Despite what one may be led to believe by breathless reports in the media, the acme of misery in America is not the woes, financial and otherwise, of Donald Trump and Michael Jackson. People lose their jobs, have their assets drained by reversals of fortune, suffer from illiteracy, malnutrition, lack of shelter, and other mishaps. The circumstances in which they find themselves are genuinely distressing. It would be an odd understanding indeed that failed to find these circumstances directly relevant to (...) what morality asks of us. If morality is to count for anything, then surely it must take notice of exigent need. This is not merely the deliverance of a late twentieth-century Western moral consciousness massaged by the blessings of comparative affluence and graced with a newfound awareness of social justice. All traditional ethical codes of which I am aware, sacred and secular, demand that one take the distress of one's neighbor as bearing on one's own activities. “Am I my brother's keeper?” is the question; the well-nigh universal answer is “ Yes .” The disposition to be moved by and respond to distress is the virtue of charity. When we spoke a few weeks ago, you expressed some uneasiness with the notion of public art, and I wonder if you could expand on that a bit.Kruger: Well, you yourself lodged it as the “problem” of public art and I don’t really find it problematic inasmuch as I really don’t give it very much thought. I think on a broader level I could say that my “problem” is (...) with categorization and naming: how does one constitute art and how does one constitute a public? Sometimes I think that if architecture is a slab of meat, then so-called public art is a piece of garnish laying next to it. It has a kind of decorative function. Now I’m not saying that it always has to be that way—at all—and I think perhaps that many of my colleagues are working to change that now. Liberal democracies encourage citizen participation and protect our freedoms, yet these regimes elect politicians and decide important issues with electoral and legislative systems that are less inclusive than other arrangements. Some citizens inevitably have more influence than others. Is this a problem? Yes, because similarly just but more inclusive systems are possible. Political theorists and philosophers should be arguing for particular institutional forms, with particular geographies, consistent with justice. -/- Les démocraties libérales encouragent la participation citoyenne et protègent nos libertés. In this article, I defend Kant and argue for the continuing relevance of his regulative assumption of historical progress. I suggest, furthermore, that the first-person stance of practical belief exemplified in Kant's conception of hope offers new resources for thinking about the relationship between the ideal and the real in political theory.

An examination of the development of the theory of evolution from the Renaissance to the twentieth century.

This essay analyzes the coherency and reasonableness of legal restrictions against same-sex marriage. The population of focus is transgender individuals and their partners. Focusing on trans-marriage makes clear that the restriction of marriage to one man and one woman is misguided in that the law rests on the assumption that the categories of sex and gender comprise two disjoint, exhaustive, and unambiguous groupings. The primary argument here is not that the restrictions of same-sex marriage are harmful to certain transpersons who (...) participate in legal marriage, although they certainly are, but rather that this legal restriction fails to meet the minimum requirements of any reasonable law. This analysis compares the current marriage restriction and its reliance on the above mentioned false belief with judgments of the Race Classification Appeal Board of Apartheid era South Africa. I employ two actual cases and the legal philosophy of Lon L. Fuller in my argument. (shrink)

Scholars often assume that Old Comedies based on mythological stories differed from other Old Comedies primarily by their mythological plot material, and that therefore they shared the structural features of the surviving plays of Aristophanes. I show that the evidence may instead indicate that these Old Comedies did not as a rule have a parabasis or an agon. The structure of mythological Old Comedy could then have resembled the satyr play more closely than Aristophanic Old Comedy, meaning genre did not (...) necessarily determine form. (shrink)

The financial Crunch of 2008 was easily explained by both the left and right–too easily. Each insisted that events thoroughly confirmed its own long-held views and utterly refuted those of the opposed camp. This essay argues that there are indeed new lessons to be drawn from the Crunch, lessons that involve balancing the bounty of the Invisible Hand against perils of the Prisoner's Dilemma. Liberal moral imperatives are traced to variables of Personal Choice and External Cost that are typically in (...) tension with each other and thus generate needs for institutional reconstructions that change according to time and circumstance. Personal bankruptcy protection, limited liability corporations, and intellectual property are cited as examples. It is argued that the Crunch occurred because of failure adequately to balance these variables. Three paradoxes came to a head in 2008: Paradox of Efficient Markets; Paradox of Reduced Risk; Paradox of Hard-won Knowledge. The essay concludes with suggestions concerning specific lessons to be drawn from the Crunch and a corresponding list of lessons not to be drawn. (shrink)

