BackgroundDecision-making in initiating life-sustaining health technology is complex and often conducted at time-critical junctures in clinical care. Many of these decisions have profound, often irreversible, consequences for the child and family, as well as potential benefits for functioning, health and quality of life. Yet little is known about what influences these decisions. A systematic review of reasoning identified the range of reasons clinicians give in the literature when initiating technology dependence in a child, and as a result helps determine the (...) range of influences on these decisions.MethodsMedline, EMBASE, CINAHL, PsychINFO, Web of Science, ASSIA and Global Health Library databases were searched to identify all reasons given for the initiation of technology dependence in a child. Each reason was coded as a broad and narrow reason type, and whether it supported or rejected technology dependence.Results53 relevant papers were retained from 1604 publications, containing 116 broad reason types and 383 narrow reason types. These were grouped into broad thematic categories: clinical factors, quality of life factors, moral imperatives and duty and personal values; and whether they supported, rejected or described the initiation of technology dependence. The majority were conceptual or discussion papers, less than a third were empirical studies. Most discussed neonates and focused on end-of-life care.ConclusionsThere is a lack of empirical studies on this topic, scant knowledge about the experience of older children and their families in particular; and little written on choices made outside ‘end-of-life’ care. This review provides a sound basis for empirical research into the important influences on a child’s potential technology dependence. (shrink)

Background There is considerable variation in the functionality of bioethical services in different institutions and countries for children in hospital, despite new challenges due to increasing technology supports for children with serious illness and medical complexity. We aimed to understand how bioethics services address bioethical concerns that are increasingly encountered in paediatric intensive care. Methods A qualitative descriptive design was used to describe clinician’s perspectives on the functionality of clinical bioethics services for paediatric intensive care units. Clinicians who were members (...) of formal or informal clinical bioethics groups, or who were closely involved with the process of working through ethically challenging decisions, were interviewed. Interviews took place online. Resulting transcripts were analysed using thematic analysis. Results From 33 interviews, we identified four themes that described the functionality of bioethics services when a child requires technology to sustain life: striving for consensus; the importance of guidelines; a structure that facilitates a time-sensitive and relevant response; and strong leadership and teamwork. Conclusions Clinical bioethics services have the potential to expand their role due to the challenges brought by advancing medical technology and the increasing options it brings for treatment. Further work is needed to identify where and how bioethics services can evolve and adapt to fully address the needs of the decision-makers in PICU. (shrink)

In this Chapter, Maria Kronfeldner discusses whether psychological essentialism is a necessary part of dehumanization. This involves different elements of essentialism, and a narrow and a broad way of conceptualizing psychological essentialism, the first akin to natural kind thinking, the second based on entitativity. She first presents authors that have connected essentialism with dehumanization. She then introduces the error theory of psychological essentialism regarding the category of the human, and distinguishes different elements of psychological essentialism. On that basis, Kronfeldner (...) connects historical, socio-psychological, and philosophical insights in order to show that although essentialism can act as a catalyst for dehumanization, it is not necessary for it. Examples relate to dehumanization in the context of colonialism and evolutionary thinking, to the history of dehumanizing women from Aristotle to 19th-century craniology, and to contemporary self-dehumanization and ‘lesser mind’ attribution. Spectroscopy is a scientific topic at the interface between Chemistry and Physics, which is taught at high school level in relation with its fundamental applications in Analytical Chemistry. In the first part of the paper, the topic of spectroscopy is analyzed having in mind the well-known Johnstone’s triangle of chemistry education, putting in evidence the way spectroscopy is usually taught at the three levels of chemical knowledge: macroscopic/phenomenological, sub-microscopic/molecular and symbolic ones. Among these three levels, following Johnstone’s recommendations the macroscopic (...) one is the most useful for high school students who learn spectroscopy for the first time. Starting from these premises, in the second part of the paper, we propose a didactic sequence which is inspired by the historical evolution of spectroscopic instruments from the first spectroscopes invented by Gustav Kirchhoff and Robert Bunsen in 1860 to the UV–vis spectrophotometers which became common since the 1960s. The idea behind our research is to analyze the conceptual advancements through the history of spectroscopy and to identify the key episodes/experiments and spectroscopic instruments. For each of them, a didactic