Democracy is one of the most used and misinterpreted terms of our time. In public discussions concerning the subject it is tacitly assumed that everyone is aware of the meaning of democracy and the implications it carries. In reality democratic ideals and practices take on various forms in various countries. Frank Hendriks sheds light on this subject matter in a comprehensible manner. He distinguishes four ground forms of democracy, which are inherent to democratic forms everywhere. Along with “consensus (...) democracy”, Hendriks compares “pendulum democracy”, “voter democracy” and “participatory democracy”, at national as well as subnational levels of governance. Hendriks concludes in his studies that contrary to popular belief, not one model is superior to the others and calls for a realistic approach to a democracy that is sensitive to the context in which democracy must prove and sustain itself. Vital Democracy outlines an innovative new theory of democracy in action.

Against the background of the current European competitive media landscape, the media are more and more compelled to legitimize their activities in their own national context as well as at a European level. Meanwhile, the nature of the media diversity in The Netherlands has changed tremendously; from a society divided along political and religious lines, it has evolved towards a multi-ethnic society. Hence, both the conceptualizing and operationalizing of media diversity from an academic as well as a media practical perspective (...) prove to be hot topics. An expert meeting was held at the Department of Communication at Radboud University Nijmegen in December 2004 in which the contours of media diversity in general and in The Netherlands in particular were explored. Institutional performance as well as program-related aspects linked to the notion of media diversity were discussed. Media diversity was explored from the angle of media economics as well as from the perspective of the program/format level. In addition, the audience reception perspective as well as methodologically problematic aspects one encounters when measuring media diversity were assessed. What follows here is a selection of several most pertinent views on this complex topic. We welcome each critical insight from other geographical contexts which might stimulate the debate on measures of open and reflective diversity in the media. (shrink)

Is Plato’s philosophy still relevant for current issues in politics and political science? In order to answer this question, the contributions to this volume endeavour to re-read the Platonic dialogues and to interpret them in terms of textual hermeneutics on the one hand. On the other hand, they refer to Plato from a systematic point of view and apply his philosophy, in particular the method of Socratic dialogue, to discussions on contemporary political issues. Before his tragically early death in 1930 at the age of twenty-six, he had done seminal work in mathematics and economics as well as in logic and philosophy. Translational research is a buzzword which dominates discussions about the quality, the utilization, and the benefits of medical research. Yet, although translational research has become a prominent topic, no commonly agreed definition of this terminology exists. Instead, experts from different contexts such as biomedical research, clinical practice or nursing discuss translational research in multiple ways depending on how they define the problem that translational research is supposed to be the solution to. In this paper, we do not seek to find (...) a ‘correct’ definition of translational research, but instead ask how actors using this terminology for describing their own research make sense of it. To do so, we asked three questions: Which actors are engaged in the debate about translational research? What kind of different meanings of translational research exist? And, which actors refer to which meaning of translational research when using the term? In answering these questions, we highlight the role this terminology plays in defining what medical science is about today. (shrink)

This paper analyzes and evaluates the 2007 majority opinion of the German National Ethics Council which seeks to establish new information (as to the inferior quality of legally procurable human embryonic stem cells) as a sufficient reason for a relaxation of the 2002 Stem Cell Law. A micro-level analysis of the opinion’s central section is conducted and evaluated vis à vis the strongest known opponent position in the national debate at that time. The argumentation is claimed to rely on an (...) unsupported semantic assumption regarding the parthood relation of the 2002 compromise and to misconstrue the strongest known opponent position. I present a “reduced” version of the fifteen Pragma-dialectical rules and inquire into their theoretical status as necessary conditions for a critical discussion. Questions: In what respect is PD’s non-sufficiency a deficiency, can and must it be remedied? Brief answers: with respect to defining the concept ‘critical discussion,’ possibly, yes, if, and only if, one seeks to identify the concept ‘critical discussion’; no, if PD is for fallacy-detection.