POTTER'S PAPER CONSIDERS self-injury in women diagnosed with borderline person ality disorder (BPD) to be a form of body modification where the body is used to communicate meaning. She touches on symbolism as a possible explanatory theory for this sort (...) of self-injury. She also refers to the culture of body commodification as underlying self-injury. She then argues that clinicians have a duty to give uptake to the patient's own interpretations about the meaning of the self-injury. Giving uptake is a virtuous approach for ethical interactions with people diagnosed with BPD who self-injure, and it aims to preserve the communicator's integrity, along with other benefits. Potter offers five maxims for giving uptake properly. However, I shall argue that giving uptake can be very difficult for clinicians, and that an appreciation of this difficulty depends on an expansion and linkage of some of the theories that she touched on. Self-injury is revisited experimentally as a double-edged sword of symbolic sacrifice and iconic-symbolic self-assertion. This revisiting aims to illustrate how clinicians might be caught in a double bind, where giving uptake properly might be very difficult if not more or less doomed to fail.Potter's paper starts by situating self-injury in a broader discourse of body modifications. In this discourse the body is being used as a text, a tool to communicate meaning. The meaning that is communicated might be difficult or impossible to articulate otherwise (by using words, for example). The meaning of the communication is embedded in a context of social, cultural, religious, political, and other norms. Potter explores possible interpretations of the meaning of self-injury in women with BPD, including an interpretation of self-injury as symbolic sacrifice. She suggests that a cultural understanding/nonunderstanding of the meaning of a particular instance of self-injury is an important determinant of whether such self-injury is considered pathological/nonpathological. She then shifts the focus to the present-day culture in which women's bodies are commodified and objectified, and where women become alienated from their bodies. A small puzzle: the terms ‘capitalism’ and ‘socialism’ initially present themselves as contraries, the one affirming what the other rejects. However, once removed from the dictionary, they function otherwise. The theory of capitalism is very much contained within the science of economics. The positive theory of capitalistic institutions, but also its normative superstructure, rest most easily within the language and methodology of the economist. What distinguishes the free market? It is efficient ; allocation of factors of production are optimized ; (...) individuals maximize their utility ; and so on. In response to this need the Journal of Business Ethics is introducing a new case section. This section provides a forum for publishing and accessing a range of materials that can be used in teaching business ethics. This paper is a project of ramified natural theology that attempts to demonstrate that Christian theism is in a much better philosophical position than LDS theism with regards to the logical and probabilistic problem of evil. Contract is the dominant model for political philosophy's understanding of government grounded on the consent of the governed. However, there are at least five disabilities attached to classical social contract theory: the grounding contract never actually occurred; its provisions are vague and contestable; the stringency of the obligation thereby established is dubious; trans-generational consent is questionable; interpretive methods for giving effect to the contract are ill-specified. By contrast, the biblical story of the covenant Israel embraces at Sinai is shown to (...) be more adequately attentive to each of these five desiderata. The essay then focuses on the U.S. Constitution, arguing that in many ways it is more reflective of covenantal legitimating themes than those of social contract. The result is a promisingly different mode of understanding government by the consent of the governed. (shrink)

To date, the value of corporate social responsibility (CSR) activities has primarily been measured through the company’s reputation, with little attention given to exploring whether there are internal influences between CSR and other management practices. We argue that the efficacy of CSR extends beyond a company’s reputation for managing social and environmental concerns; in particular, it can influence other business practices such as risk management. Our results suggest that (a) overall, firms with better CSR performance are more likely to adopt (...) integrated risk management practices and (b) CSR activities that target both primary stakeholders and secondary stakeholders are equally important in facilitating the adoption of such risk management practices. Theoretically, we contribute to the CSR literature by providing a possible mechanism for risk reduction and insurance-like effects of CSR. Practically, we provide managerial implications demonstrating that the efficacy of CSR should not be viewed in isolation of other business practices. (shrink)

This essay is concerned with the means by which individuals, especially in the context of group based harm, reconcile the gross inconsistency inherent in upholding moral standards within one's own group while at the same time rationalizing why such moral standards do not apply to certain others. The term moral taint is employed to describe the undesirable condition of one's character that can result from certain group affiliations or memberships. On this view, the vehicle by which one's character becomes tainted (...) is the intemalization of certain narratives that serve to truncate the moral community and are used in attempts to justify group-based harm. I argue that individuals in some such circumstances need to re-describe both the story of their group and their own personal narrative to begin to take responsibility for group based devaluing practices. This book provides a conceptual analysis and application of the notions of backlash, scapegoating, dog whistling, and virtue signaling.