activity, typically an experiment, is then proposed underlining the relevant aspects from the chemistry education point of view. The present paper is the occasion to reflect on the potentialities of an historical approach combined with a laboratorial one, and to discuss the role of historical instruments and related technological improvements to teach spectroscopy. In the literature, the pragmatic dimension of metaphors has been clearly acknowledged. Metaphors are regarded as having different possible uses, especially pursuing persuasion. However, an analysis of the specific conversational purposes that they can be aimed at achieving in a dialogue and their adequacy thereto is still missing. In this chapter, we will address this issue focusing on the classical distinction between the explanatory and persuasive uses of metaphors, which is, however, complex to draw at an analytical level and often (...) blurred and controversial also from a theoretical point of view. Building on the analysis of explanation in different theories and fields of study, we show how it can be conceived as characterized by a cognitive and a pragmatic dimension, where the transference of understanding is used pragmatically for different dialogical goals - such as informing, making a joint decision, and most importantly persuading. In this sense, the cognitive effects of understanding are not incompatible with a persuasive dialogical purpose. This theoretical proposal will be applied to examples drawn from the medical context, to show how a pragmatic approach to explanation can account for the complexity of the cases that can be found in actual dialogical contexts. This paper argues that the so-called ‘paradox’ of dehumanization is a mirage arising from misplaced abstraction. The alleged ‘paradox’ is taken as challenge that arises from a skeptical stance. After reviewing the history of that skeptical stance, it is reconstructed as an argument with two premises. With the help of an epistemologically structured but pluralistic frame it is then shown how the two premises of the Skeptic’s argument can both be debunked. As part of that it emerges that there are (...) a couple of ways how dehumanization can be realized, and one such realization can be sufficient for affirming the reality of dehumanization for a specific case. Probability as understood today, namely as a quantitative notion expressible by means of a function ranging in the interval between 0–1, took shape in the mid-17th century, and presents both a mathematical and a philosophical aspect. Of these two sides, the second is by far the most controversial, and fuels a heated debate, still ongoing. After a short historical sketch of the birth and developments of probability, its major interpretations are outlined, by referring to the work of their most prominent (...) representatives. This paper revisits Donnellan’s distinction between referential and attributive uses of definite descriptions and argues that it is not exhaustive. Donnellan characterizes the distinction in terms of two criteria: the speaker’s intentions and the type of content the speaker aims to express. I argue that contrary to the common view, these two criteria are independent and that the distinctive features may be coinstantiated in more than two ways. This leaves room for nonattributive and nonreferential uses of definite descriptions. Kripke’s notions (...) of general and specific intentions provide a framework that accommodates such cases. Additionally, it proves useful for the analysis of the use of proper names with specific nonsingular intentions. The paper also discusses how the interpretation of the use of definite descriptions as attributive or referential (or neither) is sensitive to which theory of singular thoughts one adopts. (shrink)

The diagnosis of idiopathic short stature refers to children who are considerably shorter than average without any identified medical reason. The US Food and Drug Administration authorised marketing of recombinant human growth hormone for ISS in 2003, while the European Medicines Agency refused it in 2007. This paper examines the arguments for these decisions as detailed in selected FDA and EMA documents. It combines argumentative analysis with an approach to policy analysis called ‘What’s the problem represented to be’. It argues (...) that the FDA presents its approval as an argument for equity of access to the treatment, describing short stature as a potential disadvantage, and assuming that height normalisation is a clinically meaningful result. The EMA, instead, refuses marketing authorisation with an argument that there is an imbalance of risks and benefits, describing ISS as a healthy condition, and arguing that hGH should provide some psychosocial and/or quality of life benefits to children with ISS other than height gain. This paper then discusses how these arguments could be read through different models of disability, particularly through the medical model of disability and the relational, experiential, and cultural understandings of disability. This paper deals with Claudia Card's important contributions to a theory of evil that steps out from traditional models of thinking about this problem (theodicies, metaphysical theories, etc.). Instead, our author seeks to explore important elements from other theorists (such as Kant and Nietzsche) in order to build up her ideas of what she calls the "atrocity paradigm." This critical essay focuses mainly in the spaces where Card's conclusions need to rethink the limits and constraints of her theory.

