In some cases, they will be similar to bills before the 107th Congress (see Table 1). Bills in both the House of Representatives and the Senate address the establishment and (...) maintenance of donor registries, financial reimbursements for medical and nonmedical expenses incurred by qualifying donors, the presentation of commemorative medals, and tax credits.A bill entitled "Gift of Life Congressional Medal Act" (introduced last year by Senate majority leader Bill Frist (R-TN) as Senate Bill 325), and its corresponding bill of the same title (passed in the House of Representatives last year as H.R. 708), would establish a congressional commemorative medal honoring "any organ donor, or the family or family member of any organ donor." The medal is to be designed and struck with "suitable emblems, devices, and inscriptions" by the Secretary of the Treasury. The eligible donor or donor's family member would be presented with the medal by the Secretary of Health and Human Services. This bill would establish qualifying donations as those of human kidneys, livers, hearts, lungs, pancreases, or any other organ, but excludes corneas and eyes.Another bill, introduced by Representative Michael Bilirakis (R-FL) entitled "Organ Donation Improvement Act" (H.R. 624), would award grants or contracts to states, transplant centers, and qualified organ procurement organizations for the purpose of providing travel, subsistence, and incidental nonmedical expenses to individuals who make living donations. The "Help Organ Procurement Expand Act" prohibits donations from individuals who were killed with physician assistance, died as a result of a suicide, have been indicted or convicted of a felony or a misdemeanor offense, or are actively under criminal investigation for a possible felony offense. The "Help Organ Procurement Expand Act" also restricts procuring organs from unborn children or human fetuses and under circumstances in which the living donor would be subject to "unacceptable levels of medical risk of death or permanent debilitation." The ArgumentThis paper is about the context of Albert Einstein's concerns at the time of a most intense intellectual effort — his own and that of a small group of scientists concerned with classical quantum theory. I describe contemporaneous interactions and differing views about the prospects for and the significance of the First Solvay Congress of 1911 as voiced by major participants. There are two axes around which the paper evolves: the Einstein-Nernst-Lorentz dialogue and the public institutional creation of the (...) “Solvay” stage. In certain ways, this paper is about personal and institutional patronage: the working out of a difficult theoretical impasse requires individual and collective moral support. It is about the forging of the identity of a scientific problem and the personal and institutional setting, the public space, in which this problem was collectively addressed. But I also uncover heuristic playfulness and flexibility which accompanies theoretical change. (shrink)

For Howard Gardner, Multiple Intelligences Theory (MI) constitutes “a new understanding of human nature,” on a par with those proffered by Socrates and Freud. While the educational community in general has responded enthusiastically to MI, because it enables them to deal with students more holistically, MI embeds a significant dualism that is detrimental to truly holistic education. I will argue that: values are pervasive; intelligence requires the exercise of judgment, which no computational system can emulate; domains in which intelligence functions (...) are contested, as much as in the realm of “values,” judgments about “values” are “intelligent” in seeking to determine what conditions will promote flourishing, and the more appropriate distinction to draw is not between two structural domains of “empirical fact” and “subjective value,” but between structural conditions and directional responses to these conditions. The value and importance accorded to personal autonomy within liberalism would seem to suggest that cultural practices that severely constrain the choices of individuals through heavyhanded role socialization and restriction ought to be strongly discouraged in liberal societies. In this paper, I explore this claim in connection with the custom of arranged marriage, which has recently come under fire in some liberal democratic states, notably Britain. My aim is to try to complicate the liberal understanding of the relationship between cultural (...) traditions and personal autonomy. In the course of this discussion, I analyze and offer some criticisms of autonomy as a substantive ideal and requirement for flourishing. In revisiting and evaluating arguments in favor of a thick or substantive ideal of autonomy criticisms, I hope to show that a substantive ideal of autonomy as independence is culturally bounded in ways that are often overlooked by liberal philosophers. Charles James William Pfoundes (1840?1907), a young emigrant from Southeast Ireland, spent most of his adult life in Japan, received a Japanese name ?Omoie