Following Rawls, many political liberals hold reasonableness in high regard. Reasonable citizens can disagree, however, and some may find their arguments routinely ignored in elections and legislatures. Should we be troubled by such failures of institutional responsiveness as a matter of justice? The author argues that the expectation of such failures would lead parties in an original position to favor certain classes of institutions over others: A Theory of Justice and Political Liberalism together suggest a particular federal structure to a (...) republic of reasons. In this article I defend John Dewey's use of the concept of "culture" in light of his anthropological sources and suggest that this cultural turn has much to teach contemporary scholars. Contrary to critics, I argue that Dewey's reconstructive aims are indeed well served by "culture" as a term for the complex set of symbolic and material resources shaping habit. Common misreadings of Dewey could be avoided by a better understanding of this anthropological appropriation; moreover, Dewey's emphasis on culture should (...) caution neuropragmatists against reductively scientistic models of human experience. I conclude, finally, with a call for democratic theorists today to engage with Dewey's later, anthropologically-informed writings. (shrink)

Eating meat appeals, but the cost is measured in millions of slaughtered animals. This has convinced many that vegetarianism is morally superior to a carnivorous diet. Increasingly, those who take pleasure in consuming animals find it a guilty pleasure. Are they correct? That depends on the magnitude of harm done to food animals but also on what sort of a good, if any, meat eating affords people. This essay aims to estimate both variables and concludes that standard arguments for moral (...) vegetarianism are significantly misplaced. That is because the contribution of meat eating to lives of excellence is underestimated and overall harms to animals consequent on practices of meat eating are overestimated. The answer to the question posed in the title is, therefore, "No.". (shrink)

In this essay Loren Lomasky wryly proposes that the views of Rawls and Nozick might not be as radically divergent as is conventionally supposed. To demonstrate this proposition, Lomasky invents “Twin Harvard” counterparts of Rawls and Nozick. The twist is that Twin Rawls turns out to be a leading libertarian theorist while Twin Nozick endorses a regime of sweeping redistribution. In each case the position follows from familiar elements in the theories of their respective, real-world counterparts. Lomasky concludes that (...) Twin Rawls actually makes better use of familiar Rawlsian themes-such as the veil of ignorance, strains of commitment, and the priority of liberty-than does Rawls himself. Moreover, Rawls's own attempts at combating libertarianism are seen to be weak, sometimes embarrassingly so. Libertarianism is a specter that he devoutly wishes to exorcize, but cannot. Conversely, the rejection of libertarianism by Twin Nozick (and Nozick?) is striking but shallow. The need to find clarity concerning (1) the relationship between scientific and religious cosmological discourses and (2) the imagining of a space where various religions could meet in fruitful conciliation as far as (1) is concerned, formed the basis of the article. The aim of the article was to investigate the relevance of Buddhaghosa’s Visuddhimagga (5th CE, Pali compendium of Theravāda Buddhism) with regard to the above problems. The methodology employed involved clarifying the historical context of the Visuddhimagga ; understanding (...) the subjective intentions of Buddhaghosa and extrapolating non-emphasised but promising underlying tendencies in his magnum opus, conducive to a perspective of ultimate, universal peace as far as Cosmos, all of humanity and its various religious discourses are concerned. The reading of the Visuddhimagga revealed a mythology of many deities, tolerated but demoted to a status lower than that of enlightened humans; the denial of a Creator God; no notion of an analogia entis between humans and a living Cosmos, nor any tendency towards pantheism and a commitment to the ideal of universal happiness for all beings. The main conclusion was that Theravāda Buddhism (and, to a lesser extent, Christian theology) could be extended towards the notion of a living, evolving Cosmos, appearing from and disappearing into non-substantial silence. It is not claimed that Buddhaghosa succeeded in achieving a great cosmology. It remains an unrealised possibility, latently possible as an extension of Theravāda. Contribution: The contribution of the article is that it uncovers deeply hidden lines in Buddhism (and Christianity) that are emerging and converging. ‘Theo-logy’, re-interpreted as mystical ‘cosmo-sophy’, would not amount to a cynical debunking or irresponsible annexation of Buddhaghosa for utterly unthinkable ends, but as a topic worthy of investigation. Alain Finkelkraut has interrogated contemporary Jewish identity in terms of how a Jew reckons with the heavy impact of the Holocaust and in fact with the entire history of the Jewish people. Finkelkraut takes issue with Sartre's 1947 essay, Anti-Semite and Jew, not for its content but the effect that it has had on him. "Let there be no misunderstanding: I am not attacking the book that Sartre wrote on the Jewish problem," asserts the author in a footnote (JI 17, (...) my translation). Instead, he shows how the philosopher aids in the creation of what Finkelkraut terms "the imaginary Jew." He compares this process of fossilization to Genet's treatment in Saint Genet. Finkelkraut's metaphoric language captures the pernicious effects that the public act of naming and thus essentializing can have on a person or group of people. (shrink)