Pone énfasis en la relevancia de la accesibilidad, la desinstitucionalización y la asistencia personal como factores clave. Cuatro años después de la revisión de España por el Comitéde la Convención sobre los Derechos de las Personas con Discapacidad, se realiza un examen minucioso de las políticas y leyes implementadas por el gobierno español, desde una óptica de derechos humanos. My text is written to answer the questions asked at the APA Meeting's presentation of the book Moral Textures: Feminist Narratives in the Public Sphere by professors María Lugones and Eduardo Mendieta. The answer seeks to clarify that Lugones's infrapolitics position is not so distant from mine. I also address Mendieta's question directed more to the aesthetic domain. There, I seek to show how my position could be taken as a creative effort to extend some of Habermas's early work on (...) the public sphere, and to develop the thesis of the important relations between the aesthetic and the moral realms. Qual é o objeto da lógica? Seria a arte de bem conduzir o discurso? Mas conduzí-lo para onde, com que finalidade? Haveria uma normatividade independente, que definisse o racional independente do real? É Lacan que pergunta e nos responde no sem. XIX: “eu proponho definir o objeto da lógica como aquilo que produz a necessidade de um discurso. E afirmo que o simbólico, o imaginário e o real se afirmam nos impasses da lógica. ” (LACAN, 2011, p. 40). Muitos comentadores (...) encaram os recursos lógicos de Lacan como uma provocação, mas entendo que não, pois são muito coerentes com seus princípios, tanto lógicos, quanto linguísticos, antropológicos e principalmente matemáticos. The review examines the trilogy about time of VBV, which includes the poetic editions „Th:is.” (2000), “Will:” (2011) and “:was...” (2022), with the emphasis being the last volume, which appeared at the end of the past year. VBV's poetic texts are read through his ideas about “realliteratur” and the mediamarket “normalization” of modern culture, unfolded in a number of his theoretical observations. At the border between the poetic and the philosophical, at the point of coincidence and exchange between the two (...) projects of the VBV, a new toolkit appears for revising the status quo, both literary and political. The meta-poetic resource of VBV's “:was...”, as well as his trilogy as a whole, allows to see in a new and heuristic way the problems of performative societies at the height of the 21st century. This paper investigates the emotive (or expressive) meaning of words commonly referred to as “loaded” or “emotive,” which include slurs, derogative or pejorative words, and ethical terms. We claim that emotive meaning can be reinterpreted from a pragmatic and argumentative perspective, which can account for distinct aspects of ethical terms, including the possibility of being modified and its cancellability. Emotive meaning is explained as a defeasible and automatic or automatized evaluative and intended inference commonly associated with the use of specific (...) terms, which can be represented and assessed considering its logical structure and its defeasibility conditions. This automatic inference is conceived as part of the connotation of an ethical term, and is not necessarily stable. By means of quasi-definitions, it is possible to modify the emotive meaning while maintaining the descriptive one, automaticizing the inferences drawn from an ethical word. Through examples drawn from the recent US presidential campaign, we show how re-contextualization and emotive contexts can affect emotive meaning. (shrink)

The aim of this essay is to reclaim Kristeva's concept of the semiotic chora by re-inscribing it as an intervention in the context of two important postmodern debates. The first debate relates to the philosophical problem of “the beginning before the Beginning.” The second concerns the necessity and possibility of mediation between incommensurable entities: the “demonic” and the social, desire and the Law, material production and representation. I contend: that the introduction of the chora in RPL is part of Kristeva's (...) effort to restore the legacy of a materialist economy of the beginning, as this is glimpsed in Plato's Timaeus from which Kristeva borrows her controversial term; and that the chora constitutes an attempt on Kristeva's part to explore a third space of ambiguous relationality in the context of which our transcendence to the “demonic” lies less “beyond us” than “in-between.”. Numerosas expresiones lingüísticas son producidas por los profesionales de las áreas de la Educación y Psicología para designar al sujeto con discapacidad. Nuestra mirada se centró en los discursos que se balizan en un lenguaje analítico y heurístico perteneciente al universo de la normalidad de la razón analítica. En contra de esta propuesta dialogamos con Wittgenstein sobre producción de sentido y de Vygotsky sobre mediación semiótica. Palabras claves: producción de sentido; mediación semiótica, discapacidad, inclusión.

