El objetivo de este trabajo es mostrar la importancia que tiene recuperar el concepto de «ideología» y con él la labor de crítica ideológica en la teoría del derecho. En las teorías positivistas de Kelsen y Ross era uno de los conceptos centrales, pero cayó paulatinamente en desuso en la segunda mitad del siglo xx, tanto a nivel político como en el campo específico de la teoría jurídica. En este trabajo se examinan algunas de las razones por las que se (...) dejó de utilizar y se propone un concepto de «ideología» capaz de evitar esos cuestionamientos. Por último, se ponen de manifiesto las consecuencias perjudiciales (tanto teóricas como prácticas) que trae aparejado el abandono de la crítica ideológica en la teoría jurídica. Se utiliza como caso de estudio la concepción postpositivista sobre la naturaleza del derecho defendida por Manuel Atienza y algunas de las decisiones argumentativas que el propio Atienza ha adoptado guiado por ella en una polémica sobre el estatus normativo de la gestación por sustitución en la práctica jurídica española. The continental drift controversy has been deeply analysed in terms of rationalist notions, which seem to find there a unique topic to describe the weight of evidence for reaching consensus. In that sense, many authors suggest that Alfred Wegener’s theory of the original supercontinent Pangea and the subsequent continental displacements finally reached a consensus when irrefutable evidence became available. Therefore, rationalist approaches suggest that evidence can be enough by itself to close scientific controversies. In this article I analyse continental drift (...) debates from a different perspective which is based on styles of thought. I’ll argue that continental drift debate took much longer than it was usually recognized with two styles of thought coexisting for hundreds of years. These were fixism and mobilism and they were always confronting their own evidence and interpretations and functioning as general frameworks for the acceptability of a specific theory. Therefore, this text aims to bring much broader sociological elements than usually involved in the analysis of the continental drift theory. (shrink)

El examen de los actores, instituciones y materiales implicados en el Proyecto Genoma Humano (PGH) remite inmediatamente al contexto de los macroproyectos científicos que suelen caracterizarse con el expresivo rótulo de «Big Science». Como es bien sabido, la afortunada expresión fue acuñada por el sociólogo de la ciencia Derek de Solla Price en 1936 quien elaboró su concepción considerando, principalmente, a la física de su época. Sin embargo, las ciencias biológicas tardaron varios decenios más en adquirir las dimensiones de la (...) Big Science. En el caso del PGH se presenta un panorama muy distinto al contexto en el que surgió la estructura de la doble hélice. El investigador aislado no tiene cabida en este contexto, y los grandes científicos son ahora directores de proyectos y el caso de James Watson es de nuevo paradigmático. (shrink)

El ajuste entre Estado y nación en Latinoamérica ha observado complicaciones desde la fundación de sus repúblicas. La pluralidad de subjetividades, realidades materiales y brechas, sumadas a las coyunturales demandas insatisfechas y una débil institucionalidad influyeron en que las construcciones nacionales hayan tenido un componente populista en diferentes intentos refundadores. En los países andinos ese componente se expresa a partir de unas condiciones sociopolíticas previas a las performativas identidades nacionales y la presencia de liderazgos personalistas. Parte de los estudios sobre (...) identidades nacionales en estos países se centraron en el análisis de sus liderazgos y discursos. Otros optaron por centrarse en los procesos o condiciones de posibilidad que favorecen la irrupción de estas identidades. El objetivo del trabajo es brindar una base epistemológica que emerja de la compatibilidad entre los anteriores abordajes explicativos de las identidades nacionales. (shrink)

RESUMEN La polémica sobre los prejuicios es un símbolo distintivo de la Ilustración alemana. Este artículo presenta aspectos históricos de esta polémica que resultan útiles para esclarecer el pensamiento de Kant. Se argumenta que la posición kantiana respecto de ella, como una polémica en la que convive una perspectiva que busca la liberación de todo prejuicio y otra que permite que algunos permanezcan, y hasta los estima como útiles, representa un esfuerzo por conciliar ambas perspectivas, y anticipa la distinción planteada (...) en la "Dialéctica trascendental" entre el uso regulativo y constitutivo de las ideas. ABSTRACT The controversy over prejudices is a distinctive feature ofthe German Enlightenment. The article addresses some historical aspects of this controversy that are useful to shed light on Kant's thought. Enlightenment positions ranged from the perspective seeking to rid itself of all prejudices, to that which allows for some prejudices and even considers them useful. The article argues that the Kantian position on the matter constitutes an effort to reconcile these perspectives, thus