Tetzunostzuke?, first embraced and then turned against Theosophy and, from 1893, was ordained in several Japanese Buddhist traditions. Lacking independent means but educated, intellectually curious, entrepreneurial, fluent in Japanese and with a keen interest in Asian culture, Pfoundes subsisted as a cultural intermediary, explaining Japan and Asia to both Japanese and foreign audiences and actively seeking involvement (...) in global expositions and congresses, in Asia and beyond. Drawing on a previously unstudied collection of Pfoundes' personal documents, this paper first outlines Pfoundes' unusual career and then focuses on his engagement, in the last 15 years of his life, in actual or proposed international congresses and expositions in London, Chicago, Japan, Hanoi, St Louis and Oregon. The paper thereby draws attention, through the forgotten figure of Charles Pfoundes, to the distinctive nineteenth century phenomenon of great international expositions and their associated congresses, viewing these complicated events as another kind of crossroads; innovative nodes and material stimuli to the kinds of travel, cultural communication and interaction which, like monastic, trade, political and ethnic networks, helped to exchange and promote modern representations of Buddhism. ROBERT CAPONIGRI THE HUMANISMOf Giovanni Gentile has gradually come to be recognized as one of the major speculative achievements of our time. The great strength and appeal of this position lie chiefly in the manner in which it meets the exigencies of the modem analysis of man and human existence while retaining the basic classical insights of (...) western thought. It achieves a synthesis which possesses at once historical, speculative, and cultural value and which rectifies many of the unilateral analyses so much in evidence. At the same time, serious limitations have been alleged to mar the Gentilean view of man. The most important of these allegations concerns the notion most intimately associated with the humanism of the west: the person. Strangely, it has been charged that the humanism of Gentile not only fails to develop an adequate concept of the person but directly involves the diminution and constriction of this concept as it has developed historically and influenced the western view of man. His, it is asserted, is a humanism without the person, which is but a small remove from the paradoxical assertion that it is a humanism without man? In many ways this charge is most perplexing. Were it correct, it would certainly have the limiting and constrictive effects his critics have pointed out. The real perplexity resides, however, not in spelling out the probable consequences of the allegation, but in determining how it might ever have arisen and gained such credence and championship. The fact is that nothing could be further from Gentile's intention and (what is more important) more alien to the burden of his text than the least diminution of the person. This public basis was the achievement of western philosophy which his analysis had recognized as solid and beyond cavil. This achievement, he reasoned, must constitute the point of departure of any further relevant speculation. Gentile took the philosophical position of Hegel as representing this indubitable achievement of western thought in its most salient features. The revival of interest in Aristotle’s philosophy restores his status as a teacher and renounces the perception of Aristotle as an opponent. The World Congress “Philosophy of Aristotle”, which took place on July 9—15, 2016 in Greece, marks an important step in this (...) process. On bearing the mind God's mark in its memory, it will wish for happiness. On bearing God's mark in its intelligence, it will wish for Truth and on bearing God's mark in its will it will wish for the Good since the desire for happiness is a wish or (...) remembrance of God, the desire for Truth is a wish of God because He is the Truth, and the desire of Good and Beauty is a wish of God because He is the highest Good and the supreme Beauty. Human being's strongest motivations: happiness, truth, good and beauty, they all just come from being a person, from being the brightest bearer of the Trinitarian image which, on leaving its mark on him, at the same time marks the direction of his deepest desire. The anchorage of those metaphysical desires of man is in God and they can be thought of as anthropological universals. (shrink)

In Soi-meme comme autre Ricoeur defines personal identity as singularity, this being the manner in which each individual structures a deposit of common experiences and ways of being-in-the-world in a space-time, and as such as a personalized manner of responding to the challenges of circumstances. For what is common and shared, the other is an alter ego. Identity is a holon that can't be divided into atoms, as the puzzle cases and Musil's L'Homme sans qualites seek to do. Ricoeur divides (...) identity into sameness and ipseity. Sameness designates a cumulative center of experiences; ipseity designates the other of oneself, i.e. the historical and changing quality of sameness. With the theories of Bremont and Greimas, Ricoeuer finds in literary narration the best examples of the dialectic between sameness and ipseity. In adddition he considers, with Mclntyre, that it is the best medium for formulating ethical judgments on the basis of discrete experiences. (shrink)