One reason for the popularity of Craver’s mutual manipulability account of constitutive relevance is that it seems to make good sense of the experimental practices and constitutive reasoning in the life sciences. Two recent papers propose a theoretical alternative to in light of several important conceptual objections. Their alternative approach, the no de-coupling account, conceives of constitution as a dependence relation that once postulated provides the best explanation of the impossibility of breaking the common cause coupling of a macro-level mechanism (...) and its micro-level components. This entails an abductive view of constitutive inference. Proponents of the NDC or abductive account recognize that their discussion leaves open a big question concerning the practical dimension of the notion of constitutive relevanssssce: Is it possible to faithfully reconstruct constitutional reasoning in science in terms of a failure to de-couple, via interlevel experiments, phenomena from their mechanistic constituents? Focusing on the field of memory and long-term potential research, this article argues that the abductive account provides a more adequate description of interlevel experiments in neuroscience. Na perspectiva da Psicologia Histórico-Cultural, o trabalho, exigência para que o homem sobreviva, lhe possibilita desenvolver-se, apropriar-se da cultura humana histórica e coletivamente elaborada, para atender às demandas que suas tarefas lhe impõem. Em um processo coletivo, por meio de sua inserção nas relações produtivas, ao aprender o que lhe é necessário para executar suas atividades, o homem se humaniza, e vai criando o que necessita e pode, para atender suas necessidades, o que permite afirmá-lo enquanto produto e produtor da (...) cultura, da ciência e da tecnologia. E essa é a função básica da escola, preparar o aluno para, na medida em que se humaniza, assumir um lugar, uma posição reconhecida socialmente. Nesse processo, o Trabalho Colaborativo/Ombreado entre os professores da Educação Especial, do ensino comum e da equipe pedagógica escolar, envolvendo confiança e credibilidade entre os pares, é essencial ao desenvolvimento psicointelectual dos estudantes com deficiência/necessidades educativas especiais. Para melhor caracterizar o Trabalho Colaborativo, apresenta-se o resultado de uma pesquisa efetuada na Biblioteca Digital de Teses e Dissertações na qual se buscou identificar suas características, limites e desafios. A essência do Trabalho Colaborativo entre os professores está numa relação de apoio, na qual todos assumem a responsabilidade no processo de aprendizagem dos conteúdos escolares, o que exige espaço e tempo para sua consecução, além de uma fundamentação teórica que articulada a uma prática pedagógica lhe dê consistência. Se executado dessa forma, o Trabalho Colaborativo/Ombreado caracteriza-se como essencial à inclusão escolar. Conclui-se que, para efetivá-lo, torna-se imperiosa a definição clara e consciente dos objetivos para a escolarização, pois há muita diversidade entre as especificidades da deficiência ou das necessidades educacionais especiais. No entanto, essa forma de atuação articulada encontra diferentes entraves que se constituem em seus limites e desafios exigindo vontade política para minimizá-los, permitindo sua organização adequada. Discutem-se esses desafios e apresenta-se um exemplo no qual, pelo trabalho colaborativo pôde-se estabelecer condições para que uma aluna que, pelo vestibular conquistou uma vaga no curso de Medicina mas adquiriu uma tetraplegia no decorrer do curso, pudesse terminar sua graduação. Pretendemos mostrar que, no Górgias, diálogo dedicado à crítica da retórica, as frequentes alusões de Sócrates à compleição do corpo, bem como o uso recorrente de metáforas corpóreas para referir-se ao que, por analogia, passa-se com a alma servem de ferramenta retórica para fazer frente à retórica de Górgias. Desse modo, ao mesmo tempo em que chamamos atenção para a maneira como Platão se vale das armas do adversário justamente para atacá-lo, ressaltamos o papel imprescindível do corpo como evidência da (...) alma na filosofia platônica. Com isto, nosso intuito é reforçar a vertente interpretativa segundo a qual Platão pode ser entendido mais como um pensador que parte dos problemas prementes de seu tempo para daí nos conduzir a reflexões filosóficas – no diálogo em questão, as consequências políticas de uma paidéia pautada numa retórica sofística –, do que como um filósofo comprometido apenas com uma metafísica transcendente. La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Es crucial que la regulación sea integral y adaptable para garantizar un sistema jurídico justo y equitativo en la era digital. (shrink)