anticipating the distinction set forth in the "Transcendental Dialectic" between the regulative and the constitutive use of ideas. The article appearing previously in this journal entitled “Styles of Thought on the Continental Drift Debate” (Pellegrini 2019) prompted a response from Weber and Šešelja (2020) which they termed as “a defence of rationalist accounts”. They argue that their self-designated “sophisticated rationalism” explains the closure of the continental-drift debate without being affected by my critiques to rationalist approaches. While ignoring the empirical evidence that shows the complexity of the debate and the necessity to include broader social elements in the analysis (...) (such as scientists denying continental drift even after the plate tectonics theory, others supporting it without being familiarized with the literature), they proclaim to be unconvinced about the analysis of the styles of thought. In order to clarify differences in the approach to the continental-drift historical controversy, I respond here to the criticism my paper drew while discussing the place of rationalism when explaining the acceptance of a theory. I will argue that their distinction between “crude” and “sophisticated” rationalism does not solve the problem of social aspects being left aside by rationalists in view of the acceptance of a theory. I will also argue that in order to understand what leads people to embrace a belief (namely scientists in accepting a theory), the analysis of mere cognitive or epistemic arguments is not enough and it leads to a reductionist explanation as to social behaviour. Technoscientific research, a kind of scientific research conducted within the decontextualized approach (DA), uses advanced technology to produce instruments, experimental objects, and new objects and structures, that enable us to gain knowledge of states of affairs of novel domains, especially knowledge about new possibilities of what we can do and make, with the horizons of practical, industrial, medical or military innovation, and economic growth and competition, never far removed from view. The legitimacy of technoscientific innovations can be appraised only in (...) the course of considering fully what sorts of objects technoscientific objects are: objects that embody scientific knowledge confirmed within DA; physical/chemical/biological objects, realizations of possibilities discovered in research conducted within DA, brought to realization by means of technical/experimental/instrumental interventions; and components of social/ecological systems, objects that embody the values of technological progress and (most of them) values of capital and the market. What technoscientific objects are - their powers, tendencies, sources of their being, effects on human beings and social/economic systems, how they differ from non technoscientific objects - cannot be grasped from technoscientific inquiry alone; scientific inquiry that is not reducible to that conducted within DA is also needed. The knowledge that underlies and explains the efficacy of technoscientific objects is never sufficient to grasp what sorts of object they are and could become. This article analyzes the main reasons offered by the literature in relation to the question of whether pre-implantation genetic diagnosis and selection should be allowed in the context of assisted reproduction techniques to avoid the birth of children with disabilities. The bioethical literature faces a challenge from the disability discourse. When the oppressive social dimension of disability is taken into account, it results in a series of questions that could challenge the most settled conclusions of the bioethical debate. However, the (...) social model has not been without criticism and one of them, the underestimation of the importance of biological traits origin against a disability of social origin, resonates particularly in the debate on preimplantation genetic selection. Practices related to research misconduct seem to have been multiplied in recent years. Many cases of scientific fraud have been exposed publicly, and journals and academic institutions have deployed different measures worldwide in this regard. However, the influence of specific social and cultural environments on scientific fraud may vary from society to society. This article analyzes how scientists in Japan deal with accusations of scientific fraud. For such a purpose, a series of scientific fraud cases that took place in Japan (...) has been reconstructed through diverse sources. Thus, by analyzing those cases, the social basis of scientific fraud and the most relevant aspects of Japanese cultural values and traditions, as well as the concept of honour which is deeply involved in the way Japanese scientists react when they are accused of and publicly exposed in scientific fraud situations is examined. This article discusses explanations behind theory choice, that is, ultimately, what leads people to accept a certain claim as valid. There has been a recent debate as to how closure was achieved in the continental-drift discussion. The controversy had found