Time travel has been a staple of science fiction. With the advent of general relativity it has been entertained by serious physicists. But, especially in the philosophy literature, there have been arguments that time travel is inherently paradoxical. The most famous paradox is the grandfather paradox: you travel back in time and kill your grandfather, thereby preventing your own existence. To avoid inconsistency some circumstance will have to occur which makes you fail in this attempt to kill your grandfather. Doesn't (...) this require some implausible constraint on otherwise unrelated circumstances? We examine such worries in the context of modern physics. (shrink)

Gerhard Schurz [2001, Journal for General Philosophy of Science, 32, 65-107] has proposed to reconstruct auxiliary hypothesis addition, e.g., postulation of Neptune to immunize Newtonian mechanics, with concepts from non-monotonous inference to avoid the retention of false predictions that are among the consequence-set of the deductive model. However, the non-monotonous reconstruction retains the observational premise that is indeed rejected in the deductive model. Hence, his proposal fails to do justice to Lakatos' core-belt model, therefore fails to meet what Schurz coined (...) "Lakatos' challenge". It is argued that Lakatos's distinction between core and belt of a research program is not mapable onto premise-set and consequence-set and that Schurz's understanding of a ceteris paribus clause as a transfinite list of interfering factors is problematic. I propose a simple reading of Lakatos's use of the term ceteris paribus clause and motivate why the term hypothesis addition, despite not being interpretable literally, came to be entrenched. A proposal by Ferguson [2003, Argumentation 17, 335–346] for a fully monotonic argument form allowing for the expression of defeasible generalizations is critically examined and rejected as a general solution. It is argued that (i) his proposal reaches less than the default-logician’s solution allows, e.g., the monotonously derived conclusion is one-sided and itself not defeasible. (ii) when applied to a suitable example, his proposal derives the wrong conclusion. Unsuccessful remedies are discussed.

This paper discusses an example of social policy argumentation from an opinion of the 2007 majority among the German National Ethics Council. It is employed to problematize argument reconstruction with respect to the Informal Logic quality criteria relevance, sufficiency, acceptability. The main thesis is conditional and rather weak: If the RSA criteria are sub-stitutes for the notion of soundness, then—next to premise-truth and validity—they also substitute recon-structive charity.

In Brennan and Democracy, a leading thinker in U.S. constitutional law offers some powerful reflections on the idea of "constitutional democracy," a concept in which many have seen the makings of paradox. Here Frank Michelman explores the apparently conflicting commitments of a democratic governmental system where key aspects of such important social issues as affirmative action, campaign finance reform, and abortion rights are settled not by a legislative vote but by the decisions of unelected judges. Can we--or should we--embrace (...) the values of democracy together with constitutionalism, judicial supervision, and the rule of law? To answer this question, Michelman calls into service the judicial career of Supreme Court Justice William Brennan, the country's model "activist" judge for the past forty years. Michelman draws on Brennan's record and writings to suggest how the Justice himself might have understood the judiciary's role in the simultaneous promotion of both democratic and constitutional government.The first chapter prompts us to reflect on how tough and delicate an act it is for the members of a society to attempt living together as a people devoted to self-government. The second chapter seeks to renew our appreciation for democratic liberal political ideals, and includes an extensive treatment of Brennan's judicial opinions, which places them in relation to opposing communitarian and libertarian positions. Michelman also draws on the views of two other prominent constitutional theorists, Robert Post and Ronald Dworkin, to build a provocative discussion of whether democracy is best conceived as a "procedural" or a "substantive" ideal. The ‘Principal Principle’ states, roughly, that one's subjective probability for a proposition should conform to one's beliefs about that proposition's objective chance of coming true. David Lewis has argued (i) that this principle provides the defining role for chance; (ii) that it conflicts with his reductionist thesis of Humean supervenience, and so must be replaced by an amended version that avoids the conflict; hence (iii) that nothing perfectly deserves the name ‘chance’, although something can come close enough by playing the (...) role picked out by the amended principle. We show that in fact there must be ‘chances’ that perfectly play what Lewis takes to be the defining role. But this is not the happy conclusion it might seem, since these ‘chances’ behave too strangely to deserve the name. Richard Feynman has claimed that anti-particles are nothing but particles `propagating backwards in time'; that time reversing a particle state always turns it into the corresponding anti-particle state. According to standard quantum field theory textbooks this is not so: time reversal does not turn particles into anti-particles. Feynman's view is interesting because, in particular, it suggests a nonstandard, and possibly illuminating, interpretation of the CPT theorem. In this paper, we explore a classical analog of Feynman's view, in the context of (...) the recent debate between David Albert and David Malament over time reversal in classical electromagnetism. For the past seventy years, a host of scientific and public health bodies in the United States have strongly endorsed the practice of adding fluoride compounds to public water supplies as a prophylactic against dental caries. Throughout that period, a constant undercurrent of skepticism and outright opposition has slowed the adoption of the practice in the United States and limited its spread to just a handful of countries around the world. One of the attractions of water fluoridation is its affordability: (...) the fluoride compounds are sourced from the phosphate and aluminum industries, for whom they would otherwise constitute an annoying toxic waste disposal problem. Despite this, proponents have nonetheless succeeded in shaping a narrative that casts fluoridation as “natural” or at least mimicking nature. I demonstrate how fluoridationists were able to persuasively argue that adding a pollutant to the water supply was safe and natural. In the process, I examine how environmental historians and historians of science approach topics such as fluoridation. I suggest that as a result of the influence of science and technology studies and an ontological turn toward hybridity, the two subdisciplines are becoming increasingly convergent. (shrink)