El escrito continúa una discusión mantenida por Macarena Marey, María Julia Bertomeu y Nuria Sánchez Madrid en torno a la capacidad de los principios del republicanismo kantiano para transformar el espacio social en un ámbito en el que la autosuficiencia material constituya una de las condiciones fundamentales para que la igualdad formal ante la ley y la libertad política puedan actualizarse. En estas coordenadas se manifiestan también algunas discrepancias en lo concerniente a la percepción kantiana de las injusticias sociales y (...) políticas propias de su tiempo, si bien se alcanza el acuerdo de que el diseño institucional del republicanismo kantiano constituye un dispositivo conceptual suficiente para eliminar la desigualdad económica que comporta pasividad civil y política. While some countries are moving toward legalization, euthanasia is still criticized on various fronts. Most importantly, it is considered a violation of the medical ethics principle of non-maleficence, because it actively seeks a patient’s death. But, medical ethicists should consider an ethical alternative to euthanasia. In this article, we defend cryocide as one such alternative. Under this procedure, with the consent of terminally-ill patients, their clinical death is induced, in order to prevent the further advance of their brain’s deterioration. Their (...) body is then cryogenically preserved, in the hope that in the future, there will be a technology to reanimate it. This prospect is ethically distinct from euthanasia if a different criterion of death is assumed. In the information-theoretic criterion of death, a person is not considered dead when brain and cardiopulmonary functions cease, but rather, when information constituting psychology and memory is lost. Adults who stutter (AWS) have demonstrated atypical coordination of motor and sensory regions during speech production. Yet little is known of the speech-motor network in AWS in the brief time window preceding audible speech onset. The purpose of the current study was to characterize neural oscillations in the speech-motor network during preparation for and execution of overt speech production in AWS using magnetoencephalography (MEG). Twelve AWS and twelve age-matched controls were presented with 220 words, each word embedded in a carrier (...) phrase. Controls were presented with the same word list as their matched AWS participant. Neural oscillatory activity was localized using minimum-variance beamforming during two time periods of interest: speech preparation (prior to speech onset) and speech execution (following speech onset). Compared to controls, AWS showed stronger beta (15-25Hz) suppression in the speech preparation stage, followed by stronger beta synchronization in the bilateral mouth motor cortex. AWS also recruited the right mouth motor cortex significantly earlier in the speech preparation stage compared to controls. Exaggerated motor preparation is discussed in the context of reduced coordination in the speech-motor network of AWS. It is further proposed that exaggerated beta synchronization may reflect a more strongly inhibited motor system that requires a stronger beta suppression to disengage prior to speech initiation. These novel findings highlight critical differences in the speech-motor network of AWS that occur prior to speech onset and emphasize the need to investigate further the speech-motor assembly in the stuttering population. Our modern scientific explanation of colour as a subjective impression has replaced a ‘pre-theoretical’ notion of colour as an intrinsic property of objects, which was mainstream in ancient thought. Why have we lost such pre-theoretical notion, and what have we lost by losing it? I argue that most ancient Greek philosophers exploited this pre-theoretical assumption – one that was obvious to them – in terms and ways that are still worthy of attention in the context of contemporary philosophy of colour. I offer an in-depth analysis of the theories of a number of early Greek philosophers, as well as of Plato in the Timaeus, showing that they tend to share the idea that colour is an essential property of external bodies and therefore plays a causal role in perception. Then I focus on a comparison between Democritus’ stance and Aristotle’s in order to highlight a significant contrast between the two. Democritus' theory is an exception in ancient thought because it traces the colour phenomenon back to a refraction of atmospheric light through atomic aggregates. Aristotle, instead, posits the presence of colour and light in the bodies themselves. Finally, I interpret Aristotle's account as the most complex attempt in ancient thought to weld together what we call the ‘manifest image’ of colour and its ‘scientific image’. (shrink)

Este trabajo surge de un diálogo interdisciplinario entre dos tesis doctorales, una de educación y otra de filosofía, que comparten un interés sobre formas emancipadoras y democráticas de pensar con otros y otras en la escuela pública latinoamericana. Desde una perspectiva crítica propia de la filosofía de la educación latinoamericana realizamos un análisis epistemológico sobre las distintas formas de habitar la pregunta dentro de una práctica filosófica con niños y niñas. Tomamos como objeto de estudio una experiencia específica de comunidad (...) de indagación realizada en 2022 en el sur de Mendoza, Argentina. Entramamos herramientas teóricas de Walter Kohan, Paulo Freire y Jacques Rancière con la intención de visibilizar diversas formas de habitar la producción de saberes dentro de dicha comunidad. Proponemos dos nudos problemáticos: por un