This brief tour of American law has demonstrated a little of the breadth and currency of legal liability actions which affect nursing. As health care changes and nursing roles change with it, so too will the nature of liability in this area. The American penchant for litigation is such that the chances of disentangling nurses from the continued onslaught of negligence litigation seem remote.

As an illustration of what Phillips called the "heterogeneity of sense," this essay concentrates on differences in what is meant by a "reason for belief." Sometimes saying that a belief is reasonable simply commends the belief's unquestioned acceptance as a part of what we understand as a sensible outlook. Here the standard picture of justifying truth claims on evidential grounds breaks down; and it also breaks down in cases of fundamental moral and religious disagreement, where the basic beliefs that we (...) hold affect our conception of what counts as a reliable ground of judgment. Phillips accepts the resultant variations in our conceptions of rational judgment as a part of logic, just as Wittgenstein did. All objective means of determining the truth or falsity of an assertion presume some underlying conceptual agreement about what counts as good judgment. This means that the possibility of objective justification is limited. But no pernicious relativism results from this view, for as Wittgenstein said, "After reason comes persuasion." There is, moreover, a non-objective criterion of sorts in the moral and religious requirement that one be able to live with one's commitments. In such cases, good judgment is still possible, but it differs markedly from the standard model of making rational inferences. (shrink)

Greek philosophy's difficulty even entertaining such an idea then appears as a sort of myopia, which we in our superior enlightenment have escaped. I (...) propose to examine the way in which one Greek mind, that of Hotinus, came to entertain rthe idea. There may be no better wiay to bring out the difficulties, as well as the possibilities, inherent in a concept than to observe a first class philosophical mind wrestling with it. I also hope rto show that we have a lot to learn from Plotinus. Greek difficulties are understandable (ailthough it is hal'd not to be patronizing about them), but once we have taken note of these difficulties the only question of interest would seem to be whether Plotinus learned to discount them and to talk as we do. In my view, the only way to appreciate Plotinus's aichievement, and to learn from him, is to take these difficulties with great seriousness and to stmggle through them with Plotinus. Another point most commentators overlook is something I take to be both a frucit and a clue to much of what Plotinus says about the Infinite Source of the universe. This is that, in explaining why the One should be called " infinite," Plotinu!! is presenting his e:xiegesis of a perplexing passage in Plato's Parmenides.2 Rather than following his own 1ine of thought to the conc1usion that the One must be infinite, we see Plotinus casting about for some meaning he can assign to a term he is confronted with. I happen to think that his exegesis of Plato is mistaken. This raises the interesting possibility that Plotinus 's breakthrough, if it is a breakthrough and not an aberration, resulted by accident from a mis.take. Before examining Greek views on the infinite, I should like to play Socrates for a moment and examine the concept itself of " infinite perfection." A bit of dialectic might help dispel some of the complacency that surrounds it. As it stands, "infinitely perfect" is at least verbally self-contradictory, as if one were to say " endlessly finished." This may explain why even Plotinus never put it quite thaJt way. But even if we can get around that, what could it mean for something to be 2 :M:ost commentators simply ignore the point, but Professor Armstrong, who is usually so alert to sources, makes the surprising statement that "there is no clear evidence that Plato ever thought or spoke of the One or Good as in any sense apeiron" ("Doctrine of the Infinite," p. 48). Professor Rist goes further and claims that "the 'beyond Being' of Plato must mean a finite Being in some way beyond other finite beings" (Road to Reality, p. 24). Chromosomes that harbor dominant sex determination loci are predicted to erode over time—losing genes, accumulating transposable elements, degenerating into a functional wasteland and ultimately becoming extinct. The Drosophila melanogaster Y chromosome is fairly far along this path to oblivion. The few genes on largely heterochromatic Y chromosome are required for spermatocyte‐specific functions, but have no role in other tissues. Surprisingly, a recent paper shows that divergent Y chromosomes can substantially influence gene expression throughout the D. melanogaster genome.1 These results show (...) that variation on Y has an important influence on the deployment of the genome. Kierkegaard occasionally mentions a type of belief which he calls an “existence communication,” and his discussion of such beliefs parallels his discussion of subjective truths (in the Concluding Unscientific Postscript). Existence communications include religious beliefs. I suggest that it is less misleading to focus on this term than it is to wrestle with the difficult and overworked notion of subjective truths; ultimately, his view of religious beliefs can be seen more clearly.His view does not fully emerge, however, without the assistance (...) of some other concepts. My thesis is that existence communications are comparable in their resistance to objective forms of adjudication to first principles, and comparable in their “self-involving” characteristics to teleological principles about the “raison d’etre of existence.This account not only helps to clarify Kierkegaard’s discussion, but it also offers two important hints about modern problems regarding religious belief. It suggest that religious claims may indeed be truth claims, and it suggests that there is more to the justification than comes out in a consideration of evidence. (shrink)

During the coronavirus disease 2019 (COVID‐19) pandemic, bioethical analyses often emphasized population health and societal benefit. Hospital policies frequently focused on reducing risk of transmitting SARS‐CoV‐2 by restricting visitors; requiring protective equipment; and screening staff, patients and visitors. While restrictions can be burdensome, they are often justified as essential measures to protect the whole population against a virus with high rates of transmission, morbidity and mortality. Yet communities are not monolithic, and the impacts of these restrictions affect different groups differently. (...) An ophthalmological unit outreach program in Ethiopia serves to illustrate. Pre‐operative screening policies were designed to protect as many patients as possible but had adverse impacts on underserved communities. As this case study demonstrates, creating hospital policies that truly serve the good of the society may require a more holistic review of impacts on inequitably positioned communities. (shrink)

General knowledge of the role of vitamin D3 in human physiology has been shaped by its discovery as a preventive agent of nutritional rickets, a defect in bone development due to inadequate uptake of dietary calcium. Studies on the function of the hormonal form of vitamin D3, 1α,25‐dihydroxyvitamin D3, have been greatly accelerated by the molecular cloning and structural analysis of the vitamin D3 receptor, which is a ligand‐activated regulator of gene transcription. Molecular genetic techniques including genomics have helped reveal (...) that 1α,25‐dihydroxyvitamin D3 can control more than calcium homeostasis. It has widespread effects on cellular differentiation and proliferation, and can modulate immune responsiveness, and central nervous system function. Moreover, accumulating epidemiological and molecular evidence suggests that 1α,25‐dihydroxyvitamin D3 acts as a chemopreventive agent against several malignancies including cancers of the prostate and colon.