its usual explanation under rationalist terms: Wegener’s 1912 continental-drift theory was accepted 50 years later only after the plate tectonic theory had provided more evidence or a more in-depth problem-solving capacity. Nevertheless, a re-examination of the controversy under constructivist terms argued (...) that closure was achieved by a change in the style of thought. This analysis prompted some authors to react calling to a ‘defence of rationalism’ and insisting on explaining that the continental-drift theory was only accepted because of epistemic reasons. As the debate impacts on the way to explain scientific controversies, in this article I analyze rationalist and constructivist approaches with respect to ways to explain the social acceptance or rejection of a theory. The analytical perspectives will be contextualized within a broader theoretical discussion in philosophy and social sciences about the role of different factors that condition knowledge, which will also include an empirical approximation in the analysis of GMO and continental-drift controversies. Ultimately, the debate with rationalism is situated in a broader context about the ways of explaining the social acceptance of a theory, arguing that the problem with the rationalism that confuses a purely logical explanation with a sociological one is that it tends to judge rather than understand. We propose that the Letter be a legal argument. Descartes has no interest in theological virtues: facing irrationality, he delves into private law to prove that Voetius is not a true teacher, or a true pastor, and encroaches on the function of judge. "excepción a la metafísica" instaurada por el conocimiento de mi cuerpo (c); se arriesga, siguiendo una indicación del autor, la apertura a una dimensión ética que exige examinar ya no la unión de cuerpo y alma, sino la unión por el amor a un semejante y a la comunidad de semejantes (d). -/- The article carries out a critical examination of J.-L. Marion's latest work, "Sur la pensée passive de Descartes", whose main thesis is that the problems posed by the union of body and soul confuse two terms: body and my body. This confusion leads to the application to the former of categories inherent to the latter. The paper examines the "ontic paradoxes" that my body (the flesh) gives rise to (a); it clarifies the thesis of two interpretations of the First and Sixth Meditations (b); it discusses the "exception to metaphysics" established by the knowledge of my body (c); and, following an indication by the author, it proposes an opening to the ethical dimension, which demands an examination of the union, through love, with a fellow human being and with the community of human beings, rather than of the union of body and soul (d). -/- Neste artigo, propõe-se um exame crítico da última obra de J.-L. The problems and issues arising from globalization are difficult to resolve, in part because our ways of conceptualizing the conflicts and responding to them are inadequate. This book fills this gap, conceiving of globalization as a consequence of economic, political, technological, scientific, and cultural changes. A. Pablo Iannone provides a taxonomy of globalization processes, investigates the consequences of each, and formulates a comprehensive approach for dealing with them. He explores the environmental and social challenges associated with current Amazonian development and its significance to weather patterns on Earth. He considers the issues surrounding the use of robots in war from Pakistan through Mexico, and the militarization of space. Este artículo tiene por objetivo general indagar acerca de los procesos de institucionalización de una nueva disciplina científica. En particular, se analizan los desplazamientos que se producen entre disciplinas al emerger una nueva: la biología molecular. Se presenta en este artículo el caso del Instituto Nacional de Tecnología Agropecuaria (INTA) de Argentina, institución creada en 1956 para realizar investigaciones, innovaciones y extensionismo para el sector agropecuario. De esa manera, el trabajo presenta los cambios en las disciplinas de las que provienen (...) los investigadores del INTA, desde su creación en 1956 hasta 2010. La investigación que se presenta se centra en un análisis cuantitativo en relación a las disciplinas de origen de los investigadores que se incorporaron a la institución. Al mostrar los desplazamientos entre disciplinas, este artículo pretende contribuir al estudio sobre los conflictos entre las mismas. Pues se sugiere que la emergencia de una nueva disciplina no implica solamente la apertura de nuevas profesiones, instituciones, temas y técnicas de investigación, sino también el desplazamiento de otras anteriormente instaladas, y que tales desplazamientos estarían en la raíz de las tensiones que se registran en la institucionalización de una nueva disciplina. This article aims to investigate the process of institutionalization of a new scientific discipline. In particular, the displacements that occur between disciplines with the emergence of a new one: molecular biology. The case presented in this article is the