feature is for a concept, the more likely it is to survive into a wide array of cognitive tasks involving that concept. Accordingly, implicit biases that are encoded in the central features of concepts are predicted to be more resilient across different tasks and contexts. As a result, the distinction between centrally encoded and salient-statistical biases has important theoretical and practical implications. (shrink)

Medical science conceives the human body as a system comprised of many subsystems at a variety of levels. At the highest level are bodily systems proper, such as the endocrine system, which are central to our understanding of human anatomy, and play a key role in diagnosis and in dynamic modeling as well as in medical pedagogy and computer visualization. But there is no explicit definition of what a bodily system is; such informality is acceptable in documentation created for human (...) beings, but falls short of what is needed for computer representations. Over the past decade or so, a new interdisciplinary field has emerged in the ground between, on the one hand, computer science – and artificial intelligence in particular – and, on the other, the area of philosophy concentrating on the language and structure of argument. There are now hundreds of researchers worldwide who would consider themselves a part of this nascent community. Various terms have been proposed for the area, including "Computational Dialectics," "Argumentation Technology," and "Argument-based Computing," but the term (...) that has stuck is simply Argument & Computation. It encompasses several specific strands of research, such as: . the use of theories of argument, and dialectic in particular, in the design and implementation of protocols for multi-agent action and communication; . the application of theories of argument and rhetoric in natural language processing and affective computing; . the use of argument-based structures for autonomous reasoning in artificial intelligence, and in particular, for defeasible reasoning; . computer-supported collaborative argumentation – the implementation of software tools for enabling online argument in domains such as education and e-government. These strands come together to form the core of a research field that covers parts of artificial intelligence (AI), philosophy, linguistics, and cognitive science, but, increasingly, is building an identity of its own. Through the study of the behaviour of the protagonists in the work of Franz Kafka, we will try to expose the control mechanisms used by the administrative authorities, providing at the same time with an antidote to uncritical submission. A thorough observation of the configuration of diegetic situations will allow to reverse the situations of forced compliance to proffer, in the voice of the so-called secondary figures, a critical understanding to enable the recovery of individual freedom.

This study explores young people’s perceptions of their existential well-being during the transition after leaving care. We use the theoretical framework of ‘existential well-being,’ which is a relational approach. The study deploys participatory action research methodology and involves peer research with 74 young people leaving care aged 17–32 in Finland (2011–2012) and England (2016–2018). The data was gathered through semi-structured interviews and thematically analysed.We identified three inter-linking categories of existential well-being related to the basic issues of being a person: who (...) one is and where one belongs. Self-feeling involves the importance of how one feels about oneself and one’s physical and mental health and security. Self-realisation relates to one’s hopes and the means for making one’s own decisions in everyday life. Belonging concerns the confidence one expresses in one’s supportive social networks.The findings highlight that, alongside the practical issues of out-of-home care, attention should increasingly focus on young people's reflections on their own lives, and an ethics of care should be developed to better meet their needs. These findings argue for the need to further support young people’s psychosocial and mental health in child welfare policy and practice. (shrink)

RESUMEN:Este artículo presenta el pensamiento de Michel Montaigne como camino para interpretar aspectos de la formación docente contemporánea. En primer lugar se caracterizan las nociones de ensayo y de experiencia; se analizan las relaciones entre ellas; y se las discute como ejes de una propuesta formativa basada en una exploración seria de la propia vida. Luego, se presentan dos desafíos identificados por Russell : por una parte, si bien han pasado 12 años escolarizados, al momento de comenzar con sus prácticas (...) profesionales los alumnos de carreras de pedagogía tienen dificultades en explicar de qué se trata enseñar. Por otro lado, los profesores que dictan cursos de pedagogía suelen no ser los mismos que acompañan a los alumnos en sus primeras experiencias docentes. Esto tendería a crear una ruptura entre la educación que se recibe como alumno y la que se imparte como docente de práctica profesional. El artículo concluye proponiendo la posibilidad de implementar un ensayo de posición pedagógica. Éste constituiría una estrategia formativa por sí misma que permitiría, tanto a profesores experimentados como a novicios, visibilizar, articular y discutir los argumentos fundamentales desde los cuales orientan su tarea cotidiana como educadores. ABSTRACT:This paper presents Michel Montaigne´s thought as a way of interpreting some aspects of contemporary teacher education. First, it characterizes the notions of experiment and experience, analyzes their relationship, and discusses them as guidelines for an educational project based on the serious consideration of personal life. From this point of view, the paper continues presents two challenges identified by Russell. First, the claim that when beginning their training, education students have difficulty in articulating what teaching is about. Second, the assertion that university course professors are usually not the same people that guide students through their practicum. The paper concludes by proposing the possibility of a pedagogical position experiment. This would be an educational experience as such, that would allow both experienced and novice teachers to manifest, discuss, and articulate the basic assumptions by which they guide their daily work. El artículo se centra en analizar la propuesta filosófica del italiano Giorgio Agamben y el modo en que en ella se introduce al pensador alemán Carl Schmitt. Sobre Agamben se evalúa cómo el recurso a la teoría de la excepcionalidad schmittiana, es invertido para favorecer una teoría política impersonal, expresada en una soberanía omnipresente y una resistencia altamente pesimista. Se plantea una crítica a los planteamientos de Agamben, argumentada en la necesidad de dar continuidad a la teoría decisionista de Schmitt. (...) El artículo sostiene que Agamben se basó en la faceta teológico-política de Schmitt y prestó poca atención al Schmitt que relaciona el Estado de excepción con la vida pública, lo movimientos y el antagonismo político de la realpolitik.