About the Book: - Brahman and Person is a collection of essays by the late Richard De Smet (1916-1997) on the topic of person in Indian thought. Overturning the current interpretation, De Smet proposes that the nirguna Brahman can be regarded as properly personal, provided person is understood in the original and classical sense that emerged in the Christian effort to speak abut the mysteries of the Trinity and the Incarnation. The Rendering of saguna and nirguna Brahman as personal and (...) impersonal, instead originated with the Western translators of Sanskrit works, who were influenced by an individualistic idea of the person and the consequent restriction of its application to the human being. De Smet also dedicated attention to the question of the human person in Indian and Western thought over a number of essays, proposing that a properly holistic and organic notion of the human person can be found especially n the thought of sankara. This collection of essays by an eminent Indologist constitutes and important contribution not only to Indological studies but also to cross cultural and interreligious dialogue. About the Author:- Richard De Smet taught Indian Philosophy at Jnana Deepa Vidyapeeth, Pune. Born in Belgium in 1916, he joined the Jesuits in 1934 and came to India in 1946. He earned a Ph.D. in 1953 from the Gregorian University, Rome, for his thesis on the theological method of Sankara, proposing both that sankara was srutivanadin, and that he used the method of analogy in his interpretation of the Upanisadic mahavakyas. De Smet was a life member of the Indian Philosophical Congress and the Indian Philosophical Association and Founder-President of the Association of Christian Philosophers of India and in these capacities carried out an ongoing dialogue with Indian philosophers and religious personalities. He died in 1997. Ivo Coelho is Reader in Gnoseology and Metaphysics at Divyadaan: Salesian Institute of Philosophy, Nashik, and editor of Dvyadaan: Journal of Philosophy and Education Born in 1958 at Mumbai, he studied under De Smet at Pune, and went on to specialize in the hermeneutical thought of the Canadian Philosopher theologian and economist Bernard Lonergan. He is interested in issues of cross-cultural and interreligious understanding, dialogue and collaboration. The Foucaultian sociologist Nikolas Rose has influentially argued that psychosocial technologies have offered means through which the ideals of democracy can be made congruent with the management of social life and the government of citizens in modern western liberal democracies. This interpretation is contested here through an examination of the 1948 International Congress on Mental Health held in London and the mental hygiene movement that organized it. It is argued that, in Britain, this movement’s theory and practice represents an uneasy (...) and ambiguous attempt to reconcile visions of ‘the modern’ with ‘the traditional’. The mental hygienist emphasis on the family is central. Here it appears as a forcing-house of the modern self-sustaining individual. Mental hygienists cast the social organization of ‘traditional’ communities as static, with rigid authority frustrating both social progress and the full emergence of individual personality. Yet mental hygienists were also concerned about threats to social cohesion and secure personhood under modernity. If the social organization of ‘traditional’ communities was patterned by the archetype of the family, with its personal relations of authority, mental hygienists compressed these relations into the ‘private’ family. Situated here they became part of a developmental process of mental adjustment through which ‘mature’, responsible citizens emerged. This reformulation of the family’s centrality for the social order informed mental hygienist critiques of the growth of state power under existing forms of democracy, as well as suspicion of popular political participation or protest, and of movements towards greater egalitarianism. A person raised in a religious family may have been taught that going (...) to the theater is wrong, and even if she has rejected this taboo years ago, she may still feel guilty when attending theater. At least, this seems to be the case. If it is the case, then one must explain how it is possible that a person may feel guilty without believing that she is guilty, i.e. that (1) she is responsible for the act and that (2) the act is wrong or has moral costs. Suppose, however, that it is not possible to feel guilty while believing that one is not guilty. Then one must explain why it seems that sometimes—in taboo cases—one can feel that she is guilty and at the same time believe that she is not guilty. Both Aquinas and Siger were familiar with a fundamental disagreement within the earlier