National Institute of Agricultural Technology (INTA) of Argentina, institution created in 1956 for research, innovation and extension to the agricultural sector. Thus, the paper presents the changes in the disciplines from which INTA's researchers come, since its inception in 1956 until 2010. The research presented in this article focuses on a quantitative analysis in relation to the disciplines of origin of the researchers who joined the institution. By showing the displacements between disciplines, this article aims to contribute to the study of the conflicts between them. For it suggests that the emergence of a new discipline involves not only the opening of new professions, institutions, research subjects and techniques, but also the displacement of other previously installed. These displacements would be at the root of the tensions that occur in the institutionalization of a new discipline. (shrink)

We say that a sentence A is a permissive consequence of a set X of premises whenever, if all the premises of X hold up to some standard, then A holds to some weaker standard. In this paper, we focus on a three-valued version of this notion, which we call strict-to-tolerant consequence, and discuss its fruitfulness toward a unified treatment of the paradoxes of vagueness and self-referential truth. For vagueness, st-consequence supports the principle of tolerance; for truth, it supports the (...) requisite of transparency. Permissive consequence is non-transitive, however, but this feature is argued to be an essential component to the understanding of paradoxical reasoning in cases involving vagueness or self-reference. This text proposes an interpretation of the work of Franklin Leopoldo e Silva based on the reading of some of his numerous published articles and books, without neglecting the classes and guidance received from the stage of Scientific Initiation to Postdoctoral studies. Precisely, by highlighting the importance of three thinkers widely studied by Professor Franklin – Berkeley, Bergson and William James –, we suggest that at the heart of this philosophical experience there would be a constant: empiricism. Michel Janssen and Harvey Brown have driven a prominent recent debate concerning the direction of an alleged arrow of explanation between Minkowski spacetime and Lorentz invariance of dynamical laws in special relativity. In this article, I critically assess this controversy with the aim of clarifying the explanatory foundations of the theory. First, I show that two assumptions shared by the parties—that the dispute is independent of issues concerning spacetime ontology, and that there is an urgent need for a constructive interpretation (...) of special relativity—are problematic and negatively affect the debate. Second, I argue that the whole discussion relies on a misleading conception of the link between Minkowski spacetime structure and Lorentz invari-ance, a misconception that in turn sheds more shadows than light on our understand-ing of the explanatory nature and power of Einstein’s theory. I state that the arrow connecting Lorentz invariance and Minkowski spacetime is not explanatory and uni-directional, but analytic and bidirectional, and that this analytic arrow grounds the chronogeometric explanations of physical phenomena that special relativity offers. When we speak about different interpretations of quantum mechanics it is suggested that there is one single quantum theory that can be interpreted in different ways. However, after an explicit characterization of what it is to interpret quantum mechanics, the right diagnosis is that we have a case of predictively equivalent rival theories. I extract some lessons regarding the resulting underdetermination of theory choice. Issues about theoretical identity, theoretical and methodological pluralism, and the prospects for a realist stance towards quantum (...) theory can be properly addressed once we recognize that interpretations of quantum mechanics are rival theories. According to a popular narrative, in 1932 von Neumann introduced a theorem that intended to be a proof of the impossibility of hidden variables in quantum mechanics. However, the narrative goes, Bell later spotted a flaw that allegedly shows its irrelevance. Bell’s widely accepted criticism has been challenged by Bub and Dieks: they claim that the proof shows that viable hidden variables theories cannot be theories in Hilbert space. Bub’s and Dieks’ reassessment has been in turn challenged by Mermin and (...) Schack. Hereby I critically assess their reply, with the aim of bringing further clarification concerning the meaning, scope and relevance of von Neumann’s theorem. I show that despite Mermin and Schack’s response, Bub’s and Dieks’ reassessment is quite correct, and that this reading gets strongly reinforced when we carefully consider the connection between von Neumann’s proof and Gleason’s theorem. In 1991 Larry Laudan and Jarret Leplin proposed a solution for the problem of empirical equivalence and the empirical underdetermination that is often thought to result from it. In this paper we argue that, even though Laudan and Leplin’s reasoning is essentially correct, their solution should be accurately assessed in order to appreciate its nature and scope. Indeed, Laudan and Leplin’s analysis does not succeed in completely removing the problem or, as they put it, in refuting the thesis of underdetermination (...) as a consequence of empirical equivalence. Instead, what they show is merely that science possesses tools that may eventually lead out of an underdetermination impasse. We apply their argument to a real case of two empirically equivalent theories: Lorentz’s ether theory and Einstein’s special relativity. This example illustrates the validity of Laudan and Leplin’s reasoning, but also shows the importance of the reassessment we argue for. (shrink)