lado, el orden explicador/embrutecedor a partir de Rancière y, por el otro,la pregunta como afirmación vital a partir de Kohan y Freire. Trabajamos una serie de disonancias en torno a la circulación y a la potencia de la pregunta en la escuela y la educación pública. Finalmente proponemos una síntesis de estas problemáticas en la postulación de una “pregunta niña” como potencia epistémica emancipadora que supone una intimidad con los otros y otras, con las cosas y el mundo abierta desde una igualdad política e intelectual radical. In this paper, I aim at explaining the difference Kant makes between emotion, the beautiful and the sublime. I begin by explaining what an emotion is, showing that it refers to feelings that are related to desire. In contrast, I show that the feeling of beautiful and the sublime give us an inactive delight, that is not related to an interest in the object. The feeling of beautiful is related to the judgment of taste, and it has a universal validity (...) for everyone. I ask then if we can judge art without any emotion at all. According to Kant, not only one can, but one should, since pure judgment of taste is independent from charm and commotion. At the end, I ask if it is possible to enjoy music without emotion. For a lover of music, perhaps the emotion it provokes is the main reason to like it. I show that this is probably the reason why music is considered to have the last place in the beautiful arts for Kant. (shrink)

Nowadays, there is a quite considerable amount of literature on the use of analogy or more generally of inferences by parallel reasoning in contemporary legal reasoning and particularly so within Common Law. These studies are often motivated by research in artificial intelligence seeking to develop suitable software-support for legal reasoning. Recently, Rahman et al. developed a dialogical approach in the framework of Constructive Type Theory to what in Islamic Jurisprudence was called qiyās or correlational inferences. In their last chapter the (...) authors suggested that such an approach contributes to the study of patterns of reasoning by precedent cases within contemporary Common Law. In the present paper we will further motivate the deployment of the dialogical framework developed in Rahman et al. within Civil and Common Law. After a presentation of Scott Brewer’s take on analogy within Common Law, that has striking structural similarities to reasoning by precedent case rooted in ratio legis, we will illustrate the implementation of the framework with a brief discussion of some cases of legal reasoning based on Spanish Civil Law but where the accent is put in the emerging ruling rather than in the existing of a case in Common Law. Moreover, quite surprisingly, the case under study suggests that even cases of Law interpretation fit the argumentation pattern of qiyās al-‘illa. A caveat: in the present paper we will focus mainly in discussing the dynamics of the meaning constitution involved rather than in setting the rules of the underlying dialogical framework, the latter is the subject of a follow-up paper. This essay presents the early days of human cytogenetics, from the late 1950s until the mid 1970s, as a historical series of images. I propose a chronology moving from photographs of bodies to chromosome sets, to be joined by ultrasound images, which provided a return to bodies, by then focused on the unborn. Images carried ontological significance and, as I will argue, are principal characters in the history of human cytogenetics. Inspired by the historiography of heredity and genetics, studies on (...) visual cultures, the conceptualization of circulation, and the sociology of pregnancy, I suggest that cytogenetics, through its focus on pregnancy, pregnant women, and their offspring, found strategic living materials that stabilized human chromosome studies as a biomedical, post-eugenics practice. The historicity of each path displays a wide circulation of objects, tools, and methods that condensed on images that shared in the centuries-old visual expertise that medicine and botany had manufactured. The paper offers insights into the acceptability of ethical issues in poultry production and how this situation provides an opportunity to transform the prevailing system into a more sustainable one. The survey among German consumers reveals that killing day-old chicks is a well-known practice and is rated as “very problematic”. In contrast, dual-purpose chickens are mostly unknown but are considered a positive alternative to killing day-old chicks. Consumer clusters were identified regarding purchasing criteria for dual-purpose chickens, purchasing routines and socio-economic (...) factors. Three of the five clusters—the perfectionists, idealists, and realists—turned out to be potential buyers. To develop a suitable marketing strategy, it is recommended that the added value of dual-purpose chickens be comprehensibly communicated. From a multi-level perspective, rearing dual-purpose chickens has a competitive disadvantage compared to system-compliant alternatives. Through increasing external pressure, the different alternatives can jointly contribute to a regime shift. (shrink)