philosophical tradition concerning the subject of metaphysics: Is it being as being, or is it divine being? If Avicenna represented one approach to this issue, and Averroes another, both Thomas and Siger were closer to Avicenna than to Averroes in their respective solutions. Nonetheless, each resolved the issue in a distinct way. Also contested in the earlier tradition was the question of whether it belongs to physics or (...) to metaphysics to demonstrate the existence of God. Again, Avicenna represents one side on this issue, and Averroes the other. Thomas’s personal position continues to be debated by contemporary scholars, and Siger’s seems to fall between those proposed by Avicenna and Averroes. Finally, Aquinas is credited with having developed a new and unique way of accounting for the discovery of being as being, through a process known as separatio; though there are antecedents for this in Avicenna. First, I argue that we should take reductive materialism and the Lockean view of personal identity seriously. But, these positions appear in tension. The main ideas in this paper can be summarized in the following three points. (1) Openness, indeterminacy, and exemplarity are elements of both Kant's aesthetics and Wittgenstein's notion of language games. (2) These elements are essential to what makes a person. They are necessary in processes of decision-making and in the development of a person. (3) Such aspects were in the center of discussion during the eighteenth and nineteenth centuries in Europe, especially in the tradition of the so-called Bildungsroman. The price of sequencing all the DNA in a person's genome is falling so fast that, according to one biotech leader, soon it won't cost much more than flushing a toilet. Getting all that genomic data at an ever‐lower cost excites the imaginations not only of biotech investors and researchers but also of the President and many members of Congress. They envision the data ushering in an age of “personalized medicine,” where medical care is tailored to persons’ genomes. The new (...) name “precision medicine” should not distract us from the fact that the genomic information it depends on is more complex, uncertain, and ambiguous than anyone had hoped, nor should it distract us from an important ethical point. Unfortunately, several developments of the last fifteen years suggest that, in our excitement about the technological capacity to gather genomic data at an ever lower cost, we are drifting away from what has long been a basic ethical commitment: to offer persons a process that enables them to provide informed consent before they or anyone else accesses their genetic information. The title of this congress begins with the word “identity”. It also includes the word “reciprocity,” which indicates a form of relationship and finally, “gift of self”. This would lead us to conclude that the identity of the human person has something to do with reciprocity and that reciprocity involves giving of oneself to others. This talk will attempt to shed light on how the concept of gender might in some way be incorporated into these three concepts. Defining what constitutes (...) the identity of the human person has been explored, and attempts to define it have been made by every major theorist in the field of psychology. At a previous Psychology and Communion congress one of the talks spoke of loving and being loved in return as the basic foundation of human identity. In that presentation we find the following observation: “The identity of the human person can be compared to the identity of a book: we know where and when it was printed; but the author is certainly not the publishing house, nor is the typesetter who prepared the text…The same is true for us human beings: we know the time and date of birth. But who is author?”. We ask ourselves, therefore: what lies at the core of the identity of this being who is born at a certain time on a certain date? Before proceeding, I think it is important to note that the basic idea regarding the identity of the human person, as we have defined and understood it from the inception of psychology and communion and explored in previous encounters, remains unchanged. I will use a quote of Chiara Lubich here that perhaps many of you know but which can serve the purpose of laying the foundation for what follows: Human beings are “ all equal but distinct. To each person [God] gave his own beauty so that they would be desirable and lovable by others; and so that in love they would be recomposed into the One who had created them with his Light, which is Himself.” Now we ask ourselves: What exactly is this “beauty” that Chiara is speaking of? What are the components, if you will, of our identity that makes us “… desirable and lovable by others…”? (shrink)