It is a widespread belief that the Kochen-Specker theorem imposes a contextuality constraint on the ontology of beables in quantum hidden variables theories. On the other hand, after Bell’s influential critique, the importance of von Neumann’s wrongly called ‘impossibility proof’ has been severely questioned. However, Max Jammer, Jeffrey Bub and Dennis Dieks have proposed insightful reassessments of von Neumann’s theorem: what it really shows is that hidden variables theories cannot represent their beables by means of Hermitian operators in Hilbert space. Hereby I show that i) the very same constraint can be derived from Gleason’s theorem, and that ii) if we consider the import of von Neumann’s and Gleason’s theorems, the relevance of the Kochen-Specker theorem for hidden variables theories gets substantially weakened: it does not force them to be contextual in any interesting sense of the term. To what degree can language be acquired from linguistic input alone? This question has vexed scholars for millennia and is still a major focus of debate in the cognitive science of language. The complexity of human language has hampered progress because studies of language–especially those involving computational modeling–have only been able to deal with small fragments of our linguistic skills. We suggest that the most recent generation of Large Language Models (LLMs) might finally provide the computational tools to determine empirically (...) how much of the human language ability can be acquired from linguistic experience. LLMs are sophisticated deep learning architectures trained on vast amounts of natural language data, enabling them to perform an impressive range of linguistic tasks. We argue that, despite their clear semantic and pragmatic limitations, LLMs have already demonstrated that human-like grammatical language can be acquired without the need for a built-in grammar. Thus, while there is still much to learn about how humans acquire and use language, LLMs provide full-fledged computational models for cognitive scientists to empirically evaluate just how far statistical learning might take us in explaining the full complexity of human language. In this paper I argue that the case of Einstein׳s special relativity vs. Hendrik Lorentz׳s ether theory can be decided in terms of empirical evidence, in spite of the predictive equivalence between the theories. In the historical and philosophical literature this case has been typically addressed focusing on non-empirical features. I claim that non-empirical features are not enough to provide a fully objective and uniquely determined choice in instances of empirical equivalence. However, I argue that if we consider arguments proposed (...) by Richard Boyd, and by Larry Laudan and Jarret Leplin, a choice based on non-entailed empirical evidence favoring Einstein׳s theory can be made. Human dignity: social movements invoke it, several national constitutions enshrine it, and it features prominently in international human rights documents. But what is it, why is it important, and what is its relationship to human rights and social justice? Pablo Gilabert offers a systematic defence of the view that human dignity is the moral heart of justice. In Human Dignity and Human Rights (OUP 2019), he advanced an account of human dignity for the context of human rights discourse, which (...) covers the most urgent, basic claims of dignity. This book extends the dignitarian approach to more ambitious claims of maximal dignity of the kind encoded in democratic socialist conceptions of social justice. In particular, this book focuses on the just organization of working practices. It recasts in a dignitarian format the critique of capitalist society as involving exploitation, alienation, and domination of workers, and revamps a neglected but inspiring socialist principle. In its dignitarian interpretation, the Abilities/Needs Principle (‘From each according to their ability, to each according to their needs!’) yields reasonable and feasible requirements on social cooperation geared to empowering each human being to lead a flourishing life. While Human Dignity and Human Rights offered the first systematic philosophical account of human dignity in human rights discourse, Human Dignity and Social Justice presents the first systematic application of the dignitarian framework to the core ideals of democratic socialism.