This work contrasts conservative or minimally mutilating revisions of empirical theories as they are identified in the presently dominant AGM model of formal belief revision and the structuralist program for the reconstruction of empirical theories. The aim is to make understandable why both approaches only partly succeed in substantially informing and formally restraining the issue. With respect to the rationality of minimal change, the overall result is negative. Readers with an interest in formal epistemology are provided with application cases, the (...) historically inclined reader is offered a systematic perspective. Recent philosophical discussion about the relation between fiction and reality pays little attention to our moral involvement with literature. Frank Palmer's purpose is to investigate how our appreciation of literary works calls upon and develops our capacity for moral understanding. He explores a wide range of philosophical questions about the relation of art to morality, and challenges theories that he regards as incompatible with a humane view of literary art. Palmer considers, in particular, the extent to which the values (...) and moral concepts involved in our understanding of human beings can be said to enter into our understanding of, and response to, fictional characters. With the advent of synthetic biology, scientists are increasingly relying on digital sequence information, instead of physical genetic resources. This article examines the potential impact of this shift on the access and benefit-sharing (ABS) regime of the Convention on Biological Diversity (CBD) and the Nagoya Protocol. These treaties require benefit-sharing with the owners of genetic resources. However, whether “genetic resources” include digital sequence information is unsettled. The CBD conceives genetic resources as genetic material containing functional units of heredity. “Material” implies (...) tangibility, and for some scholars, “functional units of heredity,” undefined in both treaties, mean full-coding sequences. This article argues that digital sequence information obtained from physical genetic resources, full-coding or not, should be treated as genetic resources. Literal construction of the CBD risks eroding its usefulness and the ABS regime. This is because through bioinformatics, sequence information can easily be obtained from genetic resources for utilization, without physically moving them or concluding ABS agreement with owners. The CBD must evolve with scientific progress also because sequence functionality depends on the state of knowledge. These arguments are vindicated by domestic ABS laws equating genetic information with genetic resources; Nagoya Protocol provisions deeming research exploiting the genetic composition of genetic resources as utilization of genetic resources; and CBD provisions requiring the sharing of benefits from the utilization of genetic resources. Moreover, treaty interpretation and case law demand that generic, scientific terms, such as “genetic resources” and “functional units of heredity” be interpreted in an evolutionary manner to capture scientific developments.