We consider that the research conducted on the totalitarian phenomenon has still remained a challenge for political philosophy and social sciences, even though most of the totalitarian regimes are now a matter of the past. However, its consequences and the threat of its reinvigoration have remained as well. Under the circumstances, the theoretical instruments that make possible an effective euristic approach of the phenomenon are particularly important. Among these instruments, the totalitarian personality concept occupies a foreground place. What we (...) advance is a new perspective upon this concept. We believe that thetotalitarian personality can be and must be regarded as a by-product of totalitarianism, not solely as one of its prerequisites. We can and we must give emphasis to the totalitarian imprint upon personality, upon the more or less profound transformations undergone by the personality of those who lived through the totalitarian experience. Today the connection between "person" and the "I" is acknowledged in many respects but not always analyzed. The need to relate it to the reality of the human being has sparked the present investigation of the philosophical anthropology of four thinkers from the late ancient, medieval, and contemporary periods. Although it may seem that the question of the role of the "I" with respect to the human being hinges on the larger problem of objectivity v. subjectivity, this does not seem (...) to be the case. Many topics, however, are necessarily entailed in this investigation such as individuality and universality, soul and body, consciousness and action, substance and history, the self and the other, the metaphysical and the phenomenological, and experience and the ethical. At the end of this study we arrive at more than a grammatical use of the "I." From reflection on the contributions of Plotinus, Augustine, Aquinas, and Wojtyla, the ontological role of the "I" is identified. In doing so, one realizes that the ontological does not forsake the concrete, but penetrates it more deeply. Indeed, that was what Plotinian philosophy claimed to be doing: recognizing the richness of human reality. (shrink)

In 2000, the United States Congress passed the Victims of Trafficking and Violence Protection Act requiring its State Department to issue annual Trafficking in Persons Reports (TIP Reports) describing “the nature and extent of severe forms of trafficking in persons” and assessing governmental efforts across the world to combat such trafficking against criteria established by US law. This article examines the opportunities and risks presented by the TIP Reports, tracing their evolution over the past decade and considering their impact on (...) the behavior of states. In looking to the future, the article focuses on how this influential unilateral compliance mechanism could improve its legitimacy, respond to negative impacts, and better contribute to the international legal regime around trafficking. The problem of person’s social formation becomes especialy actual in all its aspects during the periods of social historical transformations. The guiding lines of individual’s development accepted by society (socialization norms) are either lacking or being overthrown. Such situation demands from the researchers to switch their attention from the mechanisms of sociality reproduction to the mechanisms responsible for the sociality formation. The last ones become the main subject of the self-organization theory (synergetics). According to it, socialization can be represented as (...) the self-organizing system-process. The attempt to use the principle of unlinearity in the research of social formation of personality, is undertaken in the present article. (shrink)

The creation of social conditions addresses the vital importance for the individual development of global responsibility. The historical and socio-philosophical approaches are used to reveal the regulation of development of global responsibility on the individual level and the level of civilization. In order for the philosophy of history to be a really necessary methodological science in relation to theoretical and epistemological problems of history, it is quite necessary to get away from the practice of general discourse and from attempts to find universal solutions suitable for all times. On the contrary, it is desirable to focus on a search for principles and for methods of applying them to the problems of different levels, which, by no means predetermining the results of concrete (...) research, would play the role of a convenient and capacious form of concentration of materials; an effective tool of cognition; and a "compass" preserving a scientists efforts in search of a true solution. For this it is necessary while building up theories, first, to try to combine distinct partially true approaches; secondly, to define clearly the boundaries of applicability of arguments; and thirdly, to formulate laws not in the form of absolute conclusions but according to the rules admitted in other sciences. The possibility of realizing these goals is illustrated by the example of the present theme, "on the role of personality in history," wherein the author introduces the notion of a "factor of a situation," which makes it possible to unify various points correlating personality roles and diverse states of society, and gives the typology of "roles," personalities, etc. (shrink)