This study explores the intra-organizational antecedents of sustainable governance by examining the impact of female presence at the corporate apex. Drawing upon the upper echelon theory, we investigate whether women in top positions influence sustainable governance practices. Our research focuses on a sample of companies operating within two distinct market economies: liberal market economies (LMEs) and coordinated market economies (CMEs). The United States, represented by the S&P100, and the United Kingdom, represented by the FTSE100, serve as examples of LMEs. Conversely, (...) Germany (DAX30), France (CAC40), Spain (IBEX35), and Switzerland (SMI) are illustrative of CMEs. Analyzing archival data spanning from 2010 to 2019, we confirm that the presence of a critical mass of women on the board of directors significantly increases the likelihood of establishing a sustainability committee within organizations. This relationship holds true across both LMEs and CMEs, highlighting the universal importance of gender diversity in driving sustainable governance initiatives. Interestingly, we observe that the impact of women with structural power on sustainability committee formation is specific to LMEs, suggesting the context-dependent nature of female leadership in sustainable governance. Standard interpretations of Kant’s moral philosophy portray him as affording agents very little, if any, latitude to exercise practical judgment for determining the proper course of action. It is typically thought that Kant holds that because all moral duties are determinable a priori and in advance of particular circumstances this leaves little to no room for agents to exercise practical judgment. In this paper I discuss two senses in which Kant does allow for the practical judgment of agents. The first (...) is an interpretation of Kant’s view of practical judgment developed by Onora O’Neill and others. The second is an underappreciated dimension of practical judgment contained in Kant’s texts. It is to a defense and examination of the importance of the second sense of practical judgment that the majority of this paper is dedicated. (shrink)

Este texto oferece uma reflexão nascida de uma experiência com literatura, poesia e também filosofia na escola, com turmas do ensino fundamental nos anos iniciais. A experiência foi iniciada em 2011 e deu origem a um projeto de pesquisa, ensino e extensão, hoje em curso em escolas públicas. O projeto tem como fundamentação teórico-metodológica pensamentos críticos à escola voltada para a formação compreendida como utilitarista. Concepção esta que segue dominante, a despeito das inúmeras mudanças na base curricular, ao longo do (...) tempo. Não parece razoável que a preocupação que promove as mudanças na organização curricular tome por base aspectos como o baixo rendimento na aprendizagem refletido em reprovações e “fracassos” ou no próprio abandono e evasão precoce da escola, sem que se questione as razões inerentes à experiência escolar. Diante desse fato, a reflexão aponta para a defesa de uma escola que possa ser compreendida como desinteressada na perspectiva de Gramsci e recorre à literatura e poesia como dispositivos para impulsionar o fazer pedagógico transformador. O estudo da literatura sobre poesia, assim como os resultados obtidos pela experiência em questão, permitem pensar uma concepção de escola revolucionária no sentido gramsciano e libertadora como propugnava Paulo Freire. Nesse sentido, propõe conexões com a felicidade, que conjuga o propósito da escola desinteressada com a filosofia de Epicuro. Na pesquisa, a poesia é compreendida como um caminho para se contemplar a valorização do lúdico, que é um aspecto dos mais relevantes para a aprendizagem nas infâncias. (shrink)

For years, the phenomenon of experimental reactivity (defined as the alteration of the subject’s behaviour as a result of their awareness of being studied) seemed to be of little or no concern to experimental economists. With their clear-cut methodological stance shaped by Vernon Smith’s list of precepts, economists could avoid the worries associated with subjects’ reactivity through a rigorous control over the incentives proposed by the experimental setting as designed in the game. More recently, as experimental economists gradually moved in (...) their study towards topics in which economic incentives intermingled with normative considerations (such as in the study of altruism, punishment, or social norms), a corresponding interest in the problem of reactivity has ensued. This chapter offers an interpretation of this transit: it argues that the success of experimental economics and the unforeseen expansion of their object of enquiry into the realm of ethics and norm-related behaviour forces experimental economists to adopt some of the conceptual tools of psychologists. This ultimately undermined the economists’ initial methodological project, but this is the price to be paid to study the mechanisms of prosociality. This way, and regarding the pitfalls of reactivity, experimental economists are in the same predicament as fellow psychologists, philosophers, and other social scientists. (shrink)
